PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार् ुपररवतान मतं्रालर् अजधसचूना नई दिल्ली, 23 िनवरी, 2020 का.आ. 412(अ).—प्रारुप अजधसूचना भारत के रािपत्र, असाधारण में भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान, मंत्रालर् की अजधसूचना सं. का.आ. 5834(अ), तारीख 22 नवम्बर, 2018, द्वारा प्रकाजित की गई थी जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करने वाले रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थ;े और, उि प्रारूप अजधसूचना को अन्तर्वाष्ट करन ेवाले रािपत्र की प्रजतर्ां िनता को तारीख 26 नवम्बर, 2018, को उपलब्ध करा िी गई थी;
और, प्रारुप अजधसूचना के उत्तर में व्यजिर्ों और पणधाररर्ों से कोई भी आक्षेप और सुझाव प्राप्त नहीं हुए;
और, कोडाईकनाल वन्र्िीव अभर्ारण्र् 608.95 वगा दकलोमीटर के्षत्र में फैला हुआ ह ै और तजमलनाडु राज्र् के डडंडीगलु जिला के कोडाईकनाल और पलानी तालुकों और थेनी जिला के पेररर्ाकुलम तालुक में जस्ट्थत ह;ै और, कोडाईकनाल वन संभाग का गठन 19अप्रैल,1982 को िी.ओ.एमएस.सं.468 के अनुसार पूवा मिरुई उत्तर संभाग जिसका मुख्र्ालर् कोडाईकनाल में ह ैऔर िैसा दक िी.ओ.एम.एस. सं 261 तारीख 21 माचा, 1977 में आिेि दिर्ा गर्ा था, मिरुई और डडंडीगलू जिलों के अंतगात मिरुई रािस्ट्व जिला के जद्वभािन पर िी.ओ.एम.एस.सं 640 तारीख 22 अप्रैल, 1985 के अनुसार थेनी वन संभाग में स्ट्थानांतररत कर दिर्ा गर्ा। संभाग में समीपस्ट्थ और सघन खंड हैं और िो कोडाईकनाल तालुक में जस्ट्थत ह ैऔर डडंडीगलु जिला में पलानी तालकु का भाग ह ैऔर थेनी जिला में पेररर्ाकुलम तालुक का भाग ह।ै कोडाईकनाल वन संभाग में िी.ओ.सं. 143 पर्ाावरण और वन (एफ आर- 5) तारीख: 20 जसतम्बर, 2013 को कोडाईकनाल वन्र्िीव अभर्ारण्र् घोजित दकर्ा गर्ा;

उत्तर-पूवा में डडंडीगुल वन संभाग, िजक्षण-पूवा में मिरुई रािस्ट्व जिला और िजक्षण में थेनी वन संभाग के चारों ओर पूवा िेिांतर 77016’ और 770 45’ और उत्तर अक्षांि 100 20’और 1005’ के बीच में आत ेह;ै और, कोडाईकनाल वन्र्िीव अभर्ारण्र् जवजवध वनस्ट्पजत और िीविंतुओं के जलए महत्त्वपूणा और अद्भुत पर्ाावास ह ै जिसमें स्ट्तनधाररर्ों की लगभग 44 प्रिाजतर्ां के जलए पाररजस्ट्थजतकी सतत पर्ाावास प्रिान करता ह ै इसमें लुप्तप्रार् प्रिाजतर्ों िैसे बाघ, हाथी, नीलजगरी थार, आदि सजम्मजलत ह।ै र्ह पजक्षर्ों की 150 से अजधक प्रिाजतर्ों, सरीसृप की 40 प्रिाजतर्ों, उभर्चर की 8 प्रिाजतर्ां, जततजलर्ों की 202 प्रिाजतर्ों और पाररजस्ट्थजतकी तंत्र के बृहत जवजवध िैसे घासभूजम, तािा िल पाररजस्ट्थजतकी तंत्र, मािा पाररजस्ट्थजतकी ततं्र, िुष्क पणापाती वन, उष्णकरटबंधीर् सिाहररत वन और िोला वन का आश्रर् प्रिान करता ह।ै कोडाईकनाल वन्र्िीव अभर्ारण्र् के संरजक्षत के्षत्र के आसपास भौजतक और िैजवक जवजवधता को संरजक्षत करना आवश्र्क ह;ै और, अभर्ारण्र् में वनस्ट्पजत जवजवधता असाधारण ह।ै के्षत्र का बार्ोटा बेहि जवजवध ह ै जिसमें 2478 पुजष्पत पौधे की प्रिाजतर्ां के 201 पररवार ह ैजिसमें से 1758 स्ट्थानीर् प्रिाजतर्ां हैं। इस के्षत्र में 161 प्रिाजतर्ां प्राकृजतक ह;ै 344 खेती प्रिाजतर्ां और 215 बाग प्रिाजतर्ां हैं। पचाइ सवुक्कु (अकैजिर्ा िेकुरेनेस), सोक्काला (अगलाजनर्ा इलेबगनोइिेजर्र्ा, एजिर्ारटक पेन्नर्वोरट (कें टल्ला अजसअटीका), अर्बाअन िजस्ट्मने (िसजमनमु सम्बक) आदि वनस्ट्पजत के उिारण हैं;
और, अभर्ारण्र् में पजक्षर्ों, जततजलर्ों, कीडे-मकोडों, सरीसृपों, उभर्चरों और स्ट्तनधाररर्ों की जवजवधता ह।ै बाघ (पैंथेरा टाइगररस), इंजडर्न गौर (बोस गौरस), हाथी (एजलफस मैक्सीमूस), बनैला सूअर (सस स्ट्रोफा), समान्र् लंगरू (सेम्नोजपथेकुस) आदि स्ट्तनधारी के उिाहरण हैं। रेड-जवस्ट्केरेड बुलबुल (फर्कनोनोटुस िोकोउस), समान्र् ककंगदफिर (अल्केिो अट्टहीस), बेबरा स्ट्परोव-हवक हवक (जवरगटुस बेसरा) आदि पजक्षर्ााँ हैं। सामान्र् एजिर्न टोड (बुफो मेलानोस्ट्टीकटुस),इंजडर्न जस्ट्कप्पर मेढक (इर्फ्लर्रटस कर्नोफर्ेटीस) आदि उभर्चरों के उिाहरण ह;ै और, कोडाईकनाल वन्र्िीव अभर्ारण्र् में िलुाभ, लुप्तप्रार् और संकटापन्न प्रिाजतर्ों की 32 प्रिाजतर्ां और स्ट्थाजनक प्रिाजतर्ों की 49 प्रिाजतर्ां हैं। जिसमें पक्षी (29 प्रिाजतर्ां), जततली (12 प्रिाजतर्ां), उभर्चर (8 प्रिाजतर्ां) सजम्मजलत हैं। इस अभर्ारण्र् में स्ट्थाजनक वनस्ट्पजत प्रिाजतर्ां लुप्तप्रार् ह ैऔर स्ट्थाजनक िोला वन ह;ै और, कोडाईकनाल वन्र्िीव अभर्ारण्र् के चारों ओर के क्षेत्र को, जिसका जवस्ट्तार और सीमाएं पाररजस्ट्थजतकी पर्ाावरणीर् से पाररजस्ट्थजतकी संवेिी िोन के रूप में पैरा 1 में जवजनर्िाष्ट हैं, िैव जवजवजधता की िजृष्ट सुरजक्षत और संरजक्षत करना और उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों के वगों के प्रचालन और प्रसंस्ट्करण करन े को प्रजतजिद्ध करना आवश्र्क ह;ै अतः, अब, केन्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इस अजधसूचना में इसके पिात पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उपधारा )1 (और उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा )3( द्वारा प्रित्त िजिर्ों का प्रर्ोग करत ेहुए, तजमलनाडु राज्र् के डडंडीगुल और थेनी जिला में कोडाईकनाल वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर 0.0 (िून्र्) से 1.0 दकलोमीटर तक जवस्ट् ताररत क्षेत्र को पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके पश् चातप पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै, के रूप में अजधसूजचत करती ह,ै जिसके जववरण जनम्नानुसार ह,ै अथाातप :-
1. पाररजस्ट्थजतकी संविेी िोन का जवस्ट्तार और उसकी सीमाएं.-(1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार कोडाईकनाल वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर 0.0 (िून्र्) से 1.0 दकलोमीटर तक जवस्ट्तृत ह ैऔर पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल 106.78 वगा दकलोमीटर ह।ै (पाररजस्ट्थजतकी संवेिी िोन का िून्र् जवस्ट्तार केरल के साथ अंतर-राज्र्ीर् सीमा और नगरी के उपजस्ट्थजत के कारण ह।ै)
(2) कोडाईकनाल वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण उपाबधं-I के रूप में संलग्न ह।ै
(3) सीमा जववरण और अक्षांि और ििेांतर के साथ पाररजस्ट्थजतकी संवेिी िोन के कोडाईकनाल वन्र्िीव अभर्ारण्र् भाग II खण् ड (ii) भारत का रािपत्र : असाधारण 3 के मानजचत्र उपाबधं–IIक, उपाबधं–IIख, उपाबधं–IIग उपाबधं–IIघ, उपाबधं–II ङ और उपाबधं–II च के रूप में संलग्न ह।ै
(4) पाररजस्ट्थजतकी संवेिी िोन के िून्र् जवस्ट्तार के प्रमुख अवस्ट्थान और कोडाईकनाल वन्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू-जनिेिांको की सूची उपाबधं III की सारणी क, सारणी ख और सारणी ग में िी गई ह।ै
(5) मुख्र् डबंिओुं के भू-जनिेिांको के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगात आन ेवाल ेग्रामों की सूची उपाबधं IV के रूप में संलग्न ह।ै
2. पाररजस्ट्थजतकी संविेी िोन के जलए आचंजलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्र् के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसूचना में दिए गए अनुबंधों का पालन करते हुए आंचजलक महार्ोिना तैर्ार करेगी।
(2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत से िो इस अजधसूचना में जवजनर्िाष् ट दकए गए हैं के अनुसार तथा सुसंगत कें रीर् और राज् र् जवजधर्ों के अनुरुप और कें रीर् सरकार द्वारा िारी मागाजनिेिों, र्दि कोई हों, द्वारा तैर्ार होगी ।
(3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करने के जलए राज् र् सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार होगी.-
(i) पर्ाावरण;
(ii) वन और वन्र्िीव;
(iii) कृजि;
(iv) रािस्ट् व;
(v) नगर जवकास;
(vi) पर्ाटन;
(vii) ग्रामीण जवकास;
(viii) डसंचाई और बाढ़ जनर्ंत्रण;
(ix) नगरपाजलका;
(x) पंचार्ती राि;
(xi) लोक जन मााण जव भाग;
(xii) रािमागा;
(xiii) तजमलनाडु राज्र् प्रििूण जनर्तं्रण बोडा।
(4) आंचजलक महार्ोिना अनुमोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दरर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िाष् ट न हो और आचंजलक महार्ोिना सभी अवसंरचना और दरर्ाकलापों में, िो अजधक िक्षता और पाररजस्ट्थजतकी अनुकूल हों, का संवधान करेगी ।
(5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण से संबंजधत ऐसे अन्र् पहलुओं, जिन पर ध्र्ान िेना आवश्र्क ह,ै के जलए उपबंध होंगे ।
(6) आंचजलक महार्ोिना जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेिताओं के ब्र्ौरों से अनुसमर्थात मानजचत्र के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, कृजि क्षेत्रों, ऊपिाऊ भूजम, हररत क्षेत्र िैसे उद्यान और उसी प्रकार के स्ट् थान, उद्यान कृजि क्षेत्र, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभ्र्कंन करेगी। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करेगी और सारणी में सूचीबद्ध पैराग्राफ-4 में प्रजतजिद्ध और जवजनर्जमत दरर्ाकलापों का अनुपालन करेगी और स्ट् थानीर् समुिार्ों की िीजवका को सुरजक्षत करन ेके जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजित और उसकी अजभवृजद्ध भी करेगी।
(8) आंचजलक महार्ोिना प्रािेजिक जवकास र्ोिना की सह जवस्ट्तारी होगी ।
(9) इस प्रकार अनुमोदित आंचजलक महार्ोिना इस अजधसूचना के उपबंधों के अनुसार मानीटरी के अपने कार्ों को करने के जलए मानीटर सजमजत के जलए एक संिभा िस्ट्तावेि तैर्ार करेगी ।
(10) उि आंचजलक महार्ोिना स्ट्थानीर् सामुिाजर्क जवकास की सुरक्षा के जलए पर्ाावरण के अनुकूल जवकास सुजनजित करन ेके जलए पाररजस्ट्थजतकी-संवेिी िोन में जवकास को जवजनर्जमत करेगा।
3. राज्र् सरकार द्वारा दकए िान ेवाल ेउपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करन ेके जलए जनम्नजलजखत उपार् करेगी, अथाातप:-
(1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए जचजन्हत दकए गए पाकों और खुल े स्ट्थानों का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक संबद्ध जवकास दरर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नहीं होगा:
परंत ुर्ह दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भाग (क) में जवजनर्िाष्ट प्रर्ोिनों से जभन्न प्रर्ोिन के जलए कृजि और अन्र् भूजम का संपररवतान मानीटरी सजमजत की जसफाररि पर और र्था लागू और क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्रीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से, और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करन ेके जलए अनुज्ञात दकर्ा िाएगा, िैसे:-
(i) जवद्यमान सडकों को चौडा करना और उन्हें सुिढृ़ करना तथा नई सडकों का संजनमााण;
(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;
(iii) प्रििूण उत्पन्न न करने वाल ेलघ ुउद्योग;
(iv) कुटीर उद्योगों जिनके अतंगात ग्रामीण उद्योग भी हैं; सुजवधािनक भण्डार और स्ट्थानीर् सुजवधाएं सहार्क पाररजस्ट्थजतकी पर्ाटन जिसके अन्तगात ग्रह वास सजम्मजलत ह;ै और
(v) पैरा 4 के अधीन दिए गए संवर्धात दरर्ाकलाप:
परंत ुर्ह और दक प्रािेजिक नगर र्ोिना अजधजनर्म और राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन और संजवधान के अनुच्छेि 244 के उपबंधों र्ा तत्समर् प्रवृत्त जवजध के उपबंधों के अनुपालन के जबना, जिसके अन्तगात अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी ह,ै वाजणजज्र्क र्ा औद्योजगक जवकास दरर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनुज्ञात नहीं होगा:
परंत ुर्ह और भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भू-अजभलेखों में उपसंिात कोई गलती, मानीटरी सजमजत के जवचार प्राप्त करने के पिातप राज्र् सरकार द्वारा प्रत्र्ेक मामल ेमें एक बार ठीक होगी और उि गलती के सुधार की सूचना कें रीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को िी िाएगी:
परंत ुर्ह और भी दक गलती के संिोधन में इस उप पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा में भू- उपर्ोग का पररवतान सजम्मजलत नहीं होगा;
(ख) वनीकरण तथा वास िीणोद्धार दरर्ाकलापों सजहत अनप्रर्ुक् त र्ा अनुत् पािक कृजि क्षेत्रों में पुन: वनीकरण करने के प्रर्ास दकए िाएंगे।
(2) प्राकृजतक िल स्रोतों.- आचंजलक महार्ोिना में सभी प्राकृजतक िल स्रोतों/नदिर्ों के आवाह क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण के जलए र्ोिना सजम् मजलत होगी और राज् र् सरकार द्वारा ऐसे क्षेत्रों पर र्ा भाग II खण् ड (ii) भारत का रािपत्र : असाधारण 5 उनके जनकट जवकास दरर्ाकलाप प्रजतजिद्ध करने के बारे में िो ऐसे क्षेत्रों के जलए अजहतकर हो ऐसी रीजत से मागाििाक जसद्धांत तैर्ार दकए िाएंगे ।
(3) पर्ाटन र्ा पाररजस्ट्थजतकी पर्ाटन.- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दरर्ाकलाप र्ा जवद्यमान पर्ाटन दरर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी संवेिी िोन के जलए होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् पर्ाटन जवभाग द्वारा राज्र् पर्ाावरण और वन जवभाग के परामिा से तैर्ार होगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना के एक घटक के रूप में होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िाएगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दरर्ाकलाप जनम्नानुसार जवजनर्जमत होंगे:-
(i) संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट ह,ै नर्े वाजणजज्र्क होटल और ररिॉटा के सजन्नमााण अनजु्ञात नहीं होंग:े परंत,ु र्ह दक संरजक्षत के्षत्र की सीमा से एक दकलोमीटर की िरूी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक होटलों और ररिॉटा का स्ट्थापना केवल पूवा पररभाजित और नामजनर्िाष्ट क्षेत्रों में पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए ही अनुज्ञात होगा;
(ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर नए पर्ाटन दरर्ाकलापों र्ा जवद्यमान पर्ाटन दरर्ाकलापों का जवस्ट्तार कें रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् के मागाििाक जसद्धांतों के द्वारा तथा राष् रीर् ा र्ाघ्र संरक्षण प्राजधकरण, द्वारा िारी पाररजस्ट्थजतकी–पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेत े हुए (समर्-समर् पर र्था संिोजधत) िारी मागाििाक जसद्धांतों के अनुसार होगा;
(iii) आंचजलक महार्ोिना का अनुमोिन दकए िाने तक, पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन दरर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्िाष्ट संवीक्षा और मानीटरी सजमजत की जसफाररि पर आधाररत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नर् ेहोटल र्ा ररसोटा र्ा वाजणजज्र्क स्ट्थापना का संजनमााण अनजु्ञात नहीं दकर्ा िार्ेगा ।
(4) नसैर्गाक जवरासत.- पाररजस्ट्थजतकी संवेिी िोन में महत्वपूणा नैसर्गाक जवरासत के सभी स्ट्थलों िैसे िीन कोि आरजक्षत के्षत्र, िैल जवरचनाएं, िल प्रपातों, झरनों, घाटी मागों, उपवनों, गुफाए,ं स्ट्थलों, भ्रमण, अश्वरोहण, प्रपातों आदि की पहचान की िाएगी और जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रुप में परररक्षण और संरक्षण के जलए तैर्ार की िाएगी ।
(5) मानव जनर्मात जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, जिल्प-तथ्र्, ऐजतहाजसक, स्ट्थापत्र्, सौंिर्ापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और उपक्षेत्रों पहचान और उनके संरक्षण के जलए जवरासत र्ोिना आंचजलक महार्ोिना के भाग के रुप में तैर्ार की िाएगी।
(6) ध् वजन प्रििूण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रििूण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 में जनर्त उपबंधों के अनुसार में पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रििूण के जनर्ंत्रण और जनवारण का अनपुालन दकर्ा िाएगा।
(7) वार् ुप्रििूण.- पाररजस्ट्थजतकी संवेिी िोन में, वार्ु प्रििूण के जनवारण और जनर्ंत्रण का वार्ु (प्रििूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार अनुपालन दकर्ा िाएगा।
(8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सारण, साधारणों मानकों के उपबंधों के अनुसार पर्ाावरणीर् अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आन ेवाले पर्ाावरणीर् प्रििूण के जनस्ट्सारण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक कठोर हो, के उपबंधों के अनुसार होगा। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1357(अ), तारीख 8 अप्रैल, 2016 के द्वारा प्रकाजित ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों )ईएसएम ( का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।
(10) िैव जचदकत्सा अपजिष् ट.- िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016 के द्वारा प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा । (ख) पाररजस्ट्थजतकी संविी िोन में मान्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण-अनकूुल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।
(11) प्लाजस्ट्टक अपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
(12) जनमााण और जवध्वसं अपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सां.का.जन 317(अ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा ।
(13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत द्वारा प्रकाजित ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
(14) र्ानीर् र्ातार्ात.- र्ातार्ात की र्ानीर् गजतजवजधर्ां आवास के अनुकूल जवजनर्जमत होंगी और इस संबंध में आंचजलक महार्ोिना में जविेि उपबंध सजम्मजलत दकए िाएंग ेऔर आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित होने तक, मानीटरी सजमजत सुसंगत अजधजनर्मों और उसके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार र्ानीर् दरर्ाकलापों के अनुपालन को मानीटर करेगी ।
(15) र्ानीर् प्रििूण.- लागू जवजधर्ों के अनुपालन में वाहन प्रििूण का जनवारण और जनर्ंत्रण दकर्ा िाएगा और स्ट्वच्छक ईंधन उिाहरण के जलए सीएनिी, एलपीिी, आदि के उपर्ोग के जलए प्रर्ास दकए िाएंगे।
(16) औद्योजगक ईकाइर्ा.ं- (i) रािपत्र में इस अजधसूचना के प्रकािन पर र्ा उसके पिात पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिजूित उद्योगों की स्ट्थापना की अनुमजत नहीं िी िाएगी।
(ii) केन्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो; पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर- प्रििूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रििूणकारी उद्योगों को बढ़ावा दिर्ा िाएगा।
(17) पहाडी ढलानों को सरंक्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार होगा:- (क) आंचजलक महार्ोिना पहाडी ढलानों पर क्षेत्रों का संकेत होगा िहां दकसी भी संजनमााण की अनुमजत नहीं िी िाएगी;

4. पाररजस्ट्थजतकी सवंिेी िोन में प्रजतजिद्ध और जवजनर्जमत दकए िान ेवाल ेदरर्ाकलापों की सचूी.- पाररजस्ट्थजतकी संवेिी िोन में सभी दरर्ाकलाप पर्ाावरण अजधजनर्म के उपबंधों और उसके अधीन बनाए गए जनर्मों जिसके अन्तगात तटीर् जवजनर्मन िोन अजधसूचना, 2011 और पर्ाावरणीर् समाघात जनधाारण अजधसूचना, 2006 और अन्र् लागू जवजधर्ों के जिसमें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) सजम्मजलत हैं और दकर्े गर्े संिोधनों द्वारा िाजसत होंग ेऔर नीचे िी गई सारणी में जवजनर्िाष्ट रीजत में जवजनर्जमत होंगे, अथाातप :- सारणी रम स.ं

1. वाजणजज्र्क खनन, पत्थर उत्खनन और अपघिाण इकाईर्ां । (क) वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेल ू आवश्र्कताओं जिसमें जनिी उपर्ोग के जलए मकानों के संजनमााण र्ा मरम्मत के जलए धरती को खोिना और मकान बनाने के जलए िेिी टाइल्स र्ा ईंटों का जनमााण करना भी सजम्मजलत है, के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनि), पत्थर की खानें और उनको तोडने की इकाइर्ां तत्काल प्रभाव से प्रजतजिद्ध होगी। (ख) खनन प्रचालन, माननीर् उच्चतम न्र्ार्ालर् की ररट र्ाजचका (जसजवल) सं. 1995 का 202 टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले में आिेि तारीख 4 अगस्ट्त, 2006 और ररट र्ाजचका (सी) सं. 2012 का 435 गोवा फाउंडेिन बनाम भारत संघ के मामले में तारीख 21 अप्रैल, 2014 के आिेि के अनसुरण में प्रचाजलत होंगी ।
2. प्रििूण (िल, वार्ु, मृिा, ध्वजन, आदि) उत्पन करन ेवाल ेउद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रििूणकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नहीं होगी:
परन्त ु र्ह दक केन्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी मागा ििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार िब तक दक अजधसूचना में ऐसा जवजनर्िाष्ट न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गैर-प्रििूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि गैर- प्रििूणकारी कुटीर उद्यागों को बढ़ावा दिर्ा िाएगा।
3. बृहत िल जवदु्यत पररर्ोिना की स्ट्थापना । लागू जवजधर्ों के अनुसार प्रजतजिद्ध (अन् र्था उपबंजधत के जसवार्) होंगे ।
4. दकसी पररसंकटमर् पिाथा का उपर्ोग र्ा उत्पािन र्ा प्रसंस्ट्करण। लागू जवजधर्ों के अनुसार प्रजतजिद्ध (अन् र्था उपबंजधत के जसवार्) होंगे ।
5. प्राकृजतक िल जनकार्ों र्ा क्षेत्र भूजम में अनुपचाररत बजहस्रााव का जनस्ट्सारण । लागू जवजधर्ों के अनुसार प्रजतजिद्ध (अन् र्था उपबंजधत के जसवार्) होंगे । 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा जमलों का जवस्ट् तार अनजु्ञात नहीं होगा ।
7. ईंट भट्टों की स्ट्थापना करना। लागू जवजधर्ों के अनुसार प्रजतजिद्ध (अन् र्था उपबंजधत के जसवार्) होंगे । ख. जवजनर्जमत दरर्ाकलाप
8. वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना । पाररजस्ट्थजतकी पर्ाटन दरर्ाकलापों लघु अस्ट्थार्ी संरचनाओं के जसवार् संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट ह,ै नए वाजणजज्र्क होटल और ररसोटों को अनुज्ञात नहीं दकर्ा िाएगा:
परंत ुर्ह दक संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के परे र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक इनमें से िो भी जनकट हो सभी नए पर्ाटन दरर्ाकलाप र्ा जवद्यमान दरर्ाकलाप का जवस्ट्तार पर्ाटन महार्ोिना और र्था लाग ू मागाििी जसद्धांतों के अनुरुप होगा।
9. संजनमााण दरर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट हो, दकसी भी प्रकार के नर् ेवाजणजज्र्क संजनमााण की अनुज्ञा नहीं होगी:
परंत ु र्ह दक स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत आवश्र्कताओं को पूरा करन े के जलए, पैरा 3 के उप पैरा (1) में सूचीबद्ध दरर्ाकलापों सजहत अपने उपर्ोग के जलए, अपनी भूजम में भवन उप-जवजधर्ों के अनुसार, संजनमााण करने की अनुज्ञा होगी, िैसे:- परंत ु र्ह दक गैर–प्रििूणकारी लघ ु उद्योगों से संबंजधत संजनमााण दरर्ाकलाप लाग ू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत से जवजनर्जमत दकए िाएंगे और वे न्र्ूनतम होंग े। (ख) एक दकलोमीटर क्षेत्र से परे रे् आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे ।
10. प्रििूण उत्पन्न न करने वाले लघ ु उद्योग । फरवरी, 2016 में केन्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा िारी उद्योगों में वगीकरण के अनुसार गैर-प्रििूणकारी उद्योग और अपररसंकटमर् में, लघु और सेवा उद्योग, कृजि, पुष्प कृजि, उद्यान कृजि र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्री से उत्पािों को उत्पन्न करने वाल े कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे।
11. वृक्षों की कटाई । (क) राज्र् सरकार में सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन, सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर र्ा वनों में वृक्षों की कटाई नहीं होगी । भाग II खण् ड (ii) भारत का रािपत्र : असाधारण 9 (ख) वृक्षों की कटाई संबंजधत कें रीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंध के अनुसार जवजनर्जमत होगे ।
12. वन उत्पािों र्ा गैर काष् ठ वन उत्पािों का संग्रहण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
13. फमों, कंपजनर्ों द्वारा बडे पैमाने पर वाजणजज्र्क पिुओं और पोल्री फामों की स्ट्थापना । स्ट्थानीर् आवश्र्कताओं को परूा करन ेके जलए लाग ूजवजधर्ों के अनुसार जवजनर्जमत (अन्र्था प्रिान दकए गए) होंगे ।
14. जवदु्यत और संचार टावरों का पररजनमााण और केबलों के जबछाए िाने और अन्र् बुजनर्ािी ढांचे । लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे। (भूजमगत केबल के जबछाए िाने को बढ़ावा दिर्ा िा सकेगा)।
15. नागररक सुख सुजवधाओं सजहत अवसंरचनाएं । न्र्ूनीकरण उपार्ों को लाग ूजवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाना ।
16. जवद्यमान सडकों को चौडा करना और उन्हें सुिढृ़ करना तथा नवीन सडकों का संजनमााण । न्र्ूनीकरण उपार्ों को लाग ूजवजधर्ों, जनर्मों और जवजनर्मनों तथा उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाना।
17. पर्ाटन से संबंजधत अन्र् दरर्ाकलाप िैसे गमा वार्ु गबु्बारें, हलेीकाप्टर, ड्रोन, माइरोलाइटस आदि द्वारा पाररजस्ट्थजतकी संवेिी िोन क्षते्र के ऊपर से उडना िैसे दरर्ाकलाप करना। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
18. पहाडी ढालों और निी तटों का संरक्षण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
19. राजत्र में र्ाजनक र्ातार्ात का संचलन । लाग ू जवजधर्ों के अनुसार वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत ।
20. स्ट्थानीर् समुिार्ों द्वारा चल रही कृजि और बागवानी प्रथाओं के साथ िगु्धिाला, िगु्घ उद्योग, कृजि और मछली पालन । स्ट्थानीर् लोगों के उपर्ोग के जलए लाग ू जवजधर्ों के अधीन अनुज्ञात ।
21. प्राकृजतक िल जनकार्ों र्ा सतही के्षत्र में उपचाररत बजहस्रााव का जनस्ट्तारण । िल जनकार्ों में उपचाररत अपजिष्ट िल र्ा बजहस्रााव के जनस्ट्सारण से बचा िाएगा और उपचाररत अपजिष्ट िल के पुन:चरण और पुन:उपर्ोग के जलए प्रर्ास दकए िाएंगे। अन्र्था लागू जवजधर्ों के अनुसार उपचाररत बजहस्रााव के पुनचारण/प्रवाह के जनवाहन को जवजनर्जमत दकर्ा िाएगा।
22. सतह और भूिल का वाजणजज्र्क जनष्किाण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
23. खुले कंुआ, बोर कंुआ, आदि कृजि और अन्र् उपर्ोग के जलए । सम्बद्ध प्राजधकारी द्वारा दरर्ाकलापों को जवजनर्जमत और सख्ती से मानीटरी की िानी चाजहए। 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
24. ठोस अपजिष्ट का प्रबन्धन। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
25. जविेिी प्रिाजतर्ों को लाना । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
26. पाररजस्ट्थजतकी पर्ाटन। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
27. पोजलथीन बैगों का उपर्ोग । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
28. वाजणजज् र्क संकेत और होर्डंग। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे । ग. सवंर्धात दरर्ाकलाप
29. विाा िल संचर्न । सदर र् रूप से बढ़ावा दिर्ा िाएगा ।
30. िैजवक खेती। सदर र् रूप से बढ़ावा दिर्ा िाएगा ।
31. सभी गजतजवजधर्ों के जलए हररत प्रौद्योजगकी को ग्रहण करना । सदर र् रूप से बढ़ावा दिर्ा िाएगा ।
32. कुटीर उद्योगों जिसके अतंगात ग्रामीण कारीगर भी हैं। सदर र् रूप से बढ़ावा दिर्ा िाएगा ।
33. नवीकरणीर् ऊिाा और ईंधन का उपर्ोग । बार्ोगैस, सौर प्रकाि इत् र्ादि को बढ़ावा दिर्ा िाना ह ै।
34. कृजि वाजनकी । सदर र् रूप से बढ़ावा दिर्ा िाएगा ।
35. बागान लगाना और िडी बूरटर्ों का रोपण । सदर र् रूप से बढ़ावा दिर्ा िाएगा ।

5. पाररजस्ट्थजतकी संविेी िोन की अजधसचूना की मानीटरी के जलए मानीटरी सजमजत- कें रीर् सरकार, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 3 की उपधारा (3) के अधीन इस अजधसूचना के उपबंधों की प्रभावी मानीटरी के जलए मानीटरी सजमजत का गठन करती ह,ै िो जनम्नजलजखत से जमलकर बनेगी, अथाातप:- र.स.ं मानीटरी सजमजत का सघंटक पिनाम
(i) जिला कलेक्टर अध्र्क्ष;
(ii) जिला वन अजधकारी, डडंडीगलु जडवीिन सिस्ट्र्;
(iii) सहार्क जनिेिक, खान और खजनि सिस्ट्र्;
(iv) कार्ाकारी अजभर्ंता, सावािजनक कार्ा जवभाग और भूिल सिस्ट्र्;
(v) राज्र् सरकार द्वारा नामजनर्िाष्ट दकए िान े वाल े वन्र्िीव संरक्षण के के्षत्र में काम करने वाल ेगैर-सरकारी संगठन का प्रजतजनजध सिस्ट्र्;

(vi) राज्र् सरकार द्वारा नामजनर्िाष्ट िैव जवजवधता में एक जविेिज्ञ सिस्ट्र्;

6. जनिेि–जनबधंन.- (1) मानीटरी सजमजत इस अजधसूचना के उपबंधों के अनुपालन को मानीटर करेगी।
(2) मानीटरी सजमजत का कार्ाकाल तीन विा तक र्ा राज्र् सरकार द्वारा नई सजमजत के पनु: गठन तक के जलए होगा और तत्पिात मानीटरी सजमजत राज्र् सरकार द्वारा गरठत की िाएगी।
(3) उन दरर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533 (अ), तारीख 14 जसतम्बर, 2006 की अनुसूची में सजम्मजलत हैं, और िो पाररजस्ट्थजतकी संवेिी िोन में आत ेहैं, जसवार् इसके िो पैरा 4 के अधीन सारणी में र्था जवजनर्िाष्ट प्रजतजिद्ध दरर्ाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त के जलए केरींर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को जनर्िाष्ट दकर्ा िाएगा।
(4) उन दरर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ.1533(अ) तारीख 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत नहीं ह,ै और िो पाररजस्ट्थजतकी संवेिी िोन में आते ह,ै जसवार् इसके पैरा 4 के अधीन सारणी में र्थाजवजनर्िाष्ट प्रजतजिद्ध दरर्ाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे संबंद्ध जवजनर्ामक प्राजधकरणों को जनर्िाष्ट दकर्ा िाएगा ।
(5) मानीटरी सजमजत का सिस्ट्र्-सजचव र्ा संबद्ध उपार्ुि ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लघंन करता ह,ै पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के अधीन पररवाि फाइल करने के जलए सक्षम होगा।
(6) मानीटरी सजमजत मुद्दा िर मुद्दा के आधार पर अपेक्षाओं पर जनभार रहते हुए संबद्ध जवभागों के प्रजतजनजधर्ों र्ा जविेिज्ञों, औद्योजगक संगमों र्ा संबद्ध पणधाररर्ों के प्रजतजनजधर्ों को अपन े जवचार-जवमिा में सहार्ता के जलए आमंजत्रत कर सकेगी ।
(7) मानीटरी सजमजत प्रत्र्ेक विा की 31 माचा तक के अपन ेदरर्ाकलापों की वार्िाक कारावाई ररपोटा राज् र् के मुख् र् वन् र्िीव वाडान को उपाबधं V में संलग्न प्रपत्र में उक् त विा के 30 िून तक प्रस्ट्तुत करेगी ।
(8) केन्रीर् सरकार का पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् मानीटरी सजमजत को अपन ेकृत्र्ों के प्रभावी जनवाहन के जलए ऐसे जनिेि िे सकेगा, िो वह ठीक समझे ।
7. इस अजधसूचना के उपबंधों को प्रभाव िेने के जलए कें रीर् सरकार और राज् र् सरकार अजतररक् त उपार्, र्दि कोई हों, जवजनर्िाष् ट कर सकेंगी।

8. कोई अन् र् महत् वपूणा मामला । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 23rd January, 2020 S.O. 412(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 5834 (E) dated the 22nd November, 2018, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 26nd November, 2018;
AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification;
AND WHEREAS, Kodaikanal Wildlife Sanctuary is spread over an area of 608.95 square kilometres and located in Kodaikanal and Palani Taluks of Dindigul District and Periyakulam Taluk of Theni District in the State of Tamil Nadu;
AND WHEREAS, Kodaikanal Forest Division was formed after bifurcating erstwhile Madurai North Division with headquarters at Kodaikanal with effect from 19th April, 1982 as per G.O.Ms. No.468 and as ordered in G.O.Ms. No. 261 dated 21st March, 1977. On bifurcation of Madurai Revenue District into Madurai and Dindigul districts as per G.O. Ms. No. 640 Revenue dated 22nd April, 1985, the forest areas under the control of Theni Forest Division were transferred to Kodaikanal Forest division and the division forms contiguous and compact block, lying in Kodaikanal Taluk and part of Palani Taluk in Dindigul district and part of Periyakulam Taluk of Theni district and the Kodaikanal Forest Division have been declared as Kodaikanal Wildlife Sanctuary in G.O. No.143 Environment and Forest (FR-5) dated: 20th September, 2013;
AND WHEREAS, forests of Kodaikanal Forest Division falling between 77016’ and 770 45’ of East longitude and 100 20’ and 1005’ of North latitude, is surrounded by Kerala State in the West, Coimbatore Revenue district in the North-West, Dindigul Forest Division on the 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] North-East, Madurai Revenue district in the South – East and Theni Forest Division on the South;
AND WHEREAS, Kodaikanal Wildlife Sanctuary is an important and unique habitat for varied flora and fauna which provide an ecologically sustainable habitat for about 44 species of mammals including endangered species like tiger, elephant, nilgiri tahr etc. It supports more than 150 species of birds, 40 species of reptiles, 8 species of amphibians, 202 species of butterflies and wide variety of ecosystems such as grasslands, fresh water ecosystem, marsh ecosystem, dry deciduous forest, tropical evergreen forest and shola forests and it is necessary to conserve the physical and biological diversity around the protected area of Kodaikanal Wildlife Sanctuary;
AND WHEREAS, the Sanctuary’s floral diversity is extraordinary. The biota of the region is highly diverse with over 2478 species of flowering plant in 201 families of which 1758 are indigenous species, 161 species are naturalized in the area, 344 are cultivated species and 215 are garden species and examples of the floras are Pachai savukku (Acacia decurrens), Sokkala (Aglaia elaeagnoidea), Asiatic pennywort (Centella asiatica), Arabian jasmine (Jasminum sambac), etc;
AND WHEREAS, the Sanctuary has variety of birds, butterflies, insects, reptiles, amphibians and mammals and the examples of mammals are Tiger (Panthera tigris), Indian gaur (Bos gaurus), Elephant (Elephas mazimus), Wildboar (Sus scrofa), common Langur (Semnopithecus) etc. and the examples of birds are Red-whiskered bulbul (Phycnonotus jocous), common Kingfisher (Alcedo atthis), Bebra Sparrow-hawk (Virgatus besra) etc. while amphibians of the Sanctuary are common Asian Toad (Bufo melanostictus), Indian Skipper Frog (Euphlyatis cyanophlyetis), etc;
AND WHEREAS, the Kodaikanal Wildlife Sanctuary has 32 species of rare, endangered and threatened species and 49 endemic species which includes birds (29 species), butterfly (12 species), amphibians (8 species) and some endemic floral species which has become endangered and endemic to shola forest of this Sanctuary;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Kodaikanal Wildlife Sanctuary which are specified in paragraph 1 as Eco- Sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0.0 (zero) kilometre to 1.0 kilometre around the boundary of Kodaikanal Wildlife Sanctuary, in Dindigul and Theni districts in the State of Tamil Nadu as the Eco-Sensitive Zone (hereafter in this notification referred to as the Eco-Sensitive Zone), details of which are as under, namely: -
1. Extent and boundaries of Eco-Sensitive Zone. – (1) The Eco-Sensitive Zone shall be to an extent of 0.0 (zero) to 1.0 kilometre around the boundary of Kodaikanal Wildlife Sanctuary and the area of the Eco-Sensitive Zone is 106.78 square kilometres. (Zero extent of Eco-Sensitive Zone is due to inter-State border with Kerala and presence of a township).
2. The boundary description of Kodaikanal Wildlife Sanctuary and its Eco- Sensitive Zone is appended as Annexure-I.
3. The maps of the Eco-Sensitive Zone of Kodaikanal Wildlife Sanctuary along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB, Annexure-IIC, Annexure-IID, Annexure-IIE and Annexure-IIF.

4. List of geo-coordinates of the boundary of Eco-Sensitive Zone of Kodaikanal Wildlife Sanctuary and prominent locations of zero extent of Eco-Sensitive Zone are given in Table A, Table B and Table C of Annexure-III.
5. The list of villages falling in the proposed Eco-Sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV.
2. Zonal Master Plan for Eco-Sensitive Zone.- (1) The State Government shall, for the purposes of effective management of the Eco-Sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority of State.
(2) The Zonal Master Plan for the Eco-Sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department;
(xii) Highways; and
(xiii) Tamil Nadu State Pollution Control Board.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-Sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
(10) The said Master Plan shall regulate development in Eco-Sensitive Zone so as to ensure eco-friendly development for security of local community development.
3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-Sensitive Zone shall not be used or converted into areas for major commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a) adove, within the Eco-Sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given under paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-Sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs or rivers shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-Sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by the Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.

(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-Sensitive Zone.
(e) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-Sensitive Zone whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the Wildlife Sanctuary till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco- Sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-Sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-Sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution. - Prevention and control of noise pollution in the Eco-Sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-Sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-Sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:- a) the solid waste disposal and management in the Eco-Sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016;
the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-Sensitive Zone;
b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.

(10) Bio-Medical Waste.– Bio Medical Waste Management shall be as under:- a) the Bio-Medical Waste disposal in the Eco-Sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016.
b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-Sensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste.- The E-waste management in the Eco-Sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuel like CNG, LPG etc.
(16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco- Sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-Sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
4. List of activities prohibited or to be regulated within Eco-Sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- भाग II खण् ड (ii) भारत का रािपत्र : असाधारण 29 TABLE S. (b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
New industries and expansion of existing polluting industries in the Eco-Sensitive Zone shall not be permitted:
Provided that non-polluting industries shall be allowed within Eco-Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification and in addition the non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project.
Prohibited (except as otherwise provided) as per the applicable laws.
4. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per the applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per the applicable laws.
6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-Sensitive Zone.
7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per the applicable laws.
B. Regulated Activities
8. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of Eco- Sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:

Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-Sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
9. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-Sensitive Zone, whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents.
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
10. Small scale non polluting industries.
Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and nonhazardous, small-scale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous materials from the Eco-Sensitive Zone shall be permitted by the competent Authority.
11. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
12. Collection of Forest produce or Non-Timber Forest produce.
Regulated as per the applicable laws.
13. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and Regulated (except otherwise provided) as per the applicable laws except for meeting local needs.

5. Monitoring Committee for Monitoring the Eco-Sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S N Constituent of the Monitoring Committee Designation

(vi) An expert in Biodiversity nominated by the State Government Member;
(vii) An expert in Ecology and Environment to be nominated by the State Government Member;
(viii) A representative from State Public Works Department Member;
(ix) A representative from State Pollution Control Board Member;
(x) Deputy Director, Town Planning Member;
(xi) District Forest Officer, Kodaikanal Member- Secretary.

6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring Committee shall be for three years or till the reconstitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-Sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O.
1533 (E), dated the 14th September, 2006 and are falling in the Eco-Sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.

GARKOTI, Scientist ‘G’ ANNEXURE- I BOUNDARY DESCRIPTION OF KODAIKANAL WILDLIFE SANCTUARY AND ITS ECOSENSITIVE ZONE IN THE STATE TAMIL NADU North The Northern boundary of the Eco-Sensitive Zone commences from the Palani – Perumalmalai Road to Anna Junction (Palani – Perumalmalai) at Id – F14 to F15 runs crossing the prominent places as mentioned in the map from North to North East in Palani Range.
In North Eco sensitive Zone runs from in North East Id-G1 to id-G3 runs towards west crossing from the prominent places. (Anchuran mandai to Nagamarathalai) in Palani Range.

East The eastern boundary of the Eco-Sensitive Zone commences from the Perumalmalai Addukkam Road (Id-G13), Palamalai (Id-G12), Kurudikadumalai (Id-G11) and extend to Periyavarai (Id-B11) and runs towards South East crossing the prominent places as mentioned in the map and key location in Kodaikanal Range.
And the other part of Eco sensitive zone commences from the Krishnan kovail and staring point of Dindingul – Theni Districts boundary at id – H1 and runs towars south east crossing the prominent places as mentioned in the map with Global Positioning System (GPS) readings in order of Id – H2 to Id – H7 and finally reach Batalagundu – Periyakulam Road at Id - H8 in Perumpallam and Devathanapatty Ranges.
South East The South east boundary of the Eco-Sensitive Zone commences from the Batalagundu – Periyakulam Road at Id - H8 towards south crossing the prominent places as mentioned in the map with Global Positioning System (GPS) readings in order of Id – H9 to Id – H18 and finally reach the Sothuparai Reservoir at Id – H19.
South The South boundary of the sanctuary from South corner to South West corner is surrounded by the Boundary of Theni Forest Division in Theni District. No proposal is being made for the Eco-Sensitive Zone on that front in Devathanapatty, Berijam and Vandaravu Ranges.
South West The South West boundary of the Eco-Sensitive Zone commences from the id- 11(Gurusamy medu) extend towards west up to 10 (Zero Eco-Sensitive Zone) and from 9 (Zero Eco-Sensitive Zone) runs towards at id- G9 (Kulatta kanavay Falls) crossing the prominent places as mentioned in the map. And, also interstate boundary of Kerala Buffer and core area of Anamalai Tiger Reserve located from Northwest towards west. Therefore, no proposal is being made for the Eco-Sensitive Zone on that front in Vandaravu, Mannavanur and Poombarai Ranges.
West The West boundary of the Eco Sensitive Zone commences from the Kulatta kanavay Falls to Ulrapulran Kanavai at id – G9 to id- G4 towards Northwest crossing the prominent places as mentioned in the map in Palani Range. And, also Anamalai Tiger Reserve located from West corner to Northwest corner.
No proposal is being made for the Eco-Sensitive Zone on that front in Poombarai and Palani Ranges.
North West The northern west boundary of the Eco-Sensitive Zone commences from the Bi-junction of Anamalai Tiger Reserve and Kodaikanal Wildlife Sanctuary boundary at Id – F1 and runs towards north crossing the prominent places along the natural boundaries such as Streams, roads, path way and nullahsetc with Global Positioning System (GPS) reading in order of id’s viz F2 (Naval Odai DGL – Thiruppur District Boundary) to F11 (Vannatti odai).And also from Mottaiparai to Palar-Porandalar Reservoir-zero point at id-F12 to id-F13 in Palani Range.
