PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार् ुपररवतान मतं्रालर् अजधसचूना नई दिल्ली, 13 अक् तूबर, 2021 का.आ. 4262(अ).—प्रारूप अजधसूचना भारत के रािपत्र, असाधारण में भारत सरकार के पर्ाावरण, वन और िलवार् ुपररवतान, मंत्रालर् की अजधसूचना सं. का.आ. 121 (अ), तारीख 12 िनवरी, 2021, द्वारा प्रकाजित की गई थी जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करन ेवाले रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थ;े और, उि प्रारूप अजधसूचना को अन्तर्वाष्ट करने वाल ेरािपत्र की प्रजतर्ां िनता को तारीख 13 िनवरी, 2021, को उपलब्ध करा िी गई थी;
और, पूवोि प्रारूप अजधसूचना के उत्तर में व्यजिर्ों और पणधाररर्ों से कोई भी आक्षेप और सुझाव प्राप्त नहीं हुए;
और, दकश्तवाड़ उच्च ऊंचाई राष्ट्रीर् उद्यान का नाम िम्मू प्रांत के सुप्रजसद्ध और पुरान ेिहर “दकश्तवाड़” के नाम पर रखा गर्ा था िो इसका प्रवेिद्वार ह,ै र्ह िम्मू और कश्मीर के दकश्तवाड़ जिले में ग्रेट जहमालर्न पवातों के उंचे-नीचे भू- भाग में 2191.50 वगा दकलोमीटर के क्षेत्रफल में फैला हुआ ह,ै और उि राष्ट्रीर् उद्यान दकश्तवाड़ िहर के उत्तर में लगभग 60 दकलोमीटर और िम्मू से 230 दकलोमीटर की िरूी पर जस्ट्थत ह;ै स.ं 3915] नई दिल्ली, बृहस्ट् पजतवार, अक् तबूर 14, 2021/आजश् वन 22, 1943 No. 3915] NEW DELHI, THURSDAY, OCTOBER 14, 2021/ASVINA 22, 1943 सी.जी.-डी.एल.-अ.-18102021-230471 CG-DL-E-18102021-230471 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, दकश्तवाड़ उच्च ऊंचाई राष्ट्रीर् उद्यान अजधसूचना संख्र्ा एफएसटी-20 का 1981, तारीख 4 फरवरी, 1981 द्वारा राष्ट्रीर् उद्यान घोजित दकर्ा गर्ा था, इसका क्षेत्रफल 425 वगा दकलोमीटर ह,ै और िम्मू और कश्मीर सरकार न े दकश्तवाड़ उच्च ऊंचाई राष्ट्रीर् उद्यान की अजधसूचना सं. एसआरओ-212, तारीख 6 िुलाई, 2015 को पुन: अजधसूजचत दकर्ा गर्ा था जिसमें 2191.50 वगा दकलोमीटर का क्षेत्रफल सजम्मजलत ह;ै और, दकश्तवाड़ उच्च ऊंचाई राष्ट्रीर् उद्यान और इसके जनकटवती वन के्षत्र को इसके स्ट्थाजनक वन्र्िीवों के कारण संरक्षण के उदे्दश्र् से प्राथजमकता िी िाती ह,ै र्ह के्षत्र लुप्तप्रार् िैव -जवजवधता की व्यवहार्ा संख्र्ा को आश्रर् प्रिान करता ह ै और र्ह कई िंगली वनस्ट्पजत और िीविंतु प्रिाजतर्ों के प्रवधान, संरक्षण और स्ट्थार्ीकरण के जलए “िीन पूल” का प्रजतजनजधत्व करता ह;ै और, दकश्तवाड़ उच्च ऊंचाई राष्ट्रीर् उद्यान अत्रं्त लुप्तप्रार् प्रिाजत हगंुल र्ा कश्मीरी स्ट्टैग (केरवस एलाफस हगंुल) और कस्ट्तूरी मृग (मोसचस् के्रसोगेटर) के वास के जलए िाना िाता है ,और र्हां उि राष्ट्रीर् उद्यान के के्षत्र में स्ट्तनधाररर्ों की लगभग 25 प्रिाजतर्ां और पजक्षर्ों की 200 प्रिाजतर्ां सूजचत की गई हैं;
और, संरजक्षत के्षत्र लुप्तप्रार्, िलुाभ िाकाहारी और मांसाहारी पिुओं िैसे एजिर्ाई काला भालू ) उसास जथबेटानस(, जहमालर्न ब्राउन भाल ू (उरसूस आका टोस इसाबेजल्लनस), गोरल (नैमोरहडेस गोरल), जहमालर्न लगंूर (सेम्नोजपथेकस अिाक्स), तेंिआु (पेन्थरेा प्रड्यूस) ,स्नो तेंिआु(पेन्थरेा उंदकर्ा), इबेक्स(कापरा इबेक्स), जहमालर्न माउस खरगोि (ओचोटोना रोर्लेइ), जहमालर्न मामोट (मामोट बोबाक), लााँग टेल्ड मामोट (मामोट कौडेट), जसर्ार ) कैजनस ऑररर्स (, रेड लोमड़ी (वुल्पेस वुल्पेस) और पक्षी प्रिाजतर्ों िैसे पजिमी रगोपनै ) रगोपन मलेानोसेफेलस), मोनल (लोफोफोरूस इम्पेिानस), गोल्डन ईगल (एदिला क्रार्जसटोस), स्नो तीतर (लेरवा लेरवा) और चकोर तीतर (एलेक्टोररस चोकर), जहमालर्न जग्रफ्फोन जगद्ध (जिप्स जहमालर्ेंजसस), बेअरडेड जगद्ध (जिपाइतुस बारबाटुस), कश्मीर फ्लाईकैचर (दफकेडुला सुबरूब्र) ,आदि की बृहत ्संख्र्ा को आश्रर् प्रिान करता ह;ै और, दकश्तवाड़ उच्च ऊंचाई राष्ट्रीर् उद्यान की जविेिता इसकी स्ट्थलाकृजत, िलवार्ु और ऊंचाई में स्ट्पष्ट जभन्नता ह ैजिसके पररणामस्ट्वरूप इस के्षत्र में वन वनस्ट्पजत की जवजवधता होती है ,और कीबर, नांथ और दकर्ार तीनों जवजिष्ट नालों के जनचल ेिलग्रहण क्षेत्रों में जवजवध प्रिाजतर्ों के अनुकूल जमश्रण से उपर्ुि पहलओुं पर वन जवकास होता ह;ै और, दकश्तवाड़ उच्च ऊंचाई राष्ट्रीर् उद्यान में आर्द्ा िेविार वन, पजिमी जमजश्रत िंकुधारी वन, आर्द्ा िीतोष्ण पणापाती वन, कम ऊंचाई के ब्ल ूपाइन वन, पजिम जहमालर्न ऊपरी ओक-फीर वन, चीलगोजा पाइन वन, िुष्क िेविार वन, परोरटर्ा (पोहू) झाड़ी वन, पजिम जहमालर्न उच्च स्ट्तर िुष्क ब्ल ू पाइन वन, पजिम जहमालर्न उप-अल्पाइन ब्रीच/फीर वन, उप-अल्पाइन चरागाह, ब्रीच/रहोडोडैंड्रोन झाड़ी वन, अल्पाइन चरागाह हैं और उच्च ऊंचाई और अच्छी नमी के कारण, िेविार-कैल वन में फीर वन प्रमुख हैं और बृहत पत्ती वाली प्रिाजतर्ां नालों के दकनारे और अपेक्षाकृत ठंडे और नमस्ट्थलों तक ही सीजमत हैं, परोरटर्ा भी पैचों में होता है ,और इस के्षत्र में महत्त्वपूणा औिधीर् पौधों िैसे सोस्ट्सुरेर्ा लाप्पा, डार्स्ट्कोररर्ा एसपीपी, पोडोफर्ल्लुम एसपीपी, बेल्लाडोना एसपीपी, बेरजगजनर्ा एसपीपी, जस्ट्कम्मेर्ा एसपीपी, जपक्कोरजहिा एसपीपी और एकोजनतुम एसपीपी, आदि की बड़ी जवजवधता भी ह;ै और, उि राष्ट्रीर् उद्यान का िलग्रहण के्षत्र िम्मू प्रांत की प्रजसद्ध चेनाब निी के स्त्रोत के अलावा, संरजक्षत के्षत्र के अंतगात आन ेवाले ििानों ग्रामों के जलए पेर्िल और ससंचाई के िल का स्त्रोत ह;ै और , दकश्तवाड़ उच्च ऊंचाई राष्ट्रीर् उद्यान के चारों ओर के संरजक्षत क्षेत्र को, जिसका जवस्ट्तार और सीमाएं पाररजस्ट्थजतकी पर्ाावरणीर् से पाररजस्ट्थजतकी संवेिी िोन के रूप में परैा 1 में जवजनर्िाष्ट हैं ,िैव जवजवजधता की िजृष्ट सुरजक्षत और संरजक्षत करना और उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों के वगों के प्रचालन और प्रसंस्ट्करण करने को प्रजतजिद्ध करना आवश्र्क ह;ै [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 अतः, अब, केन्र्द्ीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इस अजधसूचना में इसके पिात पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उपधारा )1 ( और उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा )3( द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, िम्मू और कश्मीर संघ राज्र् क्षेत्र के दकश्तवाड़ उच्च ऊंचाई राष्ट्रीर् उद्यान की सीमा के चारों ओर 0.51 दकलोमीटर से 10.106 दकलोमीटर जवस्ट्ताररत क्षेत्र दकश्तवाड़ उच्च ऊंचाई राष्ट्रीर् उद्यान को पाररजस्ट्थजतकी संवेिी िोन )जिसे इसमें इसके पश् चात ् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा है (के रूप में अजधसूजचत करती ह,ै जिसके ब्र्ौरे जनम्नानुसार ह,ै अथाात ्:-
1. पाररजस्ट्थजतकी संविेी िोन का जवस्ट्तार और सीमा.-(1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार दकश्तवाड़ उच्च ऊंचाई राष्ट्रीर् उद्यान की सीमा के चारों ओर 0.51 दकलोमीटर से 10.106 दकलोमीटर के साथ 547.09 वगा दकलोमीटर तक जवस्ट्तृत ह।ै
(2) दकश्तवाड़ उच्च ऊंचाई राष्ट्रीर् उद्यान और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण उपाबधं-I के रूप में संलग्न ह।ै )3 ( सीमा जववरण और अक्षािंों और िेिांतरों के साथ पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करत ेहुए राष्ट्रीर् उद्यान के मानजचत्र उपाबधं –IIक, उपाबधं –IIख ,उपाबधं –IIग और उपाबधं –IIघ के रूप में सलंग्न ह।ै
(4) दकश्तवाड़ उच्च ऊंचाई राष्ट्रीर् उद्यान और पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू- जनिेिांकों की सूची उपाबधं -III की सारणी क और सारणी ख में िी गई ह।ै
(5) पाररजस्ट्थजतकी संवेिी िोन के अंतगात कोई ग्राम नहीं ह।ै
2. पाररजस्ट्थजतकी संवेिी िोन के जलए आंचजलक महार्ोिना– (1) संघ राज्र् के्षत्र सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और संघ राज्र् के्षत्र के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसूचना में दिए गए अनुबंधों का पालन करते हुए आंचजलक महार्ोिना तैर्ार करेगी और संघ राज्र् के्षत्र में सक्षम प्राजधकारी द्वारा जवजधवत अनुमोदित दकर्ा िाएगा।
(2) संघ राज्र् के्षत्र सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत से िो इस अजधसूचना में जवजनर्िाष् ट दकए गए हैं, के अनुसार तथा सुसंगत कें र्द्ीर् और संघ राज्र् के्षत्र जवजधर्ों के अनरुुप और कें र्द्ीर् सरकार द्वारा िारी मागाजनिेिों, र्दि कोई हों, द्वारा तैर्ार होगी ।
(3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करने के जलए संघ राज्र् के्षत्र सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार होगी.-
(i) िम्मू और कश्मीर सरकार का पर्ाावरण, वन और वन्र्िीव संरक्षण जवभाग;
(ii) िम्मू और कश्मीर प्रििूण जनर्ंत्रण बोडा;
(iii) आवास और िहरी जवकास जवभाग;
(iv) पर्ाटन जवभाग;
(v) ग्रामीण जवकास जवभाग;
(vi) ससंचाई और बाढ़ जनर्ंत्रण जवभाग;
(vii) लोक जनमााण और जबिली जवकास जवभाग;

(viii) रािस्ट्व जवभाग;
(ix) आपिा प्रबंधन;
(x) कृजि जवभाग;
(xi) नगर जनगम, िम्मू;
(xii) िहर र्ोिना जवभाग, िम्मू। )4 ) आंचजलक महार्ोिना अनमुोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िाष् ट न हो और आचंजलक महार्ोिना सभी अवसंरचना और दक्रर्ाकलापों में, िो अजधक िक्षता और पाररजस्ट्थजतकी अनुकूल हों, का संवधान करेगी ।
(5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण से संबंजधत ऐसे अन्र् पहलओुं, जिन पर ध्र्ान िनेा आवश्र्क ह,ै के जलए उपबंध होंग े।
(6) आंचजलक महार्ोिना जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेिताओं के ब्र्ौरों से अनुसमर्थात मानजचत्र के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस् मों, कृजि क्षेत्रों, ऊपिाऊ भूजम, हररत के्षत्र िैसे उद्यान और उसी प्रकार के स्ट् थान, उद्यान कृजि के्षत्र, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभर्ांकन करेगी।
(7) आंचजलक महार्ोिना में पाररजस्ट्थजतकी संवेिी िोन में जवकासात्मक दक्रर्ाकलापों को जवजनर्जमत करन ेके जलए प्रदक्रर्ा प्रिान की िाएगी और सारणी में र्थासूचीबद्ध पैराग्राफ 4 में प्रजतजिद्ध और जवजनर्जमत दक्रर्ाकलापों का पालन दकर्ा िाएगा। इसमें स्ट् थानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनिर् और संवधान दकर्ा िाएगा।
(8) आंचजलक महार्ोिना प्रािेजिक जवकास र्ोिना की सह जवस्ट्तारी होगी।
(9) संघ राज्र् क्षेत्र सरकार द्वारा अनुमोदित आंचजलक महार्ोिना, मानीटरी सजमजत के जलए एक संिभा िस्ट्तावेि होगी तादक वह इस अजधसूचना के उपबंधों के अनुसार मानीटरी के अपन ेकताव्यों का जनवाहन कर सके।
3. सघं राज्र् क्षते्र सरकार द्वारा दकए िान ेवाल ेउपार्.- संघ राज्र् क्षेत्र सरकार इस अजधसूचना के उपबंधों को प्रभावी करन ेके जलए जनम्नजलजखत उपार् करेगी, अथाात:्-
(1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए जचजन्हत दकए गए पाकों और खुल ेस्ट्थानों का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक संबद्ध जवकास दक्रर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नहीं होगा:
परंत ुपाररजस्ट्थजतकी संवेिी िोन के भीतर खंड (क) में जवजनर्िाष्ट प्रर्ोिनों से जभन्न प्रर्ोिनों के जलए कृजि और अन्र् भूजम का संपररवतान मानीटरी सजमजत की जसफाररि पर और र्था लागू और क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्र्द्ीर् सरकार र्ा संघ राज्र् क्षेत्र सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से, और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करन ेके जलए अनुज्ञात दकर्ा िाएगा ,िैसे -
(i) जवद्यमान सड़कों को चौड़ा करना और उन्हें सुिढृ़ करना तथा नई सड़कों का संजनमााण;
(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;
(iii) प्रििूण उत्पन्न न करन ेवाले लघ ुउद्योग;
[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5
(iv) कुटीर उद्योगों जिनके अंतगात ग्रामीण उद्योग भी हैं; सुजवधािनक भण्डार और स्ट्थानीर् सुजवधाएं सहार्क पाररजस्ट्थजतकी पर्ाटन जिसके अन्तगात गृह वास सजम्मजलत ह;ै और
(v) पैरा 4 के अधीन दिए गए संवर्धात दक्रर्ाकलाप:
परंत ुर्ह भी दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म तथा संघ राज्र् क्षेत्र सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना और संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगात अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का प्रर्ोग अनुमत नहीं होगा:
परंत ु र्ह और भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भू-अजभलेखों में उपसंिात कोई गलती, मानीटरी सजमजत के जवचार प्राप्त करन ेके पिात ्संघ राज्र् क्षेत्र सरकार द्वारा प्रत्र्ेक मामल ेमें एक बार ठीक होगी और उि गलती के सुधार की सूचना कें र्द्ीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी:
परंत ुर्ह और भी दक गलती के सुधार में इस उप पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा में भू-उपर्ोग का पररवतान सजम्मजलत नहीं होगा। (ख) वनीकरण तथा वास िीणोद्धार दक्रर्ाकलापों सजहत अनप्रर्ुक् त र्ा अनुत् पािक कृजि क्षते्रों में पुन :वनीकरण करने के प्रर्ास दकए िाएंगे।
(2) प्राकृजतक िल स्रोतों.- आचंजलक महार्ोिना में सभी प्राकृजतक झरनों के आवाह क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण के जलए र्ोिना सजम् मजलत होगी और संघ राज्र् के्षत्र सरकार द्वारा ऐसे क्षेत्रों पर र्ा उनके जनकट जवकास दक्रर्ाकलाप प्रजतजिद्ध करने के बारे में िो ऐसे क्षेत्रों के जलए अजहतकर हो ऐसी रीजत से मागाििाक जसद्धांत तैर्ार दकए िाएंगे।
(3) पर्ाटन र्ा पाररजस्ट्थजतकी पर्ाटन.- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी संवेिी िोन के जलए होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना संघ राज्र् के्षत्र पर्ाटन जवभाग द्वारा संघ राज्र् के्षत्र पर्ाावरण और वन जवभाग के परामिा से तैर्ार होगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना के एक घटक के रूप में होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िाएगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनम्नानुसार जवजनर्जमत होंग,े अथाात:्-
(i) संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट ह,ै नर् ेवाजणजज्र्क होटल और ररिॉटा के सजन्नमााण अनजु्ञात नहीं होंगे:
परंत,ु र्ह दक संरजक्षत के्षत्र की सीमा से एक दकलोमीटर की िरूी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक होटलों और ररिॉटा का स्ट्थापना केवल पूवा पररभाजित और नामजनर्िाष्ट क्षेत्रों में पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए ही अनजु्ञात होगा;
(ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार कें र्द्ीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् के मागाििाक जसद्धांतों के द्वारा तथा राष् रीर् व् र्ाघ्र संरक्षण प्राजधकरण, द्वारा िारी पाररजस्ट्थजतकी–पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेते हुए (समर्- समर् पर र्था संिोजधत) िारी मागाििाक जसद्धांतों के अनुसार होगा;

(iii) आंचजलक महार्ोिना का अनुमोिन दकए िाने तक, पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्िाष्ट संवीक्षा और मानीटरी सजमजत की जसफाररि पर आधाररत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नर् े होटल र्ा ररसोटा र्ा वाजणजज्र्क स्ट्थापना का संजनमााण अनुज्ञात नहीं दकर्ा िार्ेगा ।
(4) नसैर्गाक जवरासत.- पाररजस्ट्थजतकी संवेिी िोन में महत्वपणूा नैसर्गाक जवरासत के सभी स्ट्थलों िैसे िीन कोि आरजक्षत के्षत्र, िैल जवरचनाएं, िल प्रपातों, झरनों, घाटी मागों, उपवनों, गुफाए,ं स्ट्थलों, भ्रमण, अश्वरोहण, प्रपातों आदि की पहचान की िाएगी और जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रुप में परररक्षण और संरक्षण के जलए तैर्ार की िाएगी ।
(5) मानव जनर्मात जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, जिल्प-तथ्र्, ऐजतहाजसक, स्ट्थापत्र्, सौंिर्ापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और उपक्षेत्रों पहचान और उनके संरक्षण के जलए जवरासत र्ोिना आंचजलक महार्ोिना के भाग के रुप में तरै्ार की िाएगी।
(6) ध् वजन प्रििूण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रििूण (जवजनर्मन और जनर्तं्रण) जनर्म, 2000 में जनर्त उपबंधों के अनुसार में पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रििूण के जनर्ंत्रण और जनवारण का अनुपालन दकर्ा िाएगा।
(7) वार् ुप्रििूण.- पाररजस्ट्थजतकी संवेिी िोन में, वार् ुप्रििूण के जनवारण और जनर्ंत्रण का वार् ु (प्रििूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार अनुपालन दकर्ा िाएगा।
(8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सरण, साधारण मानकों के उपबंधों के अनसुार पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आने वाल ेपर्ाावरणीर् प्रििूण के जनस्ट्सरण के जलए साधारण मानकों र्ा संघ राज्र् के्षत्र सरकार द्वारा जनर्त मानकों, िो भी अजधक कठोर हो, के उपबंधों के अनुसार होगा।
(9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1357(अ), तारीख 8 अप्रैल, 2016 के द्वारा प्रकाजित ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा;
(ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।
(10) िवै जचदकत्सा अपजिष् ट.- िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा.- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016 के द्वारा प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा;
(ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।
(11) प्लाजस्ट्टक अपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7
(12) जनमााण और जवध्वसं अपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सां.का.जन 317(अ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
(13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत द्वारा प्रकाजित ई–अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
(14) र्ानीर् र्ातार्ात.- र्ातार्ात की र्ानीर् गजतजवजधर्ां आवास के अनुकूल जवजनर्जमत होंगी और इस संबंध में आंचजलक महार्ोिना में जविेि उपबंध सजम्मजलत दकए िाएंगे और आंचजलक महार्ोिना के तैर्ार होने और संघ राज्र् के्षत्र सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित होन ेतक, मानीटरी सजमजत सुसंगत अजधजनर्मों और उसके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार र्ानीर् दक्रर्ाकलापों के अनपुालन की मानीटरी करेगी।
(15) र्ानीर् प्रििूण.- लाग ूजवजधर्ों के अनुपालन में र्ान प्रििूण का जनवारण और जनर्ंत्रण दकर्ा िाएगा और स्ट्वच्छक ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे।
(16) औद्योजगक ईकाइर्ा.ं- (क) रािपत्र में इस अजधसूचना के प्रकािन पर र्ा उसके पिात पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिजूित उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी। (ख) केन्र्द्ीर् प्रििूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी समर्-समर् पर र्था संिोजधत मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रििूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रििूणकारी उद्योगों को बढ़ावा दिर्ा िाएगा।
(17) पहाड़ी ढलानों को सरंक्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार होगा:- (क) आंचजलक महार्ोिना पहाड़ी ढलानों पर क्षेत्रों का संकेत होगा िहां दकसी भी संजनमााण की अनुज्ञा नहीं िी िाएगी;
(ख) कटाव के एक उच्च जडग्री के साथ जवद्यमान खड़ी पहाड़ी ढलानों र्ा ढलानों पर दकसी भी संजनमााण की अनुज्ञा नहीं िी िाएगी ।
4. पाररजस्ट्थजतकी सवंिेी िोन में प्रजतजिद्ध और जवजनर्जमत दकए िान ेवाल ेदक्रर्ाकलापों की सचूी.- पाररजस्ट्थजतकी संवेिी िोन में सभी दक्रर्ाकलाप पर्ाावरण अजधजनर्म के उपबंधों और उसके अधीन बनाए गए जनर्मों जिसके अन्तगात तटीर् जवजनर्मन िोन, 2011 और पर्ाावरणीर् समाघात जनधाारण अजधसूचना, 2006 और अन्र् लागू जवजधर्ों के जिसमें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53), सजम्मजलत हैं और दकर् ेगर्े संिोधनों द्वारा िाजसत होंगे और नीचे िी गई सारणी में जवजनर्िाष्ट रीजत में जवजनर्जमत होंगे, अथाात ्:- सारणी क्रम स.ं दक्रर्ाकलाप वणान क. प्रजतजिद्ध दक्रर्ाकलाप
1. वाजणजज्र्क खनन, पत्थर उत्खनन और अपघिाण इकाइर्ां। (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेलू आवश्र्कताओं जिसमें मकानों के संजनमााण र्ा मरम्मत के जलए धरती को खोिना सजम्मजलत ह,ै के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनि), पत्थर उत्खनन और अपघिाण इकाइर्ां तत्काल प्रभाव से प्रजतजिद्ध होंगी;
(ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) सं. 202 में 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामल े में माननीर् उच्चतम न्र्ार्ालर् के आिेि 4 अगस्ट्त, 2006 और 2012 की ररट र्ाजचका (जसजवल) सं. 435 में गोवा फाउंडेिन बनाम भारत संघ के मामले में तारीख 21 अप्रलै, 2014 के आििे के अनुसरण में होगा ।
2. प्रििूण (िल, वार्ु, मृिा, ध्वजन, आदि) उत्पन करन ेवाल ेउद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगान ेऔर वतामान प्रििूणकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नहीं होगी:
परंत ुर्ह दक, केन्र्द्ीर् प्रििूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी समर्-समर् पर र्था संिोजधत मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में ऐसा जवजनर्िाष्ट न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गैर- प्रििूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि गरै-प्रििूणकारी कुटीर उद्यागों को बढ़ावा दिर्ा िाएगा।
3. बृहत िल जवदु्यत पररर्ोिना की स्ट्थापना। प्रजतजिद्ध।
4. दकसी पररसंकटमर् पिाथा का उपर्ोग र्ा उत्पािन र्ा प्रसंस्ट्करण। प्रजतजिद्ध।
5. प्राकृजतक िल जनकार्ों र्ा क्षेत्र भूजम में अनुपचाररत बजहस्रााव का जनस्ट्सारण । प्रजतजिद्ध।
6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई आरा जमलों की स्ट्थापना और जवद्यमान आरा जमलों का जवस्ट् तार अनुज्ञात नहीं होगा।
7. ईंट भट्टों की स्ट्थापना करना। प्रजतजिद्ध।
8. िलावन लकड़ी का वाजणजज्र्क उपर्ोग । प्रजतजिद्ध। आ. जवजनर्जमत दक्रर्ाकलाप
9. वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना । पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों लघु अस्ट्थार्ी संरचनाओं के जसवार् संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक ,इनमें िो भी जनकट है , नए वाजणजज्र्क होटल और ररसोटों को अनुज्ञात नहीं दकर्ा िाएगा:
परंत ुर्ह दक, संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के परे र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक इनमें से, िो भी जनकट हो सभी नए पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान दक्रर्ाकलाप का जवस्ट्तार पर्ाटन महार्ोिना और र्था लाग ूमागाििी जसद्धांतों के अनुरुप होगा।
10. संजनमााण दक्रर्ाकलाप । )क (संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट हो , दकसी भी प्रकार के नर् े वाजणजज्र्क संजनमााण की अनुज्ञा नहीं होगी:
परंत ु र्ह दक, स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत आवश्र्कताओं को पूरा करन े के जलए, पैरा 3 के उप पैरा )1 (में सूचीबद्ध दक्रर्ाकलापों सजहत अपने उपर्ोग के जलए, अपनी भूजम में भवन उप-जवजधर्ों के अनुसार, संजनमााण करन ेकी अनुज्ञा होगी:
[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 परंत ु र्ह दक, गैर–प्रििूणकारी लघु उद्योगों से संबंजधत संजनमााण दक्रर्ाकलाप लागू जनर्मों और जवजनर्मों ,र्दि कोई हों , के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत से जवजनर्जमत दकए िाएंगे और वे न्र्ूनतम होंगे । (ख) एक दकलोमीटर क्षेत्र से परे र् े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे ।
11. प्रििूण उत्पन्न न करन ेवाले लघु उद्योग। फरवरी, 2016 में केन्र्द्ीर् प्रििूण जनर्ंत्रण बोडा द्वारा िारी उद्योगों में वगीकरण के अनुसार समर्-समर् पर र्था संिोजधत गैर- प्रििूणकारी उद्योग और अपररसंकटमर् में, लघु और सेवा उद्योग, कृजि, पुष्प कृजि, उद्यान कृजि र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्री से उत्पािों को उत्पन्न करने वाले कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे।
12. वृक्षों की कटाई। (क) संघ राज्र् क्षेत्र सरकार में सक्षम प्राजधकारी की पूवा अनुज्ञा के जबना वन, सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर र्ा वनों में वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत कें र्द्ीर् र्ा संघ राज्र् क्षेत्र अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंध के अनसुार जवजनर्जमत होगे।
13. वन उत्पािों र्ा गैर काष् ठ वन उत्पािों का संग्रहण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
14. जवदु्यत और संचार टावरों का पररजनमााण और केबलों के जबछाए िान े और अन्र् बुजनर्ािी ढांचे । लाग ू जवजधर्ों के अधीन जवजनर्जमत होंग े और भूजमगत केबल के जबछाए िाने को बढ़ावा दिर्ा िा सकेगा।
15. नागररक सुख सुजवधाओं सजहत अवसंरचनाएं । न्र्ूनीकरण उपार्ों को लागू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाएगा।
16. जवद्यमान सड़कों को चौड़ा करना और उन्हें सुिढृ़ करना तथा नवीन सड़कों का संजनमााण । न्र्ूनीकरण उपार्ों को लाग ूजवजधर्ों, जनर्मों और जवजनर्मनों तथा उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाएगा।
17. पर्ाटन से संबंजधत अन्र् दक्रर्ाकलाप िैसे गमा वार् ु गुब्बारें, हलेीकॉप्टर, ड्रोन, माइक्रोलाइटस, आदि द्वारा पाररजस्ट्थजतकी संवेिी िोन क्षते्र के ऊपर से उड़ना िैसे दक्रर्ाकलाप करना। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
18. पहाड़ी ढालों और निी तटों का संरक्षण। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
19. राजत्र में र्ाजनक र्ातार्ात का संचलन। लाग ू जवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होंगे ।
20. स्ट्थानीर् समुिार्ों द्वारा चल रही कृजि और बागवानी प्रथाओं के साथ िगु्धिाला, िगु्घ उद्योग, कृजि और मछली पालन । स्ट्थानीर् लोगों के उपर्ोग के जलए लागू जवजधर्ों के अधीन अनुज्ञात होंगे।
21. प्राकृजतक िल जनकार्ों र्ा सतही के्षत्र में उपचाररत बजहस्रााव का जनस्ट्तारण । िल जनकार्ों में उपचाररत अपजिष्ट िल र्ा बजहस्रााव के जनस्ट्सारण से बचा िाएगा और उपचाररत अपजिष्ट िल के 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पुन:चक्रण और पुन:उपर्ोग के जलए प्रर्ास दकए िाएगंे। अन्र्था लागू जवजधर्ों के अनुसार उपचाररत बजहस्रााव के पुनचाक्रण र्ा प्रवाह के जनवाहन को जवजनर्जमत दकर्ा िाएगा।
22. सतही और भूिल का वाजणजज्र्क जनष्किाण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
23. फमों, जनगम और कंपजनर्ों द्वारा बडे़ पैमाने पर वाजणजज्र्क पिओुं और कुक्कुट फामों की स्ट्थापना । स्ट्थानीर् आवश्र्कताओं को पूरा करन ेके अलावा लाग ूजवजधर्ों के अधीन जवजनर्जमत )अन्र्था उपबंध को छोड़कर ( होंग े।
24. खुले कंुआ ,बोर कंुआ ,आदि कृजि और अन्र् उपर्ोग के जलए । सम्बद्ध प्राजधकारी द्वारा दक्रर्ाकलापों की सख्ती से मानीटरी की िार्ेगी।
25. ठोस अपजिष्ट का प्रबन्धन। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
26. जविेिी प्रिाजतर्ों को लाना । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
27. पाररजस्ट्थजतकी पर्ाटन। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
28. पोजलथीन बैगों का प्रर्ोग । पाररजस्ट्थजतकी संवेिी िोन के भीतर पोजलथीन बैग के उपर्ोग की अनुमजत ह:ै परंतु र्ह दक, जवजिष्ट आवश्र्कता के आधार पर, इसे लाग ू जवजधर्ों के अनुसार जवजनर्जमत दकर्ा िाएगा।
29. वाजणजज् र्क सूचनापट्ट और होर्डंग। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे । इ. सवंर्धात दक्रर्ाकलाप
30. विाा िल संचर्न। सदक्र र् रूप से बढ़ावा दिर्ा िाएगा।
31. िैजवक खेती। सदक्र र् रूप से बढ़ावा दिर्ा िाएगा।

6. जवचाराथा जविर्.- (1) मानीटरी सजमजत इस अजधसूचना के उपबंधों के अनुपालन की मानीटरी करेगी।
(2) मानीटरी सजमजत का कार्ाकाल अगल ेआिेि होने तक दकर्ा िाएगा, परंत ुर्ह दक सजमजत के गैर-सरकारी सिस्ट्र्ों को समर्-समर् पर संघ राज्र् क्षेत्र सरकार द्वारा नामजनर्िाष्ट दकर्ा िाएगा।
(3) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ.
1533 (अ), तारीख 14 जसतम्बर, 2006 की अनुसूची में सजम्मजलत हैं, और िो पाररजस्ट्थजतकी संवेिी िोन में आत ेहैं, जसवार् इसके िो पैरा 4 के अधीन सारणी में र्था जवजनर्िाष्ट प्रजतजिद्ध दक्रर्ाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त के जलए केर्द्ींर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को जनर्िाष्ट दकर्ा िाएगा।
(4) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533 (अ) तारीख 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत नहीं ह,ै और िो पाररजस्ट्थजतकी संवेिी िोन में आत ेहैं, जसवार् इसके पैरा 4 के अधीन सारणी में र्थाजवर्नाष्ट प्रजतजिद्ध दक्रलाकलापों के मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे संबंद्ध जवजनर्ामक प्राजधकरणों को जनर्िाष्ट दकर्ा िाएगा।
(5) मानीटरी सजमजत का सिस्ट्र्-सजचव र्ा संबद्ध उपार्ुि ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लघंन करता ह,ै पर्ाावरण अजधजनर्म की धारा 19 के अधीन पररवाि फाइल करन ेके जलए सक्षम होगा।
(6) मानीटरी सजमजत मुद्दा िर मदु्दा के आधार पर अपेक्षाओं पर जनभार रहत े हुए संबद्ध जवभागों के प्रजतजनजधर्ों र्ा जविेिज्ञों, औद्योजगक संगमों र्ा संबद्ध पणधाररर्ों के प्रजतजनजधर्ों को अपन ेजवचार-जवमिा में सहार्ता के जलए आमंजत्रत कर सकेगी । 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(8) केन्र्द्ीर् सरकार का पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् मानीटरी सजमजत को अपन ेकृत्र्ों के प्रभावी जनवाहन के जलए ऐसे जनिेि िे सकेगा, िो वह ठीक समझे ।

8. कोई अन् र् महत् वपूणा जविर् । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 13th October, 2021 S.O. 4262(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O 121(E), dated the 12 th January, 2021, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 13 th January, 2021;
AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the aforesaid draft notification;
AND WHEREAS, the Kishtwar High Altitude National Park was named after well-known and old town of “Kishtwar” which forms its gateway, it is spread over the undulating terrain of the great Himalayan Mountains with an area of 2191.50 square kilometres in Kishtwar District, Jammu and Kashmir, and the said National Park is located about 60 kilometres North from Kishtwar town and is 230 kilometres away from Jammu;
AND WHEREAS, the Kishtwar High Altitude National Park was declared as a National Park vide notification number FST-20 of 1981, dated the 4 th February, 1981, with an area of 425 square kilometers, and the Jammu and Kashmir Government re-notified the Kishtwar High Altitude National Park vide notification no. SRO-212, dated the 6 th July 2015, comprising an area of 2191.50 square kilometres;
AND WHEREAS, the Kishtwar High Altitude National Park and its adjacent forest area are given priority in order to protect its endemic wildlife, the area supports viable population of the endangered biodiversity and represents the “gene pool” for propagation, protection and perpetuation of manywild flora and fauna species;
AND WHEREAS, the Kishtwar High Altitude National Park is known to harbour the highly endangered species such as hangul or Kashmiri stag (Cervus elaphus hangul) and muskdeer (Moschus crysogater) and there are about 25 species of mammals and over 200 species of birds reported in the territories of the said National Park;
[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 19 AND WHEREAS, the protected area provides shelter to a large number of endangered, rare herbivore and carnivore animals like Asiatic black bear (Ursus thibetanus), Himalayan brown bear(Ursus arctos isabellinus), goral (Naemorhedus goral), Himalayan langur (Semnopithecus ajax), leopard (Panthera pardus), snow leopard (Panthera uncia), Ibex(Capraibex), Himalayan mouse hare (Ochotona roylei), Himalayan marmot (Marmot bobak), long tailed marmot (Marmot caudate), jackal (Canis aureus), red fox (Vulpes vulpes) and avi-faunal species like western tragopan (Tragopan melanocephalus), monal (Lophophorus impejanus), golden eagle(Aquila chrysaetos), snow partridge (Lerwa lerwa) and chakore pheasant (Alectoris chukar), Himalayan griffon vulture(Gyps himalayensis), bearded vulture (Gypaetus barbatus), Kashmir flycatcher (Ficedula subrubra) , etc;
AND WHEREAS, the area of Kishtwar High Altitude National Park is characterised by marked variation of topography, climate and altitude which have resulted into diversity of forest vegetation, and the lower catchment areas of all the three conspicuous nallahs, namely Kibar, Nanth and Kiyar carry forest growth on suitable aspects with increased admixture of miscellaneous species;
AND WHEREAS, the Kishtwar High Altitude National Park consists of moist deodar forest, western mixed coniferous forest, moist temperate deciduous forest, low level blue pine forest, west Himalayan upper oak-fir forest, chilgoza pine forest, dry deodar forest, parrotia (pohu) scrub forest, west Himalayan high level dry blue pine forest, west Himalayan sub-alpine birch/fir forest, sub-alpine pastures, birch/rhododendron scrub forest, alpine pastures and due to the high elevation and good moisture regime, the fir forests are predominant over deodar-kail forest, and the broad-leaved species are confined to the sides of nallahs and on cooler and damp sites, Parrotia also occurs in patches and the area also has a vast diversity of important medicinal plants like Saussurea lappa, Diascoria spp, Podophyllum spp, Belladona spp, Bergenia spp, Skimmea spp, Piccorhiza spp and Aconitum spp, etc;
AND WHEREAS, the catchments of the said National Park are source of drinking and irrigation water to dozens of villages falling down stream to the protected area, besides feeding source to the famous River Chenab of Jammu Provence;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries which are specified in paragraph 1, around the protected area of Kishtwar High Altitude National Park as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and
(xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0.51 kilometersto 10.106kilometers around the boundary of Kishtwar High Altitude National Park, in the Union territory of Jammu and Kashmir as Kishtwar High Altitude National Park Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely : -
1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be of 547.09 square kilometers with an extent 0.51 kilometers to 10.106 kilometers around the boundary of Kishtwar High Altitude National Park.
(2) The boundary description of Kishtwar High Altitude National Park and its Eco-sensitive Zone is appended as Annexure-I.
(3) The maps of the Kishtwar National Park demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-II A, Annexure-IIB,Annexure-IIC and Annexure-IID
(4) Lists of geo co-ordinates of the boundary of Kishtwar High Altitude National Park and Ecosensitive Zone are given in Table A and Table B of Annexure-III.
(5) There are no villages falling within the Eco-sensitive Zone.
2. Zonal Master Plan for Eco-sensitive Zone.-(1) The Union territory Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification and get it duly approvedby the competent authority in the Union territory.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the Union territory Government in such manner as is specified in this notification and also in consonance with the relevant Central and Union territory laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the Union territory Government, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment, Forests and Wildlife Protection Department of Jammu and Kashmir Government;
(ii) Jammu and Kashmir Pollution Control Board;
(iii) Housing and Urban Development Department;
(iv) Tourism Department;
(v) Rural Development Department;
(vi) Irrigation and Flood Control Department;
(vii) Public Works and Power Development Department;
(viii) Revenue Department;
(ix) Disaster Management,
(x) Agriculture Department;
(xi) Municipal Corporation, Jammu;
(xii) Department of Town Planning, Jammu.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall provide mechanism for regulating developmental activities in Ecosensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved by the Union territory Government shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by Union territory Government.-The Union territory Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purposes other than that specified in clause (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 21 authority under Regional Town Planning Act and other rules and regulations of the Central Government or Union territory Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Union territory Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the Union territory Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the Union territory Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Ecosensitive Zone.
(b) The Tourism Master Plan shall be prepared by the Union territory Department of Tourism in consultation with the Union territory Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Ecosensitive Zone.
(e) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometer from the boundary of the protected area or up to the extent of the Eco-sensitive Zone, whichever is nearer:
Provided that beyond the distance of one kilometer from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Ecosensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the ecotourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution. -Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made there under or standards stipulated by the Union territory Government, whichever is more stringent.
(9) Solid wastes. -Disposal and management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.
(10) Bio-medical waste.– Bio-medical waste management shall be as under:-
(a) the Bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R.
343 (E), dated the 28 th March, 2016;
(b) safe and Environmentally Sound Management of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Ecosensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.
(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.

(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the Union territory Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be in compliance with applicable laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Ecosensitive Zone shall be governed by the provisions of the Environment Act and the rules made thereunder including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within Ecosensitive Zone;
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (water, air, soil, noise, etc.).
New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:
Provided that, non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project.
Prohibited.

4. Use or production or processing of any hazardous substance.
Prohibited.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited.
6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited.
8. Commercial use of firewood Prohibited.
B. Regulated Activities
9. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
10. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents:
Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission of the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
11. Small scale non-polluting industries.
Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016, as amended from time to time and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent authority.
12. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the Union territory Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or Union territory Act and the rules made thereunder.
13. Collection of Forest Produce or Non-Timber Forest Produce.
Regulated under applicable laws.
14. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable laws and underground cabling may be promoted.
15. Infrastructure including civic amenities.
Taking measures of mitigation, as per applicable laws, rules and regulations and available guidelines.
16. Widening and strengthening of existing roads and construction of new roads.
Taking measures of mitigation, as per applicable laws, rules and regulations and available guidelines.
17. Undertaking other activities related to tourism like over flying over the Eco-sensitive Zone area by hot air balloon, helicopter, drones, microlites, etc.
Regulated as per the applicable laws.
18. Protection of hill slopes and river banks.
Regulated as per the applicable laws.
19. Movement of vehicular traffic at night.
Regulated for commercial purpose under applicable laws.
20. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted as per the applicable laws for use of locals.
21. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per the applicable laws.
22. Commercial extraction of surface and ground water.
Regulated under applicable laws.
23. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies.
Regulated (except as otherwise provided) as per applicable laws except for meeting local needs.
24. Open well, bore well, etc. for agriculture or other usage.
Regulated and the activity should be strictly monitored by the concerned authority.
25. Solid waste management. Regulated as per the applicable laws.
26. Introduction of exotic species. Regulated as per the applicable laws.
27. Eco-tourism. Regulated as per the applicable laws.

Bio-gas, solar light, etc. shall be actively promoted.

38. Skill development. Shall be actively promoted.
39. Restoration of degraded land/ forests/ habitat.

5. Monitoring Committee for Monitoring Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification, under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely: - S. 6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring Committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the Union territory Government from time to time.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-Sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the Union territory as per proforma appended as Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional measures.- The Central Government and Union territory Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. Supreme Court, etc. orders.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
