PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार् ुपररवतान मतं्रालर् अजधसचूना नई दिल्ली, 25 नवम् बर, 2020 का.आ. 4268(अ).—प्रारुप अजधसूचना भारत के रािपत्र, असाधारण में भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 174(अ), तारीख 10 जनवरी, 2020, द्वारा प्रकाजित की गई थी जिसमें ऐसे सभी व्यजिर्ों से, जिनके उससे प्रभाजवत होन ेकी संभावना थी, उस तारीख से, जिसको उि अजधसूचना में अन्तर्वाष्ट रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षपे और सुझाव आमंजत्रत दकए गए थ;े और, उि प्रारूप अजधसूचना में अन्तर्वाष्ट रािपत्र की प्रजतर्ां िनता को तारीख 10 जनवरी, 2020, को उपलब्ध करा िी गई थी;

और, पूवोक्त प्रारुप अजधसूचना के प्रत्र्ुतर में व्यजिर्ों और पणधाररर्ों से प्राप्त आक्षेपों और सुझावों पर मंत्रालर् में जवचार दकर्ा गर्ा था;

और, मुकन्िरा जहल्स टाइगर ररज़वा (एम एच टी आर) का गठन 2013 में दकर्ा गर्ा था, जिसमें मुकन्िरा जहल्स राष्ट्रीर् उद्यान, िारा अभर्ारण्र्, िवाहर सागर अभर्ारण्र् और राष्ट्रीर् चंबल घज़िर्ाल अभर्ारण्र् (गरदिर्ा महािेव से िवाहर सागर बांध तक) का क्षेत्र सम्ममम्ित ह,ै िो दक राजस्थान राज्य में मुकन्िरा जहल्स टाइगर ररज़वा के कोर क्षेत्र का गठन करता ह;ै स.ं 3763] नई दिल्ली, िुक्रवार, नवम् बर 27, 2020/अग्रहार्ण 6, 1942 No. 3763] NEW DELHI, FRIDAY, NOVEMBER 27, 2020/AGRAHAYANA 6, 1942 सी.जी.-डी.एल.-अ.-28112020-223409 CG-DL-E-28112020-223409 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, टाइगर ररज़वा 759.99 वगा दकलोमीटर क्षेत्रफल में फैला हुआ ह ै और रािस्ट्थान राज्र् में कोटा जिला के लाडपरुा, संगोि, रामगंिमंडी तहसील, झालावर जिला के झालरपटन तहसील, बंूिी जिला के तलरेा तहसील और जचत्तौ़िगढ़ जिला के रावतभाटा तहसील में जस्ट्थत ह।ै िवाहर सागर अभर्ारण्र् उत्तर अक्षािं 240-56' से 250 7.5’ और पूवा िेिांतर 750 26.50’ से 750 41’ के बीच जस्ट्थत ह।ै र्ह रावतभाटा से 35 दकलोमीटर और बंूिी से 75 दकलोमीटर में जस्ट्थत ह ैऔर र्ह रािस्ट्थान सरकार की अजधसूचना संख्र्ा एफ 3(5) (13) आरईवी. 18/73 दिनांक 9 अक्टूबर, 1975 को अभर्ारण्र् के रुप में घोजित दकर्ा गर्ा था;

और, मुकन्िरा जहल्स टाइगर ररज़वा का नाम संकीणा कें द्रीर् रेंि के साथ िो जनरंतर समतल टॉप और प्रार्ः समानांतर पहाज़िर्ों के साथ रखा गर्ा ह,ै िो ववंध्र् रेंि प्रणाली का भाग ह,ै िो चंबल निी से कलीवसंध तक फैली हुई ह ैऔर लगभग 80 दकलोमीटर लंबाई में और 2 से 5 दकलोमीटर की चौ़िाई में ह;ै और, मुकन्िरा जहल्स टाइगर ररज़वा न केवल दशृ्य संुिरता और िैव जवजवधता से समृद्ध ह,ै बजल्क रणथंभौर से कम से कम िो संभाव्य गजलर्ारे हैं - एक इंद्रगढ़ के माध्र्म से - लखेरी - रामगढ़ जविधारी अभर्ारण्र्- िाबी- िवाहर सागर अभर्ारण्र् और अन्र् चंबल और कालीवसंध से िारा के िरों के माध्र्म ह।ै हालााँदक, इस समृद्ध प्राकृजतक जवरासत को संरजक्षत करने के जलए, रणथंभौर टाइगर ररिवा के बाघों को सुरजक्षत मागा/गजलर्ारा प्रिान करने और क्षेत्र में बाघों को दफर से लाने के जलए जविेि प्रर्ासों की आवश्र्कता ह।ै इसजलए इसे जविेि जवजध संरक्षण दिर्ा गर्ा ह ैिो इसे टाइगर ररज़वा के रूप घोजित करके वन्र्िीव संरक्षण अजधजनर्म-1972 की धारा 38 (V) के अधीन उपलब्ध ह;ै और, मुकन्िरा जहल्स टाइगर ररज़वा (एमएचटीआर) घन ेवन (कैनोपी का घनत्व 0.6 से 0.7) से र्ुि ह ैऔर ढोक और खैर प्रमुख प्रिाजतर्ााँ हैं। र्हां िैवाल, कवक, ब्रार्ोफाइट्स, टेररडोफाइट्स और एंजिर्ोस्ट्पमा की कई प्रिाजतर्ां उपलब्ध हैं। र्ह आर्काड और ट्यूबोरस् पौधों में भी समृद्ध ह।ै घाटी और धाराएं औिधीर् पौधों की कई प्रिाजतर्ों का वास ह।ै एथनो औिधीर् िजृष्टकोण से उनमें से ब़िी संख्र्ा बहुत महत्वपूणा ह।ै संरजक्षत क्षेत्र में मुख्र् वनस्ट्पजत प्रिाजतर्ां वहगंोट (बालानाइट्स एजिजटटका), खखारो (ब्र्ूरटर्ा मोनोसपमाा), खिूर (फोजनक्स जसल्वेस्ट्रीस), जवलार्जत बबुल (प्रोसोजपस िूलीफ्लोरा), खैर (अकेजिर्ा कैटेचु), धव़िा (एनोगाइजसस लेरटफोजलर्ा), कलम (जमत्राजगनपर्वाफ्लोरा), अिुासा (अडाटोडा वाजसका), जलसोडा (कॉर्डार्ा मार्क्सा), कडार्ा (स्ट्टकुा जलर्ा र्रेून्स), आदि उपलब्ध हैं;

और, मुकन्िरा जहल्स टाइगर ररज़वा दकसी समर् भारतीर् राष्ट्रीर् पि ुऔर फ्लगैजिप प्रिाजत टाइगर का बहुत ही अच्छा वास था। टाइगर ररज़वा िलुाभ और लुप्तप्रार् िीविंत ु िैसे रीछ (मेलासास र्ूर्सानस), सांभर (करवस र्ूजनकोलर), रतेल (मालीवोरा कैपेजन्सस), सामान्य लगंूर (प्रेजस्ट्बरटस एंटेलस), िंगली सूअर (सुस स्ट्क्रोफा), पैंथर (पेंथरेा पाडास), ब्ल ूबुल (बोसेलाफस रागोकैमेलस), जसर्ार (कैजनस ओरेस), धारीिार लक़िबग्गा (हाइना हाइना), जचत्तीिार जहरण (एजक्सस एजक्सस), भारतीर् साही (जहजस्ट्ट्रक्स इंजडका), मॉजनटर जछपकली (वारनस बेंगालेंजसस), पार्थन (पार्थॉन मोलसास), रैट स्नेक (पाइटस म्र्ूकोसस), रसेल वाइपर (वाइपर रसेली), भारतीय कोबरा (नाज़ा नाज़ा), आदि को संरक्षण प्रिान करता ह;ै और, संरजक्षत क्षेत्रों से मुख्र् पक्षी िीव जलरटल ग्रेबे (टेकीबैटटस रूदफकोजलस), ग्रेट कॉमोरेंट (फेलाक्रोकैरेक्स काबो), सामान्य ककंगदफिर (एलेडेसो एजथस), रेड वॉटल्ड लपैववंग (वनीलस इंजडकस), रॉक कबूतर (कोलंबा जलजवर्ा), रोि ररंग्ड पैराकेट (जसरटटाकुला र्ुपैरीर्ा), टलम हडेेड परैाकेट (जसटाकुला सार्नोसेफाला), रूफस रीपी (डेंड्रोदकट्टा वेिुबुन्डा), ओररएंटल मैगपाई रॉजबन (कोजटसकस सैलाररस), सामान्य बब्बलर (टबााइडस क्रु्डाटस), छोटा इग्रेट (इग्रेटा गािेटा), आदि, अजभजलजखत दकर् ेगर् ेहैं;

और, संरजक्षत क्षेत्र में महत्वपूणा िलुाभ, लपु्तप्रार् और संकटापन्न प्रिाजतर्ां एमोफोरलस पेओजनफोजलर्स, एनोगाइजसस सेररजसर्ा, बाउजहजनर्ा वाहली, ररबुलस रािस्ट्थाजनजसस, एनोगेइसस लैरटफोजलर्ा, कोनीफोरा वाइटी, अकेजिर्ा कैटेचु, अकेजिर्ा ल्र्कूोफोजलर्ा, भेज़िर्ा, लोम़िी और पायथन उपलब्ध हैं;

[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 और, संरजक्षत क्षेत्र में कुछ महत्वपूणा पुरातत्व स्ट्थल भी हैं िैसे दक गरगोन दकला िो एक र्नूेस्ट्को की जवश्व धरोहर स्ट्थल ह,ै अबली मीजनका महल, रौंथा महल, मंदिरों का बिोली समूह आदि। कुछ महत्वपूणा धार्माक तीथा स्ट्थल हैं गर्िार्ा महािेव, गपेरनाथ, अंबरानी मातािी, नाहर वसंह मातािी आदि। चंबल की संुिर घारटर्ां और अजद्वतीर् भू-िशृ्र् टाइगर ररिवा का भाग ह।ै मुकन्िरा जहल्स टाइगर ररज़वा कलीवसंध, आहु, अमझर, इरु, ब्राह्मणी और चंबल िैसी नदिर्ों के िलग्रहण क्षेत्र के रूप में कार्ा करती ह।ै लक्ष्मीपरुतालई, बेवडातलाई, कडपकखल और चंबल निी िैसे िल जनकार् प्रवासी पजक्षर्ों को बहुत आकर्िात करते हैं। हालााँदक, मुकन्िरा जहल्स टाइगर ररज़वा पर्ाटकों को एक काल्पजनक आकिाण प्रिान करता ह।ै र्ह पाररजस्ट्थजतकी पर्ाटन को बढ़ावा िेने की अच्छी सुजवधा ह ैिो ररज़वा में बाघों को लाए िान ेके साथ बढे़गा;

और, मुकन्िरा जहल्स टाइगर ररज़वा और के चारों ओर के क्षेत्र को, जिसका जवस्ट्तार और सीमाऐं इस अजधसूचना के पैरा 1 में जवजनर्िाष्ट हैं, पर्ाावरण की िजृष्ट से पाररजस्ट्थजतकी संवेिी िोन के रूप में सुरजक्षत और संरजक्षत करना और उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों के वगो के प्रचालन और प्रसंस्ट्करण करन ेको प्रजतजिद्ध करना आवश्र्क ह;ै अतः, अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इसमें इसके पश्चात ्पर्ाावरण अजधसूचना कहा गर्ा ह)ै की धारा 3 की उपधारा (1) तथा उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत ेहुए, राजस्थान राज्र् में कोटा, झालावर, बंूिी, जचत्तौ़िगढ़ म्जिा मुकन्िरा जहल्स टाइगर ररज़वा की सीमा के चारों ओर 0 (शून्य) से 1.0 ककिोमीटर तक जवस्ट् ताररत क्षेत्र को पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके पश् चात ् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती ह,ै जिसके ब्यौरे जनम्नानुसार ह,ै अथाात:्-

1. पाररजस्ट्थजतकी सवंिेी िोन का जवस्ट्तार और उसकी सीमाएं.-(1) पाररजस्ट्थजतकी संवेिी िोन का म्वस्तार मुकन्िरा जहल्स टाइगर ररज़वा की सीमा के चारों ओर 0 (शून्य) से 1.0 ककिोमीटर तक म्वस्तृत ह ैऔर पाररम्स्थम्तकी संवेदी जोन का क्षेत्रफि 248.70 वर्ग ककिोमीटर ह।ै राज्य सरकार द्वारा पाररम्स्थम्तकी संवेदी जोन के शून्य म्वस्तार को उम्चत ठहराया र्या ह ैमुकन्िरा जहल्स टाइगर ररज़वा के बफर क्षेत्र के साथ पाररजस्ट्थजतकी संवेिी िोन सह-समाजप्त के कारण ह।ै जवजभन्न दििाओं में पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार नीचे कदया र्या हःै दििा जवस्ट्तार (दकलोमीटर में) उत्तर 1.00 उत्तर-पूवा 0 से 1.00 पूवा 0 िजक्षण-पूवा 0 से 1.00 िजक्षण 0 से 1.00 िजक्षण-पजश्चम 0 पजश्चम 1.00 उत्तर-पजश्चम 1.00

(2) मुकन्िरा जहल्स टाइगर ररज़वा और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण उपाबधं-I के रुप में संिग्न ह।ै

(3) सीमा जववरण और अक्षांि और ििेांतर के साथ पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करत ेहुए मुकन्िरा जहल्स 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] टाइगर ररज़वा के मानजचत्र उपाबधं–IIक, उपाबधं–IIख, उपाबधं–IIर् और उपाबधं–IIघ के रुप में संिग्न ह।ै

(4) पाररजस्ट्थजतकी संवेिी िोन और मुकन्िरा जहल्स टाइगर ररज़वा की सीमा के भू-म्नदेशांकों की सूची उपाबधं-III की सारणी क और सारणी ख में िी गई ह।ै

(5) मुख्र् वबंिओुं के भू-म्नदेशाकंों के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगात आन ेवाल ेग्रामों की सूची उपाबधं-IV के रूप में संिग्न ह।ै

2. पाररजस्ट्थजतकी संविेी िोन के जलए आचंजलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्य के सक्षम प्राम्िकारी के अनुमोदन के म्िए इस अजधसूचना में दिए गए अनुबंधों का पालन करत े हुए आंचजलक महार्ोिना तैर्ार करेगी।

(2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत से िो इस अजधसूचना में जवजनर्िाष् ट दकए गए हैं के अनसुार तथा सुसंगत कें द्रीर् और राज् र् जवजधर्ों के अनुरुप और कें द्रीर् सरकार द्वारा िारी मागाजनिेिों, र्दि कोई हों, द्वारा तैर्ार होगी ।

(3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करने के जलए राज् र् सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार होगी, अथाात्:-

(i) पर्ाावरण;

(ii) वन और वन्र्िीव;

(iii) कृजि;

(iv) रािस्ट् व;

(v) शहरी जवकास;

(vi) पर्ाटन;

(vii) ग्रामीण जवकास;

(viii) वसंचाई और बाढ़ जनर्ंत्रण;

(ix) नगरपाम्िका;

(x) पंचार्ती राि;

(xi) लोक जन मााण जव भाग।

(4) आंचजलक महार्ोिना अनमुोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िाष् ट न हो और आचंजलक महार्ोिना सभी अवसंरचना और दक्रर्ाकलापों में िो अजधक िक्षता और पाररजस्ट्थजतकी अनुकूल हों का संवधान करेगी ।

(5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण से संबंजधत ऐसे अन्र् पहलओुं, जिन पर ध्र्ान िेना आवश्र्क ह,ै के जलए उपबंध होंगे ।

(6) आंचजलक महार्ोिना म्वद्यमान और प्रस्ताम्वत भूम्म उपयोर् म्वशेषताओं के ब्यौरों से अनुसमर्थगत मानम्चत्र के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, कृजि क्षेत्रों, ऊपिाऊ भूजम, हररत क्षेत्र िैसे उद्यान और उसी प्रकार के स्ट् थान, उद्यान कृजि क्षेत्र, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभ्र्कंन करेगी। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5

(7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करेगी और सारणी में सूचीबद्ध पैरा-4 में प्रजतजिद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन करेगी और स्ट् थानीर् समुिार्ों की जीम्वका को सुरम्क्षत करन ेके म्िए पाररजस्ट्थजतकी अनुकूल जवकास को सुम्नम्ित और उसकी अम्भवृम्ि भी करेर्ी।

(8) आंचजलक महार्ोिना प्रादेम्शक जवकास र्ोिना की सह जवस्ट्तारी होगी ।

(9) इस प्रकार अनुमोदित आंचजलक महार्ोिना इस अजधसूचना के उपबंधों के अनुसार मानीटरी के अपने कार्ों को करन ेके जलए मानीटरी सजमजत के जलए एक संिभा िस्ट्तावेि तैर्ार करेगी ।

3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्:-

(1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए जचजन्हत दकए गए उद्यानों और खुल ेस्ट्थानों का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक दक्रर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नहीं दकर्ा िाएगा:

परन्त ुपाररजस्ट्थजतकी संवेिी िोन के भीतर भाग (क), में जवजनर्िाष्ट प्रर्ोिन से जभन्न प्रर्ोिन के जलए कृजि और अन्र् भूजम का संपररवतान, मानीटरी सजमजत की जसफाररि पर और सक्षम प्राजधकारी के पूवा अनुमोिन से क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा र्था लाग ूकेन्द्रीर् सरकार और राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन तथा इस अजधसूचना के उपबंधों के अनसुार स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करने के जलए अनुज्ञात दकर्ा िाएगा:-

(i) जवद्यमान स़िकों को चौ़िा करना और उन्हें सुिढृ़ करना और नई स़िकों का संजनमााण;

(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;

(iii) प्रििूण उत्पन्न न करने वाल ेलघ ुउद्योग;

(iv) कुटीर उद्योगों जिनके अंतगात ग्रामीण उद्योग भी हैं; सुजवधािनक भंडार और स्ट्थानीर् सुजवधाएं सहार्क पाररजस्ट्थजतकी पर्ाटन जिसके अतंगात र्ृहवास सजम्मजलत ह;ै और

(v) पैरा 4 के अधीन दिए गए संवर्धात दक्रर्ाकलाप:

परंत ुर्ह और भी दक क्षेत्रीर् नगर र्ोिना अजधजनर्म के अधीन सक्षम प्राजधकारी के पूवा अनमुोिन के जबना तथा राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों और संजवधान के अनचु्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगात अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का प्रर्ोग अनुज्ञात नहीं होगा:

परंत ुर्ह और भी दक पाररजस्ट् थजतकी संवेिी िोन के भीतर आने वाली भूजम के अजभलेखों में हुई दकसी गलती को, मानीटरी सजमजत के जवचार प्राप्त करन ेके पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामल ेमें एक बार सुधारा िाएगा और उि गलती को सुधारन ेकी सूचना कें द्रीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को िी िाएगी:

परंत ुर्ह और भी दक उपर्ुाि गलती को सुधारन ेमें, इस उप-पैरा में र्था उपबंजधत के जसवार्, दकसी भी ििा में भू-उपर्ोग का पररवतान सजम्मजलत नहीं होगा;

(ख) वनीकरण तथा वास जीणोद्वार कियाकिापों सम्हत अनप्रयुक्त या अनुत्पादक कृम्ष क्षेत्रों में पुन: वनीकरण करने के प्रयास ककए जाएंर्े । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(2) प्राकृजतक िल स्रोत.- आंचजलक महार्ोिना में सभी प्राकृजतक िल स्त्रोतों के आवाह क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण के जलए र्ोिना सजम्मजलत होगी और राज् र् सरकार द्वारा ऐसे क्षेत्रों पर र्ा उनके जनकट जवकास दक्रर्ाकलापों प्रजतजिद्ध करने के बारे में िो ऐसे क्षेत्रों के जलए अजहतकर हो ऐसी रीजत से मागाििाक जसद्धांत तैर्ार दकए िाएंगे।

(3) पर्ाटन र्ा पाररजस्ट्थजतकी पर्ाटन.– (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी संवेिी िोन के जलए होगा । (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् पर्ाावरण और वन जवभागों के परामिा से राज्य पर्ाटन जवभाग द्वारा तैर्ार होर्ी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का घटक होगी । (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनम् नानुसार जवजनर्जमत दकए िाएंग ेअथाात्:-

(i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट हो दकसी होटल र्ा ररिॉटा का नर्ा सजन्नमााण अनजु्ञात नहीं दकर्ा िाएगा:

परन्तु संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर की िरूी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक होटलों और ररिॉटा का स्ट्थापन केवल पूवा पररभाजित और नामजनर्िाष्ट क्षेत्रों में पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए ही अनजु्ञात होगा;

(ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दक्रर्ा-कलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा िारी मागाििाक जसद्धांतो तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेने वाल ेराष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी मागाििाक जसद्धांतो (समर्-समर् पर र्था संिोजधत) के अनुसार होगा;

(iii) आंचजलक महार्ोिना का अनुमोिन होने तक, पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजनर्िाष्ट संवीक्षा तथा मानीटरी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए होटल, ररिाटा र्ा वाजणजज्र्क स्ट्थापन का संजन्नमााण अनजु्ञात नहीं होगा ।

(4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन में आन ेवाले बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन कोि आरजक्षत के्षत्र, िैल जवरचनाएं, िल प्रपातो, झरने, िरो, उपवनों, गुफाए,ं स्ट्थलों, वनपथ, रोहण मागा, उत्प्रपातो आदि की पहचान की िाएगी और उनकी सुरक्षा और संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी।

(5) मानव जनर्मात जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, कलाकृजत- क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी।

(6) ध् वजन प्रििूण.– पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रििूण (जवजनर्मन और जनर्तं्रण) जनर्म, 2000 में जनर्त उपबंधों के अनुसार में पाररजस्ट्थजतकी-संवेिी िोन में ध्वजन प्रििूण के जनर्ंत्रण और जनवारण का अनुपालन दकर्ा िाएगा।

(7) वार् ु प्रििूण.- पाररजस्ट्थजतकी संवेिी िोन में, वार् ु प्रििूण की जनवारण और जनर्ंत्रण, वार् ु (प्रििूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) के उपबंधों और उसके अधीन बनाए गए जनर्मों के अनुसार अनुपालन दकर्ा िाएगा। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7

(8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सारण, और पर्ाावरण अजधजनर्म अधीन बनाए गए जनर्मों के अिीन आन ेवािे पर्ाावरणीर् प्रििूण के जनस्ट्सारण संबंधी साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, इनमें िो भी अजधक कठोर हों, के अनुसार दकर्ा िाएगा।

(9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान और प्रबन्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1357 (अ), तारीख 8 अप्रलै, 2016 के अधीन प्रकाजित ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा;

(ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन (ईएसएम) अनजु्ञात दकर्ा जा सकेर्ा।

(10) िैव जचदकत्सा अपजिष् ट.- िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना सं.सा.का.जन. 343 (अ), तारीख 28 माचा, 2016 के द्वारा प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संविी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण-अनकूुल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।

(11) टलाजस्ट्टक अपजिष्ट का प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में टलाजस्ट्टक अपजिष्ट का प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 के द्वारा प्रकाजित टलाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधो के अनुसार दकर्ा िाएगा।

(12) जनमााण और जवध्वसं अपजिष्ट का प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में जनमााण और जवध्वंस अपजिष्ट का प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 317(अ), तारीख 29 माचा, 2016 के द्वारा प्रकाजित संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट का प्रबंधन का जनपटान भारत सरकार पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा प्रकाजित तथा समर्- समर् पर र्था संिोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(14) र्ानीर्-र्ातार्ात.- वाहन-र्ातार्ात का संचलन आवास-अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना में जविेि उपबंध सजम्मजलत दकए िाएंगे तथा आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित दकए िाने तक, मानीटरी सजमजत सुसंगत अजधजनर्मों और उनके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार वाहनों की आवािाही के अनुपालन की मानीटरी करेगी।

(15) र्ानीर् प्रििूण.- र्ानीर् प्रििूण की रोकथाम और जनर्तं्रण लागू जवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईंधन के उपर्ोग के प्रर्ास दकए िाएंग े।

(16) औद्योजगक ईकाइर्ा.ं- (i) रािपत्र में इस अजधसूचना के प्रकािन पर र्ा उसके पश्चात पाररजस्ट्थजतकी संवेिी िोन में दकसी नए प्रििूणकारी उद्योग की स्ट्थापना की अनजु्ञा नहीं िी िाएगी। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(ii) िब तक इस अजधसूचना में जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन में कें द्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी मागाििाक जसद्धांतो में दकए गए उद्योगों के वगीकरण के अनुसार केवल गैर-प्रििूणकारी उद्योगों की स्ट्थापना अनुज्ञात होगी। इसके अजतररि, गैर-प्रििूणकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा।

(17) पहा़िी ढलानों का सरंक्षण.- पहा़िी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना में पहा़िी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनमें दकसी भी संजनमााण की अनजु्ञा नहीं होगी । (ख) जिन ढ़लानों र्ा जवद्यमान ख़िी पहा़िी ढलानों में अत्र्जधक भू-क्षरण होता ह ै उनमें दकसी भी संजनमााण की अनजु्ञा नहीं िी िाएगी ।

4. पाररजस्ट्थजतकी संविेी िोन में प्रजतजिद्ध र्ा जवजनर्जमत दकए िान ेवाल ेदक्रर्ाकलापों की सचूी.- पाररजस्ट्थजतकी संवेिी िोन में सभी दक्रर्ाकलाप, पर्ाावरण अजधजनर्म, के उपबंिों और उसके अधीन बने जनर्मों म्जसके अंतर्गत तटीर् जवजनर्मन िोन, 2011 और पर्ाावरणीर् समाघात जनधाारण अजधसूचना, 2006 और अन्य िार् ू म्वम्ियों म्जसमें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) सम्ममम्ित ह ैतथा उनमें दकए गए संिोधनों के अनुसार िाजसत होंग ेऔर नीचे िी गई सारणी में जवजनर्िाष्ट रीजत से जवजनर्जमत होंगे, अथाात:्- सारणी क्रम स.ं

1. वाजणजज्र्क खनन, पत्थर उत्खनन और अपघिाण इकाइर्ां । (क) पाररजस्ट्थजतकी संवेिी िोन के अतंगात वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेल ू आवश्र्कताओं जिसमें मकानों के संजनमााण र्ा मरम्मत के जलए धरती को खोिना सजम्मजलत ह,ै के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनि), पत्थर उत्खनन और अपघिाण इकाइर्ां तत्काल प्रभाव से प्रम्तम्षि होगी;

(ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) सं.

202 में टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले में माननीर् उच्चतम न्र्ार्ालर् के आदेश 4 अगस्ट्त, 2006 और 2012 की ररट र्ाजचका (जसजवल) सं. 435 में गोवा फाउंडेिन बनाम भारत संघ के मामले में तारीख 21 अप्रैल, 2014 के आिेि के अनसुरण में होगा ।

2. प्रििूण (िल, वार्ु, मृिा, ध्वजन, आदि) उत्पन करन ेवाल ेउद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगान े और वतामान प्रििूणकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नहीं होर्ी:

परन्त ु यह कक केन्रीय प्रदषूण म्नयंत्रण बोर्ग द्वारा फरवरी, 2016 में जारी मार्ग दशगक म्सिान्तों में उद्योर्ों के वर्ीकरण [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 के अनुसार जब तक कक अम्िसूचना में ऐसा म्वम्नर्दगष्ट न हों, पाररम्स्थम्तकी संवेदी जोन के भीतर र्ैर-प्रदषूणकारी उद्योर्ों को अनुज्ञात ककया जाएर्ा और इसके अम्तररक्त र्ैर- प्रदषूणकारी कुटीर उद्यार्ों को बढावा कदया जाएर्ा।

3. बृहत िल जवदु्यत पररर्ोिना की स्ट्थापना । प्रम्तम्षि।

4. दकसी पररसंकटमर् पिाथग का उपर्ोग र्ा उत्पािन र्ा प्रसंस्ट्करण। प्रम्तम्षि।

5. प्राकृजतक िल जनकार्ों र्ा क्षेत्र भूजम में अनुपचाररत बजहस्रााव का जनस्ट्सारण । प्रम्तम्षि।

6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा जमलों का जवस्ट् तार अनजु्ञात नहीं होगा ।

7. ईंट भट्टों की स्ट्थापना करना। प्रम्तम्षि।

8. िलावन लक़िी का वाजणजज्र्क उपर्ोग। प्रम्तम्षि। ख. जवजनर्जमत दक्रर्ाकलाप

9. वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना । पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों लघु अस्ट्थार्ी संरचनाओं के जसवार् संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट ह,ै नए वाजणजज्र्क होटल और ररसोटों को अनुज्ञात नहीं दकर्ा िाएगा:

परंत ुयह कक संरम्क्षत के्षत्र की सीमा से एक ककिोमीटर के परे या पाररम्स्थम्तकी संवेदी जोन के म्वस्तार तक इनमें से जो भी म्नकट हो सभी नए पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान दक्रर्ाकलाप का जवस्ट्तार पर्ाटन महार्ोिना और र्था लाग ू मागाििी जसद्धांतों के अनुरुप होगा।

10. संजनमााण दक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के म्वस्तार तक, इनमें िो भी जनकट हो, दकसी भी प्रकार के नर्े वाजणजज्र्क संजनमााण की अनुज्ञा नहीं होगी:

परंत ु यह कक स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत आवश्र्कताओं को पूरा करन ेके जलए, पैरा 3 के उप पैरा (1) में सूचीबद्ध दक्रर्ाकलापों सजहत अपने उपर्ोग के जलए, अपनी भूजम में भवन उप-जवजधर्ों के अनुसार, संजनमााण करने की अनुज्ञा होगी, जैसे:- परंत ुयह और कक गैर–प्रििूणकारी लघ ुउद्योगों से संबंजधत संजनमााण दक्रर्ाकलाप लागू जनर्मों और जवजनर्मों, र्दि कोई 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुज्ञा से जवजनर्जमत दकए िाएंगे और वे न्र्ूनतम होंग े। (ख) एक दकलोमीटर क्षेत्र से परे र् ेआंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे ।

11. प्रििूण उत्पन्न न करन े वाले लघ ु उद्योग । फरवरी, 2016 में केन्द्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा िारी उद्योगों में वगीकरण के अनुसार गरै-प्रििूणकारी उद्योग और अपररसंकटमय में, लघ ु और सेवा उद्योग, कृजि, पुष्प कृजि, उद्यान कृजि र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्री से उत्पािों को उत्पन्न करन े वाल े कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे।

12. वृक्षों की कटाई । (क) राज्र् सरकार में सक्षम प्राजधकारी की पूवा अनजु्ञा के जबना वन, सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर र्ा वनों में वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत कें द्रीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंध के अनुसार जवजनर्जमत होगे ।

13. वन उत्पािों या गैर काष् ठ वन उत्पािों का संग्रहण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।

14. जवदु्यत और संचार टावरों का पररजनमााण और केबलों के जबछाए िाने और अन्र् बुजनर्ािी ढांचे । लाग ू जवजधर्ों के अधीन जवजनर्जमत होंगे। भूजमगत केबल के जबछाए िाने को बढ़ावा दिर्ा जा सकेर्ा।

15. नागररक सुख सुजवधाओं सजहत अवसंरचनाएं । न्र्ूनीकरण उपार्ों को िार् ूम्वम्ियों, जनर्मों और जवजनर्मनों और उपलब्ध मार्गदशगक म्सिांतों के अनुसार ककया जाएर्ा ।

16. जवद्यमान स़िकों को चौ़िा करना और उन्हें सुिढृ करना तथा नवीन स़िकों का संजनमााण । न्र्ूनीकरण उपार्ों को िार् ू म्वम्ियों, जनर्मों और जवजनर्मनों तथा उपलब्ध मार्गदशगक म्सिांतों के अनुसार ककया जाएर्ा ।

17. पर्ाटन से संबंजधत अन्र् दक्रर्ाकलाप िैसे गमा वार्ु गुब्बारें, हलेीकाटटर, ड्रोन, माइक्रोलाइटस आदि द्वारा पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से उ़िना िैसे दक्रर्ाकलाप करना। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।

18. पहा़िी ढालों और निी तटों का संरक्षण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।

19. राजत्र में र्ाजनक र्ातार्ात का संचलन । लाग ू जवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होंगे।

20. ध्वजन प्रििूण। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।

21. स्ट्थानीर् समुिार्ों द्वारा चल रही कृजि और बागवानी प्रथाओं के साथ दगु्ििाला, िगु्घ उद्योग, कृजि और स्ट्थानीर् लोगों के उपर्ोग के जलए लाग ू जवजधर्ों के अधीन अनुज्ञात दक र्ा िाएगा । [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 मछली पालन ।

22. फमों, कंपजनर्ों द्वारा ब़ेि पैमाने पर वाजणजज्र्क पिुओं और कुक्कुट फामों की स्ट्थापना । जस वार् स्ट् थानीर् आवश् र्कताओं को पूरा करने के जल ए लाग ू जव जध के अनुसार (जसवार् अन्र्था उपबंजधत) जवजनर्जमत होंगे।

23. प्राकृजतक िल जनकार्ों र्ा सतही के्षत्र में उपचाररत बजहस्रााव का म्नस्तारण । जि म्नकायों में उपचाररत अपम्शष्ट जि या बजहस्रााव के म्नस्सारण से बचा िाएगा और उपचाररत अपजिष्ट िल के पुन:चक्रण और पुन:उपर्ोग के जलए प्रर्ास दकए िाएंगे। अन्र्था लाग ू जवजधर्ों के अनुसार उपचाररत बजहस्रााव के पुनचाक्रण/प्रवाह के जनवाहन को जवजनर्जमत दकर्ा िाएगा।

24. सतह और भूिल का वाजणजज्र्क जनष्किाण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।

25. ठोस अपजिष्ट का प्रबन्धन। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।

26. जविेिी प्रिाजतर्ों को लाना । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।

27. पाररजस्ट्थजतकी-पर्ाटन। लाग ूजवजधर्ों के अधीन जवजनर्जमत होंग े।

28. पोजलथीन बैगों का उपर्ोग । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।

29. वाजणजज् र्क सूचना पट्ट और होर्डंग । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे । इ. सवंर्धात दक्रर्ाकलाप

5. पाररम्स्थम्तकी संवदेी जोन की अम्िसचूना की जनगरानी के म्िए जनगरानी सजमजत- कें द्रीर् सरकार, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 3 की उपधारा (3) के अिीन इस अम्िसूचना के उपबंिों की प्रभावी मानीटरी के म्िए मानीटरी सजमजत का र्ठन करती ह,ै िो जनम्नजलजखत से जमलकर बनगेी अथागत:्- 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] क्र.स. मानीटरी सजमजत का गठन पिनाम

(viii) राज्र् सरकार द्वारा नामम्नर्दगष्ट दकए िान ेवाल ेवन्र्िीव संरक्षण के के्षत्र में काम करन ेवाले गरै-सरकारी संगठन का प्रजतजनजध सिस्ट्र्;

(ix) राज्र् सरकार द्वारा नामम्नर्दगष्ट िैव जवजवधता में एक जविेिज्ञ सिस्ट्र्;

(x) राज्र् के प्रजतजित संस्ट्थान र्ा जवश्वजवद्यालर् से पाररजस्ट्थजतकी में एक जविेिज्ञ सिस्ट्र्;

(xi) प्रधान पंचार्त सजमजत लाडपरुा, भैसरोरगढ़, झालरापाटन, तालेरा, खेराबाि (संबंजधत के्षत्र के जलए) सिस्ट्र्;

(xii) उप वन संरक्षक, मुकन्िरा जहल्स टाइगर ररज़वा सिस्ट्र्-सम्चव।

6. जनिेि–जनबधंन.- (1) मानीटरी सजमजत इस अजधसूचना के उपबंधों के अनुपालन को मानीटरी करेगी।

(2) मानीटरी सजमजत का कार्ाकाल अर्ि ेआदेश होने तक ककया जाएर्ा, परंत ुयह कक सम्मम्त के र्ैर-सरकारी सदस्यों को समय-समय पर राज्य सरकार द्वारा नामम्नर्दगष्ट ककया जाएर्ा।

(3) उन कियाकिापों की, जो भारत सरकार के तत्कािीन पयागवरण और वन मंत्रािय की अम्िसूचना संखयांक का.आ.

1533 (अ), तारीख 14 म्सतमबर, 2006 की अनुसूची में सम्ममम्ित हैं, और जो पाररम्स्थम्तकी संवेदी जोन में आत ेहैं, म्सवाय इसके परैाग्राफ 4 के अिीन सारणी में यथा म्वम्नर्दगष्ट प्रम्तम्षि कियाकिापों के, मानीटरी सम्मम्त द्वारा वास्तम्वक म्वम्नर्दगष्ट स्थिीय दशाओं के आिार पर संवीक्षा की जाएर्ी और उक्त अम्िसूचना के उपबंिों के अिीन पूवग पयागवरण अनापम्ि के म्िए केरींय सरकार के पयागवरण, वन और जिवायु पररवतगन मंत्रािय को म्नर्दगष्ट ककया जाएर्ा।

(4) उन कियाकिापों की, जो भारत सरकार के तत्कािीन पयागवरण और वन मंत्रािय की अम्िसूचना संख्र्ांक 1533 (अ), तारीख 14 म्सतंबर, 2006 की अनुसूची में सम्ममम्ित नहीं है, और जो पाररम्स्थम्तकी संवेदी जोन में आते हैं, म्सवाय इसके पैरा 4 के अिीन सारणी में यथाम्वम्नर्दगष्ट प्रम्तम्षि कियाकिापों के, मानीटरी सम्मम्त द्वारा वास्तम्वक म्वम्नर्दगष्ट स्थिीय दशाओं के आिार पर संवीक्षा की जाएर्ी और उसे संबंि म्वम्नयामक प्राम्िकरणों को म्नर्दगष्ट ककया जाएर्ा।

(5) मानीटरी सजमजत का सिस्ट्र्-सजचव र्ा संबद्ध उपायुक्त ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लघंन करता ह,ै पर्ाावरण अजधजनर्म, की धारा 19 के अधीन पररवाि फाइल करन ेके जलए सक्षम होगा। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 13

(6) मानीटरी सजमजत मुद्दा िर मदु्दा के आधार पर अपेक्षाओं पर जनभार रहत े हुए संबद्ध जवभागों के प्रजतजनजधर्ों र्ा जविेिज्ञों, औद्योजगक संगमों र्ा संबद्ध पणधाररर्ों के प्रजतजनजधर्ों को अपन ेजवचार-जवमिा में सहार्ता के जलए आमंजत्रत कर सकेगी ।

(7) मानीटरी सजमजत प्रत्र्ेक विा की 31 माचा तक के अपने दक्रर्ाकलापों की वार्िाक कारावाई ररपोटा राज् र् के मुख् र् वन् र्िीव वाडान को उपाबधं V में संलग्न प्रोफामाा में उक् त विा के 30 िून तक प्रस्ट्ततु करेगी ।

(8) केन्द्रीर् सरकार का पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् मानीटरी सजमजत को अपन ेकृत्र्ों के प्रभावी जनवाहन के जलए ऐसे जनिेि िे सकेगा, िो वह ठीक समझे।

7. इस अजधसूचना के उपबंधों को प्रभाव िने े के जलए कें द्रीर् सरकार और राज् र् सरकार अजतररक् त उपार्, र्दि कोई हों, जवजनर्िाष् ट कर सकें र्ी।

8. कोई अन् र् महत् वपूणा जविर् । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 25th November, 2020 S.O. 4268(E).— WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 174 (E), dated the 10 th January, 2020, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 10 th January, 2020;

AND WHEREAS, objections and suggestions were received from persons and stakeholders in response to the aforesaid draft notification were duly considered in the Ministry;

AND WHEREAS, Mukundara Hills Tiger Reserve (MHTR) was constituted in the year 2013 which encompasses area of Mukundara Hills National Park, Dara Sanctuary, Jawahar Sagar Sanctuary and part of National Chambal Ghariyal Sanctuary (From Garadia Mahadev to Jawahar Sagar Dam) which constitutes the core area of Mukundara Hills Tiger Reserve in the State of Rajasthan;

26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, the Tiger Reserve is spread over an area of 759.99 square kilometres and situated in Tehsil Ladpura, Sangod, Ramganjmandi of district Kota, Tehsil Jhalarapatan of district Jhalawar, Tehsil Talera of district Bundi and Tehsil Rawatbhat of district Chittorgarh in the State of Rajasthan. Jawahar Sagar Sanctuary lies between 24 0 -56' to 25 0

7.5’ North Latitude and 75 0

26.50’ to 75 0 41’, East Longitude. It is situated 35 kilometres from Rawatbhata and 75 kilometres from Bundi and was declared as a Sanctuary vide Government of Rajasthan notification no. F3(5) (13) Rev. 18/73 dated the 9 th October, 1975;

AND WHEREAS, Mukundara Hills Tiger Reserve is named after the two continuous flat topped and almost parallel hills with the narrow central ridges, which are a part of Vindhyan Range system extending from river Chambal to Kalisindh and are approximately 80 kilometres in length and 2 to 5 kilometres in width;

AND WHEREAS, Mukandara hills tiger reserve is not only rich in scenic beauty and biodiversity, but also has at least two probable corridors from Ranthambhore–one through Indergarh - Lakheri - Ramgarh Vishdhari Sanctuary-Dabi – Jawahar Sagar Sanctuary and the other through the ravines of Chambal and Kalisindh to Dara.

However, special efforts are required to conserve this rich natural heritage, to provide safe passage/corridor to the tigers of adjacent Ranthambhore Tiger Reserve and to reintroduce tigers in the area. Hence it has been given special legal protection as is available under section 38(V) of Wildlife Protection Act - 1972 by constituting it as a tiger reserve;

AND WHEREAS, Mukundara Hills Tiger Reserve (MHTR) comprises of fairly dense forest (canopy density 0.6 to 0.7) Dhok and Khair are the predominant species. Several species of algae, fungi, bryophytes, pteridophytes and angiosperms are available here. It is also rich in orchid and tuberous plants. Valley and streams are habitat of several species of medicinal plants. A large number of them are very vital from ethno medical view. Major flora species available in the Protected Area are hingot (Balanites aegyptica), khakhro (Butea monosperma), khajur (Phoenix sylvestris), vilayati babul (Prosopis juliflora), khair (Acacia catechu), dhavda (Anogeissus latifolia), kalam (Mitragyna parviflora), ardusa (Adatoda vasica), lisoda (Cordia myxa), kadaya (Sterculia urens), etc.;

AND WHEREAS, Mukundara Hills Tiger Reserve was once a very good habitat of India’s national animal and flagship species tiger. The Tiger Reserve renders protection to rare and endangered fauna such as sloth bear (Melarsus ursinus), sambhar (Cervus unicolor), ratel (Malivora capensis), common langur (Presbytis entellus), wild boar (Sus scrofa), panther (Panthera pardus), blue bull (Boselaphus tragocamelus), jackal (Canis aureus), striped hyanea (Hyaena hyaena), spotted deer (Axis axis), Indian porcupine (Hystrix indica), monitor lizard (Varanus bengalensis), python (Python molursus), rat snake(Ptyas mucosus), Russel’s viper (Viper russelli), Indian cobra (Naja naja), etc;

AND WHEREAS, major avifauna recorded from the Protected Areas are little grebe (Techybaptus ruficollis), great cormorant (Phalacrocarax carbo), comman kingfisher (Alcedo athis), red wattled lapwing (Vanellus indicus), rock pigeon (Columba livia), rose ringed parakeet (Psittacula eupatria), plum headed parakeet (Psittacula cynoceplala), rufous treepie (Dendrocitta vagabunda), oriental magpie robin (Copsychus saularis), common babblar (Turdoides caudatus), little egret (Egretta garzetta), etc.

AND WHEREAS, important rare, endangered and threatened species available in the Protected Areas are Amorphallus paeonifolius, Anogeissus sericia, Bauhinia vahlii, Tribulus rajasthanensis, Anogeissus latifolia, Commiphora wightii, Acacia catechu, Acacia leucophloea, wolf, fox and python;

AND WHEREAS, the Protected Area also has some important archeological sites such as Gargon Fort which is a UNESCO world heritage site, Abli Meenika Mahal, Raontha Mahal, Badoli group of temples etc. Some of important religious pilgrimage sites are Garadia Mahadev, Gapernath, Ambarani Mataji, Nahar Singh Mataji etc.

Beautiful Chambal gorges and unique landscape also formed the part of the Tiger Reserve. MHTR serves as catchment of rivers like Kalisindh, Ahu, Amjhar, Eru, Brahmini, and Chambal. Water bodies such as Laximpura talai, Bewada Talai, Kadap Kakhal and Chambal River attract lot of migratory birds. Hence, MHTR provides an ideal attraction to tourists. It is also a good opportunity for promotion of ecotourism which will enhance with reintroduction of tigers in the reserve;

AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Mukundara Hills Tiger Reserve which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0 (zero) to 1.0 kilometre around the boundary of Mukundara Hills Tiger Reserve in Kota, Jhalawar, Bundi, Chittorgarh Districts in the State of Rajasthan as the Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely:- [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27

248.70 square kilometres. The State Government has justified that the zero extent of Eco-sensitive Zone is due to co-termination of Eco-sensitive Zone with buffer area of Mukandra Hills Tiger Reserve. The extents of Ecosensitive Zone at various directions are given as:- Direction Extents (in kilometre) North 1.00 North- East 0 to 1.00 East 0 South-East 0 to 1.00 South 0 to 1.00 South-West 0 West 1.00 North-West 1.00

(2) The boundary description of Mukundara Hills Tiger Reserve and its Eco-sensitive Zone is appended in Annexure-I.

(3) The maps of the Mukundara Hills Tiger Reserve demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB, Annexure-IIC and Annexure- IID.

(4) Lists of geo-coordinates of the boundary of Mukundara Hills Tiger Reserve and Eco-sensitive Zone are given in Table A and Table B of Annexure-III.

(5) The list of villages falling in the proposed Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV.

2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Ecosensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority of State.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:-

(i) Environment;

(ii) Forest and Wildlife;

(iii) Agriculture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism;

(vii) Rural Development;

(viii) Irrigation and Flood Control;

(ix) Municipal;

(x) Panchayati Raj;

(xi) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:

Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities given under paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests.

(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone.

(e) The activities of eco-tourism shall be regulated as under, namely:-

(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer:

Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, ecoeducation and eco-development;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.

(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent.

(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-

(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;

(b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.

(10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:-

(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28 th March,

2016.

(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.

(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.

(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.

(13) E-waste.- The E - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.

(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.

(16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.

(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) construction shall not be permitted on existing steep hill slopes or slopes with a high degree of erosion.

4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act, 1972 (53 of 1972) and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining, stone quarrying and crushing units.

(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within the Eco-sensitive Zone;

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N.

Godavarman Thirumulpad Vs. Union of India in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. Union of India in W.P.(C) No.435 of 2012.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).

New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:

Provided that non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 31 otherwise specified in this notification and in addition the non-polluting cottage industries shall be promoted.

3. Establishment of major hydro-electric project.

Prohibited.

4. Use or production or processing of any hazardous substances.

Prohibited.

5. Discharge of untreated effluents in natural water bodies or land area.

Prohibited.

6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.

7. Setting up of brick kilns. Prohibited.

8. Commercial use of firewood. Prohibited.

B. Regulated Activities

9. Commercial establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for ecotourism activities:

Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

10. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Ecosensitive Zone, whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph

(1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents.

Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

11. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.

12. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State 32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Act and the rules made thereunder.

13. Collection of Forest produce or Non- Timber Forest produce.

Regulated as per the applicable laws.

14. Erection of electrical and communication towers and laying of cables and other infrastructures.

Regulated under applicable laws (underground cabling may be promoted).

15. Infrastructure including civic amenities.

Taking measures of mitigation as per the applicable laws, rules and regulations available guidelines.

16. Widening and strengthening of existing roads and construction of new roads.

19. Movement of vehicular traffic at night.

Regulated for commercial purpose under applicable laws.

20. Noise pollution. Regulated as per the applicable laws.

21. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

Permitted as per the applicable laws for use of locals.

22. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies.

Regulated (except otherwise provided) as per the applicable laws except for meeting local needs.

23. Discharge of treated waste water or effluents in natural water bodies or land area.

The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water.

Otherwise the discharge of treated waste water or effluent shall be regulated as per the applicable laws.

24. Commercial extraction of surface and ground water.

Regulated as per the applicable laws.

25. Solid waste management. Regulated as per the applicable laws.

26. Introduction of exotic species. Regulated as per the applicable laws.

27. Eco-tourism. Regulated as per the applicable laws.

28. Use of polythene bags. Regulated as per the applicable laws.

29. Commercial sign boards and hoardings.

Regulated as per the applicable laws.

C. Promoted Activities

30. Rain water harvesting. Shall be actively promoted.

31. Organic farming. Shall be actively promoted.

32. Adoption of green technology for all activities.

Shall be actively promoted.

33. Cottage industries including village Shall be actively promoted.

39. Restoration of degraded land/ forests/ habitat.

40. Environmental awareness. Shall be actively promoted.

5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S N Constituent of the Monitoring Committee Designation

(i) District Collector, Kota Chairman, ex officio;

(ii) Sub Divisional Officer Kota Member;

(iii) Sub Divisional Officer Ramganjmandi Member;

(iv) Sub Divisional Officer Jhalawar Member;

(v) Sub Divisional Officer Bundi Member;

(vi) Sub Divisional Officer Rawatbhata Member;

(vii) Honorary Wild Life Warden, Kota Member;

(viii) A representative of Non-governmental Organisation working in the field of wildlife conservation to be nominated by the State Government Member;

(ix) An expert in Biodiversity to be nominated by the State Government Member;

(x) One expert in Ecology from reputed institution or university of the State Member;

(xi) Pradhan Panchayat Samiti Ladpura ,Bhaisororgarh, Jhalarapatan, Talera, Kherabad (for respective area) Member;

(xii) Deputy Conservator of Forests, Mukandra Hills Tiger Reserve Member-Secretary.

6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The Central Government and the State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
