पा#रिIथितक' संवेदी जोन =े& क' जनसंKया लगभग 520 ह।ै अिधकांश लोग कृिष पर िनभ�र हF और दैिनक मजदरू का काय� करते ह;ै और, वे@ंगुडी प=ी अभयारBय के चार1 ओर के =े& को, िजसका िवIतार और सीमाएं पैरा 1 म) िविनkदl हF, पया�वरण क' दिृl से पा#रिIथितक' संवेदी जोन के ;प म) सुरि=त और संरि=त करना तथा उ0 पा#रिIथितक' संवेदी जोन म) उmोग या उmोग1 क' Qेिणय1 के �चालन तथा �संIकरण को �ितिषn करना आवoयक ह;ै अतःअतःअतःअतः अबअबअबअब,,,, केW\ीय सरकार, पया�वरण (संर=ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प#ठत पया�वरण (संर=ण) अिधिनयम, 1986 (1986 का 29) (िजसे इसमे इसके पqात् पया�वरण अिधिनयम कहा गया ह)ै क' उपधारा (1) और धारा 3 क' उपधारा (2) एवं उपधारा (3) के खंड (v) और खंड (xiv) (ारा �द8 शि0य1 का �योग करते ?ए, तिमलनाडु राtय म) वे@ंगुडी प=ी अभयारBय क' सीमा के चार1 ओर एक �कलोमीटर (सम�प) तक िवIता#रत =े& को वे@ंगडुी प=ी अभयारBय पा#रिIथितक' संवेदी जोन (िजसे इसम) इसके पo चात् पा#रिIथितक' संवेदी जोन के �प म) यह अिधसूचना �कया गया ह)ै के ;प म) अिधसूिचत करती ह,ै िजसका िववरण िनuानुसार ह,ै अथा�त् :- 1. पा�रि�थितकपा�रि�थितकपा�रि�थितकपा�रि�थितक संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन काकाकाका िव�तारिव�तारिव�तारिव�तार औरऔरऔरऔर सीमासीमासीमासीमा.- (1) पा#रिIथितक' संवेदी जोन का िवIतार वे@ंगुडी प=ी अभयारBय के चार1 ओर एक �कलोमीटर (सम�प) ह।ै पा#रिIथितक' संवेदी जोन का =े&फल 7.423 वग� �कलोमीटर ह।ै (2) पा#रिIथितक' संवेदी जोन क' सीमा का वण�न उपाबंधउपाबंधउपाबंधउपाबंध----IIII के ;प म) उपाबn ह।ै (3) पा#रिIथितक' संवेदी जोन क' सीमा के संरि=त =े& का मानिच& उपाबंध उपाबंध उपाबंध उपाबंध IIIIIIII कककक----डडडड.... म) ह।ै (4) पा#रिIथितक' संवेदी जोन और संरि=त =े& क' सीमा के भू-िनदfशांक1 क' सूची vमश: उपाबंधउपाबंधउपाबंधउपाबंध III III III III सारणी (सारणी (सारणी (सारणी (कककक)))) और (खखखख)))) म) ह।ै (5) �मुख ^बदwु के भू-िनदfशांक1 के साथ पा#रिIथितक' संवेदी जोन के अंतग�त आने वाले dाम1 क' सूची उपाबंधउपाबंधउपाबंधउपाबंध----IVIVIVIV के ;प म) उपाबn ह।ै 2222.... पा�रि�थपा�रि�थपा�रि�थपा�रि�थितक�ितक�ितक�ितक� संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आंचिलकआंचिलकआंचिलकआंचिलक महायोजनामहायोजनामहायोजनामहायोजना....–––– (1) राtय सरकार, पा#रिIथितक' संवेदी जोन के �योजन के िलए, राजप& म) अिधसूचना के �काशन क' तारीख से दो वष� क' अविध के भीतर, Iथानीय /ि0य1 के परामश� से और इस अिधसूचना म) �दए गए अनुबंध1 का पालन करते ?ए, राtय सरकार के स=म �ािधकारी के अनुमोदनाथ� एक आंचिलक महायोजना बनायेगी। (2) राt य सरकार (ारा पा#रिIथितक' संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना म) िविनkदx ट रीित से तथा �ासंिगक क) \ीय और राt य िविधय1 के अनु;प तथा क) \ीय सरकार (ारा जारी �दशा िनदfश1, य�द कोई ह1, के अनुसार बनायी जाएगी । ¹Hkkx IIµ[k.M 3(ii)] Hkkjr dk jkti=k % vlk/kj.k 3 (3) आंचिलक महायोजना म) पा#रिIथितक' और पया�वरण संबंधी सरोकार1 को िवचार करने के िलए इसे राt य सरकार के िनuिलिखत िवभाग1 के परामश� से बनाया जाएगा, अथा�त्:-
(i) पया�वरण;
(ii) वन और वWयजीव;
(iii) कृिष;
(iv) राजI व;
(v) शहरी िवकास;
(vi) पय�टन;
(vii) dामीण िवकास;
(viii) ^सचाई और बाढ़ िनयं&ण;
(ix) नगरपािलका;
(x) पंचायती राज;
(xi) लोक िन मा�ण िव भाग;
(xii) राजमाग{ ; और
(xiii) तिमलनाडु राtय �दषूण िनयं&ण बोड� । (4) जब तक इस अिधसूचना म) िविनkदl न हो, आंचिलक महायोजना म) वत�मान म) अनुमो�दत भू-उपयोग, अवसंरचना और �vयाकलाप1 पर कोई �ितबंध नह< लगाया जाएगा तथा आचंिलक महायोजना म) सभी अवसंरचनाw और �vयाकलाप1 म) सुधार करके उWह) अिधक द= और पा#रिIथितक'-अनुकूल बनाने क' /वIथा क' जाएगी । (5) आंचिलक महायोजना म) वन रिहत और अवvिमत =े&1 के सुधार, िवmमान जल िनकाय1 के संर=ण, आवाह =े&1 के �बंधन, जल-संभर1 के �बंधन, भू-जल के �बंधन, मृदा और नमी के संर=ण, Iथानीय जनता क' आवoयकताw तथा पा#रिIथितक' एवं पया�वरण के ऐसे अWय पहलwु क' /वIथा क' जाएगी िजन पर |यान �दया जाना आवoयक ह।ै (6) आंचिलक महायोजना म) सभी िवmमान पूजा I थल1, dाम1 एवं शहरी बिIतय1, वन1 क' Qेिणय1 एवं �कI म1, कृिष =े&1, ऊपजाऊ भूिम, उmान1 एवं उmान1 क' तरह के ह#रत =े&1, बागवानी =े&1, बगीच1, झील1 और अWय जल िनकाय1 क' सीमा का िनधा�रण �कया जाएगा तथा इस महायोजना म) िवmमान और �Iतािवत भू- उपयोग क' िवशेषताw का 5यौरा देने वाल ेमानिच& भी �दए जाएंगे। (7) आंचिलक महायोजना म) पा#रिIथितक' संवेदी जोन म) होने वाल ेिवकास का िविनयमन �कया जाएगा और पैराdाफ 4 म) सारणी म) यथासूचीबn �ितिषn एवं िविनयिमत �vयाकलाप1 का पालन �कया जाएगा। इसमे I थानीय जनता क' आजीिवका क' सुर=ा के िलए पा#रिIथितक'-अनुकूल िवकास का भी सुिनo चय एवं संवध�न �कया जाएगा। (8) आंचिलक महायोजना, =े&ीय िवकास योजना क' सह-कािलक होगी । (9) अनुमो�दत आंचिलक महायोजना, िनगरानी सिमित के िलए एक संदभ� दIतावेज होगी ता�क वह इस अिधसूचना के उपबंध1 के अनुसार िनगरानी के अपने कत�/1 का िनव�हन कर सके । 3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय....---- राtय सरकार इस अिधसूचना के उपबंध1 को �भावी बनाने के िलए िनuिलिखत उपाय करेगी, अथा�त् :- ((((1111)))) भूभूभूभू----उपयोग.उपयोग.उपयोग.उपयोग.–––– (क) पा#रिIथितक' संवेदी जोन म) वन1, बागवानी =े&1, कृिष =े&1, मनोरंजन के िलए िचिWहत उmान1 और खुल ेIथान1 का वृहद वािणिtयक या आवासीय प#रसर1 या औmोिगक �vयाकलाप1 के िलए �योग या संप#रवत�न अनु~ात नह< �कया जाएगा: परंतु पा#रिIथितक' संवेदी जोन के भीतर भाग (क), म) िविनkदl �योजन से िभH �योजन के िलए कृिष और अWय भूिम का संप#रवत�न, िनगरानी सिमित क' िसफा#रश पर और स=म �ािधकारी के पूव� अनुमोदन से, =े&ीय नगर योजना 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अिधिनयम तथा यथा लाग ूकेW\ीय सरकार या राtय सरकार के अWय िनयम1 एवं िविनयम1 के अधीन तथा इस अिधसूचना के उपबंध1 के अनुसार Iथानीय िनवािसय1 क' िनuिलिखत आवासीय ज;रत1 को पूरा करने के िलए अनु~ात �कया जाएगा:- (i) िवmमान सड़क1 को चौड़ा करना और उWह) सुदढृ करना और नई सड़क1 का संिनमा�ण करना; (ii) बुिनयादी ढांच1 और नाग#रक सुिवधाw का संिनमा�ण और नवीकरण; (iii) �दषूण उLपH न करने वाल ेलघु उmोग; (iv) कुटीर उmोग एवं dाम उmोग; पा#रिIथितक' पय�टन म) सहायक सुिवधा भBडार, Iथानीय सुिवधाएं तथा गृह वास; और (v) बढ़ावा �दए गए पैराdाफ 4 म) उि�लिखत �vयाकलाप: परंतु यह भी �क =े&ीय शहरी िनयोजन अिधिनयम के अधीन स=म �ािधकारी के पूव� अनुमोदन के िबना तथा राtय सरकार के अWय िनयम1 एवं िविनयम1 एवं संिवधान के अनु�छेद 244 के उपबंध1 तथा तLसमय �वृ8 िविध, िजसके अंतग�त अनुसूिचत जनजाित और अWय परंपरागत वन िनवासी (वन अिधकार1 क' माWयता) अिधिनयम, 2006 (2007 का 2) भी आता ह,ै का अनुपालन �कए िबना वािणिtयक या औmोिगक िवकास �vयाकलाप1 के िलए जनजातीय भूिम का उपयोग अनु~ात नह< होगा: परंतु यह भी �क पा#रिI थितक' संवेदी जोन के अंतग�त आने वाली भूिम के अिभलेख1 म) ?ई �कसी &ु#ट को, िनगरानी सिमित के िवचार �ा> करने के पqात्, राtय सरकार (ारा �Lयेक मामले म) एक बार सुधारा जाएगा और उ0 &ु#ट को सुधारने क' सूचना क) \ीय सरकार के पया�वरण, वन और जलवायु प#रवत�न मं&ालय को दी जाएगी: परंतु यह भी �क &ु#ट को सुधारने म), इस उप-पैरा म) यथा उपबंिधत के िसवाय, �कसी भी दशा म) भू-उपयोग का प#रवत�न शािमल नह< होगा । (ख) अनु�युD त या अनुL पादक कृिष =े&1 म) पुन: वनीकरण तथा पया�वास1 और जैव- िविवधता क' बहाली के �यास �कए जाएंगे । (2) �ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत....- आंचिलक महायोजना म) सभी �ाकृितक जल �ोत1/न�दय1/जलमाग{ के आवाह =े&1 क' पहचान करके उनके संर=ण और बहाली क' योजना सि मिलत क' जाएगी और राt य सरकार (ारा करके इस रीित से बनाए जा�ग े�क उसम) इन =े&1 या इनके आसपास के =े&1 के िलए हािनकारक िवकास �vयाकलाप1 को �ितिषn �कया गया हो। (3) पय�टन या पा�रि�थितक� पय�टन.पय�टन या पा�रि�थितक� पय�टन.पय�टन या पा�रि�थितक� पय�टन.पय�टन या पा�रि�थितक� पय�टन.–––– (क) पा#रिIथितक' संवेदी जोन के भीतर सभी नए पा#रिIथितक' पय�टन �vयाकलाप या िवmमान पय�टन �vयाकलाप1 का िवIतार पा#रिIथितक' संवेदी जोन स बंधी पय�टन महायोजना के अनुसार अनु~ात होगा । (ख) पा#रिIथितक' पय�टन महायोजना राtय िवभाग के पया�वरण और वन िवभाग1 के परामश� से पय�टन िवभाग (ारा बनायी जाएगी । (ग) पय�टन महायोजना आंचिलक महायोजना का घटक होगी । (घ) पय�टन महायोजना पा#रिIथितक' संवेदी जोन क' वहन =मता के आधार पर तैयार क' जायेगी। (ङ) पा#रिIथितक' पय�टन संबंधी �vयाकलाप िन नानुसार िविनयिमत �कए जाएंग ेअथा�त्:- (i) संरि=त =े& क' सीमा से एक �कलोमीटर के भीतर या पा#रिIथितक' संवेदी जोन क' सीमा तक इनम) जो भी अिधक िनकट हो �कसी होटल या #रसोट� का नया सिHमा�ण अनु~ात नह< �कया जाएगा: परंतु, पा#रिIथितक' पय�टन सुिवधाw के िलए संरि=त =े& क' सीमा से एक �कलोमीटर क' दरूी से परे पा#रिIथितक' संवेदी जोन क' सीमा तक पूव� प#रभािषत और अभीिहत =े&1 म) पय�टन महायोजना के अनुसार, नए होटल1 और #रसोट� क' Iथापना अनु~ात होगी; (ii) पा#रिIथितक' संवेदी जोन के अWदर सभी नए पय�टन �vया-कलाप1 या िवmमान पय�टन �vयाकलाप1 का िवIतार, केW\ीय सरकार के पया�वरण, वन और जलवायु प#रवत�न मं&ालय (ारा जारी �दशािनदfश1 तथा पा#रिIथितक' पय�टन, पा#रिIथितक'-िश=ा और पा#रिIथितक'-िवकास पर बल देने वाले रा�ीय /ा� संर=ण �ािधकरण (ारा जारी पा#रिIथितक' पय�टन संबंधी �दशािनदfश1 (समय-समय पर यथा संशोिधत) के अनुसार होगा;

15. नाग#रक सुिवधाw सिहत बुिनयादी अवसंरचना। यह /वIथा लाग ू िविधय1, िनयम1, िविनयम1 और उपल5ध �दशािनदfश1 के अनुसार उपशमन उपाय1 के साथ क' जाएगी।

19. राि& म) यानीय यातायात का संचलन । लागू िविधय1 के अधीन वािणिtयक �योजन के िलए िविनयिमत होगा ।
20. Iथानीय जनता (ारा अपनायी जा रही वत�मान कृिष और बागवानी पnितय1 के साथ डेय#रयां, द�ुध उLपादन, जल कृिष और मLIय पालन। Iथानीय जनता के उपयोग के िलए लाग ू िविधय1 के अधीन अनु~ात ह1गे।

8. कोई अW य महL वपूण� मामला । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 13th December, 2019 S.O. 4500(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 3439(E) dated the 12 th July, 2018, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 12 th July, 2018;
AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification;
AND WHEREAS, the Vettangudi Birds Sanctuary is spread over an area of 0.38 426 square kilometres (38.426 ha) and comprises of three tanks namely Vettangudipatti (18.415 ha), Periyakollugudipatti (13.66 ha) and Chinnakollugudipatti (6.351 ha) tanks and is located between 10°06’ to 10°06’45” N latitude and 78°30’15’’ to 78°31’30” E longitude in Sivaganga District of Tamil Nadu which is 45 kilometres away from Sivaganga main town;
AND WHEREAS, this Sanctuary is important and known for aquatic avifauna harbouring nearly 5321 birds belonging to 46 species, recorded during winter season. The important birds include white ibis, black ibis, open-billed stork, egrets, mynas, teals, ducks, darters, herons, little cormorant etc. The Sanctuary attracts different species of migratory birds from various parts of the world which come primarily for feeding purposes. The area is an important and unique habitat known for varied avian fauna which provides an ecologically sustainable habitat for majority bird species. The feathered visitors flock the Sanctuary from October to February. The wetland is irregular in depth and retains water for 3 to 5 months, if rain is normal;

Babul (Acacia nilotica) plantations were raised. The other major flora on the tank bunds and foreshore are Acanthospermum hispidum Aeschynomene aspera, Ageratum conyzoides, Alysicarpus longifolius, Aponogeton natans, Brachiaria mutica, Cyanotis axillaris, Dactyloctenium aegyptium, Hybanthus enneaspermus, Mollugo pentaphylla , Typha domingensis etc which are used for roosting and nesting by the migratory birds like Anhinga melanogaster, Bubulcus ibis, Coracias benghalensis, Nycticorax nycticorax, Threskiornis melanocephalus, Microcarbo niger, etc;
AND WHEREAS, the Sanctuary has 46 species of avian fauna visiting and residing in this small tank spread over 38.426 ha. The common species are Acridotheres tristis, Amaurornis phoenicurus, Anhinga melanogaster, Bubulcus ibis, Coracias benghalensis, Corves splendens, Egretta garzetta, Egretta intermedia.
Proper successful management measures may attract more breeding species and wintering species;
AND WHEREAS, the Sanctuary has diversity of flora and fauna including birds, insects, butterflies, reptiles, amphibians etc. Example of birds are common myna (Acridotheres tristis Linnaeus), common kingfisher (Alcedo atthis Linnaeus), white-breasted waterhen (Amaurornis phoenicurus Pennant), spot-bill duck (Anas poecilorhyncha), Asian openbill (Anastomus oscitans Boddaert), darter (Anhinga melanogaster Pennant), Indian pond-heron (Ardeola grayii sykes), cattle egret (Bubulcus ibis Linnaeus) etc. and examples of reptiles are house gecko (Hemidactylus frenatus), spotted Indian gecko (Hemidactylus brookii), garden lizard (Calotes versicolor), green lizard (Calotes calotes), etc. and Common Indian Toad (Duttaphrynus melanostictus), Ornate Narrow mouthed frog (Microhyla ornata), common skittering frog (Euphlyctis cyanophlyctis), etc. The population of the Eco-sensitive Zone area is around 520 numbers. Most of the people depend on agriculture and the remaining work in the agricultural fields as daily wage workers;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Vettangudi Birds Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent of one kilo meter (uniform) around the boundary of Vettangudi Birds Sanctuary in the State of Tamil Nadu as the Vettangudi Birds Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone. - (1) The Eco-sensitive Zone shall be to an extent of one kilometer (uniform) around the Vettangudi Birds Sanctuary. The area of the Eco-sensitive Zone is 7.423 square kilometers.
(2) The extent and boundary description of the Eco-sensitive Zone is appended at Annexure I.
(3) The map of the Protected Area demarcating the Eco-sensitive Zone boundary is at Annexure IIA-E.
(4) List of geo co-ordinates of the boundary of the Protected Area and the Eco-sensitive Zone is at Annexure III (A) and (B) respectively.
(5) The list of villages falling within the proposed Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure IV.
2. Zonal Master Plan for the Eco-sensitive Zone. - (1) The State Government shall, for the purpose of effective management of the Eco-sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of publication of this Notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this Notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-Sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government for integrating environmental and ecological considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department;
(xii) Highways; and
(xiii) Tamil Nadu State Pollution Control Board.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:- 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given in paragraph 4;
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-Sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.- The catchment areas of all natural springs/ rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Ecosensitive Zone.
(e) The activities of eco-tourism shall be regulated as under, namely:-
(i) New construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-Sensitive Zone whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Ecosensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the ecotourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based ¹Hkkx IIµ[k.M 3(ii)] Hkkjr dk jkti=k % vlk/kj.k 19 on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel or resort or commercial establishment construction is permitted within Ecosensitive Zone area.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artifacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution. - The Environment Department of the State Government or Tamil Nadu State Pollution Control Board shall implement the regulations for control of noise pollution in the Ecosensitive Zone in accordance with the provisions of The Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-Sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made there under.
(8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental Act, and the rules made there under or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes. - Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.
(10) Bio-Medical Waste. - Bio-Medical Waste Management shall be as under:-
(a) The Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification Number GSR 343 (E), dated the 28 th March, 2016 as amended from time to time.
(b) Safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Ecosensitive Zone.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management. - The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R.
317(E), dated the 29 th March, 2016, as amended from time to time.

(13) E-waste. - The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular Pollution. - Prevention and control of Vehicular Pollution shall be incompliance with applicable laws and efforts to be made for use of cleaner fuel like CNG, LPG, etc.
(16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition the non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes: The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) Construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980, the Indian Forest Act, 1927, the Wildlife (Protection) Act, 1972, and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE Sl. (a) All new and existing mining (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities;
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 4 th August, 2006 in the matter of T.N. Godavarman Thirumalpad Vs UOI in W.P. (C) No. 202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs UOI in W.P. (C) No. 435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc).
New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:

5. Discharge of untreated effluents in natural water bodies or land area.

New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns.
Prohibited (except as otherwise provided) as per the applicable laws.
B. Regulated Activities
8. Commercial establishment of hotels and resorts.
New commercial hotels and resorts shall not be permitted within one kilometre of the boundary of the Protected Area or up to the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for Ecotourism activities:
Provided that, beyond one kilometre from the boundary of the Protected Area or up to the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
9. Construction activities.
(a) New commercial construction of any kind shall not be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents:
Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations if any.
(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
10. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the central Pollution Control Board in February, 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Sl. No. Activity Description

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
12. Collection of Forest produce or Non-Timber Forest Produce.
Regulated as per the applicable laws.
13. Establishment of large scale commercial live stock and poultry farms by firms, corporate, companies.
Regulated as per the applicable laws.
14. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated as per the applicable laws. Underground cabling may be promoted.
15. Infrastructure including civic amenities.
Taking measures of mitigation as per the applicable laws, rules and regulations available guidelines.

17. Undertaking other activities related to tourism like over flying above the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.

19. Movement of vehicular traffic at night.
Regulated for commercial purpose as per the applicable laws.
20. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

21. Discharge of treated waste water or effluents in natural water bodies or land area.
The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts to be made for recycle and reuse of treated waste water.
Otherwise the discharge of treated waste water or effluent shall be regulated as per the applicable laws.

5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following namely:-
1. The District Collector, Sivaganga Chairman, ex officio;
2. A representative of Non-government Organisation working in the field of wildlife conservation to be nominated by State Government Member;
3. An expert in Biodiversity nominated by the State Government Member;
4. An expert in Ecology and Environment to be nominated by the State Government Member;
5. A representative from State Public Works Department Member;

6. A representative from State Pollution Control Board Member;
7. District Forest Officer, Sivaganga Member- Secretary.
6. Terms of Reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual sitespecific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual sitespecific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per proforma given in Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification are subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the Hon’ble High Court or the National Green Tribunal.

GARKOTI, Scientist ‘G’ ANNEXURE- I BOUNDARY DESCRIPTION OF ECO-SENSITIVE ZONE OF THE PROTECTED AREA North The boundary of the Eco-sensitive Zone on the northern side through the villages adjacent to the boundaries of the ayyapatti, Madhvarayanpatti, villages at a distance of one km from the boundary of the Vettangudi Birds Sanctuary.
North East The boundary of the Eco-sensitive Zone on the north eastern side through the villages adjacent to the boundaries of the Muthiah Nagar Krishnanpatti villages at a distance of one km from the boundary of the Vettangudi Birds Sanctuary East The boundary of the Eco-sensitive Zone then traverses on the eastern side through the villages adjacent to the boundaries of the Karuppur village at a distance of one km from the boundary of the Vettangudi Birds Sanctuary.
