PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार् ुपररवतान मतं्रालर् अजधसचूना नई दिल्ली, 2 नवम् बर, 2023 का.आ. 4799(अ).—प्रारुप अजधसूचना भारत के रािपत्र, असाधारण में भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना संखर्ांक का.आ. 4616 (अ), तारीख 8 नवंबर, 2021 द्वारा प्रकाजित की गई थी, जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करन ेवाली रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थ;े और, उि प्रारूप अजधसूचना को अंतर्वाष्ट करने वाली रािपत्र की प्रजतर्ां िनता को तारीख 9 नवंबर, 2021 को उपलब्ध करा िी गई थी;
और, पूवोि प्रारुप अजधसूचना के उत्तर में व्यजिर्ों और पणधाररर्ों से प्राप्त आक्षेपों और सुझावों पर कें द्रीर् सरकार द्वारा जवचार दकर्ा गर्ा था;

और, रालामंडल वन्र्िीव अभर्ारण्र् के आसपास के क्षेत्रों में कृजि, रािस्ट्व और ररज़वा वन क्षेत्रों हैं और वनस्ट्पजतर्ों और िीविंत ुप्रिाजतर्ों की जवद्यान िैव जवजवधता जनकट भजवष्र् में रालामंडल वन्र्िीव अभर्ारण्र् के िैजवक जवजवधता मूल्र्ों को समृद्ध करने में सक्षम ह;ै [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 और, रालामडंल वन्र्िीव अभर्ारण्र् के चारों ओर के भौगोजलक क्षेत्र, जवस्ट्तार और सीमाओं को पाररजस्ट्थजतकी, पर्ाावरणीर् और िैव-जवजवधता की िजृष्ट से पाररजस्ट्थजतकी संवेिी िोन के रूप में सुरजक्षत और संरजक्षत करना तथा इस भौगोजलक क्षेत्र में उद्योगों र्ा उद्योगों के वगो के प्रचालन तथा प्रसंस्ट्करण को प्रजतजिद्ध करना आवश्र्क ह;ै अतः अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खंड
(xiv) एवं उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत ेहुए, मध्र् प्रिेि राज्र् के इंिौर जिले में रालामंडल वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर समरूप 0.1 दकलोमीटर तक जवस्ट्ताररत के्षत्र को रालामंडल वन्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके पश् चात ्पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात्:-
1. पाररजस्ट्थजतकी सवंिेी िोन का जवस्ट्तार और उसकी सीमाएं— (1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार रालामंडल वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर समरूप 0.1 दकलोमीटर तक जवस्ट्तृत ह ैऔर पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल 0.810 वगा दकलोमीटर आच्छादित ह।ै रालामंडल अभर्ारण्र् के पाररजस्ट्थजतकी संवेिी िोन के आसपास का आवासीर् क्षेत्र 100 मीटर ह।ै
(2) रालामंडल वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण उपाबधं-I के रूप में संलग्न ह।ै
(3) सीमा जववरण और अक्षािंों और िेिांतरों सजहत पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करते हुए रालामंडल वन्र्िीव अभर्ारण्र् के मानजचत्र उपाबधं–II और उपाबधं –III के रूप में संलग्न ह।ै
(4) रालामडंल वन्र्िीव अभर्ारण्र् और पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू- जनििेांकों की सूची उपाबधं-IV की सारणी क और सारणी ख में ह।ै
(5) मुखर् लबंिओुं के भू-जनििेांकों के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाले ग्रामों की सूची उपाबधं –V के रूप में संलग्न ह।ै
2. पाररजस्ट्थजतकी सवंिेी िोन के जलए आचंजलक महार्ोिना.– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर आंचजलक महार्ोिना तैर्ार करेगी।
(2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसूचना में जवजनर्िाष् ट ऐसी रीजत से तथा सुसंगत कें द्रीर् और राज् र् जवजधर्ों के अनुरूप और राज्र् सरकार द्वारा िारी मागाििाक जसद्धांतों, र्दि कोई हों, द्वारा तैर्ार की िाएगी।
(3) आंचजलक महार्ोिना, स्ट्थानीर् जनवाजसर्ों और राज्र् सरकार के जवभागों के परामिा स ेतैर्ार की िाएगी, अथाात:्-
(i) पर्ाावरण;
(ii) वन और वन्र्िीव;
(iii) कृजि;
(iv) रािस्ट्व;
(v) िहरी जवकास;
(vi) पर्ाटन;

(vii) ग्रामीण जवकास;
(viii) लसंचाई और बाढ़ जनर्ंत्रण;
(ix) नगरपाजलका;
(x) पंचार्ती राि;
(xi) मध्र् प्रििे राज्र् प्रििूण जनर्ंत्रण बोडा; और
(xii) लोक जनमााण जवभाग।
(4) आंचजलक महार्ोिना अनमुोदित भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक इस अजधसूचना में जवजनर्िाष्ट न हो, तथा आचंजलक महार्ोिना में सभी अवसंरचनाओं और दक्रर्ाकलापों में सुधार करके उन्हें अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनान ेकी व्यवस्ट्था की िाएगी।
(5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, िलग्रहण क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐसे अन्र् पहलओुं जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह,ै के जलए उपबंध होंगे।
(6) आंचजलक महार्ोिना जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेिताओं के ब्र्ौरों से अनुसमर्थात मानजचत्र के साथ सभी जवद्यमान पूिा स्ट्थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, कृजि क्षते्रों, ऊपिाऊ भूजम, हररत क्षेत्र िैसे उद्यान और उसी प्रकार के स्ट्थान, उद्यान कृजि के्षत्र, फलोउद्यान और अन्र् िल जनकार्ों का अभ्र्ंकन करेगी।
(7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करेगी और सारणी में सूचीबद्ध परैाग्राफ 4 में प्रजतजिद्ध और जवजनर्जमत दक्रर्ाकलापों का अनपुालन करेगी और स्ट् थानीर् समुिार्ों की िीजवका को सुरजक्षत करन ेके जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजित और उसकी अजभवृजद्ध भी करेगी।
(8) आंचजलक महार्ोिना, प्रािेजिक जवकास र्ोिना की सह-जवस्ट्तारी होगी ।
(9) राज्र् सरकार द्वारा इस प्रकार अनुमोदित आंचजलक महार्ोिना, इस अजधसूचना के उपबंधों के अनुसार मानीटरी के अपन ेकृत्र्ो को करन ेके जलए मानीटरी सजमजत हतेु एक संिभा िस्ट्तावेि होगी।
(10) पाररजस्ट्थजतकी संवेिी िोन के जलए आंचजलक महार्ोिना तैर्ार होन ेतक, सभी नए जवकासात्मक दक्रर्ाकलापों को पैराग्राफ 22 के अधीन समुजचत कारावाई के जलए परैाग्राफ के अधीन गरठत मानीटरी सजमजत को भेिा िाएगा।
3. राज्र् सरकार द्वारा दकए िान ेवाल ेउपार्-- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करने के जलए उपार् करेगी।
4. भ-ूउपर्ोग सबंधंी उपार्.- (1) पाररजस्ट्थजतकी संवेिी िोन में आमोि-प्रमोि के प्रर्ोिनों के जलए जचजन्हत दकए गए वनों, उद्यान कृजि क्षेत्रों, िनिाजत क्षते्रों, कृजि क्षेत्रों, पाकों और खुल ेस्ट्थानों का उपर्ोग वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक संबंजधत जवकास दक्रर्ाकलापों के जलए क्षेत्रों में उपर्ोग नहीं दकर्ा िाएगा र्ा संपररवतान नहीं होगा:
परंतु राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के भीतर ऊपर भाग (क), में जवजनर्िाष्ट प्रर्ोिन से जभन्न प्रर्ोिन के जलए कृजि और अन्र् भूजम का संपररवतान, मानीटरी सजमजत की जसफाररि पर और सक्षम प्राजधकारी के पूवा अनुमोिन से मध्र् प्रिेि नगर र्ोिना अजधजनर्म, (1973) तथा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करने के जलए अनजु्ञात दकर्ा िाएगा िैसे:-
(i) जवद्यमान सड़कों को चौड़ा करना, उन्हें सुिढृ़ करना और नई सड़कों का जनमााण करना;
(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;
(iii) प्रििूण उत्पन्न न करन ेवाले लघ ुउद्योग की स्ट्थापना;

(iv) कुटीर उद्योग जिनके अतंगात ग्राम उद्योग भी ह;ै सुजवधा भण्डार और स्ट्थानीर् सुजवधाएं सहार्क पाररजस्ट्थजतकी पर्ाटन जिसके अंतगात गृह वास सजम्मजलत ह;ै और
(v) पैराग्राफ-4 के अजधन दिए गए संवर्धात दक्रर्ाकलापः परंतु र्ह और दक राज्र् सरकार संजवधान के अनुच्छेि 244 के उपबंधों और तत्समर् प्रवृत्त जवजध, जिसके अंतगात अनुसूजचत िाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी ह,ै का अनुपालन करत ेहुए, वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनुज्ञात कर सकेगी। परंतु र्ह और भी की राज्र् सरकार पाररजस्ट्थजतकी संवेिी िोन के भीतर भू-अजभलेखों में उपसंिात कोई तु्ररट को प्रत्र्ेक मामल ेमें केवल एक बार मानीटरी सजमजत के परामिा पर संिोजधत होगी, और ऐसे सुधार के बारे में पररवतान के जलए केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को सूचना िनेी होगी:
परंतु र्ह और दक तु्ररट के संिोधन में इस उप पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा में भू- उपर्ोग का पररवतान सजम्मजलत नहीं होगा:
(ख) अनुप्रर्िु र्ा अनुत् पािक कृजि क्षेत्रों में वनीकरण तथा पर्ाावासों की बहाली के कार्ाकलापों से पनु: वनीकरण के प्रर्ास दकए िाएंगे।
5. प्राकृजतक िल जनकार् सबंधंी उपार्.- सभी प्राकृजतक िलमागों के िलग्रहण क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना में उनके संरक्षण और नवीकरण की र्ोिना सजम् मजलत की िाएगी और राज् र् सरकार द्वारा ऐसे क्षेत्रों पर र्ा उसके जनकट जवकास दक्रर्ाकलापों को प्रजतजिद्ध करन ेके बारे में िो ऐसे क्षेत्रों के जलए अजहतकर हो ऐसी रीजत से मागाििाक जसद्धांत तैर्ार दकए िाएगंे ।
6. पर्ाटन एव ं पाररजस्ट्थजतकी-पर्ाटन सबंधंी उपार्.- (क) पाररजस्ट्थजतकी संवेिी िोन में सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन के जलए पर्ाटन महार्ोिना के अनुसार होगा;
(ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् पर्ाटन जवभाग द्वारा राज्र् पर्ाावरण और वन जवभाग के परामिा से तैर्ार होगी;
(ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का घटक होगी;
(घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तैर्ार की िार्ेगी;
(ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनम् नानुसार जवजनर्जमत दकए िाएंग,े अथाात:्-
(i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी अजधक जनकट हो, दकसी होटल र्ा ररिॉटा का नर्ा सजन्नमााण अनुज्ञात नहीं दकर्ा िाएगाः परंत ुर्ह, संरजक्षत क्षेत्र की सीमा लसे एक दकलोमीटर की िरूी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक केवल नए होटलों और ररिॉटा की स्ट्थापना पूवा पररभाजित और नामजनर्िाष्ट क्षेत्रों में पर्ाटन महार्ोिना के अनुसार, पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए ही अनुज्ञात होगा;
(ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा िारी मागाििाक जसद्धांतों के द्वारा तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेने वाल े राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी मागाििाक जसद्धांतों (समर्-समर् 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पर र्था संिोजधत) के अनुसार होगा;
(iii) इस अजधसूचना के अजधन आचंजलक महार्ोिना का अनुमोिन दकए िाने तक, पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजनर्िाष्ट संवीक्षा तथा मानीटरी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनजु्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन में दकसी नए होटल/ ररिॉटा र्ा वाजणजज्र्क स्ट्थापन का संजन्नमााण अनुज्ञात नहीं दकर्ा िाएगा ।
7. प्राकृजतक जवरासत सबंधंी उपार्.– पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाले बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पूल ररिवा के्षत्र, िैल संरचना, िल प्रपात, झरन,े िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण मागा, उत्प्रपात आदि की पहचान की िाएगी और उनकी परररक्षण एवं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी।
8. मानव जनर्मात जवरासत स्ट् थल सबंधंी उपार्.– पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी।
9. ध् वजन प्रििूण सबंधंी उपार्.– ध्वजन प्रििूण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 के उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रििूण के जनवारण और जनर्ंत्रण के जलए मागा ििाक जसद्धांत तैर्ार करेगा।
10. वार् ुप्रििूण सबंधंी उपार्.– वार् ु(प्रििूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और तद्धीन बनाए गए जनर्मों के उपबंधों के अनसुार पाररजस्ट्थजतकी संवेिी िोन में वार् ु प्रििूण के जनर्ंत्रण के जलए मागाििाक जसद्धांत तैर्ार करेगा।
11. बजहःस्राव का जनस्ट्सारण सबंधंी उपार्.– पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहःस्राव का जनस्ट्सारण िल (प्रििूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) और तद्धीन बनाए गए जनर्मों के उपबंधों के अनुसार होगा।
12. ठोस अपजिष्ट जनपटान सबंधंी उपार्.– ठोस अपजिष्ट का जनपटान और प्रबन्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपटान और प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन (ईएसएम) अनुज्ञात दकर्ा िार्गेा।
13. िवै जचदकत्सा अपजिष्ट जनपटान सबंधंी उपार्.– िैव जचदकत्सा अपजिष् ट का प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनजु्ञात दकर्ा िार्ेगा।
14. सलाजस्ट्टक अपजिष्ट प्रबधंन सबंधंी उपार्.– पाररजस्ट्थजतकी संवेिी िोन में सलाजस्ट्टक अपजिष्ट प्रबंधन सलाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
15. सजंनमााण और जवध्वसं अपजिष्ट प्रबधंन सबंधंी उपार्.– पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिष्ट प्रबंधन, संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
16. ई–अपजिष्ट सबंधंी उपार्.– पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा प्रकाजित ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा, जिसे समर्-समर् पर संिोजधत दकर्ा िाएगा। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7
17. र्ानीर्-र्ातार्ात सबंधंी उपार्.– र्ातार्ात की र्ानीर् गजतजवजधर्ों को पर्ाावास-अनकूुल रीजत से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना में जवजनर्िाष्ट उपबंध सजम्मजलत दकए िाएंग ेऔर आंचजलक महार्ोिना के तैर्ार होन ेऔर राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनमुोदित होने तक, मानीटरी सजमजत सुसंगत अजधजनर्मों और उसके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार र्ानों की आवािाही के अनुपालन की मानीटरी करेगी।
18. र्ानीर् प्रििूण सबंधंी उपार्.– राज्र् सरकार लागू जवजधर्ों के अनुसार र्ानीर् प्रििूण का जनवारण और जनर्ंत्रण करेगी और स्ट्वच्छ ईंधन के उपर्ोग के जलए प्रर्ास करेगी।
19. औद्योजगक ईकाइर्ा ंसबंधंी उपार्.– पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रििूणकारी उद्योगों की स्ट्थापना की अनजु्ञा नहीं िी िाएगी और केन्द्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी मागाििाक जसद्धान्तों के अनुसार, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रििूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा ।
20. पहाड़ी ढलानों का सरंक्षण सबंधंी उपार्.– (1) आंचजलक महार्ोिना में पहाड़ी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनमें दकसी भी संजनमााण की अनजु्ञा नहीं होगी;
(2) जिन ढलानों र्ा जवद्यमान खड़ी पहाड़ी ढलानों में अत्र्जधक भू-क्षरण होता ह ैउनमें दकसी भी संजनमााण की अनुज्ञा नहीं होगी ।
21. पाररजस्ट्थजतकी सवंिेी िोन में प्रजतजिद्ध, जवजनर्जमत र्ा सवंर्धात दकए िान े वाल े दक्रर्ाकलापों की सचूी.- पाररजस्ट्थजतकी संवेिी िोन में सभी दक्रर्ाकलाप पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) के उपबंधों और तटीर् जवजनर्मन िोन, 2011 और अजधसूचना संखर्ाक का.आ. 1533 (अ), तारीख 14 जसतंबर, 2006 सजहत तद्धीन बनाए गए जनर्मों द्वारा िाजसत होंगी और अन्र् लाग ूजवजधर्ों, जिनमें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म 1972 (1972 का 53), और तद्धीन बनाए गए जनर्म सजम्मजलत हैं और नीचे िी गई सारणी में जवजनर्िाष्ट रीजत से जवजनर्जमत दकए िाएंगे, अथाात.्- सारणी क्रम स.ं

(ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) सं. 202 में टी.एन . गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले में माननीर् उच्चतम न्र्ार्ालर् के आिेि तारीख 4 अगस्ट्त ,2006 और 2012 की ररट र्ाजचका (जसजवल) सं. 435 में गोवा फाउंडेिन बनाम भारत संघ के मामले में तारीख 21 अप्रलै, 2014 के आिेि के अनुसरण में होगा ।

9. होटलों और ररसोटों की वाजणजज्र्क स्ट्थापना । पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हतेु लघु अस्ट्थार्ी संरचनाओं के जनमााण के जसवार्, संरजक्षत क्षते्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना को अनजु्ञात नहीं दकर्ा िाएगा:
परंत,ु संरजक्षत के्षत्र की सीमा से एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी अजधक जनकट हो, सभी नए पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना और र्था लागू मागाििाक जसद्धांतों के अनरुुप होगा।
10. संजनमााण दक्रर्ाकलाप । (क) संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक िो भी जनकट हो, दकसी भी प्रकार का वाजणजज्र्क संजनमााण अनजु्ञात नहीं दकर्ा िाएगा:
परंत ु स्ट् थानीर् लोगों को पैराग्राफ 4 में सूचीबद्ध दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम में स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को परूा करने जलए संजनमााण करन े की अनजु्ञा भवन उपजवजधर्ों के अनुसार िी िाएगी:
परन्त ुर्ह और दक ऐसे लघ ुउद्योगों िो प्रििूण उत् पन् न नहीं करत ेहैं, से संबंजधत संजनमााण दक्रर्ाकलाप लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत से ही जवजनर्जमत दकए िाएंगे और न् र्नूतम पर रखे िाएंगे। (ख) एक दकलोमीटर से आग े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे ।
11. गैर प्रििूणकारी लघ ुउद्योग। फरवरी, 2016 में केन्द्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा िारी, समर्- समर् पर र्था संिोजधत उद्योगों में वगीकरण के अनसुार गैर- प्रििूणकारी उद्योग और अपररसंकटमर्, लघु और सेवा उद्योग, कृजि, पुष्प कृजि, उद्यान कृजि र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्री से उत्पािों को उत्पन्न करन ेवाले कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनजु्ञात होंगे।
12. वृक्षों की कटाई । (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 होगी । (ख) वृक्षों की कटाई संबंजधत कें द्रीर् र्ा राज्र् के अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी ।
13. वन उत्पािों और गरै काष्ठ वन उत्पािों का संग्रहण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगें ।
14. जवदु्यत और संचार टॉवर लगाने, तार-जबछान े तथा अन्र् अवसंरचनाओ की व्यवस्ट्था । लागू जवजधर्ों के अधीन जवजनर्जमत (भूजमगत केबल जबछाने को बढ़ावा दिर्ा िाएगा) होगा।
15. नागररक सुजवधाओं सजहत अवसंरचनाएं। लाग ू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक जसद्धांतों के अनुसार न्र्ूनीकरण उपार् करना।
16. जवद्यमान सड़कों को चौड़ा करना और उन्हें सुिढृ बनाना और नई सड़कों का जनमााण। लाग ू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक जसद्धांतों के अनुसार न्र्ूनीकरण उपार् करना।
17. पर्ाटन से संबंजधत अन्र् दक्रर्ाकलाप िैसे गमा वार्ु गबु्बारें, हलेीकॉसटर, ड्रोन, माइक्रोलाइटस, आदि द्वारा पाररजस्ट्थजतकी संवेिी िोन क्षते्र के ऊपर से उड़ना िैसे दक्रर्ाकलाप करना। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा ।
18. पहाड़ी ढालों और निी तटों का संरक्षण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा ।
19. राजत्र में र्ाजनक र्ातार्ात का संचलन । लाग ूजवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होगा ।
20. स्ट्थानीर् समुिार्ों द्वारा अपनार्ी िा रही वतामान कृजि और बागवानी पद्धजतर्ों के साथ िगु्धिाला, िगु्ध उत्पािन, िल कृजि और मत्स्ट्र् पालन। लाग ूजवजधर्ों के अनुसार अनुज्ञात होगा ।
21. फमों, कारपोरेट और कंपजनर्ों द्वारा बड़े पैमान े पर वाजणजज्र्क पिुधन संपिा और कुक्कुट फामों की स्ट्थापना । स्ट्थानीर् आवश्र्कताओं को पूरा करन ेके जलए लाग ूजवजधर्ों के अनुसार जवजनर्जमत (अन्र्था प्रिान दकए गए) होंगे ।
22. प्राकृजतक िल जनकार्ों र्ा भू के्षत्र में उपचाररत अपजिष्ट िल/बजहस्रााव का जनस्ट्सरण । िल जनकार्ों में उपचाररत अपजिष्ट िल र्ा बजहस्रााव के जनस्ट्सारण से बचा िाएगा और उपचाररत अपजिष्ट िल के पुनचाक्रण और पनु:उपर्ोग के प्रर्ास दकए िाएंगे। अन्र्था उपचाररत अपजिष्ट िल र्ा बजहस्रााव का जनस्ट्सारण लाग ूजवजधर्ों के अनसुार जवजनर्जमत दकर्ा िाएगा।
23. सतही और भूिल का वाजणजज्र्क प्रर्ोग एवं जनष्किाण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा।
24. ठोस अपजिष्ट का प्रबन्धन। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा।
25. जविेिी प्रिाजतर्ों को लाना। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा।
26. पाररजस्ट्थजत की पर्ाटन। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा।
27. पोजलथीन बैगों का प्रर्ोग । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा।

40. कौिल जवकास । सदक्रर् रूप से बढ़ावा दिर्ा िाएगा ।
41. अवक्रजमत भूजम र्ा वनों र्ा पर्ाावासों की बहाली । सदक्रर् रूप से बढ़ावा दिर्ा िाएगा ।
42. पर्ाावरण के प्रजत िागरुकता। सदक्रर् रूप से बढ़ावा दिर्ा िाएगा ।
22. पाररजस्ट्थजतकी-सवंिेी िोन अजधसचूना की मानीटरी के जलए मानीटरी सजमजत.- केन्द्रीर् सरकार, इस अजधसूचना के उपबंधों की प्रभावी मानीटरी के जलए, एक मानीटरी सजमजत का गठन करती ह,ै िो जनम्नजलजखत व्यजिर्ों से जमलकर बनेगी, अथाात्:- क्र.स.ं मानीटरी सजमजत का गठन पिनाम

23. मानीटरी सजमजत के कार्ा.- (1) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संखर्ांक का. आ. 1553(अ), तारीख 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत ह,ै और िो पाररजस्ट्थजतकी संवेिी िोन में आते हैं, जसवार् इसके परैा 20 के अधीन सारणी में जवजनर्िाष्ट प्रजतजिद्ध दक्रर्ाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त के जलए, र्थाजस्ट्थजत, कें द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को जनर्िाष्ट दकर्ा िाएगा।
(2) उन दक्रर्ाकलापों की, िो भारत सरकार के तत् कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संखर्ांक का.आ.
1533(अ), तारीख 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत नहीं ह,ै और िो पाररजस्ट्थजतकी संवेिी िोन में आते हैं, जसवार् इसके पैरा 20 के अधीन सारणी में र्थाजवजनर्िाष्ट प्रजतजिद्ध दक्रर्ाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे संबंद्ध जवजनर्ामक प्राजधकरणों को जनर्िाष्ट दकर्ा िाएगा ।
(3) मानीटरी सजमजत मामला-िर-मामला के आधार पर अपके्षाओं पर जनभार रहते हुए संबद्ध जवभागों के प्रजतजनजधर्ों र्ा जविेिज्ञों, औद्योजगक संगमों र्ा संबद्ध पणधाररर्ों के प्रजतजनजधर्ों को, अपने जवचार-जवमिा में सहार्ता के जलए आमंजत्रत कर सकेगी ।
(4) मानीटरी सजमजत प्रत्र्ेक विा 31 माचा तक के अपन ेदक्रर्ाकलापों की वार्िाक कारावाई ररपोटा, राज्र् के मुखर् वन्र्िीव वाडान को, उपाबंध-VI में जवजनर्िाष्ट जनििान पत्र में उस विा के 30 िून तक प्रस्ट्तुत करेगी ।
(5) केन्द्रीर् सरकार का पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् मानीटरी सजमजत को उसके कार्ा-कलापों के प्रभावी जनवाहन के जलए ऐसे जनििे िे सकेगा िो वह उजचत समझे ।

AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 9th November, 2021;
AND WHEREAS, objections and suggestions received from persons and stakeholders in response to the aforesaid draft notification were considered by the Central Government;
AND WHEREAS, Ralamandal Wildlife Sanctuary is situated about 12 kilometres from Indore city. It is located within compartment number R-260, having a total area of 2.34550 square kilometres in the Indore Forest Division of Indore District in the State of Madhya Pradesh. The Sanctuary was notified in 1989 by the Government of Madhya Pradesh vide notification number 14-20-X-II-88, dated 09 February, 1989. It is situated at 2608 feet from mean sea level and 2.5 kilometres from the main entrance gate of the sanctuary;
AND WHEREAS, Ralamandal Wildlife Sanctuary has recorded about 28 cheetal, 19 black buck, 42 neelgai, 5 bhedki, 11 hyenas, and 10 lomdi. Apart from this, other fauna species such as sehi, mor, kharna, siyar, etc.
are also present in the Sanctuary area. AND WHEREAS, the surrounding areas of Ralamandal Wildlife Sanctuary has agriculture, revenue and reserve forest areas and the existing biodiversity of flora and fauna species are capable to enrich the biological diversity values of Ralamandal Wildlife Sanctuary in near future;
AND WHEREAS, it is necessary to conserve and protect the geographical area, the extent and boundaries of Ralamandal Wildlife Sanctuary from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in this geographical area;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of 0.1 kilometres uniform around the boundary of Ralamandal Wildlife Sanctuary, in Indore District in the State of Madhya Pradesh as the Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely : - 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
1. Extent and boundaries of the Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall cover an area of 0.810 square kilometres with an extent of 0.1 kilometre uniform around the boundary of Ralamandal Wildlife Sanctuary. The residential area around the Ralamandal Sanctuary Eco-sensitive Zone with 100 meters extent.
(2) The boundary description of Ralamandal Wildlife Sanctuary and its Eco-sensitive Zone is appended in Annexure-I.
(3) The maps of the Ralamandal Wildlife Sanctuary demarcating the Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-III and Annexure-III.
(4) Lists of geo-coordinates of the boundary of Ralamandal Wildlife Sanctuary and the Eco-sensitive Zone are in Table A and Table B of Annexure-IV.
(5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-V.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purposes of the Ecosensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the local people and State Government Departments, namely:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipality;
(x) Panchayati Raj;
(xi) Madhya Pradesh State Pollution Control Board; and
(xii) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks and it’s like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall provide mechanism for regulating developmental activities in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved by the State Government shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

(10) Pending approval of the Zonal Master Plan for Eco-sensitive Zone, any new developmental activities shall be referred to the monitoring committee constituted under paragraph 22 for appropriate action under paragraph 21.
3. Measures to be taken by the State Government.- The State Government shall take the measures for giving effect to the provisions of this notification.
4. Land use related measures.– (a) Forests, horticulture areas, tribal areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:
Provided that the State Government may permit the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Madhya Pradesh Town and Country Planning Act, (1973) as applicable, to meet the residential needs of the local residents and for activities such as:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) setting up small scale industries not causing pollution;
(iv) setting up cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given under paragraph 4:
Provided further that the State Government may permit the use of land in tribal area for commercial or industrial development activities on compliance of the provisions of Article 244 of the Constitution and the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that the State Government shall correct any error appearing in the records of land within the Eco-sensitive Zone, only once in each case and in consultation with the Monitoring Committee and intimate to the Central Government in the Ministry of Environment, Forest and Climate Change about such correction:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph;
(b) efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
5. Natural water bodies related measures.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
6. Tourism or Eco-tourism related measures.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone;
(b) the Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests;
(c) the Tourism Master Plan shall form a component of the Zonal Master Plan;
(d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone;
(e) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Conservation Authority (as amended from time to time) with emphasis on eco-tourism, ecoeducation and eco-development;
(iii) The development for tourism and expansion of existing tourism activities may be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and on recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area until Zonal Master Plan is approved under this notification.
7. Natural heritage related measures.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
8. Man-made heritage sites related measures.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.
9. Noise pollution related measures.- Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000.
10. Air pollution related measures.- Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and Environment (Protection) Act, 1986 and rules framed thereunder.
11. Discharge of effluents related measures.- Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of environmental Pollutants covered under the rules framed under the Environment (Protection) Act, 1986 and standards stipulated by State Pollution Control Board, whichever is more stringent.
12. Solid wastes disposal related measures.- Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be in accordance with the Solid Waste Management Rules, 2016.
(b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.
13. Bio-Medical Waste disposal related measures.- Bio-Medical Waste Management shall be in accordance with the Bio-Medical Waste Management Rules, 2016 and safe and environmentally sound management of Bio- Medical Wastes in conformity with the applicable rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.
14. Plastic waste management related measures.- The plastic waste management in the Eco-sensitive Zone shall be in accordance with the provisions of the Plastic Waste Management Rules, 2016.
15. Construction and demolition waste management related measures.- The construction and demolition waste management in the Eco-sensitive Zone shall be in accordance with the provisions of the Construction and Demolition Waste Management Rules, 2016.
16. E-waste related measures.- The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.
17. Vehicular traffic related measures.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
18. Vehicular pollution related measures.- The State Government shall prevent and control vehicular pollution in accordance with the applicable laws and shall make efforts for use of cleaner fuels.
19. Industrial units related measures.- No new polluting industries shall be permitted to be set up within the Ecosensitive Zone and only non-polluting industries shall be allowed within Eco-sensitive Zone in accordance with the guidelines issued by the Central Pollution Control Board in February, 2016.

20. Protection of hill slopes related measures.-
(1) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(2) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
21. List of prohibited, regulated and promoted activities within Eco-sensitive Zone.- All activities in the Ecosensitive Zone shall be governed by the provisions of the Environment Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone, 2011 and the notification number S.O. 1533 (E) dated the 14th September, 2006 and other applicable laws, including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and the rules made thereunder and be regulated in the manner specified in the Table below, namely:- TABLE Sl. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within the Eco-sensitive Zone;
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N.
Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 26.04.2023 and 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:
Central Pollution Control Board’s guidelines for Categorisation of Industry in 2016 vide their letter No. B- 29012/ESS(CPA)/2015-2016 dated 07.03.2016 shall be applicable.
3. Establishment of major hydro-electric project.
Prohibited.
4. Use or production or processing of any hazardous substances.
Prohibited.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited.
6. Setting up of new saw mills and wood base industries.
New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited.
8. Commercial use of firewood. Prohibited.
B. Regulated Activities
9. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometer from the boundary of the 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
10. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in paragraph 4 as per building bye-laws to meet the residential needs of the local residents:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
11. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent authority.
12. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
13. Collection of Forest produce or Non- Timber Forest produce.
Regulated as per the applicable laws.
14. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable laws (underground cabling may be promoted).
15. Infrastructure including civic amenities. Taking measures of mitigation as per the applicable laws, rules, regulations and available guidelines.
16. Widening and strengthening of existing roads and construction of new roads.
Taking measures of mitigation as per the applicable laws, rules, regulations and available guidelines.
17. Undertaking other activities related to tourism like flying over the Ecosensitive Zone area by hot air balloon, helicopter, drones, microlites, etc.
Regulated as per the applicable laws.
18. Protection of hill slopes and river banks. Regulated as per the applicable laws.
19. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
20. Ongoing agriculture and horticulture practices by local communities along Permitted as per the applicable laws.

21. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies.
Regulated (except otherwise provided) as per the applicable laws except for meeting local needs.
22. Discharge of treated waste water or effluents in natural water bodies or land area.
The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water or effluent shall be regulated as per the applicable laws.
23. Commercial extraction of surface and ground water.
Regulated as per the applicable laws.
24. Solid waste management. Regulated as per the applicable laws.
25. Introduction of exotic species. Regulated as per the applicable laws.
26. Eco-tourism. Regulated as per the applicable laws.
27. Use of polythene bags. Regulated as per the applicable laws.
28. Commercial sign boards and hoardings. Regulated as per the applicable laws.
29. Open Well, Borewell, etc. for agriculture and other usages.
Regulated as per the applicable laws.
30. Air and vehicular pollution. Regulated as per the applicable laws.
31. New trenching ground. Regulated as per the applicable laws.
C. Promoted Activities
32. Rain water harvesting. Shall be actively promoted.
33. Organic farming. Shall be actively promoted.
34. Adoption of green technology for all activities.
Shall be actively promoted.
35. Cottage industries including village artisans, etc.
Shall be actively promoted.
36. Use of renewable energy and fuels. Bio-gas, solar light, etc. shall be actively promoted.
37. Agro-Forestry. Shall be actively promoted.
38. Plantation of Horticulture and Herbals. Shall be actively promoted.
39. Use of eco-friendly transport. Shall be actively promoted.
40. Skill Development. Shall be actively promoted.
41. Restoration of degraded land or forests or habitat.
Shall be actively promoted.
42. Environmental awareness. Shall be actively promoted.
22. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification, the Central Government hereby constitutes a Monitoring Committee, comprising of the following persons, namely:- Sl. (viii) An expert in Biodiversity nominated by the State Government Member;
(ix) An expert in Ecology and Environment to be nominated by the State Government Member;
(x) District Officer of Town and country planning Department Member; ex officio;
(xi) Regional Officer Madhya Pradesh Pollution Control Board, Indore Member; ex officio;
(xii) Wildlife Warden of Ralamandal Wildlife Sanctuary, Indore Member-Secretary, ex officio.
23. Functions of the Monitoring Committee. – (1) The Monitoring Committee shall, based on the actual sitespecific conditions scrutinize, the activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1553 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities specified in the Table under paragraph 20 thereof, and refer to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification.
(2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Ecosensitive Zone, except for the prohibited activities as specified in the Table under paragraph 20 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and refer to the Regulatory Authorities concerned.
(3) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(4) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in Annexure-VI, appended to this notification.
(5) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
24. Complaints for non-compliance.- The Member-Secretary of the Monitoring Committee or the Collector or the Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
