PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार् ुपररवतान मतं्रालर् अजधसचूना नई दिल्ली, 2 दिसम् बर, 2021 का.आ. 4929(अ).—प्रारुप अजधसूचना भारत के रािपत्र, असाधारण, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान, मंत्रालर् की अजधसूचना सं. का.आ. 548 (अ), तारीख 29 िनवरी, 2019, द्वारा प्रकाजित की गई थी जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करने वाले रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थे;

और, उि प्रारूप अजधसूचना को अन्तर्वाष्ट करने वाले रािपत्र की प्रजतर्ां िनता को तारीख 29 िनवरी, 2019, को उपलब्ध करा िी गई थी;

और, उि प्रारुप अजधसूचना के प्रत्र्ुतर में व्यजिर्ों और पणधाररर्ों से प्राप्त आक्षेपों और सुझावों पर मंत्रालर् द्वारा जवचार दकर्ा गर्ा था;

और, असकोट वन्र्िीव अभर्ारण्र्, उत्तराखंड राज्र् के जपथौरागढ़ जिले में जस्ट्थत ह।ै अभर्ारण्र् की स्ट्थापना सरकारी आििे सं. 3239/एक्स-2-2013-19(1) 2002 तारीख 25 िुलाई, 2002 के द्वारा 2013, में की गई थी जिसमें जपथौरागढ वन संभाग के असकोट और धारचूला रेंि के 12 वन खण्डों का 290.914 वगा दकलोमीटर आरजक्षत वन क्षेत्र और वन पंचार्तों और अवगीकृत जसजवल भूजम के क्षेत्र सजहत संरजक्षत वन का 309.086 वगा दकलोमीटर क्षेत्र िाजमल ह।ै इस प्रकार असकोट वन्र्िीव अभर्ारण्र् की स्ट्थापना 600 वगा दकलोमीटर क्षेत्र में की गई थी। अभर्ारण्र् बनाने का मूल उद्देश्र् क्षेत्र में वनस्ट्पजतर्ों और िीविंतुओं की बृहत् जवजवधता का संरक्षण करना था;

स.ं 4558] नई दिल्ली, बृहस्ट् पजतवार, दिसम् बर 2, 2021/अग्रहार्ण 11, 1943 No. 4558] NEW DELHI, THURSDAY, DECEMBER 2, 2021/AGRAHAYANA 11, 1943 सी.जी.-डी.एल.-अ.-02122021-231540 CG-DL-E-02122021-231540 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, असकोट वन्र्िीव अभर्ारण्र् में िलुाभ और लुप्तप्रार् पौधों और पिुओं प्रिाजतर्ों की बहुतार्त का वास है। अभर्ारण्र् में, पौधों की 2600, पजक्षर्ों की 250 और स्ट्तनधाररर्ों की 37 प्रिाजतर्ां ह ैिैसे स्नोव तेंिआु (पेन्थेरा अनजसर्ा), जहमालर्न काला भालू (सेलेनक्टोस जथबेटनुस), कस्ट्तूरी जहरन (मोस्ट्चस चरर्सोगास्ट्टर), जहमालर्न थार (हजेमटरागुस िेमलाहीकुस), ब्लू भेड़ (पसेउड़ाइस न्र्ौर), सेरोव (कपरीकोनीस सुमतराइंजसस) ह।ै िीविंतु प्रिाजतर्ों में िैसे लंूग, मोनल (लोफोफोरूस इम्पेिानुस), कलीि फेअसंत (लोफुरा लेउकोमेलानुस), चीर फेअसंत (कटरेउस वाजल्लची) और कस्ट्तूरी जहरन (मोस्ट्चुस स्ट्पा) प्रिाजतर्ां ह।ै असकोट वन्र्िीव अभर्ारण्र् मस्ट्क जडर्र उद्यान, वन रंिीस, व्यासी, रंगिरमा, चौिजस, रंगभोरटर्ा, अंवाल के जलए िाना िाता ह।ै और वन्र्िीव क्षेत्र में अन्र् जपछड़ा वगा समुिार् रहते हैं। मौसमी तौर पर उच्च जहमालर् क्षेत्रों में भूरटर्ा र्हां प्रवास करते ह ैऔर कृजि करना, ऊन का व्यापार, हस्ट्तजिल्प, भेड़ और बकरी का पालन-पोिण करना और िड़ी-बूटी और झाड़ी का संग्रहण िैसे कार्ा करते है;

और, असकोट वन्र्िीव अभर्ारण्र् 600 मीटर से 7000 मीटर ऊंचाई तक फैला हुआ ह ैऔर र्ह मुख्र्त: काली निी और उसकी सहार्क नदिर्ों के िलसंभर क्षेत्र में जस्ट्थत है; सहार्क नदिर्ां धौली और गौरो उत्तर में रंूगललंग खंड से नीचे काली निी से ऊपर 1582 मीटर ह।ै अजधकांि सभी पहाजड़र्ां उत्तर-पजिम में फैली हुई ह ैऔर प्रथम मुख्र् रेंि ऊपरी काली और धौली निी के िलग्रहण क्षेत्र को अलग करती हैं। इसके ऊंचाई लबंि ुरंूगजलग चोटी की ऊंचाई 4075 मीटर और सबसे जनचली तावाघाट 1108 मीटर ह।ै इस घाटी में क्षेत्र करठन और खड़ी चट्टान ह,ै इस श्ृंखला में जहरागूमरी, ज्र्ोजतगाड़ और रंूगललंग के वन खंड है। िसूरी मुख्र् रेंि धौली और गौरी गंगा के िलग्रहण क्षेत्र को अलग करती हैं। वन खंडों में िगू चोटी की ऊंचाई लबंि ु4560 मीटर है और िौलिीबी और जछप्लाकोट का जनचला लबंि ु4499 मीटर ह।ै क्षेत्र में 2100 मीटर तक ऊंची खड़ी चट्टान ह ैलेदकन ढलान सीधी ह ैऔर इस खंड में पय्र्ा, मिथम, िदफर्ा धुरा, थाकला, िगू और सोबला के वन खंड़ है। तीसरा समूह गौर, रामगंगा और काली निी के बीच में ह ैऔर इस श्ृंखला में मुख्र् चोटी घनधूरा की ऊंचाई 2501 मीटर ह;ै और, असकोट वन्र्िीव अभर्ारण्र् में िैजवक हस्ट्तक्षेप और अप्राकृजतक दिर्ाकलापों के कारण मानव वन्र्िीव संघिा अजधक होते है, अत्र्जधक चराई, कतरन, अजि घटना, अवैज्ञाजनक भूजम िोहन खनन तथा जवकास से िुडे़ अन्र् दिर्ाकलापों को जनर्ंजत्रत करने की आवश्र्कता है;

और, असकोट वन्र्िीव अभर्ारण्र् के चारों ओर के क्षेत्र को, जिसका जवस्ट्तार और सीमाएं पाररजस्ट्थजतकी पर्ाावरणीर् से पाररजस्ट्थजतकी संवेिी िोन के रूप में पैरा 1 में जवजनर्िाष्ट हैं, िैव जवजवजधता की िजृष्ट सुरजक्षत और संरजक्षत करना और उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों के वगों के प्रचालन और प्रसंस्ट्करण करने को प्रजतजिद्ध करना आवश्र्क ह;ै अतः, अब, केन्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इस अजधसूचना में इसके पिात पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उपधारा

(1) और उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, उत्तराखंड राज्र् के जिला जपथौरागढ़ में असकोट वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर 0 (िून्र्) से 22 दकलोमीटर जवस्ट्ताररत क्षेत्र को असकोट वन्र्िीव अभर्ारण्र् पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके पश् चात् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात ्:-

1. पाररजस्ट्थजतकी सवंेिी िोन का जवस्ट्तार और सीमाएं.-(1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार असकोट वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर 0 (िून्र्) से 22 दकलोमीटर तक जवस्ट्तृत ह ैऔर पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल

454.65 वगा दकलोमीटर है। अंतरराष्ट्रीर् सीमा के कारण अभर्ारण्र् के िजक्षणी, पजिमी और पूवी भागों की ओर पाररजस्ट्थजतकी संवेिी जोन का िून्र् जवस्ट्तार है; िबदक, अन्र् स्ट्थानों पर, क्षेत्र में रहने वाले स्ट्थानीर् समुिार् और आदिम आदिवासी समूहों (वन रािी) के साथ सावािजनक परामिा के िौरान जलए गए जस्ट्थरता के कारण िून्र् जवस्ट्तार है।

(2) असकोट वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण उपाबंध-I के रूप में संलि है।

(3) सीमा जववरण और अक्षांि और ििेांतर के साथ पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करते हुए असकोट वन्र्िीव अभर्ारण्र् के मानजचत्र उपाबंध –IIक और उपाबधं –IIख के रूप में संलि है।

(4) असकोट वन्र्िीव अभर्ारण्र् और पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू-जनििेांकों की सूची उपाबंध -III की सारणी क और सारणी ख में िी गई ह।ै [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3

(5) असकोट वन्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी संवेिी िोन के अंतगात कोई ग्राम नहीं है।

2. पाररजस्ट्थजतकी सवंेिी िोन के जलए आचंजलक महार्ोिना.– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्र् के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसूचना में दिए गए अनुबंधों का पालन करते हुए आंचजलक महार्ोिना तैर्ार करेगी और राज्र् में सक्षम प्राजधकारी द्वारा जवजधवत अनुमोदित दकर्ा िाएगा।

(2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत से िो इस अजधसूचना में जवजनर्िाष् ट दकए गए हैं, के अनुसार तथा सुसंगत कें रीर् और राज् र् जवजधर्ों के अनुरुप और कें रीर् सरकार द्वारा िारी मागाजनििेों, र्दि कोई हों, द्वारा तैर्ार होगी।

(3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करने के जलए राज् र् सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार होगी:-

(i) पर्ाावरण;

(ii) वन और वन्र्िीव;

(iii) कृजि;

(iv) रािस्ट् व;

(v) िहरी जवकास;

(vi) पर्ाटन;

(vii) ग्रामीण जवकास;

(viii) लसंचाई और बाढ़ जनर्ंत्रण;

(ix) नगरपाजलका;

(x) पंचार्ती राि;

(xi) रािमागा;

(xii) उत्तराखंड राज्र् प्रििूण जनर्ंत्रण बोडा; और

(xiii) लोक जन मााण जव भाग।

(4) आंचजलक महार्ोिना अनुमोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दिर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िाष् ट न हो और आचंजलक महार्ोिना सभी अवसंरचना और दिर्ाकलापों में, िो अजधक िक्षता और पाररजस्ट्थजतकी अनुकूल हों, का संवधान करेगी ।

(5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण स े संबंजधत ऐसे अन्र् पहलुओं, जिन पर ध्र्ान िनेा आवश्र्क है, के जलए उपबंध होंगे ।

(6) आंचजलक महार्ोिना जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेिताओं के ब्र्ौरों से अनुसमर्थात मानजचत्र के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, कृजि क्षेत्रों, उपिाऊ भूजम, हररत क्षेत्र िैसे उद्यान और उसी प्रकार के स्ट् थान, उद्यान कृजि क्षेत्र, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभ्र्ंकन करेगी।

(7) आंचजलक महार्ोिना में पाररजस्ट्थजतकी संवेिी िोन में जवकासात्मक दिर्ाकलापों को जवजनर्जमत करने के जलए प्रदिर्ा प्रिान करेगा और सारणी में र्थासूचीबद्ध पैरा 4 में प्रजतजिद्ध और जवजनर्जमत दिर्ाकलापों का पालन दकर्ा िाएगा। इसमें स्ट् थानीर् िनता की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनिर् एव ंसंवधान दकर्ा िाएगा।

(8) आंचजलक महार्ोिना प्रािजेिक जवकास र्ोिना की सह जवस्ट्तारी होगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(9) राज्र् सरकार द्वारा अनुमोदित आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक संिभा िस्ट्तावेि होगी तादक वह इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपने कताव्यों का जनवाहन कर सके।

3. राज्र् सरकार द्वारा दकए िान ेवाल ेउपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करने के जलए जनम्नजलजखत उपार् करेगी, अथाात्:-

(1) भ-ूउपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए जचजन्हत दकए गए पाकों और खुले स्ट्थानों का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक संबद्ध जवकास दिर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नहीं होगा:

परंतु पाररजस्ट्थजतकी संवेिी िोन के भीतर भाग (क) में जवजनर्िाष्ट प्रर्ोिनों से जभन्न प्रर्ोिनों के जलए कृजि और अन्र् भूजम का संपररवतान जनगरानी सजमजत की जसफाररि पर और र्था लाग ूऔर क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्रीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से, और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करने के जलए अनुज्ञात दकर्ा िाएगा, िैसे-

(i) जवद्यमान सड़कों को चौड़ा करना और उन्हें सुिढृ़ करना तथा नई सड़कों का संजनमााण;

(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;

(iii) प्रििूण उत्पन्न न करने वाले लघु उद्योग;

(iv) कुटीर उद्योगों जिनके अंतगात ग्रामीण उद्योग भी हैं; सुजवधािनक भण्डार और स्ट्थानीर् सुजवधाएं सहार्क पाररजस्ट्थजतकी पर्ाटन जिसके अन्तगात गृह वास सजम्मजलत ह;ै और

(v) पैरा 4 के अधीन दिए गए संवर्धात दिर्ाकलाप:

परंतु र्ह और दक प्रािजेिक नगर र्ोिना अजधजनर्म और राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन और संजवधान के अनुच्छेि 244 के उपबंधों र्ा तत्समर् प्रवृत्त जवजध के उपबंधों के अनुपालन के जबना, जिसके अधीन अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी है, वाजणजज्र्क र्ा औद्योजगक जवकास दिर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनुज्ञात नहीं होगा:

परंतु र्ह और भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भू-अजभलेखों में उपसंिात कोई गलती, जनगरानी सजमजत के जवचार प्राप्त करने के पिात ् राज्र् सरकार द्वारा प्रत्र्ेक मामले में एक बार ठीक होगी और उि गलती के सुधार की सूचना कें रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी:

परंतु र्ह और भी दक गलती के सुधार में इस उप पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा में भू-उपर्ोग का पररवतान सजम्मजलत नहीं होगा। (ख) वनीकरण तथा वास िीणोद्धार दिर्ाकलापों सजहत अनप्रर्ुक् त र्ा अनुत् पािक कृजि क्षेत्रों में पुन: वनीकरण करने के प्रर्ास दकए िाएंगे।

(2) प्राकृजतक िल स्रोत.- आचंजलक महार्ोिना में सभी प्राकृजतक झरनों के आवाह क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण के जलए र्ोिना सजम् मजलत होगी और राज् र् सरकार द्वारा ऐसे क्षेत्रों पर र्ा उनके जनकट जवकास दिर्ाकलाप प्रजतजिद्ध करने के बारे में िो ऐसे क्षेत्रों के जलए अजहतकर हो ऐसी रीजत से मागाििाक जसद्धांत तैर्ार दकए िाएंगे।

(3) पर्ाटन र्ा पाररजस्ट्थजतकी पर्ाटन.- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दिर्ाकलाप र्ा जवद्यमान पर्ाटन दिर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी संवेिी िोन के जलए होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् पर्ाटन जवभाग द्वारा राज्र् पर्ाावरण और वन जवभाग के परामिा से तैर्ार होगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना के एक घटक के रूप में होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िाएगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दिर्ाकलाप जनम्नानुसार जवजनर्जमत होंगे, अथाात:्- [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5

(i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट ह,ै नर् े वाजणजज्र्क होटल और ररिॉटा के सजन्नमााण अनुज्ञात नहीं होंगे:

परंतु, र्ह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर की िरूी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक होटलों और ररिॉटा का स्ट्थापना केवल पूवा पररभाजित और नामजनर्िाष्ट क्षेत्रों में पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए ही अनुज्ञात होगा;

(ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दिर्ाकलापों र्ा जवद्यमान पर्ाटन दिर्ाकलापों का जवस्ट्तार कें रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् के मागाििाक जसद्धांतों के द्वारा तथा राष् रीर् व् र्ाघ्र संरक्षण प्राजधकरण, द्वारा िारी पाररजस्ट्थजतकी–पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल ितेे हुए (समर्-समर् पर र्था संिोजधत) िारी मागाििाक जसद्धांतों के अनुसार होगा;

(iii) आंचजलक महार्ोिना का अनुमोिन दकए िाने तक, पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन दिर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्िाष्ट संवीक्षा और जनगरानी सजमजत की जसफाररि पर आधाररत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नर्े होटल र्ा ररसोटा र्ा वाजणजज्र्क स्ट्थापना का संजनमााण अनुज्ञात नहीं दकर्ा िार्ेगा ।

(4) नसैर्गाक जवरासत.- पाररजस्ट्थजतकी संवेिी िोन में महत्वपूणा नैसर्गाक जवरासत के सभी स्ट्थलों िैसे िीन कोि आरजक्षत क्षेत्र, िैल जवरचनाएं, िल प्रपातों, झरनों, घाटी मागों, उपवनों, गुफाएं, स्ट्थलों, भ्रमण, अश्वरोहण, प्रपातों आदि की पहचान की िाएगी और जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रुप में परररक्षण और संरक्षण के जलए तैर्ार की िाएगी ।

(5) मानव जनर्मात जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, जिल्प-तथ्र्, ऐजतहाजसक, स्ट्थापत्र्, सौंिर्ापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और उपक्षेत्रों पहचान और उनके संरक्षण के जलए जवरासत र्ोिना आंचजलक महार्ोिना के भाग के रुप में तैर्ार की िाएगी।

(6) ध् वजन प्रििूण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रििूण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 में जनर्त उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रििूण के जनर्ंत्रण और जनवारण का अनुपालन दकर्ा िाएगा।

(7) वार् ु प्रििूण.- पाररजस्ट्थजतकी संवेिी िोन में, वार्ु प्रििूण के जनवारण और जनर्ंत्रण का वार्ु (प्रििूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार अनुपालन दकर्ा िाएगा।

(8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सरण, साधारण मानकों के उपबंधों के अनुसार पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आन ेवाले पर्ाावरणीर् प्रििूण के जनस्ट्सरण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक कठोर हो, के उपबधंों के अनुसार होगा।

(9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1357(अ), तारीख 8 अप्रैल, 2016 के द्वारा प्रकाजित ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा;

(ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।

(10) िैव जचदकत्सा अपजिष् ट.- िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016, के द्वारा प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(11) प्लाजस्ट्टक अपजिष्ट प्रबंधन.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(12) जनमााण और जवध्वसं अपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सां.का.जन 317(अ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा ।

(13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत द्वारा प्रकाजित ई–अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(14) र्ानीर् र्ातार्ात.- र्ातार्ात की र्ानीर् गजतजवजधर्ा ं आवास के अनुकूल जवजनर्जमत होंगी और इस संबंध में आंचजलक महार्ोिना में जविेि उपबंध सजम्मजलत दकए िाएंग ेऔर आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित होने तक, जनगरानी सजमजत सुसंगत अजधजनर्मों और उसके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार र्ानीर् दिर्ाकलापों के अनुपालन को जनगरानी करेगी।

(15) र्ानीर् प्रििूण.- लाग ू जवजधर्ों के अनुपालन में वाहन प्रििूण का जनवारण और जनर्ंत्रण दकर्ा िाएगा और स्ट्वच्छक ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे।

(16) औद्योजगक ईकाइर्ा.ं- (क) रािपत्र में इस अजधसूचना के प्रकािन पर र्ा उसके पिात पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिजूित उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी। (ख) केन्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी समर्-समर् पर र्था संिोजधत मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रििूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रििूणकारी उद्योगों को बढ़ावा दिर्ा िाएगा।

(17) पहाड़ी ढलानों को संरक्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार होगा:- (क) आंचजलक महार्ोिना पहाड़ी ढलानों पर क्षेत्रों का संकेत होगा िहां दकसी भी संजनमााण की अनुज्ञा नहीं िी िाएगी;

(ख) कटाव के एक उच्च जडग्री के साथ जवद्यमान खड़ी पहाड़ी ढलानों र्ा ढलानों पर दकसी भी संजनमााण की अनुज्ञा नहीं िी िाएगी ।

4. पाररजस्ट्थजतकी संविेी िोन में प्रजतजिद्ध और जवजनर्जमत दकए िान ेवाले दिर्ाकलापों की सचूी.- पाररजस्ट्थजतकी संवेिी िोन में सभी दिर्ाकलाप पर्ाावरण अजधजनर्म के उपबंधों और उसके अधीन बनाए गए जनर्मों जिसके अन्तगात तटीर् जवजनर्मन िोन, 2011 और पर्ाावरणीर् समाघात जनधाारण अजधसूचना, 2006 और अन्र् लागू जवजधर्ों के जिसमें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) सजम्मजलत हैं और दकर्े गर् ेसंिोधनों द्वारा िाजसत होंगे और नीचे िी गई सारणी में जवजनर्िाष्ट रीजत में जवजनर्जमत होंगे, अथाात् :- सारणी िम स.ं

(1) दिर्ाकलाप

(2) वणान

(3) क. प्रजतजिद्ध दिर्ाकलाप

1. वाजणजज्र्क खनन, पत्थर उत्खनन और अपघिाण इकाइर्ां । (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेलू आवश्र्कताओं जिसमें मकानों के संजनमााण र्ा मरम्मत के जलए धरती को खोिना सजम्मजलत है, के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघ ु और वृहत खजनि), पत्थर उत्खनन और अपघिाण इकाइर्ां तत्काल प्रभाव से प्रजतजिद्ध होंगी;

(ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) सं. 202 में टी.एन.

गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले में माननीर् उच्चतम [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 न्र्ार्ालर् के आििे 4 अगस्ट्त, 2006 और 2012 की ररट र्ाजचका (जसजवल) सं. 435 में गोवा फाउंडेिन बनाम भारत संघ के मामले में तारीख 21 अप्रैल, 2014 के आििे के अनुसरण में होगा ।

2. प्रििूण (िल, वार्ु, मृिा, ध्वजन, आदि) उत्पन करने वाले उद्योगों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रििूणकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नहीं होगी:

परन्तु, केन्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी समर्-समर् पर र्था संिोजधत मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में ऐसा जवजनर्िाष्ट न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गैर-प्रििूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि गैर-प्रििूणकारी कुटीर उद्यागों को बढ़ावा दिर्ा िाएगा।

3. बृहत िल जवद्युत पररर्ोिना की स्ट्थापना । प्रजतजिद्ध।

4. दकसी पररसंकटमर् पिाथा का उपर्ोग र्ा उत्पािन र्ा प्रसंस्ट्करण। प्रजतजिद्ध।

5. प्राकृजतक िल जनकार्ों र्ा क्षेत्र भूजम में अनुपचाररत बजहस्रााव का जनस्ट्सरण । प्रजतजिद्ध।

6. िलावन लकड़ी का वाजणजज्र्क उपर्ोग। प्रजतजिद्ध।

7. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई आरा जमलों की स्ट्थापना और जवद्यमान आरा जमलों का जवस्ट् तार अनुज्ञात नहीं होगा।

8. ईंट भट्टों की स्ट्थापना करना। प्रजतजिद्ध। आ. जवजनर्जमत दिर्ाकलाप

9. वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना। पाररजस्ट्थजतकी पर्ाटन दिर्ाकलापों लघ ु अस्ट्थार्ी संरचनाओं के जसवार् संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट है, नए वाजणजज्र्क होटल और ररसोटों को अनुज्ञात नहीं दकर्ा िाएगा:

परंतु, र्ह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के परे र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक इनमें स,े िो भी जनकट हो सभी नए पर्ाटन दिर्ाकलाप र्ा जवद्यमान दिर्ाकलाप का जवस्ट्तार पर्ाटन महार्ोिना और र्था लाग ूमागाििी जसद्धांतों के अनुरुप होगा।

10. संजनमााण दिर्ाकलाप। (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट हो, दकसी भी प्रकार के नर्े वाजणजज्र्क संजनमााण की अनुज्ञा नहीं होगी: परंतु र्ह दक स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत आवश्र्कताओं को पूरा करने के जलए, पैरा 3 के उप पैरा (1) में सूचीबद्ध दिर्ाकलापों सजहत अपने उपर्ोग के जलए, अपनी भूजम में भवन उप-जवजधर्ों के अनुसार, संजनमााण करने की अनजु्ञा होगी:

परंतु र्ह दक गैर–प्रििूणकारी लघु उद्योगों से संबंजधत संजनमााण दिर्ाकलाप लाग ूजनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत से जवजनर्जमत दकए िाएंग े और वे न्र्ूनतम होंगे। (ख) एक दकलोमीटर क्षेत्र से परे र्े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे।

11. वृक्षों की कटाई। (क) राज्र् सरकार में सक्षम प्राजधकारी की पूवा अनुज्ञा के जबना वन, सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर र्ा वनों में वृक्षों की कटाई नहीं होगी । 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) वृक्षों की कटाई संबंजधत कें रीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंध के अनुसार जवजनर्जमत होग े।

12. होटलों और लॉि के जवद्यमान पररसरों में बाड लगाना। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

13. जवद्युत और संचार टावरों का पररजनमााण और केबलों के जबछाए िाने और अन्र् बुजनर्ािी ढांचे। लाग ूजवजधर्ों के अधीन जवजनर्जमत होंगे (भूजमगत केबल के जबछाए िाने को बढ़ावा दिर्ा िा सकेगा)।

14. वन उत्पािों र्ा गैर काष् ठ वन उत्पािों का संग्रहण । लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

15. पोजलथीन बैगों का उपर्ोग । लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

16. पर्ाटन से संबंजधत अन्र् दिर्ाकलाप िैसे गमा वार्ु गुब्बारें, हलेीकॉप्टर, ड्रोन, माइिोलाइटस, आदि द्वारा पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से उड़ना िैसे दिर्ाकलाप करना। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

17. प्राकृजतक िल जनकार्ों र्ा सतही क्षेत्र में उपचाररत बजहस्रााव का जनस्ट्तारण । िल जनकार्ों में उपचाररत अपजिष्ट िल र्ा बजहस्रााव के जनस्ट्सारण से बचा िाएगा और उपचाररत अपजिष्ट िल के पुन:चिण और पुन:उपर्ोग के जलए प्रर्ास दकए िाएंगे। अन्र्था लागू जवजधर्ों के अनुसार उपचाररत बजहस्रााव के पुनचािण र्ा प्रवाह के जनवाहन को जवजनर्जमत दकर्ा िाएगा।

18. स्ट्थानीर् िनता द्वारा अपनार्ी िा रही वतामान कृजि और बागवानी पद्धजतर्ों के साथ डेर्ररर्ां, िगु्ध उत्पािन, िल कृजि और मत्स्ट्र् पालन। स्ट्थानीर् िनता के प्रर्ोग के जलए लाग ूजवजधर्ों के अधीन अनुमत होंगे।

19. पहाड़ी ढालों और निी तटों का संरक्षण । लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

20. राजत्र में र्ाजनक र्ातार्ात का संचलन । लाग ूजवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होंग े।

21. नागररक सुख सुजवधाओं सजहत अवसंरचनाएं । न्र्ूनीकरण उपार्ों को लागू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाना ।

22. जवद्यमान सड़कों को चौड़ा करना और उन्हें सुिढृ़ करना तथा नवीन सड़कों का संजनमााण । न्र्ूनीकरण उपार्ों को लाग ू जवजधर्ों, जनर्मों और जवजनर्मनों तथा उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाएगा ।

23. खुल े कंुआ, बोर कंुआ, आदि कृजि और अन्र् उपर्ोग के जलए । जवजनर्जमत और सम्बद्ध प्राजधकारी द्वारा दिर्ाकलापों की सख्ती से जनगरानी की िाएगी।

24. ठोस अपजिष्ट का प्रबन्धन। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

25. वार्ु और वाहन प्रििूण। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

26. वाजणजज् र्क सूचनापट्ट और होर्डंग। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

27. जवििेी प्रिाजतर्ों को लाना। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

28. फमों, जनगम और कंपजनर्ों द्वारा बडे़ पैमाने पर वाजणजज्र्क पिुओं और कुक्कुट फामों की स्ट्थापना । स्ट्थानीर् आवश्र्कताओं को पूरा करने के जलए लाग ू जवजधर्ों के अधीन जवजनर्जमत (अन्र्था उपबंजधत दकए गए) होंग े।

29. सतही और भूिल का वाजणजज्र्क जनष्किाण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।

30. प्रििूण उत्पन्न न करने वाले लघु उद्योग। फरवरी, 2016 में केन्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा िारी उद्योगों में वगीकरण के अनुसार समर्-समर् पर र्था संिोजधत गैर-प्रििूणकारी उद्योग और अपररसंकटमर् में, लघु और सेवा उद्योग, कृजि, पुष्प कृजि, उद्यान कृजि र्ा पाररजस्ट्थजतकी संवेिी िोन से ििेी सामग्री से उत्पािों को [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9

5. पाररजस्ट्थजतकी सवंेिी िोन की अजधसचूना की जनगरानी के जलए मानीटरी सजमजत-कें रीर् सरकार, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 3 की उपधारा (3) के अधीन इस अजधसूचना के उपबंधों की प्रभावी जनगरानी के जलए जनगरानी सजमजत का गठन करती ह,ै िो जनम्नजलजखत से जमलकर बनेगी, अथाात्:- ि.स.ं जनगरानी सजमजत का गठन पिनाम

1. जिला कलक्टर, जपथौरागढ़ अध् र्क्ष ,पिने;

2. उत्तराखंड के वन जवभाग द्वारा नाजमत एक प्रजतजनजध सिस्ट्र्, पिने;

3. राज्र् सरकार द्वारा नाजमत दकर्ा िाने वाला वन्र्िीव संरक्षण के क्षेत्र में काम कर रहे गैर सरकारी संगठनों का एक प्रजतजनजध सिस्ट्र्;

4. राज्र् सरकार द्वारा नाजमत िैव जवजवधता में एक जविेिज्ञ सिस्ट्र्;

5. राज्र् सरकार द्वारा नाजमत दकर्ा िाने वाला पाररजस्ट्थजतकी और पर्ाावरण का एक जविेिज्ञ सिस्ट्र्;

6. उत्तराखंड राज्र् प्रििूण जनर्ंत्रण बोडा का एक प्रजतजनजध सिस्ट्र्, पिने;

7. उप-संभागीर् मजिस्ट्रेट, धारचौला सिस्ट्र्, पिने;

8. वन्र्िीव वाडान, असकोट वन्र्िीव अभर्ारण्र् सिस्ट्र्, पिने;

9. संभागीर् वन अजधकारी, जपथौरागढ़ एव ंउप जनििेक, असकोट वन्र्िीव अभर्ारण्र् सिस्ट्र् –सजचव, पिने

6. जवचाराथा-जविर्.- (1) जनगरानी सजमजत इस अजधसूचना के उपबंधों के अनुपालन को जनगरानी करेगी।

(2) जनगरानी सजमजत का कार्ाकाल अगले आििे होन ेतक दकर्ा िाएगा, परंतु र्ह दक सजमजत के गैर-सरकारी सिस्ट्र्ों को समर्-समर् पर राज्र् सरकार द्वारा नामजनर्िाष्ट दकर्ा िाएगा। उत्पन्न करने वाले कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे।

33. िैजवक खेती। सदि र् रूप से बढ़ावा दिर्ा िाएगा।

34. सभी गजतजवजधर्ों के जलए हररत प्रौद्योजगकी को अंगीकृत करना । सदि र् रूप से बढ़ावा दिर्ा िाएगा।

35. कुटीर उद्योगों जिसके अंतगात ग्रामीण कारीगर भी हैं। सदि र् रूप से बढ़ावा दिर्ा िाएगा।

36. नवीकरणीर् ऊिाा और ईंधन का उपर्ोग । बार्ोगैस, सौर प्रकाि, इत् र्ादि को बढ़ावा दिर्ा िाएगा।

37. कृजि वाजनकी । सदि र् रूप से बढ़ावा दिर्ा िाएगा।

38. बागान लगाना और िड़ी बूरटर्ों का रोपण । सदि र् रूप से बढ़ावा दिर्ा िाएगा।

39. पाररजस्ट्थजतकी अनुकूल पररवहन का उपर्ोग । सदि र् रूप से बढ़ावा दिर्ा िाएगा।

40. कौिल जवकास । सदि र् रूप से बढ़ावा दिर्ा िाएगा।

41. जनम्नीकृत भूजम / वन / वास की बहाली । सदि र् रूप से बढ़ावा दिर्ा िाएगा।

(3) उन दिर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533 (अ), तारीख 14 जसतम्बर, 2006 की अनुसूची में सजम्मजलत हैं, और िो पाररजस्ट्थजतकी संवेिी िोन में आते हैं, जसवार् इसके िो पैरा 4 के अधीन सारणी में र्था जवजनर्िाष्ट प्रजतजिद्ध दिर्ाकलापों के, जनगरानी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त के जलए केरींर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को जनर्िाष्ट दकर्ा िाएगा।

(4) उन दिर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533 (अ) तारीख 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत नहीं है, और िो पाररजस्ट्थजतकी संवेिी िोन में आते हैं, जसवार् इसके पैरा 4 के अधीन सारणी में र्थाजवर्नाष्ट प्रजतजिद्ध दिलाकलापों के जनगरानी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे संबद्ध जवजनर्ामक प्राजधकरणों को जनर्िाष्ट दकर्ा िाएगा।

(5) जनगरानी सजमजत का सिस्ट्र्-सजचव र्ा संबद्ध उपार्ुि ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लंघन करता ह,ै पर्ाावरण अजधजनर्म की धारा 19 के अधीन पररवाि फाइल करने के जलए सक्षम होगा।

(6) जनगरानी सजमजत मुद्दा िर मुद्दा के आधार पर अपेक्षाओं पर जनभार रहते हुए संबद्ध जवभागों के प्रजतजनजधर्ों र्ा जविेिज्ञों, औद्योजगक संगमों र्ा संबद्ध पणधाररर्ों के प्रजतजनजधर्ों को अपने जवचार-जवमिा में सहार्ता के जलए आमंजत्रत कर सकेगी ।

(7) जनगरानी सजमजत प्रत्र्ेक विा की 31 माचा तक के अपने दिर्ाकलापों की वार्िाक कारावाई ररपोटा राज् र् के मुख् र् वन् र्िीव वाडान को उपाबंध-IV में संलि प्रोफामाा में उक् त विा के 30 िून तक प्रस्ट्तुत करेगी ।

(8) केन्रीर् सरकार का पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् जनगरानी सजमजत को अपने कृत्र्ों के प्रभावी जनवाहन के जलए ऐसे जनििे ि ेसकेगा, िो वह ठीक समझे ।

7. अजतररक् त उपार्.- इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए कें रीर् सरकार और राज् र् सरकार, अजतररक् त उपार्, र्दि कोई हों, जवजनर्िाष् ट कर सकें गी।

8. कोई अन् र् महत् वपूणा जविर् । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 2nd December, 2021 S.O. 4929(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O.

548(E), dated the 29 th January, 2019, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 29 th January, 2019;

AND WHEREAS, objections and suggestions were received from persons and stakeholders in response to the aforesaid draft notification were duly considered in the Ministry;

AND WHEREAS, Askot Wildlife Sanctuary is situated in Pithoragarh District of Uttarakhand State. The Sanctuary was established vide Government Order No. 3239/X-2-2013-19 (1) 2002 dated the 25 th July, 2002 in 2013, whereby 290.914 square kilometers Reserve Forest area of 12 forest blocks of Askot and Dharchula Ranges of Pithoragarh Forest Division and 309.086 square kilometers area of protected forest comprising areas of Van Panchayats and unclassified civil land were included. As such the Askot Wildlife Sanctuary was established in an area of 600 square kilometers. The principal objective for the formation of the Sanctuary was conservation of the wide variety of flora and fauna in the area;

AND WHEREAS, Askot Wildlife Sanctuary is home for a large number of rare and endangered plant and animal species. In the sanctuary there are 2600 plants, 250 birds and 37 mammal species like snow leopard (Panthera uncia), Himalayan black bear (Selenarctos thibetanus), musk deer (Moschus chrysogaster), Himalayan tahr (Hemitragus jemlahicus), blue sheep (Pseudois nayaur), serow (Capricornis sumatraensis). Among the fauna are species like loong, monal (Lophophorus impejanus), kalij pheasant (Lophura leucomelanos), cheer pheasant (Catreus wallichii) and musk deer (Moschus spp.) the flag species. The Askot Wildlife Sanctuary is also known as Musk Deer Park. Van ranjees, Vyasi, Rangdarma, Chaudasi, Rangbhotiya, Anwal and other backward class communities live in the Wildlife Sanctuary area. Bhotiyas migrate in the high Himalayan areas seasonally and are involved in activities like farming, wool trade, handicraft, sheep and goat rearing and collection of herbs and shrubs;

AND WHEREAS, Askot Wildlife Sanctuary is spread between the heights of 600 meters to 7000 meters and is located mostly in the watershed areas of the river Kali and its tributaries; the tributaries Dhauli and Gauri are to the north below the Rungling block above the river Kali at 1582 meters. Almost all the hill ranges are spread in the northwest and the first main range separates the upper Kali and Dhauli river catchment areas. Its highest points are Rungling peak 4075 meters and the lowest point is Tawaghat at 1108 meters. The valley areas are difficult and steep slope which are the series of forest blocks viz, Hiragumri, Jyotigaad and Rungling. The second main range separates the catchment areas of Dhauli and Gauri Ganga. In the forest blocks the highest point is Dug peak 4560 meters and the lowest point Jauljeevi and Chhiplakot at 4499 meters. The area is highly steep till 2100 meters but below that point is in gentle slope and the section are comprises of the forest blocks of Payya, Majtham, Daphiyadhura, Thakla, Dug and Sobla. The third group falls between the river Gauri, Ramganga and Kali and it has main peak Ghandhura at a height of 2501 meters;

AND WHEREAS, due to biotic interference and unnatural activities possibilities of man-wildlife conflict are rampant, there is need for controlling excessive grazing, lopping, fire incidence unscientific exploitation of land, mining and other activities associated with development in the Askot Wildlife Sanctuary;

AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Askot Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0 (zero) to 22 kilometres around the boundary of Askot Wildlife Sanctuary, in Pithoragarh District in the State of Uttarakhand as the Askot Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: -

1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 0 (zero) to 22 kilometres around the boundary of Askot Wildlife Sanctuary and the area of the Eco-sensitive Zone is 454.65 square kilometres. Zero extent of Eco-sensitive Zone towards Southern, Western and Eastern side of the Sanctuary is due to international border; whereas, in other places, the zero extent is due to the resolution taken during the public consultations with local community and primitive tribal groups (Van Raaji) habituating in the area.

(2) The boundary description of Askot Wildlife Sanctuary and its Eco-sensitive Zone is appended in Annexure-I.

(3) The maps of the Askot Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA and Annexure-IIB.

(4) Lists of geo-coordinates of the boundary of Askot Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure-III.

(5) There is no village falling inside the Eco-sensitive Zone of Askot Wildlife Sanctuary.

2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Ecosensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification and get it duly approved by the competent authority in the State.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:-

(i) Environment;

(ii) Forest and Wildlife;

(iii) Agriculture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism;

(vii) Rural Development;

(viii) Irrigation and Flood Control;

(ix) Municipal;

(x) Panchayati Raj;

(xi) Highways;

(xii) Uttarakhand State Pollution Control Board; and

(xiii) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 19 horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall provide mechanism for regulating developmental activities in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved by State Government shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:

Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as:-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities given in paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests.

(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone.

(e) The activities of eco-tourism shall be regulated as under, namely:-

(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:

Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, ecoeducation and eco-development;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.

(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by the State Government, whichever is more stringent.

(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-

(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;

(b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.

(10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:-

(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28 th March,

2016.

(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.

(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.

(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.

(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.

(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.

(16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.

(b) Only non-polluting industries shall be allowed within the Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) construction shall not be permitted on existing steep hill slopes or slopes with a high degree of erosion.

4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act and the rules made thereunder including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act, 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE Sl. 1. Commercial mining, stone quarrying and crushing units.

(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within the Ecosensitive Zone;

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).

New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:

Provided that non-polluting industries shall be allowed within the Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition the non-polluting cottage industries shall be promoted.

3. Establishment of major hydro-electric project.

Prohibited.

4. Use or production or processing of any hazardous substances.

Prohibited.

5. Discharge of untreated effluents in natural water bodies or land area.

Prohibited.

6. Commercial use of firewood. Prohibited.

7. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.

8. Setting up of brick kilns. Prohibited.

B. Regulated Activities

9. Commercial establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:

Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

10. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents:

Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

11. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.

12. Fencing of premises of hotels and lodges.

Regulated as per the applicable laws.

13. Erection of electrical and communication towers and laying of cables and other infrastructures.

Regulated under applicable laws (underground cabling may be promoted).

14. Collection of Forest produce or Non- Timber Forest produce.

Regulated as per the applicable laws.

15. Use of polythene bags. Regulated as per the applicable laws.

16. Undertaking other activities related to tourism like flying over the Ecosensitive Zone area by hot air balloon, helicopter, drones, microlites, etc.

Regulated as per the applicable laws.

17. Discharge of treated waste water or effluents in natural water bodies or land area.

The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water or effluent shall be regulated as per the applicable laws.

18. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

Permitted as per the applicable laws for use of locals.

19. Protection of hill slopes and river banks. Regulated as per the applicable laws.

20. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.

21. Infrastructure including civic amenities. Taking measures of mitigation as per the applicable laws, rules and regulations and available guidelines.

22. Widening and strengthening of existing roads and construction of new roads.

Taking measures of mitigation as per the applicable laws, rules and regulation and available guidelines.

23. Open Well, Borewell, etc. for agriculture and other usages.

Regulated as per the applicable laws.

24. Solid waste management. Regulated as per the applicable laws.

25. Air and vehicular pollution. Regulated as per the applicable laws.

26. Commercial sign boards and hoardings. Regulated as per the applicable laws.

27. Introduction of exotic species. Regulated as per the applicable laws.

28. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies.

Regulated (except as otherwise provided) as per the applicable laws except for meeting local needs.

29. Commercial extraction of surface and ground water.

Regulated as per the applicable laws.

30. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent authority.

31. Eco-tourism. Regulated as per the applicable laws.

32. Rain water harvesting. Shall be actively promoted.

33. Organic farming. Shall be actively promoted.

34. Adoption of green technology for all activities.

Shall be actively promoted.

36. Use of renewable energy and fuels. Bio-gas, solar light, etc. shall be actively promoted.

37. Agro-Forestry. Shall be actively promoted.

38. Plantation of Horticulture and Herbals. Shall be actively promoted.

39. Use of eco-friendly transport. Shall be actively promoted.

40. Skill Development. Shall be actively promoted.

41. Restoration of degraded land or forests or habitat.

Shall be actively promoted.

42. Environmental awareness. Shall be actively promoted.

5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification, under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- Sl. 2. A representative nominated by the Forest Department of Uttarakhand Member, ex officio;

A representative of Non-government Organization working in the field of wildlife conservation to be nominated by State Government Member;

4. An expert in Biodiversity nominated by the State Government Member;

An expert in Ecology and Environment to be nominated by the State Government Member;

6. A representative from Uttarakhand State Pollution Control Board Member, ex officio;

7. Sub-Divisional Magistrate, Dharchula Member, ex officio;

8. Wildlife Warden, Askot Wildlife Sanctuary Member, ex officio;

Divisional Forest Officer, Pithoragarh or Deputy Director, Askot Wildlife Sanctuary Member-Secretary, ex officio.

6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure-IV.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. Additional measures.- The Central Government and the State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. Orders of Supreme Court, etc.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
