जो बढ़ती मानवीय �Wयाकलाप1 से िनरंतर खतरे म' ह।ै भारतीय जंगली गधा का अंितम वास भी एक (Hतािवत िवi धरोहर Hथल ह ैऔर कEछ जीवमंडल �रजव� के अंतग�त आता ह।ै अतः इस 7े� के अJय सभी सकंटाप_ वJयजीव1 और अि&तीय और गितशील प�रदgृय क� सुर7ा के िलए भारतीय जंगली गधे को संरि7त करने क� तुरंत आवgयकता है। और, जंगली गधा अभयार@य के चार1 ओर के 7े� को, िजसका िवHतार और सीमाएं इस अिधसचूना के पैरा 1 म' िविनkद�l ह?, पया�वरण और पा�रिHथितक� क� दिृl स ेपा�रिHथितक� संवेदी जोन के eप म' सुरि7त और संरि7त करना तथा उ0 पा�रिHथितक� संवेदी जोन म' उdोग1 और उdोग1 के वग] और उनके (चालन और (संHकरण करने को (ितिषL करना आवgयक ह ै; अतः, अब, केJGीय सरकार, पया�वरण (संर7ण) अिधिनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प�ठत पया�वरण (संर7ण) अिधिनयम, 1986 (1986 का 29) क� उपधारा (1) तथा धारा 3 क� उपधारा (2) एवं उपधारा (3) के खंड (v) और खंड (xiv) &ारा (द< शि0य1 का (योग करते >ए गुजरात राDय म' जंगली गधा अभयार@य क� सीमा के चार1 ओर 0 स े 1.2 �कलोमीटर तक िवH ता�रत 7े� को जंगली गधा अभयार@य पा�रिHथितक� संवेदी जोन (िजसे इसम' इसके पg चात् पा�रिHथितक� सवेंदी जोन कहा गया ह)ै के eप म' अिधसिूचत करती है, िजसका िववरण िनpानुसार ह,ै अथा�त्:-- 1. पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन काकाकाका िव�तारिव�तारिव�तारिव�तार औरऔरऔरऔर उसक�उसक�उसक�उसक� सीमाएंसीमाएंसीमाएंसीमाएं::::— (1) पा�रिHथितक� संवेदी जोन aेणी का िवHतार शूJय से 1.2 �कलोमीटर के अतंग�त गुजरात के कEछ, मोरबी, सरेुJGनगर और पाटन िजल1 के भाग1 म' अभयार@य क� सीमा से 7े� 638.83 वग� �कलोमीटर तक फैला >आ ह।ै (2) पा�रिHथितक� संवेदी जोन क� सीमा का िववरण उपाबंधउपाबंधउपाबंधउपाबंध IIII के eप म' संलu ह ै। (3) अवHथान, भिूम उपयोग और अ7ांश और दशेांतर के साथ पा�रिHथितक� संवेदी जोन और जंगली गधा अभयार@य का मानिच� उपाबंधउपाबंधउपाबंधउपाबंध----IIIIIIII कककक, , , , उपाबंधउपाबंधउपाबंधउपाबंध----IIIIIIII ख और ख और ख और ख और उपाबंधउपाबंधउपाबंधउपाबंध----IIIIIIII ग ग ग ग के eप म' संलu ह ै। (4) इस अिधसूचना म' दशा�ए गए पा�रिHथितक� संवेदी जोन और संरि7त 7े� क� सीमाw के मुfय Mबंदwु के भ-ूिनदxशाकं उपाबंधउपाबंधउपाबंधउपाबंध IIIIIIIIIIII के eप म' संलu ह।ै (5) पा�रिHथितक� संवेदी जोन 7े� के अंतग�त आने वाले Yाम1 क� सूची उपाबंध उपाबंध उपाबंध उपाबंध IVIVIVIV म' दी गयी ह।ै ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 2222.... पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आंचिलकआंचिलकआंचिलकआंचिलक महायोजनामहायोजनामहायोजनामहायोजना::::–––– (1) राDय सरकार, पा�रिHथितक� संवेदी जोन के (योजन के िलए राजप� म' इस अिधसूचना के अंितम (काशन क� तारीख से दो वष� क� अविध के भीतर, Hथानीय /ि0य1 के परामश� से और राजप� म' इस अिधसूचना म' �दए गए अनुबंध1 का पालन करके आंचिलक महायोजना तैयार करेगी राD य सरकार म' स7म (ािधकारी &ारा अनुमो�दत होगी । (2) जंगली गधा अभयार@य के पा�रिHथितक� संवेदी जोन के िलए आंचिलक महायोजना, राD य सरकार &ारा इस अिधसूचना म' िविनkद�y ट eप म' ऐसी रीित म' और सुसंगत क' Gीय और राD य िविधय1 के अनुeप भी और क' Gीय सरकार &ारा जारी माग�िनदxश, य�द कोई ह1, &ारा तैयार होगी। (3) आंचिलक महायोजना, उ0 योजना म' पया�वरणीय और पा�रिHथितक� बात1 को समाकिलत करने के िलए राD य के िनpिलिखत िवभाग1 के परामश� से तैयार होगी, अथा�त्:-

(i) पया�वरण;

(ii) वन और वJयजीव;

(iii) कृिष;

(iv) राजH व;

(v) शहरी िवकास;

(vi) पय�टन;

(vii) Yामीण िवकास;

(viii) Mसंचाई और बाढ़ िनयं�ण;

(ix) नगरपािलका;

(x) पंचायती राज; और

(xi) लोक िन मा�ण िव भाग। (4) आंचिलक महायोजना अनुमो�दत िवdमान भ-ूउपयोग, अवसंरचना और �Wयाकलाप1 पर कोई िनब|धन अिधरोिपत नह: करेगी जब तक �क इस अिधसूचना म' और आंचिलक महायोजना म' सभी अवसंरचना और अिधक (भावी और पा�रिHथितक� अनुकूल �Wयाकलाप कारक इस (कार िविनkद�l न हो । (5) आंचिलक महायोजना म' अनाEछा�दत 7े�1 के जीण]Lार, िवdमान जल िनकाय1 के संर7ण, आवाह 7े�1 के (बंधन, जल-संभर1 के (बंधन, भूतल जल के (बंधन, मदृा और नमी संर7ण, Hथानीय समुदाय1 क� आवgयकताw और पा�रिHथितक� और पया�वरण से संबंिधत ऐस ेअJय पहलwू, िजन पर }यान दनेा आवgयक ह,ै के िलए उपबंध ह1गे । (6) आंचिलक महायोजना सभी िवdमान पूजा H थल1, Yाम1 और नगरीय बंदोबHत1, वन1 के (कार और �कH म1, कृिष 7े�1, ऊपजाऊ भूिम, ह�रत 7े� जैसे उdान और उसी (कार के H थान, उdान कृिष 7े�, फलोउdान, झील1 और अJय जल िनकाय1 का अ�यांकन करेगी और इस योजना के मानिच� के साथ िवdमान और (Hतािवत भिूम उपयोग िवशेषताw का िववरण संलu होगा । (7) आंचिलक महायोजना H थानीय समदुाय1 क� जीवकोपाज�न को सुिनिg चत करने के िलए, पा�रिHथितक� संवेदी जोन म' िवकास को पा�रिHथितक� अनुकूल िवकास के िलए पैरा 4 क� सारणी म' सूचीबL िविनयिमत करेगी और अिधसूचना म' िविनkद�l (ितिषL, िविनयम और संव�ध�त �Wयाकलाप1 का अनुसरण करेगी। (8) आंचिलक महायोजना 7े�ीय िवकास योजना के साथ सह-िवHतारी होगी । (9) आंचिलक महायोजना पा�रिHथितक� संवेदी जोन म' िवकास को िविनयिमत करेगी िजससे पा�रिHथितक� अनुकूल िवकास Hथानीय समुदाय1 क� जीवकोपाज�न सुर7ा के िलए सुिनिcत �कया जा सकेगा । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (10) आंचिलक महायोजना इस अिधसूचना म' �दए गए उपबंध1 के अनुसार म' अपने कृ;य1 का पालन करने के िलए मानीटरी सिमित के िलए एक संदभ� दHतावेज इस (कार अनुमो�दत करेगी । 3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय::::———— राDय सरकार इस अिधसूचना के उपबंध1 को (भावी करने के िलए िनpिलिखत उपाय करेगी, अथा�त्:— (1) भूभभूूभू----उपयोगउपयोगउपयोगउपयोग:::: –––– (क) पा�रिHथितक� संवेदी जोन म' वन1, उdान-कृिष 7े�1, कृिष 7े�1, आमोद-(मोद के (योजन1 के िलए िचिJहत �कए गए पाक� और खुले Hथान1 का वािणिDयक और औdोिगक संबL िवकास �Wयाकलाप1 के िलए उपयोग या संप�रवत�न नह: होगा: (ख) परंतु पा�रिHथितक� संवेदी जोन के भीतर भाग (क) म' िविनkद�l (योजन से िभ_ (योजन के िलए कृिष और अJय भूिम का संप�रवत�न, मानीटरी सिमित क� िसफा�रश पर और यथा लागू और 7े�ीय नगर योजना अिधिनयम और केJGीय/राDय सरकार के अJय िनयम1 और िविनयम1 के अधीन स7म (ािधकारी के पूव� अनुमोदन से, और इस अिधसूचना के उपबंध1 &ारा Hथानीय िनवािसय1 क� िनpिलिखत आवासीय जeरत1 को पूरा करने के िलए अनु�ात �कया जाएगा, जैस े�क:- (i) िवdमान सड़क1 को चौड़ा करना, उJह' सुदढृ करना और नई सड़क1 का सिंनमा�ण; (ii) बुिनयादी ढांच1 और नाग�रक सुिवधाw का संिनमा�ण और नवीकरण; (iii) (दषूण उ;प_ न करने वाले लघ ुउdोग, (iv) कुटीर, उdोग िजसके अंतग�त Yामीण उdोग ह?; सुिवधाजनक भ@डार और Hथानीय सुिवधाw जो पा�रिHथितक� पय�टन म' सहायक ह? िजसम' Yह वास सि�मिलत ह;ैऔर (v) संव�ध�त �Wयाकलाप और पैरा 4 के अधीन �दया गया ह:ै (ग) परंतु यह और भी �क 7े�ीय नगर योजना अिधिनयम और अJय िनयम1 और िविनयम1 के अंतग�त राDय सरकार के पूव� अनुमोदन और संिवधान के अनुEछेद 244 और त;समय (वृ< िविध के उपबंध1 के अनुपालन के िबना, िजसके अंतग�त अनुसूिचत जनजाित और अJय परंपरागत वन िनवासी (वन अिधकार1 क� माJयता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिDयक या उdोग िवकास �Wयाकलाप1 के िलए जनजातीय भूिम का उपयोग अनु�ात नह: होगा: (घ) परंतु यह और भी �क पा�रिHथितक� संवेदी जोन के भीतर भ-ूअिभलेख1 म' उपसंजात कोई �ु�ट, मानीटरी सिमित के िवचार (ा= करने के पcात् राDय सरकार &ारा (;येक मामले म' एक बार संशोिधत होगी और उ0 गलती के संशोधन क� सूचना क' Gीय सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय को दी जाएगी। (ड.) परंतु यह और भी �क उपयु�0 �ु�ट का संशोधन म' इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म' भ-ूउपयोग का प�रवत�न सि�मिलत नह: होगा; (च) अनु(यु� त या अनु; पादक कृिष 7े�1 म' पुन: वनीकरण के और पया�वास और जैव- िविवधता क� बहाली के (यास �कए जाएंगे। (2) �ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत::::— आचंिलक महायोजना म' सभी (ाकृितक जल �ोत1 क� पहचान क� जाएगी और उनके सरं7ण और पुन)जीवन के िलए योजना सि� मिलत होगी राDय सरकार &ारा इन 7े�1 म' या उनके िनकट िवकास �Wयाकलाप1 जो ऐसे 7े�1 के िलए हािनकारक ह,ै को (ितिषL करने के िलए ऐसी रीित से माग�िनदxश तैयार करेगा। (3) पय�टन/पा�रि�थितक� पय�टनपय�टन/पा�रि�थितक� पय�टनपय�टन/पा�रि�थितक� पय�टनपय�टन/पा�रि�थितक� पय�टन:::: ———— (क) पा�रिHथितक� संवेदी जोन के भीतर सभी नए पा�रिHथितक� पय�टन �Wयाकलाप या िवdमान पय�टन �Wयाकलाप1 का िवHतार पा�रिHथितक� संवेदी जोन के िलए पय�टन महायोजना के अनुसार होगा । (ख) पा�रिHथितक� पय�टन महायोजना पय�टन िवभाग, &ारा राDय के पया�वरण और वन िवभाग के परामश� से तैयार होगी । (ग) पय�टन महायोजना आंचिलक महायोजना का एक घटक होगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 (घ) पा�रिHथितक� पय�टन संबंधी �Wयाकलाप िनpानुसार िविनयिमत ह1गे, अथा�त् :- (i) जंगली गधा अभयार@य क� सीमा से एक �कलोमीटर के भीतर या पा�रिHथितक� संवेदी जोन के िवHतार तक, इनम' जो भी िनकट है, वािणिDयक होटल और �रसोट� का नया सि_मा�ण अनु�ात नह: �कया जाएगा। परंतु, जंगली गधा अभयार@य क� सीमा स ेएक �कलोमीटर क� दरूी से परे पा�रिHथितक� संवेदी जोन के िवHतार तक होटल1 और सैरगाह1 का Hथापन केवल पूव� प�रभािषत और प�रिनिcत 7े�1 म' पय�टन महायोजना के अनुसार पा�रिHथितक� पय�टन सुिवधाw के िलए ही अनु�ात होगा; (ii) पा�रिHथितक� संवेदी जोन के भीतर सभी नए पय�टन �Wयाकलाप1 या िवdमान पय�टन �Wयाकलाप1 का िवHतार क' Gीय सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय के माग�दश�क िसLांत1 के &ारा और राy �ीय U या� संर7ण (ािधकरण, &ारा जारी पा�रिHथितक� पय�टन (समय-समय पर यथा संशोिधत) माग�दश�क िसLांत1 के अनुसार होगा; 9. संिनमा�ण �Wयाकलाप । (क) संरि7त 7े� क� सीमा से एक �कलोमीटर के भीतर या पा�रिHथितक� संवेदी जोन क� सीमा तक, इनम' जो भी अिधक िनकट हो, �कसी भी (कार के नये वािणिDयक सिंनमा�ण क� अनु�ा नह: होगी:

10. गैर (दषूणकारी लघु उdोग। फरवरी, 2016 म' केJGीय (दषूण िनयं�ण बोड� &ारा जारी उdोग1 के वग�करण के अनुसार गैर-(दषूणकारी उdोग और अप�रसकंटमय लघु और सेवा उdोग, कृिष, पुyप कृिष, बागबानी या कृिष आधा�रत उdोग, जो पा�रिHथितक� संवेदी जोन से दशेी सामिYय1 से उ;पाद बनाते ह?, स7म (ािधकारी &ारा अनु�ात ह1गे।

11. फम�, कारपोरेट, कंपिनय1 &ारा बड़ ेपैमाने पर वािणिDयक पशुधन संपदा और कु�कुट फाम� क� Hथापना । लागू िविधय1 के अनुसार िविनयिमत (अJ यथा उपबंिधत के िसवाय) ह1गे ।

12. वृ71 क� कटाई । (क) राDय सरकार के स7म (ािधकारी क� पूव� अनुमित के िबना वन भिूम या सरकारी या राजHव या िनजी भूिम पर वृ71 क� कटाई नह: होगी । (ख) वृ71 क� कटाई क' Gीय या संबंिधत राDय के अिधिनयम या उसके अधीन बनाए गए िनयम1 के उपबंध1 के अनुसार िविनयिमत होगी ।

13. वन उ;पाद1 और गैर का� वन उ;पाद1 (एनटीएफपी) का संYहण । लागू िविधय1 के अधीन िविनयिमत होगा ।

14. िवdुत और संचार टॉवर लगाने और तार-िबछाने और अJय बुिनयादी ढांचे क� /वHथा । लागू िविधय1 के अधीन िविनयिमत होगा । भूिमगत केबल िबछाने को बढ़ावा �दया जाएगा।

15. नाग�रक सुिवधाw सिहत बुिनयादी ढांचा। इसक� /वHथा लागू िविधय1, िनयम1, िविनयम1 और म�जूदा �दशािनदxश1 के अनुसार उपशमन उपाय1 के साथ क� जाएगी।

16. िवdमान सड़क1 को चौड़ा करना, उJह' सुदढृ बनाना और नई सड़क1 का िनमा�ण। लागू िविधय1, िनयम1, िविनयम1 और मौजूदा �दशािनदxश1 के अनुसार उपशमन उपाय1 के साथ �कया जाएगा।

17. पय�टन से संबंिधत अJय �Wयाकलाप जैसे �क पा�रिHथितक� संवेदी जोन 7े� के ऊपर स े गम� वायु के गु5बारे, हलेीका�टर, �ोन, माइWोलाइ�स लागू िविधय1 के अधीन िविनयिमत होगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9 आ�द को उडाना आ�द।

18. पव�तीय ढ़लान1 और नदी तट1 का संर7ण । लागू िविधय1 के अधीन िविनयिमत होगा ।

19. राि� म' वाहन यातायात का संचलन । लागू िविधय1 के अधीन वािणिDयक (योजन के िलए िविनयिमत होगा।

20. Hथानीय जनता &ारा अपनायी जा रही वत�मान कृिष और बागवानी (थाw के साथ डेय�रया,ं दPुध उ;पादन, जल कृिष और म;Hय पालन। Hथानीय जनता के (योग के िलए लागू िविधय1 के अधीन अनु�ात होगा ।

21. (ाकृितक जल िनकाय1 या भ ू 7े� म' उपचा�रत अपिशl जल/बिह�ा�व का िनHसारण। जल िनकाय1 म' उपचा�रत अपिशl जल/बिह�ा�व के िनHसारण से बचा जाएगा। उपचा�रत अपिशl जल के पुनच�Wण और पुन:उपयोग के (यास �कए जाएंगे अJयथा उपचा�रत अपिशl जल/बिह�ा�व का िनHसारण लागू िविधय1 के अनुसार िविनयिमत �कया जाएगा।

22. सतही और भूजल का वािणिDयक (योग एवं िनyकष�ण । लागू िविधय1 के अधीन िविनयिमत होगा ।

23. कृिष या अJय उपयोग के िलए खुल ेकुएं/ बोर कुए ंआ�द का िनमा�ण । समुिचत (ािधकारी &ारा िविनयिमत �कया जाएगा और �Wयाकलाप क� सfत मानीटरी क� जाएगी।

सि�मिलत �Wयाकलाप1 और इस अिधसूचना के पैरा 4 के अधीन सारणी म' िविनkद�y ट (ितिषL गितिविधय1 के िसवाय आने वाले ऐसे �Wयाकलाप1 क� दशा म' वाHतिवक िविनkद�l Hथलीय दशाw पर आधा�रत मानीटरी सिमित &ारा संवी7ा क� जाएगी और उ0 अिधसूचना के उपबंध1 के अधीन पूव� पया�वरण िनकासी के िलए केJGीय सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय को िनkद�l क� जाएगी । (iv) इस अिधसूचना के पैरा 4 के अधीन यथा िविनkद�l (ितिषL AND WHEREAS, copies of the Gazette containing the said notification were made available to the public on the 16th January, 2018;

AND WHEREAS, no objections and suggestions were received from the public and stakeholders in response to the draft notification;

AND WHEREAS, the Wild Ass Sanctuary is spread over an area of 4953.712 square kilometer and located in parts of Kachchh, Morbi, Surendranagar and Patan districts in the State of Gujarat;

AND WHEREAS, the flora and fauna represent rich biological significance of this Sanctuary;

the Wild Ass Sanctuary is habitat of Indian Wild Ass/Gurkhar (Equus hemionus khur), Black buck/kariyar (Antilope cervicarpa), Chinkara (Gazella bennettii), Striped Hyena (Hyaena hyaena), Wolf (Canis lupus), Desert Fox (Vulpus vulpus pusilla), Jackal (Canis aureus), Indian marbled toad (Duttaphrynus), stomaticus), Kutchi prawn/Jhinga (Metapenaeus kutchensis) etc; the Birds in the Wild Ass Sanctuary are Macqueen’s bustard (Chalmydotis macqueenii), White-rumped vulture (Gyps bengalensis). desert courser Caspian tern (Hydroprogne caspia), Sarus crane (Grus antigone), Common Crane (Grus grus), Demoiselle crane (Grus virgo), Osprey (Pandion haliaetus), Greater Flamingo (Phoenicopterus roseus), Lesser Flamingo (Phoenicopterus minor) etc, while Spiney tailed lizard (Uromastrix hardwikii), Desert monitor (Veranus griseus), Indian flapshell turtle Lissemys punctata), Rock agama (Agama spp.), Fan-throated lizard (Sitana ponticeriana), Saw scaled viper (Echis carinatus) etc. are the important species of butterfly, insects, reptiles in the Wild Ass Sanctuary; the flora species available in the Sanctuary are Morad (Sueda fruticosa), Ud-morad ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 25 (Sueda nudiflora), Lana (Sueda maritima), Dolri (Aeluropus lagopoides),Tal baval (Acacia farnesiana), Theg (Cyperus bulbosus), Jhenjvo (Dichanthium annulatum), Bethu lapdu (Aristida spp.), Gorad (Acacia senegal), Desi baval (Acacia nilotica), Pilu (Salvadora persica, S. oleoids), Limbdo (Azadirachta indica), Kerdo (Capparis deciduas), Gundee (Cordia gharaf) etc;

AND WHEREAS, Dolri (Aeluropus lagopoides), Morad (Sueda fruticosa), Parasi (Tamarix troupii, Indian Wild Ass (Equus hemionus khur), Sarus crane (Grus antigone) are the important Endangered flora and fauna of the Sanctuary, while Lesser Flamingo (Phoenicopterus minor) and Wolf (Canis lupus) are the threatened species; Uud morad (Sueda nudiflora), Bethi morad (Sueda fruticosa), Dolri (Aluropus lagopoides), Parasi (Tamarix troupii), Indian Wild Ass (Equus hemionus khur), Kutchi prawn (Metapenaeus kutchensis) are the endemic species of Wild Ass Sanctuary;

AND WHEREAS, the Sanctuary is the last refuge of the endangered Indian Wild Ass (Equus hemionus khur), which is a sub-species of Asiatic Wild Ass (Equus hemionus) and once it was distributed well across the north-west of India and West Pakistan; They existed as far north as Jaisalmer and Bikaner in Rajasthan and Sind and Beluchistan in Pakistan; now, the equin species have been locally extinct from all its earlier habitats and the Wild Ass Sanctuary has become their last home where their population is thriving under the conservation efforts made by the government;

the Indian Wild Ass is representing the Little Rann of Kuchchh landscape and acting as a flagship species giving protection umbrella to the rest of the species of the landscape; Hyena and Indian Grey Wolf are the large carnivores of the Sanctuary; Desert Fox, Indian Fox and Desert Cat are among the important lesser carnivore species which are under continuous threat from the increasing human activities; the last home of Indian Wild Ass is also a proposed World Heritage site and comes under Kutch Biosphere Reserve, therefore, it is the urgent need to conserve the Indian Wild Ass to protect the unique and dynamic landscape and all other threatened wildlife of this region;

AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in paragraph 1 of this notification, around the protected area of Wild Ass Sanctuary, as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco- Sensitive Zone;

NOW THEREFORE, in exercise of the power conferred by sub section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent from zero to 1.2 kilometers around the boundary of the Wild Ass Sanctuary in the State of Gujarat as Wild Ass Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and Boundaries of Eco-Sensitive Zone. -

(1) The extent of Eco-Sensitive Zone range from zero to 1.2 kilometers consisting of an area of

638. 83 square kilometer from the boundary of the Sanctuary in the parts of Kachchh, Morbi, Surendranagar and Patan districts in the State of Gujarat.

(2) The boundary description of the Eco-Sensitive Zone is appended as Annexure I.

(3) The map of Wild Ass Sanctuary and Eco-Sensitive Zone along with location, land use and latitudes and longitudes are appended as Annexure-II A, Annexure-II B and Annexure-II C.

(4) The geo-coordinates showing prominent points of the boundaries of Protected Area and Eco-Sensitive Zone are appended to this notification as Annexure III.

(5) The list of villages falling in the in Eco-Sensitive Zone area in given at Annexure IV.

2. Zonal Master Plan for Eco-Sensitive Zone. - i. The State Government shall, for the purpose of the Eco-Sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the Competent authority of State.

The Zonal Master Plan for the Eco-Sensitive Zone of Wild Ass Sanctuary shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

iii. The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said Plan, namely: -

(a) Environment;

(b) Forest and Wildlife;

(d) Revenue;

(e) Urban Development;

(f) Tourism;

(g) Rural Development;

(h) Irrigation and Flood Control;

(i) Municipal;

(j) Panchayati Raj;

(k) Public Works Department.

iv. The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and ecofriendly.

v. The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

vi. The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.

vii. The Zonal Master Plan shall regulate development in Eco-Sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities.

viii. The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

ix. The Zonal Master Plan shall regulate development in Eco-Sensitive Zone so as to ensure ecofriendly development for livelihood security of local communities.

x. The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by State Government - The State Government shall take the following measures for giving effect to the provisions of this notification, namely: -

(1) Land use. –

(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-Sensitive Zone of shall not be used or converted into areas for commercial or residential complex or industrial activities;

(b) Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-Sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities and given under paragraph 4.

(c) Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007);

(d) Provided also that any error appearing in the land records within the Eco-Sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change;

(e) Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph;

(f) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies. -The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism/ Eco-tourism

(a) All new eco-tourism activities or expansion of existing tourism activities within the Eco- Sensitive Zone shall be as per the Tourism Master Plan for the Eco-Sensitive Zone.

(b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests.

(d) The activities of eco-tourism shall be regulated as under, namely: -

(i) no new construction of hotels and resorts shall be permitted within one kilometer from the boundary of the Wild Ass Sanctuary or upto the extent of the Eco Sensitive Zone, whichever is nearer; Provided that, beyond the distance of one kilometer from the boundary of the Wild Ass Sanctuary till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan.

(ii) all new tourism activities or expansion of existing tourism activities within the Eco- Sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the ecotourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;

(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within Eco-Sensitive Zone area.

(4) Natural heritage. - All sites of valuable natural heritage in the Eco-Sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites. - Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.

(6) Noise pollution. - Prevention and Control of noise pollution in the Eco-Sensitive Zone shall be carried out in accordance with Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto.

(7) Air pollution. - Prevention and control of air pollution in the Eco-Sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto.

(8) Discharge of effluents. - Discharge of treated effluent in Eco-Sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent.

(9) Solid wastes. - Disposal and management of solid wastes shall be as under: -

(a) the solid waste disposal and management in the Eco-Sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-Sensitive Zone.

(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco- Sensitive Zone.

(10) Bio-medical waste. – Bio medical waste management shall be as under:

(a) The bio-medical waste disposal in the Eco-Sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016.

(b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.

(11) Plastic waste management. - The plastic waste management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.

(12) Construction and demolition waste management. - The construction and demolition waste management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.

(13) E-waste. - The E- Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.

(14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution. - Prevention and control of vehicular pollution shall be carried out in accordance with applicable laws and efforts shall be made for use of cleaner fuel for example CNG, LPG, etc.

(16) Industrial units. –

(i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.

(ii) Only non-polluting industries shall be permitted within Eco-Sensitive Zone as per classification of industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification. In addition, non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes. – The protection of hill slopes shall be as under:-

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.

4. List of activities prohibited or to be regulated within the Eco-Sensitive Zone. – All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S No Activity Remarks

(a) All new existing and mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal consumption.

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N.

Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).

(a) No new industries and expansion of existing polluting industries in the Eco-sensitive Zone shall be permitted.

(b) Only non-polluting industries shall be permitted within Eco-sensitive Zone as per classification of industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification.

3. Establishment of major hydroelectric project.

Prohibited (except as otherwise provided) as per applicable laws.

4. Use or production or processing of any hazardous substances.

Prohibited (except as otherwise provided) as per applicable laws.

5. Discharge of untreated effluents in natural water bodies or land area.

Prohibited (except as otherwise provided) as per applicable laws.

6. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.

7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.

B. Regulated Activities

8. Commercial establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for ecotourism activities.

Beyond one kilometer from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

9. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-Sensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents :

(i) Widening and strengthening of existing roads and construction of new roads;

(ii) Construction and renovation of infrastructure and civic amenities;

(iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016;

(iv) Cottage industries including village industries;

convenience stores and local amenities supporting ecotourism including homestays; and

(v) Promoted activities listed in this Notification.

(b) Provided further that the construction activity related to small scale industries not causing pollution shall ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 31 be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

10. Small scale non polluting industries.

Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent authority.

11. Establishment of large-scale commercial livestock and poultry farms by firms, companies, etc .

Regulated (except as otherwise provided) as per applicable laws.

12. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.

13. Collection of Forest Produce or Non-Timber Forest Produce (NTFP).

Regulated under applicable laws.

14. Erection of electrical and communication towers and laying of cables and other infrastructures.

Regulated under applicable laws (underground cabling may be promoted).

15. Infrastructure including civic amenities.

Shall be done with mitigation measures, as per applicable laws, rules and regulations and available guidelines.

16. Widening and strengthening of existing roads and construction of new roads.

Shall be done with mitigation measures, as per applicable laws, rules and regulations and available guidelines.

17. Undertaking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.

18. Protection of hill slopes and river banks.

19. Movement of vehicular traffic at night.

Regulated, for commercial purpose, under applicable laws.

20. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

5. Monitoring Committee .- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this Notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely: -

1. Collector of Morbi, Surendranagar, Patan and Kutchh Chairman

A representative of Non-Governmental Organisation working in the field of environment (including heritage conservation) to be nominated by the State Government Member

3. Regional Officer, Gujarat State Pollution Control Board Member

A representative of the Department of Forest and Environment, Government of Gujarat Member

One expert in the area of ecology and environment to be nominated by the State Government Member

6. Member State Biodiversity Board Member

7. Deputy Conservator of Forest, Wild Ass Sanctuary Member- Secretary water bodies or land area. made for recycle and reuse of treated waste water, and the discharge of treated waste water/effluent shall be regulated as per applicable laws.

22. Commercial extraction of surface and ground water.

23. Open well, bore well etc, for agriculture or other usage Regulated and the activity should be strictly monitored by the appropriate authority.

24. Solid waste management. Regulated under applicable laws.

25. Introduction of exotic species.

6. Terms of Reference. –

(1) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government, and subsequently the Monitoring Committee would be constituted by the State Government.

(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma given in Annexure V.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The Central Government and State Government may specify additional measures, if any, for giving effect to the provisions of this notification.

8. The provisions of this notification are subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
