PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार् ुपररवतान मतं्रालर् अजधसचूना नई दिल्ली, 20 फरवरी, 2020 का.आ. 794(अ).—प्रारुप अजधसूचना भारत के रािपत्र, असाधारण में भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1223(अ) तारीख 8 माचा, 2019 द्वारा प्रकाजित की गई थी जिसमें उन सभी व्यजिर्ों से, जिनको उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अंतर्वाष्ट करने वाले रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थी, साठ दिन की अवजध के भीतर, आक्षेप और सुझाव आमजंत्रत दकए गए थे;

और, उि प्रारुप अजधसूचना को अंतर्वाष्ट करन ेवाली रािपत्र की प्रजतर्ां िनता को 8 माचा, 2019 को उपलब्ध करा िी गई थीं;

और, प्रारुप अजधसूचना के उत्तर में व्यजिर्ों और पणधाररर्ों से कोई भी आक्षेप और सुझाव प्राप्त नहीं हुए;

ओसुि ुझील, तजमलनाडु के जवल्लुपुरम जिला में बडी उथली आर्द्ाभूजम ह ै11°56’ से 11°58’ उ और 79°44’ से 79°45’ पू में जस्ट्थत ह।ै र्ह सबसे महत्वपूणा तािा िल वाली झील ह ैऔर र्ह पुडुचेरी-जवल्लपुुरम-वालुथवुर मुख्र् सडक पर पजिमी तरफ पडुुचेरी िहर से 12 दकलोमीटर िरू ह।ै र्ह तजमलनाडु के पेराम्बई-पौथुरई ग्रामों वनरू तालुक, जवल्लुपुरम जिल ेमें जस्ट्थत ह।ै तजमलनाडु की तरफ अजधकतर ओस्ट्टरी तटो में अजधकतर ग्रामीण बजस्ट्तर्ााँ हैं, स.ं 725] नई दिल्ली, िुक्रवार, फरवरी 21, 2020/फाल् गनु 2, 1941 No. 725] NEW DELHI, FRIDAY, FEBRUARY 21, 2020/PHALGUNA 2, 1941 सी.जी.-डी.एल.-अ.-25022020-216387 CG-DL-E-25022020-216387 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] झील की पांजडचेरी की तरफ मखु्र् रूप से िहरी र्ा उपनगर हैं। झील की पररजध 7.275 दकलोमीटर ह ैऔर झील का कुल िलग्रहण क्षेत्र 15.54 वगा दकलोमीटर ह।ै र्ह मुख्र् रूप से सुथुकेनी नहर के माध्र्म से सुथुकेनी चेक बांध से और झील बेजसन के रन-ऑफ से िल प्राप्त करता ह।ै सुथुकेनी चेक बांध िंकरपाराणी निी के पार बनार्ा गर्ा ह।ै सुथुकेनी बांध के जलए प्रमुख िल स्रोत तजमलनाडु राज्र् के जवल्लपुुरम जिला के वीिरू बांध से अजतररि िल प्राप्त होता ह;ै और, टैंक का कुल क्षेत्रफल 8.00 वगा दकलोमीटर (800 हके्टेर्र) ह ैजिसमें से पुडुचेरी सरकार द्वारा अभर्ारण्र् के रुप में 3.90 वगा दकलोमीटर (390 हके्टेर्र) प्रस्ट्ताजवत था और 3.31 वगा दकलोमीटर (331.785 हके्टेर्र) का सवेक्षण दकर्ा गर्ा था, तब तजमलनाडु सरकार द्वारा पक्षी अभर्ारण्र् के रूप में अजधसूजचत दकर्ा गर्ा ह;ै और, अभर्ारण्र् के रूप में अजधसूजचत वतामान में झील इन कारणों से महत्वपूणा ह:ै (क) र्ह क्षेत्र उन प्रवासी पजक्षर्ों के जलए महत्वपूणा गजलर्ारा ह ैिो सर्िार्ों के िौरान प्वाइंट कैजलमेरे में चल ेिाते हैं; (ख) हर साल अक्टूबर से फरवरी के महीनों के िौरान इस िलिली भूजम में हिारों में िल पजक्षर्ााँ िेखी िा सकती ह;ै (ग) एजिर्ाई आर्द्ाभूजम ब्र्ूरो ने ओसुि ुको एजिर्ा में 115 महत्वपूणा आर्द्ाभूजम में से एक घोजित दकर्ा था; (घ) ओसुि ुझील की पर्ाावरण और वन मंत्रालर् (पर्ाावरण, वन और िलवार् ु पररवतान मतं्रालर्, 2009), भारत के राष्ट्रीर् आर्द्ाभूजम संरक्षण कार्ाक्रम के अधीन राष्ट्रीर् महत्व की एक आर्द्ाभूजम के रूप में पहचान की गर्ी थी;

और, मुंबई प्राकृजतक जवज्ञान सोसाइटी (बीएनएचएस), मुंबई, िो पक्षीिीव अंतरराष्ट्रीर् के सिस्ट्र् ह,ै ने ओसुि ु को भारत के महत्वपूणा पक्षी क्षेत्र (आईबीए) के रूप में जनर्िाष्ट दकर्ा ह;ै ओसुि ुमें लगभग 40 प्रवासी प्रिाजतर्ों से संबंजधत 20,000 से अजधक पक्षी सर्िार्ों में र्हां प्रवास करते हैं। इसके आईर्ूसीएन (प्रकृजत और प्राकृजतक संसाधनों के संरक्षण के जलए अंतरााष्ट्रीर् संघ) द्वारा जवरासत स्ट्थलों के रूप में भी पहचान की गर्ी है, िो इसे एजिर्ा की सबसे महत्वपूणा आर्द्ाभूजम में रैंककंग करता ह;ै और, ओसुि ुझील अवक्रजमत आर्द्ाभूजम का एक उिाहरण ह।ै ओसुि ु जवल्लुपुरम और पांजडचेरी के जलए भूिल िल जनकासी को ररचािा करन ेमें एक बहुत ही महत्वपूणा भूजमका जनभाता है, िो मुख्र् रूप से अपनी पेर्िल की आपूर्ता के जलए भूिल पर जनभार ह।ै र्ह समुर्द्ी िल को भूजमगत िलभरों में प्रवेि करने से भी रोकता ह।ै ओस्ट्टरर झील को भूजम-सुधार, कृजि, गाि िमाव, खरपतवार आक्रमण और चोरी दकर्े जिकार िैसे गभंीर खतरों का सामना करना पड रहा ह;ै और, ओसुि ुपाररजस्ट्थजतकी संवेिी िोन में पजक्षर्ों के बसेरा क्षते्र मनुष्र्ों के बहुत जनकट जस्ट्थत हैं। क्षेत्र में अवधै रुप से मछली पकडना िंगली पजक्षर्ों का जिकार करना अक्सर िेखा गर्ा ह।ै र्दि इन पर रोक नहीं लगाई िाती ह ै तो ही झील की र्ूरोदफकेिन, गाि िमाव और अन्नतः झील का अंत हो सकता ह;ै और, र्ह क्षेत्र िलुाभ और जवजवध स्ट्थाजनक वनस्ट्पजतर्ों के जलए समृद्ध ह।ै र्ह एक मानसूनी झील ह ैऔर पूवोत्तर मानसून के कारण िीत ऋतु के िौरान ओस्ट्टरर झील में बाढ़ आ िाती ह ैऔर ग्रीष्म ऋत ुके िौरान आंजिक रूप से सूख िाती ह।ै अध्र्र्न क्षेत्र की वनस्ट्पजत बहुत जवजवध ह,ै छोटी िडी बूटी से लेकर बहुत बडे वृक्षों तक कई िलीर् पौधें िाजमल हैं। र्द्यजप झील छोटी ह ैपरन्तु र्हां वनस्ट्पजतर्ों और िीविन्तओुं की जवजवधता ह ैजिनमें लगभग 480 पौधें की प्रिाजतर्ां 317 िेनेरा से संबंजधत हैं और 92 पररवारों में फैली हुई हैं;

और, झील के चारों ओर अजभजलजखत प्रमुख वृक्ष हैं र्डालबजगर्ा पैजनकुलाटा, अकेजसर्ा ऑररकुजलफॉर्मास, टर्मानेजलर्ा अिुान, स्ट्पेजिर्ा पॉपुलन,े तामाररन्िस इंजडकस खर्ा सेनेगलेंजसस, द़िकस बेंगलेंजसस आदि हैं। झाजडर्ा िैसे दफकस जहसजपडा, फ्लगुगेा ल्र्ूकोपीरस, कैजसर्ा ऑररकुलाटा, राउवॉजल्फर्ा टेरादफला, प्लंबैगो जेलेजनका, फीजनक्स लॉरीएरी, लंताना कैमारा, अबुरटलोन जहटाम, ए. इंजडकम आदि हैं। झील के्षत्र में अजभजलजखत प्रमुख िडी- बूरटर्ों के पौधे अकालीफा इंजडका, बोरेररर्ा ओसीमोइड्स, कमेजलना बेंगलेंजसस, सी.लांजगओजलर्ा, साइपरस रोटंडस, रुइएजलर्ा पेटुला, एजलजसकापास मोजनजलफर, एच्र्ोरेंथेस एस्ट्पेरा, दफलेंथस मडेरस्ट्पटेेंजसस, कॉकोरस ररडेन्स, डेसमोजडर्म राइफ्लोरम आदि ह;ै [भाग II— खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 और, अध्र्र्न के्षत्र में और उसके आस-पास सामान्र् पवातारोही/स्ट्रेिलसा सीसस ररफोजलर्ा, सी.जवरटिेनेर्ा, कार्डार्ोस्ट्पमाम हजेलकैबैम, राजगर्ा इनक्र्ूके्रटा, टी.प्लुकेनेरट, टोड्डाजलर्ा एजिर्ारटका, पैजसफ्लोरा फोएटीडा, ऑक्सीस्ट्टेलमा एस्ट्कुलेंटम आदि अजभजलजखत हैं। प्रमुख हाइड्रोफाइट नेलुम्बो नुसीफेरा, जनम्फेर्ा नाउचली, सेराटोदफलम डेमसाम, हाइजड्रला वर्टाजसलाटा, नािस माइनर, इपोमोर्ा कानेआ, साजल्वजनर्ा मोलेस्ट्टा, जपजस्ट्टर्ा स्ट्रेटाइड्स, लेम्ना माइनर, अपोनोगेटन नटन्स, ओटेजलर्ा एजलमोइड्स, सेराटोप्टेररस थाजलक्रॉइड, इकोर्नार्ा कै्रजसप्स, वाजलसनेरा सर्पाजलस आदि अजभजलजखत हैं;

और, ओसुि ुझील से लगभग 25 मछली प्रिाजतर्ां अजभजलजखत की गई ह ैजिसमें स्ट्र्ूड्यूरोजपर्स एजथररनोइड्स और एरोप्लस मैक्र्लूेट्स, कैटल कैटल, माइस्ट्टस जवटैटस, हटेरोपनेस्ट्ट्स फोजसजलस, चना ओररएंटजलस, क्लरैस बैराचस, एरोप्लस सूरतेंजसस, मार्स्ट्टस गुजलओ, चन्ना स्ट्रैटस और गैंबजसर्ा एद़िजनस िाजमल हैं। झील में जविेिी तीन प्रिाजतर्ां अथाात ्ओरेच्रोजमस मोसाजम्बका, साइजप्रनस कापीओ और हाइपोफथजल्मजचस मोजलररक्स पाई िाती हैं। स्ट्तनधाररर्ों की कुल 14 प्रिाजतर्ां अजभजलजखत की गईं जिनमें जचत्तीिार जहरण, जसर्ार, िंगल जबल्ली, सामान्र् नेवला, ब्लैक नेप्ड हरे, लघ ुपुच् छ वानर, भारतीर् साही, बैंडीकूट रैट आदि िाजमल हैं। अभर्ारण्र् में जततली की 63 प्रिाजतर्ों के अंतगात 46 िेनेरा और 5 पररवारों में फैले हुए अजभजलजखत दकए गए हैं;

और, ओसुि ुझील से कुल पजक्षर्ों की 166 प्रिाजतर्ों से संबंजधत 47 पररवारों को अजभजलजखत दकर्ा गर्ा ह ै और र्ह पररप्रिेि ह ै जिसमें 75 िलीर् प्रिाजतर्ां िाजमल ह।ै इसमें पक्षी िैसे फ्लैममगंोस, डाटार, स्ट्पॉट-जबल पेजलकन, ग्रेट व्हाइट पेजलकन, पेंटेड स्ट्टोका , र्ूरेजिर्न चम्मच जबल और पलैीड हरैरर्र संकटापन्न श्रेणी के अंतगात आत े हैं;

और, ओसुि ुपजक्षर्ों की 47 प्रिाजतर्ों का आश्रर् प्रिान करता ह ैिो 22 पररवारों का प्रजतजनजधत्व करती हैं। झील पृथ्वी में प्रवासी िल पंख के जलए िाना िाता ह ै- उत्तर एजिर्ा के ठंडी सर्िार्ों से ओसुि ुमें राउटटंग िल पक्षी का आश्रर् ह।ै कुछ पक्षी िैसे फैनटेल जिप, मस्ट्टंटस, प्लोवसा, लैपमवंग और सैंडजपपसा अफ्रीका और उत्तरी र्ूरोप से ओसुि ुआत ेहैं;

और, ओसुि ुपक्षी की जवजवधता के जलए आकर्िात करता ह ैझील जवजवध वासों िैसे कृजि खेती, झाजडर्ां, खुली झाजडर्ां जमट्टी घास भूजम का आश्रर् प्रिान करती ह।ै वास के अनुसार र्ह पार्ा गर्ा दक ओसुि ुमें कम से कम 70 प्रजतित पजक्षर्ों का एकमात्र जविेि वास, 4 प्रजतित कम से कम 2 वास, और 2 प्रजतित कम से कम 3 अलग-अलग वास हैं। लगभग 32 प्रजतित पक्षी, जविेिकर गीज और बत्तख, र्ह िल के जलए झील पर आधाररत ह।ै गहरे िल में झील के रूप में पजक्षर्ों के जलए उपर्ुि प्रतीत होता ह ैिो दक मछली के पोिण के जलए िैसे कॉमोरेंट और कूट्स हैं;

और, क्षेत्र की महत्वपूणा अथाव्यवस्ट्था प्राथजमक रूप से कृजि ह ै पाररजस्ट्थजतकी संवेिी िोन के क्षेत्र का 60 प्रजतित से अजधक कृजि उपर्ोग में ह।ै ििे क्षेत्रों में िल पक्षी, बंिर भूजम और कुछ बजस्ट्तर्ां हैं;

और, ओसुि ुअभर्ारण्र् के चारों ओर के क्षेत्र को, जिसका जवस्ट्तार और सीमाएं इस अजधसूचना के पैरा 1 में जवजनर्िाष्ट हैं, पर्ाावरण की िजृष्ट से पाररजस्ट्थजतकी संवेिी िोन के रूप में सुरजक्षत और संरजक्षत करना तथा उि पाररजस्ट्थजतकी संवेिी िोन में उद्योग र्ा उद्योगों की श्रेजणर्ों के प्रचालन तथा प्रसंस्ट्करण को प्रजतजिद्ध करना आवश्र्क ह;ै अतः, अब, केन्र्द्ीर् सरकार, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इसमें इसके पिात् पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उपधारा (1) तथा उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, तजमलनाडु राज्र् में ओसुि ु झील पक्षी अभर्ारण्र् की सीमा के चारों ओर िून्र् दकलोमीटर से 1.91 दकलोमीटर तक जवस्ट्ताररत क्षेत्र को ओसुि ुझील पक्षी अभर्ारण्र् पाररजस्ट्थजतकी-संवेिी िोन 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (जिसे इसमें इसके पश् चात् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात ्:-

1. पाररजस्ट्थजतकी संविेी िोन का जवस्ट्तार और सीमाएं.- (1) पाररजस्ट्थजतकी-संवेिी िोन का जवस्ट्तार ओसुि ुझील पक्षी अभर्ारण्र् के चारों ओर िून्र् दकलोमीटर (अतंःराज्र्ीर् सीमा के कारण) से 1.91 दकलोमीटर तक फैला हुआ ह।ै पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल 9.068 वगा दकलोमीटर ह।ै

(2) पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण उपाबधं I के रुप में संलग्न ह।ै

(3) पाररजस्ट्थजतकी संवेिी िोन की सीमा के संरजक्षत क्षेत्र का मानजचत्र उपाबधं-IIक स ेउपाबधं-IIघ में ह।ै

(4) पाररजस्ट्थजतकी-संवेिी िोन और संरजक्षत क्षेत्र की सीमा के भू-जनिेिांकों की सूची उपाबधं-III के सारणी क और सारणी ख के रुप में सलंग्न ह ै।

(5) मुख्र् मबंिओुं के भू-जनिेिांकों के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाले ग्रामों की सूची उपाबधं-IV के रूप में सलंग्न ह।ै

2. पाररजस्ट्थजतकी सवंिेी िोन के जलए आचंजलक महार्ोिना.– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए, रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और इस अजधसूचना में दिए गए अनुबंधों का पालन करत ेहुए, राज्र् सरकार के सक्षम प्राजधकारी के अनुमोिनाथा एक आंचजलक महार्ोिना बनारे्गी।

(2) राज् र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत से िो इस अजधसूचना में जवजनर्िाष् ट दकए गए हों के अनसुार तथा सुसंगत कें र्द्ीर् और राज् र् जवजधर्ों के अनुरूप तथा कें र्द्ीर् सरकार द्वारा िारी मागाजनिेिों, र्दि कोई हों, द्वारा तैर्ार होगी ।

(3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरण संबंधी सरोकारों को समाकजलत करने के जलए राज् र् सरकार के जनम्नजलजखत जवभागों के परामिा स ेतैर्ार होगी, अथाात:्-

(i) पर्ाावरण;

(ii) वन और वन्र्िीव;

(iii) कृजि;

(iv) रािस्ट्व;

(v) िहरी जवकास;

(vi) पर्ाटन;

(vii) ग्रामीण जवकास;

(viii) मसंचाई और बाढ़ जनर्ंत्रण;

(ix) नगरपाजलका;

(x) पंचार्ती राि;

(xi) लोक जनमााण जवभाग;

(xii) रािमागा; और

(xiii) तजमलनाडु राज्र् प्रििूण जनर्ंत्रण बोडा । [भाग II— खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5

(4) आंचजलक महार्ोिना अनुमोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक इस अजधसूचना में जवजनर्िाष्ट न हो,तथा आचंजलक महार्ोिना में सभी अवसंरचना और दक्रर्ाकलापों में िो अजधक िक्षता और पाररजस्ट्थजतकी-अनकूुल हों का संवधान करेगी ।

(5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों की पुनः बहाली, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐसे अन्र् पहलुओं की व्यवस्ट्था की िाएगी जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै

(6) आंचजलक महार्ोिना में सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, कृजि क्षेत्रों, ऊपिाऊ भूजम, उद्यानों और उद्यानों की तरह के हररत क्षेत्रों, उद्यान कृजि क्षेत्रों, बगीचों, झीलों और अन्र् िल जनकार्ों का अभ्र्ंकन करेगी और इस में जवद्यमान और प्रस्ट्ताजवत भू- उपर्ोग की जविेिताओं का ब्र्ौरा िेने वाल े अनुसमर्थात मानजचत्र भी दिए िाएंगे।

(7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करेगी और सारणी में सूचीबद्ध पैरा- 4 में प्रजतजिद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन करेगी और स्ट्थानीर् समुिार्ों की िीजवका को सुरजक्षत करने के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजित और उसकी अजभवृजद्ध भी करेगी।

(8) आंचजलक महार्ोिना, प्रािेजिक जवकास र्ोिना की सह-जवस्ट्तारी होगी ।

(9) इस प्रकार अनुमोदित आंचजलक महार्ोिना इस अजधसूचना के उपबंधों के अनुसार मानीटरी के अपने कार्ों को करने के जलए एक संिभा िस्ट्तावेि तैर्ार करेगी ।

3. राज्र् सरकार द्वारा दकए िान ेवाल ेउपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्:-

(1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए जचजन्हत दकए गए उद्यानों और खुल ेस्ट्थानों का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक दक्रर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नहीं दकर्ा िाएगा:

परन्त ुर्ह दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भाग (क), में जवजनर्िाष्ट प्रर्ोिन से जभन्न प्रर्ोिन के जलए कृजि और अन्र् भूजम का संपररवतान, मानीटरी सजमजत की जसफाररि पर और सक्षम प्राजधकारी के पूवा अनुमोिन से क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा र्था लाग ूकेन्र्द्ीर् सरकार और राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन तथा इस अजधसूचना के उपबंधों के अनुसार स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करन ेके जलए अनुज्ञात दकर्ा िाएगा:-

(i) जवद्यमान सडकों को चौडा करना और उन्हें सुिढृ़ करना और नई सडकों का संजनमााण;

(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;

(iii) प्रििूण उत्पन्न न करन ेवाले लघु उद्योग;

(iv) कुटीर उद्योगों जिनके अंतगात ग्रामीण उद्योग भी हैं; सुजवधािनक भंडार और स्ट्थानीर् सुजवधाएं सहार्क पाररजस्ट्थजतकी पर्ाटन जिसके अतंगात ग्रहवास सजम्मजलत ह;ै और

(v) पैराग्राफ 4 के अधीन दिए गए संवर्धात दक्रर्ाकलाप:

परंत ुर्ह और भी दक क्षेत्रीर् नगर र्ोिना अजधजनर्म के अधीन सक्षम प्राजधकारी के पूवा अनमुोिन के जबना तथा राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों और संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगात अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का प्रर्ोग अनुज्ञात नहीं होगा:

परंत ुर्ह और भी दक पाररजस्ट् थजतकी संवेिी िोन के भीतर आन ेवाली भूजम के अजभलेखों में हुई दकसी गलती को, मानीटरी सजमजत के जवचार प्राप्त करने के पिात,् राज्र् सरकार द्वारा प्रत्र्ेक मामले में एक बार सुधारा िाएगा और उि गलती को सुधारन ेकी सूचना कें र्द्ीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी:

परंत ुर्ह और भी दक उपर्ुाि गलती को सुधारन ेमें, इस उप-पैरा में र्था उपबंजधत के जसवार्, दकसी भी ििा में भू-उपर्ोग का पररवतान सजम्मजलत नहीं होगा;

(ख) अनपु्रर्ुक् त र्ा अनुत् पािक कृजि क्षेत्रों में पुन: वनीकरण तथा पर्ाावासों और िैव- जवजवधता की बहाली के प्रर्ास दकए िाएंगे ।

(2) प्राकृजतक िल स्रोत.- आंचजलक महार्ोिना में सभी प्राकृजतक िल स्त्रोतों के आवाह क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण के जलए र्ोिना सजम्मजलत होगी और राज् र् सरकार द्वारा ऐसे क्षेत्रों पर र्ा उनके जनकट जवकास दक्रर्ाकलापों प्रजतजिद्ध करन ेके बारे में िो ऐसे क्षेत्रों के जलए अजहतकर हो ऐसी रीजत से मागाििाक जसद्धांत तैर्ार दकए िाएगंे।

(3) पर्ाटन र्ा पाररजस्ट्थजतकी पर्ाटन.– (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी संवेिी िोन के जलए होगा । (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् सरकार के पर्ाावरण और वन जवभागों के परामिा से राज्र् पर्ाटन जवभाग द्वारा बनार्ी िाएगी । (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का घटक होगी । (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनम् नानुसार जवजनर्जमत दकए िाएंग:े-

(i) वन्र्िीव अभर्ारण्र् की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी अजधक जनकट हो ,दकसी होटल र्ा ररिॉटा का नर्ा सजन्नमााण अनुज्ञात नहीं दकर्ा िाएगा:

परंतु र्ह दक वन्र्िीव अभर्ारण्र् की सीमा से एक दकलोमीटर की िरूी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक होटलों और ररिॉटा का स्ट्थापन केवल पूवा पररभाजित और नामजनर्िाष्ट क्षेत्रों में पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए ही अनजु्ञात होगा;

(ii) पाररजस्ट्थजतकी संवेिी िोन के अन्िर सभी नए पर्ाटन दक्रर्ा-कलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्र्द्ीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा िारी मागाििाक जसद्धांतो तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िने े वाले राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी मागाििाक जसद्धांतो (समर्-समर् पर र्था संिोजधत) के अनुसार होगा;

(iii) आंचजलक महार्ोिना का अनुमोिन होने तक, पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजनर्िाष्ट संवीक्षा तथा मानीटरी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनजु्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए होटल, ररिाटा र्ा वाजणजज्र्क स्ट्थापन का संजन्नमााण अनुज्ञात नहीं होगा । [भाग II— खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7

(4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन के अंतगात आन ेवाले बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन कोि आरजक्षत के्षत्र, िैल जवरचनाएं, िल प्रपातो, झरने, िरो, उपवनों, गुफाएं, स्ट्थलों, वनपथ, रोहण मागा, उत्प्रपातो आदि की पहचान की िाएगी और उनकी सुरक्षा और संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी।

(5) मानव जनर्मात जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, कलाकृजत- के्षत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी।

(6) ध् वजन प्रििूण.– पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रििूण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 में जनर्त उपबंधों के अनुसार में पाररजस्ट्थजतकी-संवेिी िोन में ध्वजन प्रििूण के जनर्ंत्रण और जनवारण का अनपुालन दकर्ा िाएगा।

(7) वार् ुप्रििूण.- पाररजस्ट्थजतकी संवेिी िोन में, वार् ुप्रििूण की जनवारण और जनर्ंत्रण, वार् ु(प्रििूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) के उपबंधों और उसके अधीन बनाए गए जनर्मों के अनुसार अनुपालन दकर्ा िाएगा।

(8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सारण, और पर्ाावरण अजधजनर्म अधीन बनाए गए जनर्मों के अन्तगात सजम्मजलत दकए गए पर्ाावरणीर् प्रििूण के जनस्ट्सारण संबंधी साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, इनमें िो भी अजधक कठोर हों, के अनुसार दकर्ा िाएगा।

(9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान और प्रबन्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1357 (अ), तारीख 8 अप्रैल, 2016 के अधीन प्रकाजित ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण- अनुकूल रीजत से दकर्ा िाएगा;

(ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों )ई एस एम( का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रंबंधन अनुज्ञात दकर्ा िा सकेगा।

(10) िैव जचदकत्सा अपजिष् ट का प्रबधंन.- िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं. सा.का.जन. 343(अ), तारीख 28 माचा, 2016 के अधीन प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संविी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रंबंधन अनजु्ञात दकर्ा िा सकेगा।

(11) प्लाजस्ट्टक अपजिष्ट का प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट का प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं. सा.का.जन 340(अ), तारीख 18 माचा, 2016 के द्वारा प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधो के अनुसार दकर्ा िाएगा। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(12) जनमााण और जवध्वसं अपजिष्ट का प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में जनमााण और जवध्वंस अपजिष्ट का प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं. सा.का.जन 317(अ), तारीख 29 माचा, 2016 के द्वारा प्रकाजित संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट का प्रबंधन का जनपटान भारत सरकार पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित तथा समर्- समर् पर र्था संिोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(14) र्ानीर्-र्ातार्ात.- वाहन-र्ातार्ात का संचलन आवास-अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना में जविेि उपबंध सजम्मजलत दकए िाएंगे तथा आंचजलक महार्ोिना के तैर्ार होन े और राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित दकए िाने तक, मानीटरी सजमजत सुसंगत अजधजनर्मों और उनके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार वाहनों की आवािाही के अनुपालन की मानीटरी करेगी।

(15) र्ानीर् प्रििूण.- र्ानीर् प्रििूण की रोकथाम और जनर्ंत्रण लाग ू जवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईंधन के प्रर्ोग के प्रर्ास दकए िाएंग े।

(16) औद्योजगक ईकाइर्ा.ं- (i) रािपत्र में इस अजधसूचना के प्रकािन पर र्ा उसके पिात पाररजस्ट्थजतकी संवेिी िोन में दकसी नए प्रििूणकारी उद्योग की स्ट्थापना की अनुमजत नहीं िी िाएगी।

(ii) िब तक इस अजधसूचना में जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन में कें र्द्ीर् प्रििूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी मागाििाक जसद्धांतो में दकए गए उद्योगों के वगीकरण के अनुसार केवल गरै- प्रििूणकारी उद्योगों की स्ट्थापना अनुज्ञात होगी। इसके अजतररि, गरै-प्रििूणकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा।

(17) पहाडी ढलानों का सरंक्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना में पहाडी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनमें दकसी भी संजनमााण की अनजु्ञा नहीं होगी;

(ख) जिन ढ़लानों र्ा जवद्यमान खडी पहाडी ढलानों में अत्र्जधक भू-क्षरण होता ह ैउनमें दकसी भी संजनमााण की अनुमजत नहीं िी िाएगी ।

4. पाररजस्ट्थजतकी संविेी िोन में प्रजतजिद्ध र्ा जवजनर्जमत दकए िान ेवाल े दक्रर्ाकलापों की सचूी.- पाररजस्ट्थजतकी संवेिी िोन में सभी दक्रर्ाकलाप, पर्ाावरण अजधजनर्म, के उपबंधो और तटीर् जवजनर्मन िोन अजधसूचना, 2011 और पर्ाावरणीर् समाघात जनधाारण अजधसूचना, 2006 सजहत उसके अधीन बन े जनर्मों और वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53), सजहत अन्र् लाग ू जनर्मों तथा उनमें दकए गए संिोधनों के अनुसार िाजसत होंगे और नीचे िी गई सारणी में जवजनर्िाष्ट रीजत से जवजनर्जमत होंगे, अथाात:्- सारणी क्र. स.ं

1. वाजणजज्र्क खनन, पत्थर उत्खनन और अपघिाण इकाईर्ां । (क) वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेलू आवश्र्कताओं जिसमें जनिी उपर्ोग के जलए मकानों के संजनमााण र्ा मरम्मत के जलए धरती को खोिना और मकान बनाने के जलए ििेी टाइल्स र्ा ईंटों का जनमााण [भाग II— खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 करना भी सजम्मजलत ह,ै के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनि), पत्थर की खानें और उनको तोडने की इकाइर्ां तत्काल प्रभाव से प्रजतजिद्ध होंगी । (ख) खनन प्रचालन, माननीर् उच्चतम न्र्ार्ालर् की ररट र्ाजचका (जसजवल) सं. 1995 का 202 टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले में आििे तारीख 4 अगस्ट्त, 2006 और ररट र्ाजचका (सी) सं. 2012 का 435 गोवा फाउंडेिन बनाम भारत संघ के मामले में तारीख 21 अप्रैल, 2014 के आििे के अनुसरण में प्रचालन होगा ।

2. प्रििूण (िल, वार्ु, मृिा, ध्वजन आदि) उत्पन्न करने वाले उद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रििूणकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नहीं होगी:

फरवरी, 2016 में कें र्द्ीर् प्रििूण जनर्ंत्रण बोडा द्वारा िारी मागाििाक जसद्धांतो में दकए गए उद्योगों के वगीकरण के अनुसार परन्तु, र्ह दक इस अजधसूचना में जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन में केवल गैर- प्रििूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर- प्रििूणकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा।

3. वृहत िल जवद्युत पररर्ोिनाओं की स्ट्थापना । लागू जवजधर्ों के अनुसार प्रजतजिद्ध (अन्र्था उपबंजधत के जसवार्) होंग।े

4. दकसी पररसंकटमर् पिाथों का उपर्ोग र्ा उत्पािन र्ा प्रस्ट्संकरण । लागू जवजधर्ों के अनुसार प्रजतजिद्ध (अन्र्था उपबंजधत के जसवार्) होंग।े

5. प्राकृजतक िल जनकार्ों र्ा भूजम क्षेत्र में अनुपचाररत बजहस्रावों का जनस्ट्सारण । लागू जवजधर्ों के अनुसार प्रजतजिद्ध (अन्र्था उपबंजधत के जसवार्) होंग।े

6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन में नई र्ा जवद्यमान आरा जमलों का जवस्ट्तार अनुज्ञात नहीं होगा ।

7. ईंट भट्टों की स्ट्थापना । लागू जवजधर्ों के अनुसार प्रजतजिद्ध (अन्र्था उपबंजधत के जसवार्) होंग।े ख. जवजनर्जमत दक्रर्ाकलाप

8. होटलों और ररिॉटो का वाजणजज्र्क स्ट्थापन । पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हतेु लघु अस्ट्थार्ी संरचनाओं के जनमााण के जसवार्, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की जवस्ट्तार तक, इनमें िो भी जनकट हो, नए वाजणजज्र्क होटलों और ररसोटो को स्ट्थापना अनुज्ञात नहीं दकर्ा िाएगा:

परंतु, संरजक्षत क्षेत्र की सीमा स ेएक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन की जवस्ट्तार तक, इनमें िो भी जनकट हो, सभी नए पर्ाटन दक्रर्ाकलाप करने र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना और र्थालागू मागाििाक जसद्धांतों के अनुसार होगा।

9. संजनमााण दक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की जवस्ट्तार तक, इनमें िो भी जनकट हो, दकसी भी नर्े वाजणजज्र्क संजनमााण की अनुज्ञा नहीं होगी:

परंतु स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत आवश्र्कताओं को पूरा करने के जलए, पैराग्राफ 3 के उप पैराग्राफ

(1) में सूचीबद्ध दक्रर्ाकलापों सजहत अपने उपर्ोग के जलए, अपनी भूजम में भवन उप-जवजधर्ों के अनुसार, संजनमााण करने की अनुज्ञा होगी। परन्तु र्ह और दक गैर–प्रििूणकारी लघु उद्योगों से संबंजधत 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] संजनमााण दक्रर्ाकलाप लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुज्ञा से जवजनर्जमत दकए िाएंगे और वे न्र्ूनतम होंगे । (ख) एक दकलोमीटर से आग े र्े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे ।

10. गैर प्रििूणकारी लघु उद्योग। फरवरी, 2016 में केन्र्द्ीर् प्रििूण जनर्ंत्रण बोडा द्वारा िारी उद्योगों के वगीकरण के अनुसार गैर-प्रििूणकारी उद्योगों तथा पाररजस्ट्थजतकी संवेिी िोन से ििेी सामजग्रर्ों से उत्पाि बनाने वाले अपररसंकटमर् लघु और सेवा उद्योगों, कृजि, पुष्प कृजि, बागबानी र्ा कृजि आधाररत उद्योगों की स्ट्थापना सक्षम प्राजधकारी द्वारा अनुज्ञात होगी।

11. फमों, कारपोरेट, कंपजनर्ों द्वारा बडे पैमाने पर वाजणजज्र्क पिुधन संपिा और कुक्कुट फामों की स्ट्थापना । लागू जवजधर्ों के अनुसार जवजनर्जमत होगा ।

12. वृक्षों की कटाई । (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई की अनुज्ञा नहीं होगी । (ख) वृक्षों की कटाई कें र्द्ीर् र्ा संबंजधत राज्र् के अजधजनर्मों और उनके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी ।

13. वन उत्पािों र्ा गैर काष्ठ वन उत्पािों का संग्रह । लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

14. जवद्युत और संचार टॉवरो का पररजनमााण और तार-जबछाने तथा अन्र् बुजनर्ािी ढांचे की व्यवस्ट्था । लागू जवजधर्ों के अधीन जवजनर्जमत होगा। भूजमगत केबल जबछाने को बढ़ावा दिर्ा िाएगा ।

15. नागररक सुजवधाओं सजहत बुजनर्ािी अवसंरचनाएं। र्ह व्यवस्ट्था लागू जवजधर्ों, जनर्मों, जवजनर्मों और उपलब्ध मागाििाक जसद्धांतो के अनुसार उपिमन उपार्ों के साथ की िाएगी।

16. जवद्यमान सडकों को चौडा करना, उन्हें सुिढृ बनाना और नई सडकों का जनमााण करना। र्ह व्यवस्ट्था लागू जवजधर्ों, जनर्मों, जवजनर्मों और उपलब्ध मागाििाक जसद्धांतो के अनुसार उपिमन उपार्ों के साथ की िाएगी।

17. पर्ाटन से संबंजधत अन्र् दक्रर्ाकलाप िैसे दक पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से गमा वार्ु के गुब्बारे, हलेीकाप्टर, ड्रोन, माइक्रोलाइट्स उडाना आदि। लागू जवजधर्ों के अनुसार जवजनर्जमत होगा ।

18. पवातीर् ढ़लानों और निी तटों का संरक्षण । लागू जवजधर्ों के अनुसार जवजनर्जमत होगा ।

19. राजत्र में र्ानीर् र्ातार्ात का संचलन । लागू जवजधर्ों के अनुसार वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होगा ।

20. स्ट्थानीर् समुिार्ों द्वारा चल रही कृजि और बागवानी पद्धजतर्ों के साथ िगु्धिाला, िगु्ध उत्पािन, िल कृजि और मत्स्ट्र् पालन। स्ट्थानीर् िनता के उपर्ोग के जलए लागू जवजधर्ों के अनुसार अनुज्ञात होंगे।

21. प्राकृजतक िल जनकार्ों र्ा भू क्षेत्र में उपचाररत अपजिष्ट िल र्ा बजहस्रााव का जनस्ट्सारण । िल जनकार्ों में उपचाररत अपजिष्ट िल र्ा बजहस्रााव के जनस्ट्सारण से बचा िाएगा। उपचाररत अपजिष्ट िल के पुनचाक्रण और पुन:उपर्ोग के प्रर्ास दकए िाएंगे अन्र्था उपचाररत अपजिष्ट िल र्ा बजहस्रााव का जनस्ट्सारण लागू जवजधर्ों के अनुसार जवजनर्जमत होगा। [भाग II— खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11

22. सतही और भूिल का वाजणजज्र्क जनष्किाण । लागू जवजधर्ों के अनुसार जवजनर्जमत होगा ।

23. कृजि र्ा अन्र् उपर्ोग के जलए खुले कुएं, बोर कुएं आदि का जनमााण । समुजचत प्राजधकारी द्वारा जवजनर्जमत दकर्ा िाएगा और दक्रर्ाकलाप की सख्त मानीटरी की िाएगी।

24. ठोस अपजिष् ट प्रबंधन। लागू जवजधर्ों के अनुसार जवजनर्जमत होगा ।

25. जवििेी प्रिाजतर्ों को लाना । लागू जवजधर्ों के अनुसार जवजनर्जमत होगा ।

26. पाररजस्ट्थजतकी पर्ाटन। लागू जवजधर्ों के अनुसार जवजनर्जमत होगा ।

27. पॉजलथीन बैग का उपर्ोग। लागू जवजधर्ों के अनुसार जवजनर्जमत होगा ।

28. वाजणजज्र्क संकेत बोडा और होर्डंग का उपर्ोग। लागू जवजधर्ों के अनुसार जवजनर्जमत होगा । ग. सवंर्धात दक्रर्ाकलाप

29. विाा िल संचर् । सदक्रर् रूप से बढ़ावा दिर्ा िाएगा ।

31. सभी दक्रर्ाकलापों के जलए हररत प्रौद्योजगकी का अंगीकरण । सदक्रर् रूप से बढ़ावा दिर्ा िाएगा ।

32. कुटीर उद्योग जिसके अंतगात ग्रामीण कारीगर भी ह।ै सदक्रर् रूप से बढ़ावा दिर्ा िाएगा ।

33. नवीकरणीर् ऊिाा और ईंधन का उपर्ोग । बार्ोगैस, सौर प्रकाि इत्र्ादि को सदक्रर् रूप से बढ़ावा दिर्ा िाएगा ।

34. कृजि वाजनकी । सदक्रर् रूप से बढ़ावा दिर्ा िाएगा ।

35. पाररजस्ट्थजतकी अनुकूल र्ातार्ात का प्रर्ोग । सदक्रर् रूप से बढ़ावा दिर्ा िाएगा ।

36. कौिल जवकास । सदक्रर् रूप से बढ़ावा दिर्ा िाएगा ।

37. अवक्रजमत भूजम/वनों/पर्ाावासों की बहाली । सदक्रर् रूप से बढ़ावा दिर्ा िाएगा ।

38. पर्ाावरण के प्रजत िागरुकता। सदक्रर् रूप से बढ़ावा दिर्ा िाएगा ।

39. बागान लगाना और औिधीर् पौधों का रोपण । सदक्रर् रूप से बढ़ावा दिर्ा िाएगा ।

5. मानीटरी सजमजत.- कें र्द्ीर् सरकार, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 3 की उपधारा (3) के अधीन इस अजधसूचना के उपबंधो की प्रभावी मानीटरी के जलए मानीटरी सजमजत गरठत करती ह,ै िो जनम्नजलजखत से जमलकर बनगेी, अथाात:्- क्र. स.ं मानीटरी सजमजत का गठन पि

(4) उप जनििेक, टाउन एंड कंरी प्लामनंग, चेंगलपट्टू सिस्ट्र्;

(5) राज्र् सरकार द्वारा नामजनर्िाष्ट दकर्ा िाने वाला िैवजवजवधता का एक जविेिज्ञ सिस्ट्र्;

(6) राज्र् सरकार द्वारा नामजनर्िाष्ट दकर्ा िाने वाल पाररजस्ट्थजतकी और पर्ाावरण का एक जविेिज्ञ सिस्ट्र्;

(7) राज्र् लोक जनमााण जवभाग का एक प्रजतजनजध सिस्ट्र्;

(8) राज्र् प्रििूण जनर्ंत्रण बोडा का एक प्रजतजनजध सिस्ट्र्;

(9) जिला वन अजधकारी, जवलुप्पुरम सिस्ट्र्– सजचव।

6. जनिेि जनबधंन:- (1) मानीटरी सजमजत इस अजधसूचना के उपबंधों के अनुपालन की मानीटरी करेगी।

(2) मानीटरी सजमजत का कार्ाकाल तीन विा तक र्ा राज्र् सरकार द्वारा नई सजमजत का पुनगाठन दकए िान ेतक होगा और इसके बाि मानीटरी सजमजत राज्र् सरकार द्वारा गरठत की िाएगी।

(3) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का. आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत हैं, और िो पाररजस्ट्थजतकी संवेिी िोन में आत ेहैं, जसवार् इसके पैरा 4 के अधीन सारणी में र्थाजवजनर्िाष्ट प्रजतजिद्ध दक्रर्ाकलापों के मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त के जलए केन्र्द्ीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को जनर्िाष्ट दकर्ा िाएगा।

(4) उन दक्रर्ाकलापों की, िो भारत के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ.1533(अ) 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत नहीं ह,ै और िो पाररजस्ट्थजतकी संवेिी िोन में आते हैं, जसवार् इसके पैरा 4 के अधीन सारणी में र्थाजवजनर्िाष्ट प्रजतजिद्ध दक्रर्ाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे संबंद्ध जवजनर्ामक प्राजधकरणों को जनर्िाष्ट दकर्ा िाएगा।

(5) मानीटरी सजमजत का सिस्ट्र्-सजचव र्ा संबद्ध उपार्ुक् त र्ा संबंजधत उपार्िु ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लंघन करता ह,ै पर्ाावरण अजधजनर्म, की धारा 19 के अधीन पररवाि िार्र करन ेके जलए सक्षम होगा।

(6) मानीटरी सजमजत मुद्दा िर मुद्दा के आधार पर अपेक्षाओं पर जनभार रहत ेहुए संबद्ध जवभागों के प्रजतजनजधर्ों र्ा जविेिज्ञों, औद्योजगक संगमो र्ा संबद्ध पणधाररर्ों के प्रजतजनजधर्ों को, अपन ेजवचार-जवमिा में सहार्ता के जलए आमंजत्रत कर सकेगी ।

(7) मानीटरी सजमजत प्रत्र्ेक विा की 31 माचा तक के अपन े दक्रर्ाकलापों की वार्िाक कारावाई ररपोटा राज्र् के मुख्र् वन्र्िीव वाडान को, उपाबधं V में संलग्न प्रपत्र के अनुसार, उस विा की 30 िून तक प्रस्ट्तुत करेगी ।

(8) केन्र्द्ीर् सरकार का पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् मानीटरी सजमजत को उसके कृत्र्ों के प्रभावी जनवाहन के जलए ऐसे जनिेि िे सकेगा िो वह उजचत समझे ।

7. इस अजधसूचना के उपबंधों को प्रभावी बनान ेके जलए कें र्द्ीर् सरकार और राज् र् सरकार, अजतररक् त उपार्, र्दि कोई हों, जवजनर्िाष् ट कर सकें गी ।

8. कोई अन् र् महत् वपूणा मामला । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 20th February, 2020 S.O. 794(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 1223(E), dated the 8 th March, 2019, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 8 th March, 2019;

AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification;

24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] WHEREAS, Oussudu Lake, located at 11 0 56’ to 11 0 58’ N and 79 0 44’ to 79 0 45’ E is a large shallow wetland in Villupuram district of Tamil Nadu. It is the most important fresh water lake and is 12 Kilometers from Puducherry Town on the western side on Puducherry – Villupuram – Valuthavur main road. It is located in Perambai–Poothurai Villages, Vanur Taluk, Villupuram District, Tamil Nadu. Much of the Ousteri bank along the Tamil Nadu side consists of rural settlements, the Pondicherry side of the lake is predominantly urban or suburban. The circumference of the lake is

7.275 kilometers and the total catchment area of lake is 15.54 square kilometers. It receives water mainly from Suthukeni check dam through Suthukeni canal and the run-off from the Lake basin. The Suthukeni check dam is constructed across the river Sankaraparani. The major water source for the Suthukeni dam is the excess water from Veedur dam, Viluppuram District of Tamil Nadu State;

AND WHEREAS, the total area of the tank is 8.00 square kilometers (800 ha) of which 3.90 square kilometers (390 hectare) had been proposed by the Government of Puducherry as a Sanctuary and 3.31 square kilometers (331.785 hectare) has been surveyed, proposed and then notified by the Government of Tamil Nadu as a Bird Sanctuary;

AND WHEREAS, the lake presently notified as a Sanctuary is significant for reasons: (a) The area serves as an important corridor for the migratory birds which move to Point Calimere during winter; (b) Every year during the months of October to February large congregation of water birds can be seen in thousands in this swamp; (c) The Asian wetland Bureau declared Oussudu as one of 115 significant wetlands in Asia; (d) Oussudu Lake was identified as a wetland of National importance under the National Wetland Conservation Programme of the Ministry of Environment and Forest (Ministry of Environment, Forest and Climate Change, 2009), India;

AND WHEREAS, the Bombay Natural History Society (BNHS), Mumbai a member of Birdlife international, has designated Oussudu as an Important Bird Area (IBA) of India; over 20,000 birds belonging to nearly 40 migratory species used to inhabit or winter at Oussudu. It also has been identified as a heritage sites by IUCN (International Union for Conservation of Nature and Natural Resources), ranking it among the most important wetlands of Asia;

AND WHEREAS, Oussudu lake is an example of degrading wetlands. Oussudu plays a very vital role in recharging the ground water aquifers for Villupuram and Pondicherry, which is largely dependent on groundwater for its drinking water supply. It also protects the underground aquifers from sea water ingress. Ousteri Lake has been facing serious threats from multiple fronts such as reclamation, agriculture, siltation, weed invasion and poaching;

AND WHEREAS, in Oussudu ecologically sensitive zones such as roosting areas of birds are located in close proximity of humans. Illegal fishing and poaching of wild birds are quite frequent in the area. These trends if not checked can soon result in rapid eutrophication, siltation, and ultimate death of the lake;

AND WHEREAS, the area supports diverse flora rich in rare and endemic elements. It is a monsoonal lake and the northeast monsoons leave Ousteri lake flooded during the winter months and goes partially dry during summer months. The vegetation of the study area is very diverse, ranging from small herbs to very large trees including many aquatic plants. The lake though small contains diverse flora and fauna that includes nearly 480 plant species belonging to 317 genera and spreading over 92 families;

AND WHEREAS, the major trees recorded around the lake are Dalbergia Paniculata, Acacia auriculiformis, Terminalia arjuna, the spesia populnea, Tamarindus indicus Khaya senegalensis, Ficus benghalensis, etc. The shrub such as Ficus hispida, Fluggea leucopyrus, Cassia auriculata, Rauvolfia tetraphylla, Plumbago zeylanica, Phoenix laurierii, Lantana camara, Abutilon hirtum, A.indicum, etc. The major herbaceous plants recorded in the lake area are Acalypha indica, Borreria ocymoides, Commelina benghalensis, C.longifolia, Cyperus rotundus, Ruellia patula, Alysicarpus monilifer, Achyranthes aspera, Phyllanthus maderaspatensis, Corchorus tridens, Desmodium triflorum, etc.;

AND WHEREAS, the common climbers / stragglers recorded in and around the study area are Cissus trifolia, C.vitigenea, Cardiospermum halicacabum, Tragia involucrata, T.plukenetii, Toddalia asiatica, Passiflora foetida, Oxystelma esculentum, etc. The major hydrophytes recorded were Nelumbo nucifera, Nymphaea nouchalii, Ceratophyllum demersum, Hydrilla verticillata, Najas [भाग II— खण् ड 3(ii)] भारत का रािपत्र : असाधारण 25 minor, Ipomoea carnea, Salvinia molesta, Pistia stratoides, Lemna minor, Aponogeton natans, Ottelia alismoides, Ceratopteris thalictroides, Eichornia crassipes, Vallisnera spiralis, etc.;

AND WHEREAS, nearly 25 fish species are recorded from the Oussudu lake including Pseudeutropius atherinoides and Etroplus maculates, Catla Catla, Mystus vittatus, Heteropneustes fossilis, Channa orientalis, Clarias batrachus, Etroplus suratensis, Mystus gulio, Channa striatus and Gambusia affinis. Three species Viz., Oreochromis mossambica, Cyprinus carpio and Hypophthalmichthys molitrix are exotic and are found in the lake. A total of 14 species of mammals were recorded including Spotted deer, Jackal, Jungle cat, Common mongoose, Black napped hare, Bonnet macaque, Indian porcupine, Bandicoot rat, etc. A total number of 63 butterfly species falling under 46 genera and spreading over 5 families were recorded in the sanctuary;

AND WHEREAS, a total of 166 species of birds belonging to 47 families were recorded from the Oussudu lake and its environs which included 75 aquatic species. Of these, birds such as Flamingos, Darter, Spot-billed Pelican, Great white Pelican, Painted Stork, Eurasian Spoon Bill and Pallid Harrier are coming under near threatened category;

AND WHEREAS, Oussudu supports about 47 species of birds representing 22 families. The lake is known for the migratory water fowl as the globe-trotting water bird stake refuge at Oussudu from the chilling winters of North Asia. Some birds like fantail snipe, stints, plovers, lapwing and sandpipers come to Oussudu from as far as Africa and Northern Europe;

AND WHEREAS, Oussudu attracts a variety of birds as the lake supports diverse habitats such as agri-fields, Scrubs, open scrub sand grass lands. Habitat wise it was found that the Oussudu at least 70 percent of the birds belong to a single exclusive habitat, 4 percent share at least 2 habitats, and 2 percent share at least 3 different habitats. About 32 percent birds, especially geese and ducks, depend exclusively on the lake for its water. The deep-water of the lake seem to be suitable for the birds that feed on fish such as cormorants and the coots;

AND WHEREAS, the important economy of the area is primarily agriculture more than 60 percent of the Eco-sensitive zone area is in agriculture use. Remaining areas are water birds, wasteland and few settlements;

AND WHEREAS, it is necessary to conserve and protect the areas, the extent and boundaries of Oussudu Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent varying from zero kilometre to 1.91 kilometers around the boundary of Oussudu Lake Birds Sanctuary in the State of Tamil Nadu as the Oussudu Lake Birds Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone. - (1) The extent of Eco-sensitive Zone varies from zero kilometer (due to Inter-State boundary) to 1.91 kilometers around the Oussudu Lake Birds Sanctuary and the area of the Eco-sensitive Zone is 9.068 square kilometers.

(2) The boundary description of the Eco-sensitive Zone is appended at Annexure-I.

(3) The map of the Protected Area demarcating the Eco-sensitive Zone boundary is at Annexure-IIA to Annexure-IID.

(4) List of geo co-ordinates of the boundary of the Protected Area and the Eco-sensitive Zone is appended as Table A and B of Annexure-III.

(5) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV.

2. Zonal Master Plan for Eco-Sensitive Zone. – (1) The State Government shall, for the purposes of effective management of the Eco-sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of publication of this Notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating environmental and ecological considerations into the said plan:-

(i) Environment,

(ii) Forest and Wildlife,

(iii) Agriculture,

(iv) Revenue,

(v) Urban Development,

(vi) Tourism,

(vii) Rural Development,

(viii) Irrigation and Flood Control,

(ix) Municipal,

(x) Panchayati Raj,

(xi) Public Works Department,

(xii) Highways, and

(xiii) Tamil Nadu State Pollution Control Board.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forest, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in table in paragraph 4 and also ensure and promote eco-friendly development for the security of local communities livelihood.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- [भाग II— खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27

(1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or residential or industrial activities:

Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), above within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities given under paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies. - The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism or Eco-tourism. – (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests.

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.

(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Ecosensitive Zone;

(e) The activities of eco-tourism shall be regulated as under, namely:-

(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer:

Provided that beyond the distance of one kilometre from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for ecotourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Ecosensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the ecotourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and ecodevelopment;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within Eco-sensitive Zone area.

(4) Natural heritage. - All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites. - Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.

(6) Noise pollution. - Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.

(7) Air pollution. - Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.

(8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent.

(9) Solid wastes. - Disposal and Management of solid wastes shall be as under:-

(a) The solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.

(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Ecosensitive Zone.

(10) Bio-Medical Waste. - Bio-Medical Waste Management shall be as under:-

(a) The Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28 th March, 2016.

(b) Safe and Environmentally Sound Management of Bio-Medical Waste Management in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.

(11) Plastic waste management. - The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.

(12) Construction and demolition waste management. - The Construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.

(13) E-waste. - The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.

(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution. - Prevention and control of Vehicular Pollution shall be incompliance with applicable laws and efforts to be made for use of cleaner fuel.

(16) Industrial units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.

(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) construction shall not be permitted on existing steep hill slopes or slopes with a high degree of erosion.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act and the rules made thereunder including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act, 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE Sl.No. Activity Description

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P. (C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc).

New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:

Provided that, non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition the, non-polluting cottage industries shall be promoted.

3. Establishment of major hydroelectric project.

Prohibited (except as otherwise provided) as per the applicable laws.

4. Use or production or processing of any hazardous substances.

Prohibited (except as otherwise provided) as per the applicable laws.

5. Discharge of untreated effluents in natural water bodies or land area.

Prohibited (except as otherwise provided) as per the applicable laws.

6. Setting up of new saw mills.

New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.

7. Setting up of brick kilns.

Prohibited (except as otherwise provided) as per the applicable laws.

B. Regulated Activities

8. Commercial establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:

Provided that, beyond one kilometer from the boundary of the protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

9. Construction activities.

(a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents.

Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

10. Small scale non-polluting industries.

Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry [भाग II— खण् ड 3(ii)] भारत का रािपत्र : असाधारण 31 producing products from indigenous materials from the Ecosensitive Zone shall be permitted by the competent Authority.

11. Establishment of large scale commercial live stock and poultry farms by firms, corporate and companies.

Regulated under applicable laws.

12. Felling of Trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.

13. Collection of Forest produce or Non-Timber Forest Produce.

Regulated under applicable laws.

14. Erection of electrical and communication towers and laying of cables and other infrastructures.

Regulated under applicable laws. Underground cabling may be promoted.

15. Infrastructure including civic amenities.

Taking measures of mitigation, as per applicable laws, rules and regulation and available guidelines.

16. Widening and strengthening of existing roads and construction of new roads.

Taking measures of mitigation, as per applicable laws, rules and regulation and available guidelines.

17. Undertaking other activities related to tourism like flying over the Ecosensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.

Regulated as per the applicable laws.

18. Protection of hill slopes and river banks.

Regulated as per the applicable laws.

19. Movement of vehicular traffic at night.

Regulated for commercial purpose under applicable laws.

20. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

Permitted as per the applicable laws for use of locals.

21. Discharge of treated waste water or effluents in natural water bodies or land area.

The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water or effluent shall be regulated as per the applicable laws.

22. Commercial extraction of surface and ground water.

Regulated under applicable laws.

23. Open Well, Bore Well, etc. for agriculture or other usage.

Regulated under applicable laws and the activity shall be strictly monitored by the concerned authority.

24. Solid Waste Management.

Regulated as per the applicable laws.

25. Introduction of Exotic species. Regulated as per the applicable laws.

26. Eco-tourism. Regulated as per the applicable laws.

27. Use of polythene bags. Regulated as per the applicable laws.

28. Commercial sign boards and hoardings.

Regulated as per the applicable laws.

33. Use of renewable energy and fuels. Bio-gas, solar light, etc. to be actively promoted.

34. Agro-Forestry. Shall be actively promoted.

35. Use of eco-friendly transport. Shall be actively promoted.

36. Skill Development. Shall be actively promoted.

37. Restoration of Degraded Land/Forests/Habitats.

Shall be actively promoted.

38. Environmental awareness. Shall be actively promoted.

39. Plantation of Horticulture and Herbals.

Shall be actively promoted.

5. Monitoring Committee .- For effective monitoring of the provisions of this notification under subsection (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely: - Sl.

6. Terms of Reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the [भाग II— खण् ड 3(ii)] भारत का रािपत्र : असाधारण 33 Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per performa given in Annexure-V.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The Central Government and the State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. The provisions of this notification are subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
