1. Short title and commencement. - (1) These Statutes may be called the First Statutes of the Rajiv Gandhi National Institute of Youth Development (Amendment) Statutes, 2016.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the First Statutes of the Rajiv Gandhi National Institute of Youth Development , 2013 (hereinafter referred to as the principal statutes), in Statute 2, in sub-statute (1), -

(i) after clause (c), the following clause shall be inserted, namely:- ‘(ca) “Board of Research Studies” means the authority as referred to in clause (c) of section 11 of the Act;

(cb) “Board of Studies” means the authority as referred to in sub-section (c) section 11 of the Act;’;

(ii) after clause (e), the following clause shall be inserted, namely:- ‘(ea) “Controller of Examinations” means the Controller of Examinations of the Institute as referred to in clause (c) of section 21 of the Act;

(eb) “Dean” means the Dean of a School of the Institute;

(ec) “Division” means a unit of the Institute engaged in activities as specified in the Statutes;’;

(iii) after clause (g), the following clause shall be substituted, namely:- ‘(ga) “employee” means a person duly employed by the Institute and receiving emoluments;

(gb) “Faculty” means the teaching and research faculty of the Institute;

(gc) “Finance Committee” means the Finance Committee of the Institute as referred to in clause (c) of section 11 of the Act;

(gd) “Finance Officer” means the Finance Officer of the Institute as referred to in clause (c) of section 21 of the Act;’;

(iv) after clause (h), the following clause shall be inserted, namely:- ‘(ha) “officer” means an officer of the Institute as referred to in sub-section (c) of section 21 of the Act;

(hb) “Planning Board” means an authority as referred to in clause (c) of section 11 of the Act;

(v) in clause (i), for the words “any programme”, the words “ all academic and training programmes” shall be substituted;

(vi) after clause (i), the following clause shall be inserted, namely:- ‘(ia) “rules” mean the rules of the Institute made by the Central Government under the Act;’;

(vii) after clause (j), the following clause shall be inserted, namely:- ‘(ja) “School” means a School of studies of the Institute;’.

3. In the principal statute, in statute 3, after clause (d), the following clauses shall be inserted, namely:- “(e) the Planning Board;

(f) the Board of Studies; and

(g) the Board of Research Studies.”.

4. In the principal statute, in statute 4,-

(i) for sub-statutes (4) and (5), the following sub-statutes shall be substituted, namely:- “(4) Meetings of the Executive Council shall be convened by the Director of the institute in consultation with the Chairperson or on a requisition signed by not less than fifty percent of the members of the Executive Council.

(5) At-least one third of the members shall be the quorum for a meeting of the Executive Council:

Provided that if a meeting is adjourned for want of quorum, it shall be held after half an hour from the scheduled time of holding the meeting and members present then, shall form the quorum”.;

(ii) in sub-statute (6), for the words, “the Chairperson”, the words “the one who Chairs” shall be substituted;

(iii) for sub-statute (13), the following sub-statute shall be substituted, namely:- “(13) The minutes of the proceedings of a meeting of the Executive Council shall be drawn up by the Registrar in consultation with the Director and after approval by the person who chaired the meeting of the Executive Council shall be circulated to all the members and be placed in the next meeting and in that next meeting or through circulation, the minutes shall be confirmed by the majority of members” shall be substituted;”;

(iv) in sub-statute (16), for the words “considered by the Building and Works Committee after obtaining the administrative approval of the Executive Council”; the words “considered by the Finance committee” shall be substituted;

(v) for sub-statute (17), the following sub-statutes shall be substituted, namely.- “(17) No matter which should be first considered by the Academic Council or Building and Works Committee or Finance Committee, shall be placed directly before the Executive Council.

(18) If a member of the Executive Council fails to attend three consecutive meetings without leave of absence from the council, he shall leave to be a member of the council.”.

5. In the principal statute, in statute 5,-

(i) for the heading, the following heading shall be substituted, namely:- “Powers and functions of the Executive Council representatives.”.

6. In the principal statute, in statute 7,-

(i) in sub-statute (3), for the words “representatives of”, the words, “representative to” shall be substituted;

(ii) in sub-statute (4), for the words “two times during a calendar year”, the words “three times during an academic year of the Institute.” shall be substituted;

(iii) in sub-statute (7), for the word “half”, the word “third” shall be substituted;

(iv) in sub-statute (8), after the words, “Academic Council”, the following words shall be inserted, namely:- “and in his absence, the senior most Dean present shall preside over the meeting”;

(v) in sub-statute (12), after the word “Registrar”, the words “in consultation with the Director” shall be inserted;

(vi) after the sub-statute (13), the following sub-statutes shall be inserted, namely:- “(14) The notice may be delivered either by hand or through electronic means or by ordinary post.

(15) The Agenda shall be circulated by the Registrar to all members at least one week before the meeting.

(16) During the discussions on admission, examination, evaluation and service conditions of faculty and staff, student representatives to the Academic Council shall not be permitted to participate.”.

7. In the principal statute, in statute 8,-

(i) in the opening paragraph, for the words “power to”, the words “powers and functions to” shall be substituted;

(ii) in clause (i), for the words “courses of studies”, the words “programmes of studies, as recommended by the Board of Studies” shall be substituted;

(iii) in clause (ii), for the words “Advisory Councils”, the words “appropriate authorities of the Institute” shall be substituted;

(iv) in clause (iv), for the word “declare”, the word “approve” shall be substituted;

(v) for clauses (vi) and (vii), the following clause shall be substituted, namely:- “(vi) consider the recommendations of the appropriate authorities of the Institute attached to various divisions, schools, centres and departments and that of expert and other committees and to make recommendations to the Executive Council for appropriate action;

(vii) make provisions for periodic review of the activities of the Faculties, Divisions, Schools, Centres and Departments and to make recommendations to the Executive Council for appropriate action;”;

(vi) in clause (viii), for the words, “make periodical”, the words “make periodic” shall be substituted;

(vii) in clause (ix), for the words “make periodical”, the words “make provision for periodic” shall be substituted;

(viii) for clause (x), the following clause shall be substituted, namely:- “(x) provide for a comprehensive academic audit system, to review the functioning and performance of divisions, schools, centres, departments, library and other academic infrastructure once in three years along with setting up of an internal quality assurance cell, and to recommend to the Executive Council”.

(ix) for clause (xiii), the following clause shall be substituted, namely:- “(xiii) recommend to the Executive Council for creation, restructuring or closure of divisions, schools, centres, and departments of the Institute, with appropriate infrastructure;”;

(x) in sub-statute (xv), for the word “make”, the word “recommend” and for the word “distance”, the word “virtual” shall be substituted;

(xi) after clause (xv), the following clause shall be substituted, namely:- “(xvi) recommend collaborations, joint education and research programmes with academic or research institutions within the country and abroad.”.

8. In the principal statute, in statute 9, after the words “for approval”, the words “and ratification” shall be inserted.

9. In the principal statute, in statute 10, -

(i) in sub-section (1), for the words “every member”, the words “every membership” shall be substituted;

(ii) in sub-statute (2), for the words “in a year”, the words “in a financial year ” shall be substituted;

(iii) in sub-statute (3), for the words “for a meeting”, the words “for the meeting” shall be substituted.

10. In the principal statute, in statute 11,-

(i) in sub-statute (1), in clause (f), for the words “one expert”, the words “two experts” and for the word “Member”, the word – “Members” shall be substituted;

(ii) in sub-statute (3), for the words “four times in a year”, the words “four times in a financial year” shall be substituted;

(iii) in sub-statute (5), for the words “shall be placed before the Executive Council”, the words “shall be routed through Finance Committee and placed before the Executive Council for consideration and approval” shall be substituted.

11. In principal statute, in statute 12, in sub-statute (2), after the words “Executive Council”, the words “for ratification and approval” shall be inserted.

12. In the principal statute, for statute 13, the following statutes shall be substituted, namely:- “13. powers of Chairperson.- The Chairperson shall execute the contract of service between Institute and the Director on behalf of the Visitor.”.

13. In the principal statute, in statute 15,-

(i) in the heading, for the words “Director and his powers”, the words, “Powers of the Director” shall be substituted;

(ii) in sub-statute (2), for the word “Institute”, the words, “Chairperson of the Executive Council” shall be substituted;

(iii) in sub-statute (5), for the words, “up to a limit of twenty-five thousand rupees, subject to such stipulations as may be made”, the words, “as may be stipulated”, shall be substituted;

(iv) in sub-statute (6), the words, “in the vicinity of the Institute”, shall be omitted.

(v) for sub-statute (7), the following sub-statutes shall be substituted, namely:- “(7) The Director shall have the power to appoint academic and non-academic staff in the institute from time to time on temporary basis with the approval of the Executive Council who may be paid from contingencies for not more than one year.

(7A) The Director shall have the power to approve the foreign visits of the faculty, officers and other staff of the Institute for training or academic pursuits in consultation with the Central Government in the Department of Youth Affairs subject to such terms and conditions as may be laid down from time to time.;

(vi) in sub-statute (9), after the words “Head of Department”, the words, “in the Central Government” shall be inserted and after the words “Supplementary Rules (FRSR)”, the words, “and General Financial Rules (GFR)” shall be inserted;

(vii) after sub-statute 13, the following sub-statute shall be inserted, namely:- “(14) The Director shall execute the terms and conditions of service between the Institute and the Registrar on behalf of the Executive Council.”.

14. In the principal statute, in statute 16,-

(i) for sub-statute (1) the following sub-statute shall be substituted, namely:-

(1) The Registrar of the Institute shall be appointed on contract basis based on the recommendation of a selection Committee constituted as provided under clause (c) of Statute 17.

(ii) for sub-statute (2), the following sub-statute shall be substituted, namely:- “(2) The Registrar shall be appointed on tenure basis for a period of three years and shall be governed by the terms and conditions of services as specified in Schedule II.”;

(iii) in sub-statute (3), for clauses (g) and (h), the following clauses shall be substituted, namely:- “(g) to safeguard and maintain the movable and immovable properties of the Institute;

(h) to represent the Institute in suits or proceedings by or against the Institute, sign power of attorney and plead or depute his representatives for the purpose;”.

15. In the principal statute, for statute 17, the following statute shall be substituted, namely:- “17. Appointing authority.- (1) The following shall be the appointing authority with respect to the appointment made by the Institute, namely:—

(a) the Executive Council, if the appointment is made for a post where the maximum of the pay scale is the same or higher than that of an Assistant Professor; and

(b) the Director, in any other case.

(2) The Selection Committee for appointment to the posts specified in column (1) of the Table below shall consist of the persons specified in the corresponding entry in column (2) of the said Table.

Provided that at least four members including two outside subject experts, shall constitute the quorum.

(1) Director to be the Chairperson of the selection Committee.

(2) An academician who is the nominee of the Visitor.

(3) Three experts in the concerned subject/ field nominated by the Director out of the panel of names approved by Executive Council.

(4) Dean of the Faculty, wherever applicable.

(5) Head or Chairperson of the Department or School.

(6) An academician representing the Scheduled Caste or the Scheduled Tribe or Other Backward Class or Minority or Women or Differently-abled categories if any, of the candidates representing these categories is the applicant, to be nominated by the Director, if any of the above members of the selection committee do not belong to that category.

Provided that at least four members including two outside subject experts shall constitute the quorum.

(1) Director to be the Chairperson of the selection Committee

(2) An academician who is the nominee of the Visitor.

(3) Three experts in the concerned subject or field out of the list recommended by the Director and approved by Executive Council.

(4) Dean of the Faculty.

(5) Head or Chairperson of the Department

(6) A representative of the Scheduled Caste or Scheduled Tribe, Women and physically handicapped should be in the selection committee whenever a candidate from any of these categories appears for the interview.

Provided that atleast four members including two outside experts, must constitute the quorum.

16. In the principal statute, in statute 18, in sub-statute (1), after item (b), the following items shall be inserted,- “(c) The Chairman of the Executive Council shall be the Appellate Authority in cases where the Director is the Disciplinary Authority;

(d) The Director shall be the Appellate Authority where the Registrar is the Disciplinary Authority.”.

17. In the principal statute, for statute 19 the following statutes shall be substituted, namely:- “19. The academic staff of the Institute shall be the Director, Professor, Associate Professor, Assistant Professor, and such other academic posts as may be decided by the Executive Council.

19A. The Institute Shall have the following academic units, namely:-

(a) Division;

(b) School;

(c) Centre;

(d) Department.”.

18. In the principal statute, in statute 21, in clause (i),

(a) for the words, “he attains the prescribed maximum age for teaching posts or for technical, ministerial and administrative posts, as the case may be’’, the words, “maximum prescribed age as per UGC norms for teaching staff and Government of India norms for non-teaching staff” shall be substituted;

(v) for paragraph (11), the following paragraph shall be substituted, namely.- “(11) The appointee shall be entitled for travelling expenses for joining the Institute and also for travel in the interest of Institute work, at par with an officer of the Central Government as Fundamental Rules and Supplementary Rules (FRSR) Part II. Also, the appointee shall be entitled to leave travel concession for visiting his hometown as per Fundamental Rules and Supplementary Rules (FRSR) Part II. ”,

(vi) for paragraph (13), the following paragraphs shall be substituted, namely:- “(13) The service of appointee may, during the period of agreement, be terminated by the appointing authority for just and sufficient causes, after following the due process of enquiry and providing sufficient opportunity after serving the notice of termination.

(13 A) The appointee may resign from his service by giving to the Institute three calendar months’ notice in writing or by paying a sum equivalent to three months emoluments in lieu thereof.”;

(vii) after paragraph (15), for the word “Chairman”, the word, “Chairperson”, shall be substituted.

25. In the principal statute, in Schedule II,-

(i) in opening paragraph, for the word “Visitor”, the word “Chairperson, Executive Council” shall be inserted;

(ii) in paragraph (1), the word, “confirmed” shall be omitted;

(iii) in paragraph (3), for the word, “appointee ”, the word, “appointee shall”, shall be inserted;

(iv) in paragraph (4), for the words “Act of the Statutes”, the words “Statutes and Ordinances” shall be substituted;

(v) in paragraph (5), after the word, “Income-tax” the word, “Act, 1961 (43 of 1961)” shall be inserted and for the words, “allowances like dearness allowance, city compensatory allowance, etc.”, the words, “pay and allowances”, shall be substituted;

(vi) in paragraph (7), for the word, “affected”, the word, “effected”, shall be substituted;

(vii) for paragraph (10), the following paragraph shall be substituted, namely:- “(10) The appointee shall be entitled to reimbursement of medical expenses incurred on him and his family as per the Central Civil Services (Medical Attendance) Rules, 1944.”

(viii) for paragraph (11), the following paragraph shall be substituted, namely.- “(11) The appointee shall be entitled for travelling expenses for joining the Institute and also for travel in the interest of Institute work, at par with an officer of the Central Government as Fundamental Rules and Supplementary Rules (FRSR) Part II. Also, the appointee shall be entitled to leave travel concession for visiting his hometown as per Fundamental Rules and Supplementary Rules (FRSR) Part II. ”,

(ix) for paragraph (12), the following paragraphs shall be substituted, namely:- “(12) The service of appointee may, during the period of agreement, be terminated by the appointing authority for just and sufficient causes, after following the due process of enquiry and then providing sufficient opportunity after serving the notice of termination.

(12 A) The appointee may resign from his service by giving to the Institute three calendar months’ notice in writing or by paying a sum equivalent to three months emoluments in lieu thereof.”;

(x) after paragraph (13), for the words, “Chairman of the Executive Council”, wherever they occur the word, “Director”, and at the end for the words “Director”, the word “Registrar” shall respectively be substituted;
