PART II—Section 3—Sub-section (i) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 824] ubZ fnYyh] lkseokj] vDrwcj 9] 2017@vkf'ou 17] 1939 No. 824] NEW DELHI, MONDAY, OCTOBER 9, 2017/ASVINA 17, 1939 पया�वरणपया�वरणपया�वरणपया�वरण,,,, वनवनवनवन और जलवायु प रवत�नऔर जलवायु प रवत�नऔर जलवायु प रवत�नऔर जलवायु प रवत�न मं�ालयमं�ालयमं�ालयमं�ालय अिधसूचनाअिधसूचनाअिधसूचनाअिधसूचना नई �द�ली, 6 अ� तूबर, 2017 सा.सा.सा.सा.का.का.का.का.िनिनिनिन.... 1227122712271227((((अअअअ).).).).————के �ीय सरकार ने, पया�वरण, वन और जलवायु प�रवत�न मं�ालय क� अिधसूचना सं. का.आ. 10(अ) तारीख 6 जनवरी, 2011 (िजसे इसम% इसके प&ात् तटीय िविनयम जोन अिधसूचना, 2011 कहा गया ह)ै, (ारा कितपय तटीय *े�+ को तटीय िविनयमन जोन घोिषत �कया ह ैऔर उ2 जोन म% उ3ोग+, 5चालन+ और 5सं6करण+ क� 6थापना पर िनब9धन अिधरोिपत �कए गए थे ; और परमाण ुखिनज, खिनज+ क� वे सूची ह,ै िजसे खान और खिनज (िवकास और िविनयम) अिधिनयम, 1957 क� 5थम अनुसूची के भाग ख के अधीन घोिषत �कया गया ह,ै जो उस =प म% या अ य खिनज+ के साथ िमलकर उदभूत हो रह ेह> ; और परमाणु खिनज अणु ऊजा� िवभाग (ारा साम�रक और अ य आवAयकताB के िलए अपेि*त ह> और उनका 5सं6करण िव3ुत उCपादन सिहत साम�रक अनु5योग+ के िलए �कया जाता ह ै; और क% �ीय सरकार क� पया�वरण (संर*ण) िनयम, 1986 के िनयम 5 के उपिनयम (4) के उपबंध को Hयान म% रखते Iए यह राय ह ै �क उ2 तटीय िविनयम जोन अिधसूचना, 2011 का सशंोधन करने के िलए उ2 िनयम+ के िनयम 5 के उपिनयम (3) के खंड (क) के अधीन सूचना क� अपे*ा स ेअिभमुि2 5दान करना लोक िहत म% ह ै। अतः, अब, के �ीय सरकार, पया�वरण (संर*ण) िनयम, 1986 के िनयम 5 के उप-िनयम (3) के खंड (घ) के साथ प�ठत उ2 पया�वरण (संर*ण) अिधिनयम, 1986 (1986 का 29) क� धारा 3 क� उपधारा (1) और उपधारा (2) के खंड (v) (ारा 5दU शि2य+ का 5योग करते Iए, तटीय िविनयम जोन अिधसूचना, 2011 म% िनWिलिखत और संशोधन करती ह,ै अथा�त् :-- 1. पैरा 3 के खंड (x) के उपखंड (क) के 6थान पर िनWिलिखत उपखंड रखा जाएगा, अथा�त् :-- “(क) खान और खिनज (िवकास और िविनयम) अिधिनयम, 1957 (1957 का 67) क� 5थम अनुसूची के भाग ख के अधीन अिधसूिचत परमाणु खिनज+ का खनन, जो उस =प म% या अ य खिनज+ के साथ िमलकर उदभूत हो रह ेह>” ; 2. पैरा 4 के खंड (ii) के उपखंड (छ) के 6थान पर िनWिलिखत उपखंड रखा जाएगा, अथा�त् :-- “(छ) खान और खिनज (िवकास और िविनयम) अिधिनयम, 1957 (1957 का 67) क� 5थम अनुसूची के भाग ख के अधीन अिधसूिचत परमाणु खिनज+ का खनन, जो उस =प म% या अ य खिनज+ के साथ िमलकर उदभूत हो रह ेह>”; 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

13. का.आ. 2444(अ), तारीख 31 जुलाई, 2017 । ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 6th October, 2017 G.S.R. 1227(E).—Whereas by notification of the Government of India in the Ministry of Environment and Forests number S.O.19(E), dated the 6th January, 2011 (hereinafter referred to as the Coastal Regulation Zone Notification, 2011), the Central Government declared certain coastal stretches as Coastal Regulation Zone and restrictions were imposed on the setting up and expansion of industries, operations and processes in the said Zone; And whereas, atomic minerals are the list of minerals declared under Part-B of First Schedule of the Mines and Minerals (Development and Regulation) Act, 1957, occurring as such or in association with other minerals; And whereas, atomic minerals are required for strategic and other requirements by the Department of Atomic Energy and are processed for strategic applications including power generation; And whereas, the Central Government, having regard to the provision of sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, is of the opinion that it is in public interest to dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the said rules for amending the said Coastal Regulation Zone Notification, 2011. Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section
(2) of section 3 of the Environment (Protection) Act, (29 of 1986) read with clause (d) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following further amendments in the Coastal Regulation Zone Notification, 2011, namely:—
1. in paragraph 3, in clause (x), for sub-clause (a), the following sub-clause shall be substituted, namely:— “(a) mining of Atomic Minerals notified under Part-B of the First Schedule of the Mining and Minerals (Development) Act, 1957 (67 of 1957) occurring as such or in association with one or other minerals”;
2. in paragraph 4, in clause (ii), for sub-clause (g), the following sub-clause shall be substituted, namely:— “(g) mining of Atomic Minerals notified under Part-B of the First Schedule of the Mining and Minerals (Development) Act, 1957 occurring as such or in association with one or other minerals”;
3. in paragraph 8,—
(1) in sub-paragraph (I). CRZ-I, in item (ii), after sub-item (g), the following shall be inserted, namely:—
(h) Manual mining of atomic mineral(s) notified under Part-B of First Schedule of Mining and Minerals (Development) Act, 1957 occurring as such or in association with one or other minerals - in the inter-tidal zone by such agencies as authorised by Department of Atomic Energy, as per mining plan approved by the Department of Atomic Energy:
Provided that the manual mining operations are carried out only by deploying persons using baskets and hand spades for collection of ore or mineral within the intertidal zone and as per approved mining plan.
Explanation.—For the purpose of this notification, manual mining shall mean the mining operations undertaken without deploying or using drilling and blasting or Heavy Earth Moving machinery in the intertidal zone. 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(2) in sub-paragraph (III).CRZ-III,—
(i) in item A, in sub-item (iii), for the clause (c), the following clause shall be substituted, namely:— “(c) Mining of Atomic Minerals notified under Part-B of the First Schedule of the Mining and Minerals (Development) Act, 1957 occurring as such or in association with one or other minerals”;
(ii) in item (B), after sub-item (x), the following sub-item shall be inserted; “(xi) Mining of Atomic Minerals notified under Part-B of the First Schedule of Mining and Minerals (Development) Act, 1957 occurring as such or in association with one or other minerals”.
