(i) यदद संबंजधत ऄजभकरणों से ऄपेजित हो, अज से चार मास के भीतर पीवीसी पाआपों में प्रयकु्त होने वाल ेसीसा के गुणवत्ता मानकों को ऄजधसूजचत करन;े (ii) बीअइएस के परामिा से, पीवीसी पाआपों में सीसे की ईपजस्ट्थजत के जलए मानक ऄजधकजथत करन ेऔर (iii) पीवीसी पाआपों में स्ट्टेबलाआजर के रूप में सीसे के प्रयोग को क्रमबद्ध रूप से समाप्त करन ेके जलए एक कायाक्रम बनाने हते,ु जनदेजित दकया;
और, केन् रीय सरकार ने पयाावरण (संरिण) जनयम, 1986 के जनयम 13 के ईप जनयम (2) के साथ परित पयाावरण (संरिण) ऄजधजनयम, 1986 (1986 का 29) की धारा 3 की ईपधारा (1), धारा 3 की ईपधारा (2) के खंड
(viii) और धारा 6 की ईपधारा (2) के खंड (घ) के ऄधीन ऄपनी िजक्तयों का प्रयोग करते हुए, ईन सभी व्यजक्तयों को, जजनके ऄन्तगात वे संगिन या ईद्योग भी हैं जजनके आससे प्रभाजवत होने की संभावना थी, सूजचत करन े के जलए भारत के राजपत्र, ऄसाधारण में ऄजधसूचना संख्या सा.का.जन. 651(ऄ), तारीख 12 जसतम्बर, 2019 द्वारा प्रारुप जनयम प्रकाजित दकए और यह सूचना दी गइ दक ईक्त प्रारुप जनयमों पर केन्रीय सरकार द्वारा ईस तारीख से, जजसको आस ऄजधसूचना को ऄन्तर्ववष्ट करन ेवाल ेराजपत्र की प्रजतयां जनसाधारण को ईपलब्ध करा दी जाती हैं, साि ददन की ऄवजध की समाजप्त के पश्चात् जवचार दकया जाएगा;

और, केन्रीय सरकार ने भारत के राजपत्र, ऄसाधारण में ऄजधसूचना संख्या सा.का.जन.835(ऄ), तारीख 7 नवम्बर, 2019 द्वारा ईक्त लाग ूजनयमों का एक िुजद्ध पत्र भी जारी दकया था तथा ईक्त िुजद्ध पत्र जनसाधारण को तारीख 11 नवम्बर, 2019 को ईपलब्ध कराया गया;
और, उपर वर्वणत प्रारुप जनयमों के प्रत्युत्तर में प्राप्त सुझावों या अिेपों पर केन्रीय सरकार द्वारा सम्यक् रूप से जवचार कर जलया गया ह ै। ऄतः, ऄब, केन्रीय सरकार, पयाावरण (संरिण) जनयम, 1986 के जनयम 13 के साथ परित, पयाावरण (संरिण) ऄजधजनयम, 1986 (1986 का 29) की धारा 3 और धारा 6 द्वारा प्रदत्त िजक्तयों का प्रयोग करत ेहुए, जनम्नजलजखत जनयम बनाती ह,ै ऄथाात ्:-
1. सजंिप्त नाम और प्रारंभ – (1) आन जनयमों का संजिप् त नाम पोजलजवनायल क् लोराआड (पीवीसी) पाआपों और दिटटगों में सीसा स्ट् टेजबलाआजर जनयम, 2021 ह ै।
(2) ये राजपत्र में ईनके प्रकािन की तारीख से छह मास पश्चात ्प्रवृत् त होंगे।
2. सीसा या सीसा सजमश्रण के ईपयोग का प्रजतषधे – (1) ऄनसूुची के प्रवगा क, ख और ग में अने वाले पीवीसी पाआप और दिटटग का प्रत् यके जवजनमााता और अयातक, भारतीय मानक ब् यरूो द्वारा भारतीय मानक के जलए यथाजनर्ददष् ट सीमा जनकालने की सीमा के ऄनुपालन को, जैसा ईक् त ऄनुसूची के स्ट् तंभ (3) में ईपबंजधत ह,ै सुजनज चत करेगा ।
(2) जवजनमााता,-
(i) भारतीय मानक ब् यरूो (ऄनरुूपता जनधाारण) जवजनयम, 2018 की ऄनुसूची 2 की स्ट् कीम 1 के ऄनुसार आन जनयमों के प्रकािन की तारीख से छह मास की ऄवजध के भीतर भारतीय मानक ब् यरूो से ऄनुज्ञजप् त प्राप् त करेगा ;
(ii) भारतीय मानक ब् यरूो द्वारा जारी ऄनजु्ञजप् त में ईपबंजधत जवजनदेि के ऄनुसार सभी पीवीसी पाआप और दिटटग पर “मानक जचह्न” ईत् कीणा करेगा ।
(3) पीवीसी पाआप और दिटटग का जवजनमााता, ईक् त ऄनुसूची के स्ट् तंभ (4) में यथा जनर्ददष् ट तारीख से, देि में व्यापार के जलए ऄनुसूची के स्ट् तंभ (2) में यथा ईपबंजधत ऐसे पीवीसी पाआप और दिटटग के जवजनमााण में स्ट् टेबलाआजर के रूप में सीसे के ईपयोग या सीसा सजमश्रण का प्रजतषेध करेगा ।
(4) पीवीसी पाआप और दिटटग का कोइ भी अयातक, आन जनयमों के प्रकािन की तारीख से तीन मास की समाजप्त के पश्चात,् ऄनुसूची के स्ट्तंभ (2) में जवजनर्ददष्ट मदों के जलए स्ट्टेजबलाआजर के रूप में सीसा सजमश्रण प्रयोग करके जवजनर्ददष्ट दकए गए ऐसे पीवीसी पाआपों का अयात करन ेके जलए ऄनुज्ञात नहीं दकया जाएगा ।
3. नोडल ऄजभकरण-(1) राज्य प्रदषूण जनयंत्रण बोडा (एसपीसीबी) और प्रदषूण जनयंत्रण सजमजत (पीसीसी) आन जनयमों के ईपबंधों को दक्रयाजन् वत और प्रवृत्त करने के जलए संबंजधत राज्यों या संघ राज्यिेत्रों में नोडल ऄजभकरण होगा ।
(2) आन जनयमों के दक्रयान् वयन से संबंजधत प्रत्येक जववाद या मदु्दा नोडल ऄजभकरण को जनर्ददष् ट दकया जाएगा ।
(3) आन जनयमों के दक्रयान् वयन के प्रयोजन के जलए और आन जनयमों से संबंजधत दकसी जववाद या मुदे्द के जनराकरण के जलए नोडल ऄजभकरण द्वारा एक पनैल गरित दकया जा सकेगा ।
4. ईत् पादों के परीिण के जलए प्राजधकृत ऄजभकरण-(1) भारतीय मानक ब् यरूो की प्रयोगिालाए ंऔर भारतीय मानक द्वारा ऄनुमोददत प्रयोगिालाए ं ऐसे परीिणों को दक्रयाजन् वत करन े के जलए ऄजधकृत होगी, जो जनयम 2 के ऄनुपालन को सुजनज चत करन ेके जलए अव यक हों । [भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3
(2) ऄनुसूची के प्रवगा क, ख और ग के ऄधीन अने वाले पीवीसी पाआप और दिटटग के सभी जवजनमााता और अयातक, जनयम 2 के ऄनुपालन को सुजनज चत करने के जलए ऐसे पीवीसी पाआप और दिटटग को परीिण के जलए ईप जनयम (1) में यथाजनर्ददष् ट प्रयोगिाला के सामने प्रस्ट् तुत करेंगे ।
(3) प्रत् यके जनमााता और अयातक नोडल ऄजभकरण और भारतीय मानक ब् यरूो को परीिण ररपोटें, यथा ऄपेजित सत् यापन, और दकसी कारावाइ के जलए, प्रस्ट् तुत करेंग े।
(4) नोडल ऄजभकरण प्रत् यके छह मास में आन जनयमों के ईपबंधों के दक्रयान् वयन और प्रवतान की जस्ट् थजत पर एक व् यापक ररपोटा केन्रीय प्रदषूण जनयंत्रण बोडा (सीपीसीबी) को प्रस्ट् ततु करेगा ।

No. 477/2015 in the matter of Jan Sahyog Manch Vs. Union of India and Others directed Secretary, MoEF&CC (i) To notify, if required with concerned agencies the quality standards of lead to be used for PVC pipes within four months from today; (ii) To lay down the standards for presence of lead in PVC pipes, in consultation with BIS and (iii) To draw up a programme for phasing out of lead as stabilizer in PVC pipes;
And whereas, the Central Government had in exercise of its powers under sub-section (1) of section 3, clause (viii) of sub-section (2) of section 3 and clause (d) of sub-section (2) of section 6 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-rule (2) of rule 13 of the Environment (Protection) Rules, 1986, published the draft rules in the Gazette of India, Extraordinary, vide number G.S.R. 651(E), dated the 12th September, 2019 for information of all persons including organisations or industries likely to be affected thereby; and notice was given that the said draft rules will be taken into consideration by the Central Government after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public;
And whereas, the copies of the Gazette containing the said notification were made available to the public on the 13 th September, 2019;
And whereas, the Central Government had also issued a corrigendum to the said draft rules in the Gazette of India, Extraordinary, vide number G.S.R. 835(E), dated the 7 th November, 2019 and the said corrigendum was made available to the public on the 11 th November, 2019;
And whereas, the suggestions or objections received in response to the above mentioned draft rules have been duly considered by the Central Government.
Now, therefore, in exercise of the powers conferred by section 3 and section 6 of the Environment (Protection) Act, 1986 (29 of 1986), read with rule 13 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following rules, namely:-
1. Short title and commencement. - (1) These rules may be called the Lead Stabilizer in Polyvinyl Chloride (PVC) Pipes and Fittings Rules, 2021.
(2) They shall come into force six months after the date of their publication in the Official Gazette.
2. Prohibition of use of lead or lead compounds.—(1) Every manufacturer and importer, of thePVC pipes and fittings falling in category A, B and C of the Schedule, shall ensure to comply with the limits of the lead extraction, as specified for the Indian Standards by the Bureau of Indian Standards (BIS) and the same is provided in column (3) of the said Schedule.

(2) The manufacturer shall,-
(i) obtain a licence from the Bureau of Indian Standards within a period of six months from the date of publication of these rules in accordance with Scheme-I of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018;
(ii) mark the ―Standard Mark‖ on all the PVC pipes and fittings in accordance with the specification provided in the licence issued by the Bureau of Indian Standards.
(3) The manufacturer of PVC pipes and fittings shall be prohibited to use lead or lead compounds as stabilizer in manufacturing of such PVC pipes and fittings as provided in column (2) of the Schedule for trade in the country, from the date as specified in column (4) of the said Schedule.
(4) No importer of the PVC pipes and fittings shall be allowed to import such PVC pipes and fittings manufactured using lead or lead compounds as stabilizer for the items specified in column (2) of the Schedule after expiry of three months from the date of publication of these rules.
3. Nodal agency.—(1) The State Pollution Control Board (SPCB) and Pollution Control Committee (PCC) concerned shall be the Nodal Agency for implementation and enforcement of the provisions of these rules in their respective State or Union Territories.
(2) Every dispute or issue relating to the implementation of these rules shall be referred to the Nodal Agency.
(3) A Panel may be constituted by the Nodal Agency for the purpose of implementation of these rules and to resolve any dispute or issue relating to these rules.
4. Authorised agencies for testing of products.—(1) The Laboratories of the BIS and the Laboratories approved by the BIS shall be authorised to carry out such tests as are necessary to ascertain the compliance of rule 2.
(2) Every manufacturer and importer of the PVC pipes and fittings, falling under Category A, B and C in the Schedule, shall produce such PVC pipes and fittings for testing before the laboratories as specified in sub-rule (1), to ensure the compliance of rule 2.
(3) Every manufacturer and importer shall submit the test reports to the Nodal Agency and the BIS for verification and any action, as may be required.
(4) The Nodal Agency shall furnish a comprehensive report on the status of implementation and enforcement of the provisions of these rules to the Central Pollution Control Board (CPCB) in every six months.
5. Sale, import and export.—Sale and import of the PVC Pipes and Fittings falling under category A, B and C in the Schedule shall be regulated through this notification, except export.
