1. संजक्षप् त नाम और प्रारंभ- (1) इन जनयमों का संजक्षप् त नाम पॉजलजवनाइल क् लोराइड (पीवीसी) पाइपों और दिटिंग् स में लेड स्ट् िेंजि लाइजर (संिोधन) जनयम, 2022 ह।ै
(2) ये राजपत्र में अजधसूचना की तारीख से छ: माह में प्रवृत्त होंगे।
2. पॉजलजवनाइल क् लोराइड (पीवीसी) पाइपों और दिटिंग् स में लेड स्ट् िेंजि लाइजर जनयम, 2021 (जजसे इसमें इसके पश् चात् उक् त जनयम कहा गया ह)ै के, जनयम 2 में, — (क) उप जनयम (1) में, ‘‘स्ट् तंभ (3) में उपिंजधत’’ िब् दों, कोष् िकों और अंकों के स्ट् थान पर ‘‘स्ट् तभं (4) में उपिंजधत’’ िब् द, कोष् िक और अंक रखे जाएंग;े (ख) उप जनयम (2) के स्ट् थान पर, जनम् नजलजखत उप जनयम रखे जाएंग,े — ‘(i) जनयम 4 के उप जनयम (1) के अनुसार, जवजनमााता द्वारा संिंजधत राज् य प्रदषूण जनयंत्रण िोडा अथवा प्रदषूण जनयंत्रण सजमजत को जल (प्रदषूण जनवारण तथा जनयंत्रण) अजधजनयम, 1974 (1974 का 6) के उपिंध के अधीन संिंजधत स.ं 319] नई ददल्ली, िुधवार, मई 4, 2022/विैाख 14, 1944 No. 319] NEW DELHI, WEDNESDAY, MAY 4, 2022/VAISAKHA 14, 1944 सी.जी.-डी.एल.-अ.-05052022-235553 CG-DL-E-05052022-235553 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] राज् य प्रदषूण जनयंत्रण िोडा अथवा प्रदषूण जनयंत्रण सजमजत द्वारा प्रदान की गइा प्रचालन की सहमजत के अनुसार, परीक्षण के जलए प्राजधकृत एजेंजसयों द्वारा दकए गए पाइपों और दिटिंग् स के जल परीक्षण की ररपोिंा प्रस्ट् तुत की जाएगी:
परन् त,ु ऐसे सभी पॉजलजवनाइल क् लोराइड पाइपों और दिटिंग् स का जवजनमााण करने हते ुभारतीय मानक ब् यरूो से िैध लाइसेंस प्राप् त करन ेवाले तथा भारतीय मानक ब् यरूो द्वारा जारी लाइसेंस में ददए गए जवजनदेि के अनुसार ‘‘मानक जनिान’’ से जचजननत ऐसे सभी पॉजलजवनाइल क् लोराइड पाइपों और दिटिंग् स को रखन ेवाल ेजवजनमााता को ऐसी परीक्षण ररपोिंा प्रस्ट् ततु करने से छूिं दी जाएगी।
(ii) अनुसूची में जवजनर्ददष् िं संिंजधत श्रेणी क, ख और ग के अधीन प्रत् यके उत् पाद के जलए पॉजलजवनाइल क् लोराइड पाइपों और दिटिंग् स का प्रत् यके जवजनमााता और प्रत् यके आयातक भारतीय मानक ब् यरूो के आईएस कोड या उसके समतुल् य, जो वतामान में उपलब् ध हैं या भजवष् य में जवकजसत दकए जाएगं,े के संिंध में उस अनुसूची में उजल्लजखत िता का अनपुालन करेगा। स्ट् पष् िंीकरण.— इस जनयम और जनयम 3 के प्रयोजन के जलए, ‘‘जवजनमााता’’ का अथा भारत के भू-के्षत्र के भीतर या भारत के भू-के्षत्र के िाहर जस्ट्थत पॉजलजवनाइल क् लोराइड पाइपों और दिटिंग् स का जवजनमााता ह’ै।
3. उक् त जनयमों के जनयम 3 में, उप जनयम (3) में, ‘‘एक पनैल’’ िब् दों के स्ट् थान पर ‘‘जवजनमााता के प्रजतजनजध सजहत एक पैनल’’ िब् द रखे जाएंगे।
4. उक् त जनयमों के जनयम 4 में, उपजनयम (1) के स्ट् थान पर, जनम् नजलजखत उप जनयम (I) रखा जाएगा, अथाात:्— (।) ‘‘राष् रीय परीक्षण और समांकन प्रयोगिाला प्रत् यायन िोडा द्वारा प्रत् याजयत प्रयोगिालाएं ऐसे परीक्षणों को संचाजलत करन ेहते ुप्राजधकृत होंगी जो जनयम 2 का अनुपालन सुजनजित करन ेहते ुआवश् यक हैं’’।

1. Short title and commencement. - (1) These rules may be called the Lead Stabilizer in Polyvinyl Chloride (PVC) Pipes and Fittings (Amendment) Rules, 2022.
(2) They shall come into force six months from the date of notification in the Official Gazette.
2. In the Lead Stabilizer in Polyvinyl Chloride (PVC) Pipes and Fittings Rules 2021 (hereinafter referred to as the said rules), in rule 2,-
(a) in sub-rule(1), for the words, brackets and figure ―provided in column (3)‖, the words, brackets and figure ―provided in column (4)‖, shall be substituted;
(b) for sub-rule (2), the following sub-rule shall be substituted, - ‗(i) The manufacturer shall submit water test report of pipes and fittings carried out by authorised agencies for testing as per sub-rule (1) of rule 4, to respective State Pollution Control Board or Pollution Control Committee in accordance with the consent to operate granted by respective State Pollution Control Board or Pollution Control Committee subject to the provision of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974):
Provided that the manufacturer having valid licence from Bureau of Indian Standards for manufacturing of all such Polyvinyl Chloride Pipes and Fittings, and having all such Polyvinyl Chloride Pipes and Fittings marked with "Standard Mark" in accordance with the specification provided in the Licencse issued by the Bureau of Indian Standards, shall be exempted from submission of such test report.
(ii) Every manufacturer and every importer of Polyvinyl Chloride Pipes and Fittings for every product under the respective Category A, B, and C specified in the Schedule shall comply with the conditions mentioned in that Schedule with respect to IS code of Bureau of Indian Standard or equivalent which are presently available or shall be developed in the future.
Explanation.- For the purposes of this rule and rule 3, ―manufacturer‖ means manufacturer of Polyvinyl Chloride Pipes and Fittings situated within the territory of India or outside the territory of India‘.
3. In rule 3 of the said rules, in sub- rule (3), for the words ―A Panel‖, the words ―A Panel including a representative from manufacturer‖, shall be substituted.
4. In rule 4 of the said rules, for sub- rule (1), the following sub-rule (I) shall be substituted namely:- (I) ―The Laboratories accredited by National Accreditation Board for Testing and Calibration Laboratories shall be authorised to carry out such tests as are necessary to ascertain the compliance of rule 2‖.
5.
