PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY रेल मतं्रालय (रेलव ेबोडड) अजधसचूना नई दिल्ली 3 िून, 2020 सा.का.जन.346(अ).—केन्द रीय सरकार, रेल अजधजनयम, 1989 (1989 का 24) की धारा 129 और रेल यात्री (अनपेजित नाना क के अन्द वेषण ण की रीजत) जनयम, 2003 का अजधक्ांत करते हुए उन बातों के जसवाय जिन्द हें से अजधक्ांत करत ेहुए अजधक्मण से पहले दकया गया ह ैया करन ेका लोप दकया गया ह ैद्वारा प्रित् त िजत तयों का प्रयोग करते हुए जनम् नजलजखत जनयम बनाती ह;ै अर्ाडत ्:– 1 सजंिप् त नाम और प्रारंभ :– (1) इन जनयमों का संजिप् त नाम रेल यात्री (अनपेजित नाना क के अन्द वेषण ण की रीजत) जनयम, 2020 ह ै।
(2) य ेरािपत्र में प्रकािन की तारीख से प्रवृत् त हुए समें ें िाएंगे । 2 पररभाषण ाएं: – (1) इन जनयमों में िब तक दक संिभड से अन्द यर्ा अपेजित न हो ; (क) “अजधजनयम” से रेल अजधजनयम; 1989(1989 का 24) अजभप्रते हैं ; (ख) “िावा अजधकरण” से रेल िावा अजधकरण अजधनयम; 1987 के अधीन गरित अजधकरण अजभप्रेत ह ै; (ग) “डायरी” से सी स्ट् ाेिन डायरी अजभप्रेत ह ैिो स्ट् ाेिन पर नाी िैजनक नाना क को अजभजलजखत करने के जलए स्ट् ाेिन अधीिक द्वारा रखी िाती ह;ै (न) “प्रभागीय कायाडलय” से आंचजलक रेल का प्रभागीय मुख् यालय अजभप्रेत ह;ै स.ं 267] नई दिल्ली, बहृस्ट् पजतवार, िनू 4, 2020/ज् यषे् ि 14, 1942 No. 267] NEW DELHI, THURSDAY, JUNE 4, 2020/JYAISHTHA 14, 1942 सी.जी.-डी.एल.-अ.-04062020-219729 CG-DL-E-04062020-219729 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ङ) “प्रभागीय रेल प्रबंधक” से प्रभागीय कायाडलय का प्रिासजनक भारसाधक या उनके द्वारा नाम जनिेजित अजतररत त प्रभागीय रेल प्रबंधक अजभप्रेत ह;ै (च) “प्रभागीय सुरिा आयुत त” से कमांडेा पंजत त से अजनम् न पंजत त का सा अजधकारी िो दकसी प्रभाग या रेल से संबंन दकसी अन्द य स्ट्र्ान पर दकसी रेल स्ट् र्ापन का प्रधान ह;ै अजभप्रेत ह;ै (छ) “बल” से रेल संरिण बल अजभप्रेत ह;ै (ि) “प्ररूप” से इन जनयमों से संलग् न प्ररूप अजभप्रेत ह;ै (ें ) “समीिा ररपोाड” से पुजलस द्वारा तैयार की गई नाना के ब् यौरों से युत त ररपोाड अजभप्रेत ह;ै (ञ) “िामा तलािी” से अनपेजित नाना से प्रभाजवत व् यजत त के दकसी मालअसबाब की वसूली के बारे में ररपोाड अजभप्रेत ह;ै (ा) “बल के अजधकारी” से रेल संपजत् त (जवजध जवरूध क कब् िा) अजधजनयम; 1966 (1966 का 29) की धारा 2 के खंड (ग) और रेल अजधजनयम; 1989 (1989 का 2) की धारा 2 के खंड (26क) में यर्ा पररभाजषण त प्राजधकृत अजधकारी अजभप्रेत ह;ै (ि) “पुजलस” से राज् य पुजलस अजभप्रेत ह;ै (ड) “स्ट् ाेिन अधीिक” के अतंगडत उप स्ट् ाेिन अधीिक; स्ट् ाेिन मास्ट् ार और सहायक स्ट् ाेिन मास्ट् ार या स्ट् ाेिन का भारसाधक अन्द य अजधकारी अजभप्रेत ह;ै (ढ) “अनपेजित धाना” से अजधजनयम की धारा 123 के खंड(ग) के अधीन पररभाजषण त कोई धाना अजभप्रेत ह;ै और (ण) “ऑंचजलक रेल” से अजधजनयम की धारा 3 के अधीन गरित कोई आंचजलक रेल अजभप्रेत ह;ै
(2) उन िब् िों और पिों के; िो इसमें प्रयुत त ह ैऔर पररभाजषण त नह ह ैिंकंतु अजधजनयम में पररभाजषण त है; क्मि: वही अर्ड होंगे िो उनके अजधजनयम में ह ै।
(3) अनपिेजपत नाना के बारे में ररपोाड – कोई रेल सेवक, जिसके अंतगडत बल के सिस्ट् य, गाड़ी का गाडड और चालक भी हैं, अनपेिजपत नाना की िानकारी जमलन े पर, जनकातम मास्ट् ार रेल स्ट् ाेिन अधीिक को तत् काल नाना की ररपोाड करेगा ।
(4) स्ट् ाेिन अधीिक, गाडड, सवंाहक और गाड़ी का भारसानक गाड़ी राका परीिक के कतडव् य – (1) यदि स्ट् ाेिन पर कोई अनपेजित नाना नाती ह ैतो संबंध स्ट् ाेिन अधीिक आहत याजत्रयेां की जचदकत् सीय सहायता के जलए तत् काल इंतिाम करेगा और सी नाना की ररपोाड नरात होन ेके चौबीस धंाे के भीतर प्ररूप-1 में प्रभागीय सुरिा आयुत त को िेगा । प्ररूप-1
(2) यदि सेत िन के म् य में कोई अनपेजित नाना नाती ह ैतो संबंध गाड़ी का गाडड जनकातम स्ट् ाेिन के स्ट् ाेिन मास्ट् ार को सूजचत करेगा िो उप-जनयम (1) में जनर्िडष् ा कतव् यों को पालन करेगा ।
(3) यदि अनपेजित नाना में गाडड आहत हो िाता ह ै तो संबंध गाड़ी का संवाहक जनकातम स्ट् ाेिन के स्ट् ाेिन अधीिक को सूजचत करेगा िो उप-जनयम (1) के जनर्िडषण ् ा कतडव् यों का पालन करेगा ।
(4) यदि गाडड और संवाहक िोनेां अनपेजित नाना में आहत हो िाते ह ैतो भारसाधक गाड़ी राका परीिक संबंध गाड़ी का संवाह जनकातम स्ट् ाेिन के स्ट् ाेिन अधीिक को सूजचत करेगा िो उप-जनयम (1) के जनर्िडष् ा कतडव् यों का पालन करेगा ।
(5) यदि उप-जनयम (2); उप-जनयम (3) और उप-जनयम (4) में उजल् लजखत अजधकाररयों की अनुपजस्ट् र्जत में स्ट् ाेिन के म् य में कोई नाना नाती ह ैतो स्ट् ाेिन का अधीिक उप-जनयम (1) में जनर्िडष् ा कतडव् यों का पालन करेगा । [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 5 . स्ट्ाेिन अधीिक के अजतररक्त कतडव्य- जनयम 3 के अधीन दकसी अनपेजित नाना के होन ेबारे मे स्ट्ाेिन अधीिक; -
(i) अनपेजित नाना क की ररकॉर्डिंग के जलए एक अलग अनन्दय रजिस्ट्ार बनाए रखना (क) प्रत्येक अनपेजित नाना की एक जवजिष्ट पहचान संख्या सौंपना और इस जवजिष्ट पहचान संख्या के सामने उक्त रजिस्ट्ार में अनपेजित नाना का उल्लेख करें। (ख) अनपेजित नाना रजिस्ट्ार को हर दिन 23:59 बिे बंि कर दिया िाना चाजहए जिससे बाि में होन े वाली अनपेजित नाना को उस दिन के सामने रजिस्ट्ार में िोड़ा िा सके।
(ii) अनपेजित नाना के मौके के बारे में एक संजिप्त ररपोाड करे और उसकी प्रजतयााँ प्रभागीय कायाडलय; िेत्रीय रेलवे; पुजलस और बल के प्रभागीय सुरिा आयकु्त को िें।
(iii) प्रभागीय वाजणजज्यक प्रबंधक प्रभारी वररष्ठ प्रभागीय वाजणजज्यक प्रबंधक को जनयम 4 के अनुपालन सजहत अनपेजित नाना क की प्राजस्ट्र्जत ररपोाड प्रस्ट्ततु करें।
6. बल द्वारा अन्द वषेण ण दकया िाना और उसको ररपोाड प्रस्ट् तुत करना – (1) जनयम 6के अधीन सूचना प्राप् त होने पर; बल का अजधकारी िो जनरीिक की पंजत त से नीचे का न हो अन्द वेषण ण करेगा, और
(i) नाना का अन्द वेषण ण करने वाली पुजलस से मृत् यु समीिा ररपोाड ग् िव- परीिण ररपोाड और िामा तलािी रररपोाड की प्रजतयां अजभप्राप् त करेगा;
(ii) जनयम 5 के खंड (ii) के अधीन जवजनर्िडष्ट ररपोाड की प्रजत प्राप्त करेगा;
(iii) अनपेजित नाना के बारे में प्रारूप-2 में सूचना अजभप्राप् त् करेगा;
(iv) अजतररत त साजियों के कर्न यदि सा अपेजित हो तो अजभजलजखत करेगा;
(v) मामले की पररजस्ट् र्जतयों द्वारा अपेजित कोई अन्द य सा् य एकजत्रत करेगा ।
(2) बल का अजधकारी अन्द वेषण ण की साि दिन की अवजध के पूरा हो िाने पर जनयम 9 के उप जनयम 2के अधीन जवजनर्िडष् ा प्राजधकाररयों को ररपोाड प्रस्ट् तुत करेगा ।
7. पजुलस द्वारा अन्द वषेण ण दकया िाना और उसको ररपोाड प्रस्ट् ततु करना: (1) पुजलस को साधारण िनता या स्ट्ाेिन अधीिक सजहत दकसी भी रेलवे सेवक से दकसी अनपेजित नाना की सूचना जमलन ेपर, पुजलस तरंुत िााँच िुरू करेगी और िंड प्रदक्या संजहता; 1973 में अजभकजर्त प्रदक्या के अनुसार समीिा ररपोाड या िजत ररपोाड तैयार करेगी ।
(2). दकसी अनपेजित नाना के नानास्ट्र्ल पर पहुाँचने पर पुजलस जनकातम संबंजधत स्ट्ाेिन अधीिक को व्यजक्तगत रूप से या ाेलीफोन पर या नाना के स्ट्र्ल पर या एसएमएस या अपनी उपजस्ट्र्जत के दकसी प्रभावी इलेतरॉजनक मा्यम से सूजचत करेगी। पुजलस तुरंत नानास्ट्र्ल पर पाररयों साजियों (एस) आसपास खड़े लोंगों के सार् िव पीजड़त के सार् नाना की तस्ट्वीरें लेगी।
(3) पुजलस उप-जनयम (1) और उप जनयम (2) में यर्ा वर्णडत ररपोाड तैयार हो िाने पश्चात ्नाना स्ट् र्ल से गाजड़यों के संचलन के जलए तत् काल जनकासी प्रमाण पत्र िगेी जिससे गाड़ी संचलन के पुन:स्ट् र्ापन में न्द यून्द तम जवलंब हो ।
(4) पुजलस जवस्ट्तृत िनुडाना ररपोाड (डीएआर) तैयार करेगी और प्रभागीय रेलवे प्रबंधक को प्रस्ट्ततु करन े के जलए अनपेजित नाना की तारीख से 60 दिनों के भीतर उनकी एक प्रजत प्रभागीय सुरिा आयुक्त वररष्ठ प्रभागीय सुरिा आयुक्त को सौंपेगी।
(5) उपरोक्त जनयम 7 के उप-जनयम (2) के अधीन फोाो लेन ेमें पुजलस के जवफल होने की जस्ट्र्जत में, संबंजधत डीसीपी यह िााँच करेगा दक तस्ट्वीरें तयों नह ली गई और तया चूक के जलए कोई कारडवाई की गई ह।ै
8. आहत याजत्रयों के जनका संबंधी पुजलस के समि सभी सुसंगत सा् य प्रस्ट् ततु कर सकें ग ेऔर अन्द वेषण ण को पूरा करन ेमें पुजलस तर्ा बल की सहायता कर सकें ग े।
9. पजुलस और बल द्वारा अन्द वेषण ण ररपोाड भिेना:- (1) । अन्द वेषण ण पूरा हो िान ेपर, पुजलस िडं प्रदक्या संजहता,1973 (1974 का 2) के अधीन यर्ापजेित मजिस्ट् रेा को उसकी ररपोाड भेिेगी। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(2) बल का अजधकारी जनयम 6 के उप-जनयम (2) के अधीन तैयार की गई ररपोाड बल के प्रभागीय सुरिा आयुत त को भेिेगा ।
(3) प्रभागीय सुरिा आयुत त बल के अजधकारी से िांच की ररपोाड जमलने के पंरह दिनों के भीतर प्रभागीय रेलवे प्रबंधक को ररपोाड सौंपेंगे।
(4) प्रभागीय सुरिा आयकु्त यह भी सुजनजश्चत करेंगे दक गृह मंत्रालय द्वारा पररचाजलत प्रारूप में पुजलस द्वारा तैयार की गई जवस्ट्तृत िनुडाना ररपोाड की एक प्रजत (सीएस जडवीिन) पत्र क्मांक 24013/35 / जवजवध / 2017 सीएसआर; .II तारीख 02.09.2019 द्वारा पुजलस को प्राजप्त के 15 दिनों के भीतर और तथ्यों का पता लगान ेके बाि और प्ररूप -2 के सार्-सार् मामल ेके तथ्यों की वास्ट्तजवकता की पुजष्ट करन ेके जलए प्रभागीय रेलवे प्रबंधक को भेि दिया िाता ह।ै
10. प्रभागीय रेल प्रबधंक द्वारा ररपोाड पर कारडवाई – (1) प्रभागीय रेलवे प्रबंधक ररपोाड जमलने पर; जनयम 9 उप- जनयम के उप-जनयम (3) में उजल्लजखत परंह दिनों के भीतर िांच करेगा।
(2). प्रभागीय रेलवे प्रबंधक, ररपोाड प्राप्त होने पर; जनयम 9 के उप-जनयम (3) में उजल्लजखत पंरह दिनों के भीतर िांच करेगा । से मामले में, प्ररूप -1 और प्ररूप -2 िाजखल करने के जनयमों में उजल्लजखत काननूी समय अवजध का पालन नह दकया गया ह;ै तो प्रभागीय रेलवे प्रबंधक,संबंजधत प्राजधकाररयों से िेरी के जलए स्ट्पष्टीकरण मांगेगा।
(3). िब िांच दकए िान ेपर, प्रभागीय रेल प्रबंधक का यह समाधान हो िाता ह ैदक अन्द वेषण ण पूरा हो गया ह ै तब वह उत त ररपोाड स्ट् वीकार करते हुए आििे पाररत करेगा ।
(4). यदि प्रभागीय रेल प्रबंधक के पास यह जवश् वास करन ेका कारण ह ैदक मामले में कुछ और िांच अपेजित ह ैतो वह उसे और अन्द वेषण ण के जलए अपने सप्रेिणों सजहत बल के अजधकारी को अन्द वेषण ण के जलए इसे वापस जनर्िडष् ा करेगा ।
(5). उप-जनयम (3) के अधीन दकसी जनिेि के प्राप् त होने पर, बल का अजधकारी मामले का और अन्द वेषण ण करेगा तर्ा प्रभागीय रेल प्रबंधक को तत् काल ररपोाड प्रस्ट् ततु करेगा ।
11. आिेि की ससंचूना :- प्रभागीय रेल प्रबंधक द्वारा ररपोाड परपाररत अंजतम आिेि स्ट् ाेिन अधीिक को संसूजचत दकए िाएंगे िो अजभलेख रखेगा और स्ट् ाेिन डायरी में इस आिय की आवश् यक प्रजवजष् ायां करेगा ।
12. िावा कायाडलय को ररपोाड का भिेना:- (1) प्रभागीय रेल प्रबंधक की अन्द वेषण ण ररपोाड उस पर िोनल रेलवे के िावा कायाडलय के प्रिासजनक प्रभारी को पंरह दिन के भीतरभेिी िाएगी िहां सी अनपेजित नाना हुई ह।ै
(2) िोनल रेलवे के िावा कायाडलय के प्रिासजनक प्रभारी को उस जविेषण नाना के जलए िावे का नोरास प्राप्त हुआ ह;ै रेलवे के िावा कायाडलय से ररपोाड एकत्र करन ेकी व्यवस्ट्र्ा करेगा िहां पर नाना हुई ह;ै िुरू में होगी प्रस्ट्तुत अजधकारी (रेलवे िावा अजधकरण) और संबंजधत कानूनी िाखा और उनके प्रस्ट्तुत करने के आधार पर िांच की गई ह;ै और जनयम 10 के उप-जनयम (3) के अधीन यर्ा उपबंजधत प्रभागीय रेलवे प्रबंधक की जसफाररि के अनुसार और एक बोलने का आििे पाररत दकया है; तया िावा स्ट्वीकार होने या लड़ने के जलए और जलजखत कर्न के सार् रेलवे िावा अजधकरण की संबंजधत खंडपीि को प्रस्ट्ततु करना होगा। प्ररूप-1 (जनयम 4 िेजखए) अनपजेित नाना की ररपोाड

31. कोई अन्दय राप्पणी राप्पणी: तारीख ; हस्ट्तािर नाम और पिनाम [फा.सं. 2019 / ाीसी- III / 26/1] जववेक श्रीवास्ट्तव, कायडकारी जनिेिक (लोक जिकायत) [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 स्ट्पष्टीकारक ज्ञापन माननीय दिल्ली उच्च न्दयायालय के एफएओ 22 2015 में जवजनश्चय और सीएम आवेिन 4501 2015 तारीख 6 नवंबर 2019 गीता िेवी बनाम भारत संन के संिभड में 1 िनवरी 2020 से रेल यात्री (अनपेजित नाना के अन्दवेषण ण की रीजत) जनयम, 2020 का भूतलिी प्रभाव प्रिान करती ह ै। उक्त जनयम के भूतलिी प्रभाव प्रिान करने से दकसी व्यजक्त के जहत पर कोई प्रजतकूल प्रभाव नह पड़ेगा । MINISTRY OF RAILWAYS (RAILWAY BOARD) NOTIFICATION New Delhi the 3 rd , June 2020 G.S.R. 346(E).—In exercise of Powers conferred by Section 129 of the Railways Act,1989 (24 of 1989) and in supersession of the Railway Passengers (Manner of Investigation of Untoward Incidents) Rules, 2003 except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules, namely:-
1. Short title and commencement. – (1) These rules may be called Railway Passengers (Manner of Investigation of Untoward Incidents) Rules, 2020.
(2) They shall be deemed to have come into force on the 1 st day of January, 2020.
2. Definitions. – (1) In these rules, unless the context otherwise requires:-
(a) ‘Act’ means the Railways Act, 1989 (24 of 1989) ;
(b) ‘Claims Tribunal’ means Tribunal constituted under the Railway Claims Tribunal Act, 1987 (54 of 1987);
(c) ‘Diary’ means the station diary being maintained by the Station Superintendent for recording daily events happened at the station;
(d) ‘Divisional Office’ means the Divisional Headquarter of the Zonal Railway;
(e) ‘Divisional Railway Manager’ means the administrative in-charge of the divisional office or the Additional Divisional Railway Manager nominated by him ;
(f) ‘Divisional Security Commissioner’ means an officer, not below the rank of a Commandant, who is the head of the Force of a Division or a Railway Establishment at any other place connected with the Railways;
(g) ‘Force’ means the Railway Protection Force;
(h) ‘Form’ means the form appended to these rules;
(i) ‘Inquest Report’ means the report prepared by the Police containing details of incident;
(j) ‘Jama Talashi’ means the report about the recovery of any belongings of the person affected by the untoward incident;
(k) ‘Officer of the Force’ means the authorised officer as defined in clause (c) of section 2 of the Railway Property (Unlawful Possession) Act, 1966 (29 of 1966) and clause (26A) of section 2 of the Railways Act, 1989 (2 of 1989);
(l) ‘Police’ means a State Police;
(m) ‘Station Superintendent’ includes Deputy Station Superintendent Station Master and Assistant Station Master or other officer being in-charge of the station;
(n) ‘Untoward Incident’ means an incident defined under clause (c) of section 123 of the Act; and
(o) ‘Zonal Railway’ means a Zonal Railway constituted under section 3 of the Act.
(2) The words and expressions used herein and not defined but defined in the Act shall have the 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] meaning respectively assigned to them in the Act.
3. Report about untoward incident.- Any railway servant, including member of the Force, Guard and Driver of the train, on coming to know of the occurrence of an untoward incident, shall report the incident immediately to the nearest Stations Master/ Station Superintendent of Railways.
4. Duties of Station Superintendent, Guard, Conductor and Train Ticket Examiner in – charge of the train.- (1) If an untoward incident occurs at the station, the concerned Station Superintendent shall immediately arrange for medical assistance to the injured passengers and report such incident within twenty-four hours of the occurrence to the Divisional Security Commissioner in FORM –I.
(2) If an untoward incident occurs in the mid-section, the Guard of the concerned train shall inform the Station Superintendent of the nearest station who shall perform the duties referred to in sub-rule (1).
(3) In case the Guard is injured in an untoward incident, the Conductor of the concerned train shall inform the Station Superintendent of the nearest station who shall perform the duties referred to in sub-rule (1).
(4) In case both the Guard and the Conductor are injured in an untoward incident, the Train Ticket Examiner in-charge shall inform the Station Superintendent of the nearest station who shall perform the duties referred to in sub- rule (1).
(5) If an untoward incident occurs in mid-section, in the absence of officers mentioned in subrules (2), (3) and (4), the Station Superintendent, if it comes to his notice, shall perform the duties referred to in sub-rule (1).
5. Additional duties of Station Superintendent.-The Station Superintendent on receipt of an information about the occurrence of untoward incident under rule 3, shall, -
(i) Maintain a separate exclusive register for recording the untoward incidents
(a) Assign a unique identification number to each untoward incident and mention the untoward incident in the said register against this unique identification number.
(b) The untoward incident register should be closed at 23:59 hrs every day so that untoward incident happening thereafter can be added in the register against that day.
(ii) Make a brief report in respect of spot of the untoward incident and forward copies thereof to the Divisional Office, Zonal Railways, Police and Divisional Security Commissioner of the Force.
(iii) Submit a fortnightly status report of untoward incidents including compliance of rule 4 to Divisional Commercial Manager In-charge / Senior Divisional Commercial Manager.
6. Conducting of investigation and submission of report by the Force.- (1) On receipt of information under rule 5, an officer of the Force, shall carry out the investigation and shall-
(i) Obtain copies of the inquest report, post mortem report and Jama Talashi report from the Police investigating the incident;
(ii) Obtain a copy of the report specified under clause (ii) of rule 5;
(iii) Obtain information about the untoward incident in Form - 2;
(iv) Record statement of additional witnesses, if so required;
(v) Collect any other evidence required by the circumstances of the case;
(2) The officer of the Force shall complete the investigation within sixty days and submit a report to the authority specified under sub-rule (2) of rule 9.
7. Conducting of investigation and submission of report by the Police.- (1) The Police on receipt of information of an untoward incident from general public or any Railway servant including Station Superintendent, the Police shall immediately initiate investigation and prepare inquest report or injury report in accordance with the procedure laid down in Code of Criminal Procedure, 1973 (2 of 1974).
(2) The Police upon reaching the scene of the untoward incident shall inform the nearest/concerned [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 Station Superintendent personally or over telephone or through SMS or any effective electronic means of its presence at the scene of the incident. The Police shall immediately take photographs of the incident along with dead body/victim at the spot along with the tracks/witness(es)/bystanders.
(3) After preparation of report, as mentioned in sub-rules (1) and (2), the Police shall immediately give clearance certificate for movement of trains from the site of incident so that minimum delay is caused in restoration of train movement.
(4) The Police shall prepare the Detailed Accident Report (DAR) and submit a copy of the same to Divisional Security Commissioner/ Sr. DSC within 60 days from the date of untoward incident for onward submission to Divisional Railway Manager.
(5) In the event of the Police failing to take photographs as stated under sub-rule (2) of rule 7 above, the concerned DCP shall examine why the photographs were not taken and whether any action is warranted for the lapse.
8. The injured and the next of kin of the deceased passenger shall submit all the relevant evidence before the Police and assist the Police/Force to complete investigation.
9. Forwarding of investigation report by the police and the Force.- (1) The Police on completion of the investigation shall forward the report thereof to the Magistrate as required under the Code of Criminal Procedure, 1973 (2 of 1974).
(2) The officer of the Force shall forward the report prepared under sub-rule (2) of rule 6 to the Divisional Security Commissioner of Force.
(3) The Divisional Security Commissioner shall submit the report to Divisional Railway Manager within fifteen days of the receipt of report of investigation from officer of the Force.
(4) The Divisional Security Commissioner shall also ensure that a copy of Detailed Accident Report prepared by Police, in the format circulated by Ministry of Home Affairs (CS Division) vide their letter No. 24013/35/Misc./2017 CSR,.III dated 02.09.2019, is forwarded to the Divisional Railway Manager within 15 days of the receipt from the Police and after ascertaining the facts and verifying the genuineness of the facts of the case along with Form – 2.
10. Action on the Report by the Divisional Railway Manager. - (1) The Divisional Railway Manager, on receipt of the report, mentioned in sub-rule(3) of rule 9 shall examine the same within fifteen days.
(2) The Divisional Railway Manager, on receipt of the report, mentioned in sub-rule (3) of rule 9 shall examine the same within fifteen days. In case, the statutory time periods mentioned in the rules for filing of Form-1 and Form-2 have not been adhered to then Divisional Railway Manager shall call for explanation for delay from the concerned authorities.
(3) When, on examination, Divisional Railway Manager is satisfied that the investigation is complete, he shall pass an order accepting the said report.
(4) If the Divisional Railway Manager has reason to believe that some more inquiry is required in the matter, it shall refer the same back for investigation to the officer of the Force along with his observations for further investigation.
(5) On receipt of the reference under sub-rule 4, the officer of the Force shall investigate the matter further and submit the report immediately to the Divisional Railway Manager.
11. Communication of order.- Final orders passed on the report by the Divisional Railway Manager shall be communicated to the Station Superintendent who shall maintain the records and make necessary entries in the Station Diary to this effect.
12. Sending report to Claim Office.– (1) The investigation report along with acceptance of Divisional Railway Manager there on shall be sent within fifteen days to the administrative in-charge of the Claim office of the Zonal Railway where the incident has occurred.
(2) The administrative in-charge of Claim office of the Zonal Railway who has received the notice of the claim for that particular incident, shall arrange to collect the report from the Claim office of 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Railway where the incidence has occurred, shall initially have the claim examined by presenting officer (Railway Claims Tribunal) and associated legal branch and on the basis of their submission, and recommendation of Divisional Railway Manager as provided under sub-rule (3) of Rule 10 and pass a speaking order, whether the claim is to be admitted or contested and shall submit the same to the concerned Bench of the Railway Claims Tribunal along with the Written Statement.
