P a r t I I . S e c t i o n 3 , s u b - s e c t i o n ( i ) , d a t e d t h e 6th J u l y , 1998, u n d e r t h e n o t i f i c a t i o n o f t h e G o v e r n m e n t o f I n d i a in t h e Ministry of A g r i c u l t u r e , D e p a r t m e n t o f A g r i c u l t u r e a n d Cooperation , N o . G . S . R . 3 7 9 ( E ) . d a t e d t h e 6 t h J u l y , 1 9 9 8 , f o r i n v i t i n g o b j e c t i o n s a n d s u g g e s t i o n s f r o m a l l p e r s o n s l i k e l y t o b e affected t h e r e b y b e f o r e t h e e x p i r y o f f o r t y - f i v e d a y s f r o m t h e date o n w h i c h t h e copies of t h e s a i d n o t i f i c a t i o n , a s p u b l i s h e d i n t h e Gazette o f India, w e r e m a d e a v a i l a b l e t o t h e p u b l i c ; And whereas copies of the said Gazette were made available t o t h e p u b l i c o n t h e 1 7 t h J u l y , 1 9 9 8 ; 17 And Whereas objections and suggestions received from public on the said draft have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by Section 36 of the Insecticides Act, 1968 (46 of 1968), the Central Government, after consultation with the Central Insecticides Board hereby makes the following rules, further to amend the Insecticides Rules, 1971, namely:- RULES

1. Short title and commencement -

(1) These rules may be called the Insecticides (Amendment) Rules, 1999.

(2) They shall come into force on the date of their publication in the official Gazette,

In the Insecticides Rules, 1971 (hereinafter referred to as the said rules), in rule 2, after clause ( q ) t h e following clauses shall be inserted , namely:- "(r) 'commercial Pest Control Operation' means any application or dispersion of Insecticide(s) including fumigants in household or public or private premises or land and includes pest control operations in the field including aerial applications for commercial purposes but excludes private use;

(s) 'Pest Control Operators' means any person who undertakes pest control operations and includes the person or the firm or the company or the organisation under whose control such a person(s) is operating."

3. In rule 6 of the said rules - (a) for sub-rule (2), the following sub-rule shall be substituted, namely:-

(2) An application form duly filled together with a bank draft, drawn in favour of the Accounts Officer, Directorate of Plant Protection. Quarantine & Storage, payable at Faridabad towards registration fee shall be sent to the Secretary, Registration Committee, Directorate of Plant Protection, Quarantine & Storage, NH-IV, Faridabad -121001, Haryana. The fee shall be payable as follows :-

(i) rupees five thousand each in case of application for registration under Section 9(3) and 9(3B) of the Insecticides Act, 1968;

(ii) rupees two thousand five hundred in case of application for registration under Section 9(4) of the Insecticides Act, 1968";

(b) for sub-rule 6(A) the following sub-rule shall be substituted namely:- " ( 6 ) ( A) Issue of duplicate Certificate of Registration - A fee of rupees one hundred shall be paid in the form of demand 1518 GI/99-3 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] draft drawn on the state Bank of India, Faridabad in favour of the Accounts Officer, Directorate of Plant P r o t e c t i o n , Quarantine & Storage Faridabad, Haryana for a duplicate copy of a Certificate of Registration if the original is defaced, damaged or lost ";

(c) after sub-rule 6(A)} so amended the following rule shall be inserted, namely :- " (6) (B) Addition, deletion or alteration on the Certificate of Registration including labels and leaflets - A Fee of rupees one hundred shall be paid in the form of demand draft drawn on the State Bank of India, Faridabad, in favour of the Accounts O f f i c e r , Directorate of Plant Protection, Quarantine and Storage, Faridabad, Haryana on each occasion for each Certificate of Registration for addition, deletion, alteration on the Certificate of Registration including labels and leaflets."

4. In rule 7 of the said rules-(a) for sub-rule (3) , the following sub-rule shall be substituted, n a m e l y : - "(3) Every appeal shall be accompanied by a demand draft of rupees one thousand towards fee and a copy of the decision appealed against."

(b) for sub-rule (4), the following sub-rule shall be substituted, namely:- "(4) The fee payable for preferring an appeal shall be paid by a demand draft drawn on the State Bank of India, N e w Delhi in favour of the Pay and Accounts O f f i c e r , Department of Agriculture & Cooperation. New D e l h i . "

5. In rule 9 of the said rules:-

(a) for sub-rule (1) , the following sub-rule shall be substituted, namely:- "(1) -Application for the grant or renewal of a licence to manufacture any insecticide shall be made in Form III or Form IV, as the case may be, to the licensing officer and shall be accompanied by a fee of rupees two thousand for every insecticide, and a maximum of rupees twenty thousand for all Insecticides for which the licence is applied."

(b) for sub-rule (5) the following sub-rule shall be substituted, namely:- "(5) A fee of rupees one hundred shall be paid for a duplicate copy of a licence issued under this rule, if the original is defaced, damaged, or lost."

6 . In rule 10 of the said rules -

(a) for sub-rule' ( 2 ) , the following sub-rule shall be substituted , namely:- " ( 2 ) - The fee payable under sub-rule (1) for grant or renewal of a licence shall be rupees five hundred for every insecticide for which the licence is applied. There shall be a separate fee for each place, if any insecticide is sold, stocked or exhibited for sale at more than one place. Provided that the 19 maximum fee payable in respect of insecticides commonly used for household purposes and registered as such shall be rupees seven thousand five hundred for every place,

Provided further that, if the place of sale is established in the rural areas, the fee shall be one fifth of the fee specified in this rule."

(b) alter sub-rule (3) , the following sub-rule 3(A) shall be inserted, namely:- "3A. Pest control operators -

(1) Any person who desires to undertake pest control operations, with the use of Aluminium Phosphide, Methyl bromide. Ethylene dibromide or as notified shall apply for a licence in Form VI-A with a fee of rupees one thousand tor each place of operation. The licence granted for such operations shall be valid for a period of five years provided that the licence shall be renewed alter verification or inspection at the expiry of this period on application in Form Vl-B for a further period of five years with an application fee of rupees one thousand.

(ii) A licence to stock and use insecticides for pest control operators will be issued in Form Vl-C.

(iii) Any person who applies for grant of licence for undertaking pest Control operations should be at least a graduate in Agriculture or in Science with Chemistry as a subject with a certificate of minimum 15 days training from any of the following Institutions - Central Food Technological Research Institute. Mysore; Indian Grain storage Institute, Hapur and National Plant Protection Training Institute Hyderabad.

(iv) For undertaking fumigation, the pest control operators shall have to obtain special permission from the Plant Protection Adviser to the Government of India in addition to obtaining licence. The Plant Protection Adviser will grant such permission as per procedure or guidelines approved by the Registration Committee.

(v) The commercial pest control operators shall adhere to the prescribed guidelines or procedures as laid down by the Plant Protection Adviser to the Government of India in regard to the fumigation operations undertaken by them."

(c) for sub-rule (6) , the following sub-rule shall be substituted namely:- "(6 ) A fee of rupees one hundred shall be payable for a duplicate copy of a licence issued under this rule if the original is defaced, damaged or lost."

7. In rule 11 of the said rules.

(1) for sub-clause (b) (i) and (b) (ii) the following sub-clauses shall be substituted, namely:- 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.3(i)] 'b(i) rupees five hundred for the first month or part thereof, rupees one thousand for the second month or part thereof and rupees one thousand and five hundred for the third month or part thereof, in case of licence to manufacture insecticides or to carry pest control operations;

(ii) rupees one hundred for the first month or part thereof, rupees two hundred for the second month or part thereof and rupees three hundred for the third month or part thereof, in case of any other licence shall be paid alongwith the application for renewal;

Provided that where the main pest control operation unit or the place of sale is located in the rural areas, the late fee shall be one-fifth of the said late fee;

Provided further that in case of death or disability of the licensee, the Licensing Officer may after recording reasons in writing, exempt the applicant from payment of the late fee."

(2) for clause (c), the following clause shall be substituted, namely:- "(c) The licence shall continue to be in force until it is renewed or revoked. Where an appeal is preferred under Section 15, the licence shall continue to be revoked until disposal of appeal or as ordered by the appellate authority pending disposal of the appeal."

8. In rule 14 of the said rules, for sub-rule (2), the following sub-rule shall be substituted, namely:- "2 . The application under sub-rule (1) shall be accompanied by a fee of rupees one hundred."

9. In the First Schedule to the said rules, after Form VI, the following forms shall be inserted, namely;- "FORM VI - A [See Rule 10(3A)] Application for the grant of licence to stock and use restricted insecticide(s) for commercial pest control operation(s) . 6. Quantity(s) of each restricted insecticide in possession on the date of application (Give details of plaee(s) where it is stored).

7. Details of persons engaged or proposed to be engaged (Attach separate sheet, duly authenticated)

8. Details of safety applications available alongwith antidotes and all other facilities required under chapter will be stored for use.

9. Situations of the branch offices and depots where the restricted insecticide(s) will be stored for use.

10. Name (s) of restricted insecticide(s) which the applicant desires to use.

11. Category(s) applied for,

13. Whether technical expertise approved by the Plant Protection Adviser to the Government of India for undertaking Pest control operations (Attach Proof),

Secy. 28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 29 30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 31 NOTIFICATION New Delhi, the 20th May, 1999 G.S.R. 372(E).— Whereas the draft rules further to amend the Insecticides R u l e s . 1971 were published, as required under Section 3b of the Insecticides A c t , 1968 (46 of 1 9 6 8 ) , in the Gazette of India ,Part II. Section 3, Sub-section ( i ) , dated the 25th August. 1988, under the notification of the Government of India in the Ministry of Agriculture, Department of Agriculture and C o o p e r a t i o n , No. G.S.R. 5 2 1 ( E ) , dated the 25th August, 1998 for inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of forty-five days from the date on which the Copies of the said notification as piblished in the Gazette of India, were made available to the public; And whereas copies of the said Gazette were made available to the public on the 11th Sept., 1998. And Whereas no objection and suggestion was received on the said draft . Now, therefore in exercise of the powers conferred by section 36 of the Insecticides. Act. 1968 (46 of 1 9 6 8 ) , the Central Government, after consultation with the Central Insecticides Board hereby makes the following rules, further to amend the Insecticides Rules, 1971, namely:-

1. Short title and commencement -

(1) These rules may be called the Insecticides (Second) (Amendment) Rules, 1999.

(2) They shall come into force on the date of their publication in the official Gazette.

2. In the Insecticides R u l e s , 1971 (hereinafter referred to as the said r u l e s ) , in rule 9, both in sub-rule 3 and in Form V, after clause (v) and condition number 5, respectively the following shall be inserted in sequence, namely.- 32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] " T h e L i c e n s e e s h a l l o b t a i n ISI M a r k C e r t i f i c a t e f r o m B u r e a u o f I n d i a n S t a n d a r d w i t h i n t h r e e m o n t h s o f t h e c o m m e n c e m e n t of the m a n u f a c t u r e . N o I n s e c t i c i d e s s h a l l b e s o l d o r d i s t r i b u t e d w i t h o u t I S I M a r k C e r t i f i c a t i o n . " a s ( v i ) a d d ( v i i ) a d d ( 6 ) a d d ( 7 ) r e s p e c t i v e l y .

3. In t h e s a i d r u l e s , i n r u l e 1 0 .

" 4 . In t h e s a i d r u l e d , in r u l e 1 0 A , f o r s u b - r u l e ( b ) , t h e f o l l o w i n g s u b - r u l e s h a l l b e s u b s t i t u t e d , n a m e l y : - " ( b ) A l l s u c h s t o c k s t h e n s h a l l b e d i s p o s e d o f in a n e n v i r o n m e n t f r i e n d l y m a n n e r a s m a y b e s p e c i f i e d f r o m t i m e to t i m e b y t h e C e n t r a l G o v e r n m e n t in c o n s u l t a t i o n w i t h t h e C e n t r a l I n s e c t i c i d e s B o a r d a n d s h a l l n o t b e u s e d f o r r e m a n u f a c t u r e , "

5. In t h e s a i d r u l e s , in r u l e 3 5 . f o r t h e e x i s t i n g h e a d i n g , t h e f o l l o w i n g h e a d i n g s h a l l b e s u b s t i t u t e d , n a m e IV:- " M a n n e r of P a c k i n g . S t o r a g e w h i l e t r a n s p o r t i n g . "

6. We authorise them to sell, stock or exhibit for sale or distribution of the following insecticides in Wholesale/Retail in _____________________Taluka/District/State. Sl.
