PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 3084] ubZ fnYyh] cq/okj] fnlEcj 28] 2016@ikS"k 7] 1938 No. 3084] NEW DELHI, WEDNESDAY, DECEMBER 28, 2016/PAUSA 7, 1938 कृिष और ᳰकसान क᭨ याण मंᮢ ालय (कृिष, सहकाᳯरता और ᳰकसान क᭨ याण िवभाग) अिधसचूना नई ᳰद᭨ली, 15 ᳰदस᭥ बर, 2016 का. आ. 4212(अ).— कृिष, सहकाᳯरता और ᳰकसान क᭨ याण् िवभाग ने डॉ अनुपम वमाᭅ, (भूतपूवᭅ रा᭬ ᮝीय ᮧाचायᭅ), भारतीय कृिष अनुसंधान सं᭭ थान, नई ᳰद᭨ ली कᳱ अ᭟ यᭃता मᱶ भारत मᱶ रिज᭭ ᮝीकृत नीयो-िनकोटीनोईड कᳱटनािशयᲂ के उपयोग के पुनरावलोकन के िलए 8 जुलाई, 2013 को एक िवशेष᭄ सिमित गᳯठत कᳱ थी। सिमित के तारीख 19 अग᭭ त, 2013 के आदेश का 66 कᳱटनािशयᲂ जो अ᭠ य दशेᲂ मᱶ ᮧितबंिधत और िनबᲈिधत ह ैलेᳰकन भारत मᱶ घरेलू उपयोग के िलए रिज᭭ ᮝीकृत ᳰकया जाना जारी ह,ै का पुनरावलोकन करने के िलए और आगे िव᭭ तार ᳰकया गया था। िवशेष᭄ सिमित ने इस िवभाग को ᳯरपोटᭅ ᮧ᭭ तुत कᳱ है;
और, रिज᭭ ᮝीकरण सिमित ने उसकᳱ 361 वᱭ िवशेष बैठक मᱶ ᳯरपोटᭅ पर िवचार ᳰकया था और इस िवभाग को अपने कायᭅवृत मᱶ अपना संᮧेᭃण ᮧ᭭ तुत ᳰकया था;
और, कᱶ ᮤीय सरकार, उ त िवशेष᭄ सिमित कᳱ िसफाᳯरशᲂ पर िवचार करने के प᭫ चात् और रिज᭭ ᮝीकरण सिमित के साथ परामशᭅ के प᭫ चात् संतु᭬ ट ह ैᳰक इस अिधसूचना के उपाबध मᱶ यथा िविन᳸द᭬ ट 18 कᳱटनािशयᲂ के उपयोग से मानव और पशुᲐ को जोिखम संभा᭪ य ह ैइस कारण से तुरंत कायᭅवाही करना समीचीन और आव᭫ यक है;
अत: अब, ᮧाᱧप आदशे, िजसे कᱶ ᮤीय सरकार, कᳱटनाशी अिधिनयम, 1968 (िजसे इसमᱶ इसके प᭫ चात् उ त अिधिनयम कहा गया ह)ै कᳱ धारा 27 कᳱ उप-धारा 2 के साथ पᳯठत धारा 28 और धारा 36 कᳱ उप-धारा (1) ᳇ारा ᮧद᭜ त शि तयᲂ का ᮧयोग करते ᱟए बनान े का ᮧ᭭ताव करती है उन सभी संभा᳞ ᮧभािवत ᳞िᲦयᲂ कᳱ जानकारी के िलए ᮧकािशत ᳰकया जाता है और नोᳯटस ᳰदया जाता है ᳰक उᲦ ᮧाᱧप आदशे पर उस तारीख से जब इस आदेश कᳱ राजपᮢ कᳱ ᮧितयां आम जनता को उपल᭣ ध कराई जाती ह,ै से पᱹतािलस ᳰदन कᳱ अविध कᳱ समाि᳙ के प᳟ात् िवचार ᳰकया जाएगा;
उᲦ ᮧाᱧप आदशे के संबंध मᱶ ᳰकसी ᳞िᲦ से इस ᮧकार उपरो त पᱹतािलस ᳰदवस कᳱ अविध कᳱ समाि᳙ से पूवᭅ ᮧा᳙ आᭃेपᲂ और सुझावᲂ पर कᱶ ᮤीय सरकार ᳇ारा िवचार ᳰकया जाएगा । 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] उᲦ ᮧाᱧप आदेश के संबंध मᱶ आᭃेप या सुझाव, यᳰद कोई हो, तो संयु त सिचव (पादप संरᭃण), कृिष और ᳰकसान क᭨ याण् मंᮢालय, कृिष, सहकाᳯरता और ᳰकसान क᭨ याण् िवभाग, कृिष भवन, नई ᳰद᭨ली - 110001 को भेजे जा सकᱶ गे;
ᮧाᱨप आदशे
1.(i) इस आदेश का नाम कᳱटनािशयो पर ᮧितबंध लगाने के िलए आदशे, 2016 ह।ै
(ii) ये राजपᮢ मे उनके अंितम ᮧकाशन कᳱ तारीख को ᮧवृत होगᱶ।
2. कोई ᭪ यि त इस आदेश मᱶ यथा िविन᳸द᭬ ट कᳱटनािशयᲂ का उसमᱶ यथा िविन᳸द᭬ ट तारीख से िविनमाᭅण, आयात, बनाना, पᳯरवहन, िवᮓय, उपयोग नहᱭ करेगा।
3. रिज᭭ ᮝीकरण सिमित उ त उपाब मᱶ यथा िविन᳸द᭬ ट कᳱटनािशयᲂ के िलए ᮧदान ᳰकए गए रिज᭭ ᮝेशन ᮧमाण-पᮢ को वापस ले सकेगी।
4. यᳰद कोई ᭪ यि त जो रिज᭭ ᮝेशन ᮧमाण-पᮢ धारण करता ह ैतीन मास कᳱ अविध के भीतर, खंड (3) मᱶ िन᳸द᭬ ट रिज᭭ ᮝीकरण ᮧमाण- पᮢ वापस करने मᱶ असफल रहता ह,ै उ त आदशे मᱶ अंतᳶव᭬ ट उपबंधᲂ के अधीन कारᭅवाई कᳱ जाएगी।
5. उ त अिधिनयम कᳱ धारा 9 के अधीन ᮧद᭜ त उपाब पर यथा िविन᳸द᭬ ट कᳱटनािशयᲂ के िलए ᮧमाण-पᮢ उस आदेश के उपाब मᱶ यथा िविन᳸द᭬ ट तारीख से र ᳰकया गया समझा जाएगा।
6. ᮧ᭜ येक रा᭔ य सरकार उ त अिधिनयम और इसके अधीन बनाये गए िनयमᲂ के उपबंधᲂ के अधीन ऐसे सभी कदम उठायेगी जो वह रा᭔ यᲂ मᱶ इस आदशे के िन᭬ पादन के िलए आव᭫ यक समझे। अनबुधं ᮓ.स. कᳱटनाशी (कᳱटनािशयᲂ) का नाम आरसी का िविन᭫ चय कᱶ ᮤीय सरकार का िविन᭫ चय

1. बेनोमाइल (i) अब से रिज᭭ ᮝीकरण, आयात और िविनमाᭅण ᮧितिषि ᳰकया जाता ह ै और उसका उपयोग 1 जनवरी, 2018 से पूणᭅत: ᮧितबंिधत होगा।
(ii) लेबल और पᮢक पर एक चेतावनी कथन समािव᭬ ट होगा ᳰक बेनोमाइल जलीय जीव के िलए िवषैला ह ैइसिलए जल िनकायᲂ, जलीय कृिष, मछली कᳱ खेती के पास इसका उपयोग नहᱭ ᳰकया जाना चािहए।
(iii) उ᭜ पाद टैराटोजेिनक और फोइटोटोि सक है इसिलए लेबल और पᮢक पर एक िन᭥ निलिखत चेतावनी कथन समािव᭬ ट ᳰकया जाना चािहए “यह फाइटोटोि सक और टैराटोजेिनक ह ै इसिलए गभᭅवती मिहलाएं उ᭜ पाद के संपकᭅ से दरू रहे।” ᭭ वीकृत
2. काबᭅराइल (i) अब से रिज᭭ ᮝीकरण, आयात और िविनमाᭅण ᮧितिषि ᳰकया जाता ह ै और उसका उपयोग 1 जनवरी, 2018 से पूणᭅत: ᮧितबंिधत होगा।
(ii) लेबल और पᮢक पर एक चेतावनी कथन समािव᭬ ट होगा ᳰक काबᭅराइल जलीय जीव के िलए िवषैला ह ैइसिलए जल िनकायᲂ, जलीय कृिष, मछली कᳱ खेती के पास इसका उपयोग नहᱭ ᳰकया जाना चािहए।
(iii) उ᭜ पाद मधुमि खयᲂ के िलए अ᭜ यिधक िवषैला ह ै इसिलए लेबल और पᮢक पर एक चेतावनी कथन समािव᭬ ट ᳰकया जाना चािहए ᳰक सᳰᮓय मधुम खी फोरेᳲजग अविध के दौरान िछड़काव करने से दरू रहना चािहए। ᭭ वीकृत
3. डायिजनोन अब से रिज᭭ ᮝीकरण, आयात और िविनमाᭅण ᮧितिषि ᳰकया जाता ह ैऔर उसका उपयोग 1 जनवरी, 2018 से पूणᭅत: ᮧितबंिधत होगा। ᭭ वीकृत

(ii) यह जलीय जीव के िलए िवषैला ह ै इसिलए लेबल और पᮢक पर एक चेतावनी कथन समािव᭬ ट होगा ᳰक जल िनकायᲂ, जलीय कृिष, मछली कᳱ खेती के पास इसका उपयोग नहᱭ ᳰकया जाना चािहए।
5. फᱶ िथओन (i) अब से रिज᭭ ᮝीकरण, आयात और िविनमाᭅण ᮧितिषि ᳰकया जाता ह ै और उसका उपयोग 1 जनवरी, 2018 से पूणᭅत: ᮧितबंिधत होगा।

6. िलनुरोन (i) अब से रिज᭭ ᮝीकरण, आयात और िविनमाᭅण ᮧितिषि ᳰकया जाता ह ै और उसका उपयोग 1 जनवरी, 2018 से पूणᭅत: ᮧितबंिधत होगा। ᭭ वीकृत
7. मेथो सी ईथाइल मरकरी लोराइड (एमईएमसी)
(i) अब से रिज᭭ ᮝीकरण, आयात और िविनमाᭅण ᮧितिषि ᳰकया जाता ह ै और उसका उपयोग 1 जनवरी, 2018 से पूणᭅत: ᮧितबंिधत होगा। ᭭ वीकृत
8. िमथाईल पैरािथओन (i) अब से रिज᭭ ᮝीकरण, आयात और िविनमाᭅण ᮧितिषि ᳰकया जाता ह ै और उसका उपयोग 1 जनवरी, 2018 से पूणᭅत: ᮧितबंिधत होगा।
(ii) लेबल और पᮢक पर एक चेतावनी कथन समािव᭬ ट होगा ᳰक यह जलीय जीव के िलए िवषैला ह ैइसिलए जल िनकायᲂ, जलीय कृिष, मछली कᳱ खेती के पास इसका उपयोग नहᱭ ᳰकया जाना चािहए।
(iii) लेबल/पᮢक पर एक चेतावनी कथन समािव᭬ ट होगा ᳰक यह उ᭜ पाद िचिड़यᲂ के िलए िवषैला है
(iv) लेबल और पᮢक पर एक चेतावनी कथन समािव᭬ ट ᳰकया जा सकेगा ᳰक उ᭜ पाद मधुमि खयᲂ के िलए िवषैला है इसिलए सᳰᮓय मधुम खी फोरेᳲजग अविध के दौरान िछड़काव नहᱭ करे। ᭭ वीकृत
9. सोिडयम सायनाईड (i) अब से रिज᭭ ᮝीकरण, आयात और िविनमाᭅण ᮧितिषि ᳰकया जाता ह ै और उसका उपयोग 1 जनवरी, 2018 से पूणᭅत: ᮧितबंिधत होगा।
(ii) लेबल और पᮢक पर एक चेतावनी कथन समािव᭬ ट होगा ᳰक यह जलीय जीव के िलए िवषैला ह ैइसिलए जल िनकायᲂ, जलीय कृिष, मछली कᳱ खेती के पास इसका उपयोग नहᱭ ᳰकया जाना चािहए।

12. ᮝाई᭢लूरेिलन (i) अब से रिज᭭ ᮝीकरण, आयात और िविनमाᭅण ᮧितिषि ᳰकया जाता ह ै और उसका उपयोग 1 जनवरी, 2018 से पूणᭅत: ᮧितबंिधत होगा।

13. अला लोर (i) ᳰदसंबर, 2017 के प᭫ चात िविनमाᭅता को नया रिज᭭ ᮝीकरण ᮧमाणपᮢ जारी नहᱭ ᳰकया जाएगा।
(ii) कोई ᭪ यि त 1 जनवरी, 2019 से अला लोर का आयात, िविनमाᭅण या बनाना नहᱭ करेगा।
(iii) अला लोर का उपयोग 31 ᳰदसंबर, 2020 से पूणᭅत: ᮧितबंिधत होगा।
(iv) यह जलीय जीव के िलए िवषैला है इसिलए लेबल और पᮢक पर एक चेतावनी कथन समािव᭬ ट होगा ᳰक “यह जलीय जीव के िलए िवषैला ह ै इसिलए जल िनकायᲂ, जलीय कृिष, मछली कᳱ खेती के पास इसका उपयोग नहᱭ ᳰकया जाना चािहए”। ᭭ वीकृत
14. डाई लोरोवस (i) ᳰदसंबर, 2017 के प᭫ चात िविनमाᭅता को नया रिज᭭ ᮝीकरण ᮧमाणपᮢ जारी नहᱭ ᳰकया जाएगा।
(ii) कोई ᭪ यि त 1 जनवरी, 2019 से डाई लोरोवस का आयात, िविनमाᭅण या बनाना नहᱭ करेगा।
(iii) डाई लोरोवस का उपयोग 31 ᳰदसंबर, 2020 से पूणᭅत: ᮧितबंिधत होगा।
(iv) यह जलीय जीव के िलए िवषैला है इसिलए लेबल और पᮢक पर एक चेतावनी कथन समािव᭬ ट होगा ᳰक यह जलीय जीव के िलए िवषैला ह ै इसिलए जल िनकायᲂ, जलीय कृिष, मछली कᳱ खेती के पास इसका उपयोग नहᱭ ᳰकया जाना चािहए।
(v) लेबल और पᮢक पर एक चेतावनी कथन समािव᭬ ट ᳰकया जा सकेगा ᳰक उ᭜ पाद मधुमि खयᲂ के िलए िवषैला है इसिलए सᳰᮓय मधुम खी फोरेᳲजग अविध के दौरान िछड़काव नहᱭ करे। ᭭ वीकृत
15. फोरेट (i) ᳰदसंबर, 2017 के प᭫ चात िविनमाᭅता को नया रिज᭭ ᮝीकरण ᮧमाणपᮢ जारी नहᱭ ᳰकया जाएगा।
(ii) कोई ᭪ यि त 1 जनवरी, 2019 से फोरेट का आयात, िविनमाᭅण या बनाना नहᱭ करेगा।
(iii) फोरेट का उपयोग 31 ᳰदसंबर, 2020 से पूणᭅत: ᮧितबंिधत होगा।
(iv) यह जलीय जीव के िलए िवषैला है इसिलए लेबल और पᮢक पर एक चेतावनी कथन समािव᭬ ट होगा ᳰक यह जलीय जीव के िलए िवषैला ह ै इसिलए जल िनकायᲂ, जलीय कृिष, मछली कᳱ खेती के पास इसका उपयोग नहᱭ ᳰकया जाना चािहए।
(v) लेबल और पᮢक पर एक चेतावनी कथन समािव᭬ ट ᳰकया जा सकेगा ᳰक उ᭜ पाद मधुमि खयᲂ के िलए िवषैला है इसिलए सᳰᮓय मधुम खी फोरेᳲजग अविध के दौरान िछड़काव नहᱭ करे।
(vi) लेबल/पᮢक पर एक चेतावनी कथन समािव᭬ ट होगा ᳰक यह उ᭜ पाद िचिड़यᲂ के िलए िवषैला है। ᭭ वीकृत
16. फो᭭ फािमडोन (i) ᳰदसंबर, 2017 के प᭫ चात िविनमाᭅता को नया रिज᭭ ᮝीकरण ᮧमाणपᮢ जारी नहᱭ ᳰकया जाएगा।
(ii) कोई ᭪ यि त 1 जनवरी, 2019 से फो᭭ फािमडोन का आयात, िविनमाᭅण या बनाना नहᱭ करेगा।
(iii) फो᭭ फािमडोन का उपयोग 31 ᳰदसंबर, 2020 से पूणᭅत: ᮧितबंिधत होगा।
(iv) यह जलीय जीव के िलए िवषैला है इसिलए लेबल और पᮢक पर एक चेतावनी कथन समािव᭬ ट होगा ᳰक यह जलीय जीव के िलए िवषैला ह ै ᭭ वीकृत ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 इसिलए जल िनकायᲂ, जलीय कृिष, मछली कᳱ खेती के पास इसका उपयोग नहᱭ ᳰकया जाना चािहए।
(v) लेबल और पᮢक पर एक चेतावनी कथन समािव᭬ ट ᳰकया जा सकेगा ᳰक उ᭜ पाद मधुमि खयᲂ के िलए िवषैला है इसिलए सᳰᮓय मधुम खी फोरेᳲजग अविध के दौरान िछड़काव नहᱭ करे।
(vi) लेबल/पᮢक पर एक चेतावनी कथन समािव᭬ ट होगा ᳰक यह उ᭜ पाद िचिड़यᲂ के िलए िवषैला है।
17. ᮝायाजोफोस (i) ᳰदसंबर, 2017 के प᭫ चात िविनमाᭅता को नया रिज᭭ ᮝीकरण ᮧमाणपᮢ जारी नहᱭ ᳰकया जाएगा।
(ii) कोई ᭪ यि त 1 जनवरी, 2019 से ᮝायाजोफोस का आयात, िविनमाᭅण या बनाना नहᱭ करेगा।
(iii) ᮝायाजोफोस का उपयोग 31 ᳰदसंबर, 2020 से पूणᭅत: ᮧितबंिधत होगा।
(iv) यह जलीय जीव के िलए िवषैला है इसिलए लेबल और पᮢक पर एक चेतावनी कथन समािव᭬ ट होगा ᳰक यह जलीय जीव के िलए िवषैला ह ै इसिलए जल िनकायᲂ, जलीय कृिष, मछली कᳱ खेती के पास इसका उपयोग नहᱭ ᳰकया जाना चािहए।
(v) लेबल और पᮢक पर एक चेतावनी कथन समािव᭬ ट ᳰकया जा सकेगा ᳰक उ᭜ पाद मधुमि खयᲂ के िलए िवषैला है इसिलए सᳰᮓय मधुम खी फोरेᳲजग अविध के दौरान िछड़काव नहᱭ करे।
(vi) लेबल/पᮢक पर एक चेतावनी कथन समािव᭬ ट होगा ᳰक यह उ᭜ पाद िचिड़यᲂ के िलए िवषैला है। ᭭ वीकृत
18. ᮝाई लोरोफोनᭅ (i) ᳰदसंबर, 2017 के प᭫ चात िविनमाᭅता को नया रिज᭭ ᮝीकरण ᮧमाणपᮢ जारी नहᱭ ᳰकया जाएगा।
(ii) कोई ᭪ यि त 1 जनवरी, 2019 से ᮝाई लोरोफोनᭅ का आयात, िविनमाᭅण या बनाना नहᱭ करेगा।
(iii) ᮝाई लोरोफोनᭅ का उपयोग 31 ᳰदसंबर, 2020 से पूणᭅत: ᮧितबंिधत होगा।
(iv) यह जलीय जीव के िलए िवषैला है इसिलए लेबल और पᮢक पर एक चेतावनी कथन समािव᭬ ट होगा ᳰक यह जलीय जीव के िलए िवषैला ह ै इसिलए जल िनकायᲂ, जलीय कृिष, मछली कᳱ खेती के पास इसका उपयोग नहᱭ ᳰकया जाना चािहए।
(v) लेबल/पᮢक पर एक चेतावनी कथन समािव᭬ ट होगा ᳰक यह उ᭜ पाद िचिड़यᲂ के िलए िवषैला है। ᭭ वीकृत [फा.सं. 13035/31/2013-पीपी-1] अ᭫ वनी कुमार, संयु त सिचव MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture, Co-operation and Farmers Welfare) NOTIFICATION New Delhi, the 15th December, 2016 S.O.4212(E).— Whereas the Department of Agriculture, Cooperation and Farmers Welfare constituted an Expert Committee on 8th July, 2013 under the chairmanship of Dr. Anupam Varma, (Former National Professor), Indian Agricultural Research Institute, New Delhi to review the use of neo-nicotinoid pesticides registered in India. The mandate of the Committee on 19th August, 2013 was further expanded to review 66 pesticides which are banned or restricted in other countries but continue to be registered for domestic use in India. The Expert Committee has submitted the report to this Department;

And whereas, the Central Government, after considering the recommendations of the said Expert Committee and after consultation with the Registration Committee satisfied that the use of 18 pesticides as specified in the Annexure to this Notification are likely to involve risk to human being and animals as to render it expedient or necessary to take immediate action;
Now therefore, the Draft Order, which the Central Government proposes to make, in exercise of the powers conferred by sub-section 2 of Section 27 read with section 28 and sub-section (1) of section 36 of the Insecticides Act, 1968 (hereinafter referred to as the said Act), is hereby published for information of all persons likely to be affected thereby and notice is hereby given that the said draft order shall be taken into consideration after the expiry of a period of forty five days from the date on which the copies of the Gazette of India containing this Order are make available to the public;
Any objection or suggestion which may be received from any person in respect of the said draft Order before the expiry of the aforesaid period of forty-five days will be considered by the Central Government.
Any objection or suggestion in respect to the said draft Order may be forwarded to the Joint Secretary (Plant Protection), Ministry of Agriculture and Farmers Welfare, Department of Agriculture, Co-operation and Farmers Welfare, Krishi Bhawan, New Delhi-110 001.
DRAFT ORDER
1. (i) This Order may be called the Banning of Pesticides Order, 2016
(ii) It shall come into force on the date of its final publication in the Official Gazette.
2. No person shall manufacture, import, formulate, transport, sell, use pesticides as specified in the Annexure to this Order from the date as specified therein.
3. The Registration Committee shall call back the certificate of registration granted for the pesticides as specified in the said Annexure.
4. If any person who holds the certificate of registration fails to return the certificate to the Registration Committee, referred to in clause (3) , within a period of three months, action shall be taken under the provisions contained in the said Act.
5. The Certificate of registration for the pesticides as specified at Annexure granted under section 9 of the said Act shall be deemed to be cancelled from the date as specified in the Annexure to this order.
6. Every State Government shall take all such steps under the provisions of the said Act and the rules framed thereunder, as it considers necessary for the execution of this order in the state.

(ii) No person shall import, manufacture or formulate Trichlorfon w.e.f. 1st January, 2019.
(iii) The use Trichlorfon shall be completely banned w.e.f.
31st December, 2020.
(iv) ) It is very toxic to aquatic organism, hence a cautionary statement should be incorporated on label and leaflets that it is toxic to aquatic organism, hence should not be used near water bodies, aquaculture or pisciculture area.
(v) A cautionary statement should incorporate in label/ leaflet that this product is toxic to birds.
