1. (1) These rules may be caled the _Envlmnment (Protection) Amendment Rules, 2003.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Envimnrfient(Protection) Rules, 1986, in Schedule |,-
(a) in serial number 94 relating to NOISE LIMIT FOR GENERATOR SETS RUN WITH DIESEL, -
(i) in paragraph 1, for the words, letters and figures "the 1® July, 2003", at both the places, the words, letters and figures " the 1% July, 2004" shall respectively be substituted;
(i) in paragraphs 3, 3.1 and 3.2, for the word, letters and figures " July, 2003", the word, letters and figures "4t July, 2004" shall respectively be substituted;
(b) in serial number 95 relating to EMISSION LIMITS FOR NEW DIESEL ENGINES (UP TO 800 KW) FOR GENERATOR SETS (GENSETS) APPLICATIONS,-
(i) for paragraph 1 and the TABLE relating thereto, the following shall be substituted, namely : - "4, Emission Limits R [ [ THE GAZETTE OF INDIA : EXTRAORDINARY [Part I—Ssc. 3] The gmisslon limits for new diesel engines upta 800 kW for gensets applications shall be as given in the Table below :

N KW Notel:— -The diesel engine manufacturers in the category of engines upto 19 kW, who are unable to meet the emission limits fixed for such diesel engines for gensets applications vide the notification of the Government of India, in the Ministry of Environment and Forests number G.S.R. 371(E) dated 17" May, 2002 (herein referred to as the said notification), may avail the benefit of extension of time provided under this notification subject to the condition that every such manufacturer shall submit
(i) an affidavit to the Central Poilution Control Board or the respective State .
Pollution Control Boards or Committees where they are located to the effect that the specified emission limits shall be complied with by them as per the A aseees e s [ I—avs 33} ) - I T ST extended date of implememétipn given hereinabove for that category of engines without seeking further extension of time and (i) a bank guarantee of Rs. 50,000 (Rupees Fifty thousand) which in case of non compliance shall stand forfeited, _ Notefi:— The diesel engine manufacturers in the category of engines of more than 19 kW and upto 800 kW, who are unable to meet the emission limits fixed for such diesel engines for gensets applications vide the said notification may ‘avail the benefit of extension of time provided under this notification subject to the condition that every such manufacturer shall submit
(i) an affidavit to the Central Pollution. Control Board or. the respective State Pollution Control Boards or Committees where they are located to the effect that the specified emission limits shall be complied with by them as per the extended, date ‘of implementation given hereinabove for that category of engines without seeking further extension of time and (i) a bank guarantee for an amount of Rs 10,00,000/- (Rupees ten lakhs) per parent engine model which in case of non compliance shall stand forfeited.
Note it :— The diesel engine manufacturers in the category of engines of ‘r:\or; than 176 kW and upto 800 kW shall, in addition to the conditions specified in Note Il above, also give an affidavit to the Central Poliution Control Board or to the respective State Pollution Control Boards or Committees where they are located to the effect that they shall develop either individual or a common test facility and get the same approved by the certification agencies méntiened in paragraph 8 of serial number 95 of Schedule I " - (¢) in paragraph 6, for the figures and letters "20 kW", the figures and letters " 19 kW " shall be substituted.
