1. Short title and commencement.—(1) These rules may bo calleil the Insecticides (Amendment) JUiIes, 199."!;

(i) lifter the existing clause (a) the following clause (c) shall be inserted, namely :— "tO "expiry date" means the date that is mentioned on the container, label or wrapper aguinst the colgmn 'date of expiry';*' (iij after 10 inserted clause (c), for clauses (d) and fe) the following clauses jjiall be substituted, namely :— "(d) "from" means a lorm set out in the First Schedule; (•e) "laboratory'' means the Central Insecticides Laboratory;"
(ili) for clause (h) the following clause shall be sulstituled, namely :— ••.ii) 'Pests" rt«ari9 any inlets, lodt-nts, fuiniri, wreds and other foteti nf rlnnt or animal life not useful to human beings;"
(iv) aftei so substituted clause (h), the following clauses shall be added, namely :— "(i) "primaly package" menus the immcili-ile pmL'ine L-nntaiiiina tho insecticides;
(i) "mincipal"1 means the importer or manufacturer of irrccticide, as iho case may be;
(k) "registration" includes provisional registration;
(1) "lural area" means an area which f&lh outside the limits of any Municipal Corporation or Municipal Committee or a notified Area Committee or a Cantonment;
(m) 'Schedule" means a Schedule annexed to these I ules; (nj "secondaiy package" means a uaiAafic which is neither a primary package noi a UansporleUion package;
(ti) "section" means a section of the Act;
(p) "testing facility" means an opciatioiul unit vvhetc the experimental studies arc being earned out oi have been carried out in relation to submission of data on product quality or on salety or on efficacy, or on residues or on stability in storage of the insecticides for which an application for registration is M klc;
(q) "transportation package" means the outer most packnge used for transportation of insecticides."
3. In rule 6 of the said rules,
(i) for sub-rule (1), th« following sub-iule shall be substituted, namely :— "(l)(a) An applicati.m for legislation of an insecticide under the Act shall be made in Form 1 and the Sdid Form including the verification cprtion, shall be signed in case of an individual by tht individual himself or a person duly authorised by him; in case of Hindu Undivided Family, by the Kaita or any peison duly authoiised by him; in case of partnership firm b_y the managing partner; in case of a company, by any person duly authoiised in that behalf by the Board of Directors; and in any other case by the person in charge of responsible for the conduct of the busidess. Any change in members of Hindu Undivided Family or pailners or the Board of Directors or the person in chaige, as the case may be, shall be forthwith intimated to the Secretary, Central Insecticides Bodid and Registration Committee and the Licensing Officer. <h) The Registration Committee may, if neccssnry diicct the inspection of the 'testing facility' fcr c^abiishing the authenticity of the datn"; foi mb-rules (3) and («) I hi' tolkiw'iig tub-iuies1 shall be fubslitutcd, namely :— "O) The registration fee payable "shall be paid by a demand draft drawn on the State Bank of Tndia, F^ridabrtd, in favour of the Accounts Officer. Directorate of Plant Protection, Quarantine and Sloraue, Faridabad, Haryana.
(4) Tin certificate" of legislation shall be in Form II or Form TIA, ;i< the case imy re ;nVt shall be subject lo such conditions ns specified therein".
4. 6. In mlc 9 of ihe said rule;., foi sub-rule (4), the following sub-rule1; shall be substituted, namley :— "(1) A licensing officci may, after e'vl|ifi reasonable oppoitunity of being heard, to the applicant, tcfuse to plant any licence. (4A) No licence to miinufacture an iiiasrticidc shall he granted unless the licensing officer i* satisfied that necessary platit and machinery, safety devices mid liist aid facilities, etc., exist in Ihe premises where the insecticide is proposed to be manufictuicd".
7. fn inlc 10 of the said rules,
(i) for sub-rule (2), the following sub-rule shall be substituted, namely ;— "(2) The fee payable under sub-rule (1) for the gjfcnt or renewal of a licence shall be rupees twenty for every insecticide for which the licence is applied, •subject to a maximum of rupees three hundred, There shall bo a separate fee for eacli place, if any insecticide is proposed to be sold, stocked or exhibited for sale at more than one place:
Provided that ihe maximum fee pa; able in repcet of inseet'eides commonly used for household purposes and registered is such shall be rupees ten for every place : Piovided further that, if the place of sale is esiublishcil in ihe rural area1?, the fee shall be one-fifth of the1 fee specified in this sub-rule". di) in tub-rule (3), after the words ''such place'", Ihe words "and for every insecticide" shall be added;
(iii) in subirule (4), for clauses (iii) and (iv), tlic following clause shall be substituted, namelv :— ''(iu) Where the licensee wants to sell, $tock or cxh bited foi sale or distribute any additional kvecticides during the currency of the licence, he may apply to the licensing officer for necessary endorsement on the licence on pa)mcnl of fees specified in sub-rule (2)".
(iv) after sub-rule (4), Ihe following sub-iule shall be inserted, namely : "I4)(i> Every person 'ahull alonjf with his application for giant or icncwal of a licence to undertake operations or shall, stock or exhibit for sale or d'siributc insecticides, file a certificate from the principal whom he represents or des.itcs to i«iiietenL,
(ii) The certificate to be issued by the principal shall be addressed to the licensing officer of the concerned nreu and shall contain full paiticulars of the principal including their registration and manufacturing licence iiumbeis, full name and address of the ptrson proposed to be authorised and afco the type or formulations to be used in commercial pest control operations, sold, stocked or exhibited for sale or distribution.
(iii) In ordei to v-i rfy thj yt-nuiiicni^s or otherwise of the certificate, the principal shall send to the I censing officer of the State where he intends to sell his products a,n adequate number of copies of ihe specimen signature or the specimen signatuici' of the persons authorised in writing to issue the principal's certificate.
(iv) In case of suspension, revocation or cunccllut'on of the cei tificatc, (ho piincipal shall forthwith in'.imate the licensing officic having jurisdiction", (\) foi sub-rule (5), the lolloping sub-rule shall be substituted, namely ;— ''(5) A licensing oflicoi may, aflci giving a le.i'-onable opportunity of being heard lo the ap[ilic.int, icfuse to cnint any licence". S. After rule 10 of Ihe said i tiles, the following lules shall be inserted, namely ;— "10A. Segregation and disposal of date expiicd pesticides—
(a) Immediately after the date of expiry oil such stocks after being segregated and stamped 'not for sale' or 'not for use' or 'not for manufacture', as Ihe case may be, shall be kept by the licensee in a separate place specially demarcated for the purpose with n declaration 'date-expired insect icidce,j' to be exhibited on the conspicuous purl of the place.
(b) All such Mocks then shall be disposed of in such a manner as may be specified from time to time by the Cential Government in consultation with ihe Central Insecticides Boaid.
10B. Special provision with regard to SuJphui—In icgard to insecticides sulphur and its formulations, oil licences bhall :—
(a) ubseive all precautions to prevent its then;
(b) report any such theft to the neatest police authorities promptly; and (el maintain a separate register showing names and addresses of nil the persons to whom it has b^en told on distributed and the quantities to soki or distributed, IOC. Prohibition against sale oi stotaye of Insecticides in certain pi.ices—No person thall liuniiCaciure, sloic or c\posc for sale or permit the sale or Moraqs of any insecticide in I he same building where any articles consumable by Indian beings or animals are manufactured,, stored Or c^pns-ed for sale. 22 THE GAZETTE OF INDIA : EXTRAORDINARY LPART II—SEC. 3(h]
Explanation.—Nothing contained in this rule will apply to the retail sales of hou^huld insecticides from the building wherefrom other articles consumable by human beings, or animals are usually sold provided such household insecticides have been registered as such and arc packed and labelled in accoidance with these rules." 9, In rule 11 of l,he said rules. 0) for clause (al and (b), the followinc claiucs shall be substituted, namely :— "(ul Any licence issue.1 or icnewed inder this chapter shall, unless sooner suspended or cancelled, been force for a period of two calendar years
Provided that the licence to manufacture insecticides', if any, issued on the basis at provibion.il legislation granted under sub action (3B) of section 9, shall expne on the date oi" expiry of the provisional registration :
Provided further thut the licence fiHtileil bv endoricnunt on the m.un licence under clause (iii) of sub-dule (S) of rule y or under clause (iif) of sub-rule (4) of rule 10 or under sub-rule (3) of mle 10A shall expire or be renewable along with the main licence, (,h) An application for the icnewal of a licence shall be made bcfoie its expiry 'and if such an application is made aftei the date of expiry but within Ihrec months from such date, a late fee of-—
(i) rupees fifty for the fust month or port 'hereof, rupees one hundred for the second month or part thereof and rupees one hundred and fifty lor tho third month or pait theieof in the case of licence to manufacture insecticides oi to carry pest control operations;
(ii) lupecs tun for the fust month or pail thereof, rupees twenty for the second month or part thereof and rupee*, thiity for the third month or part thereof, in case of any other licence, shall be paid along with the application for renewal:
Provided that where the main pest control operation unit or trie place of jalc is located m tho mud arens the late fee shull be one-fifth of the said late fee •
Provided further that in case of death or disability of the licensee the licensing officer may, after iccordiiiR rea.ons in wnting, exempt the applicant irorn pavemnl of ihe late fee. FxpUnation.—(1) Whcie an application for mievi'al is made before the expiry of the licence and the order legard'n? refusal or icncwal is passed after the expiry of the licence, the applicant shall be deemed to have been cirryii'E on his biuincss in accordance with the expired licence till the dat» of communication of the final order on that application.
(2) Where an application for renewal k made after tha expiry of the licence with late fee, the applicant shall be deemed to have been carrying on his business in accordance with (he expired licence (fiom the date of expiry") till the date of communication o£ the final order on tha; application."
(ii) in clause (c), the words "and shall be deemed to have expired if the application for renewal is not made within a month aftei Us expiry" shall be omitted; fin) in chuise (d), for the words ''and on such iefucal the fee paid for Such renewal and the puialty, if any, paid shall be refunded to the applicant", the woids "for reasons to be recuided in willing" shall be Gubstituted.
10. In rule 13 of the said rules, after the woids ''vary or amend a licence", the following wordi shall be inserted, namely :— "after satisfying himself that the Registration Committee has amended the registration certificate and".
11. 1-or rule 15 of the said rules, the following rule shall be substituted, namely :— "11. Issuing cash memo and maintenance of leeordi—(.1) All sales of insecticides shall be made by a bill or cash memo in the form prescribed under any. law.
(2) All sales of insecticides made to a licensed manufactuier (formulator or packer), stockist, distiibutor, dtalci, retailer or to a bulk consumer shall be enteied insecticidcwise, m a register in Foim XIII and a Siatcwise monthly ltturn of all sales to actual ci.nsumeis shall be sent to the licensing officer, in I i r m XIV within 15 days from ihe close of the month.
(3) hvL'iy importer or manufacturer of insecticide shall maintain a stock rogister in Form XV for technical grade insecticides and in Form XVI for foimulate insecticides.
(4) Without prejudice to the foifgomg, the Centul Government or the Slate Government or tiny other peison authorised by it may, by notice in writing require any impoitw or manuLictui er or any other person dealing in insecticides to furnish within the time specified in the notice, such infoimotion with respect to any insecticides or tmy batch thereof, includins the particiilan ov al1 perorn to vhom it has been sold or distributed, at it may consider necessary".
12. In iu)e 16 of the said rules, after the worda "or distribute11, the word's "or cause to be transported" shall bo inseited.
13. For rule 17 of the said rules, the followina rule shall be substituted, namely :— "17. Packaging of insecticides.—•( 1) Eveiy package cuntaininfl Ihe insecticides shall be of a type approved by the Registration Committee. 23
(2) Before putting any insecticide into the primary package, every batch thereof shall be analysed as per the relevant vpecilk'aiions ot the manufacture thereof, in accordance v>ith ihc appioved methods of analysii and the result of such an analysis shrill be lecoided in the icgister maintained for the purpose. If any insecticide is put in the package it shall be presumed that it is fit and ready for sale, dijtnbution 01 use for which it is intended, notwithstanding the fact that am further steps ore still required to be taken to make it marketable".
14. Rule 18 of the said rules shall be renumbered as subrule (1) thereof, and —
(i) in sub-rule (1) as so renumbered, after clause (I), the following clause shall be instreted, namely :— "(g) common name of the insecticide aj adopted by the International Standards Organisation find where such a name has not yet been adopted such other name as may be approved by the Registration Committee;"
(ii) after sub-rule (1) as so renumbered, the following sub-rule shall be inserted, nemely :— "(2) Two copies of the leaflets duly approved by the Registration Committee and signed by the Secretary, Registration Committee, shall be leturned to the manufacturer and one copy of the State licensing officer."
15. In rule 24 of the said rules, for sub-rule (2>, the following sub-rule shall be substituted, namely :-— "(2) In making the test or analysis of insecticides, it shall be sufficient of the Insecticides Analyst follows that specifications and the months of examination of samples as approved by the Registration Committee."
16. In rule 25 of the said rules, for sub-mlc tZ\ the following sub-rule shall be substituted, namely • — "(2) The fee payabel for testing or analysing snmples received from the Insecticides Inspector shall also be ns specified in the Second Schedule ; Piovided thai the Central Government may. aflci taking into consideration to genuine difficulties of any parlticular State Government, exempt fiom payment of the fee for such period as it may consider leasonablc",
17. Tor rule 37, the following rule shall be suhjiituied, namely :— "37. Medicnl Kxaminalion.—(1) All persons who are engaged in the work of handling, dealing oi otherwise coming in contact with the insecticides during manufacttire[formulation of insecticides ;or being engaged spraying during operation shall he examined medically before their employment and ntlenst quarterly in the case of those engaged in manufactuiinpiformulation units any yeaily in smy other cases including operators while in si-nice by a qualified doctor who is aware of risks to which such persons are exposed. Particulars of all suUi persons, including the particulars of their medical txsmination. shall be entered in ti legister in Form XVII Wheie the insecticide in question is an organojhosproioiJs compound oi a caibamate compound, the blood eholineaterase level shall be measured atleast once a month of all persons woiking in the manufacturing units. The blood residue eslimation shall be done once in a year in the case of persons working with organo chlorine group of insecticides in a manufacturing) formulation unit. In the case of spraying people working with the pest control operator , the estimation of cholinesterase level [if working with organo phosphorous or carbamale compounds) and blood lesidue (if working with organo chlorine gioup) shall be conducted as and when advised by the doctor as part of the general medical test.
(2) Any pel son showing symptoms of poisoning shall be immediately examined and given proper treatment".
18. In the Firsl Schedule to the said rules, —
(1) For T-oi m 1, the following Form shall be substituted, namely : — "FORM I (See rule 6) Application for registration of insecticides,

9. Instructions for storage and use including first aid and precautionary measures which are proposed for labelling.
10. (i) Ten copjes of specifications for product, quality and methods of analysis for Technical/Formulated compound (as applicable) and its residues.
(ii) Analystical test report for the product quality.
11. Seven copies of the proposed labels and leaflets (including all printed or graphic matter which will accompany the package containing the insecticide) as per the insecticides Rules, 1971. 1?. Maner of packing.
13. Particulars of fee deposited.
