Shorttitle and Commencement :~(1)The se rulesmay be called the Railway Accidents (Campensation) Rules, 1990.

(2) They shallcomeinto [Dracon the date of commencement of the Act.

2. Definitions : In these rules, unless the context otherwise requircst~ ('3 ‘accident" means on accident 0. the nature described in suction l 24 ofthc Act"

(b) ‘Aut‘ nICfllls the Railways Act,19£9 (24 of 1989)‘ (3:) “Claims Tribunal” means the Railway Claims Tribunal established under section 3 ofth; Railway Claim; Tribunal Act. 1987 (54 or ]9l<7)'

(d) “Schedule" means the sehedulc to these rules; and

(u) Words and expressions used herein and not defined in the Act shall have the meanings respectively assipmd to them in the Act- CLAIM FOR COM PENSATION 3‘ Arnaunl of Cnnpmsalion :—(I) The amount of com~ pensaiion payable in respect of death 0r injuries. shall be as specified in the Schedule. (-2) The amount of compensation payable for an injury not specified in Part Her Part III'ofthe Schedule but whieh,in the Opinion 0ftltc Claims Tribunal is such as to deprive a person of fill capacity to do any wok. shall be rupCcs two lukhs.

Provided further that the total compensation in rcspcct of ‘flll such injuries shall not exceed rupees forty thousand.

(4) Where compensation has been paid for any injuiywhich. is less than the amount which would have been pgyzblc as campengrttion if the injurcd person had dlrd and tilt prison subsequently dies as a rcSult 0f the injury, a further compensa—tion cqufll to the difference between the emounl payable for death and that already paid shall become payable.

(5) Compensation for loss. destruction or deterioration ofgoods or animals shall be paid to suCh extent as the Claims Tribunal may, in all the circ umstances of the ease,deleimine to be reasonable.

4. Limit of compensation :—N0twithstanding anything contained inrule 3, the total compemation peyzble under that rule shallin no case exceed rupees two lakk in respeCt of any oneperson.
