section (1) and clause (c) of subwscctiml (2) of Section 112 of the Railways Act. 1989 (24 of 1989) read with section 22 of the General Clauses, Act, 1897 (10 of 1897), the Central Govern.

ment hereby makes the following Rules namely:

1.511011 Title and Comnwnccment: ._(.1) These rules may be callw the Railways (Exlwt of Mommy Liability and Prcsr cs'lptlon of l’enontagc Chm-go) Rules, 1990

(2) They shall come luto force an the date of COmnmnccmcm or the Act.

2 Definitions :wm them Rules unless the context olhelwise requires;

(a) "Act” means the Railways Act, 1989 (24 of 1989).

(b) “Baggage” means personal cflects 01' a passenger gnu-usted to a railway administration for carriage.

(c) “Excess value” in mspect of any 0011511111111th means the amount by which the value declared by a consignm“ exceeds the amount of liability of a railway adminisu-asion asrspecified or calculated uxider sub rule_(1) of rule (3).

(d) “Percentage 01111136” means the percentage. charge pay.

(0) “Schedule” moans the Schedule to those rules.

(f) Words and expressions used and not defined in these mics but defined in the Act shall have the meanings respectively assigned to them in the Act.

3. Monetary Liability of a railway administrationzw (1) Where (trailway administration is responsible for loss, damage, destruction, deterioration or nondelivcry of any‘ consignment the amount of liability of such railway. Administration in respect of such loss, damage, destruction, dolprloratiim or non-delivery shall not, unless the consignor has declared its value and paid percentage charge on excess value of such consignmcnt,'exoeed,-~

(i) in the case of any cousignmont consisting of annnsls, the amount specified in Schedule I; or

(ii) in the case of any consignment consisting of baggage, an amount calculated at rupees one hundred per kilograuune;or

(iii) in the case (If any consignment other than those referred to in clauses (i)‘, and (ii) above, an amount calculated at rupees fifty per kilogromme.

(2) Where a railway administration is responsible for loss damage, destruction, deterioration or non-delivery of any consignment and the consignor has at the time of entrustmcnt for carriage declared the value of such cons‘igmnent and paid percentage charge on excess value at the rate specified in Part].

or Part II as the case may be of Schedule H, the amount of liability of a railway adminisiration for loss, damage, destruction, deterioration or non—delivery of such cousignment shall not exceed the value so declared.

Explanation 1 Where in respect of carriage of any consignment, the freight is chargeable on any basis other than its ucmal weight, the amount of liability of a railway administration shall be deter— mined with reference to the actual weight ofsuCh consignment.

Explanation 2 Where the loss, damage, destruction, deterioration or non.

delivery is Only with respect to part or it consignment, the weight to be thkcn into consideration for determining the flmOunt of liability of a railway administration is the weight of the goods lost, damaged. destroyed, deteriorated or non«dclivered unless such loss, damage, destruction, deterioration or non.delivery attests the value of the, entire consignment.

4. Certain goods not to he accepted for carriage unless per.
