PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार् ुपररवतान मतं्रालर् अजधसचूना नई दिल्ली, 26 जसतम् बर, 2024 सा.का.जन.596 (अ).—भारत सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् ने पर्ाावरण के अनुकूल ऐसे उत्पािों की मांग को बढावा दिर्ा ह ैिो पर्ाावरण पर कम प्रजतकूल प्रभाव डालत ेहैं जिससे ‘लाइफ (पर्ाावरण के जलए िीवनिैली)' के जसद्ांतों को समर्ान जमलेगा, कम ऊिाा खपत, संसाधन के कुिल उपर्ोग और संरक्षण, चक्रीर् अर्ाव्यवस्ट्र्ा को बढावा जमलेगा और उन उत्पािों के पर्ाावरणीर् पहलओुं पर भ्रामक सूचना पर रोक लगगेी। और उत्पािों की इको-लेबललगं उपभोक्ताओं को सूचना के सार् खरीि संबंधी जनणार् लेन ेमें सक्षम बनाती ह ैऔर सार् ही जवजनमााताओं को पर्ाावरण के अनुकूल उत्पािों का उत्पािन िुरु करने के जलए प्रोत्साजहत करती ह ैजिससे हररत उद्योगों को बढावा जमलता ह;ै और ईकोमाका उन उत्पािों को अनुित्त दकर्ा िा सकता ह ैिो संसाधन के उपभोग और पर्ाावरणीर् प्रभावों, जविेष रूप से िलवार् ु पररवतान पर प्रभाव, प्रकृजत और िैव जवजवधता पर प्रभाव, ऊिाा खपत, अपजिष्ट सृिन, सभी पर्ाावरणीर् क्षेत्रों में उत्सिान, भौजतक प्रभावों के माध्र्म से प्रिषूण और पररसंकटमर् पिार्ों का उपर्ोग और जनमुाजक्त के संबंध में जनर्िाष्ट पर्ाावरणीर् मानिंडों को पूरा करत ेहैं;

और प्रारूप ईकोमाका प्रमाणन जनर्म, 2023 भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (ii) में अजधसूचना संखर्ांक का.आ 4441(अ), तारीख 11 अक्टूबर, 2023 द्वारा प्रकाजित दकए गए र्े तर्ा सभी व्यजक्तर्ों से आक्षेप और सुझाव आमंजत्रत दकए गए र्;े स.ं 554] नई दिल्ली बृहस्ट् पजतवार, जसतम् बर 26, 2024/ भाद्र 4, 1946 No. 554] NEW DELHI, THURSDAY, SEPTEMBER 26, 2024/ BHADRA 4, 1946 सी.जी.-डी.एल.-अ.-01102024-257609 CG-DL-E-01102024-257609 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] और प्राप्त दकए गए सभी आक्षेपों और सुझावों पर केन्द्द्रीर् सरकार द्वारा सम्र्क रूप से जवचार दकर्ा गर्ा ह;ै अत: अब केन्द्द्रीर् सरकार ‘पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (ii), धारा 6 की उपधारा (1), धारा 23 और धारा 25 की उपधारा (1) द्वारा प्रित्त िजक्तर्ों का प्रर्ोग करते हुए जनम्नजलजखत जनर्म बनाती ह,ै अर्ाात:-

1. सजंक्षप्त नाम और प्रारंभ– (1) इन जनर्मों का संजक्षप्त नाम ईकोमाका जनर्म, 2024 ह।ै

(2) र् ेरािपत्र में उनके प्रकािन की तारीख से प्रवृत्त होंग े।

2. पररभाषाएँ. –इन जनर्मों में, िब तक संिभा में अन्द्र्र्ा अपेजक्षत न हो,- (क) "अजधजनर्म" से पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) अजभप्रेत ह;ै (ख) "उत्पाि" से प्रर्म अनुसूची के स्ट्तंभ (2) के अधीन जवजनर्िाष्ट अजभप्रेत उत्पाि ह;ै (ग) "रजिस्ट्रीकृत अजभकरण" से जनर्म 13 के उपजनर्म (2) अधीन रजिस्ट्रीकृत अजभकरण अजभप्रते ह;ै (घ) "अनुसूची" से इन जनर्मों से संलग्न अनुसूची अजभप्रेत ह;ै (ङ) "सत्र्ापक" से जनर्म 12 के अधीन सत्र्ापक के रूप में रजिस्ट्रीकृत इकाई अजभप्रेत ह।ै

3. ईकोमाका के अनिुान के जलए ितें.- (1) ईकोमाका ऐसे उत्पाि के जलए अनुित्त दकर्ा िा सकता ह ैजिसके पास भारतीर् मानक ब्र्रूो अजधजनर्म, 2016 के अधीन भारतीर् मानकों के अनरुूपता की अनतुजप्त र्ा प्रमाणपत्र ह ैऔर/र्ा कें द्रीर् सरकार द्वारा िारी क्वाजलरट जनर्ंत्रण आिेिों का अजधिेि ह,ै और िो ईकोमाका के अनुिान के जलए प्रर्म अनुसूची के स्ट्तंभ (3) के अधीन तत्स्ट्र्ानी प्रजवजष्टर्ों में जवजनर्िाष्ट मानिडंों को पूरा करता ह।ै

(2) प्रर्म अनुसूची के अधीन जवजनर्िाष्ट ईकोमाका के अनुिान के जलए मानिडंों में जनम्नजलजखत सजम्मजलत हो सकें गे:- क. अपजिष्ट सृिन और पर्ाावरणीर् उत्सिान को कम करके र्ा समाप्त करके प्रिषूण में कमी लाना;

ख. उत्पाि पुनचाक्रण र्ोग्र् हो र्ा पनुचादक्रत सामग्री से बना हो र्ा िोनों;

ग. गैर नवीकरणीर् संसाधन, जिसके अंतगात गैर-नवीकरणीर् ऊिाा स्रोत और प्राकृजतक संसाधन भी ह,ै के उपर्ोग में कमी लाना;

घ. ऐसी दकसी सामग्री, िो पर्ाावरण पर प्रजतकूल प्रभाव डालता ह,ै के उपर्ोग में कमी लाना;

(3) दकसी उत्पाि के जलए ईकोमाका के अनुिान हते ुमानिडं जवकजसत करते समर् जनम्नजलजखत बातों पर जवचार दकर्ा िा सकेगा,अर्ाात:्- क. उत्पािन प्रदक्रर्ा, जिसके अतंगात कचे्च माल के स्रोत भी ह;ै ख. प्राकृजतक संसाधनों का उपर्ोग;

ग. पर्ाावरण पर प्रभाव;

घ. उत्पािन प्रदक्रर्ा से उत्पन्न होने वाले उत्सिान र्ा अपजिष्ट का प्रभाव और जवस्ट्तार;

ङ. उत्पाि का जनपटान और इसकी पैकेलिंग;

च. जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व संबंधी मागाििाक जसद्ांतों का अनुपालन,िहां भी लाग ू हो;

छ. अपजिष्ट और पुनचाक्रण सामजग्रर्ों का उपर्ोग;

ि. पुनचाक्रण के जलए उपर्ुक्तता;और झ. पररसंकटमर् पिार्ों के स्ट्र्ान पर अपररसंकटमर् पिार्ों का उपर्ोग।

4. ईकोमाका के प्रिान के जलए प्रदक्रर्ा.- (1) जनर्म 3 के अधीन ितों का अनुपालन करने वाले उत्पाि के जलए ईकोमाका प्रिान के जलए आवेिन केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा को प्रारूप 1 में दिर्ा िाएगा। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3

(2) आवेिन प्राप्त होन ेपर, केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा स्ट्वर् ंर्ा सत्र्ापक के माध्र्म से र्ह सत्र्ाजपत करेगा दक उत्पाि जनर्म 3 के अधीन ितों का अनुपालन करता ह ैर्ा नहीं।

(3) उपजनर्म (2) के अधीन ऐसा सत्र्ापन करने के पश्चात, िैसा आवश्र्क हो, केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा एक ररपोटा तैर्ार करेगा, र्ा र्दि सत्र्ापन सत्र्ापक द्वारा दकर्ा िाता ह,ै तो सत्र्ापक एक ररपोटा तैर्ार करेगा और ऐसे सत्र्ापन की तारीख से साठ दिन की अवजध के भीतर केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा को प्रस्ट्तुत करेगा ।

(4) ररपोटा प्राप्त होन ेपर, र्दि केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा का र्ह समाधान हो िाता ह ैदक उत्पाि जनर्म 3 के अधीन ितों का अनुपालन करता ह,ै तो वह उत्पाि को ईकोमाका अनुिान कर सकेगा।

(5) उपजनर्म (4) के अधीन अनुित्त दकर्ा गर्ा ईकोमाका तीन वषा की अवजध के जलए र्ा उत्पाि के जलए ईकोमाका मानिंड में पररवतान होने तक, िो भी पहले हो, जवजधमान्द्र् होगा।

(6) ईकोमाका की अवजध समाप्त होने पर उसके नवीकरण के जलए आवेिन केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा को दकर्ा िा सकता ह ैऔर इस जनर्म के उपजनर्म (1) से (5) तर्ा जनर्म 3 के उपबंध लाग ूहोंगे।

(7) ईकोमाका के प्रत्र्ेक धारक को उत्पाि के संबंध में पूवावती वषा के 1 अप्रलै से उत्तरवती वषा के 31 माचा तक की अवजध के जलए वेब पोटाल के माध्र्म से सीपीसीबी द्वारा जवजहत जनििान पत्र के अनुसार कें द्रीर् प्रिषूण जनर्ंत्रण बोडा को ऑनलाइन वार्षाक ररपोटा प्रस्ट्तुत करना होगा और कें द्रीर् प्रिषूण जनर्ंत्रण बोडा ऐसी ररपोटों की परीक्षा करेगा तर्ा अपनी जसफाररिों के सार् उनका संकलन, र्दि कोई हो, प्रत्र्ेक वषा 31 िुलाई को र्ा उससे पहल ेपर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को भेिेगा।

5. ईकोमाका का रद्दकरण– (1) र्दि केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा का र्ह समाधान हो िाता ह ै दक दकसी ईकोमाका के धारक ने झूठी सूचना िी ह ैर्ा इन जनर्मों के अधीन िी िाने वाली अपेजक्षत दकसी सूचना को िानबूझकर जछपार्ा ह,ै तो वह ईकोमाका के धारक को सुनवाई का अवसर िेने के पश्चात ्तर्ा कारणों को जलजखत रूप में अजभजलजखत करके आििे द्वारा ईकोमाका को जनलंजबत र्ा रद्द कर सकेगा।

(2) ईकोमाका का धारक, र्दि उपजनर्म (1) के अधीन दकए गए आिेि से व्यजर्त ह,ै तो वह ऐसे जनलंबन र्ा रद्दकरण के आिेि की प्राजप्त की तारीख से तीस दिन की अवजध के भीतर प्रारूप 2 में कें द्रीर् सरकार को अपील कर सकेगा।

(3) केन्द्द्रीर् सरकार उक्त तीस दिन की अवजध की समाजप्त के पश्चात ्भी अपील पर जवचार कर सकेगी, र्दि ईकोमाका धारक केन्द्द्रीर् सरकार का र्ह समाधान कर िेता ह ैदक उसके पास उक्त अवजध के भीतर अपील प्रस्ट्तुत न करन े के जलए पर्ााप्त कारण र्ा।

(4) कें द्रीर् सरकार ईकोमाका धारक को सुनवाई का एक अवसर िेन ेके पश्चात ् और ऐसी िांच के पश्चात,् िैसा वह ठीक समझे, ऐसा आिेि िे सकेगी िैसा वह आवश्र्क समझे।

6. ईकोमाका का उपर्ोग.- (1) प्रत्र्ेक व्यजक्त जिसे दकसी उत्पाि के संबंध में ईकोमाका अनुित्त दकर्ा गर्ा ह,ै ऐसे उत्पाि पर इन जनर्मों के अधीन अनुित्त दकर्ा गर्ा ईकोमाका लेबल लगाएगा।

(2) कोई भी व्यजक्त दकसी भी उत्पाि पर ईकोमाका का उपर्ोग तब तक नहीं करेगा िब तक दक उसे ऐसे उत्पाि के संबंध में ईकोमाका अनुित्त न दकर्ा गर्ा हो।

7. सचंालन सजमजत.- (1) केन्द्द्रीर् सरकार एक संचालन सजमजत गरठत करेगी िो इन जनर्मों के प्रभावी कार्ाान्द्वर्न के जलए उत्तरिार्ी होगी।

(2) संचालन सजमजत में जनम्नजलजखत व्यजक्त सजम्मजलत होंगे:- क. सजचव, पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर्- अध्र्क्ष, पिने;

ख. अपर सजचव र्ा संर्ुक्त सजचव (प्रभारी ईकोमाका ), पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् - सिस्ट्र्, पिने;

ग. उपभोक्ता मामले मंत्रालर्, खाद्य और सावािजनक जवतरण जवभाग, उपभोक्ता मामल ेजवभाग में संर्कु्त सजचव, भारत सरकार- सिस्ट्र्, पिेन;

घ. जनम्नजलजखत में से प्रत्र्ेक एक प्रजतजनजध, िो संर्कु्त सजचव से नीचे के रैंक का न हो- 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(i) उद्योग संवधान और आंतररक व्यापार जवभाग- सिस्ट्र्, पिने:

(ii) सूचना और प्रसारण मंत्रालर्- सिस्ट्र्, पिेन;

(iii) रसार्न और पेरो रसार्न जवभाग- सिस्ट्र्, पिेन;

(iv) कृजष और दकसान कल्र्ाण जवभाग- सिस्ट्र्, पिेन;

(v) स्ट्वास्ट््र् और पररवार कल्र्ाण जवभाग- सिस्ट्र्, पिेन;

(vi) सूक्ष्म, लघु और मध्र्म उद्यम मंत्रालर्- सिस्ट्र्, पिेन;

(vii) जवदु्यत मंत्रालर्- सिस्ट्र्, पिेन;

(viii) पेर्िल और स्ट्वच्छता जवभाग- सिस्ट्र्, पिेन

(ix) व्यर् जवभाग- सिस्ट्र्, पिेन;

(x) जविेि मंत्रालर्- सिस्ट्र्, पिेन;

(xi) वाजणज्र् जवभाग- सिस्ट्र्, पिेन;

(xii) वस्त्र मंत्रालर्- सिस्ट्र्, पिेन;

(ङ) महाजनिेिक, वैज्ञाजनक और औद्योजगक अनुसंधान पररषि- सिस्ट्र्, पिेन;

(च) महाजनिेिक, भारतीर् मानक ब्र्ूरो- सिस्ट्र्, पिेन;

(छ) अध्र्क्ष, केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा- सिस्ट्र्, पिेन;

(ि) पर्ाावरणीर् मानकीकरण क्षेत्र से िो जविेषज्ञ- सिस्ट्र्, पिेन; और (ञ) उद्योग संगमों से िो प्रजतजनजध- सिस्ट्र्, पिेन।

(3) संचालन सजमजत, अध्र्क्ष के पूवा अनुमोिन से, संचालन सजमजत की बैठकों में दकसी अन्द्र् व्यजक्त को आमंजत्रत र्ा सहर्ोजित कर सकती ह।ै

(4) संचालन सजमजत का कार्ा काल पांच वषा का होगा।

8. सचंालन सजमजत के कार्ा - (1) संचालन सजमजत जनम्नजलजखत के संबंध में केन्द्द्रीर् सरकार के अनुमोिन के जलए जसफाररि करेगी, अर्ाात्:- (क) केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा की जसफाररि के आधार पर ईकोमाका के अनुिान के जलए इन जनर्मों के अधीन सजम्मजलत दकए िान ेवाले उत्पाि;

(ख) ईकोमाका को बढावा िेने के जलए अपनाए िाने वाले उपार् और रीजत;

(ग) ईकोमाका के अनुिान के जलए मानिंडों की समर्-समर् पर समीक्षा करना तर्ा कें द्रीर् सरकार को जसफाररि करना;

(घ) दकसी उत्पाि के पर्ाावरण पर पड़ने वाल ेप्रभाव के सत्र्ापन के जलए दकसी अनुसंधान को समर्ान िनेे के उपार् र्ा ईकोमाका के अनुिान के जलए मानिंडों का पुनरीक्षण करना।

(2) इन जनर्मों की प्रभावी और कुिल मॉजनटरी तर्ा कार्ाान्द्वर्न करने के जलए संचालन सजमजत ईकोमाका धारकों द्वारा प्रस्ट्तुत वार्षाक ररपोटों और कें द्रीर् प्रिषूण जनर्ंत्रण बोडा द्वारा उस पर की गई दकसी भी जसफाररि की समीक्षा करेगी।

(3) संचालन सजमजत केन्द्द्रीर् सरकार द्वारा उसे सौंपे गए कोई अन्द्र् कार्ा भी करेगी।

9. कें द्रीर् प्रिषूण जनर्तं्रण बोडा के कार्ा– (1)केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा के कार्ों में जनम्नजलजखत सजम्मजलत होंगे, अर्ाात:्- (क) ईकोमाका के अनुिान के जलए इन जनर्मों के अधीन सजम्मजलत दकए िाने वाले उत्पािों की पहचान करना और संचालन सजमजत को इसकी जसफाररि करना:

[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (ख) उपलब्ध िानकारी, प्रौद्योजगकी और बािार के जवकास तर्ा अन्द्र् िेिों में अपनाए िा रह ेमानिंडों के आधार पर ‘ईकोमाका ’ के अनिुान के जलए अपन ेमानिडं की समीक्षा करना और जवकास करना तर्ा संचालन सजमजत को इसकी जसफाररिें करना;

(ग) ईकोमाका अपनाने को प्रोत्साजहत करने के जलए संचालन सजमजत के जवचारार्ा पहलें प्रस्ट् तुत करना;

(घ) सत् र्ापकों और अजभकरणों का रजिस्ट्रीकरण;

(ङ) ईकोमाका प्रमाणपत्र धारकों द्वारा प्रस्ट्तुत वार्षाक ररपोटों को संकजलत करना तादक इन्द् हें अगल ेजवत्तीर् वषा की 31 िुलाई तक पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को प्रस्ट् तुत दकर्ा िा सके;

(च) इन जनर्मों के अधीन मान्द्र्ता प्रिान करन ेके जलए घरेल ूर्ा अतंरााष्ट्रीर् स्ट्वैजच्छक इकोलेबललंग कार्ाक्रम का जनधाारण करना;

(छ) अंतरराष्ट्रीर् इकोलेबललंग कार्ाक्रम का परस्ट् पर मान्द् र्ता प्रिान करने के जलए जनधाारण;

(ि) संचालन सजमजत र्ा केन्द्द्रीर् सरकार द्वारा सौंपा गर्ा कोई अन्द्र् कार्ा।

10. तकनीकी सजमजत.- (1) केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा, केन्द्द्रीर् सरकार के अनुमोिन से, ऐसे जविेषज्ञों और/र्ा जविेषज्ञ संगठनों से जमलकर बनी एक तकनीकी सजमजत का गठन कर सकेगा, जिन्द्हें वह आवश्र्क समझे, िो इन जनर्मों के कार्ाान्द्वर्न में केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा की सहार्ता करेगी।

(2) तकनीकी सजमजत जनम्नजलजखत मामलों में भी कें द्रीर् प्रिषूण जनर्ंत्रण बोडा की सहार्ता कर करेगी, अर्ाात्:- (क) उत्पािों के जलए ईकोमाका के अनुिान के जलए मानिंडों की समीक्षा करना और जवकजसत करना;

(ख) ईकोमाका के अनुिान के जलए उत् पािों के सत्र्ापन की प्रदक्रर्ा जवकजसत करना;

(ग) कें द्रीर् प्रिषूण जनर्ंत्रण बोडा द्वारा इसे जनर्िाष्ट दकसी भी तकनीकी मामले पर सलाह िेना।

(3) तकनीकी सजमजत का कार्ाकाल पांच वषा होगा।

11. ईकोमाका के जलए वबे पोटाल- (1) कें द्रीर् प्रिषूण जनर्ंत्रण बोडा आवेिन करन ेऔर ईकोमाका के अनुिान के जलए, ईकोमाका धारक द्वारा वार्षाक ररपोटें प्रस्ट् तुत करन,े इन जनर्मों के अधीन रजिस्ट्रीकृत सत्र्ापक और अजभकरण, इन जनर्मों के अधीन ईकोमाका के जलए ितों के अनपुालन के जलए उत्पािों की प्रभावी मॉजनटरी करने के जलए सत्र्ापकों और लेखा परीक्षकों के सार्-सार् अजभकरणों के रजिस्ट्रीकरण के जलए एक वेब पोटाल जवकजसत करेगा।

(2) प्रत्र्ेक ईकोमाका धारक, इन जनर्मों के अधीन रजिस्ट्रीकृत सत्र्ापक और अजभकरण को प्रत्र्ेक वषा की 31 मई को र्ा उससे पहल ेपूवावती वषा की पहली अप्रलै से लकेर उत्तरवती वषा की 31 माचा तक की अवजध के जलए उनके द्वारा उक् त अवजध के िौरान अनुपाजलत दक्रर्ाकलापों के संबंध में, कें द्रीर् प्रिषूण जनर्ंत्रण बोडा द्वारा जवकजसत ईकोमाका पोटाल पर जवजहत जनििान पत्र के अनुसार कें द्रीर् प्रिषूण जनर्तं्रण बोडा को वेब पोटाल के माध् र्म से ऑनलाइन एक वार्षाक ररपोटा प्रस्ट्ततु करनी होगी।

(3) कें द्रीर् प्रिषूण जनर्ंत्रण बोडा वेब पोटाल पर जनम्नजलजखत के संबंध में सूचना प्रकाजित करेगा, अर्ाात्:- (क) ईकोमाका के प्रत्र्ेक धारक का ब्र्ौरा और वह उत्पाि जिसके संबंध में इन जनर्मों के अधीन ईकोमाका अनुित्त दकर्ा गर्ा ह;ै (ख) इन जनर्मों के अधीन ईकोमाका अनुित्त दकए गए उत्पािों की सूची;

(ग) प्रत्र्ेक उत्पाि के संबंध में ररपोटा, जिसके आधार पर इन जनर्मों के अधीन उत्पाि को र्ह ईकोमाका अनुित्त दकर्ा गर्ा ह;ै (घ) दकसी उत् पाि के संबंध में दकए गए अनुसंधान और अध् र्र्नों की ररपोटें;

(ङ) ईकोमाका वाले उत्पािों के फार्िें; और (च) इन जनर्मों के अधीन ईकोमाका अनुित्त दकए गए प्रत्र्ेक उत्पाि के संबंध में वैजिक रूप से अपनाई गई सवोत्तम पद्जतर्ां। 12 सत्र्ापक- (1) केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा पर्ाावरण के क्षते्र में तर्ा ईकोमाका से संबंजधत मामलों में अहाता और अनुभव रखने वाली ऐसी इकाईर्ों को सत्र्ापकों के रूप में रजिस्ट्रीकृत करेगा, जिन्द्हें वह इन जनर्मों के अधीन ईकोमाका के अनुिान के जलए तर्ा उसके नवीकरण के जलए उत्पािों के सत्र्ापन के प्रर्ोिनों के जलए आवश्र्क समझे।

(2) प्रत्र्ेक सत्र्ापक उत्तरवती वषा की 31 मई को र्ा उससे पवूा केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा को पूवावती वषा में ऐसे सत्र्ापक द्वारा में दकए गए दक्रर्ाकलापों के संबंध में वार्षाक ररपोटा प्रस्ट्तुत करेगा। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

13. ईकोमाका वाल ेउत्पािों के सबंधं में अनपुालन.- (1) केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा अपनी इच्छा से र्ा उसे प्राप्त जिकार्त पर, स्ट्वर् ंर्ा दकसी रजिस्ट्रीकृत अजभकरण के माध्र्म से, दकसी ऐसे उत्पाि का, जिसे ईकोमाका अनुित्त दकर्ा गर्ा ह,ै इन जनर्मों के अधीन ितों के अनुपालन के जलए जनरीक्षण और सत्र्ापन कर सकेगा।

(2) कें द्रीर् प्रिषूण जनर्ंत्रण बोडा ऐसे अजभकरणों को रजिस्ट्टर करेगा, जिनके पास प्रत्र्ेक उत्पाि के संबंध में ईकोमाका मानिडं के जनरीक्षण और सत्र्ापन के जलए सुसंगत जविेषज्ञता और अनुभव हो, िैसा दक वह इन जनर्मों के प्रर्ोिनों के जलए आवश्र्क समझे।

(3) रजिस्ट्रीकृत अजभकरण, उत्पाि के ऐसे जनरीक्षण और मलू्र्ांकन के बाि, कें द्रीर् प्रिषूण जनर्ंत्रण बोडा को अपनी ररपोटा प्रस्ट्तुत करेगी।

(4) केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा, उत्पाि के संबंध में दकसी भी जिकार्त के बारे में ईकोमाका धारक को सूजचत करेगा तर्ा उससे अपना उत्तर प्रस्ट्तुत करन ेकी अपेक्षा करेगा।

(5) ईकोमाका धारक केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा र्ा रजिस्ट्रीकृत अजभकरणों को ऐसे जनरीक्षण और सत्र्ापन करने की अनुज्ञा िेगा, िो इन जनर्मों के अधीन ितों के अनुपालन को सुजनजश्चत करन ेके जलए आवश्र्क समझे िाएं।

(6) ईकोमाका धारक केन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा और रजिस्ट्रीकृत अजभकरण को उस पररसर तक पहुचं प्रिान करेगा जिसमें संबंजधत उत्पाि का उत्पािन र्ा भंडारण दकर्ा िाता ह।ै

(7) प्रत्र्ेक रजिस्ट्रीकृत अजभकरण को पूवावती वषा में उसके द्वारा दकए गए दक्रर्ाकलापों के संबंध में प्रत्र्ेक वषा 31 मई को र्ा उससे पहल ेकेन्द्द्रीर् प्रिषूण जनर्ंत्रण बोडा को वार्षाक ररपोटा प्रस्ट्तुत करनी होगी।

14. राज्र् सरकार/सघं राज्र् क्षते्रों की भजूमका.- (1) राज्र् प्रिषूण जनर्ंत्रण बोडा और प्रिषूण जनर्ंत्रण सजमजत मीजडर्ा, प्रकािनों, जवज्ञापनों, पोस्ट्टरों र्ा संचार के ऐसे अन्द्र् साधनों के माध्र्म से, जिन्द्हें समुजचत समझा िाए, इन जनर्मों के बारे में िागरूकता पिैा करेगी।

(2) राज्र् प्रिषूण जनर्ंत्रण बोडा और प्रिषूण जनर्ंत्रण सजमजत इन जनर्मों के प्रभावी कार्ाान्द्वर्न के जलए िागरूकता फैलान ेसजहत अन्द् र् दक्रर्ाकलाप करेगी, िैसा संचालन सजमजत द्वारा जसफाररि की िाए और कें द्रीर् सरकार द्वारा अनुमोदित दकर्ा िाए।

15. कार्ाान्द्वर्न सजमजत – (1) ईकोमाका जनर्मों के प्रभावी कार्ाान्द्वर्न के जलए संचालन सजमजत को उपार् सुझाने हतेु कें द्रीर् प्रिषूण जनर्ंत्रण बोडा के अध्र्क्ष की अध्र्क्षता में सजमजत का गठन दकर्ा िाएगा;

(2) सजमजत ईकोमाका जनर्मों के कार्ाान्द्वर्न की मॉजनटरी करेगी और करठनाइर्ों को िरू करने के जलए ऐसे उपार् भी करेगी िो अपेजक्षत हो,;

(3) सजमजत को ऑनलाइन पोटाल जवकजसत करने और संचाजलत करने के जलए मागाििान और जसफाररिें प्रिान करने का भी कार्ा सौंपा िाएगा;

(4) सजमजत में संबंजधत मंत्रालर्ों/जवभागों के प्रजतजनजध, उद्योग संगमों के प्रजतजनजध और अन्द्र् सुसंगत पणधारी सजम्मजलत होंगे। सजमजत का अध्र्क्ष दकसी भी पणधारी/जविेषज्ञ को इस सजमजत में सजम्मजलत कर सकेगा। पहली अनसुचूी [ननयम 2(ख) और 3(1)(च) दखेें] उत्पाि और ईकोमाका प्रिान करन ेके जलए मानिडं क्र.सं. उत्पाि ईकोमाका प्रिान करने के जलए मानिंड

1. आर्का टेक् चरल पेंट और पाउडर कोटटंग

1. सामान्द्र् अपके्षाए:ँ

1.1 पेंट के सभी प्रकारों की गुणवत् ता और उपर्ोजगता से संबंजधत भारतीर् मानक ब्र्ूरो के प्रासंजगक मानकों को परूा दकर्ा िाएगा।

1.2 उत्पाि जवजनमााता को ईकोमाका के जलए आवेिन करते समर् िल (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 और वार् ु (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 के प्रावधानों के अनुसार और पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और उसके अधीन बनाए गए जनर्मों के तहत सहमजत/ स्ट्वीकृजत [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 प्रस्ट्तुत करना होगा।

1.3 उत्पाि में महत्वपूणा अवर्वों की मौिूि मात्रा की सूची अवरोही क्रम में प्रिर्िात होनी चाजहए। ऐसे अवर्वों की सूची भारतीर् मानक ब्र्ूरो द्वारा जनधााररत की िाएगी।

1.4 उत्पाि की पैकेलिंग पर संक्षेप में उन मानिडंों को प्रिर्िात दकर्ा िाएगा, जिनके आधार पर उत्पाि को पर्ाावरण अनुकूल के रूप में लेबल दकर्ा गर्ा ह।ै

1.5 उत्पाि को उजचत उपर्ोग के जनिेिों के सार् बेचा िाएगा तादक उत्पाि का उपर्ोग अजधकतम हो और बबाािी न्द्र्ूनतम हो।

1.6 उत्पाि की पैकेलिंग के जलए प्रर्कु्त सामग्री पनुःचदक्रत, पुनः उपर्ोज्र् अर्वा िैवजनम्नीकृत होगी।

2. जवजिष्ट अपके्षाए:ँ

2.1 िल आधाररत कोटटंग्स (िषु्क जडस्ट्टेंपर और सीमेंट पेंट सजहत)

2.1.1 उत्पाि में 5 प्रजतित से अजधक वाष्पिील काबाजनक र्ौजगक (वीओसी) नहीं होने चाजहए। उत्पाि को पारा और पारा र्ौजगकों के सार् तरै्ार नहीं दकर्ा िाना चाजहए र्ा सीसा, कैडजमर्म, क्रोजमर्म VI और उनके ऑक्साइड के रंगद्रव्यों के सार् रंगा नहीं िाना चाजहए। प्राकृजतक अिुजद्र्ाँ र्ा उत्पािन प्रदक्रर्ा से होने वाली अिुजद्र्ाँ, िो भार के अनुसार 0.1 प्रजतित तक की मात्रा में हो सकती हैं, िो कच् चे माल में जनजहत हैं; इसमें िाजमल नहीं हैं।

2.1.2 उत्पाि जनम् नजलजखत के सार् तैर्ार र्ा जनर्मात नहीं दकर्ा िाएगा:

I.प्रजत दकलोग्राम पेंट में 10 जमलीग्राम से अजधक मुक् त फॉमेजल्डहाइड II. हलैोिनर्ुक्त जवलार्क III. बेंिीन और पौली-एरोमेरटक हाइड्रोकाबान और IV. अन्द्र् एरोमेरटक हाइड्रोकाबान

2.2 पाउडर कोटटंग्स

2.2.1 उत्पाि दकसी भी वीओसी (वाष्पिील काबाजनक र्ौजगक) से मुक्त होना चाजहए। उत्पाि को पारा और पारा र्ौजगकों के सार् तैर्ार नहीं दकर्ा िाना चाजहए र्ा सीसा, कैडजमर्म, क्रोजमर्म VI और उनके ऑक्साइड के रंगद्रव्यों के सार् रंगा नहीं िाना चाजहए। प्राकृजतक अिुजद्र्ाँ र्ा उत्पािन प्रदक्रर्ा से होन े वाली अिुजद्र्ां, िो भार के अनुसार 0.1 प्रजतित तक की मात्रा में हो सकती हैं, िो कचे्च माल में जनजहत हैं, इसमें िाजमल नहीं हैं।

2.2.2 उत्पाि को प्रजत दकलोग्राम पेंट में 10 जमलीग्राम से अजधक मुक्त फॉमेजल्डहाइड के सार् तैर्ार र्ा जनर्मात नहीं दकर्ा िाएगा।

2.3. जवलार्क आधाररत उच्च ठोस कोटटंग्स

2.3.1 उत्पाि में 380 ग्राम/लीटर से अजधक वाष्पिील काबाजनक र्ौजगक (वीओसी) नहीं होने चाजहए। उत्पाि को पारा और पारा र्ौजगकों के सार् तैर्ार नहीं दकर्ा िाना चाजहए र्ा सीसा, कैडजमर्म, क्रोजमर्म VI और उनके ऑक्साइड के रंगद्रव्यों के सार् रंगा नहीं िाना चाजहए। प्राकृजतक अिुजद्र्ाँ र्ा उत्पािन प्रदक्रर्ा से होन ेवाली अिुजद्र्ाँ िो भार के अनुसार 0.1 प्रजतित तक की मात्रा में हो सकती हैं, िो कचे्च माल में जनजहत हैं, इसमें िाजमल नहीं हैं। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

1.1 सभी जनर्मात उत्पाि सुरक्षा, गणुवत्ता और उपर्ोजगता से संबंजधत बीआईएस के जनम् नजलजखत भारतीर् मानकों की अपेक्षाओं को परूा करेंगे:

1.2 प्रसाधन-सामग्री को तैर्ार करने में प्रर्ुक् त सभी घटक, आईएस 4707 (भाग- I): 1988 और आईएस 4707 (भाग-II): 1993 में जवजनर्िाष् ट उपबंधों के सार्-सार् उत्पाि जवजिष्ट अपके्षाओं के अनुपालन में होंगे।

1.3 उत्पाि के पैकेि पर मौिूि मात्रा के अनुसार अवरोही क्रम में महत्वपूणा घटकों की सूची प्रिर्िात की िाएगी।

1.4 ऐसे घटकों की सूची बीआईएस द्वारा जनधााररत की िाएगी। उत्पाि के जवजनमााता को ईकोमाका के जलए आवेिन करत े समर् पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और उसके अंतगात बनाए गए जनर्मों के तहत प्राजधकार, र्दि अपेजक्षत हो, के सार्-सार् िल (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1977 और वार् ु (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 1981 के उपबंधों के अनुसार सहमजत/स्ट्वीकृजत प्रस्ट्तुत करनी चाजहए। इसके अजतररक्त, औषजध और प्रसाधन सामग्री अजधजनर्म, 1940 के उपबंधों और उसके तहत बनाए गए जनर्मों का भी अनुपालन करना होगा।

1.5 र्दि उत्पाि का पैकेि ईकोमाका स्ट् कीम के तहत परृ्क रूप से िाजमल नहीं दकर्ा गर्ा ह,ै तो उत्पाि के पकेैि को उपर्ुक्त तरीके से इस प्रकार जचजननत दकर्ा िाएगा दक ईकोमाका लेबल केवल सामग्री पर लागू हो।

1.6 उत्पाि की पैकेलिंग के जलए प्रर्कु् त सामग्री पुनःचदक्रत, पनुः उपर्ोज्र् अर्वा िैवजनम्नीकृत होगी।

1.7. उत्पाि की पैकेलिंग में उस मानिंड को संक्षेप में प्रिर्िात दकर्ा िा सकता ह ै जिसके आधार पर उत्पाि पर पर्ाावरण अनुकूल लेबल लगार्ा गर्ा ह।ै

2. जवजिष्ट अपके्षाए ं:

2.1 आईएस 4011:1982 द्वारा जवजनर्िाष् ट पद्जत द्वारा परीक्षण दकए िान ेपर उत्पाि त्वचा के जलए सरुजक्षत होगा।

2.1.1 प्रसाधन-सामग्री तैर्ार करन े में िहां कहीं भी सफेक्टेंट एिेंटों का उपर्ोग दकर्ा िाता ह ै उनकी िैवजनम् नीकृत ता लसंर्ेरटक जडटिेंट हतेु ईकोमाका के जलए जनधााररत सीमा के अनुसार होगी।

2.1.2 भारतीर् मानकों में जवजनर्िाष् ट पद्जतर्ों द्वारा परीक्षण दकए िाने पर लडे (पीबी) और आसेजनक (एएस203) के रूप में पररकजलत भारी धातुए ंक्रमिः 20 पीपीएम और 2 पीपीएम से अजधक नहीं होनी चाजहए।

2.1.3 टूर् पेस्ट्ट/टूर् पाउडर : इन उत्पािों को तैर्ार करन े के प्रर्ोिन से, आईएस 6356:1993 और आईएस 5383:1978 में सूचीबद् घटकों का ही उपर्ोग दकर्ा िाएगा। हालांदक, टूर् पेस्ट्ट फ्लोराइडर्कु्त नहीं होना चाजहए और अिुद्ता के रूप में फ्लोराइड (एफ) की उपजस्ट्र्जत, भारतीर् मानकों में जवजनर्िाष् ट पद्जत द्वारा परीक्षण दकए िाने पर 25 पीपीएम की सीमा से अजधक नहीं होनी चाजहए।

2.1.4 हरे्र डाई : लेड आधाररत डाई का उपर्ोग नहीं दकर्ा िाना चाजहए।

2.1.5 नेल पॉजलि : हलोिनर्कु्त काबाजनक सॉल्वैंट्स का उपर्ोग नहीं दकर्ा िाना चाजहए।

3. बैटरी क. टवचानलत लेड-एजसड बैटरी

1.0 सामान्द्र् अपके्षाए ं:

1.1 टवचानलत लेड-एजसड बैटरी, भारतीर् मानक ब्र्रूो के संगत मानकों को पूरा करेंगी।

1.2 उत्पाि के जवजनमााता को पर्ाावरण (संरक्षण) अजधजनर्म, 1986 तर्ा उसके अधीन जनर्मात जनर्मों के अंतगात र्र्ा अपेजक्षत अनुमोिन के सार् िल (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974, िल (प्रिषूण जनवारण और जनर्ंत्रण) उपकर अजधजनर्म, 1977 और वार् ु (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 के उपबंधों के अनसुार सहमजत स्ट्वीकृजत प्रस्ट्तुत करनी होगी।

1.3 उत्पाि की पैकेलिंग पर उस मानिंड को संक्षेप में प्रिर्िात दकर्ा िा सकता ह ैजिसके आधार पर उत्पाि पर पर्ाावरण अनुकूल लेबल लगार्ा गर्ा ह।ै

1.4 उत्पाि को उजचत उपर्ोग के अनुिेिों के सार् बेचा िा सकता ह ै तादक 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] उत्पाि का कार्ा-जनष् पािन अजधकतम हो और उसका सुरजक्षत जनपटान दकर्ा िा सके।

1.5 उत्पाि की पैकेलिंग के जलए प्रर्ुक् त्त सामग्री पुनःचदक्रत र्ा िैवजनम्नीकृत होगी।

1.6 जवजनमााता, प्रर्ुक् त बैटररर्ों के जलए संग्रहण एवं भुगतान प्रणाली की व्यवस्ट्र्ा करेगा और ईकोमाका के जलए आवेिन करते समर् भारतीर् मानक ब्र्ूरो को इस आिर् के प्रमाण-पत्र र्ा उद्घोषणा के माध्र्म से साक्ष् र् स्ट् वरूप िस्ट्तावेि उपलब् ध कराएगा।

2.4 दकसी जतमाही के िौरान जवजनर्मात बैटररर्ों में जनजहत लेड की कुल मात्रा 100 प्रजतित होने की जस्ट्र्जत में, 3 महीने की अवजध (रोललगं औसत के रूप में) में दकसी भी समर् माप ेगए (पोस्ट् ट-कंज् ़र्ूमर लडे से) पनुचादक्रत लडे का जनम्नजलजखत प्रजतित उत्पाि में जनजहत होगा :

i. 1 वषा तक न्द्र्ूनतम 25% ii. 2 वषा तक न्द्र्ूनतम 40% iii. 3 वषा तक न्द्र्ूनतम 50% ख. ड्राई सले बटैरी

1.2 उत्पाि जवजनमााता को पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और उसके अंतगात बनाए गए जनर्मों के तहत प्राजधकार, र्दि अपेजक्षत हो, के सार्- सार् िल (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974, िल (प्रिषूण जनवारण और जनर्ंत्रण) उपकर अजधजनर्म, 1977 और वार् ु (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 उपबंधों के अनुसार सहमजत स्ट्वीकृजत प्रस्ट्ततु करनी होगी। 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

1.3 उत्पाि की पैकेलिंग पर उस मानिंड को संक्षेप में प्रिर्िात दकर्ा िा सकता ह ैजिसके आधार पर उत्पाि पर पर्ाावरण अनुकूल लेबल लगार्ा गर्ा ह।ै

1.4 उत्पाि को उजचत उपर्ोग के अनुिेिों के सार् बेचा िा सकता ह ै तादक उत्पाि का जनष् पािन अजधकतम हो उसका सुरजक्षत जनपटान दकर्ा िा सके।

1.5 उत्पाि की पैकेलिंग के जलए प्रर्ुक् त सामग्री, पुनः चदक्रत र्ा िैवजनम्नीकृत होगी।

1.6 जवजनमााता, प्रर्ुक् त बैटररर्ों के जलए संग्रहण एवं भुगतान प्रणाली की व्यवस्ट्र्ा करेगा और ईकोमाका के जलए आवेिन करते समर् भारतीर् मानक ब्र्ूरो को इस आिर् के प्रमाण-पत्र र्ा उद्घोषणा के माध्र्म से साक्ष् र् स्ट् वरूप िस्ट्तावेि उपलब् ध कराएगा।

2. उत्पाि जवजिष्ट अपके्षाए ं:

2.1 नॉन-ररचािेबल ड्राई सेल बैटरी : बैटररर्ों में पारे की मात्रा, भार के

0.005 प्रजतित से अजधक नहीं होनी चाजहए।

2.2 रीचािेबल ड्राई सेल बैटरी : रीचािेबल बैटररर्ों में पारा 0.005 प्रजतित से अजधक नहीं होना चाजहए।

4. लुजिकेिन ऑर्ल 1. सामान्द्र् अपके्षाए ं:

1.1. सभी लुजिकेिन/जविेषता वाल े तले, भारतीर् मानक ब्र्रूो (बीआईएस) द्वारा अजधसूजचत संगत भारतीर् मानकों को पूरा करेंगे।

1.2. उत्पाि के जवजनमााता को ईकोमाका के जलए आवेिन करत ेसमर् पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और उसके अंतगात बनाए गए जनर्मों के तहत प्राजधकार, र्दि अपेजक्षत हो, के सार्-सार् क्रमि: िल (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974, िल (प्रिषूण जनवारण और जनर्ंत्रण) उपकर अजधजनर्म, 1977 और वार् ु (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 के उपबंधों के अनुसार सहमजत/स्ट्वीकृजत प्रस्ट्तुत करनी चाजहए।

1.3. उत्पाि पर बीआईएस द्वारा तर् दकए िाने वाले भार के प्रजतित में महत्वपूणा घटकों की मौिूि मात्रा की सूची अवरोही क्रम में प्रिर्िात की िानी चाजहए।

1.4. उत्पाि की पैकेलिंग में उस मानिंड को संक्षपे में प्रिर्िात दकर्ा िा सकता ह ैजिसके आधार पर उत्पाि पर पर्ाावरण अनुकूल लेबल लगार्ा गर्ा ह।ै

1.5. उत्पाि की पैकेलिंग के जलए प्रर्ुक् त सामग्री पनुःचदक्रत, पनु:प्रर्ोज्र् र्ा िैवजनम् नीकृत होगी।

1.6. उत्पाि के पैकेि र्ा इसके सार् लग ेलीफलेट में उजचत उपर्ोग, भंडारण एवं पररवहन संबंधी अनुििे और उपर्ोग के बाि जनपटान संबंधी दििाजनिेिों और उसकी सुरजक्षत संचालन संबंधी सावधाजनर्ा जलखी होगी, तादक उत्पाि के जनष् पािन को अजधकतम और इसकी बबाािी को न्द् र्नूतम दकर्ा िा सके।

2. उत्पाि जवजिष्ट अपके्षाए ं:

2.1 लुजिकेिन ऑर्ल (पररशुद्ध): तले की जनम्नजलजखत श्रेजणर्ां िाजमल हैं:

क) लुजिकें ट्स : वनस्ट्पजत तेल आधाररत [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 13 ख) लुजिकें ट्स: वनस्ट्पजत तले आधाररत के अलावा अन्द्र्

2.1.1 उत्पाि का िलीर् िीवों पर जवषाक्त प्रभाव नहीं पड़ना चाजहए। ईसी 50/एलसी 50, 1.0 जम.ग्रा./लीटर से कम नहीं होगा।

2.1.2 बेस ऑर्ल, एजडरटव्स और तरै्ार उत्पािों में िैवजनम् नीकृतता का नीचे उजल्लजखत प्रजतित होना चाजहए :

i. 90% लुजिकें ट्स (वनस्ट्पजत तले आधाररत) ii. 60% लुजिकें ट्स (वनस्ट्पजत तले आधाररत के अलावा) उपर्ुाक्त प्रजतित िैवजनम् नीकृतता का परीक्षण, ओईसीडी परीक्षण पद्जत सीईसी-एल-33-टी-82 तथा 21 दिनों में दकर्ा िाएगा।

2.1.3 उत्पाि में लेड और बेररर्म िैसी जवषैली धातुए ंजनजहत नहीं होनी चाजहए। ए.ए.एस. पद्जत के अनुसार परीक्षण दकए िान ेपर 0.25% से अजधक की सांद्रता में एंटीमनी का प्रर्ोग नहीं दकर्ा िाएगा।

2.1.4 उत्पाि में पी सी बी, पी सी टी और पी बी टी के सार्-सार् नाइराइट्स िैसे हलोिनर्ुक्त उत्पाि िाजमल नहीं होने चाजहए।

2.2 पुनःशोनधत/पुनःपररष्कृत तलेों से तैर्ार लुजिकें ट्स-

2.2.1 उत्पाि में पर्ाावरणीर् िजृष्ट से अनुकूल पुन:पररष् करण प्रदक्रर्ा के माध्र्म से सुधार दकए गए 50% से अजधक मात्रा में पुनःपररष्कृत/पनुचादक्रत उत्पाि जनजहत होंगे।

2.2.2 उत्पाि, लुजिकें टटंग ऑर्ल (पररशुद्ध) के जलए जनर्त उत्पाि जवजिष्ट अपेक्षाओं के अनुरूप होगा।

5. साबुन और जडटिेंट क. प्रसाधन साबनु

1. सामान्द्र् अपके्षाए ं:

1.1 सभी प्रसाधन साबुन गणुवत्ता, सुरक्षा और जनष् पािन के संबंध में समर्- समर् पर र्र्ा संिोजधत भारतीर् मानक ब्र्ूरो के संगत मानकों को परूा करेंगे।

1.2 जवजनमााताओं को ईकोमाका के जलए आवेिन करते समर् पर्ाावरण (संरक्षण) अजधजनर्म, 1986 के तहत प्राजधकार, र्दि अपेजक्षत हो, के सार्-सार् क्रमि: िल (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 और वार् ु(प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 के उपबंधों के अनुसार सहमजत/स्ट्वीकृजत प्रस्ट्तुत करनी चाजहए;

1.3 उत्पाि पर भार के प्रजतित में महत्वपूणा घटकों की मौिूि मात्रा की सूची अवरोही क्रम में प्रिर्िात की िानी चाजहए। ऐसे महत्वपणूा घटकों की सूची को भारतीर् मानक ब्र्रूो (बीआईएस) द्वारा अजभज्ञात दकर्ा िाएगा;

1.4 उत्पाि की पैकेलिंग सामग्री पुनःचदक्रत, पुन:प्रर्ोज्र् र्ा िैवजनम् नीकृत सामग्री से बनाई िाएगी;

1.5 उत्पाि की पैकेलिंग में उस मानिंड को संक्षपे में प्रिर्िात दकर्ा िा सकता ह ैजिसके आधार पर उत्पाि पर पर्ाावरण अनुकूल लेबल लगार्ा गर्ा ह;ै और

1.6 उत्पाि के सार् उजचत उपर्ोग संबंधी जवस्ट्तृत अनुिेि दिए िा सकते हैं 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] तादक उत्पाि के जनष् पािन को अजधकतम और इसकी बेकारी को न्द् र्नूतम दकर्ा िा सके।

2. जवजिष्ट अपके्षाएं :

2.1 तैर्ार र्ा जवजनर्मात उत्पाि में फॉस्ट्फेट और लसंर्ेरटक जडटिेंट नहीं होन े चाजहए।

2.2 डीओसी: सीएचडी: 025(0236) में िी गई पद्जतर्ों से परीक्षण दकए िाने पर उत्पाि त्वचा के जलए सुरजक्षत होगा। ख. जडटिेंट

1. सामान्द् र् अपके्षाएं:

1.1 घरेलू उपर्ोग और औद्योजगक उपर्ोग के जलए सभी जडटिेंट फामूालेिन गुणवत्ता, सुरक्षा और जनष् पािन के संबंध में समर्-समर् पर र्र्ा संिोजधत भारतीर् मानक ब्र्रूो(बीआईएस) के संगत मानकों को पूरा करेंग े|

1.2 जवजनमााताओं को ईकोमाका के जलए आवेिन करत े समर् पर्ाावरण (संरक्षण) अजधजनर्म, 1986 के तहत प्राजधकार, र्दि अपेजक्षत हो, के सार्-सार् क्रमि: िल (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 और वार् ु(प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 के उपबंधों के अनुसार सहमजत/स्ट्वीकृजत प्रस्ट्तुत करनी चाजहए;

1.3 उत्पाि पर भार के प्रजतित में महत्वपूणा घटकों की मौिूि मात्रा की सूची अवरोही क्रम में प्रिर्िात की िानी चाजहए। ऐसे महत्वपूणा घटकों की सूची को भारतीर् मानक ब्र्रूो (बीआईएस) द्वारा अजभज्ञात दकर्ा िाएगा;

1.4 उत्पाि की पैकेलिंग में उस मानिंड को संक्षपे में प्रिर्िात दकर्ा िा सकता ह ै जिसके आधार पर उत्पाि पर पर्ाावरण अनुकूल लेबल लगार्ा गर्ा ह;ै

1.5 उत्पाि के सार् उजचत उपर्ोग संबंधी जवस्ट्तृत अनुिेि दिए िा सकते हैं तादक उत्पाि के जनष् पािन को अजधकतम और इसकी बबाािी को न्द् र्नूतम दकर्ा िा सके;

और

1.6 उत्पाि की पैकेलिंग सामग्री पुनःचदक्रत, पुन:उपर्ोज्र् र्ा िैव जनम्नीकृत सामग्री से बनाई िाएगी।

2. उत्पाि जवजिष्ट अपके्षाए ं:

2.1 उत्पाि में फॉस्ट्फेट नहीं होना चाजहए। इसके स्ट् र्ान पर दकसी भी अन्द्र् पर्ाावरण के अनुकूल जवकल्प का उपर्ोग दकर्ा िा सकता ह।ै

2.2 उत्पाि के उपर्ोग के संबंध में सुरक्षा का मलू्र्ांकन समर्-समर् पर र्र्ासंिोजधत बीआईएस मानकों में िी गई पद्जतर्ों के अनुसार दकर्ा िाएगा:

2.3 इररटेंट क्षमता से संबंजधत सुरक्षा मूल्र्ांकन आईएस 11601 (भाग I) - 1990 के अनुसार दकर्ा िाना ह ैऔर

2.4 त्वचा संवेिी क्षमता का मूल् र्ांकन आईएस: 11601 (भाग II) - 1991 के अनुसार दकर्ा िाना ह ैतर्ा उत्पाि को भारतीर् मानक में जनधााररत संिोजधत स्ट्रम परीक्षण द्वारा परीक्षण दकए िाने पर त् वररत िैवजनम् नीकृत सफेक्टेंट के सार् तैर्ार र्ा जवजनर्मात दकर्ा िाना चाजहए। ग. कपडे़ धोन ेके साबनु

1. .सामान्द् र् अपेक्षाए ं:

[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 15

1.1 कपड़ ेधोन ेके सभी साबुन गुणवत्ता, सुरक्षा और जनष् पािन के संबंध में समर्- समर् पर र्र्ा संिोजधत भारतीर् मानक ब्र्ूरो के संगत मानकों को पूरा करेंग े|

1.2 जवजनमााताओं को ईकोमाका के जलए आवेिन करत ेसमर् पर्ाावरण (संरक्षण) अजधजनर्म, 1986 के तहत प्राजधकार, र्दि अपेजक्षत हो, के सार्-सार् क्रमि:

िल (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 और वार् ु (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 के उपबंधों के अनुसार सहमजत/स्ट्वीकृजत प्रस्ट्ततु करनी चाजहए;

1.3 उत्पाि पर भार के प्रजतित में महत्वपूणा घटकों की मौिूि मात्रा की सूची अवरोही क्रम में प्रिर्िात की िानी चाजहए। ऐसे महत्वपूणा घटकों की सूची को भारतीर् मानक ब्र्रूो (बीआईएस) द्वारा अजभज्ञात दकर्ा िाएगा;

1.4 उत्पाि की पैकेलिंग सामग्री पुनचाक्रण, पुन: प्रर्ोज्र् र्ा िैवजनम्नीकृत सामग्री से बनाई िाएगी और पैकेलिंग के जवजिष् ट मामल ेके संबंध में पर्ाावरण अनुकूल उत् पािों की लेबललगं की स्ट् कीम के तहत जवकजसत मापिंड लाग ूहोंगे।

1.5 उत्पाि की पैकेलिंग में उस मानिडं को संक्षेप में प्रिर्िात दकर्ा िा सकता ह ै जिसके आधार पर उत्पाि पर पर्ाावरण अनुकूल लेबल लगार्ा गर्ा ह;ै

1.6 उत्पाि के सार् उजचत उपर्ोग संबंधी जवस्ट्तृत अनुिेि दिए िा सकत ेहैं तादक उत्पाि के जनष् पािन को अजधकतम और इसकी बबाािी को न्द् र्नूतम दकर्ा िा सके;

और

1.7 तैर्ार र्ा जवजनर्मात दकए गए उत् पाि में फॉस्ट्फेट नहीं होना चाजहए।

1.8 र्दि कपड़े धोन े वाले साबुन के जवजनमााण में साबुन रजहत जडटेिेंट (एनएसडी) का उपर्ोग दकर्ा गर्ा ह,ै तो भारतीर् मानक में जनधााररत संिोजधत स्ट्रम परीक्षण द्वारा परीक्षण दकए िाने पर वह त् वररत िैवजनम्नीकृत होना चाजहए।

1.9 सामग्री को आईएस 11601 (भाग I) – 1986 के अनसुार इररटेंट क्षमता संबंधी मूल् र्ांकन दकए िान े पर तर्ा आईएस: 11601 (भाग II) - 1992के अनुसार त्वचा संवेिी क्षमता का मूल् र्ांकन दकए िान ेपर इस परीक्षण में पास होना चाजहए। 6 कागज़ 1. सामान्द् र् अपके्षाएं :

1.1 कागज़ के सभी जवजनमााता गुणवत्ता और जनष् पािन के संबंध में भारतीर् मानक ब्र्ूरो(बीआईएस) के संगत मानकों को परूा करेंग े|

1.2 जवजनमााताओं को ईकोमाका के जलए आवेिन करत े समर् पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और इसके तहत बनाए गए जनर्मों के अतंगात प्राजधकार, र्दि अपेजक्षत हो, के सार्-सार् क्रमि: िल (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 और वार् ु (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 के उपबंधों के अनुसार सहमजत/स्ट्वीकृजत प्रस्ट्ततु करनी चाजहए;

1.3 उत्पाि की पैकेलिंग में उस मानिंड को संक्षेप में प्रिर्िात दकर्ा िा सकता ह ैजिसके आधार पर उत्पाि पर पर्ाावरण अनुकूल लेबल लगार्ा गर्ा ह;ै

1.4 उत्पाि की पैकेलिंग सामग्री पुनःचदक्रत, पुन: उपर्ोज्र् र्ा िैवजनम्नीकृत सामग्री से बनाई िाएगी और ऐसी पैकेलिंग के संबंध में जवकजसत मापिंड लाग ूहोंगे। 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

2. जवजिष् ट अपके्षाएं :

2.1 लुगिी से जनर्मात कागि और कागि के बोडा जिन का विन बांस, ठोस लकड़ी, नरम लकड़ी और ईख के अलावा अन्द्र् सामजग्रर्ों से बने लुगिी के विन से 60 प्रजतित से कम नहीं होना चाजहए ।

2.2 पुनचादक्रत कागज़ और कागज़ के बोडा अजनवार्ा रूप से 100 प्रजतित अपजिष् ट कागज़ से बनाए िाए।ं 7 खाद्य सामग्री क. खाद्य तले, चार् और कॉफी

1. सामान्द् र् अपके्षाएं :

1.1 खाद्य तलेों, चार् और कॉफी के सभी फामूालेिन भारतीर् मानक ब्र्ूरो के गुणवत् ता संबंधी सगंत मानकों को पूरा करेंगे।

1.2 ईकोमाका के जलए आवेिन करते समर् उत्पाि के जवजनमााता को पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और उसके अंतगात बनाए गए जनर्मों के तहत प्राजधकार, र्दि अपेजक्षत हो, के सार्-सार् िल (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974, िल (प्रिषूण जनवारण और जनर्ंत्रण) उपकर अजधजनर्म, 1977 और वार् ु(प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 के उपबंधों के अनुसार सहमजत/स्ट्वीकृजत प्रस्ट्तुत करनी होगी : और अन्द् र्र्ा जवजनर्िाष् ट दकए िाने तक उत् पाि को खाद्य अपजमश्रण की रोकर्ाम अजधजनर्म, 1954 और इसके तहत बनाए गए जनर्मों के अनुसार होना चाजहए।

1.3 इसके अलावा, वन स्ट् पजत के मामल े में जवजनमााता को वनस्ट् पजत जनिेिक, सावािजनक जवतरण मंत्रालर्, भारत सरकार द्वारा िारी वनस्ट् पजत तले उत् पाि जनर्ंत्रण आिेि, 1975 के उपबंधों का अनपुालन करना होगा।

1.4 उत्पाि पर महत्वपूणा घटकों की मौिूि मात्रा की सूची (C/o. W/W, र्ा V/V) अवरोही क्रम में प्रिर्िात की िानी चाजहए। ऐसे घटकों की सूची को भारतीर् मानक ब् र्रूो द्वारा अजभज्ञात दकर्ा िाएगा।

1.5 उत्पाि की पैकेलिंग में उस मानिंड को संक्षेप में प्रिर्िात दकर्ा िा सकता ह ै जिसके आधार पर उत्पाि पर पर्ाावरण अनुकूल लेबल लगार्ा गर्ा ह;ै

1.6 उत्पाि की पैकेलिंग सामग्री पुनःचदक्रत (अर्ाात् जिसे दकसी अन्द् र् उपर्ोगी उत् पाि बनान े के जलए पुन:िोजधत दकर्ा िा सकता ह)ै र्ा िैवजनम्नीकृत होनी चाजहए और पैकेलिंग के जवजिष् ट मामले के संबंध में एस.एल.ई.एफ.पी. (पर्ाावरण अनुकूल उत् पािों की लेबललंग की स्ट् कीम) के तहत जवकजसत मापिंड लाग ूहोंगे।

2. जवजिष् ट अपके्षाएं :

(क )खाद्य तले श्रणेी 1 : कच् चा एव ंररफाइन्द् ड वनस्ट् पजत तले-

2.1 उत् पाि में 5पीपीबी से अजधक एफ्लाटॉजक्सन नहीं होना चाजहए।

2.2 उत् पाि में कीटनािक अविेष (र्दि कोई हो), तो खाद्य अपजमश्रण की रोकर्ाम अजधजनर्म, 1954 और इसके तहत बनाए गए जनर्मों में जनधााररत सीमाओं से अजधक नहीं होन ेचाजहए।

2.3 जवषाक् त धात ुकी सांद्रता (र्दि कोई हो) जनम् नजलजखत सीमा से अजधक नहीं होनी चाजहए :

i. सीसा 5.0 पीपीएम [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 17 ii. आसाजनक 0.5 पीपीएम iii. कैडजमर्म 1.0 पीपीएम iv. पारा 0.25 पीपीएम

2.4 खाद्य अपजमश्रण की रोकर्ाम अजधजनर्म, 1954 में अनुमत एंटीऑजक्सडेंट्स का जनर्िाष् ट मात्रा में उपर्ोग दकर्ा िाना चाजहए।

2.5 जवजनमााता द्वारा िले् फ लाइफ घोजषत की िानी चाजहए और इसे अंदकत दकर्ा िाना चाजहए। श्रणेी 2 : वनस्ट् पजत (हाइड्रोिनटेेड वनस्ट् पजत तले)-

2.1 उत् पाि में जनकल की सांद्रता 0.5 भाग प्रजत जमजलर्न से अजधक नहीं होना चाजहए।

2.2 उत् पाि हाननकर रसार्नों से मुक् त होना चाजहए।

2.3 उत् पाि में कीटनािक अविेष (र्दि कोई हो), तो खाद्य अपजमश्रण की रोकर्ाम अजधजनर्म, 1954 और इसके तहत बनाए गए जनर्मों में जनधााररत सीमाओं से अजधक नहीं होन ेचाजहए।

2.4 जवषाक् त धात ुकी सांद्रता (र्दि कोई हो) जनम् नजलजखत सीमा से अजधक नहीं होनी चाजहए :

i. सीसा 5.0 पीपीएम ii. आसाजनक 0.5 पीपीएम iii. कैडजमर्म 1.0 पीपीएम iv. पारा 0.25 पीपीएम

2.4 जवजनमााता द्वारा िले् फ लाइफ घोजषत की िानी चाजहए और इसे अंदकत दकर्ा िाना चाजहए।

2.5 खाद्य अपजमश्रण की रोकर्ाम अजधजनर्म, 1954 के तहत अनजु्ञेय एंटीऑजक्सडेंट्स ही, यदद आवश्यकता हो, उपर्ोग दकर्ा िाना चाजहए। (ख) चार्

2.1 उत्पाि स्ट् पेंट टी लीव् स, जग्रट, रेत, अन्द्र् पौधों की पजत्तर्ों िैसे जमलावट से मुक्त होना चाजहए।

2.2 उत् पाि में अप्राकृजतक सुगधं नहीं होगी और इसका जवजिष् ट स्ट् वाि होगा।

2.4 उत्पाि में कोई अजतररक्त रंग नहीं जमलार्ा िाएगा और कोई बाहरी स्ट्वाि नहीं जमलार्ा िाएगा, तर्ाजप, जनर्ाात के जलए खाद्य अपजमश्रण की रोकर्ाम अजधजनर्म, 1954 और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार इसकी अनुमजत िी िा सकती ह।ै

2.5 उत् पाि में फफंूि नहीं लगना चाजहए।

2.1 कॉफी बीन्द्स कीट, कवक और कृन्द्तकों के कारण संक्रमण से मुक्त होन ेचाजहए।

2.2 उत्पाि दकसी भी बाहरी पिार्ा िैसे तार, पत्र्र, गंिगी, लकड़ी, कांच और धात ु के टुकड़ों से मकु्त होगा।

2.3 उत्पाि को दकसी भी अजतररक्त रंग, स्ट्वाि से मुक्त होना चाजहए और र्ह बासी नहीं होना चाजहए तर्ा इसका जवजिष्ट स्ट्वाि होना चाजहए।

2.4 उत्पाि लसंहपणी और अन्द्र् िड़ों, नेरॉन, अंिीर, खिूर, पत्र्रों और अनाि िैसे जमलावट से मुक्त होगा।

1. सामान्द् र् अपके्षाएं :

1.1 जवजनमााता सभी पैकेलिंग सामग्री/पैकेि सुरक्षा, गणुवत्ता और जनष् पािन से संबंजधत बीआईएस (भारतीर् मानक ब्र्रूो) के प्रासंजगक मानकों, िहां लाग ूहो, को पूरा करेंगे।

1.2 ईकोमाका के जलए आवेिन करत े समर् जवजनमााता को पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और उसके अंतगात बनाए गए जनर्मों के तहत प्राजधकार, र्दि अपेजक्षत हो, के सार्-सार् िल (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 और वार् ु(प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 के उपबंधों के अनुसार सहमजत स्ट्वीकृजत प्रस्ट्तुत करनी होगी : इसके जअ तररक् त, जवजनमााता को, िहां भी आवश् र्क हो, खाद्य अपजमश्रण की रोकर्ाम अजधजनर्म, 1954 और इसके तहत बनाए गए जनर्मों का अनुपालन करना होना चाजहए।

1.3 उत्पाि की पैकेलिंग में उस मानिंड को संक्षेप में प्रिर्िात दकर्ा िा सकता ह ै जिसके आधार पर उत्पाि पर पर्ाावरण अनुकूल लेबल लगार्ा गर्ा ह;ै

1.4 पैकेलिंग सामग्री/पैकेि को उजचत उपर्ोग और सुरजक्षत जनपटान की पद्जत संबंधी अनुििेों के सार् बेचा िा सकता ह ैतादक उत्पाि के जनष् पािन को अजधकतम और इसकी बबाािी को न्द् र्नूतम दकर्ा िा सके ।

1.5 र्दि पैकेि के अंिर की सामग्री ईकोमाका के तहत िाजमल नहीं की गई है, तो इस बात का स्ट् पष् ट उल् लेख दकर्ा िाना चाजहए दक केवल पैकेलिंग सामग्री/पैकेि पर ही ईकोमाका लैबल लाग ूह।ै र्ह भी स्ट् पष् ट दकर्ा िाना चाजहए दक ईकामाका , उत् पाि र्ा पैकेलिंग सामग्री र्ा िोनों पर लाग ूह।ै

2. जवजिष् ट अपके्षाएं :

2.1 कागज़

2.1.1 कागज़ एवं कागज़ के बोडा से बनी पैकेलिंग सामग्री/पैकेि जनम् नजलजखत कच् चे माल से तैर्ार दकए िान ेचाजहए :

(i)100 प्रजतित रद्दी कागज़ र्ा कृजष/औद्योजगक अपजिष् ट;

(ii)बांस, ठोस लकड़ी, नरम लकड़ी और ईख के अलावा अन्द्र् सामजग्रर्ों से बने लगुिी के द्रव्यमान से न्द्र्ूनतम 60 प्रजतित;

(iii) खाद्य सामग्री की पैकेलिंग के जलए उपर्ोग दकए िान ेवाल ेकागि और कागि के [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 19 बोडा वर्िान पल्प से जनर्मात होंगे और डाइऑजक्सन से मुक्त होंगे। कागि की मुदद्रत सतहें भोिन के संपका में नहीं आएंगी और कागि में भोिन के संपका में आने की संभावना वाले िजूषत पिार्ों की अजधकतम मात्रा पररजिष्ट-I में िी गई जवजधर्ों के अनुसार परीक्षण दकए िाने पर जनम्नजलजखत ताजलका में िी गई सीमाओं से अजधक नहीं होगी सिंषूक X Y Z (जम.ग्रा.

2.1. 2 कागि और कागज़ के बोडा पैकेलिंग सामग्री/पैकेि संगत भारतीर् मानकों के अनुरूप होंगे। पैकेलिंग सामग्री/पैकेि के जवजनमााण के जलए उपर्ोग दकए िाने वाल े कागि और कागज़ के बोडा संगत भारतीर् मानकों का अनुपालन करेंगे।

2.2 ललाजस्ट्टक (लैजमनेट को छोड़कर)

2.2.1 खाद्य, औषजध, सौंिर्ा प्रसाधन और पेर्िल की पैकेलिंग के जलए प्रर्कु्त ललाजस्ट्टक पैकेलिंग सामग्री/पैकेि प्रासंजगक भारतीर् मानकों के अनुरूप होंग ेतर्ा उनका जनमााण ऐसे ललाजस्ट्टक से दकर्ा िाएगा िो प्रासंजगक भारतीर् मानकों के अनरुूप हो।

2.2.1 2.2.2 गैर-खाद्य, गैर-औषजध, गैर-सौंिर्ा प्रसाधन और गैर-परे्िल वस्ट्तओुं की पैकेलिंग के जलए प्रर्कु्त पैकेलिंग सामग्री का जनमााण पुननावीनीकृत ललाजस्ट्टक से दकर्ा िाएगा, िो दक भराव और सुिढृीकरण एिेंटों के अलावा, संगत ललाजस्ट्टक अपजिष्ट के भार का न्द्र्ूनतम 30% होगा। भाग - II: लजेमनटे और उसके उत्पाि

1. सामान्द्र् अपके्षाए:ँ

1.1 जवजिष्ट उत्पाि के जलए उनकी प्रासंजगकता के आधार पर जनम्नजलजखत आवश्र्कताएं लाग ूहोंगी (बीआईएस द्वारा जनणार् जलर्ा िाएगा)।

1.3 पैकेलिंग सामग्री/पैकेि के जनमााता को ईकोमाका के जलए आवेिन करते समर् िल (प्रिषूण की रोकर्ाम और जनर्ंत्रण) अजधजनर्म 1974, िल (प्रिषूण की रोकर्ाम और जनर्ंत्रण) उपकर अजधजनर्म 1977 और वार् ु (प्रिषूण की रोकर्ाम और जनर्ंत्रण) अजधजनर्म 1981 के प्रावधानों के अनुसार सहमजत प्रस्ट्तुत करनी होगी, सार् ही पर्ाावरण (संरक्षण) अजधजनर्म 1986 और उसके तहत बनाए गए जनर्मों के तहत प्राजधकरण, र्दि आवश्र्क हो, प्रस्ट्तुत करना होगा। इसके अजतररक्त, िहां भी आवश्र्क हो, जनमााता को खाद्य अपजमश्रण जनवारण अजधजनर्म, 1954 तर्ा उसके अंतगात बनाए गए जनर्मों के प्रावधानों का भी अनुपालन करना होगा।

1.4 पैकेलिंग सामग्री/पैकेि पर संक्षेप में वह मानिडं प्रिर्िात दकर्ा िाना चाजहए, जिसके आधार पर उसे पर्ाावरण अनुकूल के रूप में लबेल दकर्ा गर्ा ह।ै

1.5 पैकेलिंग सामग्री/पैकेि को उजचत भंडारण, उपर्ोग और सुरजक्षत जनपटान के तरीके के जनिेिों के सार् बेचा िा सकता ह ै तादक उत्पाि का प्रििान अजधकतम हो और बबाािी न्द्र्ूनतम हो।

1.6 र्ह भी उजचत रूप से उल्लेख दकर्ा िाना चाजहए दक इकोलेबल केवल पैकेलिंग सामग्री/पैकेि पर लागू होता ह,ै र्दि सामग्री को ईकोमाका के अंतगात अलग से कवर नहीं दकर्ा गर्ा ह,ै िहां भी लाग ूहो। र्ह कहा िा सकता ह ैदक ईकोमाका उत्पाि र्ा पैकेलिंग सामग्री/पैकेि र्ा िोनों पर लाग ू होता ह।ै

1.7 पैकेलिंग सामग्री /पैकेि तर्ा उस पर छपाई के जलए प्रर्कु्त स्ट्र्ाही में भारी धातुएं, (पीबी के रूप में) िब इसका आईएस 4006 (भाग - III) : 1978 में िी गई जवजध के अनुसार परीक्षण दकर्ा िाए तो 10 पीपीएम से अजधक नहीं होनी चाजहए। और आसेजनक सामग्री आईएस 1060(भाग-II) : 1960 में िी गई जवजध के अनुसार परीक्षण दकए िाने पर 1.5 पीपीएम से अजधक नहीं होनी चाजहए

1.8 अंनतम उत्पाि के जनमााता द्वारा उत्पाि, प्रदक्रर्ा और पैकेि की अनुकूलता, जिसमें उसके सबस्ट्रेट्स और जचपकान ेवाले पिार्ा भी िाजमल हैं, सुजनजश्चत की िानी चाजहए तादक उत्पाि (सामग्री) की गुणवत्ता, िहां भी लागू हो, उसके घोजषत िले्फ िीवन के अंत तक जनर्िाष्ट सीमाओं के भीतर बनी रह।े जवजनमााता को ईकोमाका के जलए आवेिन करते समर् इस आिर् का प्रमाण पत्र र्ा घोषणा के रूप में िस्ट्तावेिी साक्ष्र् उपलब्ध कराना होगा।

2. जवजिष्ट अपके्षाएँ:

2.1 लेजमनेट और उसके उत्पाि गैर-खाद्य प्रर्ोिनों के जलए पनुचाक्रणीर् र्ा पुन: प्रर्ोज्र् होन े चाजहए, जिन्द्हें सहार्क िस्ट्तावेि/प्रमाणपत्र के सार् बीआईएस के समक्ष प्रिर्िात दकर्ा िाना चाजहए।

2.2 खाद्य, औषजध, सौंिर्ा प्रसाधन और पेर्िल की पैकेलिंग के जलए प्रर्ुक्त लैजमनेट और उसके उत्पाि, इस प्रर्ोिन के जलए प्रासंजगक भारतीर् मानक में जनर्िाष्ट कचे्च माल से जनर्मात दकए िाएंगे।

2.3 गैस-द्रव क्रोमैटोग्राफी जवजध द्वारा परीक्षण दकए िाने पर लैजमनेट और उसके उत्पािों में कोई अवजिष्ट वाष्पिील काबाजनक र्ौजगक नहीं होना [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 21 चाजहए।

2.4 लेजमनेट और उसके उत्पािों में बहुत बेकार गधं नहीं होनी चाजहए। 9 इलेजक्रक/इलेक्राजनक सामान

1.3 उत्पाि पर, िहां भी लाग ूहो, महत्वपूणा घटकों/चेतावनी नोटों की सूची प्रिर्िात की िानी चाजहए, जिसका जनणार् बीआईएस द्वारा दकर्ा िाएगा।

1.4 उत्पाि पैकेलिंग पर संक्षेप में उन मानिंडों को प्रिर्िात दकर्ा िा सकता ह,ै जिनके आधार पर उत्पाि को पर्ाावरण अनुकूल लेबल दकर्ा गर्ा ह।ै

1.5 उत्पाि को उजचत उपर्ोग के जनिेिों के सार् बेचा िा सकता ह,ै तादक उत्पाि का प्रििान अजधकतम हो, बबाािी न्द्र्ूनतम हो तर्ा प्रर्कु्त उत्पाि का सुरजक्षत जनपटान हो सके।

1.6 उत्पाि पैकेलिंग के जलए प्रर्ुक्त सामग्री पुनचाक्रणीर् र्ा बार्ोजडग्रेडेबल होगी।

1.7 घरेल ूजवदु्यत/इलेक्रॉजनक उपकरण पर्ाावरण ) संरक्षण ( अजधजनर्म, 1986) के अंतगात समर्-समर् पर व्यजक्तगत उपकरण, र्दि कोई हो, के जलए अजधसूजचत ध्वजन स्ट्तर के अनुरूप होंगे।

2. जवजिष्ट अपके्षाएं:

2.1 टेलीजविन (रंगीन और ब्लैक एडं व्हाइट)

2.1.1. जवजनमााण संर्ोिन के िौरान सफाई के उद्देश्र् के जलए सीएफसी और अन्द्र् सुगंजधत-हलैोिनर्कु्त हाइड्रोकाबान का उपर्ोग नहीं दकर्ा िाएगा।

2.1.2 रंगीन टेलीजविन से जवदु्यत चुम्बकीर् जवदकरण, IS 4546:1983 में जनधााररत परीक्षण के अनुसार, IS 6842:1977 में जनर्िाष्ट सीमा से अजधक नहीं होना चाजहए।

2.1.3 रंगीन और ब्लैक एंड व्हाइट टेलीजविन ररसीवरों के जलए वाट में जनधााररत अजधकतम जवदु्यत खपत नीचे जनर्िाष्ट अनुसार होगी:

i. सीटीवी - 53 सेमी तक के स्ट्क्रीन आकार के जलए 75 वॉट; और 53 सेमी से अजधक स्ट्क्रीन आकार के जलए 100 वॉट। ii. ब्लैक एंड व्हाइट टीवी - 36 सेमी से अजधक लेदकन 51 सेमी से कम स्ट्क्रीन आकार के जलए 50 वॉट; और 51 सेमी और उससे अजधक स्ट्क्रीन आकार के जलए 75 वॉट"

2.2 जवद्यतु उपकरणों के जलए ऊिाा िक्षता/कम जबिली खपत

2.2.1 उत्पाि में ऊिाा िक्षता में कम से कम 5 प्रजतित सुधार र्ा प्रासंजगक भारतीर् मानकों में जनधााररत सीमा के अजतररक्त जबिली की खपत में 5 प्रजतित की कमी होनी चाजहए। वैकजल्पक रूप से, सौर ऊिाा का उपर्ोग करने वाले उपकरण इस खंड के तहत ईकोमाका के जलए पात्र होंगे। ऐसे मामल ेमें िहां भारतीर् मानकों में ऊिाा िक्षता और जवदु्यत खपत िोनों जनर्िाष्ट दकए गए हैं, ईकोमाका मानिंड उन्नत ऊिाा िक्षता पर आधाररत होंगे। हालाँदक, ऐसे मामलों में िहां ऊिाा िक्षता और पावर फैक्टर का गुणनफल जनर्िाष्ट दकर्ा गर्ा ह,ै जनर्िाष्ट सीमा में 5 प्रजतित सुधार ईकोमाका के जलए मानिंड होगा।

2.3 जवद्यतु प्रकार के पखंा जवजनर्ामक, मनैअुल सचंाजलत वोल्टेि स्ट्टेबलाइिर, स्ट्वचाजलत वोल्टेि स्ट्टेबलाइिर और सवो मोटर सचंाजलत वोल्टेि स्ट्टेबलाइिर।

2.3.1 उत्पाि में कम से कम 96 प्रजतित ऊिाा िक्षता होनी चाजहए। इलेक्रॉजनक प्रकार के पंखा जवजनर्ामकों के मामले में, संबंजधत भारतीर् मानक के सार्-सार् खंड 1 के तहत जनधााररत सामान्द्र् आवश्र्कताओं का अनुपालन, उन्द्हें ईकोमाका के तहत जवचार करने के जलए पर्ााप्त ह।ै [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 23

2.4 ट्यबूलर फ्लोरोसेंट लैंप

2.4.1 36 वाट (38 जममी व्यास वाले फ्लोरोसेंट ट्यूब के जलए 40 वाट के स्ट्र्ान पर) और 18 वाट (38 व्यास वाल ेफ्लोरोसेंट ट्यूब के जलए 20 वाट के स्ट्र्ान पर) रेटेड जवदु्यत खपत वाली जस्ट्लम लाइन फ्लोरोसेंट ट्यूब को ईकोमाका के जलए जवचार में जलर्ा िाएगा। 10 खाद्य र्ोज्र्

1. सामान्द्र् अपके्षाए:ँ

1.1 पेय पदाथथ, नशश ुआहार और प्रसंटकृत फल और सब्र्जी उत्पादों के सभी उत्पाद गुणवत्ता से संबंनधत बीआईएस के प्रासंनगक मानकों को पूरा करेंगे।

1.2 उत्पाि जनमााता को ईकोमाका के जलए आवेिन करते समर् पर्ाावरण (संरक्षण) अजधजनर्म 1986 और उसके अधीन बनाए गए जनर्मों के तहत आवश्र्क होन ेपर प्राजधकरण के सार्-सार् िल (प्रिषूण जनवारण एवं जनर्ंत्रण) अजधजनर्म 1974, िल (प्रिषूण जनवारण एवं जनर्ंत्रण) उपकर अजधजनर्म 1977 और वार् ु(प्रिषूण एवं प्रिषूण जनर्ंत्रण) अजधजनर्म 1981 के प्रावधानों के अनुसार सहमजत प्रस्ट्ततु करनी होगी और उत्पाि खाद्य अपजमश्रण जनवारण अजधजनर्म 1954 और उसके अधीन बनाए गए जनर्मों के अनरुूप भी होना चाजहए।

1.2 उत्पाि पैकेलिंग पर संक्षेप में उन मानिडंों को प्रिर्िात दकर्ा िाना चाजहए जिनके आधार पर उत्पाि को पर्ाावरण अनुकूल लेबल दकर्ा गर्ा ह।ै

1.3 उत्पाि पैकेलिंग के जलए उपर्ोग की िाने वाली सामग्री पुनचाक्रण र्ोग्र् र्ा बार्ोजडग्रेडेबल होगी

1.5 जवजनमााण की तारीख और समाजप्त की तारीख जनमााता द्वारा उत्पाि पैकेि पर घोजषत की िाएगी।

1.6 उत्पाि पैकेि र्ा उसके सार् दिए गए पत्रक पर उजचत उपर्ोग और भंडारण के जनिेि प्रिर्िात दकए िाने चाजहए तादक उत्पाि का प्रििान और सुरक्षा अजधकतम हो और बबाािी न्द्र्ूनतम हो।

2. जवजिष्ट अपके्षाए:ँ

2.6 2.1.3 फलों के रस के गूदे का प्रनतशत, यदद कोई नमलाया गया हो, उत्पाद पैकेर्ज पर उनल्लनखत दकया र्जाएगा।

2. जवजिष्ट अपके्षाए:ँ

2.1 ईंधन-लकड़ी के जवकल्प:

2.1.1 जिकेट को कृजष और लकड़ी के अविेषों (िैसे चूरा) और घरेलू कचरे (िैसे कचरा) से लसंर्ेरटक बाइंडरों के जबना औद्योजगक और घरेलू उपर्ोग के जलए बनार्ा िाएगा। ऐसे जिकेट दकसी भी अपजिष्ट पिार्ा से जनर्मात नहीं दकए िाएंगे जिसमें खतरनाक अपजिष्ट (प्रबंधन और हर्ालन) जनर्म, 1989 के तहत जवजनर्िाष्ट कोई खतरनाक घटक िाजमल हों।

2.2 लकड़ी की जवजनमााण सामग्री के जवकल्प

2.2.1 आम तौर पर पाटीिन करने के जलए, पैनललंग, क्लैलडगं और फाल्स सीललंग के रूप में उपर्ोग दकए िाने वाले जबलल्डंग बोडा, कृजष र्ा औद्योजगक अपजिष्टों (िैसे फॉस्ट्फो-जिलसम, लाल जमट्टी, बैगेि, कपास के डंठल, चावल की भूसी, कॉर्र फाइबर, जससल फाइबर र्ा लकड़ी के अविेष आदि) र्ा प्राकृजतक वनों के अलावा अन्द्र् स्रोतों से प्राप्त लकड़ी र्ा अलग से अजधसूजचत पर्ाावरण अनुकूल ललाजस्ट्टक से बनाए िाएंगे।

2.2.2 भवनों में उपर्ोग दकए िान े वाले िरवािे और जखड़दकर्ों के िेम और िटर, कृजष र्ा औद्योजगक अपजिष्टों र्ा लकड़ी के अविषेों र्ा प्राकृजतक वनों के अलावा अन्द्र् स्रोतों से प्राप्त लकड़ी र्ा ऊपर 2(ii)(क) में जवजनर्िाष्ट फेरोसीमेंट र्ा जबलल्डगं बोडा र्ा अलग से अजधसूजचत पर्ाावरण अनुकूल ललाजस्ट्टक र्ा प्रबजलत सीमेंट कंक्रीट से बने िेम से बनाए िाएंगे।

2.3 फनीचर में लकड़ी के जवकल्प

2.3.1 फनीचर (टेबल, कुर्सार्ां और स्ट्टूल आदि) कृजष र्ा औद्योजगक अपजिष्ट र्ा लकड़ी के अविेषों र्ा प्राकृजतक वनों के अलावा अन्द्र् स्रोतों से प्राप्त लकड़ी र्ा ऊपर 2(ii)(क) में जवजनर्िाष्ट जबलल्डंग बोडों र्ा अलग से अजधसूजचत पर्ाावरण अनुकूल ललाजस्ट्टक से बनाए िाएंगे। 12 एरोसोल प्रणोिक 1. सामान्द्र् अपेक्षाएँ:

1.1 एरोसोल उत्पािों में उपर्ोग दकए िाने वाले प्रणोिक सुरक्षा, गणुवत्ता और प्रििान से संबंजधत बीआईएस (भारतीर् मानक ब्र्ूरो) के प्रासंजगक मानकों को के अनुरूप होन े चाजहए। जवजनमााता को ईकोमाका के जलए आवेिन करत ेसमर् िल (प्रिषूण की रोकर्ाम और जनर्ंत्रण) अजधजनर्म 1974 और वार् ु (प्रिषूण की रोकर्ाम और जनर्ंत्रण) अजधजनर्म 1981 के प्रावधानों के अनुसार सहमजत मंिूरी प्रस्ट्तुत करनी होगी, सार् ही पर्ाावरण (संरक्षण) अजधजनर्म 1986 और उसके तहत बनाए गए जनर्मों के तहत प्राजधकार भी प्रस्ट्तुत करना होगा।

1.2 उत्पाि पैकेि पर र्ह उपर्ुक्त रूप से अंदकत दकर्ा िाएगा दक ईकोमाका लेबल केवल एरोसोल स्ट्प्रे में प्रर्कु्त प्रणोिकों पर ही लागू होगा, र्दि उत्पाि पैकेि ईकोमाका र्ोिना के अंतगात अलग से िाजमल नहीं दकर्ा गर्ा ह।ै

1.3 उत्पाि पैकेि र्ा उसके सार् दिए गए पत्रक पर उजचत उपर्ोग, भंडारण और जनपटान के जनिेि प्रिर्िात दकए िा सकत ेहैं तादक उत्पाि का प्रििान, सुरक्षा अजधकतम हो और बबाािी न्द्र्ूनतम हो।

1.4 उत्पाि पैकेलिंग के जलए प्रर्ुक्त सामग्री पुनचाक्रणीर् र्ा िैवजनम्नीकरणीर् सामग्री से बनी होगी।

2. जवजिष्ट अपके्षाए:ँ [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 27

2.1 एरोसोल प्रणोिकों में मॉजन्द्रर्ल प्रोटोकॉल के तहत अजभज्ञात दकए गए और एरोसोल उद्योग से संबंजधत कोई भी ओिोन परत को नुकसान पहुचंाने वाला पिार्ा (ओडीएस) नहीं होने चाजहए। 13 ललाजस्ट्टक उत्पाि 1. सामान्द्र् अपके्षाए:ँ

1.1 ललाजस्ट्टक के सभी उत्पाि गुणवत्ता, सुरक्षा और प्रििान से संबंजधत भारतीर् मानक ब्र्ूरो के प्रासंजगक मानकों को पूरा करेंगे। रे् उत्पाि जवजनमााता को ईकोमाका के जलए आवेिन करत ेसमर् िल (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 और वार् ु (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 के प्रावधानों के अनुसार सहमजत मंिूरी प्रस्ट्ततु करनी होगी, सार् ही पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और उसके तहत बनाए गए जनर्मों के तहत आवश्र्क होन ेपर प्राजधकार भी प्रस्ट्तुत करना होगा। ललाजस्ट्टक की वस्ट्तुओं के जवजनमााताओं को, िहां भी आवश्र्क हो, खाद्य अपजमश्रण जनवारण अजधजनर्म, 1954 और औषजध एवं प्रसाधन सामग्री अजधजनर्म, 1940 और उसके अंतगात बनाए गए जनर्मों के तहत जवजनर्मन के अनपुालन के संबंध में िस्ट्तावेिी साक्ष्र् प्रस्ट्तुत करना होगा।

1.2 इस उत्पाि में महत्वपूणा अवर्वों की सूची अवरोही क्रम में प्रिर्िात की िानी चाजहए, िो कुल मात्रा के प्रजतित के रूप में व्यक्त की गई हो। ऐसे अवर्वों की सूची भारतीर् मानक ब्र्रूो द्वारा अजभज्ञात की िाएगी।

1.3 इस उत्पाि पैकेलिंग पर संक्षेप में उन मानिंडों को प्रिर्िात दकर्ा िा सकता ह ै जिनके आधार पर उत्पाि को पर्ाावरण अनुकूल लेबल दकर्ा गर्ा ह।ै

1.4 इस उत्पाि पैकेलिंग के जलए इस्ट्तेमाल की िाने वाली सामग्री पुनचाक्रणीर् र्ा िैवजनम्नीकरणीर् होनी चाजहए। र्ह भी उजचत रूप से उल्लखे दकर्ा िाना चाजहए दक ईकोमाका लेबल केवल पैकेलिंग सामग्री/पैकेि पर लाग ूहोता ह ैर्दि सामग्री अलग से ईकोमाका के अंतगात नहीं आती ह।ै र्ह कहा िा सकता ह ै दक ईकोमाका उत्पाि र्ा पैकेलिंग सामग्री र्ा िोनों पर लागू होता ह।ै

2. जवजिष्ट अपके्षाए:ँ • 2.1 खाद्य, िवा और परे्िल ग्रडे ललाजस्ट्टक उत्पाि • 2.1.1 इन वस्ट्तओुं के जवजनमााण के जलए जनम्नजलजखत भारतीर् मानकों में िाजमल एक र्ा अजधक उपर्ोग नहीं की गई वस्ट्तुओं का उपर्ोग दकर्ा िाएगा:

i. बागवानी की आपूर्ता। ii. कंटेनर उत्पािन । 28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] iii. कार्ाालर्ों में आपूर्ता। iv. गैर-खाद्य कंटेनर। v. मनोरंिन उपकरण और फनीचर। vi. जनमााण सामग्री। बागवानी आपूर्ता में बागवानी गजतजवजधर्ों में उपर्ोग दकए िाने वाल ेसभी उपकरण, कंटेनर और सहार्क संरचनाएं िाजमल हैं, िैसे फूलों के गमल,े बगीचे के डंड ेऔर बेरी रे। उत्पाि कंटेनरों में कृजष उत्पािों िैसे अंड,े फल और सजब्िर्ों के कंटेनर िाजमल हैं। कार्ाालर् आपूर्ता में कार्ाालर्ों में उपर्ोग के जलए सभी उपकरण, कंटेनर और सहार्क संरचनाएं िाजमल हैं िैसे दक प्रिेेंटेिन फोल्डर, फाइल फोल्डर और बाइंडर कवर। गैर-खाद्य कंटेनर, िो सामग्री रखने के जलए नहीं हैं, में गरै-खाद्य उत्पािों के सभी कंटेनर िाजमल हैं, िैसे जडटिेंट की बोतलें, पलैेट और पनु: प्रर्ोज्र् पकेैलिंग कंटेनर। मनोरंिनात्मक उपकरण और फनीचर में मनोरंिनात्मक बािार के जलए जडिाइन दकए गए सभी उपकरण और सहार्क संरचनाएं िाजमल हैं, िैसे खेल के मैिान के उपकरण और आगँन की मेिें। जनमााण सामग्री में संरचनाओं के जनमााण में प्रर्कु्त सभी सामजग्रर्ां िाजमल हैं, चाह े वे जस्ट्र्र हों र्ा पररवहन र्ोग्र्, िैसे लकड़ी, बाड़ र्ा लिगंल्स।

2.2.1 उप-श्रेजणर्ों 2.2(i) से 2.2(v) में अजभज्ञात गए ललाजस्ट्टक उत्पाि, भराव और सुिढृीकरण एिेंटों के अलावा, विन के जहसाब से न्द्र्ूनतम 90 प्रजतित संगत ललाजस्ट्टक अपजिष्ट से बनाए िाएगंे।

2.2.2 उप-श्रणेी 2.2(vi) में पहचाने गए ललाजस्ट्टक उत्पाि, भराव और सुिढृीकरण एिेंटों के अलावा, विन के जहसाब से न्द्र्ूनतम 60 प्रजतित र्ा संगत ललाजस्ट्टक अपजिष्ट से बने होंगे। 14 वस्त्र 1. सामान्द्र् अपके्षाए:ँ

1.1 रे् जवजनर्मात सभी वस्त्र उत्पाि भारतीर् मानक ब्र्रूो के प्रासंजगक मानकों के अनुरूप होन ेचाजहए। उत्पाि जवजनमााता को ईकोमाका के जलए आवेिन करते समर् िल (प्रिषूण जनवारण एवं जनर्ंत्रण) अजधजनर्म 1974 और वार् ु (प्रिषूण जनवारण एवं जनर्ंत्रण) अजधजनर्म 1981, िल (प्रिषूण जनवारण एवं जनर्ंत्रण) उपकर अजधजनर्म, 1977 के प्रावधानों के अनुसार सहमजत मंिूरी प्रस्ट्तुत करनी होगी, सार् ही पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और उसके तहत बनाए गए जनर्मों के तहत प्राजधकार भी प्रस्ट्तुत करना होगा। इसके अजतररक्त, जवजनमााता को कारखाना अजधजनर्म, 1948 और उसके अंतगात बनाए गए जनर्मों के प्रावधानों के अतंगात ध्वजन स्ट्तर और व्यावसाजर्क स्ट्वास्ट््र् से संबंजधत प्रावधानों के अनुपालन पर िस्ट्तावेिी साक्ष्र् प्रस्ट्ततु करना होगा। • 1.2 उत्पाि पैकेलिंग पर संक्षपे में उन मानिंडों को प्रिर्िात दकर्ा िा सकता ह ैजिनके आधार पर उत्पाि को पर्ाावरण अनुकूल लेबल दकर्ा गर्ा ह।ै • 1.3 उत्पाि पैकेलिंग के जलए प्रर्ुक्त सामग्री पुन: प्रर्ोज्र् होगी र्ा पनुचाक्रणीर् र्ा िैवजनम्नीकरणीर् सामजग्रर्ों से बनी होगी। • 1.4 िहां भी आवश्र्क हो, वसार्ुक्त अल्कोहल आधाररत गैर-आर्जनक पार्सीकारक का उपर्ोग दकर्ा िाना चाजहए।

G.S.R. 596(E).—WHEREAS the Government of India in the Ministry of Environment, Forest, and Climate Change intends to encourage the demand for environment-friendly products that cause lesser adverse impacts on the environment, thereby, supporting the principles of 'LIFE (Lifestyle for Environment)’, promote lower energy consumption, resource efficiency and conservation, circular economy and prevent misleading information on environmental aspects of products;

AND WHEREAS eco-labelling of products enables consumers to make informed purchase decisions as well as encourage manufacturers to transition to production of environment-friendly products leading to promotion of green industries;

AND WHEREAS the Ecomark may be granted to products that meet specified environmental criteria with respect to resource consumption and environmental impacts, in particular the impact on climate change, impact on nature and biodiversity energy consumption, generation of waste, emissions to all environmental media, pollution through physical effects and use and release of hazardous substances;

AND WHEREAS the draft Ecomark Certification Rules, 2023 were published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide notification number S.O. 4441(E), dated the 11 th October, 2023 inviting objections and suggestions from all persons;

AND WHEREAS all the objections and suggestions received have been duly considered by the Central Government;

NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clause (ii) of sub-section (2) of section 3, sub-section (1) of section 6, section 23 and sub-section (1) of section 25 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby makes the following rules, namely:-

1. Short title and commencement. – (1) These rules may be called the Ecomark Rules, 2024.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Definitions. – In these rules, unless the context otherwise requires,-

(a) "Act" means the Environment (Protection) Act, 1986 (29 of 1986);

(b) "product" means a product specified under column (2) the First Schedule;

(c) "registered agency" means an agency registered under sub-rule (2) of rule 13;

(d) "Schedule" means a Schedule appended to these rules;

(e) "Verifier" means an entity registered as Verifier under rule 12.

3. Conditions for grant of Ecomark. – (1) An Ecomark may be granted to a product which has a license or a certificate of conformity of Indian Standards granted under the Bureau of Indian Standards Act, 2016 and/or a mandate of the Quality Control Orders issued by the Central Government, and fulfils the criteria for grant of Ecomark specified under the corresponding entries under column (3) of the First Schedule.

(2) Criteria for grant of an Ecomark specified under the First Schedule may include the following:- a. reduces the pollution by minimising or eliminating the generation of waste and environmental 40 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] emissions;

b. is recyclable or is made from recycled material or both;

c. reduces the use of non-renewable resources, including non-renewable energy sources and natural resources;

d. reduces the use of any material, which has adverse impacts on the environment;

(3) While developing criteria for grant of Ecomark to a product, the following may be taken into consideration, namely:- a. production process, including source of raw material;

b. use of natural resources;

c. environmental impact;

d. effect and extent of emissions or waste arising from the production process;

e. disposal of the product and its packaging;

f. compliance with the Guidelines on Extended Producer Responsibility, wherever applicable;

g. utilisation of waste and recycled materials;

h. suitability for recycling; and i. use of non-hazardous substances in place of hazardous substances.

4. Procedure for grant of Ecomark. –(1) An application for grant of Ecomark for a product which complies with the conditions under rule 3 shall be made to the Central Pollution Control Board in Form 1.

(2) On receipt of the application, the Central Pollution Control Board shall, by itself or through a Verifier, verify whether the product complies with the conditions under rule 3.

(3) After making such verification under sub-rule (2) as may be necessary, the Central Pollution Control Board shall prepare a report, or in case the verification is done by a Verifier, the Verifier shall prepare a report and submit to the Central Pollution Control Board, within a period of sixty days from the date of such verification.

(4) On receipt of the report, if the Central Pollution Control Board is satisfied that the product complies with the conditions under rule 3. it may grant Ecomark to the product.

(5) The Ecomark granted under sub-rule (4) shall be valid for a period of three years or until change in Ecomark criteria for the product, whichever is earlier.

(6) An application for the renewal of the Ecomark may be made to the Central Pollution Control Board upon its expiry and the provisions of sub-rules (1) to (5) of this rule and rule 3 shall apply.

(7) Every holder of Ecomark shall submit on or before the 31 st May of every year, an annual report to the Central Pollution Control Board online through the web portal for the period commencing from the 1 st April of the previous year to the 31 st March of succeeding year in respect of the product as per the pro forma, prescribed by CPCB, on the Ecomark portal, and the Central Pollution Control Board shall examine such reports and forward a compilation thereof with their recommendations, if any, to the Ministry of Environment, Forest & Climate Change on or before the 31 st July of every year.

5. Cancellation of Ecomark. – (1) If the Central Pollution Control Board is satisfied that the holder of an Ecomark has furnished false information or has wilfully concealed any information required to be furnished under these rules, it may, after giving the holder of Ecomark an opportunity to be heard, and by order, for reasons to be recorded in writing, suspend or cancel the Ecomark.

(2) The holder of Ecomark, if aggrieved by an order made under sub-rule (1), may prefer an appeal to the Central Government in Form 2 within a period of thirty days from the date of receipt of the order of such suspension or cancellation.

(3) The Central Government may entertain an appeal after the expiry of the said period of thirty days, if the holder of Ecomark satisfies the Central Government that he had sufficient cause for not preferring the appeal within such period.

(4) The Central Government after giving the holder of Ecomark an opportunity to be heard and after such enquiry, as it deems fit, may make such order as it may consider necessary.

6. Use of Ecomark. – (1) Every person who has been granted an Ecomark in respect of a product shall affix on such product an Ecomark label granted under these rules.

(2) No person shall use the Ecomark on any product unless he has been granted an Ecomark in respect of such product.

7. Steering Committee. – (1) The Central Government shall constitute a Steering Committee which shall be responsible for the effective implementation of these rules.

(2) The Steering Committee shall consist of the following persons, namely:- a. the Secretary, Ministry of Environment, Forest and Climate Change Chairperson, ex officio;

b. the Additional Secretary or Joint Secretary (In-Charge Ecomark), Ministry of Environment, Forest and Climate Change - Member, ex officio;

c. the Joint Secretary to the Government of India in the Ministry of Consumer Affairs, Food and Public Distribution, Department of Consumer Affairs - Member, ex officio;

d. one representative, not below the rank of Joint Secretary, each of-

(i) the Department for Promotion of Industry and Internal Trade Member, ex officio:

(ii) the Ministry of Information and Broadcasting - Member, ex officio;

(iii) the Department of Chemicals and Petrochemicals - Member, ex officio:

(iv) the Department of Agriculture and Farmers Welfare - Member, ex officio,

(v) the Department of Health and Family Welfare - Member, ex officio:

(vi) the Ministry of Micro Small and Medium Enterprises - Member, ex officio,

(vii) the Ministry of Power - Member, ex officio;

(viii) the Department of Drinking Water and Sanitation - Member, ex officio;

(ix) the Department of Expenditure - Member, ex officio;

(x) the Ministry of External Affairs - Member, ex officio;

(xi) the Department of Commerce - Member, ex officio;

(xii) the Ministry of Textiles - Member, ex officio;

(d) the Director General, Council of Scientific and Industrial Research - Member, ex officio;

(e) the Director General, Bureau of Indian Standards - Member, ex officio;

(f) the Chairman, Central Pollution Control Board Member, ex officio;

(g) two experts from the field of environmental standardisation-Members; and

(h) two representatives of the Industry Associations - Members.

(3) The Steering Committee may, with the prior approval of the Chairperson, invite or co-opt any other person to the meetings of the Steering Committee.

(4) The term of the Steering Committee shall be five years.

8. Functions of Steering Committee. – (1) The Steering Committee shall recommend for approval of the Central Government, in respect of the following, namely :-

(a) the products to be included under these rules for the grant of Ecomark on the basis of the recommendation of the Central Pollution Control Board:

(b) the measures to be adopted and the manner of promotion of the Ecomark;

(c) make periodic review of the criteria for grant of Ecomark and make recommendation to the Central Government;

(d) the measures for support of any research for verification of product of its impact on environment or revision of criteria for grant of Ecomark.

(2) The Steering Committee shall review the annual reports submitted by the holders of Ecomark and any 42 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] recommendation made by the Central Pollution Control Board thereon for the effective and efficient monitoring and implementation of these rules.

(3) The Steering Committee shall carry out any other function assigned to it by the Central Government.

9. Functions of Central Pollution Control Board. – (1) The functions of the Central Pollution Control Board shall include the following, namely: -

(a) identification and recommendation to the Steering Committee of the products to be included under these rules for the grant of Ecomark:

(b) review and develop the criteria for grant of Ecomark, based on the knowledge available, technological and market developments, and the criteria being followed in other countries and make recommendation to the Steering Committee;

(c) develop initiatives for consideration of the Steering Committee to incentivize adoption of Ecomark;

(d) registration of Verifiers and agencies;

(e) compile the annual reports submitted by the Ecomark Certificate Holders for submission to the Ministry of Environment, Forest & Climate Change by 31 st July of the next financial year;

(f) assess domestic or international voluntary ecolabelling programme, for recognition under these rules;

(g) assess international ecolabelling programme, for mutual recognition;

(h) any other function as assigned by the Steering Committee or the Central Government.

10. Technical Committee. - (1) The Central Pollution Control Board may with the approval of the Central Government constitute Technical Committee consisting of such experts and/ or expert organizations as it may consider necessary which shall assist the Central Pollution Control Board in the implementation of these rules.

(2) The Technical Committee may also assist the Central Pollution Control Board in the following matters, namely:

(a) review and development of the criteria for grant of Ecomark for products;

(b) development of the process of verification of products for grant of Ecomark;

(c) advise on any technical matter referred to it by the Central Pollution Control Board.

(3) The term of the Technical Committee shall be five years.

11. Web portal for Ecomark. – (1) The Central Pollution Control Board shall develop a web portal for making applications and for grant of Ecomark, submission of annual reports by the holder of the Ecomark, Verifier and agency registered under these rules, registration of Verifiers and auditors as well as of agencies for effective monitoring of the products for compliance with the conditions for Ecomark under these rules.

(2) Every holder of Ecomark, Verifier and agency registered under these rules shall submit on or before the 31 st May of every year, an annual report to the Central Pollution Control Board online through the web portal for the period commencing from the 1st April of the previous year to the 31 st March of succeeding year in respect of the activities performed by them during the said period, as per prescribed pro forma on the Ecomark portal developed by the Central Pollution Control Board.

(3) The Central Pollution Control Board shall publish on the web portal the information in respect of the following, namely: -

(a) the details of each holder of Ecomark and the product in respect of which the Ecomark has been granted under these rules;

(b) a list of products which have been granted Ecomark under these rules;

(c) the report in respect of each product on the basis of which such Ecomark has been granted to the product under these rules;

(d) reports of research and studies undertaken in respect of a product and its impact on the environment;

(f) global best practices in respect of each product granted with the Ecomark under these rules.

12. Verifiers. – (1) The Central Pollution Control Board shall register such entities having qualification and experience in the field of environment and matters relating to Ecomark as Verifiers as it may consider necessary for the purposes of verification of the products for the grant of Ecomark and its renewal under these rules.

(2) Every Verifiers shall submit an annual report to the Central Pollution Control Board on or before the 31st May of the succeeding year in respect of activities done by such Verifier in the previous year.

13. Compliance of products with Ecomark. -(1) The Central Pollution Control Board may on its own volition or on a complaint received by it, inspect and verify by itself or through a registered agency, any product that has been granted Ecomark for compliance with the conditions under these rules.

(2) The Central Pollution Control Board shall register such agencies, having relevant expertise and experience for inspection and verification of Ecomark criteria in respect of each product, as it may consider necessary for the purposes of these rules.

(3) The registered agency shall, upon such inspection and evaluation of the product, submit its report to the Central Pollution Control Board.

(4) The Central Pollution Control Board shall inform the holder of the Ecomark of any complaints in respect of the product and shall require him to submit his reply.

(5) The holder of Ecomark shall allow the Central Pollution Control Board or the registered agencies to undertake such inspection and verification as may be considered necessary for ensuring compliance with the conditions under these rules.

(6) The holder of the Ecomark shall grant access to the premises in which the product concerned is produced or kept to the Central Pollution Control Board and the registered agency.

(7) Every registered agency shall submit an annual report to the Central Pollution Control Board on or before the 31st May of every year in respect of the activities undertaken by it in the previous year.

14. Role of State Government/Union Territories. – (1) The State Pollution Control Board and the Pollution Control Committee shall create awareness about these rules through media, publications, advertisements, posters or by such other means of communication as may be considered appropriate.

(2) The State Pollution Control Board and the Pollution Control Committee shall undertake activities, including in respect of awareness, for effective implementation of these rules as may be recommended by the Steering Committee and approved by the Central Government.

15. Committee of Implementation. – (1) A Committee shall be constituted under chairpersonship of Chairman, Central Pollution Control Board to recommend measures to Steering Committee for effective implementation of the Ecomark Rules;

(2) The Committee shall monitor the implementation of the Ecomark Rules and also take such measures as required for removal of difficulties;

(3) The Committee shall also be tasked with the guiding and providing recommendations for the development and operation of the online portal;

(4) The Committee shall comprise of representatives of the concerned Ministries/Departments, representatives of industry associations and other relevant stakeholders. The Chairperson of the Committee may co-opt any stakeholder/expert to this Committee.

THE FIRST SCHEDULE [See rules 2(d) and 3(1)(f)] PRODUCTS AND CRITERIA FOR GRANT OF ECOMARK Product Criteria for grant of Ecomark

(1) (2) (3)

1. Architectural paints and powder coating

1. GENERAL REQUIREMENTS:

1.1 All formulations of paints shall meet relevant standards of Bureau of Indian Standards pertaining to quality and performance.

1.2 The product manufacturer must produce the consent clearance as per the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 along with the authorisation, if required, under Environment (Protection) Act, 1986 and rules made thereunder to 44 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Bureau of Indian Standards while applying for the ECOMARK.

1.3 The product must display a list of critical ingredients in descending order of quantity present. The list of such ingredients shall be identified by Bureau of Indian Standards.

1.4 The product packaging may display in brief the criteria based on which the product has been labelled as Environment Friendly.

1.5 The product may be sold along with instructions for proper use so as to maximise product performance and minimise wastage.

1.6 The material used for product packaging shall be recyclable, reusable or biodegradable.

2. SPECIFIC REQUIREMENTS:

2.1. Water based Coatings (inclusive of dry distemper and cement paints)

2.1.1 The product shall not contain more than 5 per cent volatile organic compounds (VOC).

2.1.2 Product shall not be formulated with mercury and mercury compounds or be tinted with pigments of lead, cadmium, chromium VI and their oxides. Excluded are natural impurities or impurities entailed by the production process up to the amount of 0.1 percent by weight which are contained in the raw material.

2.1.3 The product shall not be formulated or manufactured with:

i. Free formaldehyde in excess of 10 mg per kg. of paint ii. halogenated solvents iii. benzene & poly-aromatic hydrocarbons iv. and other aromatic hydrocarbons

2.2. Powder Coatings

2.2.1 The product shall be free from any VOC (Volatile Organic Compounds).

Product shall not be formulated with mercury and mercury compounds or be tinted with pigments of lead, cadmium, chromium VI and their oxides. Excluded are natural impurities or impurities entailed by the production process up to the amount of 0.1 percent by weight which are contained in the raw material.

2.2.2 The product shall not be formulated or manufactured with free formaldehyde in excess of 10 mg per kg of paint.

2.3 Solvent based high solid coatings.

2.3.1 The product shall not contain volatile organic compounds (VOC) in excess of 380 g/l.

2.3.2.3.2 Product shall not be formulated with mercury and mercury compounds or be tinted with pigments of lead, cadmium, chromium VI and their oxides. Excluded are natural impurities or impurities entailed by the production process up to the amount of

0.1 percent by weight which are contained in the raw material.

2.3.3 The product shall not be formulated or manufactured with:

i. free formaldehyde in excess of 10 mg per kg. of paint ii. halogenated solvents iii. benzene & poly-aromatic hydrocarbons, and iv. other aromatic hydrocarbons in excess of 10 percent by weight 2 Cosmetics 1. GENERAL REQUIREMENTS:

1.1 All the products manufactured shall meet the requirements of following Indian Standards of BIS pertaining to safety, quality and performance:

i. Skin Powder IS 3959:1978 ii. Skin Powder for infant IS 5399:1978 iii. Tooth Powder IS 5383:1978 iv. Tooth Paste IS 6356:1993 v. Skin Cream IS 6608:1978 vi. Hair oil IS 7123:1993 vii. Shampoo Soap based IS 7669:1990 [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 45 viii. Shampoo Synthetic Detergent based IS 7884:1992 ix. Hair Cream IS 7679:1978 x. Oxidation Hair dye liquid IS 8481:1993 xi. Cologne IS 8482:1977 xii. Nail Polish (Nail Enamel) IS 9245:1993 xiii. After Shave Lotion IS 9255:1979 xiv. Pomades and Brilliantines IS 9339:1988 xv. Depliatories chemical IS 9636:1988 xvi. Shaving Cream IS 9740:1981 xvii. Cosmetic pencil IS 9832:1981 xviii. Lipstick IS 9875:1990

1.2 All the ingredients that go into formulation of cosmetics shall comply with the provisions prescribed in IS 4707 (Part-I) : 1988 and IS 4707 (Part-II) : 1993 as well as the product specific requirements.

1.3 The product package shall display a list of critical ingredients in descending order of quantity present.

1.4 The list of such ingredients shall be identified by BIS. The product manufacturer must produce the consent clearance as per the provisions of Water (Prevention and Control of Pollution) Act 1974, Water (Prevention and Control of Pollution) Cess Act 1977 and Air (Pollution and Control of Pollution) Act 1981 along with the authorisation if required under Environment (Protection) Act 1986 and rules made thereunder to Bureau of Indian Standards while applying for the ECOMARK.

Additionally, provisions of the Drugs and Cosmetics Act, 1940 and rules made thereunder shall also be complied with

1.5 The product package shall be suitably marked that ECOMARK label is applicable only to the content if the product package is not separately covered under the ECOMARK Scheme.

1.6 The material used for product packaging shall be recyclable, reusable or biodegradable.

1.7. The product packaging may display in brief the criteria based on which the product has been labelled Environment Friendly.

2. SPECIFIC REQUIREMENTS:

2.1 Product shall be dermatological safe when tested by the method prescribed by IS 4011:1982

2.1.1 Biodegradability of surfactant agents wherever used in cosmetics formulation shall be as per the limit finalised for Ecomark for synthetic detergents.

2.1.2 Heavy metals calculated as Lead (Pb) and Arsenic (As2O3) shall not exceed 20 ppm and 2 ppm, respectively when tested by the respectively methods prescribed in Indian Standards.

2.1.3 2.1.3 STooth Paste/Tooth Powder: For the purpose of formulation of these products, the ingredients listed in IS 6356:1993 and IS 5383:1978 shall only be used.

However, tooth paste shall not be fluoridated and presence of fluoride (F) as impurity shall not exceed the limit of 25 ppm when tested by the method prescribed in Indian Standards.

2.1.4 Hair Dyes: Lead based dyes shall not be used.

2.1.5 Nail Polish: Halogenated organic solvents shall not be used.

3 Batteries A. Automotive Lead-Acid Batteries

1. GENERAL REQUIREMENTS:

1.1 The automotive lead-acid batteries shall meet the relevant standards of Bureau of Indian Standards.

1.2 The product manufacturer must produce the consent clearance, as per the provisions of Water (PCP) Act 1974, Water (PCP) Cess Act 1977 and Air (PCP) Act 1981 along with the authorisation if required under 46 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Environment (Protection) Act 1986 and rules made thereunder.

1.3 The product packaging may display in brief the criteria based on which the product has been labelled environment friendly.

1.4 The product may be sold along with instructions for proper use so as to maximise the product performance and safe disposal.

1.5 The material used for product packaging shall be recyclable or biodegradable.

1.6 The manufacturer shall organise the collection pay back system for the used batteries and provide documentary evidence by way of certificate or declaration to this effect while applying for Ecomark.

2. PRODUCT SPECIFIC REQUIREMENTS:

2.1 Automotive Lead-Acid Batteries:

2.1.1 The quantity of lead used, in kg per battery (A), charged battery weight with electrolyte in kg (B) and Ratio A:B shall not exceed the limits given below:

2.1.2 Lead used in batteries shall be recovered/manufactured through a process complying under the provisions of Water (Prevention & Control of Pollution) Act 1974, Water (Prevention & Control of Pollution) Cess Act 1977 and Air (Prevention & Control of Pollution) Act 1981 along with the authorisation if required under Environment (Protection) Act 1986 and rules made thereunder.

2.1.3 The manufacturer of 'Oxide' as well as ‘Grid' plates of the battery shall ensure full compliance of the provision under Water (PCP) Act 1974, Water (PCP) Cess Act 1977 and Air (PCP) Act 1981 along with the authorisation if required under Environment (Protection) Act 1986 and rules made thereunder.

2.1.4 The product shall contain the following percentage of recycled lead (from post-consumer lead) measured ever a period of 3 months (as a rolling average), where 100 percent is the total amount of lead contained in the batteries manufactured during the quarter:

i. up to 1 year 25% minimum ii. up to 2 years 40% minimum iii. up to 3 years 50% minimum B. Dry Cell Batteries

1. GENERAL REQUIREMENTS:

1.1 The dry cell batteries shall meet the relevant standards of Bureau of [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 47 Indian Standards.

1.2 The product manufacturer must produce the consent clearance, as per the provisions of Water (PCP) Act 1974, Water (PCP) Cess Act 1977 and Air (PCP) Act 1981 along with the authorisation if required under Environment (Protection) Act 1986 and rules made thereunder.

1.3 The product packaging may display in brief the criteria based on which the product has been labelled environment friendly.

1.4 The product may be sold along with instructions for proper use so as to maximise the product performance and safe disposal.

1.5 The material used for product packaging shall be recyclable or biodegradable.

1.6 The manufacturer shall organise the collection pay back system for the used batteries and provide documentary evidence by way of certificate or declaration to this effect to Bureau of Indian Standards while applying for Ecomark.

2. PRODUCT SPECIFIC REQUIREMENTS:

2.1 Non-rechargeable dry cell batteries: The amount of mercury in batteries shall not exceed 0.005 per cent by weight.

2.2 Re-chargeable dry cell batteries: The re-chargeable batteries shall not contain more than 0.005 per cent of mercury.

4 Lubrication Oils

1. GENERAL REQUIREMENTS:

1.1. All lubricating/speciality oils shall meet relevant Indian Standards notified by Bureau of Indian Standards (BIS).

1.2. The product manufacturer must produce the consent clearance as per the provision of Water (Prevention and Control of Pollution) Act, 1974, Water (Prevention and Control of Pollution) Cess Act, 1977 and Air (Prevention and Control of Pollution) Act, 1981 respectively along with the authorisation, if required under Environment (Protection) Act, 1986 and rules made thereunder to Bureau of Indian Standards while applying for the Ecomark.

1.3. The product must display the list of critical ingredients in descending order of quantity present in per cent by weight, to be decided by BIS.

1.4. The product packaging may display in brief the criteria based on which the product has been labelled Environment Friendly.

1.5. The material used for product packaging shall be recyclable, reusable or biodegradable.

1.6. The product package or leaflet accompanying it may display instructions of proper use, storage, transport and recommend disposal guidelines after use and safe handling precautions so as to maximise the product performance and minimise wastage.

2. PRODUCT SPECIFIC REQUIREMENTS:

2.1.1 Lubricating Oils (Virgin) Following categories of oil are included:

a) Lubricants: Vegetable Oil based b) Lubricants: Other than Vegetable Oil based

2.1.2 The product must not have toxic effect on aquatic organisms. EC 50/LC 50 shall not be less than 1.0 mg/litre.

2.1.3 The base oil, additives and formulated products must have per cent biodegradability as mentioned below:

i. Lubricants (Vegetable Oil based) 90% ii. Lubricants (other than Vegetable Oil based) 60% The above mentioned per cent biodegradability shall be tested as per OECD test method CEC-L-33-T-82, 21 days.

2.1.4 The product shall not contain toxic metals such as lead and barium.

Antimony shall not be used in concentration beyond 0.25% when tested as per AAS method. The product must not contain halogenated products such as PCBs, PCTs and PBTs as well as Nitrites.

2.2 Formulated Lubricants from Re-claimed/Re-refined Oils.

2.2.1 The product shall contain more than 50% by volume re-refined/recycled products, reclaimed through environmentally compatible re-refining process.

2.2.2 The product shall meet the product specific requirements as per lubricating oils (Virgin) 5 Soaps and Detergents A. TOILET SOAPS

1. GENERAL REQUIREMENTS:

i) All toilet soaps shall meet relevant standards of Bureau of Indian Standards as amended from time to time pertaining to quality, safety and performance.

ii) The manufacturers must produce the consent clearance as per the provisions of Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 respectively along with the authorisation, if required, under the Environment (Protection) Act, 1986 to BIS while applying for ECOMARK;

iii) The product must display a list of critical ingredients in descending order of quantity present in per cent by weight. The list of such critical ingredients shall be identified by Bureau of Indian Standards;

iv) The product packaging material shall be made from recyclable, reusable or biodegradable material;

v) The product packaging may display in brief the criteria based on which the product has been labelled Environment Friendly; and vi) The product may be accompanied by detailed instructions for proper use so as to maximise product performance and minimise wastage.

2. PRODUCT SPECIFIC REQUIREMENTS:

(a) Product formulated or manufactured shall not contain phosphates and synthetic detergents.

(b) Product shall be dermatologically safe when tested by the methods given in DOC: CHD 025(0236).

B. DETERGENTS

1. GENERAL REQUIREMENTS:

i) All detergent formulations for house-hold and industrial use shall meet relevant standards of Bureau of Indian Standards (BIS) as amended from time to time, pertaining to quality, safety and performance.

ii) The manufacturers must produce the consent clearance from the concerned State Pollution Control Board as per the provisions of Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 respectively along with the authorization, if required, under the Environment (Protection) Act, 1986 to BIS while applying for ECO Mark;

iii) The product must display a list of critical ingredients in descending order of quantity present in per cent by weight. The list of such critical ingredients shall be identified by the BIS;

iv) The product packaging may display in brief the criteria based on which the product has been labelled Environment Friendly;

v) The product may be accompanied by detailed instructions for proper use so as to maximise product performance and minimise wastage; and vi) The product packaging material shall be made from recyclable, reusable or biodegradable material.

2. PRODUCT SPECIFIC REQUIREMENTS:

(a) Product shall not contain phosphates. Any other substitutes may be used which shall be environment friendly.

(b) The safety on use of the product shall be evaluated as per the methods given in BIS standards as amended from time to time:

(i) The safety evaluation pertaining to irritant potention according to IS 11601 (Part I)- 1990 and

(ii) Skin sensitization potential according to IS:11601 (Part II)-1991, and

(c) Skin sensitisation potential according to IS: 11601 (Part II) - 1991 and Product shall be formulated or manufactured with readily biodegradable surfactants when tested by modified strum test as prescribed in the Indian Standard.

C. LAUNDRY SOAPS

1. GENERAL REQUIREMENTS:

i) All laundry soaps shall meet relevant standards of Bureau of Indian Standards as amended from time to time pertaining to quality, safety and performance:

ii) The manufacturers must produce the consent clearance as per the provisions of Water (Prevention and Control of Pollution) Act, 1974, Water (Prevention & Control of Pollution) Cess Act 1977 and Air (Prevention and Control of Pollution) Act, 1981, along with the authorisation, if required, under the Environment (Protection) Act, 1986.

iii) The product must display a list of critical ingredients in descending order of quantity present in per cent by weight. The list of such critical ingredients shall be identified by the Bureau of Indian Standards.

iv) The material used for product packaging material shall be made from recyclable, reusable or biodegradable material and the parameters evolved under the scheme of labelling environment friendly products on specific subject of packaging shall apply.

v) The product packaging may display in brief the criteria based on which the product has been labelled Environment Friendly.

vi) The product may be accompanied by detailed instructions for proper use so as to maximise product performance and minimise wastage; and vii) Product formulated or manufactured shall not contain phosphates.

viii) The non-soapy detergent (NSD) if used in the manufacture of laundry soaps shall be readily biodegradable when tested by modified sturm test as prescribed in the Indian Standard.

ix) The material shall pass the test when evaluated for irritant potential as per the method prescribed in IS 11601 (Part-1) : 1986 and skin sensitisation potential when evaluated as per the method prescribed in IS 11601 (Part-2) : 1992.

6 Paper 1. GENERAL REQUIREMENTS:

i) All the paper manufacturers shall meet relevant Indian Standards of Bureau of Indian Standards (BIS) pertaining to quality and performance.

ii) The product manufacturers must produce the consent clearance as per the provisions of Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981, respectively along with the authorisation, if required, under Environment (Protection) Act, 1986 and rules made thereunder to BIS while applying for ECOMARK.

iii) The product packaging may display in brief the criteria based on which the product has been labelled Environment Friendly.

iv) The material used for product packaging shall be made from recyclable, reusable or biodegradable material and the parameters evolved for the packaging shall also apply.

2. SPECIFIC REQUIREMENT:

(i) The paper and paper boards manufactured out of pulp containing not less than 60 percent by weight of pulp made from materials other than bamboo, hard woods, soft woods and Reed.

(ii) Recycled paper and paper board must be made from 100 percent waste paper.

7 Food Items A. Edible Oils, Tea and Coffee 50 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

1. GENERAL REQUIREMENTS:

(i) All formulation of edible oils, tea and coffee shall meet relevant standards of Bureau of Indian Standards pertaining to quality.

(ii) The product manufacturers must produce the consent clearance as per the provisions of Water (Prevention and Control of Pollution) Act, 1974, Air (Prevention and Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Cess Act, 1977, respectively along with the authorisation, if required, under Environment (Protection) Act, 1986 and rules made thereunder while applying for ECOMARK : and the product shall be in accordance with the Prevention of Food Adulteration Act 1954 and the rules made thereunder unless otherwise specified. Additionally, in case of Vanaspati, the manufacturer shall comply with the provisions under Vegetable Oil Products Control Order 1975 issued by the Director of Vanaspati, Ministry of Civil Supplies, Government of India.

(iii) The product must display a list of critical ingredients in descending order of quantity present (C/o. W/W, or V/V). The list of such Ingredients shall be identified.

(iv) The product packaging may display in brief the criteria based on which the product has been labelled environment friendly.

(v) The material used for product packaging shall be recyclable (i.e. which can be reprocessed to manufacture any other useful product) or biodegradable and the parameters evolved under the SLEFP (scheme on labelling of environment-friendly products) on the specific subject of packaging shall apply.

2. PRODUCT SPECIFIC REQUIREMENTS:

A. Edible Oils Category 1: Raw and Refined Edible Vegetable Oil)

(i) The product shall not contain aflatoxin mor than 5 ppb.

(ii) The pesticide residues (if any), in the product shall not exceed the limits as prescribed in Prevention of Food Adulteration Act, 1954 and rules made thereunder.

(iii) The toxic metal concentration (if any) shall not exceed the following limits:

Lead 5.0 ppm Arsenic 0.5 ppm Cadmium 1.0 ppm Mercury 0.25 ppm

(iv) Antioxidants as permitted under Prevention of Food Adulteration Act, 1954 in specified quantities shall be used.

(v) Shelf life shall be declared and marked by the manufacturer.

Category 2: Vanaspati (Hydrogenated Vegetable Oil)

(i) Nickel concentration in the product shall not exceed 0.5 part per million.

(ii) The product shall be free from obnoxious chemicals (iii) The pesticides residues (if any) in the product shall not exceed the limits as prescribed in Prevention of Food Adulteration Act, 1954 and Rules made thereunder.

(iv) The toxic metal concentration (if any) shall not exceed the following limits.

Lead 5.0 ppm Arsenic 0.5 ppm Cadmium 1.0 ppm Mercury 0.25 ppm [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 51

(v) Shelf life shall be declared and marked by the manufacturer.

(vi) Only permitted antioxidants under Prevention of Food Adulteration Act, 1954 shall be used, if required.

B. Tea

(i) Product shall be free from adulterants like spent tea leaves, grit, sand, leaves of other plants.

(ii) Product shall be free from off-odour and shall have its characteristic flavour.

(iii) Lead content shall not exceed 6.5 ppm.

(iv) The product shall be free from any added colouring and no extraneous flavour shall be added, however, for exports this may be allowed as per the provisions of PFA Act, 1954 and rules made thereunder.

(v) Product shall be free from mould growth.

(vi) The pesticides residues (if any) shall not exceed the limits as specified in the Prevention of Food Adulteration Act 1954 and Rules made thereunder.

C. Coffee

(i) Coffee beans shall be free from infestation due to insect, fungus and rodents.

(ii) Product shall be free from any extraneous matter like strings, stone, dirt, wood, glass and metallic pieces.

(iii) Product shall be free from any added colouring, flavouring and also free from rancidity and should have its characteristic flavour.

(iv) Product shall be free from adulterants like dandelion and other roots, nerons, fige, date, stones and cereals.

(v) The pesticides residues (if any) in the product shall not exceed the limits as prescribed in Prevention of Food Adulteration Act, 1954 and Rules made thereunder.

8 Packaging material / Package Part I Paper Boards & Plastics excluding Laminates

1. GENERAL REQUIREMENTS:

1.1 All the packaging material/package manufactured shall meet relevant standards of BIS (Bureau of Indian Standards) pertaining to safety, quality and performance wherever applicable.

1.2 The manufacturer of packaging material/package must produce the consent clearance as per the provisions of Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 along with the authorisation, if required, under the Environment (Protection) Act, 1986 and the rules made thereunder to BIS while applying for Ecomark.

Additionally, the manufacturer shall also comply with the provisions under prevention of Food Adulteration Act 1954 and rules made thereunder, wherever necessary.

1.3 The packaging material/package may display in brief the criteria based on which the product has been labelled as Environment Friendly.

1.4 The packaging material/package may be sold along with instruction for proper use and mode of safe disposal so as to maximise product performance and minimise wastage.

1.5 It shall also be suitably mentioned that ECOMARK label is applicable only to the packaging material/package, if content is not separately covered under Ecomark. It may be stated that the Ecomark is applicable to the product or packaging material or both.

2. PRODUCT SPECIFIC REQUIREMENTS:

2.1 Paper & Paper Boards

2.1.1 The paper and paper boards packaging materials/packages shall be manufactured from the following raw materials:

52 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] i) 100 per cent waste paper or agricultural/industrial wastes;

ii) A minimum of 60 per cent by mass of pulp made from materials other than bamboo, hardwood, softwood and reed;

iii) Paper and paper boards used for packaging of food materials shall be manufactured from virgin pulp and shall be free from dioxins. Printed surfaces of the paper shall not come into contact with the food and the maximum amounts of contaminants in paper intended to come into contact with food shall not exceed the limits given in the following table when tested as per the methods given in Appendix-I X: Paper intended to come into contact with dry food.

Y: Paper intended to come into contact with wet food and food with fatty Surface.

Z: Paper for filtration.

2.1.2 The paper and paper boards packaging materials/packages shall conform to the relevant Indian Standards. The paper and paper boards used for the manufacture of packaging materials/packages shall comply with the relevant Indian standards.

2.2. PLASTICS (Excluding Laminates)

2.2.1 The plastic packaging materials/packages used for packaging of food, pharmaceutical, cosmetics and drinking water shall comply with the relevant Indian standards and shall be manufactured from the plastics which shall comply with relevant Indian Standards.

2.2.2 The packaging material used for packaging of non-food, non-pharmaceutical, non-cosmetics and non-drinking water commodities shall be manufactured from recycled plastics which shall, apart from fillers and reinforcing agents, be a minimum of 30% by weight of compatible plastic wastes.

Part - II: Laminates and products thereof

1. GENERAL REQUIREMENTS:

1.1 Following requirements will be applicable depending upon their relevance to the specific product (to be decided by BIS).

1.2 Laminates and products thereof consisting of two or more substrates mentioned below used for manufacture of packaging material/package shall meet the relevant Indian Standards of Bureau of Indian Standards (BIS) i. Aluminium ii. Jute iii. Paper iv. Plastic

1.3 The manufacturer of packaging material/package must produce the consent clearance as per the provisions of Water (Prevention & Control of Pollution) Act 1974, Water (Prevention & Control of Pollution) Cess Act 1977 and Air (Prevention & Control of Pollution) Act 1981 along with the authorisation, if required under Environment (Protection) Act 1986 while applying for ECOMARK. Additionally, the manufacturer shall also comply with the provisions under Prevention of Food Adulteration Act 1954 and rules made thereunder, wherever necessary.

1.4 The packaging material/package may display in brief the criteria based on which it has been labelled as environment friendly.

1.5 The packaging material/package may be sold along with instruction for proper storage, use and mode of safe disposal so as to maximise product performance and minimise wastage.

1.6 It shall also be suitably mentioned that Eco label is applicable only to the packaging material/package, if content is not separately covered under Ecomark, wherever is applicable. It may be stated that the Ecomark is applicable to the product or packaging material/package or both.

1.7 Packaging material/package as well as ink used for printing on it shall not contain heavy metals (as Pb) more than 10 ppm when tested as per method given in IS 4006 (Part - III) : 1978 and arsenic content shall not exceed 1.5 ppm when tested as per method given in IS 1060 (Part-II):1960.

1.8 The compatibility of the product, process and package including its substrates and adhesives must be ensured by the manufacturer of the end product so that the product (content) quality is maintained within the specified limits till the end of its declared shelf life wherever applicable.

The manufacturer shall provide documentary evidence by way of certificate or declaration to this effect while applying for Ecomark.

2. PRODUCT SPECIFIC REQUIREMENTS:

2.1 Laminates and products thereof shall be recyclable or reusable for nonfood purposes which shall be demonstrated to BIS with supporting document/certificate.

2.2 The laminates and products thereof used for packaging of food, pharmaceuticals, cosmetics and drinking water shall be manufactured from the raw material as specified in the relevant Indian Standard for this purpose.

2.3 The laminates and products thereof shall not contain any residual volatile organic compounds when tested by gas liquid chromatography method.

2.4 There shall not be any obnoxious odour in laminates.

9 Electric / Electronic Goods GENERAL REQUIREMENTS

1.1 All products manufactured shall meet the requirements of following Indian Standards of BIS pertaining to quality, safety and performance:

1.2 The product manufacturer must produce the consent clearance, as per the provisions of Water (Prevention and Control of Pollution) Act 1974, Water (Prevention and Control of Pollution) Cess Act 1977 and Air (Pollution and Control of Pollution) Act 1981 along with the authorisation if required under Environment (Protection) Act 1986 and rules made there under to Bureau of Indian Standards while applying for the ECOMARK.

1.3 The product must display a list of critical components/cautionary notes, as applicable, which shall be decided by BIS.

1.4 The product packaging may display in brief the criteria based on which the product has been labelled environment friendly.

1.5 The product may be sold along with instructions for proper use so as to maximise product performance, minimise wastage and method of safe disposal of used product.

1.6 The material used for product packaging shall be recyclable or biodegradable.

1.7 Domestic electrical/electronic appliances shall conform to the noise levels as notified under the Environment (Protection) Act, 1986 from time to time for individual appliance, if any.

2. SPECIFIC REQUIREMENTS:

2.1 Television (Colour and Black and White)

2.1.1 CFC and other aromatic-halogenated hydrocarbons shall not be used for cleaning purpose during manufacturing assembly.

2.1.2 The electromagnetic radiation from colour television shall not exceed the limit specified in IS 6842:1977 when tested as prescribed in IS 4546:1983.

2.1.3 The rated maximum power consumption in watts for colour and black & white television receivers shall be as specified below:

i. CTV – 75 W for screen size upto and including 53 cms; and 100 W for screen size above 53cm.

ii. B&W TV – 50 W for screen size above 36 cm but below 51 cm; and 75 W for screen size of 51 cm and above"

2.2 Energy Efficiency/Reduced Power Consumption for Electrical Appliances

2.2.1 The product shall have atleast 5 percent improvement in energy efficiency or 5 percent reduction in power consumption over and above, the limit prescribed in the relevant Indian Standards. Alternatively, equipment using solar energy shall be eligible for ECOMARK under this clause. In case where both energy efficiency and power consumption have been specified in the Indian Standards, the Ecomark criteria shall be based on improved energy efficiency. However, in cases where product of energy efficiency and power factor has been specified, 5 percent improvement in the specified limit shall be the criteria for Ecomark.

2.3 Electric type fan regulators, Manual operated voltage stabilizers, Automatic voltage stabilizers and Servo Motor operated voltage stabilizers.

2.3.1 The product shall have at least 96 percent energy efficiency. In case of electronic type fan regulators, compliance with the relevant Indian Standard together with compliance with the General Requirements prescribed under clause 1, are adequate for considering them under ECOMARK.

2.4 Tubular Fluorescent Lamps

2.4.1 Slim line fluorescent tubes with 36 watts (as against 40 watts for 38 mm dia fluorescent tubes) and 18 watts (as against 20 watts for 38 dia fluorescent tubes) rated power consumption shall be considered for Ecomark.

10 Food Additives

1. GENERAL REQUIREMENTS:

1.1 All products of Beverages, Baby Foods and Processed Fruit and vegetable products shall meet the relevant standards for BIS pertaining to quality

1.2 The product manufacturer must produce the consent clearance, as per the provisions of Water (Prevention and Control of Pollution) Act 1974, Water (Prevention and Control of Pollution) Cess Act 1977 and Air (Pollution and Control of Pollution) Act 1981 along with the authorisation if required under Environment (Protection) Act 1986 and rules made thereunder to Bureau of Indian Standards while applying for the ECOMARK and the product shall also be in accordance with the Prevention of Food Adulteration Act 1954 and the rules made thereunder.

1.3 The product packaging may display in brief the criteria based on which the product has been labelled Environment Friendly.

1.4 The material used for product packaging shall be recyclable or biodegradable

1.5 The date of manufacture and date of expiry shall be declared on the product package by the manufacturer.

1.6 The product must be microbiologically safe when tested as per IS:5403 and IS:5887 (Part V) and should be free from bacterial and fungal toxins.

1.7 The pesticide residues (if any) in the product shall not exceed the limit as prescribed in PFA Act, 1954 and the rules made thereunder.

1.8 The product package or leaflet accompanying it may display instructions of proper use and storage so as to maximise the product performance, safety and minimise wastage.

2. PRODUCT SPECIFIC REQUIREMENTS:

2.1 Beverages:

2.3.1 The limit of heavy metal contaminants in the products shall be in accordance with Indian Standards or as per CODEX standards and whichever is lower will apply. The list of such contaminants shall be identified by BIS.

11 Wood Substitutes

1. GENERAL REQUIREMENTS:

1.1 Products manufactured shall meet relevant Indian Standards of BIS (Bureau of Indian Standards) pertaining to safety, quality and performance. The product manufacturer must produce the consent clearance, as per the provisions of Water (Prevention and Control of Pollution) Act 1974, Water (Prevention and Control of Pollution) Cess Act 1977 and Air (Pollution and Control of Pollution) Act 1981, along with the authorisation if required under Environment (Protection) Act 1986 and rules made thereunder while applying for the ECOMARK appropriate with enforced rules and regulations of the Forest Department.

1.2 The product or product packaging may display in brief the criteria based on which the product has been labelled Environment Friendly.

1.3 The material used for product packaging shall be recyclable, reusable or biodegradable.

2. SPECIFIC REQUIREMENTS:

2.1 Substitutes for fuel-wood:

2.1.1 Briquettes shall be made from agricultural and wood residues (like saw dust) and domestic wastes (like garbage) without synthetic binders, for industrial and domestic use. Such briquettes shall not be manufactured from any wastes material which contain any hazardous constituents as specified under Hazardous Wastes (Management and Handling) Rules, 1989.

2.2 Substitutes for Wood Building Material

2.2.1 Building boards generally used as partitioning, panelling, cladding and falseceiling shall be made from agricultural or industrial wastes (such as Phospho-gypsum, red mud, baggase, cotton stalk, rice-husk, coir fibre, sisal fibre or wood residues etc., or wood from sources other than natural forests or environment friendly plastics as notified separately.

2.2.2 Door and window frames and shutters used in buildings shall be made from agricultural or industrial wastes or wood residues or wood from sources, other than natural forests or ferrocement or building boards specified in 2(ii)(a) above or environment friendly plastic as notified separately, or frames made from enforced cement concrete.

2.3 Substitutes for Wood in Furniture

2.3.1 The furniture (table, chairs and Stool etc.) shall be made from agricultural or industrial wastes or wood residues or wood from sources other than natural forests or building boards specified in 2(ii)(a) above or environment friendly plastics as notified separately.

12 Aerosol Propellants

1. GENERAL REQUIREMENTS:

1.1 Propellants used in aerosol products shall meet the relevant Standards of BIS (Bureau of Indian Standards) pertaining to safety, quality, and performance. The manufacturer must produce the consent clearance as per the provisions of water (Prevention and Control of Pollution) Act 1974 and Air (Prevention and Control of Pollution) Act 1981 along with the authorisation, if required under environment (Protection) Act 1986 and the rules made thereunder while applying for Ecomark.

1.2 The product package shall be suitably marked that the Ecomark label is applicable only to the propellants used in Aerosol sprays, if the product package is not separately covered under the Ecomark Scheme.

1.3 Product package or leaflet accompanying it may display instructions of proper use, storage and disposal so as to maximise the product performance, safety and minimise wastage.

1.4 The material used for product packaging shall be made from recyclable or biodegradable material.

2. SPECIFIC REQUIREMENTS:

2.1 The aerosol propellants shall not contain any Ozone Depleting Substances (ODS) relevant to Aerosol industry as identified under Montreal Protocol.

13 Plastic Products

1. GENERAL REQUIREMENTS:

1.1 All products of plastics shall meet relevant standards of Bureau of Indian Standards pertaining to quality, safety, and performance. The product manufacturer must produce the consent clearance as per the provisions of Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 along with the authorisation if required under Environment (Protection) Act, 1986 and the rules made thereunder while applying for the ECOMARK. The manufacturers of Plastic wares shall produce documentary evidence with respect to the compliance of regulation under Prevention of Food Adulteration Act, 1954 and Drugs and Cosmetic Act, 1940 and rules made thereunder, wherever necessary.

1.2 The product must display a list of critical ingredients in descending order of quantity present expressed as per cent of the total. The list of such ingredients shall be identified by Bureau of Indian Standards.

1.3 The product packaging may display in brief the criteria based on which the product has been labelled environment friendly.

1.4 The material used for product packaging shall be recyclable or biodegradable. It shall also be suitably mentioned that Ecomark label is applicable only to the packaging material/package if content is not separately covered under Ecomark. It may be stated that the Ecomark is applicable to the product or packaging material or both.

2. SPECIFIC REQUIREMENTS:

2.1 Food, Pharmaceutical and Drinking Water Grade Plastic Products

2.1.1 For the manufacture of these items one or more of the virgin materials covered in following Indian Standards shall be used:

i. IS 10142 : 1982 ii. IS 10151 : 1982 iii. IS 10910 : 1984 iv. IS 11434 : 1985 v. IS 11704 : 1986 vi. IS 12247 : 1988 vii. IS 12252 : 1987

2.2 Recycled Plastic Products:

This sub-category includes all plastic products as further defined in the following categories:

i. Horticultural supplies.

ii. Produce containers.

iii. Office supplies.

iv. Non-food containers.

v. Recreational equipment and furniture.

vi. Construction materials.

Horticultural supplies include all implements, containers and support structures used in gardening activities such as flower pots, garden stakes and berry trays.

Product containers include containers for agricultural produce such as eggs, fruits and vegetables.

Office supplies include all implements, containers and support structures for use in offices such as presentation folders, file folders and binder covers.

Non-food containers, not for holding the contents, include all containers for non-food products such as detergent bottles, pallets, and reusable packaging containers.

Recreational equipment and furniture include all implements and support structures designed for the recreational market such as play ground equipment and patio tables.

Construction materials include all materials used in the construction of structures [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 59 whether stationary or transportable, such as lumber, fencing or shingles.

2.2.1 The plastic products identified in sub-categories from 2.2(i) to 2.2 (v) shall apart from fillers and reinforcing agents, be made from the minimum 90 per cent, by weigh, of compatible plastic wastes.

2.2.2 The plastic products identified in sub-category 2.2(vi) shall apart from fillers and reinforcing agents, be made from the minimum 60 per cent, by weight, or compatible plastic wastes.

14 Textiles 1. GENERAL REQUIREMENTS:

1.1 All the textile products manufactured shall meet relevant standards of Bureau of Indian Standards. The product manufacturer must produce the consent clearance as per the provisions of Water (Prevention and Control of Pollution) Act 1974 and Air (Prevention and Control of Pollution) Act 1981, Water (Prevention and Control of Pollution) Cess Act, 1977 respectively, along with the authorisation, if required under Environment (Protection) Act, 1986 and the rules made thereunder while applying for Ecomark. Additionally, the manufacturer shall produce documentary evidence on compliance of the provisions related to noise level and occupational health under the provisions of Factories Act, 1948 60 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] and Rules made thereunder.

1.2 The product packaging may display in brief the criteria based on which the product has been labelled environment friendly.

1.3 The material used for product packaging shall be reusable or made from recyclable or biodegradable materials.

1.4 Fatty alcohol based non-ionics as emulsifier should be sued wherever required.

1.5 Polyhalogenated based phenolic fire retardants shall not be used.

2. SPECIFIC REQUIREMENTS:

1. GENERAL REQUIREMENTS:

1.1 Any fire extinguisher having BIS standard mark qualifies for consideration of Ecomark. Following are the BIS Standards for portable and mobile fire extinguishers:

1.2 The product manufacturer must produce the consent clearance as [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 63 per provision of the Water (Prevention & Control of Pollution) Act, 1974, Water (Prevention & Control of Pollution) Cess Act, 1977 and Air (Prevetnion & Control of Pollution) Act, 1981, respectively, along with authorisation if required under Environment (Protection) Act, 1986, and the rules made thereunder while applying for Ecomark.

1.3 The product may display in brief the criteria based on which the product has been awarded Ecomark.

1.4 The product may be sold along with instructions for proper use so as to maximise product performance with statutory warning, if any, minimise waste and method of safe disposal.

1.5 The material used for product packaging (excluding refills) shall be recyclable, reusable or biodegradable.

1.6 The product must display a list of critical ingredients in descending order of quantity present in percent by weight. The list of such critical ingredients shall be identified by the Bureau of Indian Standards.

2. SPECIFIC REQUIREMENTS:

2.1 The fire extinguishers shall not contain any Ozone Depleting Substance (ODS) relevant to fire extinguishers industry as identified under the Montreal Protocol.

2.2 Gas-based extinguishing media once discharged in the atmosphere should not have atmospheric lifetime of more than a year.

2.3 Chemicals used should not have global warming potential.

2.4 The metallic body and other metal parts of the fire extinguishers shall be free of lead or lead alloys.

2.5 The coatings used for the metallic part shall not be formulated with mercury and mercury compounds or be tinted with pigments of lead, cadmium, chromium VI and their oxides.

Excluded are natural impurities or impurities entailed by the production process up-to the amount of 0.1 percent by weight which are contained in the raw material.

16 Finished Leather

1. GENERAL REQUIREMENTS:

1.1 The manufacturers shall produce consent clearance as per the provisions of the Water (Prevention and Control of Pollution) Act, 1974, and the Air (Prevention and Control of Pollution) Act, 1981, along with the authorisation for Hazardous Waste Management, if required under the Environment (Protection) Act, 1986, for seeking Ecomark certification.

1.2 The product packaging shall display in brief the criteria based on which the product has been labelled environment friendly.

1.4 The material used for product packaging shall be recyclable or reusable or biodegradable.
