F1-18011/77/201 5] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 12th September, 2019 G.S.R. 651(E).—The following draft of certain rules to regulate the use of lead stabilizer in Polyvinyl Chloride (PVC) pipes and fittings which the Central Government proposes to make in pursuance of Hon’ble National Green Tribunal’s judgement dated the 25th May, 2017 in O.A. No. 477/2015 in the matter of Jan Sahyog Manch Vs. Union of India and Others and in exercise of its powers under sub-section (1) of section 3, clause (viii) of sub-section (2) of section 3 and clause (d) of sub-section (2) of section 6 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-rule (2) of rule 13 of the Environment (Protection) Rules, 1986, is hereby published for information of all persons including organisations or industries likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration by the Central Government after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public;

DRAFT RULES
1. Short title and commencement.—(1) These rules may be called the Lead Stabilizer in Polyvinyl Chloride (PVC) Pipes and Fittings, Rules, 2019.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Prohibition of use of lead or lead compounds.—(1) Every manufacturer and importer, of the PVC pipes and fittings falling in category A, B and C of the Schedule, shall ensure to comply with the limits of the lead extraction, as specified for the Indian Standards by the Bureau of Indian Standards (BIS) and the same is provided in column (3) of the said Schedule.
(2) The manufacturer shall,-
(i) obtain a licence from the Bureau of Indian Standards within a period of six (6) months from the date of publication of these rules in accordance with Scheme-I of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018;
ii) emboss the “Standard Mark” on all the ipes and fittings in accordance with the specification ii boss the “Standard Mark” 11 the PVC pip d fittings i d ith the specificati provided in the licence issued by the Bureau of Indian Standards.
(3) The manufacturer of PVC pipes and fittings shall be prohibited to use lead or lead compounds as stabilizer in manufacturing of such PVC pipes and fittings as provided in column (2) of the Schedule, from the date as specified in column (4) of the said Schedule.
(4) The importer of the PVC pipes and fittings shall be prohibited to import such PVC pipes and fittings, which are manufactured using lead or lead compounds as stabilizer, as provided in column (2) of the Schedule, from the date as specified in column (4) of the said Schedule.
(5) The exporter of the PVC pipes and fittings shall be prohibited to export such PVC pipes and fittings, which are manufactured using lead or lead compounds as stabilizer, as provided in column (2) of the Schedule, from the date as specified in column (4) of the said Schedule.

3. Labelling and marking requirements.—(1) All manufacturer and importer of PVC pipes and fittings falling in category A, B and C of the Schedule shall-
(i) emboss on the PVC pipes and fittings that the limit of lead is not exceeding the limit as prescribed in column (3) of the Schedule;
(ii) ensure the durability and legibility of the embossment upto the life of the PVC pipes and fittings.
(2) All the PVC pipes and fittings manufactured and imported shall emboss-
(i) the name and address of the manufacturer and importer;
(ii) the date of manufacture and import;
(iii) the name of country of import.
4. Nodal agency.—(1) The Central Pollution Control Board (CPCB) shall be the Nodal Agency for implementation and enforcement of the provisions of these rules.
(2) Every dispute or issue relating to the implementation of these rules shall be referred to the Nodal Agency.
(3) A Panel may be constituted by the Nodal Agency for the purpose of implementation of these rules and to resolve any dispute or issue relating to these rules.
5. Authorised agencies for testing of products—(1) The Laboratories of the BIS and the Laboratories approved by the BIS shall be authorised to carry out such tests as are necessary to ascertain the compliance of rule 2.
(2) Every manufacturer and importer of the PVC pipes and fittings, falling under Category A, B and C in the Schedule, shall produce such PVC pipes and fittings for testing before the laboratories as specified in sub-rule
(1), to ensure the compliance of rule 2.
(3) Every manufacturer and importer shall submit the test reports to the Nodal Agency and the BIS for verification and any action, as may be required.
(4) The Nodal Agency shall furnish a comprehensive report on the status of implementation and enforcement of the provisions of these rules to the Ministry of Environment, Forest and Climate Change in every six (6) months.
6. Transitory provision.—The PVC pipes and fittings, falling under Category A, B and C of the Schedule, manufactured or imported into the country before the date of publication of these rules, shall be permitted for sale for the next six months.
