PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पयाावरण, वन और जलवाय ुपररवतान मतं्रालय ऄजधसचूना नइ ददल्ली, 13 ऄक् तूबर, 2021 सा.का.जन. 742(ऄ).—केन्द्रीय सरकार, राष्ट्रीय राजधानी क्षते्र और जनकटवती क्षेत्रों में वायु गणुवत् ता प्रबंधन अयोग ऄजधजनयम, 2021 (2021 का 29) की धारा 12 की ईपधारा (4) के खंड (क) और खंड (ग) के ईपखंड (i) के साथ परित धारा 25 की ईपधारा (2) के खंड (छ) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, जनम्नजलजखत जनयम बनाती ह,ै ऄथाात ्:-
1. संजक्षप्त नाम, प्रारम्भ और लाग ूहोना – (1) आन जनयमों का संजक्षप्त नाम राष्ट्रीय राजधानी क्षेत्र और जनकटवती क्षेत्रों में वायु गणुवत् ता प्रबंधन अयोग (नमनूे लेन ेकी रीजत और नोरटस का प्रापप) जनयम, 2021 ह ै।
(2) य ेराजपत्र में प्रकािन की तारीख से प्रवृत्त होंग े।
(3) य ेराष्ट्रीय राजधानी क्षेत्र और जनकटवती क्षेत्रों को लागू होंग े।
2. पररभाषाएं – (1) आन जनयमों में, जब तक दक संदभा से ऄन्द्यथा ऄपेजक्षत न हो, - (क) “ऄजधजनयम” से राष्ट्रीय राजधानी क्षेत्र और जनकटवती क्षेत्रों में वायु गुणवत् ता प्रबंधन अयोग ऄजधजनयम, 2021 (2021 का 29) ऄजभप्रेत ह;ै (ख) “प्रापप” से आन जनयमों से ईपाबद्ध प्रापप ऄजभप्रेत ह;ै स.ं 599] नइ ददल्ली, बृहस्ट् पजतवार, ऄक् तबूर 14, 2021/अज वन 22, 1943 No. 599] NEW DELHI, THURSDAY, OCTOBER 14, 2021/ASVINA 22, 1943 सी.जी.-डी.एल.-अ.-16102021-230451 CG-DL-E-16102021-230451 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ग) “धारा” से आस ऄजधजनयम की धारा ऄजभप्रेत ह;ै
(2) आन जनयमों में प्रयुि दकन्द्त ुपररभाजषत नहीं दकए गए, दकन्द्तु ऄजधजनयम में पररभाजषत दकए गए िब्दों और पदों का वही ऄथा होगा जो ईनका क्रमिः ऄजधजनयम में ह ै।
3. नोरटस की तामील – अयोग या ईसके द्वारा आस जनजमत्त प्राजधकृत ऄजधकारी ऄजधष्ठाता या ईसके ऄजभकताा या ईस स्ट्थान के भारसाधक व्यजि को ईस समय और वहां ईसके नमूने का जवश्लेषण करवाने के अिय का प्रापप 1 में नोरटस तामील करेगा ।
4. नमनू ेलने ेकी रीजत – (1) अयोग या ईसके द्वारा आस जनजमत्त प्राजधकृत ऄजधकारी को धारा 12 की ईपधारा (4) के ऄधीन दकसी जचमनी, धुअंकि या नजलका, संयंत्र या दकन्द्हीं ऄन्द्य स्त्रोतों और जनकास द्वारों, चाह ेजस्ट्थर हों या चलायमान, से जवश्लेषण के प्रयोजन के जलए वायु या ईत्सजान के नमून ेलेन ेकी िजि होगी ।
(2) ऄजधष्ठाता या ईसका ऄजभकताा या ईस स्ट्थान का भारसाधक व्यजि जचमनी, धुअंकि या नजलका, संयंत्र या दकन्द्हीं ऄन्द्य स्त्रोतों और जनकास द्वारों, चाह े जस्ट्थर हों या चलायमान, से वायु या ईत्सजान के नमनू ेलनेे के जलए सभी अवयक सुजवधाएं प्रदान करेगा, जैसा अयोग या ईसके द्वारा आस जनजमत्त प्राजधकृत ऄजधकारी द्वारा जवजनर्ददष्ट दकया जाए ।
(3) ऄजधष्ठाता या ईसका ऄजभकताा या ईस स्ट्थान का भारसाधक व्यजि नमूना लेने वाल ेस्ट्थानों तक पहुचं के जलए सभी अवयक सुजवधाएं प्रदान करेगा, जैसा अयोग या ईसके द्वारा आस जनजमत्त प्राजधकृत ऄजधकारी द्वारा जवजनर्ददष्ट दकया जाए ।
(4) वायु या गैसीय ईत्सजानों के नमनूे या तो ऄविोषक जवलयन और/या ईपयुि अधान में और/या दकसी ईपयिु दिल्टर/ऄंगिुताना और/या ऄन्द्य दकसी ईपलब्ध प्रौद्योजगकी में जलए जाएगंे :
परन्द्त ु दकए जाने वाल े जवश्लेषण के प्रकार या मामल ेकी पररजस्ट्थजतयों पर जनभार करत े हुए, अयोग या ईसके द्वारा आस जनजमत्त प्राजधकृत ऄजधकारी नमनूों के संग्रहण हतेु दकसी ऄन्द्य ईपयुि पद्धजत या ईपस्ट्कर का प्रयोग कर सकेगा ।
(5) धारा 12 की ईपधारा (4) के खंड (क) के ऄधीन अयोग या नमून ेलनेे के जलए आस जनजमत्त प्राजधकृत ऄजधकारी ईस धारा की ईपधारा (4) के खंड (ग) और (घ) के ईपबंधों का ऄनसुरण करेगा । प्रापप 1 [जनयम 3 देजखए] नोरटस का प्रापप सेवा में, ---------------- ---------------- ---------------- ईस पररसर के, जजससे वायु/ईत्सजान का नमूना जलया जाना ह,ै ऄजधष्ठाता या ईसके ऄजभकताा या ईस स्ट्थान के भारसाधक व्यजि की हजैसयत से सूचना की तामील की जाती ह ै दक वायु/ईत्सजान के नमूने का जवश्लेषण दकया जाना अिजयत ह ै जजसे ईि पररसर, ऄथाात ् ----------- के ---------------- से* अज तारीख ------------- मास ------------ 20--------- को जलया जा रहा ह ै। -------------------------- ईस व्यजि का नाम और पदनाम जो नमूना लतेा ह ै। [भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 *यहा ंईस गरी, जचमनी या दकसी ऄन्द्य जनकास द्वार को जवजनर्ददष्ट करें जजसस ेवाय ुईत्सजान का नमनूा जलया जाना ह ै। [िा. सं. क्यू.-15014/08/2021-सीपीए] नरेि पाल गगंवार, संयुि सजचव MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 13th October, 2021 G.S.R. 742(E).— In exercise of the powers conferred by clause (g) of sub-section (2) of section 25, read with clause (a) and sub-clause (i) of clause (c) of sub-section (4) of section 12 of the Commission for Air Quality Management in National Capital Region and Adjoining Areas Act, 2021 (29 of 2021), the Central Government hereby makes the following rules, namely:-
1. Short title, commencement and application.- (1) These rules may be called the Commission for Air Quality Management in National Capital Region and Adjoining Areas (Manner of Taking Samples and Form of Notice) Rules, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.
(3) They shall apply to the National Capital Region and adjoining areas.
2. Definitions.- (1) In these rules, unless the context otherwise requires,-
(a) "Act" means the Commission for Air Quality Management in National Capital Region & Adjoining Areas Act, 2021 (29 of 2021);
(b) "Form" means form appended to these rules;
(c) "section" means a section of the Act.
(2) Words and expressions used in these rules and not defined, but defined in the Act shall have the meanings respectively assigned to them in the Act.
3. Service of notice.- The Commission or the officer authorised by it in this behalf shall serve on the occupier or his agent or person in charge of the premises a notice then and there in Form I of his intention to have the sample analysed.
4. Manner of drawing samples.- (1) The Commission or the officer authorised by it in this behalf shall have the power to take, for the purpose of analysis , samples of air or emission from any chimney, flue or duct, plant or any other sources and outlets, stationary or mobile under sub–section (4) of section 12.
(2) The occupier or his agent or person in charge of the premises shall provide all necessary facilities for taking samples of air or emission from any chimney, flue or duct, plant or any other sources and outlets, stationary or mobile, as may be specified by the Commission or the officer authorised by it in this behalf.
(3) The occupier or his agent or person in charge of the premises shall provide all necessary facilities for access to the sampling places as may be specified by the Commission or the officer authorised by it in this behalf.
(4) The samples of air or gaseous emissions shall be taken either into an absorbing solution and / or in a suitable container and / or on a suitable filter / thimble and / or any other any other available technology:

Provided that depending upon the type of analysis to be conducted, or the circumstances of the case, the Commission or the officer authorised by it in this behalf may use any other suitable method or, equipment to collect samples.
(5) The Commission or the officer authorised by it in this behalf to take samples under clause (a) of sub-section (4) of section 12 shall follow the provisions of clauses (c) and (d) of sub-section (4) of that section.

------------------------------------------------------ Name and designation of the person who takes the sample *Here specify the stack, chimney or any other outlets from which sample of air emission is being taken.
