1. संजिप्त नाम और प्रारंभ.- (1) इन जनर्मों का संजिप्त नाम कंपनी (कंपनी के रजिस्ट्टर से कंपजनर्ों का नाम हटाना) संिोधन जनर्म, 2022 ह।ै
(2) रे् रािपत्र में उनके प्रकािन की तारीख को प्रवृत्त होंगे।
2. कंपनी (कंपनी के रजिस्ट्टर से कंपजनर्ों का नाम हटाना) जनर्म, 2016 में,-

(1) कंपनी अजधजनर्म, 2013 की धारा 248 की उपधारा (1) के अनुसरण में, नोठटस दिर्ा िाता ह ै दक उपलब्ध अजभलेख के अनुसार,- कंपनी अपने जनगमन के एक वर्य के भीतर अपना कारोबार प्रारंभ करन ेमें असफल रही है;
कंपनी तत्काल पूवयवती िो जवत्तीर् वर्ों की अवजध में कोई कारोबार र्ा संचालन नहीं कर रही ह ैऔर [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 इस अवजध में धारा 455 के अधीन एक जनजष्क्रर् कंपनी का स्ट्तर प्राप्त करने के जलए कोई आवेिन नहीं दकर्ा ह;ै ज्ञापन के अजभिाताओं ने अजभिान का भुगतान नहीं दकर्ा ह ैिो उन्द्होंने दकसी कंपनी के जनगमन के समर् करन ेका वचन दिर्ा था और धारा 10क की उपधारा (1) के अधीन उसके जनगमन के एक सौ अस्ट्सी दिन के भीतर इस आिर् की कोई घोर्णा फाइल नहीं की गई ह।ै (िो लागू ह ैउस पर जनिान लगाएं)
(2) अतः, पूवोि कारण/कारणों के आधार पर, मैं कंपनी का नाम कंपनी रजिस्ट्टर से हटाना चाहता ह ंऔर आपसे अनुरोध ह ैदक इस नोठटस की प्राजप्त से तीस दिनों के भीतर संबंजधत िस्ट्तावेिों की प्रजतर्ों, र्दि कोई हो, सजहत अपना अभ्र्ावेिन भेिें।

संिभय:
कंपनी अजधजनर्म, 2013 की धारा 248 की उपधारा (1) के अधीन जनम्नजलजखत कंपजनर्ों के नाम हटान ेके मामल ेमें, नीचे दिए गए जववरण के अनुसार:-
1. सूचना िी िाती ह ै दक, कंपनी रजिस्ट् टार के पास जवश् वास करने का उजचत कारण ह ै दक कंपजनर्ो, जिन का नाम ............... (मंत्रालर् की वेबसाइट के पृष् ि का वेब िंलंक प्रिान करें िहां नाम सूचीबद्ध हैं) पर सूचीबद्ध ह।ै,-

1. Short title and commencement.- (1) These rules may be called the Companies (Removal of Names of Companies from the Register of Companies) Amendment Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Companies (Removal of Names of Companies from the Register of Companies) Rules, 2016, -
(i) in rule 4, after sub-rule (3), the following sub-rule shall be inserted, namely:─ “(4) (a) Where the Registrar, on examining the application made in Form STK-2, finds that it is necessary to call for further information or finds such application or any document annexed therewith is defective or incomplete in any respect, he shall inform to the applicant to remove the defects and re-submit the complete Form within fifteen days from the date of such information, failing which the Registrar shall treat the Form as invalid in the electronic record, and shall inform the applicant, accordingly.
(b) After the re-submission of the Form or document, if the Registrar finds that the Form or document is defective or incomplete in any respect, he shall give further time of fifteen days to remove such defects or complete the Form, failing which the Registrar shall treat the Form as invalid in the electronic record and shall inform the applicant, accordingly.
(c) Any re-submission of the application in Form STK-2 made prior to the commencement of the Companies (Removal of Names of Companies from the Register of Companies) Amendment Rules, 2022 shall not be counted for the purposes of reckoning the maximum number of re-submissions of such Form.”.
