NOTIFICATION New Delhi, the 19th July, 2012 S,O, '704(E).-Whereas, the Convention on the Privileges and Immunities of the United Nations was adopted by the General Assembly of the United Nations on 13th February, 1946, and clause (b) of Section 18 of Article V of the said Convention provides that officials of the United Nations shall be exempt from, taxation on the salaries and emoluments paid to them by the United Nations;
And whereas, an Agreement was made on 15th March, 1974 between the lndian Council of Agricultural Research, New Delhi and the International Maize and Wheat Improvement Centre, Mexico City, Mexico, an international organization for scientific and technical cooperation in research on maize and wheat having an international Board of Trustees, and in order to facilitate the implementation of the cooperative undertakings under it, its Article V, in clause (d), provided that in case of expatriate staff members assigned to India under this Agreement, the Council will ensure that they will not be subject to payment of Indian income-tax;
And whereas, an Agreement was made on 151h March, 1974 between t.he 'Indian Council of Agricultural Research, N~w Delhi and the International Rice Research Institute, Los Benos, The Phillipines, an international organization for scientific and technical cooperation in research on rice having an international Board of Trustees, and in order to facilitate the implementation of the cooperative undertakings under this Agreement, its Article V, in clause (d), provided that in case of expatriate staff members. assigned to India under this Agreement, the Council will ensure that they will not be subject to payment of Indian income-tax;
And whereas, an Agreement was made on 17th November, 1975 between the Indian Council of Agricultural Research, New Delhi and the International Potato Centre, Apartndo, 5969, Lima, Peru, an international organization for scientific and technical co-operation in research on potato improvement having international Board of Trustees, and in order 10facilitate the implementation of the cooperative undertakings under this Agreement, its Article V, in clause (d), provided that in case of expatriate staff members assigned to India under this Agreement, the Council will ensure that they wiil not be subject to pay:
ment oflndian income-tax;
And whereas, the United Nations, (Privileges and Immunities) Act, 1947 (46 of 1947) was enacted to give effect to the said Convention to confer on the United Nations and its representatives and officers certain privileges and immunities and to enable similar privileges and immunities to be enjoyed by other international organizations and their representatives and officials;
And whereas, the provisions of Section 2 of the said Act provide thatthe said Convention shall have the force of law in India and the provisions of the said Convention are provided in the Schedule to the said Act;
And whereas, the provisions of Section :; of the said Act provide that the Central Government may, by notification, declare that provisions set out in the said Schedule shall, subject to such modifications as it m<JY consider necessary or expedient for giving effect to the international agreement, convention or other instrument, apply mutatis mutandis to the international orsanization.. b specified in the notification and shall in such application have the force of law in India;
And whereas, in pursuance of the said three Agreements, it is necessary to accord to the expatriate staff members ofInternational Maize and Wheat Improvement Centre, Mexico City, Mexico, International Rice Research Institute, Los Benos, The Phillipines, and the International Potato Research Centre, Peru, which are assigned to India, privileges and immunities in India similarto those contained in the provisions of Section 18(b) of Article V of the Schedule to the said-Act;
Now, therefore, in exercise of the powers conferred by Section 3 of the United Nations (Privileges and Immunities) Act 1947, the Central Government hereby declares that the provisions of Section 18(b) of Article V of the Schedule to the said Act shall apply mutatis mutandis to the expatriate staff members of International. Maize and Wheat Improvement Centre, Mexico City, Mexico, International Rice Research Institute, Los Benos, The Phillipines, and the International Potato Research Centre, Peru, which are assigned to India, to the extent that such expatriate staff will not be subject to payment 0 f income-tax on the salaries and emoluments paid to them.
