Section 12: Declaration of conferment of Occupancy Rights

(1) As soon as may be after the appointed date, the Collector shall publish or cause to be published in the prescribed manner a Provisional Declaration in the prescribed form giving the names of the Proprietors and the particulars of the lands which are deemed to have been re-granted to them under section 4; and also the names of cultivating tenants and the particulars of lands in respect of which they are to become occupants under section 8. The Declaration shall also call upon all persons interested in the lands specified in the Declaration to submit to him the objections to the said Provisional Declarations, within two months from the date of publication of the said Declaration.

(2) The Collector shall consider the objections received by him under sub-section (1) and shall make an order disposing off each individual objection.

(3) Any person aggrieved by such an order may, within a period of thirty days from the date of such order, file an appeal to the Tribunal. The Tribunal shall dispose of such an -7- appeal after giving the parties concerned an opportunity of being heard.

(4) The Declaration issued under sub section (1) as modified by the orders if any, passed by the Collector, or where an appeal has been filed, as modified by the decision of the Tribunal, shall be final and shall be conclusive evidence of the conferment of occupancy rights in respect of any land under section 4 or section 8.
