2. Definition. --In rjese rules. unless the context otherwise requires '.-- (a) 'Adjoining Urban Estate' ITjeans an yare" declared by the state of Punjab or Ha::-yana to be an urban estate under sub­ section (1) of section 3 of the Punj ab Ur:Jan Estates (Development and Regulation) Act. 1964 (Punja.b Act No. 22 of 1964) and situated within ten kilometers from the boundaries of the Chandigarh viz. Mohali or Panchkula.

(b) I Drector Pri:n.cipal· means the Director Princi;Jal or Principal of Government Medical College/Hospital, Chandigarh.

(c) I Allotment I means the grant of a Licence to an employee of the Government Medical College/Hospital Chandigarh to occupy a house or a portion thereof owned, leased or requisitioned by the Government Medical College, for use by him as residence.

(d) such other Government 'Allotment year' means the year beginning on 1st April or period as may be notified by the Director Principal, Medical College/Hospital, Chandigarh.

(e) 'Chairman' means the chairman of the House Allotment Committee Upper Or Lower, as the case may be. (0 'Chandigarh' means the areas within the limits of the Union Territory of Chandigarh.

(g) 'Committee' means the House Allotment Committee Upper or Lower, as the case may be.

(h) 'Eligible Employee' means an employee of the Government . Medical College/Hospital.

(i) 'Eligible Office' means the Government Medical College/ Hospital, Chandigarh.

(j) 'Emoluments' means the emoluments as defined in FR-9(21) (A)(Il), i.e. only basic pay and no other allowances are to be taken into account.

Explanation. - In the case of an officer who is under suspension the emoluments drawn by him on the first day of the allotment year in which he is placed under suspension or if he is placed under suspension on the first day of the allotment year, the emoluments drawn by him immediately before that date shall be taken as his emoluments. • 2 {k.l 'Family' means t!1e "'life or r''':50and. ;: ~=~nts. (5) Notwithstanding anything contained in sub-rules (1) to (4) above. -- t a) If a wife or husband. as the case maybe. who is an allottee of a residence ·.lnder these rules. is subsequently allotted a residential accommodation at the same station from a pool to which these rules do not apply, she or he, as the case may be, shall surrender anyone of the residences within one month of such allotment: provided that this clause shall not apply where the husband and wife are residing separately in pursuance of an order of judicial separation made by any court

(b) Where two officers, in occupation of separate residences at the seme station, one allotted under these rules and another fror:1 a pool to which these rules do not apply, marry each other, anyone , of them shall surrender anyone of the residences within one month of such marriage. , clause deemed

4. Employees owning houses to be ineligible for allotment under these Rules. -- (l) :10 employee shall be eligible of allotment of Government residence un:::er these rules if he or his spouse or any of his c:ependent children owns a house at Chandigarh, or at the adjoining urban estates of Panchkula or Mohali, unless he is willing to :Jay double the normal licence fee:

Provided that t;;is rule shall not apply to the employees living in the earmarked :-esidences.

(3) Where an employee to whom sub-rule (2) is applicable does not surrenaer t;;e Government residence as required, he shall be liable to pay damagss for use and occupation of the residence equal to double the "ormal Licence fee from the date on which he is required to surrE:1de= the government residence.

(4) WheT:? af:er a Government residence has been allotted to an employee, hE or his spouse or any of his dependent children constructs or otherwise becomes the owner of a house at Chandigarh or at the adjoining t.::-ban estates of Panchkula or MohaU shaH notify the fact to the ~.iem~er Secretary within a Period of four weeks from the date on whic:1 hE or such member becomes the owner of _tha' house or completes the construction thereof and he shall, thereafter, be governed by the :>rovisions of sub-rules (l) to (4).

5. Classification of Residences for allotment.--(l) Save as otherwise provided ir: these rules, an employee of Government Medical College/Hospital, Chandigarh shall be eligible on the basis of the emoluments/designation. for allotment of a residence of the type shown in the table of imnexure-I attached to these rules. Entitlement for the different categones of house shall be determined by the Director Principal, Governmer.: Medical College/Hospital, Chandigarh from time to time. Keeping in ~.riew the change in the emoluments/designation or otherwise in consultation with the House Allotment Committee <Upper).

(2) An em;oioyee ofGovernment Medical College/Hospital, Chandigarh shall have the o:>tion to apply for the type of residence to which he has been entitled on the basis of his emoluments/post on .the earliest date since when he has ser,ved in the Government r~edical College/ Hospital, Chandigarh or the higher type he may have become eligible 'at any time thereafter.

6. Government Medical College/Hospital Pool of Residences.--(l) There shall be earmarked houses for Director Principal, Medical Superintend'ent, Nursing Superintendents and employees on emergency services of Government Medical College/Hospital, Chandigarh from time to time in consultation with the House Allotr:lent Committee (Upper) .

(2) There shall be two House Allotment Committees i. e. House Allotment Committee (Upper) and House Allotment Committee (Lower). The constitution of these committees shall be as under:-- House Allotment Committee (Upper): , •

(il) Vice Principal, Government Medical College, Chandigarh.

(ili) HOD, General Medicine, Government Medical College/Hospital, Chandigarh.

(iv) HOD, General Surgery, Government Medical College/Hospital, Chandigarh. Chairman Member Member Member r 5

(v) HOD, Obst. & Gynae, Government Medical College/Hospital, Chandigarh,

(vi) Administrative Officer, Government Medical College, Chandigarh. House Allotment Committee ,(Lower):

(i) Administrative Officer, Government Medical College, Chandigarh.

(ii) Asstt. Controller (F&A), Government Medical College, Chandigarh.

(iii) Sr. Store Officer. Government Medical College, Chandigarh.

(iv) Office Superintendent-I, Government Medical College, Chandigarh. Member Member Secretary Chairman Member iIJember Member Secretary

(3) The Houses of Type IV, V and VI shall be ':Iithin the purview of the House Allotment Committee (Upper) ','/hereas the houses of Types I to III shall be within the purview of the House Allotment Committee (Lower).

7. Controlling Authority. --The Director Pr':"ncipal, Government Medical. Collese/Hospital, Chandigarh shall be the Coordinating and Controlling Authority in respect of residences belonging to the Government Medical College/Hospital, C;'andigarh. :ie may, from time to time, add any residence to the Government Medical College/Hospital General Pool. or withdraw from it for the purposes of allotment to any class or catego:-y of eligible C::':1ployee of Government Medica! College/Hospital. Cha:1digarh or change the classificati')n of any residence on the recommendations of the House ':"llotment Committee (Upper).

8. Procedure for inviting applications for allotment.--(1) The Member Secretary House Allotment Committee or any other officer/ official authorised by him shall invite applicatio~s for allotment of houses in Fori:1 "A" for various categories of residences in its meeting to be held in the month of December every year.

11. Non-acceptance of allotment or failure to occupy the allotted residence after acceptance. --( 1) ';,Ihere an employee of Govern­ ment Medical CcLege/Hos;:>ital. Chandigar:, fails to accept the allot­ ment of a resi:::~nce or fails to take ;>ossession of that residence, within 14 days _0 the date of issue of the letter of allotment, he shall not be eli;:.:Ile for another allotment for a period of one year from the date of :..ssue of the Allotment Letter.

(2) A residence allotted to an employee of Government Medical College/Hospital, Chandigarh may, subject to sub-rule (3) be retained on the happening of any of the events specified in column-l of the table below for the period specified in the corresponding entry in column 2, thereof provided that the residence is Jequired for the bonafide use of the employee or member of his family. The period for which the Employee of Government Medical College/Hospital, Chandigarh remains on leave before joining duty at the new office shall not be taken into account in calculating the permissible peirod.

(3) When a residence is retained under events (ii) of the table in sub-rule (2), the allotment shall be deemed to be cancelled on the expiry of the admissible concessional period unless immediately on the the employees on such of residence previously a residence of the type 10 expiry thereof the employee of Government Medical College/Hospital, Chandigarh resumes duty in an eligible office in the Chandigarh.

(4) An employee of Government Medical Colleg,,/Hospital. Chandigarh who has rEtained the residence by virtue of the concession under event (i) of the te.i::le in sub-rule (2) shall, on re-employment or reinstatement, as the case may be, in an eligible office within the period specified in the said table, be entitled to retain that residence and shell also be eligible for any further allotment -of residence under these rules:

13.. 14. Personal liability of Employee of Government Medical College/ Hospital, Chandigarh for payment of Licence fee WI the vacation of residence. --An employee of Government Medical College/Hospital, Chandigarh to whom a residence has been allotted shall be personally liable for the payment of the Licence fee thereof and for any damages beyond usual wear and tear caused therto, or to the furniture, fixtures or fittings or services provided therein by the Government Medical Colles-e/Hospital during the period for which residence has been and remains allotted to him or, where the allotment has been cancelled under any of the provisions of these rules, until the residence alongwith the out-houses appurtenant thereto have besn vacated and full vacant possession thereof has been restored to the Government Medical College/Hospital.

15. 5u=ender of allotment and period of notice.--(l) An em­ ployee of Government Medical College/Hospital, Chandigarh may at any time surrender an allotment by giving intimation so as to reach the Member Secrete.ry I at least fourteen days before the date of vacation of the residence. The allotmem of the residence shall be deemed to have been cancelled with effect from the fifteen day after the day on which the letter is received by the Member Secretary or the date specified in the letter, whichever is later. If he fails to give due notice, he shall be responsible for payment of licence fee for fourteen days or the number of days by which the notice given by him falls short of the period specified above:

Provided that the Director Principal may accept a notice for shorter period in exceptional circumstances.

(2) An employee of Government Medical College/Hospital, Chandigarh, who surrenders the residence under sub-rule (1), shall not be considered again for allotment of government accommodation for a period of one year from the date of such surrender.

16. Change of Residence.--(l) An employee of Government Medical Coller;'.?/Hospital. Chandigarh. to whom a residence has been allotted under these rules, may apply to the Member Secretary. :-louse Allotment Comr.:ittee for " change to another reSloence of the same type or a resH::ence of the type to which he is eligible under ~ule 5 & 8, whichever is lower. ~ot more than one change 'NiH be allowed in respect of one type of residence allotted to an employee of Government Medical College/Hospital, Chandigarh.

(2) An employee oi Government Medical College/Hospital, Chandigarh, wno intends to change the accommodation already allotted to him shall :nake an application to the Member Secretary for such change of residence in Form B appended to these rules. After acceptance the name of the applicant shall be included in the waiting list to be maintained for the purpose. The inter-seniorityoi the applicants so included shall be determined on first-come first served basis. 12

(3) Change shall be offered in the order of seniority mined in accordance with sub-rule (2) above having regard employee I 5 preference to the extent possible deter­ to the

(4) An employee of Government Medical College/Hospital, Chandigarh, who fails to accept a change of residence offered to him within twenty one days of the issue of allotment letter shall not be considered again for a change of residence of that type.

(5) An employee of Government Medical College/Hospital, Chandigarh, who after accepting a change of residence fails to take ?ossession of tne same, shall be charged Licence fee for such =esidence in accordance with the provisions of rule 13 in addition to the normal Licence fee for the residence already in his possession, the allotment of which shall continue to subsist.

17. Maintenance of Residence. --An employee of Government ;.;edical College/Hospital. Chandigarh, to whom a residence has been allotted, shall maintain the residence and premises to the satisfaction of the Directo:- PrincipaL Government Medical College/Hospital, Chandigarh. Such Employee of Government Medical College/Hospital. Chandigarh shall not grow any tree, shrubs or plants contrary to the instructions issued by the Chandigarh Administration nor cut or lop cny existing trees or shrubs in any ga.rden, courtyard or compound =ctached to the residence save with the :Jrior permission in writing :rom Director Principal, Government Medical College/Hospital, Chandi­ :;arh. Trees. planation or vegetation grown in contravention of this :-ule may be caused to be removed by the Executive Engineer Horti­ culture, Engineering Department, Chandigarh Administration at the risk and cost of the Employee of Government Medical College/Hospital. Chandigarh concerned. No addition and alteration in the house shall :oe made by the employee of Government Medical College/Hospital, Chandigarh without any permission in writing of the Director ?rincipal, Government Medical College/Hospital. Chandigarh. The house allotted to a Government Medical College/Hospital employee shall :oe used by the allottee as a bona fide residence and shall not be kept locked/closed unoccupied for a period of not more than two months continuously. I 13

18. Subleting and sharing of residence. -- (1) No Employee of Government Medical College/Hospital, Chandigarh shall share the residence allotted to him or any of the out-houses, garages and cow­ sheds appurtenant thereto, except with the members of his family and close relations. The servants quarters out-houses, garages and cov,r­ sheds may be used only for the bona fide purpose including residence of the servants of the allottee or far such other purposes as ~ay be permitted by t!1e Committee:

Provided that the Committee may, for the reasons to be recorded in writint;, allow an employee of Govenment Medical College/ Hospital, Chandigar~ to share the residence with another person in exceptional circumstances for a period not exceeding six months at a time but not exceeding one year in the aggregate.

(2) No employee of Government Medical College/Hospital, ::::handigarh shall sublet the whole or any part of his residence but an employee of Government Medical College/Hospital, Chandigarh proceeding on leave or training as the case may be, may accommodate in the residence any other government employee eligible for the allotment of Government Medical College/Hospital accommodation as a caretaker for the period specified in the corresponding entry in column 2 of t!1e table below sub-rule (2) of rule 12 with the prior permission of the Director Principal. In the event of such arrangement the Licence fee shall be payable by the employee of Government Medical College/Hospital, Chandigarh to whom the residence is allotted.

19. Consequences of breach of an employee of Government Medical whom a residence has been allotted: Rules and Conditions. -- (1) Where College/Hospital, Chandigarh to

(a) sublets the residence; or

(b) erects any unauthorised structure or makes any structural alterations in any part of the residence; or

(c) uses the residence or any portion thereof for any_ purpose other than that for which it is meant; or

(d) tampers with the electric or water connection; or

(e) uses the residence or premises or permits or suffers the residence or premises to be used for any purposes which the Director Principal considers to be improper; or in any securing information a view to has knowingly furnished incorrect application or written statement with the allotment; or

(g) commits any other breach of the rules or the terms and conditions or the allotment letter. (0 the Director Principal, without prejudice to any other disciplinary action that may be taken against him/her, may cancel the allotment of the residence. 1. (i) These rules may be called the Government Residences .(Government Medical College/Hospital, Chandigarh Pool) Allotment (Amendment) Rules, 2008.

(ii) These shall come into force with immediate effect.

2. In the Government Residences (Government Medical College/Hospital, Chandigarh Pool) Allotment Rules, 1996 (hereinafter referred to as the said rules of 1996) for Annexure-I, subsequently amended.-vide Notification No. Estate/1/51/2006/05946, dated 20th February, 2006. the follOWing sha.ll be substituted as under namely :- ANNEXURE-I ENTITLEMENT OF THE OFFICERS/OFFICIALS AND THEIR DESIGNATION Type-VI Type-V

(i) Professors

(ii) In the absence/refusal of Professors. other eligible employees entitled for the allotment of Type V house. in order of their regular seniority.

(i) Due to shortage of Type-VI houses, Professors can be adjusted against "this Category. if available and acceptable to them below their entitlement.

(ii) Associate Professor.

3. In the said rules of 1996, in rule 6(2) the constitution of House Allotment Committee (Upper) shall be substituted as under :- House Allotment Committee (Upper) :

(i) Director Principal, Government Medical College anej Hospital, Chandigarh

(ii) Joint Director (Admn.)/Addl. Director (Admn.), Government Medical College and Hospital, Chandigarh

(iii)" One Regular Professor/Head of the Department(s) on rotational basis for two years in order of seniority/gradation

(iv) One Regular Associate Professor of the Department(s) on rotational basis for two years in order of seniority/gradation

(v) One Regular Assistant Professor of the Department(s) on rotational basis for two years in order of seniority/gradation

(vi) Law Officer, GMCH-32, Chandigarh

(vii) DC (F&A), GMCH-32, Chandigarh Chairman Member-Secretary Member Member Member Member Member

4. In the said rules of 1996, at the end of rule 8(3), the following shall be added as under :-

Provided further that the priority will be determined on the basis of date of joining in GMCH either on contract/tenure or through UPSC for the allotment of GMCH Pool house. CHD. ADMN GAZ. (EXTRA.), OCT. 7, 2008 (ASVN 15,1930 SAKA) 10[9

5. In the said rules of 1996, at the end of rule 9, the following shall be added as under :- "No choice of floor/sector at the time of allotment of house to an eligible employee shall be considered. The houses shall be allotted as per their availability/vacancy. however, the senior person will be given priority for choosing from the available houses at that time."

6. In the said rules of 1996. at the end of Rule 10(c), the following shall be added as under :-

Provided further that no house will be transferred in the name of spouse after completion of tenure/resignation.

7. In the said rules of 1996. in Rule 10(1 )(f) shall be substituted as under :- Allotment of a residence to an employee of Government Medical College/Hospital. Chandigarh in exceptional circumstances of hardship or in public interest or where the provisions of any Statute/Act so warrant/acknowledge: An employee of Government Medical College/Hospital, Chandigarh may, for the reasons to be recorded in writing, be allotted a residence of one category below entitlement under this sub-rule in exceptional circumstances of hardships or public interest or in deserving cases. where such preference has been warranted/acknowledged under the provisions of any Statute/Act. a. In the said rules of 1996. the Rule 10(2) shall be substituted as under :- Not withstanding any1hing contained in these rules. not more than 10% of the houses allotted in a year under clauses (e) and (f) shall be allotted on out of turn basis. This limit shall, however, be not applicable in respect of out of turn allotments under clauses (a) to (d) of sub-rule .(1).

Provided that the House Allotment COmmittee may, after due deliberation. require an applicant. who has been allolttld accommodation on out of turn basis. to vacate the said accommodation by giving two months notice, if any subsequent change in the circumstances does not warrant or justify the allotment made under this sub-rule.

Provided that out of turn allotment of Government residence will be made to an eligible Government employee "In exceptional circumstances of hardship or in public interest" subject to the conditions mentioned in the proviso.

Explanation 1. The expression "in exceptional circumstances of hardships" under this section means and includes the cases of physical and mental handicaps (50% & above), widows, blinds, applicants or tlleir spouses suffering from Cencer of AIDS or Mentally Challenged or other circumstances of like nature warranting out of turn allotment.

Explanation 2. It is made clear that the disability of the applicant/dependent of the applicant duly certified by the Disability Board of GMCH would only be considered for out of turn allotment on Medical Grounds. r 1020 CHD. ADMN GAZ. (EXTRA.), OCT. 7, 2008 (ASVN 15, 1930 SAKA)

9. In the said rules of 1996, after Rule 10(2), the following new rule shall be add'_u :-

(3) So far as Public interest is concerned, 'cases of those employees would be considered, who in public interest, have to perform official duties and other such functions as would warrant out of turn allotment of Government accommodation. The following factors would be pertinent in this regard :- (I) The employee should be working with a public servant whose nature of cfficial responsibility and duty is such as would necessitate working beyond the normal office hours, the supervisory pUblic servant would certify that the official for whom an out of turn allotment is being recommended by him also has to perform such official responsibility/duty which require him to work at odd hours/on holidays/beyond office hours etc. and that out of turn allotment of Government houses is, therefore, essential in order to enable such official to discharge his duty satisfactorily.

(ii) The name of only such official. should be recommended by the supervisory official who .has worked with him/her for a period not less than 6 months continuously.

(4) No allotment of house be made on out of turn basis on security grounds.

(5) Such employees who are already in occupation of Government accommodation out of the Chandigarh Administration General Pool/department pool houses/ State Government house would not be entitled for out of turn allotment of the GMCH Pool.

(6) There is provision of 10% of the houses allotted in a year to each categories on out of turn basis under Government residences (Government Medical College & Hospital, Chandigarh Pool), Allotment Rules, 1996.

(7) If any, question arises as to the interpretation of these Rules/Guidelines/ Policy, it shall be decided by the House Allotment Committee (Upper) whose decision shall be final and conclusive.

10. In the said rule of 1996, in rule 11 (2) the constitution of House Allotment Committee (Upper) shall be substituted as under :- However, the Chairman in consultation with Member Secretary may grant extension in deserving cases for a maximum period of 30 days.

11. In the said rules of 1996, in the Event No. (i) of the Table given under rule 12(2). the follOWing shall be substitutd as under :- The employee working on direct contract basis/tenure basis are permitted to retain the house for a period of 30 days in the event of completion of tenure/contract. In case of resignation, dismissal or removal from service, termination of services or unauthorized absence without permission, the extension will be for 15 da s. However, the Chairman in consultation with Member Secretary may grant extension in deserving cases for a maximum period of 30 days.

12. In the said rules of 1996, in rule 12(5) shall be substituted as under :- Extension of the period of retention of the residence beyond that specified in the table below sub-rule 2 may be allowed by the committee in exceptional cases except in the case of dismissed Government Officer/Official with reasons to be recorded in writing, / for a period not exceeding six months, on payment of 20 (Twenty) times of the normal license fee for the first three (03) months and 30 (thirty) times of the normal license fee for remaining three (03) months. 1 • CHD. 13. '(n the said rules of 1996, at the end of rule 13(2), the following shall be added as under :- However, in case the employee refuse to take over the possession of allotted accommodation within fourteen days, no Licence Fee will be charged but he/she will be liable to be debarred for allotment of GMCH Pool houses' for a period of one year from the date of issue of allotment order.

14. In the said rules of 1996, at the end of rule 16(1), the following proviso shall be added as under :-

Provided that the Professors can apply for change of Type VI and Associate Professors for Type V houses only. The allottees working on tenure/contract basis will not be allowed any change during the tenure/contractual period.

15. In the said. rules of 1996, the 3rd proviso to rule 16(2) shall be substituted as under :-

Provided that Employees of 'Government Medical College/Hospital, Chandigarh, to whom residences of the 'same type have been allotted under these rules, may apply for permission of mutual exchange in Form C appended to these nIles and mutual exchange of residences may be allowed subject to the condition that the alloltees/ occupants who are allowed mutual exchange cannot vacate the house within a period of one year from the date of taking over the possession of the house after mutual exchange: However, nothing in this sub-rule s,hall apply in case of Retirement/Repatriation, Resignation, Dismissal or Removal from service, Termination of services or unauthorized absence without permission 'from Government Medical College and Hospital or in case of alloltees/occupants working on tenure basis/dire~t contract basis.

16. In the said rules of 1996, after the rule 19(1)(f), a new rule 19(1)(11) shall be added as under :- Has knowingly obstructed/hindered in any manner or failed to provide free ingress to the authorized persons/officials, within a reasonable time, for maintenance; inspection or other purposes of like nature, despite due notice/knowledge of the purpose; or

17. In the said rules of 1996, in rule 21(1), after the words "shall be liable to pay" and before the words "the normal Licence Fee" the words "five times" shall be read as "two times". Gaz., dated the 1st February, 2011) CHANDIGARH ADMINISTRATION DEPARTMENT OF MEDICAL EDUCATION AND RESEARCH Notification The 6th January, 2011 No. GMCH/Estate/I-(203j/2010/558.-ln exercise of powers conferred by Rule 22 of the Government Residences (Government Medical College/Hospital, Chandigafh Pool) Allotment Rules, 1996, the Director Principal, Government Medical College and Hospital, U.T., Chandigarh hereby makes the following rules further to amend the Government Residences (Government Medical College and Hospital, Chandigarh Pool) Allotment Rules, 1996 namely :-

1. (i) These Rules may be called the Government Residences (Government Medical College and Hospital, Chandigarh Pool), Allotment (9th Amendment) Rules, 2010.

(ii) These shall come into force with immediate effect.

2. In the Government Residences (Government Medical College/Hospital, Chandigarh Pool) Allotment Rules, 1996 for Annexure-1, subsequently amended,-vide Notification No. Estate/1/(203)1 2008/42554, dated 1st October, 2008, the following shall be substituted namely :- Annexure-1

1. In the said rules of 1996, in Rule 2(n), the following provisio shall be added at the end as under :-

Provided that past service rendered by the officer/official in Defence/Armed Forces shall be counted for the purpose of determination of entitlement of accommodation for allotment of GMCH Pool Houses by way of fixation of "Notional pay" of Ex-servicemen. The notional pay shall be determined by the concemed Established Branch.

2. In the said rules of 1996, in Rule 12(2) the following table is inserted :­ Table

3. In the said rules of 1996, in Rule 12(5} of the Amendment notification circulated,-vide No. GMCH/Estate/1/(203}12008/42553, dated 1st October, 2008, the following shall be substituted as under '-- The Word "Substituted" is replaced with "Inserted".

4. In the said rules of 1996, in the last para of Rule 16(3) the proviso, at the end, shall be substituted as under ;-

Provided that no exchange of houses on mutual consent shall be allowed. (Sd) .. " Director Principal, Chairman, House Allotment Committee (Upper). 14005 CCUT-Govt. Press, U T., CM. Gaz., dated the 1st April, 2014] CHANDIGARH ADMINISTRATION DEPARTMENT OF MEDICAL EDUCATION AND RESEARCH Notification The 14th March, 2014 No. GMCH/Estatell·(203)/2014/10585.......Jn exercise of powers conferred by Rule 22 of the Government Residences (Government Medical College/Hospitll, Chandigarh Pool), Allotment Rules,

1996. the Director Principal, Government Medical College and Hospital, U.T., Chandigarh hereby makes the following rules further to amend the Government Residences (Government Medical College and Hospital. Chandigarh Pool) Allotment Rules, 1996. namely :- 1 (i) These rules may be called the Government Residences (Government Medical College and Hospital, Chandigarh Pool) Allotment (Amendment) Rules, 2014.

(ii) These shall come into force with immediate effect.

2. In the Government Residences (Government Medical College/Hospital, Chandigarh Pool) Allotment Rules, 1996, Rule 8 shall be substituted as under :- Procedure for inviting applications for allotment-

(i) The Member Secretary House Allotment Committee/duly authorized officer shall invite application for allotment of houses, by way of circular alongwith Form 'A', for various categories of residence twice in a calendar year.

(ii) The applications for allotment of house must be submitted within 21 days from the date of issuance of circular (as per sub-rule 1 of Section 8) :

Provided that where faculty staff joins GMCH any time after House Allotment Committee meeting finalizing the allotments, his/her application shall be accepted irrespective of cut off date and will be valid for due consideration by the House Allotment Committee. \

(iii) Applications for allotment of houses in Form 'A' shall be sent within schedule time to the Director Principal through HOD/incharge after the due verification of ~articulars of applicants on Form itself from concerned establishment branches.

Provided that the application Form 'A' must be submitted to HOD only after the due verification of his/her particulars from his/her establishment concerned.

(iv) A tentative seniority list of applicants of different categories of houses shall be prepared at least 1 month before House Allotment Committee meeting to be held twice in calendar year. Claim and objection, if any, shall be filed within 10 days from the date of pUblication of the tentative seniority list.

(v) Final seniority list shall be prepared and pUblished after approval of House Allotment Committee. Member Secretary would be competent to issue allotment letter on behalf of House Allotment Committee. \ I 2

3. In the Government Residences (Government Medical College/Hospital, Chandigarh Pool) Allotment Rules, 1996 for Annexure-1, Subsequently amended,-vide ~otification No. C&P/1/51/2K1/ 42503, dated 16th January, 2001, Estate/1/51/2006/05946, dated 20th February, 2006 and Estate/1/(203)/2008/42553, dated 1st October, 2008, the following shall be substituted as under Type of House Type VI Type V Eligibility

(a) Professors only on basis of their seniority.

1. Preference in allotment will be given in following sequence :-

(i) Professor on regular through UPSC

(ii) Professor on contractual basis

(iii) Re-designated Professor

2. In case a Professor working on contract basis subsequently appointed to the said post on regular basis though UPSC. then he/she will be given seniori y with effect from date of his joining on contract basis in GMCH.

3. In case the type VI house is not available, then applicant will be treated on top priority for allotment of type V house\

(a) Associate Professors only on basis of their seniority.

1. Preference in allotment will be given in following sequence :-

(i) Associate Professor on regular through UPSC

(ii) Associate Professor on contractual basis

(iii) Re-designated Associate Professor.

2. In case an Associate Professor working on contract baSIS subsequently appointed to the said post on regular basis though UPSC, then he/she will be given seniority with effect from date of his joining on contract basis in GMCH. (\D l 3. In case the type V house is not available, then applicant will be treated on top priority for allotment of type IV house. Type IV (a) Assistant Professors as per seniority for ~ector 32 houses.

1. Preference in allotment will be given in following sequence :-

(i) Assistant Professor on regular through UPSC

(ii) Assistant Professor on contractual basis

(b) Sr Residents, CMOs, Res. Anaesthetist, EMO Demonstrators for Sector 32, houses.

(c) Other Group "A" and "8" officers for houses except in Sector 32. \ / 3 Type of House Eligibility \ Type III Type II Employees, drawing basic pay of Rs. 13,500 (10,300+3,200) and above, in the scale of pay applicable with effect from 1st January, 2006. Employees, drawing basic pay of less than Rs. 13,500 (10,300+3,200) in the scale of pay with effect from 1st January, 2006. Type I (i) Group "0" employees.

(ii) Group "C" employees entitled for Type-II houses.

(iii) Group "C" employees entitled for Type-III houses if there will be no applicant mentioned as at Sr. No. (i) and (ii).

(iv) Group "C" employees when they are considered for the allotment on out of turn basis.

4. In the said rules of 1996, the following amendments are made in Rule 11

(i) In Rule 11 (1), there under the following words shall be added, at the end after word "allotment letter" :- \ "However, the Chairman in consultation with Member Secretary may grant extension in deserving cases for a maximum period of 30 days."

(ii) Amendment made in Rule 11 (2),-vide Notification No. GMCH/Estatell-(203)/2008/ 4253, dated 1st October, 2008 shall be deleted.

(iii) In Rule 11 there under the following additional clause shall be incorporated as 11 (3) :- "After the vacation of any house and before its fresh allotment, the Store Officer will certify in form of certificate that the house is in livable condition and is ready for occupation. Only after certification by Store Officer, the house will be allotted and allottee will be given 14 days of time to take possession of the house." .5. In the Government Residences (Government Medical College/Hospital, Chandigarh Pool) Allotment Rules, 1996, the amendment made in Event No. (i) of Table given under Rule 12(2),-vide Notification No. GMCH/Estate/I-(203)/2008/4253, dated 1st October, 2008 shall stand deleted.

6. In the Government Residences (Government Medical Colle~/Hospital, Chandigarh Pool) Allotment Rules, 1996, subsequently amended,-vide Notification No. Estate/1/(203)/2010/558, dated 6th January, 2011, the following clause as given below shall be added as Event No. (viii) in Table provided under Rule 12(2) :- "The employee working on direct contract basisltenure basis are permitted to retain the house for a period of 30 days in the event of completion of tenure/contract. In case of resignation, termination of services or unauthorized absence without permission, the extension will be for 15 days. However, the Chairman in consultation with Member Secretary may grant extension in deserving cases for a maximum period of 30 days." \ 4

7. In the Government Residences (Government Medical College/Hospital, Chandigarh Pool) Allotment Rules, 1996, in the Rule 12(5) subsequentlor amended,-vide Notification No. GMCH/Estate/ H203)/2008/4253, dated 1st October, 2008 and Notification No. Estate/1/(203)/2010/558, dated 6th January, 2011, shall be substituted as under :- \ "After the permissible period mentioned in Table under rule 12(2), the proceedings for eviction may be initiated after some prior notice. and in the meantime penalty of ,rent @ 50 times of the normal licence fee be charged,"

8. Amendment made in 3rd Proviso to Rule 16(2) "substituted",-vide Notifiction No, GMCH/Estate/I-(203)/2008/4253, dated 1st October, 2008 shall be deleted, 9, In the Government Residences (Government Medical College/Hospital, Chandigarh Pool) Allotment Rules, 1996, rule 16(1) and,-vide Notification No, GMCH/Estate/I-(203)/2008/4253, dated 1st October, 2008 shall be substituted as under :- "An employee of Government Medical College/Hospital, Chandigarh, to whom a residence has been allotted under these rules, may apply to the Member Secretary, House Allotment Committee for a change to another residence of the same type or a residence of the type to which he is eligible under rule 5 and 8, whichever is lower, Change in same type of house be allowed for the lind time after a period of 5 years from date of the 1st change, Further, change of house is not to be allowed, in case one has already been allotted higher type of house, till he becomes eligible for the said category of house: \

Provided that the allotlees working on tenure basis will not be allowed any change during the tenure period." (Sd,) Director Principal, Chairman, HAC (Upper), \ 3082 CCUT-Govt, Press, U. Gaz., dated the 1st January, 2017] CHANDIGARH ADMINISTRATION DEPARTMENT OF MEDICAL EDUCATION AND RESEARCH Notification The 5th December, 2016 No. GMCH/Estatell-(203)/2016/41609.-ln exercise of powers conferred by Rule 22 of the Government Residences (Government Medical College/Hospital, Chandigarh Pool) Allotment Rules, 1996, the Director Principal, Government Medical College and Hospital, U.T., Chandigarh hereby makes the following rules further to amend the Government Residences (Government Medical College and Hospital, Chandigarh Pool) Allotment Rules, 1996, namely :-

1. (i) These Rules may be called the Government Residences (Government Medical College and Hospital, Chandigarh Pool) Allotment (Amendment) Rules, 2016.

(ii) These shall come into force with immediate effect.

2. In the Government Residences (Government Medical College/Hospital, Chandigarh Pool) Allotment Rules, 1996 for Annexure-1, subsequently amended,-vide Notification No. C&P/1/51/2KlI 42503, dated 16th January, 2001, Estate/1/51/2006/05946, dated 20th February, 2006, Estate/1/

(203)/2008/42553, dated 1st October, 2008 and GMCH/Estatell-(203)/2014/10585, dated 14th March, 2014, the following shall be substituted as under :- Type of Houses Type VI Type V Eligibility

(a) Professors only on the basis of their seniority.

1. Preference in allotment will be given in following sequence :-

(i) First preference will be given to those who are appointed on regular basis through UPSC.

(ii) Second preference will be given to those who are appointed on contract basis/Career Assessment Scheme (CAS) from the date of joining in that particular designation.

2. In case a Professor working on contract basis subsequently appointed to the said post on regular basis through UPSC, then he/she will be given seniority with effect from the date of his/her joining on contract basis in GMCH, Chandigarh.

3. In case type VI house is not available, then applicant will be treated on top priority for allotment of type V house.

(c) Associate Professors only on the basis of their seniority.

1. Preference in allotment will be given in following sequence :-

(i) First preference will be given to those who are appointed on regular basis through UPSC.

(ii) Second preference will be given to those who are appointed on contract basis/Career Assessment Scheme (CAS) from the date of joining in that particular designation. 2 Type of Eligibility Houses Type IV Type III Type II Type I

2. In case an Associate Professor working on contract basis subsequently appointed to the said post on regular basis through UPSC, then he/she will be given seniority with effect from the date of his/her joining on contract basis in GMCH, Chandigarh.

3. In case type V house is not available, then applicant will be treated on top priority for allotment of type IV house.

(a) Assistant Professors as per seniority for Sector 32 Houses.

1. Preference in allotment will be given in following sequence

(i) Assistant Professor on regular through UPSC.

(ii) Assistant Professor on contractual basis.

(b) Sr. Residents, CMOs, Res. Anaesthetist, EMO, Demonstrators for Sector 32 Houses.

(c) Other Group "A" and "B" officers for houses except in Sector 32. Employees, drawing basic pay of ~ 13,500 (10,300+3,200) and above, in the scale of pay applicable with effect from 1st January, 2006. Employees, drawing basic pay of less than ~ 13,500 (10,300+3,200) in the scale of pay with effect from 1st January, 2006.

(v) Group "0" employees.

(vi) Group "CO employees entitled for Type-II houses.

(vii) Group "CO employees entitled for Type-III houses if there will be no applicant mentioned as at Sr. No. (i) and (ii).
