PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार् ुपररवतान मतं्रालर् अजधसचूना नई दिल्ली, 12 अक् तूबर, 2023 का.आ. 4458(अ).—जवजभन्न पणधारकों के पर्ाावरण अनुकूल कार्ों को प्रोत्साजित करने के जलए ग्रीन के्रजडट िते ु बािार-आधाररत िजृिकोण का लाभ उठाने के जलए राष्ट्रीर् स्ट्तर पर ग्रीन के्रजडट कार्ाक्रम आरंभ दकर्ा िा रिा ि;ै और भारत सरकार ने पर्ाावरण की सुरक्षा एवं संरक्षण और पर्ाावरण अनुकूल कार्ों, िो संरक्षण एवं संर्म की परंपराओं एवं मलू्र्ों पर आधाररत िीवन िीने के स्ट्वस्ट्थ एवं सतत तरीके का प्रचार करत ेिों, को बढाकर अन्र् पर्ाावरणीर् एवं िलवार् ुलाभों के जलए और सतत एव पर्ाावरण जितैषी जवकास के जलए भू स्ट्तर पर, िन आंिोलन के रूप में 'लाइफ' - 'पर्ाावरण ितेु िीवन िलैी' का प्रारम् भ ि;ै और पर्ाावरण के प्रजत सकारात्मक कार्ों को प्रोत्साजित करन े के जलए बािार-आधाररत अजभनव तंत्र “लाइफ” आंिोलन को बढावा िेन ेमें सिार्ता करेगा, जिसका उद्देश्र् उपभोक्ताओं और समाि को पर्ाावरण अनुकूल कार्ों को बढावा िेने वाल ेव्यविाररक पररवतानों की ओर प्रेररत करके सतत िीवन िलैी को प्रोत्साजित करना ि;ै और ग्रीन के्रजडट कार्ाक्रम, ऊिाा संरक्षण अजधजनर्म, 2001 (2001 का 52) के अधीन बनाई गई काबान के्रजडट व्यापार स्ट् कीम, 2023 से पथृक ि,ै ग्रीन के्रजडट प्रिान करन ेवाल ेपर्ाावरणीर् कार्ों से िलवार्ु संबंधी लाभ भी िो सकत ेिैं, िैसे काबान उत्सिान को कम करना र्ा समाप्त करना और ग्रीन के्रजडट कार्ाक्रम के अधीन ग्रीन के्रजडट प्रिान करन ेवाला कार्ा, उक्त स्ट् कीम के अधीन उसी कार्ा के जलए काबान के्रजडट भी प्राप्त दकर्ा िा सकेगा;

और कें द्रीर् सरकार द्वारा प्राप्त सभी आपजिर्ों और सुझावों पर सम् र्क रूप से जवचार दकर्ा गर्ा ि;ै अतः अब, कें द्रीर् सरकार पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29), धारा 3, धारा 6 और धारा 25 द्वारा प्रिि िजक्तर्ों का प्रर्ोग करते हुए जनम्नजलजखत जनर्म बनाती ि,ै अथाात्: -
1. सजंक्षप्त नाम और प्रारंभ — (1) इन जनर्मों का संजक्षप् त नाम ग्रीन के्रजडट जनर्म, 2023 ि।ै
(2) रे् रािपत्र में इनके प्रकािन की तारीख को प्रवृि िोंगे।
2. ग्रीन के्रजडट कार्ाक्रम के उदे्दश्र्. - (1) ग्रीन के्रजडट कार्ाक्रम बािार-आधाररत तंत्र के माध्र्म से पर्ाावरण ितेु सकारात्मक कार्ों को प्रोत्साजित करेगा और ग्रीन के्रजडट प्रिान करेगा, जिससे व्यापार कर पाएंगे और रे् घरेलू बािार मंच पर व्यापार ितेु उपलब्ध कराए िाएगंे।
(2) ग्रीन के्रजडट जनर्म 4 के उप-जनर्म (2) में जनर्िाि दकसी भी पर्ाावरणीर् कार्ा के जलए दकसी व्यजक्त द्वारा दकए गए उपार् से प्राप्त िोगा।
(3) ग्रीन के्रजडट कार्ाक्रम उद्योगों, कंपजनर्ों और अन्र् संस्ट्थाओं को वतामान में प्रवृि दकसी भी जवजध के अंतगात जवद्यमान िाजर्त्वों र्ा अन् र् िाजर्त्वों को पूरा करने के साथ-साथ जनर्म 4 में जनर्िाि स्ट्वैजछिक पर्ाावरणीर् उपार् करने ितेु अन् र् व्यजक्तर्ों, और इकाइर्ों को सुजवधा प्रिान करने के जलए ग्रीन के्रजडट प्रिान कर र्ा खरीिकर प्रोत्साजित करेगा;
परन् त ुदक उस समर् प्रवृि जवजध की अनुपालना में परेू दकए गए िाजर्त्व से सृजित र्ा प्राप्त ग्रीन के्रजडट व्यापार र्ोग्र् निीं िोगा।
3. पररभाषाएाँ - (1) इन जनर्मों में, िब तक दक संिभा में अन्र्था अपेजक्षत न िो, - (क) "प्रिासक" से जनर्म 7 में जनर्िाि प्रिासक अजभप्रते ि;ै (ख) "अजभजित अजभकरण" से जनर्म 13 के अधीन ऐसी अजभजित कोई इकाई अजभप्रेत ि;ै (ग) "ग्रीन के्रजडट" से दकसी जवजिि कार्ा, जिसका पर्ाावरण पर सकारात्मक प्रभाव पड़ता िो, ितेु प्रिान दकए गए प्रोत्सािन की एकल इकाई अजभप्रेत ि;ै (घ) "रजिस्ट्री" से तात्पर्ा जनर्म 10 के अधीन स्ट्थाजपत ग्रीन के्रजडट रजिस्ट्री अजभप्रेत ि।ै
(2) उन िब् िों और पिों के िो इन जनर्मों में प्रर्ुक् त िैं और पररभाजषत निीं िैं ककंत ुपर्ाावरण (संरक्षण) अजधजनर्म, 1986 में पररभाजषत िैं, विी अथा िोंग ेिो उस अजधजनर्म में ि।ै
4. ग्रीन के्रजडट कार्ाक्रम - (1) कोई व् र्जक्त र्ा इकाई पर्ाावरण की सुरक्षा, परररक्षण र्ा संरक्षण के प्रर्ोिनाथा उप-जनर्म (2) में जनर्िाि कोई भी उपार् कर सकेगा।
(2) उप-जनर्म (1) में जनर्िाि उपार्ों में जनम्नजलजखत कार्ा सजम्मजलत िैं, अथाात:्-
(i) वृक्षारोपण – सम्पूणा िेि में िररत आवरण बढाने के जलए कार्ों को प्रोत्सािन ितेु;
(ii) िल प्रबंधन - िल संरक्षण, िल संचर्न और िल के कुिल उपर्ोग र्ा िल बचत को प्रोत्सािन ितेु, जिसमें अपजिि िल का उपचार और पनु: उपर्ोग सजम्मजलत ि;ै
(iii) सतत कृजष - उत्पािकता, मृिा स्ट्वास्ट््र् और उत्पादित खाद्य के पोषण मलू्र् में सुधार लाने िते ुप्राकृजतक एवं पुनर्ोिी कृजष प्रथाओं और भूजम पुनरूद्धार को प्रोत्सािन िते;ु
(iv) अपजिि प्रबंधन - संग्रिण, पथृक्करण और पर्ाावरण की िजृि से सुिढृ प्रबंधन सजित अपजिि प्रबंधन िते ु चक्रीर्ता, सततता और पररष्कृत प्रथाओं को प्रोत्सािन िते;ु
(v) वार् ुप्रिषूण में कमी लाना - वार् ुप्रिषूण में कमी लाने वाल ेउपार्ों और अन्र् प्रिषूण उपिमन कार्ाकलापों के प्रोत्सािन ितेु;

(vi) मैंग्रोव संरक्षण और पनुरूद्धार - मैंग्रोव के संरक्षण और पनुरूद्धार के उपार्ों को प्रोत्सािन िते;ु
(vi) इकोमाका लेबल जवकजसत करना - जवजनमााताओं को अपन ेमाल और सेवाओं िते ुइकोमाका लेबल प्राप्त करन ेके जलए प्रोत्साजित करना;
(vii) सतत भवन और बुजनर्ािी ढांचा - पर्ाावरण अनुकूल प्रौद्योजगदकर्ों और सामजग्रर्ों का उपर्ोग करके सतत भवनों एवं अन्र् आधारभूत ढांचे के जनमााण को प्रोत्साजित करना।
(3) ग्रीन के्रजडट प्राप्त करन ेके इछिुक व्यजक्त र्ा संस्ट्था को उप-जनर्म (2) में जनर्िाि दकसी भी कार्ा िते ुग्रीन के्रजडट लेन ेके जलए उनके द्वारा दकए गए कार्ा को प्रिासक के पास रजिस्ट् टर करना िोगा।
(4) उप-जनर्म (3) के अधीन रजिस्ट् रीकरण ितेु आवेिन कें द्रीर् सरकार द्वारा इस प्रर्ोिनाथा स्ट्थाजपत वेबसाइट के माध्र्म से इलेक्रॉजनक रूप से प्रिासक को दकर्ा िाएगा।
(5) उप-जनर्म (4) के अधीन आवेिन प्राप्त िोन े पर, प्रिासक कार्ा को दकसी अजभजित अजभकरण द्वारा सत्र्ाजपत कराएगा।
(6) अजभजित अजभकरण, इस संबंध में बनाए गए दििाजनिेिों के अनुसार, सत्र्ापन एवं पूिताि, य़थावश्र्क, के पश्चात, आवेिक द्वारा दकए गए कार्ों की पुजि करते हुए प्रिासक को ररपोटा प्रस्ट्ततु करेगा।
(7) आवेिक द्वारा दकए गए कार्ों की पुजि करत ेहुए उप-जनर्म (6) के अधीन ररपोटा प्राप्त िोन ेपर, प्रिासक आवेिक को ग्रीन के्रजडट का प्रमाण पत्र प्रिान करेगा।
5. ग्रीन के्रजडट उत्पन्न करन ेकी पद्धजत - (1) दकसी भी कार्ा के संिभा में ग्रीन के्रजडट की गणना करने की पद्धजत इस प्रकार िोगी, िो प्रिासक की जसफाररिों पर कें द्रीर् सरकार द्वारा अजधसूजचत की िाए ।
(2) दकए गए दकसी भी कार्ा के संिभा में ग्रीन के्रजडट की गणना वांजित पर्ाावरणीर् पररणाम प्राप्त करन ेितेु आवश्र्क संसाधन, समान स्ट्केल, के्षत्र, आकार एवं अन्र् प्रासंजगक मापिंडों की समकक्षता पर आधाररत िोगी।
(3) जनर्म (4) के अधीन जनर्िाि कार्ों ितेु ग्रीन के्रजडट उत्पन्न करने और िारी करने की पद्धजतर्ााँ कें द्रीर् सरकार द्वारा अजधसूजचत की िाएंगी।
6. ग्रीन के्रजडट उत्पन्न करन ेकी प्रदक्रर्ा - (1) ग्रीन के्रजडट की गणना के प्रर्ोिनाथा दकए गए कार्ों के मूल्र्ांकन और सत्र्ापन की पद्धजत इस प्रकार िोगी, िो प्रिासक द्वारा जनधााररत की िाए।
(2) कार्ों के रजिस्ट् रीकरण का तरीका और इस प्रकार के रजिस्ट् रीकरण िते ुअपेजक्षत जववरण प्रिासक द्वारा जनधााररत दकर्ा िाएगा।
(3) प्रिासक कार्ों के रजिस्ट् रीकरण, दकए गए कार्ों के मलू्र्ांकन एवं सत्र्ापन और इस प्रकार सत्र्ाजपत कार्ों के के संबंध में इलेक्रॉजनक रूप से ग्रीन के्रजडट प्रिान करन ेिते ुवेबसाइट जवकजसत करेगा।
7. प्रिासक - (1) भारतीर् वाजनकी अनुसंधान एवं जिक्षा पररषि, सोसार्टी रजिस्ट् रीकरण अजधजनर्म, 1860 का सं. 21 के अधीन रजिस्ट् रीकरण संख्र्ा 596/1990-91 के अधीन रजिस्ट् रीकरण सोसार्टी तारीख 12 माचा, 1991 द्वारा स्ट्थाजपत और तत्कालीन पर्ाावरण और वन मंत्रालर्, भारत सरकार द्वारा फा. सं.1-8/89-आरटी, तारीख 22 िून, 1990 के माध्र्म से र्थाघोजषत एक स्ट्वार्ि जनकार्, इन जनर्मों के अधीन प्रिासक िोगा।
(2) प्रिासक इन जनर्मों के अधीन इसके प्रबंधन और संचालन सजित ग्रीन के्रजडट कार्ाक्रम के प्रभावी कार्ाान्वर्न के जलए उिरिार्ी िोगा।
(3) प्रिासक के उिरिाजर्त्वों में जनम्नजलजखत सजम्मजलत िोंगे, अथाात्: - (क) इन जनर्मों के अधीन ग्रीन के्रजडट कार्ाक्रम के कार्ाान्वर्न के जलए दििाजनिेि, प्रदक्रर्ाए ंऔर कार्ा प्रणाली जवकजसत करना;
(ख) पद्धजतर्ां, रजिस्ट् रीकरण प्रदक्रर्ा, दििाजनिेि और संबंजधत माप, ररपोर्टिंग और सत्र्ापन ितेु तंत्र जवकजसत करना;
(ग) ग्रीन के्रजडट (जडजिटल ग्रीन के्रजडट िारी करने सजित) और प्रत्र्ेक जचजननत कार्ा से उत्पन्न ग्रीन के्रजडट का समतुल्र् िारी करन ेिते ुकार्ाप्रणाली और प्रदक्रर्ाएं स्ट्थाजपत करना;
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (घ) ग्रीन के्रजडट रजिस्ट्री और व्यापार मंच की स्ट्थापना और संचालन ितेु; ग्रीन के्रजडट िारी करन ेिते ुदकसी कार्ा के रजिस्ट् रीकरण के जलए स्ट्व-प्रमाणन र्ा तृतीर् पक्ष प्रमाणन ितेु; अजभजित अजभकरण द्वारा इसके जनरीक्षण और सत्र्ापन ितेु और लेखा-परीक्षकों का पैनल बनाने एवं ऐसे लेखा-परीक्षकों द्वारा लेखा परीक्षा करन े िते ु दििाजनिेि जवकजसत करना;
(ङ) अनुमोदित दििाजनिेिों के अनुसार ग्रीन के्रजडट रजिस्ट्री व्यापार मंच सेवा प्रिाता की स्ट्थापना र्ा नाजमत करना;
(च) ग्रीन के्रजडट प्रोग्राम पोटाल, ज्ञान एवं डेटा मंच और रजिस्ट् रीकरण संस्ट्थाओं से िुल्क के जलए दििाजनिेि जवकजसत करना;
(ि) नाजमत अजभकरण, रजिस्ट्री, व्यापार मंच और ज्ञान एवं डेटा मंच द्वारा वार्षाक जववरजणर्ां एवं प्रगजत प्रजतवेिन ििा करन ेके जलए दििाजनिेि जवकजसत करना;
(ि) ग्रीन के्रजडट के व्यापार ितेु बािार जस्ट्थरता तंत्र के जलए दििाजनिेि जवकजसत करना। (झ) ग्रीन के्रजडट प्रमाणपत्रों के व्यापार से संबंजधत मामलों को जवजनर्जमत करना और जवके्रताओं और के्रताओं िोनों के जितों की रक्षा करना और धोखाधड़ी र्ा अजवश्वास को रोकने के जलए जनवारक एवं सुधारात्मक कारावाई करना।
(4) प्रिासक उपरोक्त उपजनर्म (3) के अधीन दििाजनिेिों एवं पद्धजतर्ों िते ु कें द्रीर् सरकार का अनुमोिन प्राप्त करेगा।
8. सचंालन सजमजत - (1) कें द्रीर् सरकार द्वारा गरठत की िाने वाली संचालन सजमजत इन जनर्मों के अधीन ग्रीन के्रजडट कार्ाक्रम के कार्ाान्वर्न की जनगरानी ितेु उिरिार्ी िोगी।
(2) संचालन सजमजत में मंत्रालर्ों र्ा जवभागों के प्रजतजनजध, पर्ाावरण के्षत्र के जविेषज्ञ, उद्योग संघ और अन्र् प्रासंजगक पणधारक सजम्मजलत िोंगे जिन्िें कें द्रीर् सरकार उजचत समझे।
(3) संचालन सजमजत, समर्-समर् पर, इन जनर्मों के अधीन ग्रीन के्रजडट कार्ाक्रम की समीक्षा करेगी और जनम्नजलजखत के संबंध में कें द्रीर् सरकार को जसफाररिें करेगी, अथाात:्- (क) ग्रीन के्रजडट कार्ाक्रम में सजम्मजलत दकए िान ेवाले कार्ा और के्षत्र के संबंध में; और (ख) कें द्रीर् सरकार द्वारा इसको संिर्भात दकसी भी मामले के संिभा में।
9. तकनीकी सजमजत — (1) केंद्रीर् सरकार, प्रिासक की जसफाररिों के आधार पर प्रत्र्ेक कार्ा िते ुतकनीकी सजमजतर्ों का गठन कर सकें गी, िो इन जनर्मों के अधीन ग्रीन के्रजडट कार्ाक्रम के कार्ाान्वर्न में प्रिासक की सिार्ता करेगी।
(2) प्रत्र्ेक तकनीकी सजमजत के सिस्ट्र्ों में मंत्रालर्ों एवं जवभागों, संगठनों और उस कार्ा से संबंजधत के्षत्र में ज्ञान और अनुभव रखने वाल ेजविेषज्ञ सजम्मजलत िोंग;े
(3) तकनीकी सजमजत जसफाररिें जवकजसत करेगी और प्रिासक को प्रेजषत करेगी जिसमें अन्र् बातों के साथ-साथ जनम्नजलजखत सजम्मजलत भी िोगा – (क) वांजित पर्ाावरणीर् पररणाम प्राप्त करन े िते ु आवश्र्क संसाधन, समान स्ट्केल, के्षत्र, आकार एवं अन्र् प्रासंजगक मापिंडों की समकक्षता के आधार पर ग्रीन के्रजडट की एक इकाई की गणना के जलए पद्धजत;
(ख) प्रत्र्ेक कार्ा के संबंध में रजिस्ट् रीकरण, सत्र्ापन, मूल्र्ांकन, माप और ररपोर्टिंग प्रदक्रर्ा के जलए तंत्र।
(4) प्रिासक द्वारा तकनीकी सजमजत को जनर्िाि दकसी भी अन्र् तकनीकी मामले पर र्ि परामिा िगेी।
10. ग्रीन के्रजडट रजिस्ट्री - (1) प्रिासक र्ा नाजमत अजभकरण प्रत्र्ेक ग्रीन के्रजडट का रजिस्ट् रीकरण करने एवं िारी करन ेिते ु ग्रीन के्रजडट रजिस्ट्री की स्ट्थापना एवं रखरखाव करेगी।
(2) रजिस्ट्री इलेक्रॉजनक डेटाबेस िोगी, जिसमें अन्र् बातों के साथ-साथ, रजिस्ट् रीकरण एवं ग्रीन के्रजडट िारी करने से संबंजधत सामान्र् डेटा तत्व सजम्मजलत िोंगे।
(3) रजिस्ट्री जनम्नजलजखत कार्ों का जनवािन करेगी, अथाात्: - [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (क) कार्ों का रजिस्ट् रीकरण और ग्रीन के्रजडट िारी करना;
(ख) ग्रीन के्रजडट िारी करन ेका सटीक लेखा-िोखा सुजनजश्चत करना;
(ग) सभी आवश्र्क एवं अजनवार्ा सुरक्षा प्रोटोकॉल के साथ सुरजक्षत डेटाबेस बनाए रखना;
(घ) प्रिासक द्वारा इसे सौंपा गर्ा कोई अन्र् कार्ा।
11. रेडडंग प्लटेफामा - (1) प्रिासक केन्द्रीर् सरकार के अनुमोिन से (व्यापार मंच) रेडडंग प्लटेफॉमा की स्ट्थापना करेगा एवं उसका रखरखाव करेगा।
(2) रेडडगं प्लेटफॉमा केन्द्रीर् सरकार के अनुमोिन से प्रिासक द्वारा बनाए गए दििाजनिेिों के अनुसार, ग्रीन के्रजडट के व्यापार संबंधी कार्ा करेगा।
12. ज्ञान एव ंडेटा मचं - (1) प्रिासक दकए िा रि ेजवजभन्न कार्ों के संबंध में पारिर्िाता प्रिान करने और इन जनर्मों के अधीन क्षेत्रवार प्रगजत की ररपोटा करने िते,ु केन्द्रीर् सरकार के अनुमोिन से, ज्ञान एवं डेटा मंच जवकजसत करेगा एवं उसका रखरखाव करेगा।
(2) ज्ञान एवं डेटा मंच रजिस्ट्री से उत्पन्न प्रमुख डेटा डबंिओुं और अन्र् िानकारी, िैसे क्षेत्रवार उपलजब्धर्ां, सवोिम प्रथाए,ं क्षमता जनमााण संबंधी िानकारी आदि को संगृिीत कर सकेगा।
13. अजभजित अजभकरण - (1) प्रिासक ऐसी संस्ट्थाओं को केन्द्र सरकार द्वारा अनुमोदित दििाजनिेिों के अनुसार अजभजित अजभकरण के रूप में कार्ा करन ेके जलए संस्ट्थाओं को नाजमत करेगा।
(2) अजभजित अजभकरण इन जनर्मों के अधीन ग्रीन के्रजडट िारी करन ेितेु आवेिक द्वारा दकए गए कार्ों के सत्र्ापन के संबंध में दििाजनििेों के अनसुार सत्र्ापन करवाएगा और प्रिासक को ररपोटा प्रस्ट्तुत करेगा;
(3) अजभजित अजभकरण दििाजनिेिों के अनुसार प्रिासक को वार्षाक जववरजणर्ां प्रस्ट् तुत करेगा।
14. ग्रीन के्रजडट िते ुमागं उत्पन्न करना - (1) इन जनर्मों के अधीन ग्रीन के्रजडट कार्ाक्रम में भागीिारी स्ट्वैजछिक भागीिारी पर आधाररत िोगी।
(2) संचालन सजमजत िेि में ग्रीन के्रजडट की मांग उत्पन्न करन ेके उपार्ों की जसफाररि करेगी।
15. लखेापरीक्षक. - (1) प्रिासक, अजभजित अजभकरण, रजिस्ट्री, व्यापार मंच और ज्ञान एवं डेटा मंच के कार्ों की प्रत्र्ेक तीसरे जविीर् वषा की समाजप्त पर एक वषा के भीतर संचालन सजमजत की अनिुंसा पर कें द्रीर् सरकार द्वारा जनर्ुक्त स्ट्वतंत्र लेखा परीक्षकों द्वारा लेखा परीक्षा करवाई िाएगी।

AND WHEREAS the Government of India has introduced ‘LiFE'-'Lifestyle for Environment’, as a grass-root, mass movement, for protection and conservation of environment and for other environmental and climate gains, by enhancing environmental actions that propagate a healthy and sustainable way of living based on traditions and values of conservation and moderation, and for sustainable and environment-friendly development;
6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS an innovative market-based mechanism to incentivise environment positive actions will help promote the LiFE movement, which aims at encouraging sustainable lifestyles by driving consumer and community towards behavioural changes that promote environment friendly actions;
AND WHEREAS the Green Credit programme is independent of the carbon credit under the Carbon Credit Trading Scheme, 2023 made under the Energy Conservation Act, 2001 (52 of 2001), an environmental activity generating green credit may have climate co-benefits, such as reduction or removal of carbon emissions and an activity generating green credit under Green Credit programme may also get carbon credit from the same activity under the said Scheme;
AND WHEREAS the draft Green Credit Programme Implementation Rules, 2023 was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide notification number S.O. 2779(E), dated the 26th June 2023 inviting objections and suggestions from all persons;
AND WHEREAS all the objections and suggestions received have been duly considered by the Central Government;
NOW, THEREFORE, in exercise of the powers conferred by section 3, section 6 and section 25 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby makes the following rules, namely:—
1. Short title and commencement.— (1) These rules may be called the Green Credit Rules, 2023.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Objectives of Green Credit programme.— (1) The green credit programme shall incentivise environmental positive actions through market-based mechanism and generate green credit, which shall be tradable and made available for trading on a domestic market platform.
(2) The green credit will arise from taking measures by a person of any environment activities referred to in sub-rule (2) of rule 4.
(3) The green credit programme shall encourage industries, companies and other entities to meet their existing obligations or other obligations under any law for the time being in force, and encourage other persons and entities, to undertake voluntary environmental measures referred to in rule 4 by generating or buying green credit:
Provided that the green credit generated or procured to fulfil any obligation in compliance of any law for the time being in force shall not be tradable.
3. Definitions.— (1) In these rules, unless the context otherwise requires,—
(a) “Administrator” means the Administrator referred to in rule 7;
(b) “designated agency” means an entity designated as such under rule 13;
(c) “Green Credit” means a singular unit of an incentive provided for a specified activity, delivering a positive impact on the environment;
(d) “Registry” means the Green Credit Registry established under rule 10.
(2) Words and expressions used in these rules and not defined herein but defined in the Environment (Protection) Act, 1986, shall have the same meaning as assigned to them in the Act.
4. Green Credit programme.— (1) Any person or entity may take any measure specified under sub-rule (2) for the purposes of protection, preservation, or conservation of the environment.
(2) The measures referred to in sub-rule (1) may include the following activities, namely:—
(i) tree plantation—to promote activities for increasing the green cover across the country;
(ii) water management—to promote water conservation, water harvesting and water use efficiency or water savings, including treatment and reuse of wastewater;
(iii) sustainable agriculture—to promote natural and regenerative agricultural practices and land restoration to improve productivity, soil health and nutritional value of food produced;
(iv) waste management—to promote circularity, sustainable and improved practices for waste management, including collection, segregation, and environmentally sound management;
(v) air pollution reduction—to promote measures for reducing air pollution and other pollution abatement activities;
(vi) mangrove conservation and restoration—to promote measures for conservation and restoration of mangroves;

(vi) ecomark label development—to encourage manufacturers to obtain ecomark label for their goods and services;
(vii) sustainable building and infrastructure—to encourage the construction of sustainable buildings and other infrastructure using environment friendly technologies and materials.
(3) A person or entity desirous of obtaining green credit shall register the activity with the Administrator for any activity referred to in sub-rule (2) undertaken by him for grant of green credit.
(4) An application for registration under sub-rule (3) shall be made to the Administrator electronically through a website established by the Central Government for that purpose.
(5) On receipt of the application under sub-rule (4), the Administrator shall cause the activity to be verified by a designated agency.
(6) The designated agency shall, after making such verification and inquiry as it may deem necessary, in accordance with the guideline made in this behalf, submit a report to the Administrator verifying the activities undertaken by the applicant.
(7) On receipt of the report under sub-rule (6) verifying the activities undertaken by the applicant, the Administrator shall grant the applicant a certificate of green credit.
5. Methodology of generating green credit.—(1) The methodology for calculating the green credit in respect of any activity undertaken shall be such as may be notified by the Central Government on the recommendation of the Administrator.
(2) The calculation of green credit in respect of any activity undertaken shall be based on equivalence of resource requirement, parity of scale, scope, size and other relevant parameters required to achieve the desired environmental outcome.
6. Procedure for generation of green credit.— (1) The methodology for evaluation and verification of the activities undertaken for the purpose of calculation of green credit shall be such as may be determined by the Administrator.
(2) The manner of registration of the activities and the details required for such registration shall be determined by the Administrator.
(3) The Administrator shall develop the website for registration of activities, evaluation and verification of activities undertaken and award of green credit in respect of such verified activities, electronically.
7. Administrator.— (1) The Indian Council of Forestry Research and Education, a Society registered under the Societies Registration Act, 1860 (21 of 1860) vide Registration No.596/1990-91, dated the 12th March, 1991 and an autonomous body as declared by the then Ministry of Environment and Forests, Government of India vide Resolution No.1-8/89-RT, dated the 22nd June, 1990, shall be the Administrator under these rules.
(2) The Administrator shall be responsible for the effective implementation of the Green Credit programme, including its management and operation under these rules.
(3) The responsibilities of the Administrator shall include the following, namely:—
(a) develop guidelines, processes and procedures for the implementation of the green credit programme under these rules;
(b) develop methodologies, registration process, guidelines and associated measurement, reporting and verification mechanism;
(c) establish methodologies and processes for issuance of green credit (including issuance of digital green credit), and equivalence of green credit generated from each identified activity;
(d) develop guidelines for the establishment and operation of the Green Credit Registry and trading platform; for self-certification or third-party certification for the registration of an activity for issuance of green credits and its inspection and verification by designated agency, for empanelment of auditors and audit by such auditors;
(e) establish or designate the Green Credit Registry, and trading platform service provider in accordance with the approved guidelines;
(f) develop guidelines for the green credit programme portal, the knowledge and data platform, and for the fees from the registered entities;
(g) develop guidelines for filing of annual returns and progress reports by designated agency, Registry, trading platform and knowledge and data platform;

(h) develop guidelines for the market stability mechanism for trading of green credit.
(i) regulate matters relating to trading of green credit certificates and to safeguard interest of sellers and buyers; and take preventive and corrective actions to prevent fraud or mistrust.
(4) The Administrator shall seek approval of the Central Government for guidelines and methodologies under sub-rule (3).
8. Steering Committee.— (1) A Steering Committee to be constituted by the Central Government shall be responsible for the monitoring of the implementation of the Green Credit programme under these rules.
(2) The Steering Committee shall comprise of representatives from the Ministries or Departments, experts from the field of environment, industry associations and other relevant stakeholders as the Central Government may consider appropriate.
(3) The Steering Committee shall, from time to time, review the Green Credit programme under these rules and make recommendations to the Central Government in respect of following, namely:—
(a) activities and sectors to be included in the Green Credit programme; and
(b) any matter referred to it by the Central Government.
9. Technical Committee.— (1) The Central Government, based on the recommendations of the Administrator, may constitute Technical Committees for each activity which shall assist the Administrator in implementation of the Green Credit programme under these rules.
(2) Each Technical Committee shall comprise of members from the Ministries and Departments, organisations and experts having the knowledge and experience in the field related to the activity;
(3) Technical Committee shall develop and make recommendations to the Administrator which will inter alia include—
(a) methodology for calculation of one unit of Green Credit, on the basis of equivalence of resource requirement, parity of scale, scope, size and other relevant parameters required to achieve the desired environmental outcome;
(b) mechanism for registration, verification, evaluation, measurement and reporting process in respect of each activity.
(4) The Technical Committee shall advise on any other technical matter referred to it by the Administrator.
10. Green Credit Registry.— (1) The Administrator or designated agency shall establish and maintain a Green Credit Registry for the registration and issuance of each Green Credit.
(2) The Registry shall be an electronic database, which, inter alia, shall contain common data elements relevant to the registration and issuance of green credit.
(3) The Registry shall discharge the following functions, namely:—
(a) registration of activities and issuance of green credit;
(b) ensure accurate accounting of the issuance of green credit;
(c) maintain secure database with all required and essential security protocols;
(d) any other function assigned to it by the Administrator.
11. Trading platform.— (1) The Administrator shall establish and maintain a trading platform with the approval of the Central Government.
(2) The trading platform shall perform functions regarding the trading of green credit, in accordance with the guidelines made by the Administrator with the approval of the Central Government.
12. Knowledge and data platform.— (1) The Administrator shall develop and maintain a knowledge and data platform, with approval of the Central Government, for providing transparency on various activities being undertaken and for reporting sectoral progress under these rules.
(2) The knowledge and data platform may collate key data points generated from the Registry and other information, such as sectoral achievements, best practices, information on capacity building, etc.
13. Designated agency.— (1) The Administrator shall designate such entities to act as designated agency in accordance with the guidelines approved by the Central Government.

(2) The designated agency shall conduct verification and submit reports to the Administrator in accordance with the guidelines as regard to the verification of the activities undertaken by an applicant for issuance of green credit under these rules.;
(3) The designated agency shall file annual returns to the Administrator in accordance with the guidelines.
14. Demand generation for green credit.— (1) The participation to the Green Credit programme under these rules shall be based on voluntary participation.
(2) The Steering Committee shall recommend measures to generate demand for green credit in the country.
15. Auditors.— (1) The activities of the Administrator, designated agency, Registry, trading platform and knowledge and data platform shall be audited within a period of one year at the end of every third financial year by independent auditors to be appointed by the Central Government on the recommendation of the Steering Committee.
(2) The auditor referred to in sub-rule (1) shall submit its audit report to the Administrator.
(3) The Administrator shall submit an action taken report on the audit report to the Central Government within a period of six months from the date of the receipt of the audit report.
