1. (1) इन िनयमᲂ को पासपोटᭅ (संशोधन) िनयम, 2016 कहा जाएगा ।
(2) ये राजपᮢ मᱶ उनके ᮧकाशन कᳱ ितिथ को ᮧवृᱫ हᲂगे ।
2. पासपोटᭅ िनयम, 1980 मᱶ (िजनका यहाँ से आगे उᲦ िनयम के ᱨप मᱶ उ᭨लेख ᳰकया जाएगा), सारणी III मᱶ:-
(i) “(क) पासपोटᭅ” के अंतगᭅत उप-शीषᭅक “गोद िलए गए बᲬᲂ के िलए” और इससे संबंिधत ᮧिवि᳥यᲂ के िलए, िन᳜िलिखत को ᮧित᭭थािपत ᳰकया जाएगा, अथाᭅत:- “गोद िलए गए बᲬᲂ के िलए: दशे के भीतर (घरेलू ᱨप से) गोद िलए गए बᲬᲂ के मामले मᱶ िन᳜िलिखत द᭭तावेज़ ᮧ᭭तुत करने हᲂगे: गोद लेने वाले अिभभावक(कᲂ) ᳇ारा आवेदक को जैिवक अिभभावक(कᲂ) से गोद िलए जाने कᳱ पुि᳥/िववरण वाला गोदनामा जो नोटरीकृत या पंजीकृत हो सकता है। यᳰद आवेदक के पास गोद िलए जाने कᳱ पुि᳥ के संबंध मᱶ ᳰकसी भी ᮧकार का द᭭तावेज़ न हो और ि᭭थित ऐसी हो ᳰक जैिवक/गोद लेने वाले अिभभावकᲂ कᳱ मृ᭜यु अथवा ᳰकसी अ᭠य कारण से ऐसे द᭭तावेज़ को अब तैयार नहᱭ ᳰकया जा सकता हो, जो भी हो, आवेदक एक साद ेकागज पर गोद िलए जाने कᳱ पुि᳥ संबंधी उ᭞᳒ोषणा द ेसकता ह ै।
(ii) “(ख) नाम मᱶ पᳯरवतᭅन” और इससे संबंिधत ᮧिवि᳥यᲂ के अंतगᭅत िन᳜िलिखत को ᮧित᭭थािपत ᳰकया जाएगा, अथाᭅत:- “(ख) पनुः जारीकरण के आधार पर पासपोटᭅ मᱶ नाम मᱶ पᳯरवतᭅन/पित अथवा प᳀ी का नाम जोड़ा जाना (I) िववाह, पुनᳶववाह अथवा तलाक के बाद: 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (क) अपने/अपनी पित/प᳀ी का नाम अपने पासपोटᭅ मᱶ दजᭅ कराने के िलए पासपोटᭅ पुनः जारीकरण हतेु आवेदन करने वाला आवेदक ; (ख) िववाह के कारण वतᭅमान पासपोटᭅ मᱶ नाम/कुलनाम पᳯरवतᭅन के िलए आवेदन करने वाली मिहला; (ग) वतᭅमान पासपोटᭅ मᱶ पित/प᳀ी का नाम पᳯरवतᭅन अथवा पित/प᳀ी का नाम हटाने के िलए आवेदन करने वाले तलाक़शुदा ᳞िᲦ; (घ) पासपोटᭅ मᱶ अपने नाम/पित अथवा प᳀ी के नाम मᱶ पᳯरवतᭅन हेतु आवेदन करने वाले पुनᳶववािहत आवेदक; आवेदक (उपᳶलिखत वगᲄ मᱶ से कोई भी) ᳇ारा आवेदन ᮧपᮢ मᱶ उपल᭣ध कराई गई जानकारी के अितᳯरᲦ िववाह / िववाह िव᭒छेद का कोई ᮧमाण (᭠याियक ᱨप से अलग हो जाने का ᭠यायालय आदशे/तलाक आदशे) आᳰद कᳱ आव᭫यकता नहᱭ ह ै । (II) नाम मᱶ पᳯरवतᭅन कᳱ अ᭠य पᳯरि᭭थितयᲂ मᱶ आवेदक (पुᱧष और मिहला दोनᲂ) को ᮧ᭭तुत करना होगा:
(i) दो ᭃेᮢीय अखबारᲂ कᳱ कतरन या संबंिधत रा᭔य के राजपᮢ कᳱ अिधसूचना, जो भी हो;
(ii) इि᭒छत/आवेᳰदत नाम मᱶ जारी कम से कम दो सावᭅजिनक/िव᳒ालयी द᭭तावेज़ यह सुिनि᳟त करने के िलए ᳰक आवेदक ने वा᭭तव मᱶ नाम पᳯरवᳶतत कर िलया ह ै।
3. उᲦ िनयमᲂ कᳱ अनुसूची III के अनु᭒छेद V मᱶ अनुबंधᲂ ‘क’, ‘ख’, ‘ग’, ‘घ’, ‘ङ’, ‘च’, ‘छ’, ‘ज’, ‘झ’, ‘ञ’, ‘ट’, ‘ठ’, और ‘ड’, और इनसे संबंिधत ᮧिवि᳥यᲂ के िलए, िन᳜िलिखत अनुबंध और उनसे संबंिधत ᮧिवि᳥याँ ᮧित᭭थािपत हᲂगी, अथाᭅत:- अनबुधं (क) के᭠ᮤ सरकार/रा᭔य सरकार/वैधािनक िनकायᲂ/सावᭅजिनक उपᮓमᲂ के सभी कमᭅचाᳯरयᲂ, उनके पित/प᳀ी और 18 वषᭅ तक कᳱ आय ुके बᲬᲂ को पहचान ᮧमाण पᮢ उपल᭣ध कराना आव᭫यक है (लाग ून होन ेवाल ेिवक᭨पᲂ को काट दᱶ) (कायाᭅलय के पᮢ शीषᭅ पर दो ᮧितयᲂ मᱶ ᳰदया जाए) ᮧमािणत ᳰकया जाता ह ै ᳰक ᮰ी/᮰ीमती/सु᮰ी .......................... पुᮢ/प᳀ी/पुᮢी ᮰ी ............................., जो ᳰक भारतीय नागᳯरक ह ै और .................................. का ᳰदनांक .................... से ᭭थायी/अ᭭थायी कमᭅचारी है और वतᭅमान मᱶ .............................. के पद पर कायᭅरत ह ै । ᮰ी/᮰ीमती/सु᮰ी .......................... भी भारतीय नागᳯरक ह ै और ᮰ी/᮰ीमती ......................... का आि᮰त पाᳯरवाᳯरक सद᭭य है और उसकᳱ पहचान को ᮧमािणत ᳰकया जाता ह ै। इस मंᮢालय/िवभाग/सं᭭थान को इनके भारतीय पासपोटᭅ को हािसल करने के संबंध मᱶ कोई आपिᱫ नहᱭ ह ै। मᱹ, अधोह᭭ताᭃरी इस पहचान ᮧमाण पᮢ पर ह᭭ताᭃर करने के िलए यथोिचत ᱨप से अिधकृत ᱠँ । मᱹने पारपᮢ अिधिनयम, 1967 के भाग 6 (2) के ᮧावधानᲂ को पढ िलया ह ैऔर मᱹ ᮧमािणत करता ᱠ ँᳰक आवेदक के मामले मᱶ इन ᮧावधानᲂ का उ᭨लंघन नहᱭ होता है । मᱹ इ᭠हᱶ भारतीय पासपोटᭅ ᮧदान ᳰकये जाने कᳱ अनुशंसा करता/करती ᱠ ँ। ᮧमािणत ᳰकया जाता ह ैᳰक यह सं᭭थान के᭠ᮤ सरकार/रा᭔य सरकार/सावᭅजिनक ᭃेᮢ का उपᮓम/वैधािनक िनकाय ह ै। ᮰ी/᮰ीमती/सु᮰ी .............................. 1. आवेदक का पासपोटᭅ आकार का एक छायािचᮢ भी स᭜यापन ᮧमाण पᮢ पर िचपकाया जाना चािहए और इसे जारीकताᭅ अिधकारी ᳇ारा इस ᮧकार स᭜यािपत ᳰकया जाना चािहए ᳰक आधे ह᭭ताᭃर और मुहर छायािचᮢ पर हᲂ और आधे ᮧमाण पᮢ पर ।
2. यᳰद आवेदक िपछले एक वषᭅ मᱶ एक से अिधक ᭭थानᲂ पर िनवासरत रहा ह ैतो िपछले सभी िनवास ᭭थानᲂ के पते संबंिधत तारीखᲂ सिहत दजᭅ ᳰकये जाने चािहए ।
3. इस स᭜यापन ᮧमाण पᮢ को िन᳜िलिखत मᱶ से ᳰकसी एक से स᭜यािपत कराया जा सकता ह ै:
(i) भारत सरकार के अवर सिचव/उप सिचव/िनदशेक/संयुᲦ सिचव/अपर सिचव/िवशेष सिचव/सिचव/कैिबनेट सिचव ।
(ii) रा᭔य सरकार के िनदशेक/ संयुᲦ सिचव/अपर सिचव/िवशेष सिचव/मुय सिचव ।
(iii) उप ᮧभागीय द᭛डािधकारी/ᮧथम ᮰ेणी ᭠याियक मिज᭭ᮝेट/अपर िजला द᭛डािधकारी/ आवेदक के िनवास के िजले का िजला मिज᭭ᮝेट ।
(iv) आवेदक के िनवास वाले ᭃेᮢ का िजला पुिलस अधीᭃक, डी॰आई॰जी॰ /आई॰जी॰/ डी॰जी॰पी॰।
(v) थल सेना मᱶ मेजर या उᲬ पद का अिधकारी, नौ सेना का लेि᭢टनᱶट कमांडर या उᲬ पद का अिधकारी, वायु सेना का सकवाᮟन लीडर या उᲬ पद का अिधकारी ।
(vi) सावᭅजिनक ᭃेᮢ के उपᮓमᲂ और भारतीय ᳯरजवᭅ बᱹक के महाᮧबंधक या उᲬ पद के अिधकारी ।
(vii) ᳰकसी अिखल भारतीय सेवा या के᭠ᮤीय सेवा के वे अिधकारी जो अवर सिचव के रᱹक के समकᭃ या उᲬ पद पर ह ᱹअथाᭅत 7वᱶ वेतन आयोग ᳇ारा अनुशंिसत वेतन मेᳯᮝस मᱶ ᭭तर 11 अथवा इससे अिधक वेतन पाने वाले अिधकारी ।
(viii) सभी रा᭔य सरकारᲂ के ᳰद᭨ली आधाᳯरत ᭭थािनक आयुᲦ/अपर ᭭थािनक आयुᲦ ।
(ix) आवेदकᲂ के िनवास ᭃेᮢ के तहसीलदार या संबंिधत एस॰एच॰ओ॰ ।
4. जो कोई भी गलत स᭜यापन ᮧमाण पᮢ जारी करता ह ैउस पर पासपोटᭅ अिधिनयम, 1967 कᳱ धारा 12(2) के अधीन अिभयोग चलाया जा सकता ह ै।
5. पासपोटᭅ अिधिनयम, 1967 कᳱ धारा 6(2):- “इस अिधिनयम कᳱ अ᭠य धाराᲐ के अधीन पासपोटᭅ जारीकताᭅ ᮧािधकरण उपबंध (सी) के उप ख᭛ड 5 के अनुसार िन᳜िलिखत मᱶ से ᳰकसी एक या अिधक कारणᲂ के चलते ᳰकसी िवदशेी रा᳦ कᳱ याᮢा करने हतेु पासपोटᭅ अथवा याᮢा द᭭तावेज़ जारी करने से मना कर सकता ह”ै अथाᭅत :- (क) ᳰक आवेदक भारत का नागᳯरक नहᱭ ह ै। (ख) ᳰक आवेदक भारत के बाहर उन गितिविधयᲂ मᱶ शािमल ह ैया होने वाला ह ैिजनसे भारत कᳱ एकता और संᮧभुता को खतरा है । (ग) ᳰक आवेदक के भारत से बाहर जाने पर दशे कᳱ सुरᭃा को नुकसान पᱟचँ सकता है या दशे कᳱ सुरᭃा खतरे मᱶ पड़ जाएगी । (घ) ᳰक आवेदक कᳱ दशे से बाहर उपि᭭थित ᳰकसी िवदशेी रा᳦ से भारत के िमᮢता पणूᭅ संबंधᲂ को ᮧभािवत कर सकती ह ै। (ङ) ᳰक आवेदक को आवेदन जमा करने से ठीक 5 वषᭅ पूवᭅ तक कᳱ अविध मᱶ ᳰकसी भी समय ᳰकसी भारतीय अदालत ᳇ारा नैितक ᳥᮪ता के िलए दोषी पाया गया हो और इस मामले मᱶ आवेदक को दो वषᭅ या अिधक कᳱ सजा सुनाई गई । (च) ᳰक आवेदक के िवᱧ किथत ᱨप से ᳰकसी ᳰकए गए अपराध के संबंध मᱶ अदालती कारᭅवाई लंिबत ह ै। (छ) ᳰक आवेदक को ᳰकसी अदालत ᳇ारा अपने स᭥मुख पेश होने के िलए कोई वारंट अथवा स᭥मन जारी ᳰकया गया हो, या ᳰकसी अदालत ᳇ारा ᳰकसी ᮧचिलत कानून के तहत आवेदक के िवᱧ िगर᭢तारी का वारंट जारी ᳰकया गया हो या ᳰकसी अदालत ने अपन े ऐसे आदशे ᳇ारा आवेदक के दशे छोड़ने पर रोक लगाई हो । (ज) ᳰक आवेदक को ᮧ᭜यवᳶतत ᳰकया गया था और आवेदक ᳇ारा ᮧ᭜यवतᭅन लागत का भुगतान नहᱭ ᳰकया ह ै। (झ) ᳰक कᱶ ᮤ सरकार कᳱ राय मᱶ आवेदक को पासपोटᭅ अथवा याᮢा द᭭तावेज जारी ᳰकया जाना सावᭅजािनक िहत मᱶ न हो । ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 5 अथवा नमूना स᭜यापन ᮧमाण पᮢ (शीषᭅ ᳞ापाᳯरक सं᭭थाᲐ के अ᭟यᭃ ᳇ारा चᱹबर कᳱ सद᭭यता ᮧा᳙ कंपिनयᲂ के मािलकᲂ, साझेदारᲂ और िनदशेकᲂ को जारी ᳰकये जाने हतेु) (स᭜यापन ᮧािधकारी के आिधकाᳯरक पᮢ शीषᭅ पर) संदभᭅ संया : (स᭜यापन ᮧमाणपᮢ जारीकताᭅ अिधकारी को आवेदक के छायािचᮢ को इस ᮧकार स᭜यािपत करना चािहए ᳰक ह᭭ताᭃर और मुहर आधे छायािचᮢ पर आ जाएं और आधे ᮧमाण पᮢ पर) स᭜यापन ᮧमाण पᮢ यह ᮧमािणत ᳰकया जाता ह ै ᳰक ᮰ी/᮰ीमती/कुमारी ............................................................................ पुᮢ/प᳀ी/पुᮢी ........................................... िजनका ᳞िᲦगत िववरण आगे ᳰदया गया ह ैअ᭒छे नैितक चᳯरᮢ वाला/वाली ᮧिति᳧त नागᳯरक हᱹ और पासपोटᭅ अिधिनयम, 1967 के भाग 6 (2) कᳱ धाराᲐ के अ᭟ययन के बाद मᱹ यह ᮧमािणत करता ᱠँ ᳰक आवेदक के मामले मᱶ इन धाराᲐ का उ᭨लंघन नहᱭ होता ह ैऔर मᱹ इ᭠हᱶ भारतीय पासपोटᭅ ᮧदान ᳰकए जाने कᳱ अनुशंसा करता ᱠ ँ। आवेदक अपने ᳰदये ᱟए पते पर िपछले एक वषᭅ से लगातार िनवासरत ह ै। ज᭠मितिथ ……………………………………… ज᭠म ᭭थान ……………………………………… शैᭃिणक योयता ……………………………………… पेशा ……………………………………… ᭭थायी पता ……………………………………… वतᭅमान पता ……………………………………… ᭭थान कायाᭅलय का पता अवि᭭थित सिहत ितिथ ह᭭ताᭃर ...................................................................... पूरा नाम ........................................................... पदनाम........................................................................... चᱹबर का नाम . आवेदक का छायािचᮢ कायाᭅलय कᳱ मुहर 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] दरूभाष: (का)................ (1) These rules may be called the Passport (Amendment) Rules, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Passport Rules, 1980 (herein after referred to as the said rules), in Schedule III:-
(i) Under “(A) Passports”, for the sub-heading “For Adopted Children” and the entries relating thereto, the following shall be substituted, namely:- “For Adopted Children: In case of In-country (domestically) adopted children the following documents are required to be furnished: The deed of adoption which may either be Notarized or Registered, confirming/detailing the adoption of applicant by the adoptive parents(s) from the biological parent(s). In case, the applicant is not having any kind of deed to confirm the adoption and the situation is so that the same also cannot be executed at this point of time due to death of biological/adoptive parents or any other reason, whatsoever it may be, the applicant may give a declaration on a plain paper confirming the adoption.” 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(a) An applicant applying for re-issue of passport for incorporation of the name of his/her spouse;

2. If the applicant has resided at more than one place during the last one year, then all previous addresses with the relevant dates should be mentioned.
3. This Verification Certificate may be got signed by any of the following:
(i) An Under Secretary/Deputy Secretary/Director/Joint Secretary/Add. Secretary/Special Secretary/ Secretary/ Cabinet Secretary to Government of India.
(ii) A Director/Joint Secretary/Additional Secretary/Special Secretary/Chief Secretary to a State Govt.
(iii) A Sub-Divisional Magistrate/First class Judicial Magistrate/Additional DM/District Magistrate of the district of residence of applicant.

(v) A Major and above in the Army, Lt. Commander and above in the Navy and Sq. Leader and above in the Air Force.
(vi) The General Manager and above of a Public Sector Undertaking and the Reserve Bank of India.
(vii) All members of any All India Service or Central Service who are equivalent to or above the rank of an Under Secretary to the Government, i.e. drawing their pay in the level 11 and above of the pay matrix recommended by the 7th Central Pay Commission.
(viii) Resident Commissioners/Additional Resident Commissioners of all the State Governments based in Delhi.
(ix) Concerned Tehsildars or concerned SHOs for an applicant staying in the area under his/her jurisdiction.
4. Anyone who issues incorrect verification certificate may be prosecuted under section 12(2) of the Passports Act, 1967.

Section 6(2) of the Passports Act, 1967 – “Subject to the other provisions of this Act, the passport authority shall refuse to issue a passport or travel document for visiting any foreign country under clause (C) sub-section 5 of any one or more of the following grounds, and on no other ground, namely:
(a) that the applicant is not a citizen of India.
(b) that the applicant may, or is likely to, engage outside India in activities prejudicial to the sovereignty and integrity of India.
(c) that the departure of the applicant from India may, or is likely to, be detrimental to the security of India.

(e) that the applicant has, at any time during the period of five years immediately preceding the date of his application, been convicted by a court of India for any offence involving moral turpitude and sentenced in respect thereof imprisonment for not less than two years.
(f) that criminal proceedings in respect of an offence alleged to have been committed by the applicant are pending before a court in India.
(g) that a warrant or summons for the appearance, or a warrant for the arrest of the applicant has been issued by a court under any law for the time being in force or that an order prohibiting the departure from India of the applicant has been made by any such court.
(h) that the applicant has been repatriated and has not reimbursed the expenditure.
(i) that in the opinion of the Central Government the issue of passport or travel document to the applicant will not be in the public interest.
