PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY सड़क पररवहन और राजमागग मतं्रालय अजधसचूना नई ददल्ली, 10 माचग, 2021 सा.का.जन. 166(अ).—अजखल भारतीय पयगटक यान (प्राजधकारया परजमट) जनयमका प्रारूप मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 212 की उप-धारा (1) के अधीन यथा अपेजित भारत सरकार के सड़क पररवहन और राजमागग मंत्रालय की अजधसूचना द्वारा भारत के राजपत्र, असाधारण, भाग II, खंड 3, उप-खंड (i) मेंअजधसूचना संख् या सा.का.जन. 425(अ),तरीख 01 जुलाई,2020 द्वारा प्रकाजित दकया गया था,जजनमें उन सभी व् यजयय से जजनके उससे प्रभाजवत होने की संभावना है, उस तारीख से, जजसको उक् त अजधसूचना को अ् तर्विव् ट करने वाली राजपत्र की प्रजतयां जनता को उपलब् ध करा दी गयं थं, से तीस ददन की अवजध की समाजि से पूवग आपजियां और सुझाव आमंजत्रत दकए थ;े और,उक् त राजपत्र अजधसूचनाकी प्रजतयां 01 जुलाई,2020 को जनता को उपलब् ध करा दी गयं थं;
और,जवजनर्दद् ट अवजध के भीतर प्रारूप जनयम के सम् ब् ध में प्रा् त आपजिय और सुझाव पर जवचार कर जलया गया था;
अत:, अब के् रीय सरकार, मोटर यान अजधजनयम, 1988 (1988का 59) की धारा 89 की उप-धारा (1) के खंड (छ) के साथ परित धारा 88 की उप-धारा (9), उप-धारा (14) द्वारा प्रदत् त िजयय का प्रयोग करते ुए, मोटर यान (पयगटक पररवहन संचालकगणहतेु अजखल भारत अनुज्ञापत्र) जनयम, 1993 को उन बातो के जसवाय अजधक्ांत करत ेुए, जज्ह ेऐसेअजधक्मण से पूवग दकया गया ह ैया करने का लोप दकया गया ह,ै जनम् नजलजखत जनयम बनाती ह,ै अथागत:्- स.ं 125] नई ददल्ली, बहृस्ट् पजतवार, माचग 11, 2021/फाल् गनु 20, 1942 No. 125] NEW DELHI, THURSDAY, MARCH 11, 2021/PHALGUNA 20, 1942 सी.जी.-डी.एल.-अ.-12032021-225844 CG-DL-E-12032021-225844 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
1. संजि् त नाम और प्रारम् भ– (1) इन जनयम का संजि् त नामअजखल भारतीय पयगटक यान (प्राजधकारया परजमट) जनयम, 2021ह।ै
(2) य े1 अप्रलै, 2021 से प्रवृत् त ह गे।
2. पररभाषाएं – (1) इन जनयम में, जब तक दक संदभग में अ् यथा अपेजित न हो – (क) ‘अजधजनयम’से मोटर यान अजधजनयम, 1988 (1988 का 59)अजभप्रेत ह;ै (ख) ‘प्राजधकृत करना’ से पररवहन प्राजधकरण द्वारा, दकसी पयगटक यान के प्रचालक या माजलक को उस राज् य या संघ राज् य िेत्र, जजनमें यान चलाया जाएगा, द्वारा उद्ग्रजहत कर या फीस, यदद कोई हो,के भुगतान के अधीन संपूणग भारत िेत्र मेंपयगटन यान चलाए जाने के जलय े ददया गया कोई प्राजधकार अजभप्रेत ह;ै (ग) ‘प्ररूप’ से इन जनयम से उपाबंध कोई प्ररूप अजभप्रेत ह;ै (घ) ‘परजमट’ से पररवहन प्राजधकरण द्वारा दकसी पयगटक यानके प्रचालकया माजलक को उस राज् य या संघ राज् य िेत्र, जहां यान चलाया जाएगा, द्वारा कर या िुल् क का भुगतान दकए जबना संपूणग भारत िेत्र में पयगटक यान चलाने के जलए समथग बनान ेहते ुजारी परजमट अजभप्रेत ह ै। (ड.) ‘पररवहन प्राजधकरण’ से अजधजनयम की धारा 68 की उप-धारा (1) के अधीन गरित राज् य पररवहन प्राजधकरणअजभप्रेत ह ै।
(2) उन िब्द औरपद के, जो इसमें प्रवृत हैं और पररभाजषत नही हैं ककतु अजधजनयम मे पररभाजषत ह,ै वही अथग ह ग े जो उस अजधजनयम म ेहैं।
3. प्राजधकार या परजमटके जलए आवदेन - (1) प्राजधकार जनयम 5 में यथाउजल्लजखत श्रेणी के पयगटक यान प्रचालक को ही प्रदान जाएगा और परजमट वैध प्राजधकार रख्नने वाल ेपयगटक यान प्रचालक के पयगटक यान के जलये ददया जाएगा।
(2) प्राजधकार प्रदान करन ेया प्राजधकार के नवीनीकरण के जलए आवेदन प्ररूप 1 में पररवहन प्राजधकरण को दकया जाएगा और इसके साथ प्ररूप 1 में यथा उजल्लजखत दस्ट्तावेज की प्रजतयां ह गी:-
(3) दकसी पयगटक यान के जलए परजमट प्रदान करन े या परजमट के नवीनीकरण के जलए पररवहन प्राजधकरण को आवेदन प्ररूप1क में दकया जाएगा और इसके साथ प्ररूप 1क में उजल्लजखत दस्ट्तावेज की प्रजतयां ह गी।
(4) उप-जनयम (1) के अधीन दकया गया आवेदन जनयम 5 में जवजनर्ददष्ट फीस के साथ होगा।
(5) आवेदन जवजनर्ददष्ट फीस के साथ इलेक्रॉजनक पद्धजत से सड़क पररवहन और राजमागग मंत्रालय की वेबसाइट अथागत ् https://parivahan.gov.in/parivahan/ पर दकया जाएगा।
(6) पररवहन प्राजधकरण आवेदन प्राजि की तारीख से तीस ददन की अवजध के भीतर, प्राजधकार या परजमट,जैसा भी मामला हो, जारी करेगा।
4. प्राजधकार या परजमट प्रदान करन ेतथा इसके नवीनीकरण की प्रदक्या: (1) जनयम 3 के अधीन आवेदन प्राि होन ेपर, परजमट के मामल,े यह सुजनज चत करने के जलए दकयान इन जनयम के अनुरूप और सड़क के अनुकूल हैं, संबंजधत पररवहन प्राजधकरण दस्ट्तावेज का इलेक्रॉजनक रूप से जनरीिण कर सकता ह।ै
(2) यदद जनयम 3 के उप-जनयम (1) के अधीन दकया गया आवेदन अधूरा ह ैऔर जनयम 5 में जवजनर्ददष्ट फीस के साथ नहं ह,ै तो पररवहन प्राजधकरण जलजखत में ददए जाने वाल ेकारण के आधार पर आवेदन को अस्ट् वीकृत कर सकते हैं:
परंत,ु आवेदन अस्ट्वीकृत करन ेसे पहले, आवेदक को आवेदन में गलती को सुधारन ेके जलए अवसर ददया जाना चाजहए।
(3) यदद आवेदन प्रा् त होने के तीस ददनो के भीतर पररवहन प्राजधकरण द्वारा कोई जनणगय नहं जलया जाता ह ैतो उस प्राजधकार या परजमट, जैसा भी मामला हो, को स्ट् वीकृत माना जाएगा और इलके् रॉजनक पद्धजत के जररए इसे तैयार दकया जाएगा। https://parivahan.gov.in/parivahan/ [भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3
(4) प्राजधकार और परजमट, प्ररूप 2 और प्ररूप 3, जैसा भी मामला हो, में प्रदान दकया जाएगा तथा यह तीन माह या इसके बाद इसका गणुक जो एक बार में पांच वषग से अजधक नहं, की अवजध के जलए वैध होगा।
(5) यान के प्रथम रजजस्ट्रीकरण की तारीख से बारह वषग परूा होने के बाद दकसी यान को प्राजधकार या परजमट, जैसा भी मामला हो, प्रदान नहं दकया जाना चाजहए। परंत,ु ददल्ली के राष्ट्रीय राजधानी िेत्र (एनसीटी) में रजजस्ट्रीकृत डीजल यान के मामल ेमें, इसके पहले रजजस्ट्रीकरण की तारीख से दस वषग पूरा होने के बाद परजमट प्रदान नहं दकया जाएगा।
(6) प्राजधकार या परजमट को ऐसे आवेदन पर नवीनीकृत दकया जा सकता है,जो इसकी समाजि की तारीखसे कम से कम पंरह ददन पहल ेदकया गया हो।
5. प्राजधकार या परजमट जारी करन ेके जलए फीस – (1)प्राजधकार या परजमट, जैसा भी मामला हो, प्रदान करन ेके जलए दकसी भी आवेदन पत्र के साथ जनम् नजलजखत ताजलका में यथा जवजनर्दद् ट फीस होनी चाजहए:- सारणी 1 (वार्विषक) क्.
सखं् या चालक को छोड़कर यात्री िमता के अनसुार पयगटक यान की श्रणेी प्राजधकार फीस (रुपय े में) वातानकूुजलत परजमट फीस (रुपय ेमें) गरै वातानकूुजलत परजमट फीस (रुपय ेमें)

(2) तै्रमाजसक परजमट की दर उप-जनयम (1) में जनर्ददष्ट फीस का तीस प्रजतित होगी।
(3) परंत,ु ऐसे मामले में, जहां पररवहन प्राजधकरण, अजधकाररता वाले पररवहन प्राजधकरण से अलग हो, जजसमें प्रचालकका अपना रजजस्ट्रीकृत पता हो या यान रजजस्ट्रीकृत हो, तो प्राजधकार की दिा मे सौ रुपये का अजतररय भार, जैसा भी मामला हो, प्राजधकार या परजमट को जारी करन ेके जलए जलया जाएगा।
6. समदेकत प्राजधकार या परजमट फीस का राज् य और सघं-राज् य िते्र में जवतरण – (1)प्राजधकार और परजमट की दिा म े एक हज़ार रुपये का, जैसा भी मामला हो, के जलए संदाय की गई फीस को अजधकाररता वाल ेराज् य को माजसक आधार पर संप्रेजषत दकया जाएगा।
(2) जनयम 5 के अधीन संग्रजहत की गई परजमट फीस का राज् य और संघ-राज् य िेत्र में जवतरण जनम् नजलजखत सूत्र के अनुसार दकया जाएगा:- एसआर = एसएस x (दिे के जलए माजसक वास्ट् तजवक राजस्ट् व) एसआरएन = राज् य के जलए माजसक वास्ट् तजवक राज् य राजस्ट् व एसएसएन = राज् य का राज् य जहस्ट् सा = पूवगवती 3 जवत् तीय वषक के जलए प्रत् येक राज् य हतेु कुल राजस्ट् व पूवगवती 3 जवत् तीय वषक के जलए सभी राज् य /संघ-राज् य िेत्र का कुल राजस्ट् व 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] स्ट्पष्टीकरण- इस उप-जनयम के प्रयोजनाथग, अजभव्यजय ‘कुल राजस्ट्व’ पदसे राज्य या संघ राज् य िेत्र द्वारा अ्तरराज्यजयक परजमट प्रकारो के उद्ग्रहणसे संग्रजहत राजस्ट्व अजभप्रेत ह।ै
7. प्राजधकार या परजमट का जवस्ट्तार और जवजधमा्यता – (1) प्राजधकार या परजमट, जैसा भी मामला हो, पूरे देि के जलए मा् य होना चाजहए।
(2) प्राजधकार या परजमट, जैसा भी मामला हो, का उपयोग अपने जनजी सामान के साथ व् यजक् तगत या समूह में याजत्रय के पररवहन के जलए दकया जाना चाजहए।
(3) कोई भी व् यजक् त या व् यजक् तय के समूह को व्यजयगत या समूह मे याजत्रय के पररवहन के जलये यान का उपयोग तब तक नहं करना चाजहए जब तक उनके पास वैध प्राजधकार या परजमट, जैसा भी मामला हो, इलेक् रॉजनक प्ररूप या वास्ट् तजवक प्ररूप में न हो।
8. प्राजधकार यापरजमट का अतंरण-(1) उप-जनयम (2) में अ् यथा उपबंजधत के जसवाय, अजधकाररता वाले पररवहन प्राजधकरण की अनुमजत के जसवाय एक व् यजक् त द्वारा दसूरे व् यजक् त को प्राजधकार या परजमट, जैसा भी मामला हो, का अंतरण नहं दकया जा सकता ह।ै
(2) इन जनयम के अधीन पयगटन यान के स्ट्वाजमत्व को ददया गया प्राजधकार या परजमट स्ट् वामी की मृत् यु के कारण अ्तररत दकया जा सकेगा जहां भावी स्ट् वामी या उत् तराजधकारी प्राजधकार या परजमट का उपयोग मृत् य ुके तीन माह के भीतर पररवहन प्राजधकरण द्वारा आव यक पररवतगन करन ेके पश्चात दकया जा सकेगा। परंत,ु पररवहन प्राजधकरण तीन माह की समाजि के पश्चात भी आवेदन ग्रहण कर सकेगा यदद उसको यह समाधान हो जाता ह ैदक आवेदक को जवजनर्दद् टअवजध के भीतर आवेदन करने से रोका गया था ।
9. यान का प्रजतस्ट् थापन – प्राजधकार या परजमट धारक, अजधकाररता वाल ेपररवहन प्राजधकरण की अनुमजत से यथाजस्ट्थजत प्राजधकार या परजमट, के अंतगगत आन े वाल े दकसी पयगटन यान को उसी प्रकृजत के दकसी अ् य पयगटन यान से प्रजतस्ट् थाजपत कर सकता ह।ै स्ट् पष्टीकरण- इस जनयम के प्रयोजनाथग ‘उसी प्रकृजत के पयगटकयान’ पद से ऐसा यान अजभप्रेत ह ैजो जनयम 5 की सारणी 1 में यथा उजल्लजखत उसी श्रेणी के हैं,जजसके जलए प्राजधकार या परजमट ददया गया ह ैऔर फीस चुकायी गयी ह ैतथा ऐसा प्रजतस्ट् थापन पयगटक यान के दकसी भी अ् य मेक या मॉडल का हो सकता ह।ै
10. जविषेता सचूक जच् ह- पयगटक यान जजसको इन जनयम के अधीन परजमट ददया गया ह ैवो सुस्ट्पष्ट रूप से यान के पीछे बाईं ओर नीले पषृ्ठभूजम पर सफेद अिर में परजमट की जवजधमा्यता के साथ, “अजखल भारतीय पयगटन परजमट” जलखा होगा।
11. पयगटक की सचूी- परजमट के अधीन चल रह ेमोटर कैब के अलावा अ्य पयगटक यान में हर समय इलेक् रॉजनक प्ररूप में या भौजतक प्ररूप में पयगटक की एक सूची होगी, जजसमें प्रत् येक यात्री की यात्रा के आरंभ और गंतव् य स्ट् थान के बारे में जवस्ट् तार से जानकारी हो।
(2) अजधजनयम के अधीन या इसके अधीन बनाए गए जनयम द्वारा दस्ट्तावेज को प्रस्ट्तुत करने/ मांग करन ेवाली प्राजधकृत अजधकारी के सामन ेउसकी मांग पर सूची को प्रस्ट्ततु करेगा ।
12. बीमा कवरेज-प्राजधकार और परजमट के अधीन प्रचाजलत प्रत्येक पयगटनयान चालक के साथ साथ यात्री दाजयत्व के जलए जवजधमा्य बीमा रिण होगा।
13. प्रत् यके परजमट धारक द्वारा रखी जान े वाली जानकारी – मोटर कैब के अलावाप्रत्येक पयगटन यानप्रचालकप्राजधकारया परजमटधारण करेगा और एक वषग की अजधकतमअवजध के जलए याजत्रय जजसमे यात्रा ब्योरे भी िाजमल हैं का ररकॉडग रखेगा और य ेररकॉडग मांग पर, अजधकाररता रखने वाल ेपररवहन प्राजधकरण या दकसी अ्य जवजध प्रवतगन अजधकारी को उ्लब्ध कराएगा।
(2) उप-जनयम (1) में जनर्ददष्ट याजत्रय का कोई ररकॉडग दकसी अ्य व्यजय या संगिन या कंपनी के साथ साझा नहं करेगा। [भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 5
14. प्राजधकार या परजमट रद्द करना और जनलजंबत करना- (1) ऐसा पररवहन प्राजधकरण जो यथाजस्ट्थजत प्राजधकार या परजमट अनुदि करने वाला ह,ै प्राजधकार या परजमट को रद्द कर सकेगा यदद प्राजधकार या परजमट का धारक - (क) यथा जस्ट्थजत इन जनयम या अजधजनयम के उपबंध का उल्लंघन करत ेुए प्रयोग दकए जान ेवाले दकसी पयगटन यान का उपयोग करता ह ैयाकरवाता ह ैअथवा अनुदि करता ह;ै (ख) प्राजधकार या परजमट, के अंतगगत आने वाल ेयान का स्ट्वाजमत्व समाि हो गया ह;ै (ग) कपट या जमथ्या थापदेिन द्वारा प्राजधकार या परजमट प्राि दकया;और (घ) दकसी भी जवदेिी देि की नागररकता अर्विजत की ह।ै
15. अपील - अजधकाररता रखने वाले पररवहन प्राजधकारी के आदिे द्वारा पीजड़त कोई व्यजय-
(1) जनयम 4 के उप-जनयम (3) के अधीन प्राजधकार या परजमट, जारी करने से इनकार करन ेपर, या
(2) यथाजस्ट्थजत प्राजधकार या परजमट, का जनलंबन या रद्द करन ेअथवा उसकी जस्ट् थजत में दकसी प्रकार की तब् दीली, या
(3) इन जनयम के जनयम 8 या जनयम 9 के अधीन यथाजस्ट्थजत प्राजधकार या परजमट, के अतंरण से इ्कार करने का आदेि, या
(4) यथाजस्ट्थजत प्राजधकार या परजमट, का नवीनीकरण करन ेसे इ्कार करन ेका आदेि, ऐसा व्यजय,उक् त आदेि प्रा् त करन े की जतजथ से तीस ददन की अवजध के भीतर राज् य पररवहन अपील प्राजधकरण, जो ऐसे व् यजय को अपना पि रखने का अवसर देने के बाद जनणगय लगेा, के समि अपील की जा सकती ह।ै
16. छूट - (1) कें रीय मोटरयान जनयम,1989 के जनयम 82 से 85क के अधीन जवजहत ितें इन जनयम के अधीन प्रदान दकए गए परजमट पर लाग ूनहं ह गी।
(2) मोटर यान (अजखल भारतीय पयगटन पररवहन प्रचालक के जलए अनुज्ञापत्र) जनयमावली, 1993 के अधीन जारी दकया गया परजमट उनकी वैधता अवजध के दौरान लाग ूरहगेा, जैसे दक वे अजखल भारतीय पयगटक यान (प्राजधकार या परजमट) जनयम 2020 के अधीन जारी दकए गए थे। प्ररूप 1 [ जनयम 3 (2 ) देखें ] अजखल भारतीय प्राजधकार के अनदुान / नवीकरण के जलए आवदेन प्ररूप पयगटक यान प्रचालक सेवा में पररवहन प्राजधकरण ................................. ..

(क) यान का रेजजस्ट्रीकरण प्रमाण पत्र;
(ख) रेजजस्ट्रीकृत पते का सबूत;
(ग) पनै काडग नंबर की प्रजत;
(घ) माल और सेवा कर प्रमाणपत्र;

परजमट िुल्क भुगतान जववरण मैं प्रमाजणत करता ह ंदक उपरोय जानकारी सत्य और सही ह।ै आवेदक(आवेदक ) या आजधकाररक रबर स्ट् टैंप के साथ प्राजधकृत हस्ट् तािरकताग के हस्ट् तािर या अंगिेू का जनिान। दस्ट्तावेज:
(क) वैध प्राजधकरण या प्राजधकरण आवेदन संख्या;
(ख) यान का रजजस्ट्रीकरण प्रमाण पत्र;
(ग) वैध दफटनेस प्रमाणपत्र;
(घ) वैध बीमा प्रमाणपत्र;

5. अजखल भारतीय पयगटक परजमट की वैधता की अवजध - से ………… तक …………। पररवहन प्राजधकरण का हस्ट्तािर (उपयुय प्राजधकारी की मुहर)”। [फा. सं. आर टी-16017/2/2018-टी] अजमत वरदान, संयुय सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 10th March, 2021 G.S.R. 166(E).—Whereas, the draft of All India Tourist Vehicles (Authorisation or Permit) rules, was published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988) vide notification of the Government of India in the Ministry of Road Transport and Highways, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i) vide number G.S.R. 425 (E), dated the 1 st July, 2020, inviting objections and suggestions from all persons likely to be affected thereby, before the [भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 9 expiry of thirty days from the date on which copies of the Gazette of India in which the said notification was published, were made available to the public;
And whereas, copies of the said Gazette notification were made available to the public on the 1 st July, 2020;
And whereas, the objections and suggestions received in respect of the draft rules within the period specified have been taken into consideration;
Now, therefore, in exercise of the powers conferred by sub-sections (9) and (14) of section 88 read with clause (g) of sub-section (1) of section 89 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules in suppression of the Motor Vehicles (All India Permit for Tourist Transport Operators) Rules, 1993 except as respects things done or omitted to be done before such supersession, namely:-
1. Short title and commencement. — (1) These rules may be called the All India Tourist Vehicles (Authorisation or Permit) Rules, 2021.
(2) They shall come into force on the1 st day of April, 2021.
2. Definitions.—(1) In these rules, unless the context otherwise requires, –
(a) ―Act‖ means the Motor Vehicles Act, 1988 (59 of 1988);
(b) ―Authorisation‖ means an authorisation granted by the Transport Authority to enable tourist vehicles operator/ owner to ply tourist vehicle throughout the territory of India subject to the payment of taxes or fees, if any, levied by the State or Union territory through which it plies;
(c) ―Form‖ means a Form appended to these rules;
(d) ―Permit‖ means a permit issued by the Transport Authority to enable a tourist vehicle operator/ owner to ply tourist vehicle throughout the territory of India without payment of taxes or fee levied by the State or Union territory through which it plies;
(e) ―Transport Authority‖ means the State Transport Authority constituted under sub-section (1) of section 68 of the Act.
(2) The words and expressions used in these rules but not defined herein and defined in the Act shall have the same meanings respectively assigned to them in the Act.
3. Application for authorisation or permit.— (1) The authorisation shall be granted only to a tourist vehicle operator for category as mentioned in rule 5 and the permit shall be granted to a tourist vehicle of a tourist vehicle operator having valid authorisation.
(2) An application for grant of authorisation or renewal of authorisation, shall be made to the Transport Authority in Form 1 and shall be accompanied by copies of the documents as mentioned in the Form 1.
(3) An application for grant of permit or renewal of permit for a tourist vehicle shall be made to the Transport Authority in Form 1A and shall be accompanied by copies of the documents as mentioned in the Form 1A.
(4) The application made under sub-rule (1) shall be accompanied by the fee as specified in rule 5.
(5) The application along with the specified fee shall be made in electronic form on the website of the Ministry of Road Transport and Highways i.e. https://parivahan.gov.in/parivahan/.
(6) The Transport Authority shall issue the authorisation or permit, as the case may be, within a period of thirty days from the date of receipt of application.
4. Procedure for grant of authorisation or permit and renewal thereof. — On receipt of an application under rule 3, in case of permit, to ensure that the vehicle is compliant with these rules and is road worthy, the concerned Transport Authority may inspect the documents electronically.
(2) If the application made under sub-rule (1) of rule 3 is incomplete and not accompanied by fee specified in rule 5, the Transport Authority may reject the application for reasons to be recorded in writing:

Provided that before rejecting an application, an opportunity shall be given to the applicant to cure the defects in the application.
(3) If no decision is taken by the Transport Authority within thirty days of receipt of the application, the authorisation or permit, as the case may be, shall be deemed to have been granted and generated through electronic system.
(4) The authorisation and permit shall be granted in Form 2 and Form 3, as the case may be, and shall be valid for a period of three months or its multiples thereof not exceeding five years at a time.
(5) The permit shall not be granted to a tourist vehicle after the completion of twelve years from the date of first registration of the vehicle:
Provided that, in case of a diesel vehicles registered in the National Capital Territory (NCT) of Delhi, permit shall not be granted after completion of ten years from the date of its first registration.
(6) The authorisation or the permit may be renewed on an application made not less than fifteen days before the date of its expiry.
5. (2) The rates for quarterly permit shall be thirty percent of the fee specified in sub-rule (1):
Provided that in case where the Transport Authority is other than the Jurisdictional Transport Authority in which the operator has its registered address or the vehicle is registered, an additional charge of one hundred rupees in case of authorisation and one thousand rupees in case of permit shall be charged for issuance of authorisation or permit, as the case may be.
6. Distribution of consolidated authorisation or permit fee among States and Union territories. —
(1) The fee paid towards authorisation or permit, as the case may be, shall be remitted on a monthly basis to the jurisdictional State.
(2) The permit fee collected under rule 5 shall be distributed among the States and Union territories as per the formula given below:

Explanation.- For the purposes of this sub-rule, the expression ―Total revenue‖ means the revenue collected by the State or Union territory from levy of Inter-state permit charges.
7. Scope and Validity of authorisation or permit. — (1) The authorisation or permit, as the case may be, shall be valid throughout India.
(2) The authorisation or permit, as the case may be, shall be used for the transport of passengers individually or in a group, along with their personal luggage.
(3) No individual or a group of individuals shall use the vehicle for the transport of passengers individually or in a group, unless they have a valid authorisation or permit, as the case may be, either in electronic form or in physical form.
8. Transfer of authorisation or permit.—(1) Save as otherwise provided in sub-rule (2), authorisation or permit, as the case may be, shall not be transferable from one person to another except with the permission of the jurisdictional Transport Authority.
(2) Where the ownership of the tourist vehicle granted authorisation or permit under these rules, as the case may be, is transferred due to the death of the owner, the prospective owner or successor, as the case may be, shall use the authorisation or permit, as the case may be, after getting necessary changes of ownership by the jurisdictional Transport Authority within three months from such death:
Provided that the Transport Authority may entertain an application after the expiry of three month, if it is satisfied on reasons that the applicant was prevented from making an application within the specified time.
9. Replacement of vehicle. — The holder of authorisation or permit, as the case may be, may, with the permission of the jurisdictional Transport Authority, replace any tourist vehicle covered by the authorisation or permit, as the case may be, with any other tourist vehicle of the same nature.
Explanation. — For the purpose of this rule, the expression ―tourist vehicle of same nature‖means having the same category as mentioned in Table1 of the rule 5 for which the authorisation or permit has been granted and fee has been paid and such replacement tourist vehicle may be of any other make or model.
10. Distinguishing mark.— The tourist vehicles which have been granted permit, under these rules shall prominently display the words ‗All India Tourist Permit‘ on rear left side of the vehicle in white letters in blue background along with the validity of the permit.
11. List of tourists.— (1) A tourist vehicle other than a motor cab plying under the permit, shall at all times carry a list of passengers in electronic form or in physical form, which shall contain the details of origin and the destination of each passenger.
(2) The list shall be produced on demand before the officers authorised to demand production of documents by or under the Act or the rules made there under.
12. Insurance coverage.— Every tourist vehicle operating under the authorisation and permit shall have a valid insurance coverage for passenger liability as well as for the driver.
13. Information to be kept by every permit holder.— (1) Every tourist vehicle operator holding an authorisation or permit for a tourist vehicle other than a motor cab, shall maintain record of the passengers, including journey details, for a minimum period of one year and these records shall be made available to the Jurisdictional Transport Authority or any other law enforcement officer on demand.
(2) No record of the passenger referred to in sub-rule (1) shall be shared with any other person or organisation or company.
14. Cancellation and suspension of authorisation or permit.— The Transport Authority which granted authorisation or permit, as the case may be, may cancel the authorisation or permit, if the holder of the authorisation or permit,—
(1) uses or causes or allows a tourist vehicle to be used in contravention to the provisions of these rules or the Act, as the case may be;

(2) ceases to own the vehicle covered by authorisation or permit, as the case may be;
(3) obtained the authorisation or permit by fraud or misrepresentation, and
(4) acquires the citizenship of any foreign country.
15. Appeals.—Any person aggrieved by the order of the jurisdictional Transport Authority against the, -
(1) refusal to issue authorisation or permit, as the case may be, under sub-rule (2) of rule 4; or
(2) suspension or cancellation of authorisation or permit, as the case may be, or any variation of the condition thereof; or
(3) order of refusal to transfer the authorisation or permit, as the case may be, under rule 8 or rule 9 of these rules; or
(4) order of refusal to renew the authorisation or permit, as the case may be, may within a period of thirty days from the date on which the said order is received by such person, appeal to the State Transport Appellate Tribunal, which shall give a decision thereon after giving such person an opportunity of being heard.
16. Exemption.—(1) The conditions prescribed in rules 82 to 85A of the Central Motor Vehicles Rules, 1989 shall not apply to the permits granted under these rules.
(2) The permit issued under the Motor Vehicles (All India Permit for Tourist Transport Operators) Rules, 1993 shall continue to be in force during their validity period as if they were issued under the All India Tourist Vehicles (Authorisation or Permit) Rules, 2021.
