(17) wpr.ft. 842(5T),?TRhl27t^W,2002. 4_ THE GAZETTE OF INDIA: EXTRAORDINARY [PART II—SEC.3(I)J MINISTRY OF RAILWAYS (RAILWAYBOARD) NOTIFICATION New Delhi, thel 9th April, 2006 G.S.R. 221 (E).—In exercise of the powers conferred by Sub-section (2) of Section 60,( read with Section 198 of the Railways Act, 1989 (24 of 1989), the Central Government hereby makes the following rules further to amend the Indian Railways (Open Lines) General Rules, 1976, namely:—
1. (1) These rules may be called the Indian Railways (Open Lines) General Amendment Rules, 2006. They shall come into force on the date of their publication in the Official Gazette. Indian Railways (Open Lines) General Rules, 1976, - for the words 'Driver or Drivers" wherever they occur, the words, 'Loco Pilot or Loco Pilots" shall be substituted; in sub-rules (1) and (2) of rule 3.83, for the words "first Fireman or the Assistant Driver," the words, "Assistant Loco Pilot" shall be substituted; in rule 4.04, for the words "Every Guard, Driver, Assistant Driver or Fireman" the words, "Every Guard, Loco Pilot or Assistant Loco Pilot," shall be substituted; in sub-rule (1) of rule 4.20, for the words "the Assistant Driver or the Fireman" the words, "the Assistant Loco Pilot" shall be substituted;
(e) in sub-rule (3) of rule 4.20, for the words "the Assistant Driver or the Fireman, if duly qualified, may work the train to the next station cautiously and where the Assistant Driver or the Fireman

(d) is not duly qualified," the words, "the Assistant Loco Pilot, if duly qualified, may work the train to the next station cautiously and where the Assistant Loco Pilot is not duly qualified," shall be substituted; '(f) in sub-clause (b) of sub-rule (2) of rule 4.21, for the words "the Assistant Driver", the words, "the Assistant Loco Pilot" shall be substituted; '•"
(g) for the existing rule 4.38, the following shall be substituted namely: - "4.38. Assistant Loco Pilots to obey Loco Pilots.- The Assistant Loco Pilots shall obey the lawful orders of their Loco Pilots in all particulars.";
(h) for the existing rale 4.40, the following shall be substituted namely: - "4.40. Loco Pilot and Assistant Loco Pilots to keep a good look out- Every Loco Pilot shall keep a good look out while the train is in motion, and every Assistant Loco Pilot shall also do so when he is not necessarily otherwise engaged.";
(i) for the existing rule 4.41, the following shall be substituted namely:- "4.4L The Loco Pilot and Assistant Loco Pilot to look back.- The Loco Pilot and Assistant Loco Pilot shall look back frequently during the journey to see whether the train is following in a safe and proper manner,";

(i) for the words, "depute a Fireman or Assistant Driver55, the words, "depute an Assistant Loco Pilot** shall be substituted;
(ii) for the words, "The Brakesman or Fireman or Assistant Driver"-the words, "The Brakesman or Assistant Loco Pilot" shall be substituted; I
(k) in rule 4.52, for the words "A Driver or Fireman," the words, "A Loco Pilot or Assistant Loco Pilot" shall be substituted;
(1) in sub-rule (ii) of rule 6.03, for the words "Assistant Driver or Fireman" the words, "Assistant Loco Pilot" shall be substituted;
(m) in sub-rule (3) of rule 9.02, for the words "Fireman or an Assistant Driver," the words, "Assistant Loco Pilot," shall be substituted; l
(n) in sub rule (5) of rule 9.07, for the words "Fireman or Assistant Driver," the words, "Assistant Loco Pilot," shall be substituted;
(o) in sub-rule (b) of rule 9.15, for the portion beginning with the words "absence from the Fireman or Assistant - Driver" and ending with the words, "in the absence of the Fireman or • Assistant Driver", the, following shall be substituted namely:- "absence from the Assistant Loco Pilot, the Loco Pilot shall sound the prescribed code of whistle and cautiously proceed up to the next Stop signal complying with the provisions of rule 9.02 or

(p) in sub-rule (1) of rule 12.10, for the words 'the Fireman" the words, "the Assistant Loco Pilot," shall be substituted;
(q) in sub-rule (3) of rule 12.10, for the words "the Fireman" the words, "the Assistant Loco Pilot" shall be substituted;
