1. (1) इन जनयमों को कीटनािी (जद्वतीय संिोधन) जनयम, 2020 कहा िाएगा।
(2) ये रािपत्र में प्रकािन की तारीख से प्रभावी होंगे। परंत ुयह कक इन जनयमों के प्रवृि होने की तारीख से पहले प्रदान ककए गए जवजधमान्य पंिीकरण प्रमाणपत्रों वाले सभी व्यजक्त, नबे कदनों की अवजध के भीतर, लेबल और पची िो इन जनयमों के अनुसार संिोजधत ककय ेगय ेहै ैँ, के अनुमोदन के जलए सजचवालय केन्द्रीय कीटनािक बोडा और पंिीकरण सजमजत के समक्ष आवेदन करेंग:े परंत ुयह और कक कोई भी व्यजक्त इन जनयमों के प्रवृि होने की तारीख से नो माह की समाजप्त के पश्चात् ककसी ऐसे लेबल या पची का उपयोग नहीं करेगा िो इन जनयमों के अनुसार संिोजधत नहीं ककय ेगय ेहैं: परंत ुयह भी कक ऐसे लेबल या पची लग ेककसी कीटाणुनािक या इसका पैकेि िो इन जनयमों के अनुसार संिोजधत नहीं ककए गए हैं इन जनयमों के प्रवृि होने की तारीख से एक विा नो माह की समाजप्त के पश्चात जबक्री अथवा भंडारण हते ु जवतररत, बेचे, प्रदर्शित नहीं ककया िाएगा ।

26. सा.का.जन. 07 (अ) तारीख 2 िनवरी 2020। 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture, Co-operation and Farmers Welfare) NOTIFICATION New Delhi, the 24th April, 2020 G.S.R. 264(E).—Whereas the draft rules further to amend the Insecticides Rules, 1971, was published, as required by section 36 of the Insecticides Act, 1968 (46 of 1968) vide notification number G.S.R. 10 (E), dated the 1 st January, 2019, in the Gazette of India, Extraordinary, Part-II, Section-3, Subsection (i), inviting objections or suggestions from all persons likely to be affected thereby, before the expiry of a period of thirty days from the date on which the copies of the Gazette of India in which the said notification was published were made available to the public; And whereas, copies of the said notification were made available to the public on 4 th January, 2019; And whereas, objections or suggestions received from the public on the said draft rules have been considered by the Central Government and a final gazette Notification G.S.R. 782 (E), dated the 11 th October, 2019 was published in the Gazette of India on 14 th October 2019. Thereafter, the matter was further examined in the department in the light of practical problems of the stakeholders in implementing the said rules and due to ongoing emergent COVID situation in the country. Now, therefore, the following draft rules further to amend the Insecticides Rules, 1971, which the Central Government proposed to make in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of 1968), is hereby published as required by the said section, for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of fifteen days from the date on which the copies of this notification as published in Gazette of India are made available to the public; The objection or suggestions which may be received from any person in respect of said draft rules before the expiry of the aforesaid period of fifteen days shall be considered by the Central Government; Objections and suggestions in respect to the said draft rules may be forwarded to the Joint Secretary (Plant Protection), Ministry of Agriculture and Farmers Welfare, Department of Agriculture, Co-operation and Farmers Welfare, Krishi Bhawan, New Delhi 110001 or to the NIC mail jspp-dac@gov.in. DRAFT RULES
1. (1) These rules may be called the Insecticides (Second Amendment) Rules, 2020.
(2) They shall come into force on the date of their publication in the Official Gazette:
Provided that all persons with valid certificates of registration granted before the date of coming into force of these rules shall, within a period of ninety days from this date, apply to the Secretariat, Central Insecticides Board and Registration Committee, for the approval of labels and leaflets that have been amended in accordance with these rules:
Provided further no person shall use a label or leaflet that has not been amended in accordance with these rules after the expiry of nine months from the date of coming into force of these rules:
Provided also that no insecticide or its package bearing a label or leaflet that has not been amended in accordance with these rules shall be distributed, sold, exhibited for sale or stocked, after the expiry of one year nine months from the date of coming into force of these rules.
2. In the Insecticides Rules, 1971 (hereinafter referred as the said rules) in sub-rule (1) of rule 19,-
(a) in clause (i),-
(i) in sub-clause (d), after the words “to apply”, the brackets and words, “(Please refer leaflet for details)” shall be inserted;
(ii) in sub-clause (e), after the words and bracket “the area)”, the brackets and words “(Please refer leaflet for details)” shall be inserted; [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11
(iii) in sub-clause (h), after the words “Registration Committee”, the brackets and words “(Please refer leaflet for details)” shall be inserted;
(iv) in sub-clause (j), after the words “first aid”, the brackets and words “(Please refer leaflet for details)” shall be inserted;
(b) for clause (ii), the following clause shall be substituted, namely:- “(ii) The label shall be printed legibly with indelible ink in English and Hindi languages unless stated otherwise in the font sizes not less than the size prescribed as below: Sl. (3) Ultra small 5 6 7 7”;
(c) for clauses (iv) and (v), the following clauses shall be substituted, namely:- “(iv) In case where the sachets, packets or containers are ultra-small and small (for sizes between 1 and 50 gm or ml and 51 and 250 gm or ml) the following details shall be printed with indelible ink on primary package, namely:- 1) common name; 2) brand name; 3) composition of the formulation or insecticides; 4) name and address of the manufacturer ; 5) imported and re-packed by (wherever applicable); 6) antidote; 7) registration number; 8) manufacturer’s license number; 9) batch number; 10) manufacturing date; 11) expiry date; 12) net content weight or volume (in metric system); and 13) maximum retail price (MRP inclusive of all taxes, in rupees); 14) Customer care details.
(v) The model labels (one panel, two panels and three panels) shall be as per the pictures II, III, IV, V, VI and VII given in the THIRD SCHEDULE.”.
3.
