या �कसी सरकारी माV यता $ाC त िविW वXालय या सं� थान से कृिष या उXान कृिष या संब[ िवषय' म� एक वष\य िडC लोमा पा]Tम रखता हो िजसम� पादप संरAण और क�टनाशी $बंध पर पा]Tम अंतव>� तु हो; परंतु क�टनािशय' के िवXमान ऐसे अनुUिC तधारी जो पत̂ालीस वष> से अिधक क� आयु के ह ̂और जो अपना : यापार या तो � वयं चला रह े ह ̂या क�टनाशी (दसूरा संशोधन) िनयम, 2017 #ारा यथा संशोिधत इन िनयम' के $काशन क� तारीख को दस वष> क� संचयी अविध स ेअिधक का अनुभव रखते ह ̂और िजनका वा_षक आवत> पांच लाख `पए से कम है, उनके नाम म� चालू अनुUिC तG व क� अविध के िलए पूवa@ त िनयम से छूट $ाC त ह'गे; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Gazette of India are made available to the public; The Objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period of thirty days will be considered by the Central Government; Objections and suggestions in respect to the said draft rules may be forwarded to the Joint Secretary (Plant Protection), Ministry of Agriculture and Farmers Welfare, Department of Agriculture, Co-operation and Farmers Welfare, Krishi Bhawan, New Delhi-110 001. DRAFT RULES
1. Short title and commencement.—(i) These rules may be called the Insecticides (Third Amendment) Rules, 2019.
(ii) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Insecticides Rules, 1971, in rule 10, for sub-rule (1A), the following shall be substituted namely:- “(1A) Person who applies for the grant of licence to sell, stock or exhibit for sale or distribute insecticides shall possess or employ a person possessing a graduate degree in Agricultural Sciences or Biochemistry or Biotechnology or Life Sciences or in Science with Chemistry or Botany or Zoology from a Government recognised university or Institute ; Or One year diploma course in Agriculture or Horticulture or related subjects from any government recognised university or institute with course content on plant protection and pesticides management as the minimum qualification:
Provided that the existing licensee of Insecticides, who are more than forty-five years of age and who have been running their trade either themselves or have inherited with cumulative period of experience of more than ten years before the commencement of rules as amended by The Insecticides (Second Amendment) Rules, 2017 and the annual turn over is less than Rs. five lakh are exempted from the aforesaid rule for a period of licenceship continuing in their name;
Provided further that all other existing retailers or dealers possessing a valid licence without the prescribed qualification before commencement of the rules as amended by the Insecticides (Second Amendment) Rules, 2017 may possess the certificate course for a period of 12 weeks for one day per week with classes once in a week from any State Agriculture University or Krishi Vigyan Kendras or National Institute of Agricultural Extension Management (MANAGE), Hyderabad or National Institute of Rural 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Development and Panchayati Raj (NIDPR) or National Institute of Plant Health Management, Hyderabad, State Agricultural Management and Extension Training Institute (SAMETI), Central or State Research Institutes or any other Government recognized university or institute:
Provided further that all retailers or dealers possessing a valid licence without the prescribed qualification as on the date of commencement of rules as amended by The Insecticides (Second Amendment) Rules, 2017 shall be allowed upto 31 st December, 2020 from the date of publication of this notification, to comply with the said qualifications.
(3) The payment of salary of the employee shall be made by licensees through digital mode or by a cheque to ensure that the person is employed with them”. [F. No. 13035/28/2014-PP-I (Vol. V] ATISH CHANDRA, Jt. Secy.
