PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY सड़क पररवहन और राजमागग मतं्रालय अजधसचूना नई ददल्ली, 3 जसतम् बर, 2021 सा.का.जन. 615(अ).—कें द्रीय सरकार, राष्ट्रीय सड़क सुरक्षा बोडग जनयम, 2021 का प्रारूप, जजसे कें द्रीय मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 215ख की उप-धारा (1), धारा 215ग की उप-धारा (1) और धारा 215ग की उप-धारा (2) के उप-खंड (ग), उप-खंड (घ) तथा उप-खंड (ङ) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, बनाने का प्रस्ट्ताव करती ह,ै भारत सरकार के सड़क पररवहन और राजमागग मंत्रालय की अजधसूचना सा.का.जन. 754(अ), तारीख 8 ददसंबर, 2020 द्वारा भारत के राजपत्र, असाधारण, भाग 2, खंड 3, उप-खंड (i) में उि अजधजनयम की धारा 212 की उप-धारा (1) की अपेक्षानुसार प्रकाजित दकए गए थे, उन सभी व्यजियों से, जजनके उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जजसको उि अजधसूचना से युि राजपत्र की प्रजतयां जनता को उपलब्ध करा दी गई थीं, तीस ददनों की अवजध की समाजि से पूवग आक्षपे और सुझाव आमंजत्रत दकए गए थ े;
और, उि राजपत्र की प्रजतयां, जजसमें अजधसूचना प्रकाजित की गई थी, जनता को 8 ददसंबर, 2020 को उपलब्ध करा दी गई थीं ;
और, उि प्रारूप जनयमों के संबंध में, जनता से प्राि आक्षेप और सुझावों पर जवजनर्ददष्ट अवजध के भीतर कें द्रीय सरकार द्वारा जवचार कर जलया गया था ;

(2) के उप-खंड (ग), उप-खंड (घ) तथा उप-खंड (ङ) द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, जनम्नजलजखत जनयम बनाती ह,ै अथागत ्:--
1. सजंक्षि नाम और प्रारंभ—(1) इन जनयमों का संजक्षि नाम राष्ट्रीय सड़क सुरक्षा बोडग जनयम, 2021 ह ै।
(2) य ेराजपत्र में उसके अंजतम प्रकािन की तारीख को प्रवृत्त होंगे ।
2. पररभाषाए—ं(1) इन जनयमों में, जब तक संदभग से अन्यथा अपेजक्षत न हो,-- (क) ‘‘अजधजनयम’’ से मोटर यान अजधजनयम, 1988 (1988 का 59) अजभप्रेत ह ै;
(ख) ‘‘बोडग’’ से धारा 215ख की उपधारा (1) के अधीन गरठत राष्ट्रीय सड़क सुरक्षा बोडग अजभप्रेत है;
(ग) ‘‘अध्यक्ष’’ से बोडग का अध्यक्ष अजभप्रेत ह;ै (घ) ‘‘सदस्ट्य’’ से बोडग का कोई सदस्ट्य अजभप्रेत ह;ै (ङ) ‘‘धारा’’ से इस अजधजनयम की कोई धारा अजभप्रेत ह।ै
(2) उन िब्दों और पदों के, जो इसमें प्रयुि हैं और पररभाजषत नहीं हैं, दकन्तु अजधजनयम में पररभाजषत हैं, क्रमि: वही अथग होंगे, जो अजधजनयम में हैं ।
3. अध्यक्ष और सदस्ट्यों की अहगताएं—(1) बोडग का अध्यक्ष और प्रत्येक सदस्ट्य प्रिासन, सड़क सुरक्षा, िहरी योजना, जवजध, यातायात प्रबंधन और जवजनयमन, स्ट्वास्ट््य और वकालत, पुजलस प्रवतगन और अन्वेषण, पररवहन इंजीजनयरी, बीमा, आटोमोबाइल इंजीजनयरी, जसजवल इंजीजनयरी, लोक पररवहन, जो कें द्रीय सरकार की राय में बोडग के जलए इस अजधजनयम के अधीन अपने कृत्यों के जनष्पादन और अपने उदे्दश्यों को पूरा करने के जलए उपयोगी है, रखने वाले योग्य, सत्यजनष्ठ और प्रजतजष्ठत व्यजि होगा ।
(2) राज्य सरकार के प्रजतजनजध और भारत सरकार के आजधकाररक प्रजतजनजध अंि-काजलक सदस्ट्य होंगे। बोडग का अध्यक्ष और अन्य सदस्ट्य पूणगकाजलक सदस्ट्य होंग ेतथा कोई अन्य पद धाररत नहीं करेंगे ।
4. जनयजुि की प्रदक्रया—बोडग का अध्यक्ष और इसके सदस्ट्य, कें द्रीय सरकार द्वारा जनम्नजलजखत रीजत से चयजनत होंग ेऔर उनकी जनयुजि को राजपत्र में अजधसूजचत दकया जाएगा :
(क) बोडग का अध्यक्ष और उसके सदस्ट्य, कें द्रीय सरकार द्वारा सड़क पररवहन और राजमागग मतं्रालय के सजचव की अध्यक्षता में खोज-सह-चयन सजमजत के सुझाव पर जनयिु दकए जाएंगे। (ख) भारत सरकार, सड़क पररवहन और राजमागग मंत्रालय का कोई प्रजतजनजध, जो उपसजचव की पंजि से नीचे का न हो, पदेन सदस्ट्य होगा । (ग) राज्यों से भारत सरकार के उप-सजचव से अन्यून पंजि के सदस्ट् य, आवश्यकतानुसार, पदेन-सदस्ट्य के रूप में नाम जनर्ददष्ट दकए जाएंग े। (घ) जनयुजि की प्रदक्रया, ररजि के उद्भूत होने के कम से कम छह मास पूवग कें द्रीय सरकार द्वारा प्रारंभ की जाएगी और अध्यक्ष या दकसी सदस्ट्य के त्यागपत्र या मृत्यु के कारण दकसी पद की ररजि की दिा में, यह प्रदक्रया पद के ररि होन ेके पश्चात् तुरंत प्रारंभ की जाएगी । (ङ) अध्यक्ष और सदस्ट्य के जलए आवेदन आमंजत्रत करने के जलए दकसी ररजि का जवज्ञापन कम से कम दो समाचार पत्रों में प्रकाजित दकया जाएगा और उसे ऐसी रीजत में पररचाजलत दकया जाएगा जजसे कें द्रीय सरकार उजचत समझे। [भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 (च) जवज्ञापन के उत्तर में आवेदनों के अलावा, खोज-सह-चयन सजमजत ऐसे अन्य उपयिु व्यजि/व्यजियों पर जवचार कर सकेगी, जजसे वह उजचत समझे। (छ) खोज-सह-चयन सजमजत पात्रता, उपयुिता, पूवग के प्रदिगन का ररकाडग और अन्य मानदडं, जजसे वह उजचत समझे, को ध्यान में रखते हुए अपने सुझाव देन ेके जलए अपनी प्रदक्रया अवधाररत करेगी। (ज) खोज-सह-चयन सजमजत सड़क पररवहन और राजमागग मतं्री के जवचार के जलए योग्यता के क्रम में जनयुजि हते ु अभ्यर्थिथयों के नामों के एक पैनल का सुझाव करेगी। (झ) अध्यक्ष और दकसी सदस्ट्य की प्रत्येक जनयुजि दकसी जसजवल सजगन या जजला जचदकत्सा अजधकारी द्वारा सम्यक् रूप से हस्ट्ताक्षररत इन जनयमों से संलग्न उपाबंध में यथा उपदर्थिित िारीररक योग्यता का प्रमाणपत्र प्रस्ट्तुत करन ेके अधीन होगा ।
5. अध्यक्ष और अन्य सदस्ट्यों का कायगकाल—(1) दकसी व्यजि को अध्यक्ष या सदस्ट्य के रूप में जनयुजि करने से पूवग, कें द्रीय सरकार स्ट्वय ंका समाधान करेगी दक ऐसे व्यजि का कोई जवत्तीय या अन्य जहत तो नहीं है, जजससे ऐसे अध्यक्ष या सदस्ट्य के रूप में उसके कृत्यों पर प्रजतकूल प्रभाव पडे़ ।
(2) बोडग का अध्यक्ष या कोई सदस्ट्य, ऐसी अवजध के जलए पद धारण करेगा, जो ऐसी तारीख से जब तक वह अपना पद ग्रहण करता ह,ै से तीन वषग की अवजध से अजधक न हो और अजधकतम एक और कायगकाल के जलए पुनर्थिनयुजि का पात्र होगा :
परंत ुऐसे व्यजि के मामल ेमें, जो बोडग के अध्यक्ष के रूप में जनयुि दकया गया है, पैंसठ वषग की आय ुप्राि करन ेके पश्चात् पद धारण नहीं करेगा । परंत ुयह और दक कोई सदस्ट्य बासठ वषग की आय ुप्राि करन ेके पश्चात् पद धारण नहीं करेगा ।
(3) बोडग का अध्यक्ष और उसके सदस्ट्यों का पाररश्रजमक और पूवागपेक्षा, कें द्रीय सरकार के जवद्यमान मानदंडों के अनुसार, कें द्रीय सरकार द्वारा जनयत दकया जाएगा ।
6. अध् यक्ष और सदस्ट् यों का त् यागपत्र.- (1) जनयम 7 में अंतर्थिवष् ट दकसी बात के होत ेहुए भी, बोडग का अध् यक्ष या कोई सदस्ट् य केन् द्रीय सरकार को अपने कायगकाल के समा त होने से पूवग तीन मास से अन् यून अजग्रम में जलजखत सूचना देकर दकसी भी समय अपन ेपद से त् यागपत्र दे सकेगा ।
(2) बोडग का अध् यक्ष या कोई सदस्ट् य उप-धारा (1) के अधीन नोटीस देन े के पश् चात् रर त हुए पद पर जब तक केन् द्रीय सरकार द्वारा दकसी व् यज त की जनयुज त नहीं कर दी जाती ह ैया नोटीस की प्राज त की तारीख से तीन मास बीत जान ेतक, जो भी पहल ेहो, पद पर बना रहगेा ।
7. अध् यक्ष और सदस्ट् यों को हटाया जाना.- केन् द्रीय सरकार अध् यक्ष या दकसी सदस्ट् य को पद से हटा सकेगी, जो (क) ददवाजलयां ह,ै या दकसी भी समय एक न् यायजनर्थिणत ददवाजलया हो गया ह ै; या (ख) दकसी ऐसे अपराध दोष-जसद्ध दकया गया ह,ै जो केन् द्रीय सरकार की राय में नैजतक अधमता के अतंगगत आता है;
या (ग) अपन ेकतगव् यों के जनवगहन के जलए िाररररक या मानजसक रूप से असमथग हो गया ह;ै या (घ) जजसने ऐसे जवत् तीय या अन् य जहत अर्थिजत दकया ह,ै जजससे एक सदस्ट् य सजचव के रूप में उसके कृत् यों पर प्रजतकूल प्रभाव पडन ेकी संभावना ह;ै या (ङ) केन् द्रीय सरकार की राय में, अपने पद का इस प्रकार दरुुपयोग करता ह,ै जजससे उसका पद पर बने रहना लोक जहत के जलए अजहतकर हो; या 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (च) अपनी पदावजध के दौरान दकसी अन् य जनयोजन में कायग करने लगा हो; या (छ) सदस्ट् य के मामल ेमें अध् यक्ष को और अध् यक्ष के मामले में केन् द्रीय सरकार को सूजचत दकए जबना सात ददन से अजधक अवजध के जलए जबना दकसी युज तयु त कारण के अपने कायागलय से या कतगव् यों के पश् चात्वतन जनवगहन से अनुपजस्ट् थत रहा हो । परन् त ुजहां अध् यक्ष या सदस्ट् य का खंड (क) से (छ) में जवजनर्ददष् ट दकसी आधार पर हटाया जाना प्रस्ट् ताजवत ह ैतो उन् हें उनके जवरुद्ध आरोपों की सूचना दी जाएगी और उन आरोपों के संबंध में उन् हें सुनवाई का अवसर ददया जाएगा ।
8. बोडग के सदस्ट् यों के जनयोजन का जनबधधन.- बोडग का अध् यक्ष या कोई सदस्ट् य उस तारीख से जजसको वह अपना पद धारण करने से पररवररत हो जाता ह,ै एक वषग की अवजध तक इस अजधजनयम के अधीन बोडग से संबंजधत कोई जनयोजन स्ट् वीकार नहीं करेगा । परन् त ुइस धारा के उपबंध वैसे मामले में लाग ूनहीं होंगें जहां इस संबंध में केन् द्रीय सरकार से जलजखत में जवजनर्ददष् ट प्राजधकार प्रा त कर जलया गया ह ै। स्ट् पष् टीकरण – िंकाओं के समाधान के जलए यह स्ट् पष् ट दकया जाता ह ैदक पदधारण से जवरत होने के एक वषग की समाज त से पूवग दकसी अजभकताग, प्रिासक, अजधकारी, प्रजतधारक, कायगकारणी सजमजत का सदस्ट् य या िेयरधारक या इज वटी स्ट् वामी या लाभकारी स्ट् वामी के रूप में कायगरत अध् यक्ष या दकसी सदस्ट् य का प्रत् यक्ष या अप्रत् यक्ष होन ेका अथग लगाया जाएगा ।
9. बोडग के अजधकारी या अन् य कमगचारी.- बोडग, केन् द्रीय सरकार के पूवग अनुमोदन से ऐसे अजधकाररयों और कमगचाररयों को इस अजधजनयम के अधीन अपन ेकृत् यों के दक्षतापणूग जनवगहन के जलए जो वह आवश् यक समझता ह,ै केन् द्रीय सरकार या राज् य सरकार से प्रजतजनयुज त के आधार पर या संजवदा के आधार पर ऐसे वेतन और भत् ते जो बोडग द्वारा जवजनजश् चत दकए जाएं के संदाय पर जनयु त कर सकेगा ।
10. बोडग की िज तया ंऔर कृत् यें.- (1) बोडग, सडक सुरक्षा, नवाचार और नई प्रौद्योजगकी को अपनान ेऔर यातायात तथा मोटर यान जवजनयमन के जलए उत् तरदायी होगा ।
(2) अध् यक्ष बोडग के काययों के संचालन के साधारण अधीक्षण और जनदेिन की िज त रखेगा ।
(3) बोडग, उप-जनयम (1) के प्रयोजन के जलए केन् द्रीय सरकार द्वारा जवचार के जलए बोडग के कृत् यों के संबंध में ददिाजनदशोंिों को बनाएगा;
(क) देि में पहाड़ी क्षेत्रों के जलए सड़क सुरक्षा, यातायात प्रबंधन और सड़क जनमागण के जलए जवजिष् ट मानकों को बनाया जाना;
(ख) सड़क सुरक्षा और यातायात प्रबंधन के प्रिासन पर केन् द्रीय सरकार, राज् य सरकार और स्ट् थानीय प्राजधकाररयों को तकनीकी सलाह और सहायता प्रदान करना;
(ग) सुरक्षा उपस्ट् करों की लागतों का अवधारण;
(घ) राज् य प्राजधकाररयों के साथ सलाह करके व् यवसाजयक स्ट् थापनों, सूचना पट्टों और व् यवसाजयक संकेतकों के जवजनयमन के जलए एक जवजनयामक ढांचा जवकजसत करना;
(ङ) सड़को और राजमागयों पर यातायात संबंधी क्षजतयों से जनपटन े के जलए रामा सुजवधाओं और परा-जचदकत् सा सुजवधाओं की स्ट् थापना और संचालन के जलए ददिा-जनदशोंि जवजनर्ददष् ट करना;
(च) ऐसी सहायता को सुकर बनाने वाल ेके जीवन को कोई अड़चन पहचंाए जबना सड़क दघुगटना के पीजडतों के जलए अजधकतम सहायता सुजनजश् चत करने के जलए नेक व् यज त के जसद्धांत को सम् प्रवर्थितत करना;
[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 5 (छ) सड़क सुरक्षा और यातायात प्रबंधन से जनपटने वाले यातायात पुजलस, अस्ट् पाताल प्राजधकाररयों, राजमागग प्राजधकाररयों, िैक्षजणक और अनुसंधान संगठनों और अन् य संगठनों के जलए क्षमता जनमागण और कौिल जवकास के जलए ददिा-जनदशोंि जवजनर्ददष् ट करना;
(ज) सड़क सुरक्षा और यातायात प्रबंधन में अच् छी प्रथाओं की अजभवृजद्ध करना और उसका समथगन करना, सड़क सुरक्षा और यातायात जिक्षा कायगक्रमों को चलाना और सड़क प्रयो ताओं के सभी वगयों के बीच जागरूकता लैलान ेके जलए अजभयान चलाना;
(झ) सड़क सुरक्षा और यातायात प्रबंधन के क्षेत्र में पणधारकों और गरै-सरकारी संगठनों को िाजमल करना और दक्षतापूवगक यातायात प्रबंधन और सड़क सुरक्षा प्रथाओं के संवधगन में उनकी सहायता करना;
(ञ) सड़क सुरक्षा और यातायात प्रबंधन से संबंजधत मामलों में अन् य अजभकरणों जैसे जिक्षा बोडग और संस्ट् थान, स्ट् वास्ट् ् य सेवाएं और गरै-सरकारी संगठनों के साथ समन् वय रखना;
(ट) सावगजजनक-जनजी भागीदारी पररयोजनाएं और स्ट् कीमें;
(ठ) सड़क पररवहन पाररजस्ट् थजतकी तंत्र के सुरजक्षत और सतत उपयोग को सुकर बनाना;
(ड़) वार्थिषक रूप से इसके द्वारा तक दकए गए संपादन लक्ष् य;
(ढ) धारा 2ख के अनुसार साधारण रूप से वाहन इंजीजनयरी, यंत्र नोददत वाहनों और यातायात के क्षेत्रों में नवाचार, अनुसंधान और जवकास के माध् यम से नई वाहन प्रौद्योजगकी का संवधगन करना;
(ण) अरजक्षत सड़क प्रयो ताओं की सुरक्षा;
(त) मोटर वाहनों और सड़कों के जलए अंतरराष् रीय तकनीकी मानकों के जवकास में योगदान देना;
(थ) मोटन वाहन मानकों के काययों पर अंतरराष् रीय सरकारी संगठनों और गरै-सरकारी संगठनों के साथ समन् वय की अजभवृजद्ध करना;
(द) अंतरराष् रीय तकनीकी मानकों और घरेलू तकनीकी मानकों के बीच जनरंतरता की अजभवृजद्ध करना और यह सुजनजश् चत करना दक देि में अपनाए गए सुरक्षा के स्ट् तर से कोई समझौता न दकया गया हो;
(ध) डाटा एकत्र करके अनुसंधान करना और सड़क सुरक्षा, यातायात प्रबंधन, दघुगटना जांच में सुधार के जलए जवश् लेषण और योजना गजतजवजधयों का संचालन करना और इस अजधजनयम के प्रयोजनों के जलए यथावश् यक अन् य उपाय करना;
(न) सड़क सुरक्षा में सुधार के जलए ऐसी योजनाओं को तैयार करना और लागू करना जो आवश् यक हो;
(प) तकनीकी सहयोग, गजतजवजधयों का समन् वय, सूचना और डाटा संग्रहण का आदान-प्रदान, संयु त पररयोजनाओं का जवकास और कायागन् वयन तथा इसके उत् तरदाजयत् व के भीतर आन ेवाल ेक्षेत्रों में जविेषज्ञता और सववोतत् तम प्रथाओं का आदान-प्रदान;
(ल) प्रजतस्ट् पधाग, नवपररवतगन, दक्षता और संसाधनों के आर्थिथक उपयोग को प्रोत् साजहत करना।
11. बोडग की बठैकें .-- (1) बोडग के अध् यक्ष और सदस्ट् य मास में कम से कम एक बार ऐसे समय और स्ट् थानों पर बैठक करेंग े तथा उसकी बैठकों, जजसके अंतगगत ऐसी बैठकों के जलए गणपूर्थित भी ह,ै के कायग संचालन के संबंध में प्रदक्रया के ऐसे जनयमों का पालन करेंगे जो बोडग द्वारा जवजहत दकए जाएं । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(2) अध् यक्ष या अन् य सदस्ट् य, जजनका बोडग की बैठक में जवचार दकए जाने के जलए रखे जाने वाले दकसी मामले में प्रत् यक्ष या अप्रत् यक्ष जहत ह,ै वह जैसे ही उसके ज्ञान में आता ह,ै जहत की प्रकृजत बोडग को प्रकट करेगा ।
(3) उप-धारा (2) के अधीन अध् यक्ष या सदस्ट् य द्वारा दकया गया प्रकटन, बैठक की कायगवाजहयों में अजभजलजखत दकया जाएगा और अध् यक्ष तथा ऐसा सदस्ट् य उस मामले या उससे संत त दकसी अन् य मामले की बाबत बोडग के दकसी जवचार- जवमिग या जवजनश् चय से अलग रहगेा:
परंत ुयदद अध् यक्ष स्ट् वयं को बोडग की कायगवाजहयों से अलग रखता ह ैतो वह उस मामल ेमें अध् यक्ष के कृत् यों का जनवगहन करन ेके जलए बोडग के दकसी सदस्ट् य को पदाजभजहत करेगा:
परंत ुयह और भी यदद कोई सदस्ट् य, स्ट् वय ंको बोडग की कायगवाजहयों से अलग रखता ह,ै तो केन् द्रीय सरकार दकसी व् यज त को बैठक में उपजस्ट् थत होने के जलए प्राजधकृत करेगी ।
(4) बोडग के सभी आदेि और जवजनश् चय इस संबंध में बोडग द्वारा प्राजधकृत दकसी सदस्ट् य द्वारा अजधप्रमाजणत दकए जाएगंे ।
(5) बोडग का कोई कायग या कायगवाजहयां, केवल बोडग में दकसी ररज त या उसके गठन में दकसी तु्ररट के होन ेके आधार पर ही प्रश् नगत या अजवजधमान् य नहीं होगा ।
12. तकनीकी कायग समहू.--(1) बोडग, अपने कृत् यों के दक्ष जनवगहन के जलए अनेक तकनीकी कायग समूह जो वह उजचत समझे गरठत करेगा, जजसमें अपने कृत् यों के जनवगहन में स्ट् वतंत्र जनणगय की क्षमता का अनरुक्षण और प्रयोग करन ेका साम् यग रखन े वाले स्ट् वतंत्र तकनीकी जविेषज्ञ सजम् मजलत होंगे ।
(2) उपरो त उप-जनयम (1) के अधीन गरठत प्रत् येक तकनीकी कायग समूह की अध् यक्षता, अध् यक्ष द्वारा पदाजभजहत बोडग के सदस्ट् य द्वारा की जाएगी, जो सुसंगत क्षेत्र में जविेष ज्ञान और अनुभव रखता हो ।
(3) तकनीकी कायग समूह, अपन ेको न् यस्ट् त दकए गए मामलों पर जवचार-जवमिग करने के जलए अपने जवचार-जवमियों में भाग लेन ेके जलए सुसंगत उद्योग और उपभो ता के प्रजतजनजधयों को आमंजत्रत करेगा ।
(4) उपरो त उप-जनयम (1) के अधीन तकनीकी कायग समूह का गठन करन ेके जलए तकनीकी सदस्ट् यों की संय या और प्रदक्रया ऐसी होगी, जो बोडग द्वारा जवजनयमों के अधीन जवजहत की जाए ।
(5) उपरो त उप-जनयम (1) के अधीन प्रत् येक तकनीकी कायग समूह को जनम् नजलजखत मामलों में से दकन् हीं मामलों को न्यस्ट् त दकया जा सकेगा, अथागत:्-- (क) पररवहन अवसंरचना और सुरक्षा, जजसके अंतगगत सड़क मानक भी हैं;
(ख) यातायात प्रबंधन;
(ग) ध् वंस अनुसंधान और लोरेंजसस;
(घ) आंकड़ा एकत्रण और जवश् लषेण;
(ङ) मोटर यान मानक ;
(च) चालन कौिल परीक्षण ;
(छ) प्रौद्योजगकी का जवकास, एल् कोहल या मादक धषधी के प्रभाव के अधीन अथवा अत् यजधक गजत से मोटर यान के चालन की जांच करन ेके जलए उसका उपयोग और परीक्षण मानक ;
(ज) पहल ेसे ही उपयोग दकए जा रह ेयानों का जनरीक्षण और प्रमाणन ;
(झ) यान की ईंधन वाजलटी ;

(6) बोडग, ऐसे तकनीकी समूहों के जविेषज्ञों की संय या बााकर या घटाकर अथवा उसे न् यस्ट् त मामलों में पररवतगन कर तकनीकी कायग संघों का समय-समय पर पुनगगठन कर सकेगा ।
(7) बोडग, तकनीकी कायग समूहों के जनबागध कृत् यकारी के जलए प्रिासजनक, जवत् तीय और अनुसंधान सहायता प्रदान करेगा ।
13. बोडग की समनदुेिन की िज त.— बोडग, साधारण या जवजिष् ट जलजखत आदेि द्वारा बोडग के दकसी सदस्ट् य, अजधकारी को या ऐसी ितयों के अधीन रहते हुए दकसी अन् य व् यज त को, यदद कोई हो, जो उस आदेि में जवजनर्ददष् ट की जाए, अपने इस अजधजनयम के अधीन ऐसे कृत् यों को, जजन् ह ेवह आवश् यक समझे समनुदेजित कर सकेगा ।

(जसजवल सजगन/जजला जचदकत्सा अजधकारी) MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 3rd September, 2021 G.S.R. 615(E).—Whereas, the draft of the National Road Safety Board Rules, 2021 were published, which the Central Government proposes to make in exercise of the powers conferred by sub-section (1) of section 215B, subsection (1) of section 215C and sub-clauses (c), (d) and (e) of sub-section (2) of section 215C of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport & Highways G. S. R. 754(E), dated the 8 th December, 2020 in the Gazette of India, Extraordinary, Part II, Section (3), Sub-section
(i) as required under sub-section (1) of section 212 of the said Act for inviting objections and suggestions from 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] persons likely to be affected thereby before the expiry of the period of thirty days from the date on which the copies of the Gazette containing the said notification were made available to the public;
And whereas, copies of the said Gazette in which notification was published and were made available to the public on 8 th December, 2020;
And whereas, objections and suggestions received from the public in respect of the said draft rules within specified period considered by the Central Government;
Now, therefore, in exercise of the powers conferred by in exercise of the powers conferred by sub-section (1) of section 215B, sub-section (1) of section 215C and sub-clauses (c), (d) and (e) of sub-section (2) of section 215C, read with sub-section (1) of Section 215B of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules, namely:-
1. Short Title and commencement.- (1) These rules may be called the National Road Safety Board Rules,
2021.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. Definitions.- (1) In these rules, unless the context otherwise requires:
(a) ‗Act‘ means the Motor Vehicles Act, 1988 (59 of 1988);
(b) Board‖ means the National Road Safety Board constituted under sub-section (1) of section 215B;
(c) ―Chairman‖ means the Chairman of the Board;
(d) ―Member‖ means a member of the Board;
(e) ―Section‖ means a section of the Act.
(2) The words and expressions used herein and not defined and defined in the Act shall have the same meaning respectively assigned to them in the Act.
3. Qualifications of Chairman and Members.- (1) The Chairman and every Member of the Board shall be a person of ability, integrity and standing, having special knowledge of, or professional experience in, one or more fields of administration, road safety, urban planning, law, traffic management and regulation, health and advocacy, police enforcement and investigation, transport engineering, insurance, automobile engineering, civil engineering, public transport which, in the opinion of the Central Government, is useful for the Board to render its functions and fulfil its objectives under this Act.
(2) State Government representatives and Government of India‘s official representative will be part time members. The Chairman and other Members of the Board shall be whole-time Members and shall not hold any other office.
4. Procedure for appointment.- The Chairman of the Board and its Members shall be selected in the following manner by the Central Government and their appointment shall be notified in the Official Gazette:-
(a) The Chairman of the Board or its Members shall be appointed by the Central Government on the recommendation of a Search-cum-Selection Committee, headed by Secretary, Ministry of Road Transport & Highways.
(b) A representative of the Government of India, Ministry of Road Transport and Highways, not below the rank of Deputy Secretary, shall be an ex-officio Member.
(c) members from the States, not below the rank of Deputy Secretary in Government of India, shall be nominated as ex-officio Members, as per requirement.
(d) The process of appointments shall be initiated by the Central Government at least six months before the vacancy arises and in case a post falls vacant due to resignation or death of the Chairman or a Member, the process shall be initiated immediately after the post has fallen vacant.
(e) The advertisement of a vacancy inviting applications for the Chairman and Member shall be published in at least 2 newspapers and circulated in such other manner as the Central Government may deem appropriate.
(f) Apart from applications in response to the advertisement, the Search-cum-Selection Committee may consider other suitable person(s) as it may deem fit.
(g) The Search-cum-Selection Committee shall determine its procedure for making its recommendation keeping in view the eligibility, suitability, record of past performance and such other criteria as it may deem fit.

(h) The Search-cum-Selection Committee shall recommend a panel of names of candidates for appointment in the order of merit for the consideration of Minister of Road Transport and Highways.
(i) Every appointment of a Chairman or a Member shall be subject to submission of a certificate of physical fitness as indicated in the annexure appended to these rules, duly signed by a civil surgeon or District Medical officer.
5. Term of office of Chairman and other Members.- (1) Before appointing any person as a Chairman or Member, the Central Government shall satisfy itself that such person has no financial or other interest that may be prejudicial to his functions as such Chairman or Member.
(2) The Chairman or a Member of the Board shall hold office for such period not exceeding three years from the date on which he enters upon his office and shall be eligible for re-appointment for a maximum of one more term:
Provided that in case of a person, who has been appointed as Chairman of the Board, shall not hold office after he has attained the age of sixty five years:
Provided further that no member shall hold office after he has attended the age of sixty two years.
(3) The remuneration and prerequisites of the Chairman of the Board and its Members shall be fixed by the Central Government in accordance with the prevailing norms of the Central Government.
6. Resignation of Chairman and Members.- (1) Notwithstanding anything contained in Rule 7, the Chairman or a Member of the Board may resign office at any time before the expiry of his term, by giving to the Central Government an advance notice in writing of not less than three months.
(2) The Chairman or a Member of the Board, after giving notice under sub-rule (1), shall continue to hold office until the Central Government appoints a person to the office so vacated, or till the expiry of three months from the date of receipt of notice, whichever is earlier.
7. Removal of Chairman and Members:- The Central Government may remove from office the Chairman and any Member, who-
(a) is, or at any time has been adjudged an insolvent; or
(b) has been convicted of an offence which, in the opinion of the Central Government, involves moral turpitude; or
(c) has become physically or mentally incapable of discharging his duties; or
(d) has acquired such financial or other interest as is likely to affect prejudicially his functions as a Member Secretary; or
(e) has, in the opinion of the Central Government, so abused his position as to render his continuance in office detrimental to the public interest; or
(f) has engaged at any time during his term of office in any other employment; or
(g) has remained absent from his office and subsequent discharge of duties without any reasonable cause for a period of more than seven days, without informing the Chairman in case of Member and the Central Government in case of the Chairman.
Provided that where Chairman or Member is proposed to be removed on any ground specified in clauses (a) to (g), he shall be informed the charges against him and given an opportunity of being heard in respect of those charges.
8. Restrictions of employment of Member of the Board.- The Chairman or a Member of the Board shall not, for a period of one year from the date on which he ceases to hold office as such, accept any employment relating to the Board under this Act.
Provided that the provisions of this section shall not apply in cases where specific authorisation in this regard has been obtained in writing from the Central Government.
Explanation –– For the removal of doubts, it is hereby clarified that, the Chairman or a Member acting as an agent, administrator, officer, director, retainer, Member of the executive committee or shareholder or equity owner or beneficial owner before the expiry of one year on ceasing to hold office as such Chairman or a Member shall be construed to have direct or indirect interest.
9. Officers and other employees of Board.- The Board may, with the prior approval of the Central Government, appoint such officers and other employees as it may consider necessary, for the efficient 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] discharge of its functions under the Act, on deputation from the Central Government or State Government or on contract basis on the payment of such salaries and allowances, as may be determined by the Board.
10. Powers and Functions of the Board:- (1) The Board shall be responsible for promoting road safety, innovation and adoption of new technology and for regulating traffic and motor vehicles.
(2) The Chairman shall have powers of general superintendence and directions in the conduct of affairs of the Board.
(3) For the purposes of sub-rule (1), the Board shall, for consideration by the Central Government, formulate guidelines relating to functions of the Board:
(a) the formulation of specific standards for road safety, traffic management and road construction for hilly regions in the country;
(b) provide technical advice and assistance to the Central Government, State Government and local authorities on administration of road safety and traffic management;
(c) the determination of costs of safety equipment;
(d) develop, in consultation with State authorities, a regulatory framework for regulation of commercial establishments, billboards and commercial signage;
(e) specify guidelines for establishing and operating trauma facilities and para-medical facilities for dealing with traffic related injuries on roads and highways;
(f) promote the principle of Good Samaritan so as to ensure maximum aid for victims of a road accident without causing any impediment to the life of those facilitating such aid;
(g) specify guidelines for capacity building and development of skills for traffic police, hospital authorities, highway authorities, educational and research organisations and other organisations dealing with road safety and traffic management;
(h) promote good practices in road safety and traffic management and advocacy of the same, undertake road safety and traffic education programmes, and conduct campaigns to create awareness amongst all sections of road users;
(i) involve stakeholders and non-government organisations working in the area of road safety and traffic management, and assist them in promotion of efficient traffic management and road safety practices;
(j) co-ordinate with other agencies such as education boards and institutions, health services and nongovernment organisations in matters relating to road safety and traffic management;
(k) public-private partnership projects and schemes;
(l) the facilitation of safe and sustainable utilisation of road transport ecosystem;
(m) the performance targets set by it annually;
(n) the promotion of new vehicle technology through innovation, research and development in the fields of vehicular engineering, mechanically propelled vehicles and transportation in general as per section 2B;
(o) the safety of vulnerable road users;
(p) contribute to the development of international technical standards for motor vehicles and roads;
(q) promote co-ordination with the international governmental organisations and non-governmental organisations on the work of motor vehicle standards;
(r) promote consistency between international technical standards and domestic technical standards and ensure that the level of safety adopted in the country is not compromised;
(s) conduct research, by way of collecting data and undertake analysis and planning activities to improve road safety, traffic management, crash investigation and such other measures as may be necessary for the purposes of this Act;
(t) prepare and implement such plans as may be necessary to improve road safety;
(u) establish a network of organisations to facilitate technical co-operation, co-ordination of activities, exchange of information and data collection, the development and implementation of joint projects, exchange of expertise and best practices in the fields which falls within its responsibility;

(v) encourage competition, innovation, efficiency and economical use of resources.
11. Meetings of the Board.- (1)The Chairman and the Members of the Board shall meet at least once a month, and at such times and places, and observe such rules of procedure in regard to the transaction of business at its meetings, including quorum for such meetings, as may be prescribed by the Board.
(2) The Chairman or any Member who has any direct or indirect interest in any matter coming up for consideration at a meeting of the Board shall, as soon as it comes to his knowledge, disclose the nature of interest to the Board.
(3) A disclosure made by the Chairman or a Member under sub-section (2) shall be recorded in the proceedings of the meeting, and the Chairman or such Member shall recuse from any deliberation or decision of the Board with respect to that matter or any matter connected therewith:
Provided that if the Chairman has to recuse himself from a proceeding of the Board, he shall designate a Member of the Board to discharge the functions of the Chairman for that matter.
Provided that if a Member has to recuse himself from a proceeding of the Board, the Central Government shall authorise a person to attend the meeting.
(4) All orders and decisions of the Board shall be authenticated by the Member authorised by the Board in this behalf.
(5) No act or proceedings of the Board shall be questioned or invalidated merely on the ground of existence of any vacancy or defect in the constitution of the Board.
12. Technical Working Groups.- (1) The Board shall, for the efficient discharge of its functions, constitute as many Technical Working Groups as it may consider necessary, which shall consist of independent technical experts, having the ability to maintain and exercise independent judgment in the discharge of their duties.
(2) Each Technical Working Group constituted under sub-rule (1) above, shall be headed by such Member of the Board designated by the Chairman, having regard to his special knowledge and experience in the relevant field.
(3) The Technical Working Group, for undertaking deliberations on the matters entrusted to it, shall invite the relevant industry and consumer representatives to participate in its deliberations.
(4) The number of technical Members and the procedure for constituting the technical working groups under sub-rule (1) above, shall be such as may be specified by regulations by the Board.
(5) The Technical Working Group constituted under sub-rule (1) above, may be entrusted with any of the following matters, namely:-
(a) transport infrastructure and safety, including road standards;
(b) traffic management;
(c) crash investigation and forensics;
(d) data collection and analytics;
(e) motor vehicle standards;
(f) driving skill testing;
(g) development of technology, its use and testing standards for checking driving of motor vehicles under the influence of alcohol or intoxicating drugs or over speeding;
(h) inspection and certification of vehicles already in use;
(i) vehicle fuel quality;
(j) vehicle noise standards;
(k) third party insurance relating to motor vehicles;
(l) any other matter that may be entrusted to such technical working group, as may be considered necessary by the Board.
(6) The Board may from time to time re-constitute the Technical Working Groups by increasing or decreasing the number of experts or by changing the subject matters entrusted to such Technical Working Groups.

(7) The Board shall provide the administrative, financial and research support for smooth functioning of the Technical Working Groups.
13. Power of Board to assign.- The Board may, by a general or special order made in writing, assign to any Member, officer of the Board or any other person subject to such conditions, if any, as may be specified in that order, such of its functions under this Act, as it may deem necessary.
14. Chairman, Members, etc. to be public servants.- The Chairman, Members and other officers and employees of the Board shall be deemed to be public servants within the meaning of section 21 of the Indian Penal Code, 1860.
