PART II—Section 3—Sub-section (i) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 534] ubZ fnYyh] eaxyokj] twu 27] 2017@vk"kk<+ 6] 1939 No. 534] NEW DELHI, TUESDAY, JUNE 27, 2017/ASADHA 6, 1939 सड़क पिरवहन और राजमागर् मंᮢालय अिधसचूना नई िदल् ली, 27 जून, 2017 सा.का.िन. 643(अ).—केन् ᮤ ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए कितपय ᮧारूप िनयम मोटरयान अिधिनयम, 1988 (1988 का 59) की धारा 212 की उपधारा (1) की अपेक्षानुसार भारत सरकार के सड़क पिरवहन और राजमागर् मंᮢालय की अिधसूचना संख्या सा.का.िन. 402(अ), तारीख 21 अᮧैल , 2017 के अधीन भारत के राजपᮢ, असाधारण, भाग II, खंड 3, उपखंड (i), तारीख 21 अᮧैल, 2017 मᱶ ᮧकािशत िकये गए थे, िजसमᱶ उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने की सम्भावना थी, उस तारीख से, िजसको भारत के राजपᮢ मᱶ ᮧकािशत रूप मᱶ उᲦ अिधसूचना की ᮧितयां जनता को उपलब्ध करा दी गई थी, सात िदन की समाि᳙ का पूवर् आक्षेप और सुझाव मांगे गए थे;
और उक् त अिधसूचना की ᮧितयां जनता को 21 अᮧैल, 2017 को उपलब् ध करा दी गई थी ;
उक् त ᮧारूप िनयमᲂ की बाबत जनता से ᮧाप् त आके्षप और सुझाव जनता से ᮧाप् त नहᱭ िकये गए थे;
अत:, अब कᱶ ᮤीय सरकार, मोटर यान अिधिनयम, 1988 (1988 का 59) की धारा 110 ᳇ारा ᮧदत् त शिक् तयᲂ का ᮧयोग करते हुए केन् ᮤ ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए िनम् निलिखत िनयम बनाती ह,ै अथार्त् :--
1. (1) इन िनयमᲂ का संिक्षप् त नाम कᱶ ᮤीय मोटर यान (दसवां संशोधन) िनयम, 2017 ह ै।
(2) ये राजपᮢ मᱶ उनके ᮧकाशन की तारीख को ᮧवृत् त हᲂगे ।
2. कᱶ ᮤीय मोटर यान िनयम, 1989 मᱶ, िनयम 118 मᱶ, उप-िनयम (1) के पहले परंतुक के, खंड (iv) का लोप िकया जाएगा।
1. (1) इन िनयमो का संिक्ष᳙ नाम कᱶ ᮤीय मोटर यान (दसवां संशोधन) िनयम, 2017 ह ै।
(2) ये राजपᮢ मᱶ इनके अंितम ᮧकाशन की तारीख को ᮧवृᱫ हᲂगे । 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
2. कᱶ ᮤीय मोटर वाहन िनयम 1989, मᱶ
(i) 115 (ख) तत्प᳟ात उप-िनयम (1) के रूप मᱶ संख्यांिकत िकया जाएगा और इस ᮧकार पुनः संख्यांिकत के रूप मᱶ, उपिनयम (1) के प᳟ात िन᳜िलिखत अंतः स्थािपत िकया जाएगा, अथार्त:- “(2) जब ᮤिवत ᮧाकृितक गैस को ईंधन के रूप मᱶ उपयोग िकया जायेगा तो उप िनयम (1) के तहत सामूिहक उत्सजर्न मानक जो सीएनजी समिपर्त वाहनᲂ के मूल उपकरण पर लागू ह,ᱹ वो जीवीडब्ल्यू> 3.5 टी वाले मूल उपकरण िनिमर्ᱫ वाहन पर लागू हᲂगे।
(3). उत्सजर्न मᱶ लागू होने वाले ᮤवीकृत ᮧाकृितक गैस संरचना उन ईंधन िविनदᱷशᲂ के अनुसार होना चािहए, जैसा िक यथािस्थित पेᮝोिलयम और ᮧाकृितक गैस मंᮢालय, भारत सरकार या भारतीय मानक ब्यूरो के ᳇ारा, समय-समय पर मोटर वाहन आवेदन के िलए िविनदᱷशᲂ ᳇ारा अिधसूिचत िकया गया ह;ै:
परन्तु ऐसे समय तक ᮤिवत ᮧाकृितक गैस ईंधन, उपाबंध 4 - एलए मᱶ अपेक्षाᲐ का पालन करते हुए, ᮧकार के अनुमोदन और उत्पादन की अनुरूपता के ᮧयोजन के िलए िकया जाएगा।
4. मूल उपकरण जी.वी.डब्लू. वाले वाहन समिपर्त िविनिमर्ᱫ ᮤिवत ᮧाकृितक गैस िजसमे जी.वी.डब्लू. > 3.5 टी ह,ै वह एआईएस -024 और एआईएस -028, समय-समय पर संशोिधत मᱶ, िनधार्िरत सुरक्षा अपेक्षाᲐ को पूरा करेगा। ",
(ii) िनयम 115 के उप-िनयम (1) मᱶ, पैरा ड. मᱶ, "सीएनजी" अक्षरᲂ के स्थान पर, अक्षर और शब्द "सीएनजी / बायो-सीएनजी / एलएनजी" रखा जाएगा;
पैरा च के, िटप्पण मᱶ, ᮓम संख्या 3 के प᳟ात, िन᳜िलिखत ᮓम संख्या अंतःस्थािपत िकया जाएगा, अथार्त्:- ‘3(क) “एलएनजी समिपर्त वाहन से अिभᮧेत ह ैवह वाहन जो उनके रिजस्ᮝीकरण से पहले, िविनमार्ताᲐ ᳇ारा एलएनजी संचालन के िलए िनिमर्त िकए जाते ह,ᱹ” उपाबंध 9 के स्थान पर, िन᳜िलिखत उपाबंध रखा जाएगा, अथार्त् :- उपाबंध 9 (िनयम 115 ख की मद ई दखेᱶ) आंतिरक दहन इंजन वाले वाहनᲂ मᱶ सीएनजी/ जैव सीएनजी / एलएनजी ईंधन के उपयोग के िलए सुरक्षा जांच (एआईएस - 028 के अनुसार) और भारतीय गैस िसलᱶडर िनयम (समय-समय पर संशोिधत) ᮓ. सं. सीएनजी / जैव सीएनजी / एलएनजी िकट घटक ᮧमाणीकरण / सत्यापन ᮧािधकारी एआईएस -028 / अन्य खंड, िनयम, मानक आिद
1. सीएनजी / जैव सीएनजी / एलएनजी िसलᱶडर * पीईएसओ, नागपुर के मामले मᱶ िवदशेᲂ के िनमार्ण से ᮧमािणत करने या पृ᳧ांकन करने के िलए गैस िसलᱶडर िनयम 2004,पीईएसओ ᳇ारा अनुमोिदत अंतरार᳦्ीय मानक ह ᱹ
1.1 वाहन पर िसलᱶडर का िनधार्रण िफटमᱶट एआईएस -028 के अनुसार, सत्यािपत करने के िलए परीक्षण अिभकरण एआईएस - 028 की धारा 2.3, 2.5 और
2.6 ¹Hkkx IIμ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3
2. सीएनजी / एलएनजी (बंद वाल्व) िसलᱶडर वाल्व पीईएसओ, नागपुर को िवदशेो से ᮧमािणत करने या पृ᳧ांकन करने के िलए (सीएनजी वाल्व्स के िलए) पीईएसओ ᳇ारा अनुमोिदत गैस िसलᱶडर िनयम 2004 या अंतरार᳦्ीय मानक
3. िनयामक (सीएनजी) / िविनयिमत और वाष्पीकरण / ताप एक्सचᱶजर (एलएनजी) * आईएस 15713 या आईएसओ -15500 के अनुसार, परीक्षण अिभकरण ᳇ारा घटक का परीक्षण । वैकिल्पक रूप से, परीक्षण अिभकरण, ᮧमािणत परीक्षण ᮧयोगशाला ᮧत्याियत ᳇ारा जारी मानक के अनुसार, परीक्षण ᮧमाण पᮢ या िरपोटर् की पुि᳥ को ᮧमािणत करने के िलए। एलएनजी िनयामक और वाष्पीकरणकतार्/ गमᱮ एक्सचᱶजर ईसीई आर110 या समतुल्य मानक की अपेक्षाᲐ को पूरा करेगा आईएस: 15713 या आईएसओ -15500 ईसीई आर110 या समतुल्य मानक 4 गैस एयर िमक्सर आईएस 15713 या आईएसओ -15500 के अनुसार, परीक्षण अिभकरण ᳇ारा घटक का परीक्षण । वैकिल्पक रूप से, परीक्षण अिभकरण, ᮧमािणत परीक्षण ᮧयोगशाला ᳇ारा जारी मानक के अनुसार, परीक्षण ᮧमाण पᮢ या िरपोटर् की पुि᳥ को ᮧमािणत करने के िलए। आई एस: 15714 या आईएसओ -15500
5. गैस इंजेक्टर आईएस -15500 के अनुसार, परीक्षण अिभकरण ᳇ारा घटक का परीक्षण । वैकिल्पक रूप से, परीक्षण अिभकरण, ᮧमािणत परीक्षण ᮧयोगशाला ᮧत्याियत ᳇ारा जारी मानक के अनुसार, परीक्षण ᮧमाण पᮢ या िरपोटर् की पुि᳥ को ᮧमािणत करने के िलए। आईएसओ -15500 6 पेᮝोल सोलनॉइड वाल्व* परीक्षण अिभकरण ᳇ारा आई एस: 15717 के अनुसार घटक का परीक्षण करना। वैकिल्पक रूप से, परीक्षण अिभकरण को ᮧमािणत परीक्षण ᮧयोगशाला ᳇ारा ᮧत्याियत जारी मानक के अनुसार परीक्षण ᮧमाण पᮢ या िरपोटर् की पुि᳥ करने के िलए आई एस: 15717
6.1 गैस सोलेनोइड वाल्व* आईएस के अनुसार घटक का परीक्षण: 15712 या परीक्षण अिभकरण ᳇ारा आईएसओ -15500। वैकिल्पक रूप से, परीक्षण अिभकरण को ᮧमािणत परीक्षण ᮧयोगशाला ᳇ारा ᮧत्याियत जारी मानक के अनुसार परीक्षण ᮧमाण पᮢ या िरपोटर् की पुि᳥ करने के िलए । एलएनजी ᮧणाली का स्वचािलत वाल्व ईसीईआर110 या समतुल्य मानक की अपेक्षाᲐ को पूरा करेगा आईएस: 15712या आईएसओ -15500 एलएनजी ᮧणाली का स्वचािलत वाल्व ईसीईआर110 या समतुल्य मानक की अपेक्षाᲐ को पूरा करेगा
7. सीएनजी / एलएनजी ᮧत्यारोपण के िलए कनेक्शन भरना (एनजेडएस एआईएस -028 के अनुसार, परीक्षण अिभकरण ᳇ारा वाहन पर संस्थापन की जानी चािहए। एआईएस -028 के

10. सीएनजी / जैव सीएनजी / एलएनजी ईंधन लाइन
10.1 उᲬ दबाव 100 केपीएसे अिधक
10.1.1 2.15 एमपीए से अिधक कठोर पाइप घटक का परीक्षण या ᮧमाण पᮢ का सत्यापन या आई एस:
15716 के अनुसार, परीक्षण अिभकरण ᳇ारा परीक्षण िरपोटर्। एलएनजी कठोर पाइपलाइन ईसीईआर 110 या समतुल्य मानक की अपेक्षाᲐ को पूरा करेगा। आईएस:15716 इसीएसआर 110 या समतुल्य मानक नमनीय नली घटक का परीक्षण या ᮧमाण पᮢ का सत्यापन या आई एस:
15718 के अनुसार, परीक्षण अिभकरण ᳇ारा परीक्षण िरपोटर्। एलएनजी पाइपलाइन ईसीई आर110 या समतुल्य मानक की अपेक्षाᲐ को पूरा करेगा। आई एस: 15718 ईसीई आर110 या समतुल्य मानक
10.1.2 2.15 एमपीए तक दबाव घटक का परीक्षण या ᮧमाणपᮢ का सत्यापन या आई एस:
15722 के अनुसार, परीक्षण अिभकरण ᳇ारा परीक्षण िरपोटर्। ईसीई आर 110 या समतुल्य मानक एलएनजी पाइपलाइन ईसीई आर110 या समतुल्य मानक की अपेक्षाᲐ को पूरा करेगा। आई एस:15722 संशोधन के साथ ईसीई आर110 या समतुल्य मानक
10.2 जोड़ और संपकर् परीक्षण अिभकरण ᳇ारा परीक्षण एलएनजी जोड़ और संपकर् को ईसीई आर110 या समतुल्य मानक की अपेक्षाᲐ को पूरा करेगा। एआई एस-028 के खंड
3.2.1(ख) को ईसीई आर 110 या समतुल्य मानक 11 िडब्बे या उप िडब्बे घटक का परीक्षण, परीक्षण अिभकरण ᳇ारा ᮧमाण पᮢ का सत्यापन या परीक्षण िरपोटर्, आईएस 15720 के अनुसार ह:ै आई एस: 15720 12 िविनर्िद᳥ एलएनजी घटक (क)िन᳜ िविनर्िद᳥ घटक, जैसा की लागू ह,ै ईसीईआर110 या अन्य समतुल्य मानक की अपेक्षाᲐ को पूरा करेगा ईसीईआर 110 या समतुल्य मानक (ख)इलेक्ᮝॉिनक िनयंᮢण इकाई, दबाव और / या तापमान सᱶसर (यिद एलएनजी िसलᱶडर का भाग नहᱭ ह)ै
13. सीएनजी / जैव सीएनजी / एलएनजी ᮧणाली की संस्थापन के िलए सुरक्षा जांच एआईएस -028 के अनुसार, परीक्षण अिभकरण ᳇ारा िकए जाने वाले सुरक्षा जांच एआईएस -028 की सुसंगत के खंडो मᱶ ¹Hkkx IIμ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 5 *मूल दशे की मान्यता ᮧत्याियत ᮧा᳙ परीक्षण अिभकरण ᳇ारा जारी ᮧमाण पᮢ या अंतररा᳦ीय स्तर पर मान्यता ᮧा᳙ परीक्षण ᮧयोगशाला ᳇ारा जारी एक िरपोटर् भी स्वीकार िकया जा सकता ह।ै िटप्पण 1 - केवल मानकᲂ, समय-समय पर संशोिधत, जैसा िक ऊपर िनिदष् ट ह,ै अनुपालन के िलए भेजा जाएगा। िटप्पण 2 - एलएएनजी ᮧणाली वाष्पीकरण / ऊष्मा एक्सचᱶजर को काम करने वाले घटको को सीएनजी घटकᲂ के रूप मᱶ माना जाएगा। िटप्पण 3 - परीक्षण अिभकरण को वािणिज्यक उपलब्ध एलएनजी ईंधन के साथ लागू होने वाले सीएमवीआर परीक्षण करना ह,ै करने के िलए ।"

19.05.2017 को संशोिधत िकए गए । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 27th June, 2017 G.S.R. 643(E).—Whereas, the draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, was published as required by sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988) vide notifications of Government of India in the Ministry of Road Transport and Highways number G.S.R. 402(E), dated the 21st April, 2017, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected therby, within a period of seven days from the date on which copies of the Gazette containing the said notification were made available to public;

And whereas, no objections and suggestions were received from the public in respect of the said draft rules;
Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: -
1. Short title and commencement.—(1) These rules may be called the Central Motor Vehicles (10th Amendment) Rules, 2017.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicle Rules, 1989, -
(i) rule 115B shall be renumbered as sub-rule (1) thereof and after sub-rule (1) as so renumbered, the following shall be inserted, namely: - “(2)The mass emission standards applicable to Original Equipment CNG Dedicated Vehicles under sub-rule (1) shall be applicable to Original Equipment manufactured vehicle having GVW ≥ 3.5 T, when Liquified Natural Gas is used as fuel.
(3)The Liquified Natural Gas composition used for carrying out emission shall meet the fuel specification as notified by the Government of India in the Ministry of Petroleum and Natural Gas, or Bureau of Indian Standard, as the case may be, for automotive application from time to time:
Provided that till such time the Liqiufied Natural Gas fuel complying to the requirements as provided in Annexure IV- LA shall be used for the purpose of type approval and conformity of production.
(4) The Original Equipment manufactued Liqiufied Natural Gas dedicated vehicle having GVW ≥3.5 T shall meet the safety requirements as laid down in AIS-024 and AIS- 028 as amended from time to time.”;
(ii) in rule 115B, in sub-rule (1),-
(a) in para E, for the letters “CNG”, the letters and word “CNG/bio-CNG/ LNG” shall be substituted;
(b) in para F, in the Note, after serial number 3, the following serial number shall be inserted, namely: - ‘3(a) “O.E. LNG Dedicated Vehicle” means the vehicles which are manufactured for LNG operation by the vehicle manufacturers prior to their first registration;’;
(iii) for Annexure IX, the following Annexure shall be substituted, namely: - “Annexure IX (see para E of rule 115B) SAFETY CHECKS FOR USE OF CNG / BIO-CNG/LNG FUELS IN INTERNAL COMBUSTION ENGINED VEHICLES (AS PER AIS-028) and INDIAN GAS CYLINDER RULES (as amended from time to time) Sr. No. CNG / BIO- CNG/LNG Kit Component Certifying /Verifying Authority Clause of AIS-028 / Other Rules and Standards 1 CNG / BIO- CNG/LNG Cylinder* PESO, Nagpur to certify or endorse in case of foreign make Gas cylinder rules 2004 or International standards as endorsed by PESO

10.2 Joints and connections* Testing by test agency.

IS: 15720 12 Specific LNG components
(a) Following specific components, as applicable shall meet requirements of ECE R 110 or other International standards
(b) Electronic Control Unit, Pressure and/or temperature sensor (if not part of LNG cylinder) ECE R 110 or equivalent standard 13 Safety check for installation of CNG / BIO-CNG/LNG system Safety checks to be carried out by test agency as per AIS-028.
Relevant clauses of AIS-028 * Certificate issued by accredited testing agency of the country of origin or a report issued by internationally accredited test laboratory may also be accepted.
Note 1 -Only the standards, as amended from time to time, as mentioned above, shall be referred for compliance.
Note 2 -LNG system Components downstream of Vaporiser or heat exchanger shall be considered as CNG components.
Note 3 - Test agency to conduct applicable CMVR test as applicable with commercial available LNG fuel.”;
(iv) after Annexure IV- L, the following Annexure shall be inserted, namely: - “Annexure IV-LA (see the proviso to sub-rule (3) of rule 115B) TECHNICAL SPECIFICATIONS OF THE REFERENCE LNG FUEL Sr. No Component Concentration
