2. Definitiu~u.-In these rulos, unless the context othcrwisc requires.-

(a) Y b c Act," nienns thc Narcotic Drugs and Psychotropic Substances Act, 1985 (61 of 1985);

(b) "Appellate Authority" means any authority to whom an a p p a l may lie under any provision of t h ~ s e rules;

( c ) "CZlomcaI Exarninur" means the Che4cal Examiner, Ciovemment Opium and Alkaloid W&S, Ntamuch or, as thc cnsc may k, Ghazipur;

(il) "Chicf Cunirollcr of Factirrios" means the Chief Controller of Oovern~ncnt Opium and Alkaloid Factories;

(e) "crop p a r " mean% the p~riDd beginning on and from the I ~t October of nny ycar to the 30th Septemhcr of the f ~ l l o w i n ~ ycnr;

( f ) "General Managor" mcans the General Manager, aovornmant Opium nnd Alkaloid Works, ~ c e r n u i h or, a3 the case may he, Ghazipur;

(g) "Issuing authority" mcans the Narcotic l'ommis<iuner or any othtr weer who mny k authorisad in thiq llehalf bv 1110 Ccntrnl Uvvornrncnt for issuing a licence undcr C h ~ p t c r V of thew rules or issuing an import cariiflcatc or cxpurt authorisntion under Chapter V1 of thcsv rules in respect of narcotic d n ~ e s or piychotrop~c suh~tances;

(h) "licence" mcans n liccncc ~ssued under theso rulen;

( i ) "Propcr Officer'', In relation to any function tu be porforrnod under the% rules. means thc officer of Narcotics Dapartmcnt who IS *signed thusc functions by the Narcotics Cornmissinnor;

( k ) words and erprassinns used herein awl not detincd, hut dofinc;l in the Act shall have the me,lnings tespcctivcly as5igqcd to them in the Act.

CHAFTER I T 1 OPIUM POPPY CULTIVATION AND PRODUCTION OF OPIUM AND POPPY STRAW

5. Opium poppy cultivation and production of opium or poppy straw.-Tho opium poppy for production of ,opium or poppy atraw shall not be cultivnted save on account of the IC'enLrnl Government nnd in the tracts notified by it from mime to timo and in accordance with the conditions of a : h m t issued by the District Opium Officer under rule 8.

6. Fee for Grant of Lic0ncc.-The licence for cultivation of opium poppy may be granted by the District Opium m c e r on payment of a fao of rupees five.

7. Form of Licence for cultivation of the piu urn poppy.- The licence for cultivation of opium poppy for the ppxluction of opium or poppy straw shall be issued in Form No. 1 appended to these rules.

8 . lssue of licence.-Subject to the general conditions relating to grant of licenccs notified by the Ccntral Govemrnent, tho District Opium officer may issue liccnce to any person for a crop year for cultivation of thc opium poppy for production of opium or poppy straw on receipt of an application made by that person in Form No. 2 appended to thew rules.

9. Licence to specify the m a , stc.-The licence for cultivation of opium poppy issued under rule 8 shall speciPy tho area and designate the plots to be cultivated with opium PPPY,

Designating of Lambardarn--The District Opium Omcar may designate one of tha cultivatorq of opiumlpoppy as LambRrdar in each village whore opium poppy cultivation i~ permitted, who shall perform such functions and on such terms and conditions ns may be specifled from tima to time by tho Narcotics Commissioner.

1 I . Withholding or cancellation of Licance.41) An m c o r highcr in rank than the District Opium m c a r may, for sufficient reasons to he recorded in writing, withhold or cancel a licence already issued.

- (2) No order shall be p a w d under sub-rule (1) unlc~s the cultivator has been given a reasonable oppartunity of showing cause against the said order or ia heard in person, if he so desires.

(3) Where opium poppy has been cultivated under a licence which is sub~equently withheld or cancelled, the standing crop, if any, shall be destroyed under the supervision of the propar officer in such manner as may bo specifiad by tho Narcotics Commissioner.

12. Procedure with regard to meagurement of land cultivated with opium poppy.- (1) All plots of land cultivated with opium poppy in accordance with the licence issued under thesc rules, shall be measured in metres by tho proper officcr in the presence of the cultivator co~~cerned and the Eambardnr of the village and the concerncd cultivator and the Lambardnr or the village shall attest the entries made in the records to be ~nnintnined by the Lambardnr, as may be spccificd by the Narcotics Commissioner in this bahalf, under their sianzture/lhumb impression with diAte, in tokon of having wtisfiad them~elves regarding the correctness of tho mensuren~enl.

(2) The measurement conducted by the proper officer shbll be subject to such further checks by such nfficcrs as may be spcdiflcd by the Narcotics Commissiontr in this behalf.

(7) Tho variations between the qunntity of opium Produced by the cultivator indicated in the Lanlba~dar's record and as found by the propel officer during his check, shall be Inquired into by the proper oflicer in ~ r d e r to ascertain the liability of thecultivator for punishment under scclion 19 of the Act.

14. Delivery of opiun~ produced.-All opium. the produced of landcultivated with opium poppy, shall be delivered by the cultivators to the District Opium Omccr or any other ~ c e r d u l y authorfwd in this behalf. ay the Narcotics Comrnissioner at R place as may be specified by such ofAcer:

15.' Opium-to be weighed, examined and classified.- A11 opium delivered by the cultivators to the District Opium Officer or any other officer authorised as aforesaid, shall, in the prosence of thcconccrncd cultivator or an) person uuthcriwd by him and the Lambardar of the village, be weighed.

16. Procedure where cultivator is dissatisfied withclassificarion of opium.-Any cultivator who may be dissatisfied with the ~l~ssificat ' ion of his opium dono oy the oficer r e f c r d to in rule 15 may have it fowardcd by such vficor to the Government Opium Factory stparatcly, after having it properly sealed i n his presencc and in thc presence Of the concerned Lnn~bardar.

17. Procedure for sending opium suspected to adu1torated.-When opium delivered by a cultivator to the District Opium w c e r or any other omcer authorised in this behalf, is suspected of being adulterated with any foreign substance, it shall bc forwarded to the Government Opium Factory separately, after it is properly sealcd in the Presence of the cultivator and the concerncd Lambardar.

18. Drawing of s a r n p l ~ ~ from opium sent to Government Opium Factory undcr rulc 16 or rulc 17.-The sealed opium received separately in accordance ~ i i h rule 16 or rule 17, aihall be'ownod and sample drawn theroof in the ptescnce of the cultivator, if he so desires, to whom, a notice intimating tho date and time fq this behalf, shall be sent well in advance.

(1) The manufacture of manufactured drugs notified under sub-clausc (b) of clausa (xi) of szction 2 of the Act (heraaftar raferred to as the drug) is prohibited snve undcr and in accordnnco with the conditions of a liccnce granted by thc Narcotics Commissioner or such other oHcer as may bo authorisad by the Central Ciovernment in this bahalf, in Form No. 3 apponded to thcva rules.

49. Apptnl.-(l) The licanscc may file an appeal against tho docidon or order made or passod under rule 48 to-

(ii) tho Board, in any othcr cam; within 30 days from the dale of communication to him of such docision or grder.

55. Application for Import Cortiflcnte.-(I) No narcotic drug, or ps~chotropic substance specificd in Schodulc 11, shall bc importcd into lndia without an import certificate in respect of the consignn~enl issued by tho issuing authority, in Form No. 4 appended to these rules.

(2) The importer applying for an import certificalo undar sub-rule (1) in relation to narcotic drug shall submit along with his application the original or certilicd copy of the exciso prmi t issuod by thc concerned Slato Government.

(3) The application for the import certiticatc shall stat0 such details us nmy bo specificd by the Narcotics Commissioner.

56. Issuc of Import Ccrtiflcatc.41) Thc issuing autllority shall propare suveil copios of tha import ccrtiflcatc reforred to in sub-rule (1) of rulo 55 and deal with thorn in the manner hereunder provided. namely:-

(a) (i) original and duplicate copics should l ~ c supp]iu& to tho importcr who should transmit tho original copy to the exporting country and shall produce the duplicate copy at the Customs House, Land Customs Station or Airpsrt where thc consignment arrives or, in the case of imports by parcel post. at the post office of cl.clivery, in order to obtain c'.cliv~ry of the consignment of nzrcotic drugs or psychotrophic substances.

(ii) The C )lle:tar of Customs or P ~ s t M ~s te r sh,tll state on the copy presented by the imy3rter that the nxcotic drugs or the psychotropic substances have acturllly been imported and return the docl~ment to the impdrter who bh911 indicate on it that he bas received the goods.

(iii) The importer shall return the duplicate copy of the impxt certificate in~orporating the endorsement from the Collector of Customs or Pdst Master a n i his own en t+,resment to the issuinz authority--(l) where the import certificate rclntes to narcotic drug, through the excise auth~rities of the State from which the excise permit for purposes of subrule (2) of r d e 55 was produced; (:) where the impart certificate relates to pjychn~tropic substance, through the Drugs Contrcller of the concerned State.

(b) Triplicate copy shmld be supplicd to the Collector of Customs concerned who shall return it to the issuing authority alcng with the copy of the export authorisation to be received at the time cf receipt of the consignment from the Government of the exp3r t ix country, with a n endorsement as to the actual qumtity c f narcotic drug or psychotropic substance cleared.

(c) Qurldruplicate copy of the import certificate in relation to nnrcotic drug should be supplied to the =xcise authorities of the State into which the nlrcotic drug is to be imparted, and the said copy of thecertificate in rclation to psychotropic substance should be supplied to Drugs Corrtrnller of the concerned State for comparison with the copy produced before them, by the importer under subclause (a) of this sub-rule.

(d.) Quintuplicate copy should be supplied to the Government of the exporting country for comparison with the copy furnished to them by the importer under sub-clause (a) of this sub-rule.

(e) Sextuplicate copy should be supplied to the Drugs Controller, Government of India.

jf) Se~tuplicate COPY should be retained by the issuing authority in his office.

(2) An import certificate issued uncter sub-rule (1) of rule 55 mzy allow the importation of the qumtity of the concerned drug or the substance in more than o r e collsignmerit.

57. Transit.-Subject to the provisions of sstic.n 79 of the Act and rule 53, r.o coilsignment of any nlrcotic drug, o r psyehlstropic substances specified i r Schedule 11, shall be nllol~ed to bc transited through India unless such consign- 'meat is acconlpnnied by a valid export authorisation in this be&lf, issued by the Goverlment of the exporting country:

( I ) The exp~r te r applying for an export authorisation under sub-rule (I) shall submit,-

(a) where the expxt authorisation re l~ tes to narcotic drug, alongwith his application the original o r an authenticated copy of the excise permit issued by the concerned State Government; and

(b) the i m p ~ r t certificlte in origin& issucd by the Government of the impxting country certifying the oflicial approval of the concerned Government.

(3) N3twithstanding anything contained in sub-rules

(1) and ('1 the psychqtrapic substances specified in Schedule I11 mzy be expxted out of I d a after the exporter files the origins1 and duplicate copies cf the declaration in Form No.

6 with the Nircctics Co~tn~issioner who shdl transmit the duplicate copy of the d.eclaration to the concerned authority of the importing coulltry requesting that authority to certify on the duplicate copy of the declaration thnt the actual quantity of psych?tropic substance has been duly importea and return the mid COPY; the triplicate copy of the declaration sh?uld be sent, alongwith the consignment of said substances by the %porter to the imparting country and the quadruplicate copy thereof mxy be retained by him.

(4) The application for the export authorisation shal stzte such details as m%y be specified. by the Narcotics Commissioner.
