MlI'USTRY OF FINANCE (Department of Revenue) NOTLFICATION New Dellu, the 4th Febmary, 2004 G.S.R. 95(E).-In exercise of tbe powers conferred by Section 9, read with Section 76 of the Narcotic Drugs and Psvchotroplc Substances Act, 1985 (61 of 19851, tbe Central Government hereby makes tbe following rules further to amcnd - t l ~ c Narcotic Drugs and Psychotropic Substances Rules, 1985, namely - 1 (1) These rules may be called tbe Narcotic Drugs and Psychotropic Substances (Amendment) Rules, 2004.
(2) They shall come into force on tbe date of their publication in the Offiaal Gaztte.

(a) mrule31,-
(i) for sub-rules (1) and (I), the following sub-rules shall be substituted, namely :- "( 1) The sale of opium to tbe State Governments or manufacturing chemists or tbe person or entity who has been granted licence under sub-rnle (2A) of rule 36, as the case may be, shall be only from the Government Opium Factories, located at Neemuch and Ghazipnr .";
( 2 ) Thc sale ofopiumfromthe GovemmentCpiumFaaory at Neemuchand Ghazipw to manufacturing chemists a the person or entity who has been granted licenceunder sub-rule (2A) of rule 36, as the case may be, shall be only under a permit gmnted by or under the orders of the State Government within whosejurisdiction tbe chemist or the person or entity resides or has his place of business in the fonns prescribed by that Government;"
01) In sub-rule (31, lnclause (a), for the words"G0vemment OprumPxtoory, G h p u r " tbe words, "Government Oprum Factones, at Neemuch and Ghmpw" shall be sub&tuted.

(b) in rule 36, after sub-rule (Z), the follom~ng sub-rule shall be inserted, namely :- "(2A) Notwithstanding anylhing contained in sub-rule (2), the Narcotics Commissioner or such other officer as rnay be authorized by the Central Government may, on and from the commencement of the Narcotic Drugs and Pvchotropic Substances (Amendment) Rules, 2004 grant a 1icenceinFomNo. 3 appendcd to these rules on such terms and conditions as may be specified in the licence to any person or entity for inanufachm of morphine, codeine, dionine, thebaine, dihydrdeinone, dihydrocodeine, acetyldihydrorodeine, acetyldihydrdinone, dihydromorphine, dihydromorphinone, dihydrohydroxycudeinone, pholcodine and their respeclrve salts";
(c) in rule 37, in sub-rule (21, for the words, "under this rule", the words, brackets, figures and letter b d e r this rule or sub-rule (2A) of rule 36", shall be substihlted;
(d) in rule 38, for the words and figures, "under rule 37", the words and figures "under rule 36 or rule 37". shall be substituted;
(e) in 39, in the opening portion, for the words and figures "under rule 3 7 , the words and figures "under rhe 36 or rule 37", shall be substituted;
(0 intheForm No. 3;
(i) for the brackets, words and ligurcs, "(See rule 37)", the brackets, words and figures, "(See rules 36 and 37)" shall bc substituted;
(ii) nnder the heading "Conditions of Licence" occurring in serial No. 6, for the word "firm'', wherever they ocnu, the words, "the person or the entity" shall be substihlted.
