Section 17: Punishment for failure to comply order

Notwithstanding anything contained in the section 15,-

(1) whoever, including public servant, refuses or fails to comply with any written order or direction of the Road Safety Commissioner or Joint Road 33-10 GUJARAT GOVERNMENT GAZETTE, EX. 03-10-2017 [PART IV Safety Commissioner, or any other officer under section 22 shall be punishable with imprisonment for a tenn of three months or with fine which may extend to five thousand rupees or with both.

(2) in the case of a continuing offence, a fine of one thousand rupees shall be imposed for each day for which the offence continues.

(3) a Judicial Magistrate of First Class shall try an offence punishable under this Ordinance.
