Section 28

The Gujarat Scheduled castes Development Corporation Act,1985State Act of Gujarat · Act 10 of 1985

(1) The State Government may, by notification published in the Official Gazette, make rules to carry out all or any of the purposes of this Act.

Power to State Government to make rules.

(2) In particular and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely:-

(a) the terms and conditions of service of the directors and the fees and allowances payable to them;.

(b) functions, in addition to those specified in sub-section (2) of section 16, to be discharged by the Corporation and the conditions and restrictions subject to which those functions shall be discharged;

(c) the form and manner in which accounts shall be maintained and the balance-sheet and income and expenditure accounts shall be prepared;

(d) the form in which certificate shall be issued by the managing director, the period within which and the authority before whom an appeal shall be filed, and the procedure to be followed by the appellate authority under section 22;

(e) any other matter which is required to be, or may be, prescribed.

(3) All rules made under this section shall be laid for not less than thirty days before the State Legislature as soon as may be after they are made and shall be subject to rescission by the State Legislature or to such modifications as the State Legislature may make during the session in which they are so laid or the session immediately following.

(4) Any rescission or modification so made by the State Legislature shall be published in the Official Gazette and shall thereupon, take effect.
