LABOUR DEPARTMENT The 24th August, 2006 No. 14/17/93-2 Sub -section (2) of Section 18 and further read with Section 13 of the Child Labour (Prohibition and Regulation) Act, 1986 (61 of 1986) and with reference to Haryana Government, Labour Department, Notification No. 14/17/93-6 Lab., dated the 23rd May, 2000, the Governor of Haryana hereby makes the following rules regulating the health and safety of children employed or permitted to work in any establishment or class of establishments and grant of certificate of age, namely :-
1. (1) These rules may be called the.Haryana Child Labour (Prohibition and Regulation) Rules, 2006.
(2) They shall come into force on the date of their publication in the Official Gazette.
Definitions, 2. (1) In these rules, unless the context otherwise requires,- - (a) "Act" means the Child Labour (Prohibition and Regulation) Act, 1986 (Act 61 of 1986);

Certificate of age Section 18(2)(c).
(b) "dangerous part of a machinery" means any part of machinery from which in the ordinary course of its working, danger may reasonably be anticipated, even if such danger would arise from negligence or sOme outside source;
(c) "Form" means a form appended to these rules;
(d) "Inspector" means any person appointed as Inspector under Section 17 of the Act;
(e) "register" means the register required to be maintained under Section 11 of the Act;
(f) "section" means a section of the Act; and -
(g) "Schedule" means the Schedule appended to the Act.
- - (2) Words and e..pression used in these rules but not defined shall have the same meaning as respectively assigned to them in the Act.
3. (1) Every occupier of an establishment shall maintain a register in respect of children employed or permitted to work in Form A.
(2) The register s-hall be maintained on a yearly basis but shall be retained by the employer for a period of three years after the date of the last entry made therein.
4. (1) All children in employment or S ! i n g employment in any of the occupation as setforth in Part A of the Schedule or in any workshop wherein any ' processes is setforth in Part B of the - Schedule, young person is carried on shall produce a certificate of age ""rn the appropriate medical authority wherever required to do so by an Inspector.
(2) The certificate of age referred to in sub -rule (l) shall be issued in Form .
- (3) The charges payable to the medical authority for the issue of such certificate shall be Rs. 161- (sixteen rupees only). -

(4) The charges payable to the medical authority shall be borne by the employer of the child whos age is under question.
the purpose of this rule, the "medical authority" shall be a Government medical doctor not below the rank of in -charge Civil Hospital/Primary Health Centre or a regular doctor of equivalent rank employed in Employees State Insurance dispensaries or hospitals.
5. (1) The total number of working hours for a child labour employed about the business of an establishment inclusive of intervals for means and rest, shall not exceed thirty hours in any one week or five hours in any one day.
(2) A child labour shall not be employed continuously for more than three hours without an interval of at least one hour for meals or rest.

6. Health Section 13(2).
(i) kept clean and free from accumulation of dirt and refuse;
(ii) kept sufficiently lighted during all working hours;
(iii) properly ventilated so as to permit sufficient air and light into the premises;.
(iv) white -washed and varnished at least once in a year and a notice indicating the date of last white washing and varnishing shall be exhibited on the premises;
(iv) suitable arrangements of potable drinking water, latrine/urinals,washing places and spittoons be made.
7., (1) Every dangerous part of a machinery in an establishment shall be securely fenced by Safety safeguards of substantial construction which shall be kept in position while these parts of the machinery 13(2)(c).
so fenced are in motion or in use. The description and fencing of these dangerous parts of a machinery shall be in accordance with the provisions of Section 21 of the Factories Act, 1948 (Act 63 of 1948) and rules made thereunder.
(2) In every establishment, where manufacturing is carried on with the aid of electric power,.
suitable devices of cutting off power in emergencies from running, machinery shall be provided and maintained.
(3) No employee shall be allowed or made to work near the moving machinery or belt with loose fitting clothes and the tight fitting clothes for the purpose will be provided by the employer.
(4) The employer shall provide suitable goggles for the protection of eyes of the employees
(a) risk of injury to the eyes from the particles or framents thrown off in the course of process; and
(b) risk of the eyes by reasons of exposure to excessive light.

(6) All floors, steps stairs, passages and gangways shall be of sound construction and properly maintained.
(7) Maximum weight of material, article, tool or appliance to be lifted by male child shall be 16 kilogram and 13 kilogram for the female child.
8. (1) Every establishment shall be provided with adeqaute case of fire means of escape in the case of fire.
(2) In every establishment, the doors affording access to any room shall not be locked or facetted so that they can be easily and immediately opened from inside while any person is within the room.
(3) In every establishment, buckets filled with water, sand, chemical fire extinguishers shall be provided in suitable number and at suitable site. according to the nature of work carried on and the size of the premises.
(4) No buildings, stairway, ramp, platform or other structure and plant/machinery shall be maintained in such a manner as to cause risk of bodily injury to any worker.
9. The occupier shall arrange in every establishment, first aid kept readily and easily available at the rate of one kit for every 25 children allowed to work therein. Each kit shall contain an adequate supply of dressing material, antiseptic liquid or ointment, aspirin and paracitamol tablets of 250 or 500 mg., oral rehydration salts and any other appropriate medical supplies.

(b) ' uire an occupier to furnish information as he may consider necessary;
(c) enquire any person found near the establishment and where he has reasonable cause to believe is, child employed therein;
(d) call for inspection of any register, documents or anything for the purpose of securing the health and safety of a child allowed to be employed in any occupation or any process;
(e) take, on the spot or otherwise, the statement of any person for the purpose of ascertaining whether the provisions ot ths Act are being or have been complied with;
exercise such other powers as fr..cy be necessary for carrying out the purpose of the Act and rules; and
(f)
(g) for the purpose aforesaid, the Inspector shall have the. same powers as are vested in civil court under the Code of Civil Procedure, 1908 (V of 1908), in respect of production of documents.
