HARYANA STATE AGRICULTURAL MARKETING BOARD, PANCHKULA NOTIFICATION Dated: 25 January, 2023 No. HSAMB/ME-I-A-4-2023/ 963—0 - In exercise of the powers conferred by Rule 29(1) of the Haryana Agricultural Produce Markets (General) Rules, 1962 and all other powers enabling it in this behalf, the Haryana State Agricultural Marketing Board hereby levy lump-sum fee on a licensee who has obtained license for processing under this Act and bought or brought cotton seed in the notified market area for further processing at the rate of Rs.42000/ per expeller per year on standard operating procedure giver below :- 15 All licensees who have obtained license for processing under this Act and desirous to process agricultural produce as specified in Part II of the Schedule shall submit an application/ declaration to the Secretary of the concerned Market Committee every year in attached performa and shall deposit the lump-sum fee after its approval.
2. The Secretary, Market Committee shall verify the contents of the application, after physically examining the unit and record his decision in writing.
3 The lump-sum fee shall be calculated for the year/quarter, as the case may be, on the basis of number of expellers and the rate fixed by the Board.
4. The licensee shall deposit the fee so calculated in advance for the financial year.
58 The record of lump-sum fee shall be maintained by the concerned Market Committee.
6. Where a licensee intended to increase the number of expellers in the processing unit, he shall intimate the Secretary, Market Committee seven days prior to such change.
7. The Secretary Market Committee shall after making such verification in the next seven days and on being satisfied about the correctness of the intimation shall order to deposit the respective lump-sum fee and to update the record maintained by the Market Committee.
8 (a) The lumpsum fee on agricultural produce shall be deposited for each financial year or quarter (s) including the fee of the quarter in which application has been submitted.
(b) The application/declaration for depositing the lump-sum fee for the next financial year shall be made by 31st March every year.
(¢) Provided that 30 days period of grace will be allowed for submitting the application i.. till 30th April.
(d) The Secretary Market Committee shall accept the declaration made within 30 days after the date of expiry of grace period alongwith penalty equal to the 20% of due lump-sum to be deposited on agricultural produce.
(¢) In case, a fresh application is received in any month of a quarter, the full fee shall be payable for that quarter including lump-sum for the ¥ remaining financial year.
(f) For the current financial year, the self certified application shall be submitted by 31.01.2023 alongwith relevant lump-sum fee. The market fee already deposited by the applicant during financial year 2022-23, shall be adjustable. Only difference of the fee shall be payable in such cases. However, no refund shall be allowed in any case.
9. The Secretary Market Committee shall provide the details of all such licensee to the concerned D.M.E.O. as well as Head Office within 15 days of the acceptance of application/ declaration.
10. In case, any licensee is found to having installed expellers more than declared by him shall, in addition to the due lump-sum fee shall be liable to pay penalty equal to the amount of due lump-sum fee.
11. In case any cotton seed processing unit purchases sales/processes any agricultural produce without a license in a notified market area, the Secretary of concerned Market Committee shall take further action as per Bye— law 11(6) of the Market Committees Bye—laws.
12. The processing unit shall not be treated as closed unless intimation in writing is made to the concerned Market Committee in advance.
13. The Secretary Market Committee will ensure that no cotton seed processing unit is left without depositing the due lump-sum fee.
