GAZ., FEB. 9, 2021 (MAGH. 20, 1942 SAKA) 99 [Authorised English Translation] HARYANA GOVERNMENT POWER DEPARTMENT Notification The 9th February, 2021 No. S.O. 5 /C.A. 36/2003/S. 180/2021.— In exercise of the powers conferred by Sub- section (1) and clause (o) of Sub- section (2) of Section 180 of the Electricity Act, 2003 (Central Act 36 of 2003) and in supersession of Punjab Government, Irrigation and Power Department, notification No. S.O. 133-4EL-62/22977, dated the 17th September, 1962 in its application to the State of Haryana and all other notifications issued in this regard, the Governor of Haryana hereby makes the following rules for regulating the terms and conditions for the grant of electrical contractor licence, certificate of competency and wireman permit to carry out the purpose of regulation 29 of the Central Electricity Authority (Measures relating to Safety and Electric Supply) Regulations, 2010, namely :–
1. (1) These rules may be called the Haryana Electrical Contractor Licence, Certificate of Competency and Wireman Permit Rules, 2021.
(2) It shall come into force on the date of its publication in the Official Gazette.
(3) It shall be applicable to the whole of the State of Haryana. Short title, commencement and applicability.
2. (1) In these rules unless the context otherwise requires,-
(a) ―Act‖ means the Electricity Act, 2003 (Central Act 36 of 2003);
(b) ―Annexure‖ means Annexure appended to these rules;
(c) ―Appellate Authority‖ means, Additional Chief Secretary or Principal Secretary to Government, Haryana, Power Department;
(d) ―certificate‖ means certificate of competency granted for supervision of erection and installation of all type of electrical installation work of various voltage level;
(e) ―Competent Authority‖ means the Chief Electrical Inspector , Haryana;
(f) ―Form‖ means form appended to these rules;
(g) ―Government‖ means the Government of the State of Haryana in the Administrative Department;
(h) ―institution‖ means; -
(i) any institution established by law in force in the State of Haryana; or
(ii) any other institution recognised by the Government for the purpose of these rule;
(i) ―licence‖ means ‗A‘ Class Electrical Contractor Licence granted to carry out erection and installation of all type of electrical installation work of various voltage level;
(j) ―permit‖ means wireman permit granted for doing the actual wiring work for licensed Electrical Contractor;
(k) ―recognised university‖ means,-
(i) any university incorporated by law in India; or
(ii) any other university which is declared by the Government to be a recognised university, for the purpose of these rules;
(l) ―regulations‖ means the Central Electricity Authority (Measures relating to Safety and Electric Supply) Regulations, 2010;
(m) ―Schedule‖ means Schedule appended to these rules;
(2) Words and expressions used herein but not defined in these rules shall have the same meanings respectively assigned to them in the Electricity Act, 2003 (Central Act 36 of 2003), and the Central Electricity Authority (Measures relating to Safety and Electric Supply) Regulations, 2010. Definitions. 100 HARYANA GOVT. GAZ., FEB. 9, 2021 (MAGH. 20, 1942 SAKA) Constitution of screening committee.
3. The Competent Authority shall constitute the screening committee consisting of the following members to ascertain the qualification, experience and knowledge in respect of concerned field,-
(i) Executive Engineer; and
(ii) Superintendent. Eligibility and academic qualifications for certificate.
4. No person shall be eligible to obtain the certificate unless he possesses the following academic qualification and eligibility, namely:-
(a) degree in Electrical Engineering or Electrical and Electronics Engineering from an institution or Board or university approved by All India Council for Technical Education or University Grants Commission having at least one year experience after passing degree, in the field of erection, operation, maintenance of electrical installation under ‗A‘ Class Licensed Electrical Contractor or in the Central Government or the State Government or the Semi Government Department or Organisation; or diploma in Electrical Engineering or Electrical and Electronics Engineering from an institution or Board or university approved by All India Council for Technical Education or University Grants Commission having at least five years experience after passing diploma in the field of erection, operation, maintenance of electrical installation under ‗A‘ Class Licensed Electrical Contractor or in the Central Government or the State Government or the Semi Government Department or Organisation;
(b) he shall not be less than eighteen years or more than sixty-five years of age on the date of submission of application to the Competent Authority:
Provided that he shall produce the medical fitness certificate in Annexure I issued by the Government or Government approved hospital on attaining the age of fifty-five years; and
(c) he shall be a citizen of India. Eligibility and academic qualifications for permit.
5. No person shall be eligible to obtain the permit unless he possesses the following academic qualification and eligibility, namely:-
(a) diploma in Electrical Engineering or Electrical and Electronics Engineering from an institution or Board and have practical training under ‗A‘ Class Licensed Electrical Contractor or in the Central Government or State Government or Semi Government Department/Organisation for one year in the electrical wiring and other installation work; or certificate or diploma in the trade of Wireman, Lineman and Electrician from recognised industrial Training institute and have National Apprenticeship Certificate under Apprenticeship Act, 1961 (Central Act 52 of 1961) and have practical training under ‗A‘ Class Licensed Electrical Contractor or in the Central Government or the State Government or the Semi Government Department or Organisation for three years (including period spent in Apprenticeship) in the electrical wiring and other installation work;
(b) he shall not be less than eighteen years or more than sixty-five years of age on the date of submission of application to the Competent Authority:
Provided that he shall produce the medical fitness certificate in Annexure I issued by the Government or Government approved hospital on attaining the age of fifty–five years; and
(c) he shall be a citizen of India. Application for certificate or permit.
6. (1) An applicant shall make an application online to the Competent Authority to obtain the certificate or permit in Form I along with self certified photocopies of required documents and such fees as specified in the Schedule. HARYANA GOVT. GAZ., FEB. 9, 2021 (MAGH. 20, 1942 SAKA) 101
(2) On receipt of an application made under sub-rule (1), the Competent Authority shall send the same to the screening committee to certify the genuineness of the application. The screening committee shall certify the genuineness of the application and thereafter issue a notice to the applicant to produce the original documents in person, at such place and on such date as specified in the notice. After certifying the original documents, the screening committee shall submit the application to the Competent Authority along with its recommendation.
(3) After receiving the recommendation of the screening committee and subject to fulfillment of all relevant conditions, the Competent Authority shall issue the certificate or permit, as the case may be, in Form II or III to the applicant. The applicant shall download the same from the official website:
Provided that the Competent Authority shall have the powers to reject the application, if any discrepancy is noticed in the application and/ or the supporting documents at any point of time during application process and communicate the same to applicant accordingly within seven days.
7. Every certificate or permit granted under these rules shall be issued initially for a period of one year and remain valid for a period not exceeding five years :
Provided that holder of the certificate or permit shall not be allowed to do any electrical work during its cancel period. Validity of the certificate and permit.
8. (1) Any person, who has been granted a certificate or permit under these rules, may apply online to the Competent Authority for renewal of the certificate or permit in Form IV along with required documents and such fees as specified in the Schedule, within a period of one month before the expiry of the validity of the certificate or permit:
Provided that after the expiry of the said period for renewal, the Competent Authority shall entertain the application for renewal of such certificate or permit along with such late fees as specified in the Schedule:
Provided further that no certificate or permit shall be renewed after expiry the period of five years.
(2) On receipt of an application made under sub-rule (1), the Competent Authority shall send the same to the screening committee to certify the genuineness of the application. The screening committee shall certify the genuineness of the application and shall submit the application to the Competent Authority along with its recommendation.
(3) After receiving the recommendation of the screening committee and subject to fulfillment of all relevant conditions, the Competent Authority shall issue the renewal of certificate or permit, as the case may be, in Form V or VI to the applicant. The applicant shall download the same from the official website:
Provided that the Competent Authority shall have the powers to reject the application, if any discrepancy is noticed in the application and/ or the supporting documents at any point of time, during application process and communicate the same to the applicant accordingly within seven days. Renewal of certificate and permit.
9. The Competent Authority shall have the powers to order the suspension for such period, as it may think fit, or withdrawal of any certificate or permit issued to any person, if in its opinion, the holder thereof does not perform his duties and comply with the provisions of the Act and Rules and regulations made thereunder or has been guilty of any other mal-practice:
Provided that Competent Authority shall not pass any order of suspension or withdrawal of the certificate or permit without giving an opportunity being heard to the applicant. Suspension or withdrawal of certificate and permit.
10. The Competent Authority shall have powers to upgrade the competency of any certificate issued to any person by ascertaining his qualifications and experience. However, no further up-gradation shall be made till one year or unless sufficient experience acquired in the relevant field of operation and maintenance. He shall submit relevant documents as mentioned in Form VII and such fee as specified in the Schedule. However, authorisation above 33 KV level shall only be granted to the holder of certificate, who possesses degree in Electrical Engineering or Electrical and Electronics Engineering from a university or institution. A certificate already granted on the basis of examination, shall be upgraded in view of experience required i.e. on completion of five years to diploma holder, on completion of ten years to ITI certificate holder and on completion of fifteen years to others. Up-gradation of level of certificate. 102 HARYANA GOVT. GAZ., FEB. 9, 2021 (MAGH. 20, 1942 SAKA) Transfer of certificate or permit.
11. Any person holding a certificate or permit granted by any other State shall be allowed to work as Electrical Supervisor or Wireman in the State of Haryana as mandatory staff with ‗A‘ Class Licensed Electrical Contractor on getting his certificate or Permit endorsed (subject to fulfill the qualifications and experience criteria as mentioned in rule 4 and 5), on payment of requisite fees as specified in the Schedule. Eligibility, Qualified Staff and criteria for licence.
12. No person shall be eligible to obtain a license unless he fulfills the following conditions and criteria, namely :–
(a) he shall be a citizen of India;
(b) he shall not be less than eighteen years or more than sixty-five years of age, on the date of submission of application to the Competent Authority;
(c) he should have a registered office in the State of Haryana, for which GST registration for State of Haryana shall be produced;
(d) he should have adequate drawing facility for preparation of drawings (in case of above 650 volt) and library facilities as per Annexure II;
(e) he shall employ solely for the purpose of contract works the minimum following qualified staff on full time basis and their consent and declaration in the form Annexure-III should be attached and shall be present in person along with his mandatory staff;
(i) LT—one Electrical Supervisor holding a certificate issued by the Competent Authority and one wireman/supervisor shall be employed;
(ii) HT—one Electrical Supervisor holding a certificate issued by the Competent Authority for respective voltage level for which contractor licence is applied for and two wiremen or supervisors shall be employed;
(iii) EHT—two Electrical Supervisors, holding a certificate issued by the Competent Authority out of which one should be for respective voltage level for which contractor licence is applied for and three supervisors or wiremen shall be employed:
Provided that holder of certificate or permit or wireman, working as mandatory staff with licensed ‗A‘ Class Electrical Contractor shall have to give one month notice to the firm or company or contractor before leaving the job or ‗No objection Certificate‘ in this regard, shall have to produce in the office of the issuing authority.
Note.— Production units or manufacturing concerns shall segregate the staff employed for the purpose of contractor licence from the staff engaged for routine operations of the factories. The staff employed under the procedure of licensing and under regulation 3 and 5 of the Central Electricity Authority (Measures relating to Safety and Electric Supply) Regulations, 2010 shall not on any account be mixed up. Failure to keep separate staff for the purpose of the procedure of licensing and the above said regulations shall be deemed to constitute violation of the rules and shall be rendered the licence liable for cancellation.
(f) electrical instruments for various level of voltage as per Annexure–IV are to be procured and they shall be ISI marked or equivalent quality and test certificates along with invoice to be furnished at the time of testing of the instruments and the instruments shall be duly tested by Government approved National Accreditation Board for Testing and Calibration Laboratories (NABL) accredited lab. The electrical equipments shall also be duly tested by Government approved National Accreditation Board for Testing and Calibration Laboratories (NABL) accredited laboratory on each renewal of license. (g) he shall submit the application along with Income Tax Return and Turn Over/Balance Sheet for the last three years. The eligibility for issue of license for various categories shall be as under :–
(i) Upto MV (650 Volts) minimum Rs. 20 lac turnover in one year during last three years;
(ii) Upto HV minimum rupees 50 lac turnover in one year during last three years;
(iii) Upto EHV minimum rupees One core turnover in one year during last three years.
(h) he shall have to produce the following other documents expect as mentioned above:–
(i) Undertaking in respect of the Firm/Company on the prescribed format as per Annexure–V.
(ii) Residence Proof i.e. Aadhaar Card/Voter Card.
(iii) Pan Number.
(iv) Authorisation as Authorised Signatory in case of Partnership Firm/Company.
(v) Memorandum/Deed along with resolution in case of Company/ Partnership Firm.
13. (1) An applicant shall make an application online to the Competent Authority to obtain licence to carry out erection and installation of all type of electrical installation work of low tension, medium pressure up to 650 volts on the conditions as specified in Annexure VI and Form VIII along with self certified photocopies of required document and such fees as specified in the Schedule:
Provided that the holder of the said licence shall also submit an undertaking that he shall comply with provision of Labour Laws.
(2) On receipt of an application made under sub-rule (1), the Competent Authority shall send the same to the screening committee to certify the genuineness of the application. The screening committee shall certify the genuineness of the application and thereafter issue a notice to the applicant to produce the original document in person, at such place and on such date, as specified in the notice. After certifying the original documents, the screening committee shall submit the application to the Competent Authority along with its recommendation.
(3) After receiving the recommendation of the screening committee and subject to fulfillment of all relevant conditions, the Competent Authority shall issue a license in Form IX to the applicant. The applicant shall download the same from the official website:
Provided that the Competent Authority shall have the powers to reject the application, if any discrepancy is noticed in the application and/ or the supporting documents at any point of time during application process and communicate the same to applicant accordingly within seven days. Application for licence
14. Every licence granted under these rules shall be issued initially for a period of one year and remain valid for a period not exceeding five years:
Provided that licensed Electrical Contractor shall not be allowed to carry out erection and installation of all type of electrical installation work during its cancel period or in the event of cancellation of mandatory staff and licence shall be liable cancellation for such period till renewal thereof. Validity for licence.
15. (1) Any person, who has been granted licence under these rules, may apply online to the Competent Authority for renewal of license in Form X along with required documents and such fees as specified in the Schedule, within a period of one month before the expiry of the validity of the licence:
Provided that after expiry of the said period for renewal, the Competent Authority shall entertain the application for renewal of such licence along with such late fees as specified in the Schedule:

(2) On receipt of an application made under sub-rule (1), the Competent Authority shall send the same to the screening committee to certify the genuineness of the application. The screening committee shall certify the genuineness of the application and shall submit the application to the Competent Authority along with its recommendation.
(3) After receiving the recommendation of the screening committee and subject to fulfillment of all relevant conditions, the Competent Authority shall issue the renewal of licence in Form XI to the applicant. The applicant shall download the same from the official website:
Provided that the Competent Authority shall have the powers to reject the application, if any discrepancy is noticed in the application and/ or the supporting documents at any point of time during application process and communicate the same to the applicant accordingly within seven days. Suspension or withdrawal of licence
16. The Competent Authority shall have the powers to order the suspension for such period, as it may think fit, or withdrawal of any licence to any person, if in its opinion, the holder thereof does not perform his duties and comply with the provisions of the Act and Rules and Regulations made thereunder or has been guilty of any other mal-practice:
Provided that Competent Authority shall not pass any order of suspension or withdrawal of licence without giving an opportunity being heard to the applicant. Up-gradation of voltage level
17. The Competent Authority shall have power to upgrade any ‗A‘ Class Electrical Contractor Licence for carrying out works on higher voltage level by ascertaining qualifications and experience as specified in these rules of the applicant as well as his supervisor/wireman in the relevant field. However, no further up-gradation shall be made till one year or unless sufficient experience acquired in the relevant period. The applicant make an application online to the Competent Authority in Form XII along with required documents and such fees as specified in the Schedule subject to fulfil the terms and conditions as specified in rule 12. Transfer of licence. 18. (1) Any person holding a licence granted by any other State Government shall be allowed to be transferred the same in the State of Haryana subject to conditions that such person shall fulfill all requirement for grant of licence for executing the works awarded by the Government. The applicant shall apply online to the Competent Authority along with requisite documents and such fees as specified in the Schedule.
(2) Any person can be allowed temporarily for a maximum period of six months to carry out/complete the work allotted in the State of Haryana subject to condition that such person should have valid electrical contractor license, issued by any State:
Provided that such person shall make an application online to the Competent Authority in Form VIII alongwith self certified photocopies of electrical contractor license as well as mandatory staff and deposited treasury challan of requisite fees as specified in the Schedule. Appeal. 19. Any person aggrieved by the order passed by the Competent Authority may file an appeal before the appellate authority, within sixty days from the date of order of the Competent Authority along with requisite documents. Change in the licence.
20. Any holder of the license, who desires to change the name or address of the business premises or shop or in constitution of the firm or company, shall submit a fresh application online to the Competent Authority along with relevant documents and such fees as specified in the Schedule. Turnkey Contractor Licence.
21. The Competent Authority may grant higher voltage level Electrical Contractor Licence directly to a firm or company having Turnkey Work awarded by the Government:
Provided that such firm or company has possessed the same level Electrical Contractor Licence of any other State:
Provided further that licence may be granted to a firm or company out of term, provided that such firm or company has valid turnkey work awarded by the Government and pending to be executed. However, it shall fulfill all requisite terms and conditions for grant of licence as specified in the Act, Rules and regulations made thereunder. HARYANA GOVT. 22. (1) If any certificate or permit or licence, as the case may be, is destroy or lost or deface or mutilate or damage, the applicant shall make an application online to the Competent Authority in Form XIII along with required document and such fees as specified in the Schedule.
(2) On receipt of the application made under sub–rule (1), the Competent Authority, after certify the genuineness of the document and identity of the applicant, shall issue the duplicate certificate or permit or licence, as the case may be, as soon as possible for the remaining period. The applicant shall download the same from the official web site. Grant of duplicate certificate, permit or licence.
23. There shall be thirty days timeline after receiving the complete documents to clear the services in all respect under these rules. Time limit for services.
24. (1) Any order made or action taken under the Punjab Government, Irrigation and Power Department, notification No. S.O. 133-4EL-62/22977, dated the 17th September, 1962 in its application to the State of Haryana, and all other notifications issued in this regard so superseded shall be deemed to have been made or taken under the corresponding provisions of these rules.
(2) Any certificate or permit or licence issued by the Competent Authority prior to publication of these rules shall remain valid till the expiry of such period. Further, the applicant shall be eligible for renewal of his certificate or permit or licence, as the case may be, under these rules. Saving. 106 HARYANA GOVT. 1. This licence authorized the electrical contractor to whom it is granted to carry out electrical installation work of low tension/medium pressure/high tension/extra high tension works, as restricted in the licence, within the State of Haryana. a. Where the electrical contractor conducts his business from one or more than one branch established in a single Tehsil/District, he may employ one or more electrical supervisors and be in possession of one or more sets of instruments on the strength of which the license is granted to him under intimation to the Competent Authority. b. Where an electrical contractor employing only one supervisor and possessing only one set of instruments conducts his business from one or more than one branch established in a single tehsil be may not undertake electrical installation work in another tehsil unless:– i. he employee an additional supervisor for the work such other tehsil and is in possession of an additional set of instruments, or ii. he suspends all work in the tehsil in which his business is normally conducted while the work at such other tehsil is in progress.
2. The electrical contractor shall keep the instruments in working order.
3. The electrical contractor shall at all time offer all reasonable facilities to the Electrical Inspector to Government, Haryana or his representative for examining and testing any or all the instruments in his possession.
4. The electrical contractor shall inform in writing to the Competent Authority for the purpose of regulation 29 of the Central Electricity Authority (Measures relating to Safety and Electric Supply), Regulations, 2010, the name/names and certificate no./nos. of the supervisor/supervisors employed by him. The contractor shall also inform to the Competent Authority when a supervisor in his service leaves his service.
5. Completion Test Report—After the completion of an electrical installation work to which regulation 29 of the Central Electricity Authority (Measures relating to Safety and Electric Supply), Regulations, 2010 applies, a test report shall be submitted by the licensed electrical contractor to the electricity supply undertaking concerned. The test report shall be signed by the supervisor under whose supervision the work has been carried out, and countersigned by the licensed electrical contractor.
6. If the electrical contractor is adjudged by the Competent Authority to the guilty of misconduct, carelessness or any mal-practice, the Competent Authority may suspend or cancel his licence.
7. The Competent Authority may, if the contractor commits a breach of any of the terms and conditions of this licence, or for any other sufficient cause, suspend or cancel this licence.
8. The Competent Authority may, if the contractor or commits a breach of any of the terms and conditions of this license, or for any other sufficient cause, suspend or cancel this licence either on its own motion or on the recommendation of Screening Committee constituted for the purpose.
9. If in the opinion of the Competent Authority prima facie case of misconduct and or gross violation of the Central Electricity Authority (Measures relating to Safety and Electric Supply), Regulations, 2010 exists against a contractor, the Competent Authority may suspend the licence of such contractor.
10. The licence shall be renewable periodically and if it is not renewed on due date, it shall be automatically cancelled and the full initial fee/late fee, if any will be chargeable for issue of a new licence. However, the firm/contractor shall submit the details of works executed annually. Moreover, if the licence remains cancelled for more than three years, the applicant shall apply a fresh application.
11. If the holder or all of the holders of a Certificate of Competency on the strength of whose Certificate/Certificates this licence has been granted, leaves/leave the service of the Contractor or Certificate of Competency/Wireman permit could not be renewed, the contractor‘s licence shall be deemed to have been suspended, and it shall remain suspended until such time as the contractor again employs a person holding a Certificate of Competency or renewal thereof. 12. If this licence has been granted to the contractor on the strength of a Certificate of Competency held by him in his own name, the licence shall stand automatically cancelled in the event of the contractor accepting employment under any other electrical contractor.
13. Supervisor shall not be employed in a part time, nor shall they be in the employed of more than one contractor at same time.
14. Notice of commencement of work—Notice of electric installation work including additions, alterations, repairs and adjustments to existing installations except such replacement of lamps, fans, fuses, switches and other component parts of the installations as in no way alters its capacity or character shall be given in writing by a licensed electrical contractor to the Competent Authority within 48 hours of the commencement of such work and simultaneously the supplier local office informed of it.
15. Staff of Contractors:- a. All the Wireman of the Electrical Contractor shall consist of bonafide and whole-time Wireman, holding ‗A‘ Class permit granted by the Competent Authority provided that a contractor may appoint apprentices for training purposes in which case the total number of apprentices employed by any contractor at any time shall not exceed 50 percent of his total wiring staff inclusive of apprentices, but exclusive of coolies. Provided further, that the Contractor shall not permit such apprentices to carry out any electrical installation work including additions, alterations, repairs and adjustment to existing installations as repairs and adjustment to existing Installation covered under regulation 29 of the Central Electricity Authority (Measures relating to Safety and Electric Supply), Regulations, 2010, except under the direct supervision of a person holding a Certificate of Competency, and under the guidance of at least one certified Wireman on the premises. b. Every contractor shall maintain a register, the Register of Supervisors, Wireman and apprentices employed by him in ‗Form-E‘ and daily attendance shall be maintained, which shall be got checked from the Competent Authority. The record of monthly wages, paid to the employees shall also be maintained. The register shall be open to inspection at any time by the Electrical Inspector or his representative. No person whose name is not entered in such register, shall be a bonafide employee on the contractor wiring staff. c. Every contractor shall submit an undertaking that relevant provisions of the Labour Act shall be complied with. 16. Installation work to comply with the code of Practice—The electrical installation work and fittings in building shall comply with the ―code of practice for electrical work and fittings in building‖ issued by the ―Indian Standard Institute in the year 1958—Indian Standards Specification No. 732-1958‖. 134 HARYANA GOVT. 1. Fees—Fees on the scale prescribed below shall be charged for issuing of certificates of competency to Supervisors, permits to wiremen and the licences to electrical contractors:– a.
