1. (l) These regulatiorrs tnay be called the Haryana Housing Board (Recruitrnent and Conditioms of Service of t[)f{iqers and lDmployees) Regulations,2fi}6.
(2) They shall come into force on the date of their publication in thr: Olficial Gazette.
(3) Ihey shal't be,applicable to atl thc officers and employees of the':Iousing Board, Haryana.
?. (l ) In these regulatiuns, unless the r:ontext otherwi-qe requires :-
(a) "Act" rneans the Haryana }lousing lJoard Act, lgTL QAof 1971);
ft) "Board" me.ans the Housrnl; Board , Haryana;
ic) "direct recruitrnent" means an appointment made otherwise than by promotion from u,ithin the Serv:ice or by hansfer or deputation of an olfici.al already in the service of the Government of India or any State Government or a.ny of its Boarcis/ Corporations/local a uthori ties ;
(d) "Governmsnt" meanfi the Heryana Government in the Administrative Departmettt;
(e) "Servifie" fl1eans the Haryana Housing Board (Recruitment and Conditions r;f Servicc of Officers arrd Employees) Service;
(D "recogrrised university" means any universify incorporated by law in India or any other university which is declared by Government of India as such for the purpor;e of thesil rult:s.
(?") Words ancl expressiolls u,sed in these regulations but not defined., shilll have the sanrre meaning .ls respectively assigned in the Act.
3. The Service shlll comprise th,e posls shown in Appendix A to these:regr.llations :
Provided that th.e Board rnay make additions to, or reductionp in ther number of such [rosts or to create new posts with different designations and sc,ales of pay, either permanently or tenrporarily, with ine previous sanction of the state Government.
4. (l) No person shall be appointed to any post in the Service unless he is a citizen of Indira.
(2) No person shall be appoin'led to any post in the Service by direct n*ruitment unless he produces..
(a) a certificate of charac:ter. frcrm the academic institution last attended and a. similar certificate from trvr: other responsible persons not being his relatives, who are well acquainted with the person in his private life and are not connected with the acaderrric institution abovel and Short title, commencement and application.

(b) a meclical certificate of'fitness as required under rule 3.1 of the Punjab Civil Services Rules, Volume I, Part I.
Ag". 5. The lower age limit for appointment by direct recruitment to any post in the Service shall not be less than eighteen years. The upper age limit shall be such as may be fix.ed by. the State Government for its own recruitments from time to time.
Eligibility for 6. No person shall be appointed to any post in the Service unless he fulfils the minimum appointment' eligibility.conditions as laid down in column 3 of Appendix B to these regulations in case of direct recruitment, or as laid down in column 4 of Appendix B in case of appointments other than by direct recruitments :
Provided that in the case of direct recruitment against vacancies meant for Scheduled Castes, Backward Classes, Ex-servicemen or Physically Handicapped categories.
. experience may be relaxed at the sole discretion of the appointing authority in case candidates are not available to filt up the vacancies reserved for them, after recording reasons for the same.
Disqualification s. 7. No person shall be eligible for appointment to any post in the Service,
(a) who has entered into or contracted a marriage with a person having a spouse living;
or
(b) rvho having a spouse living, has entered into or contracted a marriage with any other person; or
(c) who has been dismissed from service of the Government of India or any State Government or local authority or corporate body or Board.
Appciinting 8. Appointments to various posts in the Service shall be rnade by the authority indicated in authority column 9 of Appendix A to these regulations.
Mode of 9. (l) The mode of recruitment to various posts in the Service shall be as specified in column recruitment T of Appendix A to these regulations :
Provided that the number of appointees by any particular mode of recruitment to that post at any point of time shall not fall below that perc€ntage of the total number of that post, wherever indicated in column 7 itsdf.
(2) Promotions, unless and otherwise provided, shatl be made on merit-cum-seniority basis and seniority alone shall not confer any right to such promotions.
Probation. 10. (1) Persons appointed to any post in the Service shall remain on probation for a period-of two yea.rs, if appointed by direct recruitment; and one year, if appointed by promotion or transfer' The period as mentioned below may also be counted towards the period of probation at the discretion of the appointing authoriry,-
(a) any period spent after such appoinfment on deputation on a corresponding or a . higher post; or
(b) any period of work in equivalent or higtrer rank, prior to the appointment in the Service, in the case of an appointrnent by transfer; or
(c) any period spent on officiating appointment, but no person who has so offi,;iated . shall, on the completion of the prescribed period of probation, be entitled to be confirmed, unless he is appointed against a permanent vacancy.

(a) if such person is appointed by direct recruitment, dispense with his services; and
(b) if such person is appointed otherwise than by direct recruitment, either revert him to his former post or deal with him in such other manner as the terms and conditions of the previous appointment permit.
(3) On the completion of period of probaiion cif a person, the appointing authority may-
(a), .i,f the work or colduct has, in its opinion, been satisfactory :- ' (i) confirm such person from the date of his appointrnent, if appointed against a perrnanent vacancy; or
(ii) confirm such person from the date on which a permanent vacancy occurd , if
(iii) declare that the person has completed his probation satisfactorily if there is no permanent vacancy;

(d) in the case of members appointed by transfbr from different cadres, their seniority shall be determined according to their pay, preference being given to a member who was drawing higher scale of pay in the previous appointrnent; and if the scale of pay are also thr: .*gme, then by the length of continuous service on the earlier post, and if the lengh of such continuous service is also the same, the older member shall rank senior to the younger member.
12. The members of the Service shall be liable to s€r!'e at any place, whether within or outside the State of Haryana, on being ordered so to do by the competent authority.
13. In respect of pay, leave and all other matters not expressly provided for in these regulations, the member of the Service shall ordinarily be goverrred by the corresponding rules of the State Government.
14. (1) Unless expressly provided for in these regulations, the Haryana Civil Servrces (Punishment and Appeal) Rules, 1987, shall ordinarily apply to the members of the Service mutatis mutandis.
(2) The competent authority tcr impose any of the major or minor penalties as specified in the Haryana Civil Services (Punishment and Appeal) Rules, 1987, shall ordinarily be the appointing authority. Further, the controlling authority if below the appointing authority, shall be competent to impose any of the minor penalties as prescribed in the Haryana Civil Services (Punishment and Appeal) Rules, 1987, as per delegation in column 10 of Appendix A io these regulations.
(3) Appeals against any such order of penalty imposed upon a member of the Service shall lie to the authority as prescribed in section 72 A of the Act.
15. Every member of the Service shall get himsell'vaccinated as and when the Board so directs by a speciai or general order.
16. Every member of the Service shall be require.d to take the oath of allegiance to the Constitution of India as by law established.
1?. Notwithstanding anything contained in these regulations, the appointing authority may impose special tetms and conditions in the order of appointment if it is deemed expedient to do so.
18. Nothing contained in these regulations shall affect reservations and other concessions required to be provided for Scheduled Castes, Backward Classes, Ex-Servicemen, Physically Handicapped persons or any other class or category of persons in accor4ance with the orders issued by the State Government in this regard from time to time :
Provided that the total percentage of reservations so made shall not exceed fifty percent at any time.
19. Where the State Government is of the opinion that it is necessary or expedient to do so, it may, for reasons to be recorded in writing, nela-x any of the provisions of these regulations with respect to any class or category of persons.
20. If any doubt arises at any time as to tfte regulations or their application, notwithstanding anything contained in these regulations, the matter will be refened to Government whose decision shall be final.
. 21: Any provision contrary contained in any other regulations regarding any establishment matter of members of the Service and which vyas in force immediately before the commencement of these regulations shall stand repealed forthwith.
