4. (2) These rules may be called the Haryana Fisheries Rules, 1996 Q) They shall apply to wafers specified in the Schedu le.

4. (1) Onor afier the first day of Julyeach year,the © auctioning . authority, shall put to public auction, the right of: fishing in any water specified inthe Schedule of portion of such. waters. (2) In case the ‘highest bid at the time of auctionis not of a Pisher~ men Go-operative Socicty registercd under (he lawrelating to the registration of Co-operative socictic¢for the time being infor ce, the auctioning authority shall not accept that bid unless the samc is at least 10% more thanthe highest bid of the Fisher mn Co-opcrative Socicty ;

Provided that in case the highest bid is belowthe average of the contract amount received during the prevous thtec years the auctioning authority may not accept the highest bid or the bid, of the _-Bishermen Co-9 per ative Society, asthe case may be, in which case the fishing tights will be re-auctioncd. , , :

(3) The amount of earrest moncy depasited by the unsucessful bidders would be returned to.tkcm as soon as bid has been accepted. ‘In - the case of the succesful bidder theamount- of earnest monoy may be returned after the issuc of the licence. . ™ \ -

(4) The auctioning authdiity may cancel the auction if the bid offered lis not reasonable ; in such an cVent the fishing may be done depaitmentally or on loyalty basis.

5. (1) The persans whose bid has been accepted shall pay | the amount offercd by him for fithing in full at the time of auction o1 shall’ pay ore third of auction amount at ihe time of auction and the remaining ‘amount within 30 days from tkedate of the auclion.In case of failure to deposit {he remaining 2/3rd amount bythe bidder within the stipulated | peticd of 30 days, the 1/3rd amount deposited: by the bidder at the time of auction shall be forficitcd.’ In ‘case where the bid amountis lessthan ten thousand rupccs, the whole: emount shall have'to be paid at the time of auction. aS oS as °

(4) After depositirg the total bid amount asrequircd by, sub-1ule

Section 3. Conditicns of licence.

Section 3, 838 HARYANA GOVT GAZ., JUNE 18, 1996: (JYST. 28, 1918 SAKA) —— bid, re-auction the fishing 1ights and also debar such a bidder from bidding for three years. ,

6. Alicence granted under tule 5 shall, unless sooner determined, remain in force fromthe Ist Septembar, or fromthe date of its issucy whichever is later, uptothe 3lst August following.

7. (2) The licence ot his agents or nominces shall not | fish except. with rod and line and hand lire durirgthe close seasonfrom Ist July to 31st August.

(2) The licencee shall fish eil her’ personally or through suchof his agents or nomirces as are provided with permits in Borm C signed by the ea) Fisheries Development Officer concerned. _

(3) The licencee shall not either personally ot thtough his agents or nominees fish in any water Clos:d for fishing under the 1ules made under section 6 of the Indian Fishetics Act, 1897.

(4) The licencce ot his agents ot nominees shall not use for. fishing . any kind of gear except those mentioned below ;— a

(i) Nets of all kinds not having at any portion a mesh bir measuring - Iess , than.4 cm. from knot to kiot of (16 cm. © “all..- - around. ; ‘

(ii) Long line with hooks.“

(iii). Rod and line.

(iv) Hand line :

Provided that no gear except’ 10d and line ‘shall be uscd in the waters within adistance.cf 200 me'ersoneither sides of bridges and | head works.

(5) The licencee 61 his agents o1 nominees shall not elect .or cause to be crected any fixed engires («xcept in the case of stake nets when they aretemporcgily fixed in waters fot use in conjunction with drag nets), dams or weirs for catching fish nor shall be use or allow his agents _ or nominees tho use of the poison, electric current, lime, dynamite or ‘any other noxious or explosive substances in catching ‘fish.

(6) The licencee shall be bound to show. his licence on demand. to any person who is empowered under section, 6 of the Punjab . Fisheries Act, 1914, to arrest. without warrant: / ‘ / ; .

(7) The licencee or his agent or nominees shall not catch or expose. for sale or barter, fish of any of the following species below the length: ; of 30 cm :-—

(i) Robu “Gj Mrigal

(iv) Mahaseer

(v) Silver Carp

(vi) Grass Carp

(vii) Common Carp.

(8) The liceneee shall not transfer hissights and liabilitics under the licence without the previous sanction in writing of the Director.

(9) The licencee shall maintain a peimit register specifying the names and addresses of the persons in whose favour. permits have been issued for fishing within the area. covered by his licence.

(10) The Jicencee shall maintain a daily register showing :—

(i) Weight. of fish caught, purchased and sold ;

(ii) the gear employed. for catching the fish ; oe eae ? (iii) the varities ;

(iv) location of fishing centres :

(v) wholesale and retail prices of different species of fish.

(11) The licencee shall send a monthly statement regarding items mentioned in sub-rule(10) tothe Fisheries Development Officer con-. cerned bythe Sth of cach month following. that to Which jt relates failing which alatefee of Rs. 10 per day will be charged for a period of ten days and will be recovered from-the security deposit. If the statement is not submitted by him during the aforesaid period his licence may ‘be cancelled.

(12) The licencee shall not charge any commission for the. sale of any fish” which is given by the Fisheries Department on its behalf. _(13) Every licencee and every agent or nominees of a licencee shall be ‘bound toreport to the Tehsildar or the Deputy _ Commissioner having jurisdiction within the area of the Fisheries Officer concerned any iofringement of the rules that comes to his notice. .8 (d) The licencee anal) not be entitled to’ claim ‘any damage or compensation from the Go ernment for any loss that may be suffered by him, dueto floods, pollution, slump i in prices, litigation or any other cause whatsoever.

(2) The licencee shall not be entitled toclaim any damages for loss which may occur to him inthe event of any action taken against him by any official/officer. of the Fisheries Department for breach of any provision of these rules or of any term of his licence.

9. Section 3.

10. All apparatus erected or used by the licencee for fishing in contravention of any provision of these rules may be seized by any person empowered under section 6 of the Punjab Fisheries Act, 1914, to arrest Without warrant for offences under the said Act. Any fish caught by the licencee by any such apparatus shall also be liable to be seized and forfcitcd by the person empowercd as aforesaid and fish so forfeited shall be auctioned as early as possible by the persons who forfeited the same.

11. (J) If the licencee or-his agent or nomince commits a breach of any provision of these rules or any term of his licence, the licencing authority may Without prejudice 1o any other action that may be taken by him under these rules or apy provision of law, ‘cancel his licence, In suchan event, the fishing rights shall be put to 1e-auction and the auction together with loss, if any, occurred to the Government. due to Te-auction. . . a

(2) In the event -of cancellation of the licence under sub-rule (J), the permits issued under sub-rule (2) of rule 7 shall be deemed to have been cancelled. :

(3) In the event of cancellation of the licence under , sub-rule (J) and permit under. sub-rule (2), the licencee or the; permitholder, as the case may, shall not be ‘entitled to the refund of any amount paid ‘by him to the Government towards contract; amount or by way of losa or damages whatSoever which may occur; to him.

12.- (J) Notwithstanding the provisions of the . foregoing rules, the licensing. authority. may, on an _ application submitted to him in this behalf; grant to the applicant a ‘licence for -sport only in Fea) on the conditions specified therein for fishing with rod and ine. PRT eS Late :

(2) If the licence referred to in sub-rule (J) is issued" for. fishing in - any of the waters already auctioned, the licencee who had obtained the licence through auction shall not be entitled to claim any compensation or damages on account of the issue of licence-for the purpose of sport. . 13. Ifa licence issued under these rules is lost, mutilated or destroyed, the licensing authority may, on receipt of an application in this behalf, issue a duplicate licence to the licencee on Payment of a fee of rupees two only.

14. Nothing in these rules shall debar any official or officer of the Fisheries Department or any person empowered or authorised by. Director from catching fish of any size of any specics at any time of ‘the year by any method for the purpose of research or development. The li¢ence shall not be entitled to claim any damage or compensation on this account. ,

15. The Punjab Fisheries —_ 1966, in its application. to the State of Haryana hereby repealed :

The parties do hereby agree as under :-— 1, The Government hereby. grants to the licencee a licence to . catch fish in the public. waters specified in the Schedule appended to this deed, on the terms and conditions, contained in this instrument. “Nothing in this licence shall authorise the licencee or his ‘agent or nominees to fish in any water closed to fishing under the rules made. under section 6 of the Indian Fisheries, Act, 1897. : 2: The licence hereby ahiiited is valid for the period from— to but. no fishing except with rod _and line shall be allowed during Bere from ‘Ist: July to 31st Anat of the year. 6. The licencee or his agents or nominee shall not uso. any gear except the following kinds of gears for the purpose of fishing :

(1) Nets of all kinds not having at any portion mesh bar measur- .ing less than 4.cm. from knot toknot or 16 cm. all round, ‘

(3) Rod and line.

(4) Hand line. ~ No gear except rod and line shall be used in the water within to a’ , distance of two hundred meters on aither side of bridges and head works falling within the Haryana State.

7. The licencee or hisagents or nominees shall report to the Director or any of the officers of the Fisheries ‘Department .of — the Government any breach of the rules framed under the Punjab Fisheries Act, 1914 that c ome to his or their notico, —

8. The licencee or his agents or nominees shall not erect any fixed engines, dam or wires for catching fish or use poison, line, dynamite. orany other noxious or explosive substance in catching fish. He may however erect fixed engines as in case of Stake nets when they are temporarily fixed in waters for use in conju. ction with drag net.

9. The liceadee or his agents or -nominees shall not ‘catch or sell , any fish less than the size of the species mentioned below :

14. The licencee shall maintain a register, specifying the name and addresses of the petSonsto whom permits, have been issued: for fishing withinthe ‘watcis issued to him, A list of such permit holders shall be submitted by the licencec to the Director.

15. The licencee shall maintain a regitlat register showing weight of fish caught, putchasco and sold, Andicating different Vatieties of fish so obtained,the ways and means adopted for catching fish and types of nets used and the area and place fiom wherc, the fish has been | caught. ,

16. The vatious registers maintained by the licencee shall be opéned to inspeCtion bythe Director and such othe: officers and servants cfthe Government asthe Directo) may authorise inthis behalf, at all reasonaable time. :

17. .The licencee shall submit cach montb tothe Director a repott regarding the wholesale and retail prices of differcnt varicties of fish caught : and sold~ duiing the preceeding month: alongwiththeir respective weight . 4 - 18. (a) The licencee has been granted under the, tuless ¢ fiamed under the Punjab Bishcrics Act, 1914 and is subject to the proVision: of the said rules and the Act. 2

(b) Inthe event of the cancellation of the ‘licence, of the. licencee under the provisions of the said rules and the Act, the amount already paid bythe licencce shall not be1efurded.to him, the1ight of fishing may be 1e-auctioned and the loss sustained by the Government if any, shall be recovered from thé licencee.

19. 20.
