namely:-
1. These rules may be called the Irrigation and Water Resources Department Haryana Junior Engineers and Additional Sub Divisional Engineers (Group-C) Service (Amendment) Rules, 2023.
2. In the Haryana Irrigation and Water Resources Department, Junior Engineers and Additional Sub Divisional Engineers (Group-C) Service (Amendment) Rules, 2014 (hereinafter called the said rules), in rule 2,-
(i) for clause (a), the following shall be substituted, namely:-
(a) “appointing authority” means the Engineer-In-Chief in the Haryana Irrigation and Water Resources Department;
(ii) clause (b) shall be omitted;
(iii) after clause (d), the following clause shall be inserted, namely:-
(da) “departmental examination” means the examination for the purpose of promotion by selection amongst the eligible employees of Group C or Group D to the post of Junior Engineer (Civil) or Junior Engineer (Mechanical) or Junior Engineer (Electrical) as the case may be;
(iv) after clause (g), following clauses shall be inserted, namely:-

(i) The Punjab Public Works Department (Irrigation Branch) Head Office, Clerical (States Service Class-Ш) Rules, 1965;
(ii) The Haryana Irrigation Department, Circle Clerical (Group –C) Service Rules. 1982;
(iii) The Haryana Irrigation Department Signalers (Group-C) Service Rules, 1985;
(iv) The Haryana Irrigation and Water Resources Department Revenue Establishment Service (Group C) Rules, 2019;
(v) The Haryana Irrigation Department, Circle Cadre, Workmen Establishment Group C Service Rules, 2011;
(vi) The Haryana Irrigation Department, Draftsman and Tracers Group C Service Rules, 1982;
(gb) “Group D employees” means the employee appointed on regular basis before the commencement of the Haryana Group ‘D’ Employees (Recruitment and Conditions of Service) Act, 2018 (5 of 2018) and governed by the following service rules, namely:-
(i) The Haryana Irrigation Department (Field) (Group-D) Service Rules, 1999;
(ii) The Haryana Irrigation Department (Head Office) (Group-D) Service Rules, 1999;
(iii) The Haryana Irrigation Department, Circle Cadre, Workmen Establishment (Group D) Service Rules, 2011;'.
3. In the said rules, for rule 6, the following rule shall be substituted, namely:- “6. Appointing Authority:- Appointment to the posts in the Service shall be made by the Engineer-in- Chief in Haryana Irrigation and Water Resources Department.”
4. In the said rules, for rule 9, the following rules shall be substituted, namely:- “9. Method of recruitment:-
(1) Recruitment to the Service shall be made, -
(i) in the case of Junior Engineers (Civil),---
(a) 85% by direct recruitment; and
(b) 10% promotion by selection from amongst Group ‘C’ employees; and
(c) 5% promotion by selection from amongst Group ‘D’ employees; or
(d) by transfer or deputation of an official already in the service of any State Government or Government of India;
(ii) in the case of Junior Engineers (Mechanical), ---
(a) 85% by direct recruitment; and
(b) 10% promotion by selection from amongst Group ‘C’ employees; and
(c) 5% promotion by selection from amongst Group ‘D’ employees; or
(d) by transfer or deputation of an official already in the service of any State Government or Government of India;
(iii) in the case of Junior Engineers (Electrical), ---
(a) 85% by direct recruitment; and
(b) 10% promotion by selection from amongst Group ‘C’ employees; and
(c) 5% promotion by selection from amongst Group ‘D’ employees; or
(d) by transfer or deputation of an official already in the service of any State Government or Government of India.
(2) (i) All the Junior Engineers (Civil or Mechanical or Electrical) appointed by direct recruitment or by promotion shall, required to undergo induction training for a period of three months in case of direct recruitment or one month in case of promotion before they are given independent charge.
(ii) All the Junior Engineers (Civil or Mechanical or Electrical) shall undergo refresher training for a period of not less than five days once in every five years.

(3) The promotion by selection from amongst eligible Group C and Group D employees shall be made on the basis of merit list of departmental examination.
(4) An employee of Group C or Group D who has not attained the age of fifty-four years as on the 1st January of the calendar year shall be eligible for appearing in departmental examination.
9A Departmental examination and procedure thereof.- (1) The departmental examination shall be conducted at least once in a calendar year by the Engineer-in-Chief as per the syllabus mentioned in appendices E or F or G, as the case may be, subject to availability of vacant posts out of the quota earmarked for Group C and/or Group D employees.
(2) Each member of Service has to obtain minimum 60% marks in the departmental examination failing which he has to re-appear for consideration against the post of Junior Engineer. The result of examination shall be declared merit-wise (i.e. on the basis of marks obtained) and separately for both Group C and D employees.
(3) If the number of members of Service of any particular Group qualifying the departmental examination is more than the number of available vacancies of that Group, the remaining employee(s) shall be selected/appointed on the basis of their merit against the vacancies arising in the same calendar year in which the examination has been conducted.”
5. In the said rules, for rule 11, the following rule shall be substituted, namely:- “11. Seniority: - Seniority, inter-se of the members of the Service shall be determined by the length of continuous service on any post in the Service:
Provided that where there are different cadres in the Service, the seniority shall be determined separately for each cadre:
Provided further that in the case of members appointed by direct recruitment, the order of merit determined by the Commission or any other recruiting authority, as the case may be, shall not be disturbed in fixing the seniority:
Provided further that in the case of two or more members appointed on the same date, their seniority shall be determined as follows:-
(a) a member appointed by direct recruitment shall be senior to a member appointed by promotion or by transfer;
(b) a member appointed by promotion shall be senior to a member appointed by transfer;
(c) in the case of members appointed by promotion or by transfer, seniority shall be determined according to the seniority of such members in the appointments from which they were promoted or transferred; and
(d) in the case of members appointed by transfer from different cadres, their seniority shall be determined according to pay, preference being given to a member, who was drawing a higher rate of pay in his previous appointment; and if the rates of pay drawn are also the same, then by the length of their service in the appointments, and if the length of such service is also the same, the older member shall be senior to the younger member:
Provided further that in the case of members of Group C and Group D promoted by selection after qualifying departmental examination in the same batch, the seniority shall be fixed as per merit in the result of departmental examination for promotion by selection of Group C and Group D employees separately and further as far as inter-se seniority among Group C and Group D employees(s) is concerned, employees promoted by selection through Group C shall be senior to those promoted by selection through Group D;
Provided further that in case if two or more employees are promoted by selection from the same Group and obtain equal number of marks in the same batch of examination, their seniority shall be determined on the basis of their length of service in the Group in which they were working at the time of appearing in departmental examination. If the length of service is also the same then their seniority shall be determined on the basis of age and the elder/eldest shall be regarded as senior.”
6. In the said rules, for rule 14, the following rule shall be substituted, namely:- “14. Discipline, penalties and appeals:-
(1) In matters relating to discipline, penalties and appeals, members of the Service shall be governed by the Haryana Civil Services (Punishment and Appeal) Rules, 2016, as amended from time to time:

Provided that the nature of penalties which may be imposed, the authority empowered to impose such penalties and appellate authority shall, subject to the provisions of any law or rules made under article 309 of the Constitution of India, be such as are specified in Appendix C to these rules”.
(2) The authority competent to pass an order under clause(c) or clause (d) or clause (f) of rule 9 of the Haryana Civil Service (Punishment and Appeal) Rules, 2016 and the appellate authority shall be such as specified in Appendix D to these rules.”’
