Medical Education Department Miscellaneous (Group B) Serv ice, namely :- -
PART 1 --GENERAL Short t i t le and commencement :
1 . (1) These rules may be ca l led the Haryana Medical Education Department Miscellaneous (Group B) Service Rules , 1999.,
(2) They sha l l come into force on the date of the ir publication in the Offic ial Ga ze t te . — Daini t ions :
2 . In these rule s , unless the context otherwise requires . - -
(a) "direct recruitment" means an appointment made otherwise than by promotion from within the ser vi ce or by transfer or 'deputation of an officer! offic ial already in the serv ice of the Government of India or any State Government ;
(b) "Director" means the Director, Pandit Bhagwat Days./ Sharma Postgraduate Institute of Medical Sciences , Rohtak ; r(c) "Government" means the Haryana Government in the Administrative Department ;
(d) "institution" means ,— ( i ) any institution es tabl is hed by law in force in the State of Haryana ; or HARYANA GOVT GAZ. (EXTRA.), JUNE 26, 1999 - 2417 (ASAR 5, 1921 SAKA)
(ii) any other institution recognised by the Government for the purpose of these rules ;
(e) "recognised university" means, -- any university incorporated by law in India ; or
(ii) in the case of degree, diploma, or certificate obtained as a result of an examination held before the 15th August, 1947, the Punjab, Sind or Dacca University ; or
(iii) any other university which is Government to be a recognised purpose of these rules ;
(f) "Selection Committee" means the constituted by the Government ; declared by the university for the selection committee
(g) "Service" means the Haryana Medical Miscellaneous (Group B) Service.
PART ID—RECRUITMENT TO SERVICE Education Number and Character of posts :
3. The Service shall comprise of the posts shown in Appendix. A to these rules :
Provided that nothing in these rules shall affect the inherent right of the Government to make additions to, or reductions in, the number of such posts or to create new posts with different designations and scale, of pay, either permanently or temporarily. Nationality, domicile and character of candidates appointed to Service :
4 . (1) No person shall be appointed to any post in the Service, unless he is, --
(a) a citisen of India ; or

(e) a per son of Indian or igin who ha s migr a ted from Pa kis t an , Burma, Sr i Lanka or any of the Eas t African Countr ies of Kenya, Uganda, the United Republic of Tanzania (for mer ly Tanganyika and Zanziba r ) , Zambia, Malawi Zaire and Ethiop ia with the intent ion of permanent ly se t t ling in India : Prov ided tha t a per son belonging to any of the ca tegor ies (b ) , (c ) , (d ) or (e ) shal l be a per son in whose favour a ce r t i f ic a t e of el igibi l i ty ha s been is sued by the Government . \
(2) A per son in whose ca se a cer t i f i c a t e of el igib i l i ty i s neces s a r y , may be admi t ted to an examination or inte rview conducted by the Select ion Committee, but the off er of appointment may be given only a f ter the neces sa ry el igib i l i ty ce r t i f ica t e has been is sued to him by the Government .
(3) No per son shal l be appoin ted to any pos t in the Se rv ic e by di rec t r ec r u i tment , unless he pr oduces a ce r t if ic a t e of cha ra c te r from the Princ ipal , Academic Off icer of the ,Univer s i t y , co l l ege, school or ins t i t u t ion la s t a t tended , if any, and s im i la r ce r t i f ica t e from two o ther responsib le pe rsons, not being hi s re l a t i ve s , who are well acqua inted with him in his pri va te l i fe and ar e unconnected wi th his unive r s i ty, col lege, school or ins t i t u t ion . 5. (b) any period of wOrk in equivalent or higher rank prior to appointment to any post in the Service may, in the case of an appointment by transfer, at the discretion of the appointing authority, he allowed to count towards the period of probation fixed under this rule ; and „(c) any period . of • officiating appointment shall be reckoned as period spent on probation, but no person who has so officiated shall, on the completion of the prescribed period of probation, be entitled to be confirmed, unless he is appointed against a permanent vacancy.
(2) If in the opinion of the appointing or conduct of a person duiing the period satisfactory, it may
(a) if such person is appointed by dispense with his Services ; and authority, the work of probation is not direct recruitment,
(b) if such person is appointed otherwise than by recruitment ,--
(i) revert him to his former post ; or direct
(ii) deal, with him in such other manner as the terms and conditions of the previous appointment permit. •
(3) On the completion of the period of probation of a person, the appoin t ing au thori ty ma y,
(a) if his work or conduct has, iii its opinion, been . satisfactory ,--
(i)
(ii) confirm such person from the dite of his appointment, if appointed aga ins t a p e rm a ne n t vacancy or confirm such person from the date from which a permanent vacancy occurs, if appointed against a temporary vacancy ; or declare that he has completed his probation satisfactorily, if there is no permanent vacancy ; or 2428 HARYANA GOVT GAZ. (b) if his work or conduct has, in its opinion, been not • satisfactory ;
(i) dispense - with his Services, if appointed by direct recruitment, if appointed otherwise, revert him to his former post or deal with him in such other - manner as the terms and conditions of his previous appointment permit ; or
(ii) extend his period of probation and thereafter kass such order, as it could have passed on the expiry of the first period of probation • 'Provided that the total period of probation including extension, if any, shall not exceed three years. Seniority :
11. Seniority, in t e r s e of the members of the Service shall be determined by the length of continuous service, on any. post in the service ;
Provided that where there are different cadres in the Service, the seniority shall be determined separately for each cadre : ,
Provided further that in the case of a nv:mber appointed by direct recruitment, the order of merit determined by the Government shall not be disturbed in fixing the seniority :
Provided further that in the case of two or more members appointed on the same date, their seniority shall be determined as follows :--
(a) a member appointed by direct recruitment shall be senior to a member appointed by proniotion or by transfer ;
(b) a member appointed by promotion shall be senior to a member appointed by 'transfer ;

(d) in the case of members appointed by transfer from different cadres , their seniority sha l l be determined according to pay, preference_ being given to a member, who was drawing a higher rate of pay in hi s previous . appointment and if the rates of pay drawn are also the same, then by length of their Service in the appointments and if the length of such Service i s also the same, the older member sha l l be senior to the younger member. Liabil ity to ser ve :
12. (1) A member of thei Service sha l l be liab le to serv e at any place, whether within or outside the State of Haryana, •on being ordered so to do by the appointing authority .
(2) A member of the Service may also be deputed to serve as under :-- ( i ) a company, an associat ion or a body of indiv iduals whether incorporated or not, vihich i s wholly or substantially owned or controlled by the State Government, a municipal corporation or a local authority or univers ity within the. State of Haryana t. ( i i ) the Central Government or a Company, an association or a body of indiv iduals , whether incorporated or not, which i s wholly or substantially owned or controlled by the Central Government' ; or ( i i i ) any other State Government, an international organization, an autonomous body - not controlled by . the Government or a private body :
Provided that no member of the Service sha l l be _deputed to serve the Central or any other State Government or any organization or body referred to it: c lauses ( i i ) , or ( i i i ) except with his consent. Pay, leave , pension and other matters : •
13. In res pect of pay , leave , pension and a l l other matters , not expres s ly provided •for in these rules , the members of the Service sha l l be governed by such rule s and reg datio ns as may have been, or may hereafter be adopted or made by the competent 2430 HARYANA GOVT GAZ. 14. (1) In the ma t t er s r ela t ing to disc ip l ine , pena l t i es - and ap pea ls , member s of the Serv ice sh al l be governed by the Haryana Civil Ser vic es (Punishment and Appeal) Rules , 1987, as- amended from time to time : Pr ovided - t ha t the na ture of pena l t i es which may be imposed , the aut hor i ty empowered to imp ose such pe nal t ie s and ap p el la t e author i ty shall , sub jec t to the pr ov is io ns of any law or ru le s made under art ic le 309 af the Const i tu t ion of India ; be such ' as ar e sp ec i f i ed in Appendix C to these ru l e s .
(2) T he aut hor i ty competent to pa s s an ord er under cla us e
(c) or c la u se (d ) of sub -rule (1) of ru le 9 of the Haryana Civi l Ser vices (Punishment and Appeal) Rules , 1987, and ap p el la t e author i ty shal l be as spe c if ied in Appendix D -to the se ru les . Vaccination :
