- 521 - [Published in the Haryana Government Gazette, Legislative Supplement, dated the 10th March, 1970] HARYANA GOVERNMENT FOREST AND ANIMAL HUSBANDRY DEPARTMENT Order The 5 th , March 1970 No. S.O.73/P.A. 2/1900/S.4/1970:- Whereas the Governor of Haryana is satisfied after due enquiry that the regulations, restrictions and prohibitions hereinafter contained are necessary for the purpose of giving effect to the provisions of the Punjab Land Preservation Act, 1900; (Act 2 of 1900) Now therefore, in exercise of the powers conferred by section 4 of the said Act, the Governor of Haryana hereby prohibits the following acts for a period of a 25 years with effect from the date of publication of this order in the official Gazette, in the area more particularly specified in the schedule annexed hereto, the said areas forming part of the village in Nuh, Tehsil of Gurgaon District Specified in the Scheduled annexed to Haryana Government, Forest , Department , notification No.9419 D, dated 30 th September , 1948.

(1) The clearing breaking up of the land not ordinary under cultivation prior to the publication of erstwhile Haryana Government, Forest Department ,notification No. 9419-D, dated 30 th September.

1948:-. provided that the breaking up the land for cultivation may be permitted by the Divisional Forest Officer Gurgaon, Division.

(2) the quarrying stone or the burning of lime at places where such stone or lime had not ordinary been so quarried or burnt prior to the publication of the said notification Except with the permission of the Collector of Gurgaon District who will consult the Divisional Forest Officer, Gurgaon Division, before according such permission;

(3) The cutting of trees or timber or the collection or removal or subjection to any manufacturing process, of any forest produce other than grass, save for the bonafied domestic domestic or agricultural purposes or right holders in the land; provided that owners of the land may sell trees or timber after first obtaining a permit to do so from the Divisional Forest Officer, Gurgaon Division. Such permit will prescribe such conditions for sale as may, from time to time, appear necessary in the interest of forest conservancy;

(4) The setting of fire of trees, timber or forests produce;

(5) The admission , herding, pasturing or retention of sheep, goats or camels;

Provided that in such areas where sickness necessitates the keeping of goats for milk, the Divisional Forest Officer, Gurgaon Division, may issue a permit at his discretion for the retention of a limited number of stall fed goats to be specified for a specified period.

PART III HARYANA GOVERNMENT FOREST AND ANIMAL HUSBANDRY DEPARTMENT ORDER The 5th March, 1970.

No. S.O. 75/P.A.2/1900/S.4/70.- Whereas the Governor of the Haryana is satisfied after due inquiry that the regulations, restrictions and prohibitions hereinafter contained are necessary for the purpose of giving effect to the provisions of the Punjab Land Preservation Act, 1900;

Now, therefore, in exercise of the power conferred by section 4 of the said Act, the Governor of the Haryana hereby prohibits the following Acts for a period of 25 years, with effect from the date of this order, in the areas specified in the schedule annexed here to the said area forming part of the village in Nuh Tehsil of Gurgaon District specified in the schedule annexed to erstwhile Punjab Government notification No. 9419-D, dated 30th, September, 1948:-

1. The clearing or breaking up of the land not ordinarily under cultivation prior to the publication of erstwhile Punjab Government notification No. 9419-D dated 30th, September , 1948 ; provided that the breaking up of land for cultivation may be permitted by the Divisional Forest Officer, Gurgaon Forest Division.

2. The quarrying of the stone or the burning lime at places where such stone or lime had not ordinarily been so quarried or burnt prior to the publication of the said notification , except with the permission of the Collector of Gurgaon District; who will consult the Divisional Forest Officer, Gurgaon Forest Division, before according such permission.

3. The cutting of tress or timber, or the collection or removal or subjection to any manufacturing process, of any forest produce other than grass , flowers, fruit and honey, save for the bona domestic or agricultural purpose of right –holders in the land ; provided that the owners of the land may sell trees or timber after first obtaining a permit to do so form the Divisional Forest Officer, Gurgaon Forest Division, such permit will prescribed such conditions for sale as may from time to time appear necessary in the interest of forest conservancy.

4. The setting on fire of trees, timber or forest produce.

5. The admission, herding, pasturing, retention of sheep, goats and camels; provided that in cases where sickness necessitates the keeping of goat for milk the Divisional Forest Officer, Gurgaon Forest Division; may issue a permit at his discretion for the retention of a limited; number of stall-fed goats to be specified for a specified period.

PART III HARYANA GOVERNMANT FOREST AND ANIMAL HUSBANDRY DEPARTMENT ORDER The 5th March, 1970 No. S.O. 76/P.A.2/1900/S.5/70.- Whereas certain areas mentioned in the schedule annexed hereto are comprised within the limits of the local areas notified under section 3 of the Punjab land preservation Act, 1900 with erstwhile Punjab Government Notification No.9419-D, dated the 30 th September , 1948, whereas in respect of the said areas the Governor of the Haryana is satisfied after due inquiry that the regulations , restrictions and prohibition hereinafter specified are necessary for the purpose of giving effect to the provisions of the said Act.

Now, therefore, in exercise of the power conferred by section 5 of the said Act, the Governor of the Haryana hereby I prohibits the following Acts for a period of 25 years, with effect from the date of this order, in those areas:-

1. The cutting of trees or timber or brush wood lopping of trees for any Purpose; provided that the Divisional Forest Officer, Gurgaon Forest Division, may permit:-

(a) The cutting of trees for house building and agricultural implements, and of dry wood for fuel for marriage by person shown in the settlement record as entitled to do so; and

(b) The lopping of branches for lac and the sale of chal-leaves to leather workers:

Provided further that for the cutting of dry wood for the death ceremonies by the person shown in the settlement record as entitled to do so, the permission of the Divisional Forest Officer shall not be required and that for this purpose a simple information to the Forest Guard concerned within a fortnight of felling shall do.

2. The collection of removal of grass for any purpose; provided that the Divisional Forest Officer, Gurgaon Forest Division, may permit:-

(a) The cutting or sale of ripe grass after the rainy season; and

(b) The cutting or sale of green grass during the rainy season from such portion of the notified in area which grass may have sufficiently established itself.

3. The pasturing of any cattle other than goat, sheep and camels:

Provided that in such area where the forest crop is well established and in cases of emergency such as abnormal drought of floods, the Divisional Forest Officer, Gurgaon Forest Division ,may throw open such area for grazing of the cattle of the land owners such conditions as may be appropriate in each case.

Provided further that for the cutting of dry wood for the death ceremonies by the persons shown in the settlement records as entitled to do so, the permission of the Divisional Forest Officer shall not be required and that for this purpose a simple information to the Forest Guard concerned within a fortnight of felling shall do.

2. The collection or removal of grass for any purpose provided that the Divisional Forest Officer, Gurgaon Forest Division, may permit:

(a) The cutting or sale of ripe grass after the rainy season, and

(b) The cutting or sale of green grass during the rainy seasons from such portions of the notified area in which grass may have sufficiently established itself.

3. The pasturing of any cattle other than goat, sheep and camels:

Provided that in such area where the forest crop is well established and in cases of emergency such as abnormal drought or floods, the Divisional Forest Officer, Gurgaon Forest Division may throw such area for grazing of the cattle of the land-owners on such conditions as may be appropriate in each case.
