THE HARYANA POLICE (AMENDMENT) BILL,2018 A BILL Further to amend the Haryana police Act, 2007.
Be it enacted by the Legislature of the State of Haryana in the Sixty-ninth year of theRepublio of India as follows:- l. (2) The Director General ofPolice so appointed shall have a tenure ofnot less than one year extendable up to one more year irrespective ofhis date ofsuperannuation:
Provided that the Director General of Police may be relieved of his responsibilities from the post before the.expiry of his tenure by the State Govemrnent in consultation with the State Security Conrmission. consequent upon:
(a) conviction by a court of law in a criminal offence or where charges have been framed by a court in a case involving corruption or moral turpitudi; or
(b) punishment of dismissal, removal or compulsory retirement tiom service or of reduction to a lower post, awardetl under the p.ouirionr of the All India Services (Discipline and Appeal) Rules, 1969 or any other relevant rule; or
(c) incapacitation by physical or mental illness or otherwise unable to discharge his functions as the Director General of police; or
(d) promotion to a higher post under either in the State or the Central Govemment.,,.
4' For section 26 of the principal Act, the following section shall be substituted, namely:- "26. composition of State security Commission.- (l) The State Security Commission shall consist of the following members, namely:-
(a) the Chief Minister as its Chairperson;
(b) the Home Minister as Vice_Chairperson;
(c) the Leader of the Opposition in the State Assembly;
(d) a retired High Cour-t Judge;
(e) the Advocate General, Haryana;
(0 the ChiefSecretary;
(g) the Administrative Secretary In-charge of the Home Department;
(h) the Director General of poiice as its Member_Secretary; and
(i) two non-political persons (hereinafter referred as independent members) of high integrity, expertise and competence in admi,istration, raw enforcement and security related matters to be nominated by the State Govemment. one member shall be a retired officer of Indian Adrninistrative Seruice. The second member shall be nominated by the State Governrnent fiom the field of public service, legal profession or social organizations with at least fifteen years .^p..i.n." in that field.
Note.- The independent rrrcrnbers shall be honorary mcmbers.
(2) In the case of prenrature removal of Director General of police, Administrative Secretary, Horne shall act as the Member-secretary of the Comn.rission and Director General of Police shall not be Member of the Commission.
(3) No Sen'ing Government employee shall be appointed as an independent member.
q) Any vacancy.in the State Security Commission shall be filled up as soon as practicable aftcr the seat has fallen vacant:
Provided that the Chief Minister may nominate any other Minister as the Vice- Chairperson in the event of his being the Horne Minister also.i.
' For section 34 of the principal Act, the following section shall be substituted, namely:- "34' Police Establishr-nent Committee.- (1) The State Government shall constitute aPolice Establishment clomrnittee which shall .oniirt of the following police officers, at the headquarter, namely:-
(a) the Director General of police
(b) the Head of State Intelligence Wing
(c) the Head of the Adrninistration Wing

(2) The Police Establishment Committee shall decide with regard to hansfer and posting of police officers of the rank of Inspectors and make recommendition on posting/t.urrf"., o-f officers ofrank ofDeputy Superintendent ofpolice and Superintendent ofpolice.
I:l The transfer and posting ofsubordinate ranks within a police range shall be decided by the Inspector General ofPolice ofthe range.
lql The postings and transfer ofofficers ofsubordinate ranks within a police districts shall be decided by the Superintendent ofpolice ofthe district.
(5) The Police Establishment Committee may prepare an action plan for improving the infrastructure facilities, professionalism, general aisciptioe in the service, modemization, training, welfare of the police personnel and any other work assigned by the State Govemment.".

In ordcr to bring the provision of State Police Board of the Act within the spirit of the above mention directions,the State Police Board is required to be substihrted with State Security commission. There is no procedure for selection.1' Director Gcneral of Police..
