PANCHKULA METROPOLITAN DEVELOPMENT AUTHORITY RE : Approval of Minutes of 1" Meeting of the Pradhikaran (PMDA), held on on 20.07.2022 at 5.00pm
1. It is submitted that the First Meeting of the PMDA Pradhikaran was held on 20.07.2022 in CM Camp house, Chandigarh.
2 Based on the proceedings held during the meeting, minutes of meeting have been prepared which are appended below for perusal and approval.
PROCEEDINGS OF THE 1ST MEETING OF THE PANCHKULA METROPOLITAN DEVELOPMET AUTHORITY HELD ON 20.07.2022 AT 05.00PM AT CM RESIDENCE-CUM-CAMP HOUSE, CHANDIGARH The Chairman welcomed the Members to the first meeting of the PMDA . With the permission of the Chair, Chief Executive Officer (CEO) initiated the proceedings of the meeting.
1. AGENDA ITEM NO. 1(1), PMDA : ESTABLISHMENT OF PMDA The CEO, PMDA informed that the notification of PMDA Act has been published on 18th August, 2021. Further informed that a notification under Section-4, establishing PMDA Authority has also been published in gazette on 08 Mar, 2022.
The information given was noted by the Authority.
2. AGENDA ITEM NO. 1 (2), PMDA : Notifications issued by the Government
1. Notification of the Area of the PMDA Authority .
The CEO informed that according to the provisions of Section-3, sub-section- 1, the government has notified the area falling under the jurisdiction of PMDA vide notification dated 08 Mar, 2022. () The authority noted the above information.
2. Notification dated regarding the coming into effect the provisions of Section 15 of the PMDA Act, 2021.
The CEO informed the house that a notification dated 11.10.2021 has been issued by the Town and country Planning Department giving effect to the provisions of the PMDA Act, 2021 under Section-15 It was noted by the members that the application of the provisions cannot be from the retrospective effect as the notification was issued on 11.10.2021 while the section 15 is said to have come into force on 09.09.2021.
Accordingly, it was directed that the revised notification in this regard would be issued by the Town and country Planning Department looking various aspects of the PMDA Act, 2021. (Draft amendment is placed at Annexure-C) PANCHKULA METROPOLITAN DEVELO PMENT AUTHORITY
3. Notification giving effect to the prov isions under Section 2 to 14, 16, 22, 28-47 and 49 to 60. Mar~c| The CEO Informed to the house that a notlh cn!éfl dated 08 Mar, 2022 has been issued by the TCP Department date d 08 , 2022 giving effect to the provisions of Act under Section 2to 14 , 16, 22, 28 to 47 and 49 to 60 of the Act The above information was noted dm by th e authority.
4. Notification for Ex-officio Members The CEO informed the authority that the government has app roved six exofficio members of the authority under Sec tion-5, (I). The notification in this regard would be placed on the website of the PMDA.

3. AGENDA ITEM NO. 1(3), PMDA : Regulations to be issued by th e PMDA under Section-58 The CEO, PMDA informed the house that a total of six regulations out of 10 provided under Section 58 of the PMDA Act, 2021 have been drafted. These are :
(1) Regulations on Temporary staff (2) Regulations on the appointment of experts (3) Regulation on appointment of Coordination and Standing committee
(4) Regulations on Declaration by the CEO, officers of the Authority and members of the Resident Advisory Council (5) Regulation on the declaration by the members of the committee and the standing committee (6) Regulations on the Investment of the funds.
It was also informed tgAlfe-heuse by the CEO, PMDA that the core and crucial posts would be filled through deputation/re-employment.
The Authority approved the regulations.
4. AGENDA ITEM NO. 1(4), PMDA : Approval of Resource mobilization for PMDA
(a) Seed money e’ 10 cyoves The CEO informed the house that a total of Rs 20 crores (+8-ereres as initial fund and Rs 10 crores under ‘Mangal Nagar Vikas Yojana’) has been already credited in the account of the PMDA as on 23.05.2022.

(b) Transfer of EDC charges from Town and Country Planning to PMDA The CEO informed the authority that under Section 42(l) of PMDA Act, 2021 PMDA shall be eligible to receive the proportionate development charges for external development work and paid or payable by the owner granted a license under the Act.
The authority approved the sharing of such charges with HSVP.

(c) CLU Charges The CEO, informed the authority that Section A2(4) of PMDA Act, 2071 provides that the Authority shall recelve the conversion charge payable under sub-sections (1) and (1A) of sectlon 7 of the Haryana Scheduled Road and Controlled Areas Restriction of Unregulated Development Act, 1963 (Punjab Act 41 of 1963) The Authority confirmed the transfer of these charges,
(d) Stamp Duty Fee The CEO informed the Authority that Section 42 (5) of PMDA Act, 2021 provides that the PMDA shall have the power to levy a duty on the transfer of immovable properties situated within the limits of the notified area in addition to the duty imposed under the Indian Stamp Act, 1899 (Central Act 2 of 1899) Proposal for 1% out of 2% of stamp duty collected by Municipal Corporation, Panchkula was put forward by CEO, PMDA emphasizing that the GMDA and FMDA has also been sanctioned this share, The Authority confirmed the levy of stamp duty fee,
(e) Cess from RTA The CEO informed the authority that Section 42 (7) of PMDA Act, 2021 provides that the Authority may levy, with the prior approval of the State Government, a charge, at such rates as may be notificd, on any category of motor vehicles in the notified area, This proposal was deferred by the authority,
(f) Additional Cess as per infrastructure Development Work or Urban Amenity The CEO informed the Au{humy that Section 44 (1) of PMDA Act, 2021 provides that the PMDA shall be cligible to collect the user charge of js services under the Act, The schedule of such charges and fee. s would be prepared by the PMDA, This issue was also deferred by the authority,
5. AGENDA ITEM NO, 1(5), PMDA : Office of the PMDA The members of the Authority were informed by the CEO about the status of the office building stating that the office would be operational in the renovated ‘Youth hostel’ building which is owned by the Hsyp, The authority noted #A0N this information, ‘{ PANCHKULA METROPOLITAN DEVELOPMENT AUTHOR
6. AGENDA ITEM NO. 1(6), PMDA : IT Initiatives The members of the Authority were informed by the CEQ about the working of the website, implementation of the ERP and that the PMDA would be pa in providing the services to its citizens and services would be onlin e and deemed clearance basis.

7. AGENDA ITEM NO. 1(7), PMDA : Construction of Education Kecrea!ion {;ntre at Chandimandir (Lake, Coffee House, Rest House etc.)
The Authority decided that this CM Announcement be transferred to Municipal Corporation, Panchkula.
m 8. ANY OTHER AGENDA ITEM WITH THE PERMISSION OF THE CHAIR.
oS General discussion held on provisioning of City Bus Service to be run by PMDA.
TheAuthority was of the view that the concept should be on the basis of Tricity’ Other stake holders could be RTA ar\dlcr(he Municipal Corporation of Panchkula.
It was decided that the Transport Department shall take care of the City Bus Service in the Tricity.
The meeting ended with a vote of thanks to the Chair.
