HARYANA GOVERNMENT HEALTH DEPARTMENT Notification The 8th January, 975 No. G.S.R.2/P.A.,6/65/S.53/75.—In cxercise of the powets conferred by section 53 of the Punjab Homoeopathic practitioners Act, 965, and with reference to Haryana Government, Health Department, notisication No. G.S.R.42/P.A..6/65/S.53/72, dated the 8th Fcbruary, 972, and all other powers enabhfng him in this behalf, the Governor 0r Har_vzna’li hereby makes the following rules for the registration of Homocopathic practitioners, namely :— '
7. These rules may be called the Haryana Homoepathic Practitioners (General )Rules, 975.
2. In these rules, unless the context otherwise requires:— ) Definition
(a) “lAgcst’s’ means the Punjab Homoepathic Practitioners Act, ; , Shert title
(b) “Chairman” means the Chairman of the Council;
(¢) “Council” means the Council of Homocopathic ' System of . Medicine, Haryana, established ~ and constituted -under section 3 of the Act;
(d) “Committee” means a committee appointed by the Council;
(¢) “Form” means the Form appended to these rules; ‘
(f) “ _Government” means the Government ofthe State of Haryana;
(6] “Homocopatic System” ‘means the Homoeopathic System of Medicine founded by Dr Hahnemann, and includes the allied System 0: Bio-chemistry founded by Dr. Schussler the expressions Homoeopathic and . Bio-Chemic shall be construed accordingly ;

30 The Registrar shall be a Law Graduate having नि experience of two years as Registrar in Homocopathic Councll#mw_ncl sufficient knowledge of Hindi. Preserence Will be flr_glven _to a qualifie Homocopath. He shall be whole-time salaried ~officer i the grade of Rs. 350—25—500/30—650 and he shall reccive such allowance as may be admissible to a Government servant of similar scale under the Government ; -
Provided that the Council may with the previous approval of the Government, appoint any person who fulfils the above qualifications - 85 part-time Registrar and the person so appointed may be paid such remuneration as the Government may fix.
(2) No person shall be appointed as Registrar if he is more than 40 years old at thetime of the appointment.
(3) The Registrar shall be appainted by the Council and shall be on probation ior one year, atfet which he will be confirmed by the Council if inits opinion his work and conduct has been satisfactory.
The probationary period may, however, be furthet extended by one year, if considered necessary by the Council. He shall also 0८ governed by “the provisions of the Punjab Civil Services Rules on the matters fot provided in these rules ;
Provided that the confirmation against the post of Registrar shall be made with the previous approval of the Government.
(4) The Registrar shall periorm all the duties that may be imposed on him by the Act and therules made thereunder and regulations made by the Council. .
5) The Registrar shall be present at every mecting of the Council ( and shall record minutes of the proceedings at such meetings.
(6) The Registrar shall conduct- and have charge of the'correspondence of the Council and shall issue all requisite notices in the manner laid down in these rules.
(7)_Public holidays and office hours to be observed by the office of the Registrar shall be suchas observed by Haryana Government from time to time. The Registrar shall not absent himself from duty without the permission of the Chairman .
(8) The Registrar shall be inchrage of the offic. of the Council and shall exercise powers of supervision, direction and control over it.

Every person cntitled to have his name entered in Part-A of the Repister under sub-section (I) of section I6 or in part B of the Register under sub-section (2) of the aforesaid section, shall, if किट हि desirous of having his name entered in Part-A or Part-B of (he Register as the case may be make an application to the Registrar, in Form ‘B’ alongwith a fee of Rs. 45 and Rs. 3 for issuing Registration Certificate and Rs. 2 as postage expenditure, i, total Rs. 50 only. Heshall also furnish alongith his application, such documents or certificates as may be necessary (0 establish his claim for being registered in Part-A ot Patt-B of the Register, 85 the case may 06, .
(2) The applicants desirous of his name being entered in' Part-B of the Register shall furnish a certificate as given in the application in form- B. :
(3) The Registrar may, after examining the applicaticn, require_the applicant (0 furnish such other information \vs dovuments and I[within such reasonable time during which such information or documents can be obtained and filed]. .
(4). Ifthe Registrar, onreceipt of the application under sub-rule (7) or on receipt of further -information or. documents required from the applicant under sub-rule (3) and after making such further enquiry as he may deem proper, is satisfied that the applicant_entitled to get his name entered in Part-A or Part-B of the Register as the 0856 may be, he may issue to the applicant a registration certificate in Form C 2[immediate- Iy] if he is not so satisfied, he shall ¥[after recording reasons in writing reject the application] ;
~ Provided that no order rejecting any application shall be passed without giving the applicant an opportunity of being heard.
_ (5) 4[Every registered practitioner shall get his registration rencwed within one month of the expiry of the period of registration after every five Years on payment of a fee of fifty rupecs].

Ifa Registration Certificate is lest, destroyed or mutilated, the Registrar shall on being satisficd about the sam, issuc a duplicate Registration Cerlificate onthe application of the Practitionzr whose certificate has becn lost, destroyed or mutilated was issued. A fec of Rs. [0 shall be charged from the registeted practitioner for the issuc of duplicate certificate.

(6) Where witness fs produced by a party before the Council, he shall first beexamined by party producing him and then cross examined by the adverse party and then re-oxamined {f allowed by the Council by the party producing him. (c) If the majority of the members present (including the Chairman who shall have a casting vote in case of of the votes) vote in the affirmative the Council shall 'ordor the removal of the name of the pragtitioner. :
(7) The Registrar shall, upon the removal of name from the Register pursuant to the provision of the preceding rules forthwith send notice such removal to the rogistered practitioner. Such notice shall be scnt by registeraa lotter addrossed to the last known address or to the registered addross -of practitioner. The Registrar, shall’ also send forthwith intimatfon of any such - removal to the Dean or Secretary or other corresponding . officer of the institution from which the practitfoner has received the qualification(s). .

9.(l) Any practitioner, whose name is removed from the Register by tho Rogistrar undor sub-section (5) of Scction 5 or by the Council under sub-section(5) of Ssction 6 and who is desfrous of geiting bis name re-ontercd shall make an application in Ferm-H addressed to the Chairman. .

The dec ision of the Council shall also 96 intimated to the aggrieved person.
I6. The Register shdll be maintained ir Form-A and shall be divided | in the following two parts— . :
