(EXTRA.), SEPT. 5, 2018 (BHDR. 14, 1940 SAKA) HARYANA GOVERNMENT SPORTS AND YOUTH AFFAIRS DEPARTMENT Notification The 5th September, 2018 No. 4/40/2017-4SYA.— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules for recruitment and conditions of service of outstanding sportspersons in various services of the Government, namely:- Short title, commencement and application.
1. (1) These Rules may be called the Haryana Outstanding Sportspersons (Recruitment and Conditions of Service) Rules, 2018.
(2) They shall come into force from the date of their publication in the Official Gazette.
(3) They shall apply to all Departments, Boards, Corporations, Authorities, Commissions, Agencies, Universities and Tribunals substantially funded by the Government or under the control of the Government.
Definitions. 2. In these rules, unless the context otherwise requires,-
(a) “Department” means the Sports and Youth Affairs Department, Haryana;
(b) “Form” means a form appended to these rules;
(c) “Government” means the Government of the State of Haryana;
(d) “National Sports Federation” means a registered national level sports body, known as a Federation or in any other name, duly recognized by the Ministry of Youth Affairs and Sports, Government of India;
(e) “Schedule” means a Schedule appended to these rules;
(f) “State” means the State of Haryana.
Sports disciplines to be considered.
3. (1) Sports disciplines to be considered for appointment in the case of World Championship, Asian Championship, Commonwealth Championship and World University Games shall be as provided under sub-rules (2) and (3).
(2) Sports disciplines included in Olympic Games only shall be considered for appointment under category numbers 2, 5A, 6A or 7A of either Schedule-I or Schedule-II.
(3) Sports disciplines not included in Olympic Games, but included in either Asian Games or Commonwealth Games, shall be considered for appointment under category numbers 5B, 6B or 7B of either Schedule-I or Schedule-II.
Method of recruitment.
4. (1) Notwithstanding anything contained in any other rule, policy or instruction for the time being in force, an outstanding sportsperson shall be eligible to be appointed to a post strictly as per Schedule-I in case of an individual event or Schedule-II in case of a team event, whichever is applicable:
Provided that an outstanding sportsperson shall be considered for appointment under these rules even if the relevant medal winning performance or participation, as the case may be, was recorded prior to the commencement of these rules.
(2) A member of a team consisting of upto four players shall be considered under Schedule-I. The Schedule-II shall apply for a member of a team consisting of five or more players.
(3) For consideration under Schedule-II, the outstanding sportsperson must have played in not less than fifty percent of the games played by the team in that tournament.
(4) For consideration of appointment under these rules, only sports events at senior level shall be considered.
Reservation. 5. Appointments under these rules shall be made against the vacancies reserved for sportspersons. For Para, Blind, Deaf and Special Olympic Sports, the appointments shall be made against vacancies reserved for Persons with Disabilities.
Explanation.— The Government may at its discretion create special posts for sportspersons so that the lack of vacancies under the sports quota is not an impediment to the appointments under these Rules.

6. (1) The outstanding sportsperson must be a citizen of India.
(2) The outstanding sportsperson must have either played for the State at the national level or be a domicile/resident of the State.
(3) A sportsperson who has represented any other State or Union Territory at the national level shall not be eligible for appointment under these rules.
(4) The age of the sportsperson shall not be less than the minimum age specified for appointment to the post and not above fifty years on the date of receipt of valid application.
Eligibility criteria.
7. (1) A sportsperson shall be ineligible for appointment under these rules in case he has any subsisting contract for pecuniary gains like commercial endorsement or professional sport:
Provided that playing for India or State or National Sports Federation shall not be professional sport.
(2) A sportsperson shall be ineligible for appointment under these rules if he is guilty of sports related misconduct like doping, sexual harassment and abuse, competitive manipulation like betting, inside information, match fixing, tanking threatening the integrity and essence of sports.
(3) In case a person appointed under these rules is found guilty of any such sports related misconduct at any time subsequent to his appointment, his service shall be terminated immediately.
Ineligibility.
8. (1) Essential qualifications or experience prescribed for the post in the service rules of the appointing Department, other than qualification of a technical or professional nature like law, medicine, engineering, architecture etc., shall not be applicable at the time of the initial appointment. The appointee shall, however, be required to obtain such essential qualification(s) and complete such specific course(s) or training(s) within the probation period, which is considered essential by the appointing Department to discharge the responsibilities meant for the job.
(2) An outstanding sportsperson so appointed shall be required to pass all prescribed tests at par with other categories of appointees before confirmation in service.
Qualification.
9. (1) An eligible sportsperson shall submit an application in Form-I for individual event and in Form-II in case of team event along with proof of outstanding sports achievement, date of birth, eligibility etc. and forwarded by the National Sports Federation recognized, duly signed by the President or Secretary General of the National Sports Federation, to the Department.
(2) The Department shall recommend to the office of Chief Secretary, the appropriate category of job after verification of original documents within thirty days of the receipt of application from the sportsperson. The Chief Secretary shall forward the application to the concerned Department where vacancy is available for appointment of the sportsperson.
(3) The initial appointments whether in Haryana Civil Service, Haryana Police Service or any other Group A, B or C posts shall be made with the word “Sports” in parenthesis that shall be dropped only upon obtaining the essential qualification which may be prescribed by the appointing Department as per sub-rule (1) of rule 8.
(4) Unless the word “Sports” is dropped from the order of appointment as per the provisions of sub-rule (3), all postings shall be within a separate sports cadre for promoting sports, carrying such prospects of career progression as may be specified by the Department.
(5) In case an appointee is unable to complete the prescribed course and training successfully, the probation period shall automatically be deemed to have been extended.
Procedure for appointment.
10. The Department may at any time utilize the services of such appointees for promoting sports.
Discretionary power of Department.
11. (1) Notwithstanding anything inconsistent contained in any service rules framed under the proviso to article 309 of the Constitution of India, the provisions of these rules shall prevail.
(2) The policy issued vide notification No. Sports-Estt-DA-I-2014/23501-23555, dated the 15th July, 2014 is hereby rescinded:
Provided that a sportsperson whose application is pending under the said policy on the date of notification of these Rules shall be eligible to apply under these rules and his previous application shall not be considered.
Overriding effect.
